<section id="H4E5F6AE83DD04E2BB282BA0042E86451" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Common Sense Indian Gambling Reform Act</short-title></quote>. </text></section> 
<section id="H941E5B156B7242A6811B56D63FD7AB08"><enum>2.</enum><header>Background investigations and approval of financial interests</header> 
<subsection id="H59734DDFB6574D848BF500331F1F8569"><enum>(a)</enum><header>Background investigations</header> 
<paragraph id="H85B708731D0944EA86BCA702FFCE25DC"><enum>(1)</enum><header>Gaming investors</header><text>Section 7(b)(3) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2706">25 U.S.C. 2706(b)(3)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HAE9C7FD6E07C47D6B65867BF31FADD9" display-inline="no-display-inline"> 
<paragraph id="HBBC24868D92244EA891F2D5E5425DBA0"><enum>(3)</enum><text>shall conduct or cause to be conducted background investigations on the 10 persons or entities with the highest financial interest (such as loans, debt-based financing, financial backing for equipment or other startup or operation costs, and other financial interests as determined by the Commission) in a gaming operation regulated by the Commission and such other background investigations as may be necessary;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF24408A74BE84094997FF6789B38C79D"><enum>(2)</enum><header>Tribal gaming officials</header><text display-inline="yes-display-inline">Section 11(b)(2)(F)(i) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(b)(2)(F)(i)</external-xref>) is amended—</text> 
<subparagraph id="HDF8B7E44A6824A1888D008CFABBC5192"><enum>(A)</enum><text>by striking <quote>conducted on</quote> the first place it appears and inserting <quote>conducted by the Commission on tribal gaming commissioners, key tribal gaming commission employees, and</quote>; and </text></subparagraph> 
<subparagraph id="H9EAF9E67EEF7411D8F3653CA129E8C55"><enum>(B)</enum><text>by striking <quote>such officials and their management</quote> and inserting <quote>such individuals</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HCAD94FC634634A18904B56B4543F0054"><enum>(b)</enum><header>Approval of financial interests</header><text display-inline="yes-display-inline">Section 6 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2705">25 U.S.C. 2705</external-xref>) is amended—</text> 
<paragraph id="H65AC10EDFE734175B7984357AE7487FE"><enum>(1)</enum><text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="HA69EF9F85B28455D88A94F6F375B8618"><enum>(2)</enum><text>in paragraph (4), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HF54B7992AD6F4B2192CF7E57E4A1002E"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HE5FB64DEE08740D885E49E549DCCD220"><enum>(4)</enum><text display-inline="yes-display-inline">approve financial interests between the 10 persons or entities with the highest financial interest (such as loans, debt-based financing, financial backing for equipment or other startup or operation costs, and other financial interests as determined by the Commission) and a gaming operation regulated by the Commission.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H15E35C01C7D04B57BE0887D96800CAA5"><enum>(c)</enum><header>Commission funding</header><text display-inline="yes-display-inline">Section 18(a)(2)(B) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2717">25 U.S.C. 2717(a)(2)(B)</external-xref>) is amended by striking <quote>$8,000,000</quote> and inserting <quote>$16,000,000</quote>. </text> </subsection> </section> 
<section id="H1A50DF93C78C44C4BC267D4178F100B5" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Declaration of intent to game on trust lands</header> 
<subsection id="HBE4FD77BF899476F9B07BFCA9AC9615"><enum>(a)</enum><header>Class II gaming</header><text display-inline="yes-display-inline">Section 11(b)(1) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H25410922F6E046A8985456DECE6A336"><enum>(1) </enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HEAB3EB464BCC453C963E00BF6392F209"><enum>(2)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HE4DD8E4C603848EA85BF6F847931E027" display-inline="no-display-inline"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HACD0A32D1B5B449C9C78F6F707F9BB00"><enum>(C)</enum> 
<clause id="HB1E42D67615F430FAE026CF285FF0872" display-inline="yes-display-inline"><enum>(i)</enum><text>conducted on lands taken into trust before the date of the enactment of this subparagraph; or</text></clause> 
<clause id="H682A7CD868C245908DD1397FEA05BAE2" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">conducted on lands taken into trust after the date of the enactment of this subparagraph only if the application requesting that the land be taken into trust stated that the Indian tribe intended to conduct gaming activities on such land.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9AC2CB5C67FE409C8566D1C8EE32F102"><enum>(b)</enum><header>Class III gaming</header><text display-inline="yes-display-inline">Section 11(d)(1) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(d)(1)</external-xref>) is amended—</text> 
<paragraph id="H24C7C9941173472B8059AA00C910147B"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HA04EB50805AD43F781D6B87E795E1EB6"><enum>(2)</enum><text>in subparagraph (C), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H50E70218171B43F39C82C68B3E3056E3"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HA7D94495CDF04C1BAD36E9EBE440139D"><enum>(D)</enum> 
<clause id="H2F48DD3E265C4EC2A5F817619C179BE2" display-inline="yes-display-inline"><enum>(i)</enum><text>conducted on lands taken into trust before the date of the enactment of this subparagraph; or</text></clause> 
<clause id="H4AAA4F3B17924C92B439D78D6D477E97" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">conducted on lands taken into trust after the date of the enactment of this subparagraph only if the application requesting that the land be taken into trust stated that the Indian tribe intended to conduct gaming activities on such land.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H818A732EFC9E4C078BB77999786498FC"><enum>4.</enum><header>Clarification regarding conditions required for exception to gaming restrictions on certain land</header><text display-inline="no-display-inline"> Section 20(b)(1)(A) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2719">25 U.S.C. 2719(b)(1)(A)</external-xref>) is amended—</text> 
<paragraph id="H874E2ECB05A34B1D889420AE9357898F"><enum>(1)</enum><text>by striking <quote>appropriate State and local officials, including officials of other nearby Indian tribes</quote> and inserting <quote>officials of any State or local government or Indian tribe with jurisdiction over land located within 50 miles of the land proposed to be taken into trust</quote>; and</text></paragraph> 
<paragraph id="H57CC2EF5C0134B8A8EBF7B1F121300D2"><enum>(2)</enum><text>by striking <quote>and would not be detrimental to the surrounding community</quote> and inserting <quote>and, after conducting an economic impact study, determines that a gaming establishment on newly acquired lands would not have a negative economic impact on business, government, or Indian tribes within a 50 mile radius of the land proposed to be taken into trust or be otherwise detrimental to the community with such 50 mile radius</quote>.</text></paragraph></section> 
<section id="H6DBD309FC3FC4E19A37FF1FD4BAB096C"><enum>5.</enum><header>Approval of compacts by State</header><text display-inline="no-display-inline">Section 11(d) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(d)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H901B0401D2944CCFA721ABBBC6F40E" display-inline="no-display-inline"> 
<paragraph id="H655158EBBC1D4215B6A4FF57BE84469C"><enum>(10)</enum><text>For the purposes of State approval under this subsection, the term <term>State</term> shall mean the Governor of the State and the legislative body of the State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD963810075E24E75AFBFE0C9AE50831F"><enum>6.</enum><header>Restriction on gaming</header> 
<subsection id="H3D6B30CDF4224BBDAD96720026DF867"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 20 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2719">25 U.S.C. 2719</external-xref>) is amended—</text> 
<paragraph id="H814D120CF5A242E1B5D71B08F65BDF71"><enum>(1)</enum><text>by amending paragraph (1) of subsection (b) to read as follows:</text> 
<quoted-block id="HBE6D4864B6174AE981B0D19EF2ACF809" style="OLC"> 
<paragraph id="H1588CD5EDDB846589B5D65519E83B1E9" display-inline="yes-display-inline"></paragraph> 
<paragraph id="H41EC590B0C264F41999765325BEF88A0" display-inline="yes-display-inline"><enum>(1)</enum> 
<subparagraph id="H9D35620398C74A01997F98FA6969D266" display-inline="yes-display-inline"><enum>(A)</enum><text>Subsection (a) shall not apply to Indian land of an Indian tribe if each of the conditions in subparagraph (B) are satisfied and the Indian tribe—</text> 
<clause id="HFE67A50B648D4179AE83E6A400BA00E3" indent="up1"><enum>(i)</enum><text>was newly recognized after October 17, 1988 (including those newly recognized under the Federal Acknowledgement Process at the Bureau of Indian Affairs); </text></clause> 
<clause id="H7D88D9D4B61544B5B0AB846B87D9C133" indent="up1"><enum>(ii)</enum><text>was restored by legislation, court decree, or any other process after having been terminated by Federal law; or</text></clause> 
<clause id="H1F83D629FD6341CA8440666D5E00EA56" indent="up1"><enum>(iii)</enum><text>on the date of the enactment of subsection (e), had no lands held in trust by the United States for the benefit of the Indian tribe, no reservation, and no lands held by the Indian tribe subject to restriction by the United States against alienation over which the Indian tribe exercised governmental power.</text></clause></subparagraph> 
<subparagraph id="H858C27ADB52743B3A1482B89B935D21F" indent="up1"><enum>(B)</enum><text>The conditions referred to in subparagraph (A) are the following:</text> 
<clause id="HA4472A965E7B49ACB77638410255CFF2"><enum>(i)</enum><text>The Secretary determines that the lands acquired in trust for the benefit of the Indian tribe for the purposes of gaming are lands within the State where the Indian tribe has its primary geographic, social, and historical nexus to the land.</text></clause> 
<clause id="HDD860EC9E3AD4A6F0096400456D2269C"><enum>(ii)</enum><text>The Secretary determines that the proposed gaming activity is in the best interest of the Indian tribe, its tribal members, and would not be detrimental to the surrounding community.</text></clause> 
<clause id="H3F29DD4E51EB40978169D045AD907FB2"><enum>(iii)</enum><text>The State, city, county, town, parish, village, and other general purpose political subdivisions of the State with authority over land that is concurrent or contiguous to the lands acquired in trust for the benefit of the Indian tribe for the purposes of gaming approve.</text></clause> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H0C7DCB183C544C008C94F21729DE1E44"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="HBB6187133B4949839453D279516FDC6" style="OLC"> 
<subsection id="H2D35378FCC97491E8CD18E2056FFB79"><enum>(e)</enum><text>Notwithstanding any other provision of this Act, an Indian tribe may conduct gaming regulated by this Act on only one contiguous parcel of Indian lands. Such Indian lands must be located where that Indian tribe has its primary geographic, social, and historical nexus and within the State or States where the Indian tribe is primarily located.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBCD12EEEA7CF4A3B90864B9796210788"><enum>(b)</enum><header>Statutory construction</header><text>The amendments made by subsection (a) shall be applied prospectively. Compacts or other agreements that govern gaming regulated by the Indian Gaming Regulatory Act that were in effect on the date of the enactment of this Act shall not be affected by the amendments made by subsection (a).</text></subsection></section>
