<official-title>To provide for the reduction of mercury in the environment.</official-title>

<section id="H3A905A61939944DFB6D0A26FF32050D9" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Communities and Safe Schools Mercury Reduction Act of 2005</short-title></quote>.</text></section> 
<section id="H37274A16E0F845E594D99038ABB3B378"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H6746AC3A05FB4507A3008005F0F703B4"><enum>(1)</enum><text>Mercury is a naturally occurring element and bioaccumulative toxin that is easily absorbed through skin and respiratory and gastrointestinal tissues.</text></paragraph> 
<paragraph id="H194473E4EE3E49BF93E300833773B5A8"><enum>(2)</enum><text>Although mercury is naturally occurring, studies have shown that its concentration has increased dramatically over the past 150 to 200 years due to mining and industrial activities.</text></paragraph> 
<paragraph id="HAFF8C215199D41F29CEC2D4181F673BB"><enum>(3)</enum><text>Common sources of mercury released into the environment include breakage of mercury-containing products like fluorescent bulbs and thermometers, the manufacturing of mercury-containing products, and incineration of mercury-containing products. </text></paragraph> 
<paragraph id="HB842E1BA57804530B94D01CAB25D2D62"><enum>(4)</enum><text>According to recent studies, mercury deposits are a significant public health threat in many States throughout the United States.</text></paragraph> 
<paragraph id="H84156151410E4DB4B827B0E0BED6EB03"><enum>(5)</enum><text>Fetuses, infants, and young children are at the greatest risk from chronic low level mercury exposure.</text></paragraph> 
<paragraph id="H142F0C9B51C34E5EBCB75C9510A94700"><enum>(6)</enum><text>A study by the Centers for Disease Control and Prevention found that approximately 8 percent of women of childbearing age in the United States had mercury levels exceeding the level considered safe by the Environmental Protection Agency for protecting the fetus. This translates into approximately 60,000 babies born each year in the United States at risk of developmental harm due to mercury exposure in the womb.</text></paragraph> 
<paragraph id="H28D6D1450B08493485A534D5CA1FAD4D"><enum>(7)</enum><text>A study published in the Journal of Obstetrics and Gynecology found that elevated mercury exposures associated with seafood could be linked to an increased risk of infertility in both men and women.</text></paragraph> 
<paragraph id="HD0654BD7336347819CCB00DE232B2FFE"><enum>(8)</enum><text>Mercury pollution is widespread. As of early 2003, 43 States had issued mercury fish consumption advisories for one or more freshwater or marine fish.</text></paragraph> 
<paragraph id="H119D782250864B26A6DABD128F1502A1"><enum>(9)</enum><text>Mercury is the most common pollutant triggering fish consumption advisories in the United States. The number of mercury advisories has increased 138 percent from 1994 to 2002. In 2002, mercury advisories covered 12,000,000 lake acres and 470,000 river miles.</text></paragraph> 
<paragraph id="HE109FCBF74B045A18B64473983DDE54F"><enum>(10)</enum><text>According to the Mercury Study Report, prepared by the Environmental Protection Agency and submitted to Congress in 1997, mercury fever thermometers contribute approximately 17 tons of mercury to solid waste each year.</text></paragraph> 
<paragraph id="H81D8CF6E39C7413F8864B2BF9C1E49D9"><enum>(11)</enum><text>Numerous mercury spills have been documented in schools, often causing thousands of dollars to clean up. A mercury spill in Washington, D.C., in September of 2003 cost over $1,000,000 to clean up and resulted in a temporary school closure of several weeks.</text></paragraph> 
<paragraph id="H9FCE1B5F6BEC40AC984339804EB38D1F"><enum>(12)</enum><text>Mercury-containing thermostats generally contain 3 grams of mercury, which is enough mercury to poison a 60 acre lake for one year.</text></paragraph> 
<paragraph id="HD7F6D30E1E9E40BD9101DD16DC583467"><enum>(13)</enum><text display-inline="yes-display-inline">Automobile scrapping is the fourth largest source of mercury pollution nationwide, behind waste incineration, coal-fired power plants, and commercial and industrial boilers. It is estimated that about 20,000 pounds of automotive mercury are released each year in the United States.</text></paragraph></section> 
<section id="H2E5381E20FC94DFA9D7F67BB64FC491D"><enum>3.</enum><header>Grant program</header> 
<subsection id="HFB265068A6274FBCAF342D5FD6DBF962"><enum>(a)</enum><header>Establishment</header><text>The Administrator of the Environmental Protection Agency (in this Act referred to as the <quote>Administrator</quote>) shall establish a program for making renewable grants to governmental and nonprofit agencies and organizations, and to for-profit entities, for projects to—</text> 
<paragraph id="H4DEB67FED8794801B86D752E2E778100"><enum>(1)</enum><text>reduce harmful free-flowing elemental mercury and mercury-added products from the environment;</text></paragraph> 
<paragraph id="H80F46978E8884FCDA9583C28A86F9BFF"><enum>(2)</enum><text>safely dispose of or recycle harmful mercury; </text></paragraph> 
<paragraph id="H966A7E02C4844E3D9C37EF5B00E2B5EE"><enum>(3)</enum><text>educate communities and citizens about the harmful effects of mercury; </text></paragraph> 
<paragraph id="HA8214EC7CBF24415B9B8E3394B6F9D28"><enum>(4)</enum><text>develop and carry out a plan, in accordance with guidance provided by the Administrator under section 5, on how to eliminate free flowing mercury and instruments containing mercury from the premises of K–12 public and private schools;</text></paragraph> 
<paragraph id="H683D3BC79E2943CD82F5EC21FEB16389"><enum>(5)</enum><text>carry out a mercury thermometer exchange program; or</text></paragraph> 
<paragraph id="H52553A26BAE44AD399DDA9C100CCEA1B"><enum>(6)</enum><text>facilitate the recovery and safe disposal and management of mercury-added components from automobiles.</text></paragraph></subsection> 
<subsection id="H334B35CB09514B0F9B429547A007385B"><enum>(b)</enum><header>Procedures and selection criteria</header><text>The Administrator shall establish procedures for the selection of grant recipients under this section, including requirements that appropriate records and information be made available to the Administrator as necessary to ensure that grant funds are used for the purposes for which they are provided. Criteria for selection shall include—</text> 
<paragraph id="H6C33B7D8E70D4C84AB3DEDBF47490000"><enum>(1)</enum><text>strengths and weaknesses of the project;</text></paragraph> 
<paragraph id="HC7134889F85A45618BD5ED59F86F92B9"><enum>(2)</enum><text>adequacy of overall project design;</text></paragraph> 
<paragraph id="HD32C88B88BB240A200BFB749D1A109C2"><enum>(3)</enum><text>competency of proposed staff;</text></paragraph> 
<paragraph id="H54E9A104C7B644978251BFD08C4B1CE7"><enum>(4)</enum><text>suitability of applicant’s available resources;</text></paragraph> 
<paragraph id="H10D5A3464AEE443D8B9CFC5D2896B720"><enum>(5)</enum><text>appropriateness of the proposed project duration and budget; and</text></paragraph> 
<paragraph id="H9FB4A13F238D4DCBBB2018287807418D"><enum>(6)</enum><text>probability that the project will accomplish stated objectives.</text></paragraph></subsection> 
<subsection id="H8A5F7E1C7DFF440293B69B27AC46DAB"><enum>(c)</enum><header>Recycling programs</header><text>Funds provided through a grant provided under this section may be used for a recycling program only if more than 50 percent of the total material recycled under the program is mercury.</text></subsection> 
<subsection id="HEF2A5313D8A14040921BFC4DCAB28C6"><enum>(d)</enum><header>Automobile components</header><text>The Administrator shall encourage States to develop programs that facilitate the recovery and safe disposal and management of mercury-added component parts from automobiles. These programs should target the removal of mercury-added components when they are being replaced or removed from scrapped vehicles.</text> </subsection> 
<subsection id="HB6094936EEAE40BE8E4283BF58EDBFA"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator for carrying out this section $75,000,000 for each of the fiscal years 2006 through 2009.</text> </subsection></section> 
<section id="HFB5A21D1FB8D49989766ED5F007917CA"><enum>4.</enum><header>Sale of thermometers; thermostat replacement and recycling</header> 
<subsection id="H61424D9FA64C43ADB3C6C6B3CE914F2"><enum>(a)</enum><header>In general</header><text>Subtitle C of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H10419C74091E40CBB5027095072828FB" style="OLC"> 
<section id="H65B61E72DC1D40948561C8A4CF61DADD"><enum>3024.</enum><header>Mercury</header> 
<subsection id="H65A821F81F4F4713A8CB62E0352E7276"><enum>(a)</enum><header>Sale of thermometers</header><text>Effective beginning 180 days after the date of enactment of this section—</text> 
<paragraph id="HCBC1B64C12944CF8942F968E95FBCC7"><enum>(1)</enum><text>a person shall not sell or supply a mercury fever thermometer to a consumer, except by prescription; and</text></paragraph> 
<paragraph id="H03E9B797C8D940A2ADEFDEF737B829B"><enum>(2)</enum><text>with each mercury fever thermometer sold or supplied by prescription, the manufacturer of the thermometer shall provide clear instructions on—</text> 
<subparagraph id="H34432C30257143A69FD4FFB96DA97FF"><enum>(A)</enum><text>careful handling of the thermometer to avoid breakage; and</text></subparagraph> 
<subparagraph id="H9E64131DD9444D7591B5C0CE54241FBA"><enum>(B)</enum><text>proper cleanup of the thermometer and its contents in the event of breakage.</text></subparagraph></paragraph></subsection> 
<subsection id="H9A6ED2A0DA184E55A5C2CEF47F14586B"><enum>(b)</enum><header>Thermostat replacement</header><text>Effective beginning 2 years after the date of enactment of this section—</text> 
<paragraph id="HA0086A621B2B47788878D716A2F0E91F"><enum>(1)</enum><text>a contractor who replaces a building thermostat in a residential or commercial building shall dispose of the replaced thermostat through a recycling program established or participated in under paragraph (2); and</text></paragraph> 
<paragraph id="HC54EF1455DFF41E19352EF922C08CA69"><enum>(2)</enum><text>each manufacturer of building thermostats for installation in a residential or commercial building shall—</text> 
<subparagraph id="H99BF0F945DB542B898DCCE00401032DD"><enum>(A)</enum><text>establish or participate in a program for the safe and environmentally responsible recycling of thermostats replaced by the manufacturer’s thermostats; and</text></subparagraph> 
<subparagraph id="H61F0A9BCD05E437A9970CF7004EB2146"><enum>(B)</enum><text>establish or participate in a program to clearly educate individuals who sell or install the manufacturer’s thermostats about the program established under subparagraph (A).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9A75F757151F4BB5A5ADF2F4783C239B"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1001 of the Solid Waste Disposal Act (42 U.S.C. prec. 6901) is amended by adding at the end of the items relating to subtitle C the following: </text> 
<quoted-block style="OLC" id="H53619DD27E0C476CB3F008B28FB0049" display-inline="no-display-inline"> 
<toc regeneration="no-regeneration"> 
<toc-entry level="section">Sec. 3024. Mercury</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HED3C5433F3C64CD99C7000E4125C8670"><enum>5.</enum><header>School premises guidance</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall publish guidance to assist State and local governments to remove elemental free-flowing mercury and mercury-added instruments from the premises of public and private schools. Thermostats, computers, and motorized vehicles shall not be considered instruments for the purposes of this section.</text></section> 
<section id="H79B6E955396D4A23A70101E300552F64"><enum>6.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator, after obtaining necessary information from appropriate State agencies, shall transmit to the Congress a report on the progress made under this Act. Such report shall include—</text> 
<paragraph id="H3E2EED4CB42B452BBC243456C7ED01C9"><enum>(1)</enum><text>an executive summary;</text></paragraph> 
<paragraph id="H94EC1A0B69A94857BDD9ED15F45B20E6"><enum>(2)</enum><text>a brief description of the background of this Act;</text></paragraph> 
<paragraph id="H34667EF45551464BA4EADA9ED03E330"><enum>(3)</enum><text>a State-by-State progress summary of mercury reduction efforts relating to this Act, including a quantitative analysis of the amount of mercury eliminated, recycled, or disposed of in each State, and an identification of the method or program responsible;</text></paragraph> 
<paragraph id="HB8D7B4FCC04740F19705E521D4AA54DA"><enum>(4)</enum><text>a description of grants and amounts awarded under section 3, and of the criteria used for awarding those grants;</text></paragraph> 
<paragraph id="H47F9683AC4254FD390D71B86C708C393"><enum>(5)</enum><text>a summary of a few selected mercury reduction programs that received grants, with a description of the success or problems each program had;</text></paragraph> 
<paragraph id="H114888E3D6C04EFA97F389297842C1CE"><enum>(6)</enum><text>a detailed financial reporting of total administration costs of carrying out this Act;</text></paragraph> 
<paragraph id="H1E3654A0572E47EE8F004900518D6061"><enum>(7)</enum><text>a joint summary, by the Administrator and appropriate State officials, that describes the coordination and communication progress and problems between the Federal and State Governments in carrying out this Act; and</text></paragraph> 
<paragraph id="HE654691193C549B4AD4997007E007D09"><enum>(8)</enum><text>recommendations for greater efficiency or improvement of administration of this Act.</text></paragraph></section> 
<section id="H5CA3275716904F92B05343C131AE604E"><enum>7.</enum><header>Mercury amalgam reduction</header> 
<subsection id="HE15FC7C270DA4BF28DC794A7059F56CE"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall issue guidelines that specify requirements for dentists to capture 90 percent or more of mercury-laden amalgam when administering amalgam to, or recovering amalgam from, their patients.</text></subsection> 
<subsection id="H7D4BE690D78B48F0B334AA16AF8585D7"><enum>(b)</enum><header>Considerations</header><text>The guidelines described in subsection (a) shall take into account—</text> 
<paragraph id="HB1205EF90A1345208FBC0771E700F51B"><enum>(1)</enum><text>Federal, State, and local mercury-laden amalgam programs in existence;</text></paragraph> 
<paragraph id="H98FE5772EBCB4340850597A53D73CCC"><enum>(2)</enum><text>current use of mercury-laden amalgam by dentists;</text></paragraph> 
<paragraph id="H3CCB929B9D6947FF8152F51C30EAB86D"><enum>(3)</enum><text>current waste management practices used by dental offices and their mercury-laden amalgam capture rates;</text></paragraph> 
<paragraph id="H377E975985C94230858611D9F6A6F68"><enum>(4)</enum><text>the number of technologies that capture mercury-laden amalgam, and their availability, capture rates, and affordability;</text></paragraph> 
<paragraph id="HA0F156FA3BDD4D7600889B25DE65F336"><enum>(5)</enum><text>the economic costs to dental offices in meeting the 90 percent capture requirements;</text></paragraph> 
<paragraph id="H49BD73D4ECC545BE94C3A6EDD800E9D"><enum>(6)</enum><text>structural designs of office buildings that may restrict technologies that can be used to capture mercury-laden amalgam;</text></paragraph> 
<paragraph id="H778F899C199C49A381926EFED87054EE"><enum>(7)</enum><text>implementing a process in which dental offices can request an exemption waiver from meeting these requirements;</text></paragraph> 
<paragraph id="H99599AE56BAE4FB48C6D7225BDF6D14"><enum>(8)</enum><text>geographic areas where the bioaccumulation of mercury-laden amalgam is more likely; and</text></paragraph> 
<paragraph id="HDBDE9AC033DE497CBFE533D035308E11"><enum>(9)</enum><text>lack of recycling or waste management programs or infrastructure that supports the safe removal and management of mercury-laden amalgam within reasonable proximities to dental offices.</text></paragraph></subsection></section>
