<official-title>To amend title 46, United States Code, and title II of the Social Security Act to provide benefits to certain individuals who served in the United States merchant marine (including the Army Transport Service and the Naval Transport Service) during World War II.</official-title>

<section id="HFE9865C6C2D34C6FA19EC5CF619D0077" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Belated Thank You to the Merchant Mariners of World War II Act of 2005</short-title></quote>. </text></section> 
<section id="HDB5997DC8AC445DEA7AD31DCC0680128"><enum>2.</enum><header>Monthly benefit for World War II merchant mariners and survivors under title 46, United States Code</header> 
<subsection id="HE1073C9BE84B4F9CA74C89F918299FD0"><enum>(a)</enum><header>Monthly benefit</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">Chapter 112</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H9F7FC54EDB7A47D28FE75BD89BCAEC28"><enum>(1)</enum><text>by inserting after the table of sections the following new subchapter heading: </text>

<subchapter id="H5B983546BC1B4CDF80564D3703FAFEDA"><enum>I</enum><header>Veterans’ burial and cemetery benefits</header></subchapter><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H11F6F280489D476080907E0071910259"><enum>(2)</enum><text>by adding at the end the following new subchapter:</text>

<subchapter id="HE5890FC1D19A41F5ACA27DDA4C60E8FF"><enum>II</enum><header>Monthly benefit</header> 
<section id="H476C0C7E4BF7458AAD819FE8A277D546"><enum>11205.</enum><header>Monthly benefit</header> 
<subsection id="H10177766F75D4579BFAE3914DE08C273"><enum>(a)</enum><header>Payment</header><text>The Secretary of Veterans Affairs shall pay to each person issued a certificate of honorable service pursuant to section 11207(b) of this title a monthly benefit of $1,000.</text></subsection> 
<subsection id="H658B7D4969F54CE881C6652DB85FD7C"><enum>(b)</enum><header>Surviving spouses</header><text></text> 
<paragraph id="HFFB3EDD7C3904E4681AB633436B1629B"><enum>(1)</enum><header>Payment to surviving spouses</header><text>The Secretary of Veterans Affairs shall pay to the surviving spouse of each person issued a certificate of honorable service pursuant to section 11207(b) of this title a monthly benefit of $1,000.</text></paragraph> 
<paragraph id="HC3E4B4B00FDD4A62A4D40058B62E51C"><enum>(2)</enum><header>Exclusion</header><text>No benefit shall be paid under paragraph (1) to a surviving spouse of a person issued a certificate of honorable service pursuant to section 11207(b) unless the surviving spouse was married to such person for no less than 1 year. </text></paragraph></subsection> 
<subsection id="H6C3E406E6EFC49298EB4CDD4B79AE75"><enum>(c)</enum><header>Exemption from taxation</header><text>Payments of benefits under this section are exempt from taxation as provided in <external-xref legal-doc="usc" parsable-cite="usc/38/5301">section 5301(a)</external-xref> of title 38.</text></subsection></section> 
<section id="H64128693F94A4A9100B8645EF46F6CEA"><enum>11206.</enum><header>Qualified service</header> <text display-inline="no-display-inline">For purposes of this subchapter, a person shall be considered to have engaged in qualified service if, between December 7, 1941, and December 31, 1946, the person—</text> 
<paragraph id="HE8F2739622E941FC916F5E66FD4BA4F"><enum>(1)</enum><text>was a member of the United States merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was—</text> 
<subparagraph id="HE64F03766DA44F8CB614122F79CA23B2"><enum>(A)</enum><text>operated by the War Shipping Administration or the Office of Defense Transportation (or an agent of such Administration or Office);</text></subparagraph> 
<subparagraph id="HB04EB1A38995421C8B5EE7390686EA"><enum>(B)</enum><text>operated in waters other than—</text> 
<clause id="H10C1551495354F22A4A164BE93612727"><enum>(i)</enum><text>inland waters;</text></clause> 
<clause id="H36912C54212B49B9B092B8EA6EFC53D2"><enum>(ii)</enum><text>the Great Lakes; and</text></clause> 
<clause id="HFE01027A97414F4B82AEE6D2F9786FB1"><enum>(iii)</enum><text>other lakes, bays, and harbors of the United States;</text></clause></subparagraph> 
<subparagraph id="HC98BFDDB3A654143BC05DA8DE9335D03"><enum>(C)</enum><text>under contract or charter to, or property of, the Government of the United States; and</text></subparagraph> 
<subparagraph id="HE67F8A3259CC4E3C97BBFEB6CADDB9B"><enum>(D)</enum><text>serving the Armed Forces; and</text></subparagraph></paragraph> 
<paragraph id="HF43FB1213DB34D52B206013FB00BD17"><enum>(2)</enum><text>while serving as described in paragraph (1), was licensed or otherwise documented for service as a crewmember of such a vessel by an officer or employee of the United States authorized to license or document the person for such service.</text></paragraph> </section> 
<section id="HEF3A16DBF9404CAB95DC89C71D4FFAA3"><enum>11207.</enum><header>Documentation of qualified service</header> 
<subsection id="HC1CBBE8C253C4F44BFF4B8E4081E92C"><enum>(a)</enum><header>Application for service certificate</header><text>A person seeking benefits under section 11205 of this title shall submit an application for a service certificate to the Secretary of Transportation, or in the case of personnel of the Army Transport Service or the Naval Transport Service, the Secretary of Defense.</text></subsection> 
<subsection id="HAD3B6FD615BA463982E332FB63A5EEE"><enum>(b)</enum><header>Issuance of service certificate</header><text>The Secretary who receives an application under subsection (a) shall issue a certificate of honorable service to the applicant if, as determined by that Secretary, the person engaged in qualified service under section 11206 of this title and meets the standards referred to in subsection (d) of this section.</text></subsection> 
<subsection id="H2148F4ACD3A4455D9BA7BC4FB58D3097"><enum>(c)</enum><header>Timing of documentation</header><text>A Secretary receiving an application under subsection (a) shall act on the application not later than 1 year after the date of that receipt.</text></subsection> 
<subsection id="H2AAF301E77554AB399AFE93DD0B4C70"><enum>(d)</enum><header>Standards relating to service</header><text>In making a determination under subsection (b), the Secretary acting on the application shall apply the same standards relating to the nature and duration of service that apply to the issuance of honorable discharges under section 401(a)(1)(B) of the GI Bill Improvement Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/38/106">38 U.S.C. 106</external-xref> note).</text></subsection></section> 
<section id="H8ED24E1E855E42D9BB21737223491EAC"><enum>11208.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter, the term <term>surviving spouse</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, except that in applying the meaning in this subchapter, the term <term>veteran</term> shall include a person who performed qualified service as specified in section 11206 of this title.</text></section> 
<section id="H68D409B20C18438FBAEA3C00F523A462"><enum>11209.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary of Veterans Affairs such sums as may be necessary for the purpose of carrying out this subchapter.</text></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8B8630E4F4FA412B86FD37D28CC500E0"><enum>(b)</enum><header>Conforming amendments</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/46/11201">section 11201</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H6A46183CA6214FE6A777AB5CD0DA7E58"><enum>(1)</enum><text>in paragraph (1), by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>; and</text></paragraph> 
<paragraph id="H0874E5F5742A4FA78458ABE6DBB99D3"><enum>(2)</enum><text>in paragraph (2), by striking <quote>chapter</quote> the second place it appears and inserting <quote>subchapter</quote>. </text></paragraph></subsection> 
<subsection id="HF3DD7213AA8447F0A1DD2F70EB87FD7D"><enum>(c)</enum><header>Clerical amendments</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">chapter 112</external-xref> of title 46, United States Code, is amended—</text>

<subsection id="H3B44AD72095C4B049FC112B600E76E59"><enum>(d)</enum><header>Effective date</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">chapter 112</external-xref> of title 46, United States Code, as added by subsection (a) of this section, shall take effect with respect to payments for periods beginning on or after the date of the enactment of this Act, regardless of the date of application for benefits.</text></subsection></section> 
<section id="H19159F51B2A14627B032783725485B88"><enum>3.</enum><header>Benefits for World War II merchant mariners under title II of the Social Security Act</header> 
<subsection id="HD8234DB05E1E4040BB0048B986FCDFE6"><enum>(a)</enum><header>Benefits</header><text>Section 217(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/417">42 U.S.C. 417(d)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HDE272ED8B16B4D43A1C515E6DD5F76A8" display-inline="no-display-inline"> 
<paragraph id="H6F2F33E8D8884D459F333343B3DD0900"><enum>(3)</enum><text>The term <term>active military or naval service</term> includes the service, or any period of forcible detention or internment by an enemy government or hostile force as a result of action against a vessel described in subparagraph (A), of a person who—</text> 
<subparagraph id="HF13C812AAE094F50853C8533AD3E2868"><enum>(A)</enum><text>was a member of the United States merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was—</text> 
<clause id="HA6794677BC67457AA2CF3D3DF02CABD9"><enum>(i)</enum><text>operated by the War Shipping Administration or the Office of Defense Transportation (or an agent of such Administration or Office);</text></clause> 
<clause id="H04782120614149EBA956637CA79C1B95"><enum>(ii)</enum><text>operated in waters other than—</text> 
<subclause id="H14D996E1228A45ECA300611EF826BA16"><enum>(I)</enum><text>inland waters;</text></subclause> 
<subclause id="HA8C07E63AAD2466F8511B567F356AD3E"><enum>(II)</enum><text>the Great Lakes; and</text></subclause> 
<subclause id="HF28313E22C564E899F919CA9D155B6BF"><enum>(III)</enum><text>other lakes, bays, and harbors of the United States;</text></subclause></clause> 
<clause id="H9E748DF9E25D47F5A02E31A4D5A6E097"><enum>(iii)</enum><text>under contract or charter to, or property of, the Government of the United States; and</text></clause> 
<clause id="H0FE91411D6D94E738151010078BF3573"><enum>(iv)</enum><text>serving the Armed Forces; and</text></clause></subparagraph> 
<subparagraph id="H5C3CDFE62CCD4B50BA2FEC9FC1CECA3F"><enum>(B)</enum><text>while serving as described in subparagraph (A), was licensed or otherwise documented for service as a crewmember of such a vessel by an officer or employee of the United States authorized to license or document the person for such service.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3DD1796466824DD293CB664C9E03AEE0"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply only with respect to benefits for months beginning on or after the date of the enactment of this Act.</text></subsection></section>
