<official-title>To amend title XVIII of the Social Security Act to provide for improvements in access to services in rural hospitals and critical access hospitals.</official-title>

<section id="H56D1A2C2AC9A40748725B84EE2F4B33D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title; Amendments to Social Security Act</header> 
<subsection id="HE2480445EA6C4915B17D9752840067DE"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Rural Community Hospital Assistance Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="H7940DE112FA746F084CC47F306932578"><enum>(b)</enum><header>Amendments to Social Security Act</header><text>Except as otherwise specifically provided, whenever in this Act an amendment is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered a reference to that section or other provision of the Social Security Act.</text></subsection></section> 
<section id="H6AE954E6114B476E95F4E6441B60451C"><enum>2.</enum><header>Establishment of rural community hospital (rch) program</header> 
<subsection id="HE6D1ED3B7F564F7FA0107B789D00E0C7"><enum>(a)</enum><header>In general</header><text>Section 1861 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end of the following new subsection:</text> 
<quoted-block act-name="" display-inline="no-display-inline" id="HA209C40FEA9841BA8D44A2007B6E4503" style="other" other-style="archaic"> 
<subsection id="H1F6C1E464E6A4F18A000BA9E6574DC89"><enum>(bbb)</enum><header>Rural community Hospital; Rural Community Hospital Services</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB821763DC23D4283003D37DB59DC42FA"><enum>(1)</enum><text>The term <term>rural community hospital</term> means a hospital (as defined in subsection (e)) that—</text> 
<subparagraph id="H7314EF90DAF3491B98F5E7BE07F957B" indent="up1"><enum>(A)</enum><text>is located in a rural area (as defined in section 1886(d)(2)(D)) or treated as being so located pursuant to section 1886(d)(8)(E);</text></subparagraph> 
<subparagraph id="H6092E980D95F4641A0B0FB01B697CFBE" indent="up1"><enum>(B)</enum><text>subject to paragraph (2), has less than 51 acute care inpatient beds, as reported in its most recent cost report;</text></subparagraph> 
<subparagraph id="H01A1330BEE0F4482BEE03CD5131F7E99" indent="up1"><enum>(C)</enum><text>makes available 24-hour emergency care services;</text></subparagraph> 
<subparagraph id="H818135E10C18485B9812E10B04B3D8E" indent="up1"><enum>(D)</enum><text>subject to paragraph (3), has a provider agreement in effect with the Secretary and is open to the public as of January 1, 2005; and</text></subparagraph> 
<subparagraph id="HF4379ED2D3A746E09DA1E963D31F4E41" indent="up1"><enum>(E)</enum><text>applies to the Secretary for such designation.</text></subparagraph></paragraph> 
<paragraph id="H47167DAE18A74E70855B90491BDD0031" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1)(B), beds in a psychiatric or rehabilitation unit of the hospital which is a distinct part of the hospital shall not be counted.</text></paragraph> 
<paragraph id="HEC6B00DE372D4ED190F5D480302B69C" indent="up1"><enum>(3)</enum><text>Subparagraph (1)(D) shall not be construed to prohibit any of the following from qualifying as a rural community hospital:</text> 
<subparagraph id="HAC45ED283B61453C8DA261846FA08CB9"><enum>(A)</enum><text>A replacement facility (as defined by the Secretary in regulations in effect on January 1, 2005) with the same service area (as defined by the Secretary in regulations in effect on such date).</text></subparagraph> 
<subparagraph id="HE4C2950846684A1CAFBFBB87EFA2E1D7"><enum>(B)</enum><text>A facility obtaining a new provider number pursuant to a change of ownership.</text></subparagraph> 
<subparagraph id="H4685EB30972D4EE6ADBA9CC555E79CE4"><enum>(C)</enum><text>A facility which has a binding written agreement with an outside, unrelated party for the construction, reconstruction, lease, rental, or financing of a building as of January 1, 2005.</text></subparagraph></paragraph> 
<paragraph id="H9931EAADD30A4E148C00E5CE7C1EFE27" indent="up1"><enum>(4)</enum><text>Nothing in this subsection shall be construed as prohibiting a critical access hospital from qualifying as a rural community hospital if the critical access hospital meets the conditions otherwise applicable to hospitals under subsection (e) and section 1866.</text></paragraph> 
<paragraph id="HD4C52854A0864354B5AF5EF8E4155BA4" indent="up1"><enum>(5)</enum><text>Nothing in this subsection shall be construed as prohibiting a rural community hospital participating in the demonstration program under Section 410A of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2313) from qualifying as a rural community hospital if the rural community hospital meets the conditions otherwise applicable to hospitals under subsection (e) and section 1866.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0579D5B8D9C548369578AB114C6ED853"><enum>(b)</enum><header>Payment</header> 
<paragraph id="H4DF0177D5BB7450D93FC5E827C4F4E20"><enum>(1)</enum><header>Inpatient hospital services</header><text>Section 1814 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block act-name="" display-inline="no-display-inline" id="H1E78D75622834697A8BA9491AA51B1" style="other" other-style="archaic"> 
<subsection id="HE62C7C42EF51463AA75D42ADCFF6EE93"><enum>(m)</enum><header>Payment for Inpatient Services Furnished in Rural Community Hospitals</header><text>The amount of payment under this part for inpatient hospital services furnished in a rural community hospital, other than such services furnished in a psychiatric or rehabilitation unit of the hospital which is a distinct part, is, at the election of the hospital in the application referred to in section 1861(bbb)(1)(E)—</text> 
<paragraph id="H8B76984431AD4177B88BA25632B5D562"><enum>(1)</enum><text>101 percent of the reasonable costs of providing such services, without regard to the amount of the customary or other charge, or</text></paragraph> 
<paragraph id="H072847E9D043410BB539D2F6AA2D9D47"><enum>(2)</enum><text>the amount of payment provided for under the prospective payment system for inpatient hospital services under section 1886(d).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC67786B4FC17466B9F48EE00396900C0"><enum>(2)</enum><header>Outpatient services</header><text>Section 1834 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H76CBE464512B4241B581D7A25CCA1345" style="OLC"> 
<subsection id="H6F76FBCBE8204E688CD287C856FF15F2"><enum>(n)</enum><header>Payment for outpatient services furnished in rural community hospitals</header><text>The amount of payment under this part for outpatient services furnished in a rural community hospital is, at the election of the hospital in the application referred to in section 1861(bbb)(1)(E)—</text> 
<paragraph id="H57D1B91ACB3549AC9EB8E69C252226A0"><enum>(1)</enum><text>101 percent of the reasonable costs of providing such services, without regard to the amount of the customary or other charge and any limitation under section 1861(v)(1)(U), or</text></paragraph> 
<paragraph id="H0DC14B2317CC40289ECCF05CC7633E6B"><enum>(2)</enum><text>the amount of payment provided for under the prospective payment system for covered OPD services under section 1833(t).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAE6583872CBC408F95CB420098E9C2B"><enum>(3)</enum><header>Home health services</header> 
<subparagraph id="H87759F67B604488F945514D4006F3BEE"><enum>(A)</enum><header>Exclusion from home health pps</header> 
<clause id="H2A7D265BB62A4A0B005D5BDD5DA30008"><enum>(i)</enum><header>In general</header><text>Section 1895 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395fff">42 U.S.C. 1395fff</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDB5D1FCE740848DCA8741DCC10066E4" style="OLC"> 
<subsection id="HA683C1875DCE466BBFF9B58C7126E1F"><enum>(f)</enum><header>Exclusion</header> 
<paragraph id="H5A0CB766BA504334AB88831D6F23FDBE"><enum>(1)</enum><header>In general</header><text>In determining payments under this title for home health services furnished on or after October 1, 2005, by a qualified RCH-based home health agency (as defined in paragraph (2))—</text> 
<subparagraph id="HF80FC0B93F6E4F4981C3246EB5E8A449"><enum>(A)</enum><text>the agency may make a one-time election to waive application of the prospective payment system established under this section to such services furnished by the agency; and</text></subparagraph> 
<subparagraph id="H919F95DF0F5D4F3CBA16C8DC48134643"><enum>(B)</enum><text>in the case of such an election, payment shall be made on the basis of 101 percent of the reasonable costs incurred in furnishing such services as determined under section 1861(v), but without regard to the amount of the customary or other charges with respect to such services or the limitations established under paragraph (1)(L) of such section.</text></subparagraph></paragraph> 
<paragraph id="H3C7A353381AF477BAF0513382488A9F"><enum>(2)</enum><header>Qualified rch-based home health agency defined</header><text>For purposes of paragraph (1), a ‘qualified RCH-based home health agency' is a home health agency that is a provider-based entity (as defined in section 404 of the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 (Appendix F, 114 Stat. 2763A–506), as enacted into law by section 1(a)(6) of <external-xref legal-doc="public-law" parsable-cite="pl/106/554">Public Law 106–554</external-xref>) of a rural community hospital that is located—</text> 
<subparagraph id="H7429EB1F81B14FC3BCBE39C203C8A63C"><enum>(A)</enum><text>in a county in which no main or branch office of another home health agency is located; or</text></subparagraph> 
<subparagraph id="H007683205D1B46288DC073523C3207"><enum>(B)</enum><text>at least 35 miles from any main or branch office of another home health agency.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause> 
<clause id="H0432F969592B46128DEEFEFCDE7245C"><enum>(ii)</enum><header>Conforming changes</header> 
<subclause id="H0F6182F3CF1C4BEBBCCF46CC51FCDB43"><enum>(I)</enum><header>Payment under part a</header><text>Section 1814(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(b)</external-xref>) is amended by inserting <quote>or with respect to services to which section 1895(f) applies</quote> after <quote>equipment</quote> in the matter preceding paragraph (1).</text></subclause> 
<subclause id="H808FE2AA22144571B2B3D3342DB7CA20"><enum>(II)</enum><header>Payments under part b</header><text>Section 1833(a)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(2)(A)</external-xref>) is amended by striking <quote>the prospective payment system under</quote>.</text></subclause> 
<subclause id="H3A1A1A2DF1374DEAA4490783193B9500"><enum>(III)</enum><header>Per visit limits</header><text>Section 1861(v)(1)(L)(i) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(v)(1)(L)(i)</external-xref>) is amended by inserting <quote>(other than by a qualified RCH-based home health agency (as defined in section 1895(f)(2))</quote> after <quote>with respect to services furnished by home health agencies</quote>.</text></subclause></clause> 
<clause id="H333B813B9181412FA6981B334E6791AD"><enum>(iii)</enum><header>Consolidated billing</header> 
<subclause id="H015ED21ECE1D4A6BA966527E929D4380"><enum>(I)</enum><header>Recipient of payment</header><text>Section 1842(b)(6)(F) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(6)(F)</external-xref>) is amended by inserting <quote>and excluding home health services to which section 1895(f) applies</quote> after <quote>provided for in such section</quote>.</text></subclause> 
<subclause id="HEDB1E6AA4C41480F9E87D70077364977"><enum>(II)</enum><header>Exception to exclusion from coverage</header><text>Section 1862(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)</external-xref>) is amended by inserting before the period at the end of the second sentence the following: “and paragraph (21) shall not apply to home health services to which section 1895(f) applies”.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H2D6A999BE6DD45D1A426C0344EC42627"><enum>(4)</enum><header>Exemption from 30-percent reduction in reimbursement for bad debt</header><text>Section 1861(v)(1)(T) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(v)(1)(T)</external-xref>) is amended by inserting <quote>(other than for a rural community hospital)</quote> after <quote>In determining such reasonable costs for hospitals</quote>.</text></paragraph></subsection> 
<subsection id="HA083B9B122CC4654BCB07108AF5328D4"><enum>(c)</enum><header>Beneficiary Cost-Sharing for outpatient services</header><text>Section 1834(n) (as added by subsection (b)(2)) is amended—</text> 
<paragraph id="HE1EAED712AD74F52AD97F5DD1BE6DA6E"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></paragraph> 
<paragraph id="HF64DF3C4059E41B1ADE568E1FCBAC1DC"><enum>(2)</enum><text>by inserting <quote>(1)</quote> after <quote>(n)</quote>; and</text></paragraph> 
<paragraph id="HD427DD38C04A4C81BBCB66DC191DB756"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H66CCCB3305F54D2794745403417D3614" style="OLC"> 
<paragraph id="H1D5B047D905145FE8DAF53B08320AE5C" indent="up1"><enum>(2)</enum><text>The amounts of beneficiary cost-sharing for outpatient services furnished in a rural community hospital under this part shall be as follows:</text> 
<subparagraph id="H891B23276EE44B5DB80745CEC435D3DE"><enum>(A)</enum><text>For items and services that would have been paid under section 1833(t) if provided by a hospital, the amount of cost-sharing determined under paragraph (8) of such section.</text></subparagraph> 
<subparagraph id="HD93F17AE51AE4B32B62F619C7C51C39B"><enum>(B)</enum><text>For items and services that would have been paid under section 1833(h) if furnished by a provider or supplier, no cost-sharing shall apply.</text></subparagraph> 
<subparagraph id="H454BFDB7EA9344ED95D8561D435745BC"><enum>(C)</enum><text>For all other items and services, the amount of cost-sharing that would apply to the item or service under the methodology that would be used to determine payment for such item or service if provided by a physician, provider, or supplier, as the case may be.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8BDAFBCE6E23485EB0F32E101697D3C5"><enum>(d)</enum><header>Conforming amendments</header> 
<paragraph id="HF383CA1E59C14A4AB52587596D117B13"><enum>(1)</enum><header>Part a payment</header><text>Section 1814(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(b)</external-xref>) is amended in the matter preceding paragraph (1) by inserting <quote>other than inpatient hospital services furnished by a rural community hospital,</quote> after <quote>critical access hospital services,</quote>.</text></paragraph> 
<paragraph id="H10F6C5B7F2B648FCB3585BDC05600FE"><enum>(2)</enum><header>Part b payment</header> 
<subparagraph id="H9B954472791D4F5FBBFE98D1ACF53E88"><enum>(A)</enum><header>In general</header><text>Section 1833(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)</external-xref>) is amended—</text> 
<clause id="H07756CF6918842359EFBD31F5540252E"><enum>(i)</enum><text>in paragraph (2), in the matter before subparagraph (A), by striking <quote>and (I)</quote> and inserting <quote>(I), and (K)</quote>;</text></clause> 
<clause id="H646DDDB6137741DFA1BD3EE7522230B6"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end of paragraph (8);</text></clause>

<subparagraph id="H4681A314A58E4E6A9D557118AD9FE1C3"><enum>(B)</enum><header>Ambulance services</header><text>Section 1834(l)(8) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)(8)</external-xref>) is amended—</text> 
<clause id="H1DB5098DDBB94626B97BAF02B3EA45"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">critical access hospitals</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">certain facilities</header-in-text></quote>;</text></clause> 
<clause id="H6E1A0B6750A54158B9D63DBFE8BD9B51"><enum>(ii)</enum><text>in the matter preceding subparagraph (A), by striking <quote>the reasonable costs</quote> and inserting <quote>101 percent of the reasonable costs</quote>;</text></clause> 
<clause id="HE6E2E2C5A62F4237A0DFE35082337EB1"><enum>(iii)</enum><text>by striking <quote>or</quote> at the end of subparagraph (A);</text></clause> 
<clause id="HEFB20E75ACAE45919E7C443C7112C7F9"><enum>(iv)</enum><text>by redesignating subparagraph (B) as subparagraph (C);</text></clause> 
<clause id="H0B66FCF920004571B198FBF1E79EB200"><enum>(v)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text>

<clause id="H446713353DA34217A404C7A31BD78772"><enum>(vi)</enum><text>in subparagraph (C), as so redesignated, by inserting <quote>or a rural community hospital</quote> after <quote>critical access hospital</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="H9D664CB6EAAA427198F3EBBCD104445C"><enum>(3)</enum><header>Technical amendments</header> 
<subparagraph id="H7D72376CC7E94BA4A438C8163000F766"><enum>(A)</enum><header>Consultation with state agencies</header><text>Section 1863 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395z">42 U.S.C. 1395z</external-xref>) is amended by striking <quote>and (dd)(2)</quote> and inserting <quote>(dd)(2), (mm)(1), and (bbb)(1)</quote>.</text></subparagraph> 
<subparagraph id="H70A804ED92C049CD92000045D0221300"><enum>(B)</enum><header>Provider agreements</header><text>Section 1866(a)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(2)(A)</external-xref>) is amended by inserting <quote>section 1834(n)(2),</quote> after <quote>section 1833(b),</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H686D708A20AD43C7A630D80126AE5166"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to items and services furnished on or after October 1, 2005.</text></subsection></section> 
<section id="H5664815119A94713AEDBD7BD768ECF93"><enum>3.</enum><header>Removing barriers to establishment of distinct part units by rch and cah facilities</header> 
<subsection id="H6191501A01304668B7C430B288F9A1B9"><enum>(a)</enum><header>In general</header><text>Section 1886(d)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395(d)(1)(B)</external-xref>) is amended by striking <quote>a distinct part of the hospital (as defined by the Secretary)</quote> in the matter following clause (v) and inserting <quote>a distinct part (as defined by the Secretary) of the hospital or of a critical access hospital or a rural community hospital</quote>.</text></subsection> 
<subsection id="HB5854EE1407B41648343B48222D8EBE2"><enum>(b)</enum><header>Revision of limits on authority for CAHs To establish psychiatric and rehabilitation distinct part units</header><text>Section 1820(c)(2)(E)(iv) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i–4(c)(2)(E)(iv)</external-xref>) is amended—</text> 
<paragraph id="H5CA6B68EC0324A139559765E2C10F155"><enum>(1)</enum><text>by striking <quote>If</quote> and inserting <quote>If the Secretary finds that</quote>;</text></paragraph> 
<paragraph id="H50CAEEB7B5BD44E3AD968826CB38B8EC"><enum>(2)</enum><text>by striking <quote>with respect to a cost reporting period</quote>; and</text></paragraph> 
<paragraph id="H7AD09C64A4674E2C8650C6E068159981"><enum>(3)</enum><text>by striking <quote>during such period</quote> and inserting <quote>after such finding is made</quote>.</text></paragraph></subsection> 
<subsection id="H57FBC3BDDA00483CAEE6FD037D607D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to determinations with respect to distinct part unit status that are made on or after October 1, 2005.</text></subsection></section> 
<section id="HEB73990A3FBA4BA29B40534E892D2895"><enum>4.</enum><header>Improvements to medicare critical access hospital (cah) program</header> 
<subsection id="HE87A47508E784691B14D73E32C0368A0"><enum>(a)</enum><header>Payments to home health agencies owned and operated by a CAH</header><text>Section 1895(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395fff">42 U.S.C. 1395fff(f)</external-xref>), as added by section 2(b)(3), is further amended by inserting <quote>or by a home health agency that is owned and operated by a critical access hospital (as defined in section 1861(mm)(1))</quote> after <quote>as defined in paragraph (2))</quote>.</text></subsection> 
<subsection id="H430B0673CB9A4155A4FCAB15FCD13416"><enum>(b)</enum><header>Payments to CAH-owned SNFs</header> 
<paragraph id="H29B859AA5AD34E56A709B04996D092C4"><enum>(1)</enum><header>In general</header><text>Section 1888(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395yy">42 U.S.C. 1395yy(e)</external-xref>) is amended—</text> 
<subparagraph id="H455EE946A2B14034B6006941CA2369F2"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and (12)</quote> and inserting <quote>(12), and (13)</quote>; and</text></subparagraph> 
<subparagraph id="H52D01F41B49D4206A16E586EE04223A8"><enum>(B)</enum><text>by adding at the end thereof the following:</text>

<paragraph id="H4DFE4C4593C04FA4BFC5BEF9FB100F1"><enum>(13)</enum><header>Exemption of cah facilities from pps</header><text>In determining payments under this part for covered skilled nursing facility services furnished on or after October 1, 2005, by a skilled nursing facility that is a distinct part unit of a critical access hospital (as defined in section 1861(mm)(1)) or is owned and operated by a critical access hospital—</text> 
<subparagraph id="H5B63DA4193B443CEB3716954FC40F0C6"><enum>(A)</enum><text>the prospective payment system established under this subsection shall not apply; and</text></subparagraph> 
<subparagraph id="HAF4E0201178D44F98C482F168BDFAC3C"><enum>(B)</enum><text>payment shall be made on the basis of 101 percent of the reasonable costs incurred in furnishing such services as determined under section 1861(v), but without regard to the amount of the customary or other charges with respect to such services or the limitations established under subsection (a)</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0C603334C47A40E2B3C7096C53623EED"><enum>(2)</enum><header>Conforming changes</header> 
<subparagraph id="H5CE94805CC1448D5AF7D5724A7C9774"><enum>(A)</enum><header>In general</header><text>Section 1814(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(b)</external-xref>), as amended by section 2(d)(1), is amended in the matter preceding paragraph (1)—</text> 
<clause id="H6057D20C605E48A49528BE7E2DCF128B"><enum>(i)</enum><text>by inserting <quote>other than a skilled nursing facility providing covered skilled nursing facility services (as defined in section 1888(e)(2)) or posthospital extended care services to which section 1888(e)(13) applies,</quote> after <quote>inpatient hospital services furnished by a rural community hospital,</quote>; and</text></clause> 
<clause id="HBC8CA8F81A134B6A86CFC39DA7DD89B"><enum>(ii)</enum><text>by striking <quote>1813, 1886,</quote> and inserting <quote>1813, 1886, 1888,</quote>.</text></clause></subparagraph> 
<subparagraph id="H80AE23AF5E524802834CECD79F023891"><enum>(B)</enum><header>Consolidated billing</header> 
<clause id="H213B4CB46EF34153B8C8EA3CEB3FA15"><enum>(i)</enum><header>Recipient of payment</header><text>Section 1842(b)(6)(E) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(6)(E)</external-xref>) is amended by inserting <quote>services to which paragraph (7)(C) or (13) of section 1888(e) applies and</quote> after <quote>other than</quote>.</text></clause> 
<clause id="HC5E38570782B498BAF9BB19B3CAAAA9F"><enum>(ii)</enum><header>Exception to exclusion from coverage</header><text>Section 1862(a)(18) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(18)</external-xref>) is amended by inserting <quote>(other than services to which paragraph (7)(C) or (13) of section 1888(e) applies)</quote> after <quote>section 1888(e)(2)(A)(i)</quote>.</text></clause></subparagraph></paragraph></subsection>

<subparagraph id="H73897B1622384BA9AE04F2E343D375F"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, other than a distinct part psychiatric or rehabilitation unit to which paragraph (8) applies,</quote> after <quote>subsection (d)(1)(B)</quote>; and</text></subparagraph> 
<subparagraph id="HD256DE1645E44F22A3CD8C9529906D9E"><enum>(B)</enum><text>by adding at the end the following:</text>

<subparagraph id="H28BAC7F7680340D8B163CB1D05F661FF"><enum>(A)</enum><text>the limits imposed under the preceding paragraphs of this subsection shall not apply; and</text></subparagraph>

<subsection id="H59CBA3C963BE451EB93DD52CD7009609"><enum>(d)</enum><header>Elimination of isolation test for cost-Based CAH ambulance services</header><text>Paragraph (8) of section 1834(l) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)</external-xref>) is amended by striking the comma at the end of subparagraph (B) and all that follows and inserting a period.</text></subsection> 
<subsection id="H3E36BB76D0E0457290BF4E01CE402CD5"><enum>(e)</enum><header>Technical corrections</header> 
<paragraph id="H958B2A42D78041199F5731D06FDCF229"><enum>(1)</enum><header>Section <enum-in-header>403(b)</enum-in-header> of BBRA <enum-in-header>1999</enum-in-header></header><text>Section 1820(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i-4(b)(2)</external-xref>) is amended by striking <quote>nonprofit or public hospitals</quote> and inserting <quote>hospitals</quote>.</text></paragraph> 
<paragraph id="H79B4108387F047EBAD7BBFB97BD4D12"><enum>(2)</enum><header>Section <enum-in-header>203(b)</enum-in-header> of BIPA <enum-in-header>2000</enum-in-header></header><text>Section 1883(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395tt">42 U.S.C. 1395tt(a)(3)</external-xref>) is amended—</text>
