<official-title>To amend the Controlled Substances Act to provide civil liability for illegal manufacturers and distributors of controlled substances for the harm caused by the use of those controlled substances.</official-title>

<section section-type="section-one" id="H7FFC7FD047D5497EB290BE8F99DB22B0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug Dealer Liability Act of 2005</short-title></quote>.</text></section> 
<section id="H73EB4DD39FDB427497CA03B5C35F3263"><enum>2.</enum><header>Federal cause of action for drug dealer liability</header> 
<subsection id="H02F7B2DBA6E544EE8E52C672F94F3676"><enum>(a)</enum><header>In general</header><text>Part E of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> is amended by adding at the end the following:</text>

<section id="HCEEBFE11CD7A4D24AD68898FC6F9E38F"><enum>521.</enum><header>Federal cause of action for drug dealer liability</header> 
<subsection id="H8466773ED0CB47D6921DFA80E22FE276"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), any person who manufactures or distributes a controlled substance in a felony violation of this title or title III shall be liable in a civil action to any party harmed, directly or indirectly, by the use of that controlled substance.</text></subsection> 
<subsection id="H28CC4E9A5E6C40DA821B006855477089"><enum>(b)</enum><header>Exception</header><text>An individual user of a controlled substance may not bring or maintain an action under this section unless the individual personally discloses to narcotics enforcement authorities all of the information known to the individual regarding all that individual’s sources of illegal controlled substances.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H031315E1C1574E4FAC4759F761EA554D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for the <act-name parsable-cite="CDAPCA70">Comprehensive Drug Abuse Prevention and Control Act of 1970</act-name> is amended by inserting after the time relating to section 520 the following new item:</text>
