<official-title>To designate certain National Forest System lands in the Mendocino and Six Rivers National Forests and certain Bureau of Land Management lands in Humboldt, Lake, Mendocino, and Napa Counties in the State of California as wilderness, to designate the Elkhorn Ridge Potential Wilderness Area, to designate certain segments of the Black Butte River in Mendocino County, California as a wild or scenic river, and for other purposes.</official-title>

<section section-type="section-one" id="H54D084B2084D49269C28D6575C55B3C4" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northern California Coastal Wild Heritage Wilderness Act</short-title></quote>.</text></section>
<section id="H3174E2DF3909410E99F1BE15BFC5A78D"><enum>2.</enum><header>Designation of wilderness areas, coastal California</header><text display-inline="no-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following areas in the State of California are designated as wilderness areas and as components of the National Wilderness Preservation System:</text>
<paragraph id="H3C1F7F60C47E446E871ED64E6F92DDD3"><enum>(1)</enum><header>Snow mountain wilderness addition</header>
<subparagraph id="HDF8D4FB4C6B04EA7A161BADD52A9DDE8"><enum>(A)</enum><header>In general</header><text>Certain land in the Mendocino National Forest, comprising approximately 23,312 acres, as generally depicted on the maps described in subparagraph (B), is incorporated in and shall considered to be a part of the <quote>Snow Mountain Wilderness</quote>, as designated by section 101(a)(31) of the California Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/98/425">Public Law 98–425</external-xref>).</text></subparagraph>
<subparagraph id="HA0899AD95AB243A8B78022FBD6D50963"><enum>(B)</enum><header>Description of maps</header><text>The maps referred to in subparagraph (A) are—</text>
<clause id="H2697B4A4C2964C839D7706643078D326"><enum>(i)</enum><text>the map entitled <quote>Skeleton Glade Unit, Snow Mountain Proposed Wilderness Addition, Mendocino National Forest</quote> and dated September 17, 2004; and</text></clause>
<clause id="HAF93E4B121B047F4BF04EEC84CC5F168"><enum>(ii)</enum><text>the map entitled <quote>Bear Creek/Deafy Glade Unit, Snow Mountain Wilderness Addition, Mendocino National Forest</quote> and dated September 17, 2004.</text></clause></subparagraph></paragraph>
<paragraph id="H1E657ADFC1654F75AD94ECC756FC2DAE"><enum>(2)</enum><header>Sanhedrin wilderness</header><text>Certain land in the Mendocino National Forest, comprising approximately 10,571 acres, as generally depicted on the map entitled <quote>Sanhedrin Proposed Wilderness, Mendocino National Forest</quote> and dated September 17, 2004, which shall be known as the <quote>Sanhedrin Wilderness</quote>.</text></paragraph>
<paragraph id="HBCBF6DE48BA4435D8BF9E7CC6350B1BE"><enum>(3)</enum><header>Yuki wilderness</header><text>Certain land in the Mendocino National Forest and certain land administered by the Bureau of Land Management in Lake and Mendocino Counties, California, together comprising approximately 54,087 acres, as generally depicted on the map entitled <quote>Yuki Proposed Wilderness</quote> and dated October 28, 2004, which shall be known as the <quote>Yuki Wilderness</quote>.</text></paragraph>
<paragraph id="HDDD095AF44EC406A8DDFEC97F2DC91E6"><enum>(4)</enum><header>Yolla bolly-middle eel wilderness addition</header><text>Certain land in the Mendocino National Forest and certain land administered by the Bureau of Land Management in Mendocino County, California, together comprising approximately 25,806 acres, as generally depicted on the map entitled <quote>Middle Fork Eel, Smokehouse and Big Butte Units, Yolla Bolly-Middle Eel Proposed Wilderness Addition</quote> and dated October 28, 2004, is incorporated in and shall considered to be a part of the Yolla Bolly-Middle Eel Wilderness, as designated by section 3 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref>).</text></paragraph>
<paragraph id="HE5545435CEE64C48B0C264101B6EEBB8"><enum>(5)</enum><header>Mad river buttes wilderness</header><text>Certain land in the Six Rivers National Forest, comprising approximately 6,494 acres, as generally depicted on the map entitled <quote>Mad River Buttes, Mad River Proposed Wilderness</quote> and dated September 17, 2004, which shall be known as the <quote>Mad River Buttes Wilderness</quote>.</text></paragraph>
<paragraph id="H04A524D9C4BB4854AD1DC4EEC7C28B4"><enum>(6)</enum><header>Siskiyou wilderness addition</header>
<subparagraph id="H97D691E8F96549FB008C176B53721063"><enum>(A)</enum><header>In general</header><text>Certain land in the Six Rivers National Forest, comprising approximately 48,754 acres, as generally depicted on the maps described in subparagraph (B), is incorporated in and shall be considered to be a part of the Siskiyou Wilderness, as designated by section 101(a)(30) of the California Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/98/425">Public Law 98–425</external-xref>).</text></subparagraph>

<subparagraph id="H0B72AEF995924E2D89067F09A5C02944"><enum>(A)</enum><header>In general</header><text>Certain land in the Six Rivers National Forest, comprising approximately 28,805 acres, as generally depicted on the maps described in subparagraph (B) and which is incorporated in and shall be considered to be a part of the Trinity Alps Wilderness as designated by section 101(a)(34) of the California Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/98/425">Public Law 98–425</external-xref>).</text></subparagraph>

<paragraph id="HD360AD87586C44328600ABD589250724"><enum>(10)</enum><header>Cache creek wilderness</header><text>Certain land administered by the Bureau of Land Management in Lake County, California, comprising approximately 30,870 acres, as generally depicted on the map entitled <quote>Cache Creek Wilderness Area</quote> and dated September 27, 2004, which shall be known as the <quote>Cache Creek Wilderness</quote>.</text></paragraph>

<paragraph id="H0D17ACA2AF184222B76ED6D4CF8E21D"><enum>(12)</enum><header>South fork eel river wilderness</header><text>Certain land administered by the Bureau of Land Management in Mendocino County, California, comprising approximately 12,915 acres, as generally depicted on the map entitled <quote>South Fork Eel River Wilderness Area and Elkhorn Ridge Potential Wilderness</quote> and dated September 27, 2004, which shall be known as the <quote>South Fork Eel River Wilderness</quote>.</text></paragraph>
<paragraph id="H39456D170FD64DD5B61C75056D7D386C"><enum>(13)</enum><header>King range wilderness</header>
<subparagraph id="H7C5B67ED05474F0A922B574F59FBDEE2"><enum>(A)</enum><header>In general</header><text>Certain land administered by the Bureau of Land Management in Humboldt and Mendocino Counties, California, comprising approximately 42,585 acres, as generally depicted on the map entitled <quote>King Range Wilderness</quote>, and dated November 12, 2004, which shall be known as the <quote>King Range Wilderness</quote>.</text></subparagraph>
<subparagraph id="HAC1AE71EB75341B69E18CE67A1B19E28"><enum>(B)</enum><header>Applicable law</header><text>With respect to the wilderness designated by subparagraph (A), in the case of a conflict between a provision of section 3 and a provision of <external-xref legal-doc="public-law" parsable-cite="pl/91/476">Public Law 91–476</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460y">16 U.S.C. 460y et seq.</external-xref>), the more restrictive provision shall control.</text></subparagraph></paragraph>
<paragraph id="H37EE7525CE024742AB6F8EAFDD30EF68"><enum>(14)</enum><header>Rocks and islands, king range national conservation area</header>
<subparagraph id="H6410490654A4407D9225210256C208AC"><enum>(A)</enum><header>In general</header><text>All Federally-owned rocks, islets, and islands (whether named or unnamed and surveyed or unsurveyed) that are located—</text>
<clause id="HA9064225A44A45D98CDA3836431DBEA2"><enum>(i)</enum><text>not more than 3 geographic miles off the coast of the King Range National Conservation Area; and</text></clause>
<clause id="HB8AFC4B217CD4F55AF2E1120460080AD"><enum>(ii)</enum><text>above mean high tide.</text></clause></subparagraph>
<subparagraph id="H277E83D84E2642E5B45053769FBDE88F"><enum>(B)</enum><header>Applicable law</header><text display-inline="yes-display-inline">With respect to the wilderness designated by subparagraph (A), in the case of a conflict between a provision of section 3 and a provision of Proclamation No. 7264 (65 Fed. Reg. 2821), the more restrictive provision shall control.</text></subparagraph></paragraph></section>
<section id="HC77C43E983CE4378ACB5BD17003274C9"><enum>3.</enum><header>Administration of wilderness areas</header>
<subsection id="HF726B8F3E188465C9618D0381CA372E4"><enum>(a)</enum><header>Management</header>
<paragraph id="HE6A8C2BDD2BE4C5783BA46E6F8F26A4"><enum>(1)</enum><header>Management generally</header><text>Subject to valid existing rights, each area designated as wilderness by section 2 shall be administered by the Secretary of Agriculture or the Secretary of the Interior, as the case may be, in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text>
<subparagraph id="H649734E2E1EB4F8F81394578A18E8FBD"><enum>(A)</enum><text display-inline="yes-display-inline">any reference in the Wilderness Act to the effective date of such Act shall be considered to be a reference to the date of enactment of this Act; and</text></subparagraph>
<subparagraph id="H1811A5BE5DEF49A7A1005EB97B1030FA"><enum>(B)</enum><text display-inline="yes-display-inline">any reference in the Wilderness Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary that has jurisdiction over the wilderness area.</text></subparagraph></paragraph>
<paragraph id="H5EBB231CBA6642DAA998865BDC56E8AA" display-inline="no-display-inline"><enum>(2)</enum><header>Secretary defined</header><text display-inline="yes-display-inline">In this section, the term <quote>Secretary concerned</quote> means—</text>
<subparagraph id="H6C9243FE354E4B71BB2CA3A2AFD639DF"><enum>(A)</enum><text>with respect to a wilderness area under the jurisdiction of the Secretary of Agriculture, the Secretary of Agriculture; and</text></subparagraph>
<subparagraph id="HF987A9FA0A2640A78CCB56207303D87"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a wilderness area under the jurisdiction of the Secretary of the Interior, the Secretary of the Interior.</text></subparagraph></paragraph></subsection>
<subsection id="H029221D1A3EC4608888C84F1059D00EB"><enum>(b)</enum><header>Map and description</header>
<paragraph id="HD9D790D4732F48AEBBF1C72855041F86"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary concerned shall file a map and a legal description of each wilderness area designated by this Act with—</text>
<subparagraph id="HF0A2F5271B154156A1304834F6FFAF7E"><enum>(A)</enum><text>the Committee on Resources of the House of Representatives; and</text></subparagraph>
<subparagraph id="H9CAC5880B987442FBD349DC63F005B87"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph>
<paragraph id="H19E7E803D8F1483F93F1B8B88D00A0C6"><enum>(2)</enum><header>Force of law</header><text>A map and legal description filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary concerned may correct errors in the map and legal description.</text></paragraph>
<paragraph id="H7DB4F9C459B24F1A8DE4F893BC251D8"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be filed and made available for public inspection in the appropriate office of the Secretary concerned.</text></paragraph></subsection>
<subsection id="H379543EC667C4DFBBB5847E9004CC952"><enum>(c)</enum><header>Incorporation of acquired land and interests</header><text>Any land within the boundary of a wilderness area designated by this Act that is acquired by the Federal Government shall—</text>
<paragraph id="H299428BF5E8B46C691912163FEBE4BC3"><enum>(1)</enum><text>become part of the wilderness area in which the land is located; and</text></paragraph>
<paragraph id="HC4612519631242EABDC42213D0F85C56"><enum>(2)</enum><text>be managed in accordance with this Act, the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), and any other applicable law.</text></paragraph></subsection>
<subsection id="HBAD8A029F6084D7F9FDEE4E9B25EAC26"><enum>(d)</enum><header>Withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Federal land designated as wilderness by this Act is withdrawn from all forms of—</text>
<paragraph id="HCD8ED7AFBECF4E0F952BC6C463D428B1"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph>
<paragraph id="HA73D749E6A9B465DB8B3F30004DDDA1E"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph>
<paragraph id="HB96901D324584F21ACD445646FD88E00"><enum>(3)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></paragraph></subsection>
<subsection id="HD2A3460B443F4160A95C77DAA7E4C53"><enum>(e)</enum><header>Fire, insect, and disease management activities</header>
<paragraph id="HFFCF9A190C4A4FA798D52F04BFEA5CC0"><enum>(1)</enum><header>In general</header><text>The Secretary concerned may take such measures in the wilderness areas designated by this Act as are necessary for the control and prevention of fire, insects, and diseases, in accordance with—</text>
<subparagraph id="H6754A0802DD34D6EBF0032F3000014DF"><enum>(A)</enum><text>section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></subparagraph>
<subparagraph id="H87FBF785F05142C9BEB2FFA371FE56B4"><enum>(B)</enum><text>House Report No. 98–40 of the 98th Congress.</text></subparagraph></paragraph>
<paragraph id="H9B0AD2B7D53C4CBFBE18E0ECAB271F3C"><enum>(2)</enum><header>Review</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary concerned shall review existing policies applicable to the wilderness areas designated by this Act to ensure that authorized approval procedures for any fire management measures allow a timely and efficient response to fire emergencies in the wilderness areas.</text></paragraph></subsection>
<subsection id="HE4C0CD13469A40B3A9F6FEB2C98B538D"><enum>(f)</enum><header>Access to private property</header>
<paragraph id="H53355240E61E4B3EAB03E476E1AEFAE5"><enum>(1)</enum><header>In general</header><text>The Secretary concerned shall provide any owner of private property within the boundary of a wilderness area designated by this Act adequate access to such property to ensure the reasonable use and enjoyment of the property by the owner.</text></paragraph>
<paragraph id="H5CFBF36A036D425EBBE6AD6749D2F2A3"><enum>(2)</enum><header>King Range Wilderness</header>
<subparagraph id="H37E20003DB924A23004F2E348B412476"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), within the wilderness designated by section 2(13), the access route depicted on the map for private landowners shall also be available for invitees of the private landowners.</text></subparagraph>
<subparagraph id="HCD73D693B3DA46B700064F980074B130"><enum>(B)</enum><header>Limitation</header><text>Nothing in subparagraph (A) requires the Secretary concerned to provide any access to the landowners or invitees beyond the access that would be available if the wilderness had not been designated.</text></subparagraph></paragraph></subsection>
<subsection id="HD5617694D9534C8C8B42AE2271CC91E1"><enum>(g)</enum><header>Snow sensors and stream gauges</header><text>If the Secretary concerned determines that hydrologic, meteorologic, or climatological instrumentation is appropriate to further the scientific, educational, and conservation purposes of the wilderness areas designated by this Act, nothing in this Act prevents the installation and maintenance of the instrumentation within the wilderness areas.</text></subsection>
<subsection id="HEB3ED4D2A14C4F7BB917C0845145D337"><enum>(h)</enum><header>Military activities</header><text>Nothing in this Act precludes low-level overflights of military aircraft, the designation of new units of special airspace, or the use or establishment of military flight training routes over wilderness areas designated by this Act.</text></subsection>
<subsection id="H29998549B4554DB79911C4C1FD038619"><enum>(i)</enum><header>Livestock</header><text>Grazing of livestock and the maintenance of existing facilities related to grazing in wilderness areas designated by this Act, where established before the date of enactment of this Act, shall be permitted to continue in accordance with—</text>
<paragraph id="H7D6DD64F74CC4A10BAA32D8879F3670"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph>
<paragraph id="H6AB7C99404FB409DA5C7D7D8A89300BF"><enum>(2)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></paragraph></subsection>
<subsection id="H4393B33A888E4E98A0AEC9AEAFAE97B7"><enum>(j)</enum><header>Fish and wildlife management</header>
<paragraph id="HCFADAB437FD843959DEA748E9B047C25"><enum>(1)</enum><header>In general</header><text>In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the Secretary concerned may carry out management activities to maintain or restore fish and wildlife populations and fish and wildlife habitats in wilderness areas designated by this Act if such activities are—</text>
<subparagraph id="HB53611688C3D42BBAB3030DA49942CC7"><enum>(A)</enum><text>consistent with applicable wilderness management plans; and</text></subparagraph>
<subparagraph id="H329F153CA2ED42AC9FBA8154D81F316B"><enum>(B)</enum><text>carried out in accordance with applicable guidelines and policies.</text></subparagraph></paragraph>
<paragraph id="H50720096FF7D4DD1B3FAB9C93879CDCE"><enum>(2)</enum><header>State jurisdiction</header><text>Nothing in this Act affects the jurisdiction of the State of California with respect to fish and wildlife on the public land located in the State.</text></paragraph></subsection>
<subsection id="H000837D5872943BC9E1D6968B8D436D6"><enum>(k)</enum><header>Use by members of Indian tribes</header>
<paragraph id="H7838C1DA5C044BAA83A1F88D6159C31C"><enum>(1)</enum><header>Access</header><text>In recognition of the past use of wilderness areas designated by this Act by members of Indian tribes for traditional cultural and religious purposes, the Secretary concerned shall ensure that Indian tribes have access to the wilderness areas for traditional cultural and religious purposes.</text></paragraph>
<paragraph id="HFAF713A74EB64F2AA046437B02DC00F9"><enum>(2)</enum><header>Temporary closures</header>
<subparagraph id="HDE98C6D3138448BBA67CD22092DB3613"><enum>(A)</enum><header>In general</header><text>In carrying out this subsection, the Secretary concerned, on request of an Indian tribe, may temporarily close to the general public 1 or more specific portions of a wilderness area to protect the privacy of the members of the Indian tribe in the conduct of the traditional cultural and religious activities in the wilderness area.</text></subparagraph>
<subparagraph id="H088F19F0B8094E08A69D3F9526068EA5"><enum>(B)</enum><header>Requirement</header><text>Any closure under subparagraph (A) shall be made in such a manner as to affect the smallest practicable area for the minimum period of time necessary for the activity to be carried out.</text></subparagraph></paragraph>
<paragraph id="H4C2E99469FE34E45ADB260F54541A410"><enum>(3)</enum><header>Applicable law</header><text>Access to the wilderness areas under this subsection shall be in accordance with—</text>
<subparagraph id="H196B4D18CCB44F00A0CE305588D98246"><enum>(A)</enum><text>Public Law 95–341 (commonly known as the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="HD3B0B9727484489194F9F4EFA2BBF073"><enum>(B)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="H2A5099DFAC1E470EA6A90070592562DF"><enum>(l)</enum><header>Adjacent management</header>
<paragraph id="HC406B685767D4F3497291D60EF713FB4"><enum>(1)</enum><header>In general</header><text>Nothing in this Act creates protective perimeters or buffer zones around any wilderness area designated by this Act.</text></paragraph>
<paragraph id="H571F5451C35B434CBF28E200BB936B13"><enum>(2)</enum><header>Nonwilderness activities</header><text>The fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness area designated by this Act shall not preclude the conduct of those activities or uses outside the boundary of the wilderness area.</text></paragraph></subsection></section>
<section id="H103E946FADD64EF0B08274497000FC06"><enum>4.</enum><header>Release of wilderness study areas</header>
<subsection id="H845B310A04474337A5715471F534D2AA"><enum>(a)</enum><header>Finding</header><text>Congress finds that, for the purposes of section 603 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), any portion of a wilderness study area described in subsection (b) that is not designated as wilderness by this Act or any previous Act has been adequately studied for wilderness.</text></subsection>
<subsection id="H224F9E81F05C43250001B9952317C15B"><enum>(b)</enum><header>Description of study areas</header><text>The study areas referred to in subsection (a) are—</text>
<paragraph id="H3AA360AC850A4F9591F0C29185E340E8"><enum>(1)</enum><text>the King Range Wilderness Study Area;</text></paragraph>
<paragraph id="H2C5E374254DA4B148E18F134A62CDDB3"><enum>(2)</enum><text>the Chemise Mountain Instant Study Area;</text></paragraph>
<paragraph id="H91AC121024F44D3D8B981E6CCA93F436"><enum>(3)</enum><text>the Red Mountain Wilderness Study Area;</text></paragraph>
<paragraph id="H739688252F4B44B89B99B33F4584B363"><enum>(4)</enum><text>the Cedar Roughs Wilderness Study Area; and</text></paragraph>
<paragraph id="H9E1AAC44178447DFB14CA0A0CABD89C"><enum>(5)</enum><text>those portions of the Rocky Creek/Cache Creek Wilderness Study Area in Lake County, California which are not in R. 5 W., T. 12 N., sec. 22, Mount Diablo Meridian.</text></paragraph></subsection>
<subsection id="H18DA215571034415BD99EA12C4F3D2F"><enum>(c)</enum><header>Release</header><text>Any portion of a wilderness study area described in subsection (b) that is not designated as wilderness by this Act or any other Act enacted before the date of enactment of this Act shall not be subject to section 603(c) of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></subsection></section>
<section id="H2A84D8BAE71A4E66A7EB12ADC0FC3C33"><enum>5.</enum><header>Elkhorn Ridge Potential Wilderness Area</header>
<subsection id="HDEA1EB12BCA94DC700D0B251505E98D3"><enum>(a)</enum><header>Designation as potential wilderness area</header><text>In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), certain public land in the State administered by the Bureau of Land Management, compromising approximately 9,655 acres, as generally depicted on the map entitled <quote>South Fork Eel River Wilderness Area and Elkhorn Ridge Potential Wilderness</quote> and dated September 27, 2004, is designated as a potential wilderness area.</text></subsection>
<subsection id="H7FE1C11FCBDD49978BEFB52153124DDD"><enum>(b)</enum><header>Management of potential wilderness area</header><text>Except as provided in subsection (c) and subject to valid existing rights, the Secretary of the Interior shall manage the potential wilderness area as wilderness until the potential wilderness area is designated as wilderness.</text></subsection>
<subsection id="HA651C70B9FFB4944AFEC45A52EF2EAD"><enum>(c)</enum><header>Ecological restoration</header>
<paragraph id="H494F2CB09EF343D38F3939A484C1E2D0"><enum>(1)</enum><header>In general</header><text>For purposes of ecological restoration (including the elimination of non-native species, removal of illegal, unused, or decommissioned roads, repair of skid tracks, and any other activities necessary to restore the natural ecosystems in the potential wilderness area), the Secretary of the Interior may used motorized equipment and mechanized transport in the potential wilderness area until the potential wilderness area is designated as wilderness.</text></paragraph>
<paragraph id="H6141DB3C271E435984275FD17EAA5661"><enum>(2)</enum><header>Limitation</header><text>To the maximum extent practicable, the Secretary of the Interior shall use the minimum tool or administrative practice necessary to accomplish ecological restoration with the least amount of adverse impact on wilderness character and resources.</text></paragraph></subsection>
<subsection id="H447421895D1548F3AFD9B794F9AAD51E"><enum>(d)</enum><header>Designation as wilderness</header><text>The potential wilderness area shall be designated as wilderness and as a component of the National Wilderness Preservation System on the earlier of—</text>
<paragraph id="HD2240116B3314C44AF02CED4E346100"><enum>(1)</enum><text>the date on which the Secretary of the Interior publishes in the Federal Register notice that the conditions in the potential wilderness area that are incompatible with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) have been removed; or</text></paragraph>
<paragraph id="H0E7BE875D4B44E21A2C07910775FEE05"><enum>(2)</enum><text>the date that is 5 years after the date of enactment of this Act.</text></paragraph></subsection>
<subsection id="HD8FCE57D2A6B418E95023CA1383C334D"><enum>(e)</enum><header>Management of wilderness area</header><text display-inline="yes-display-inline">Upon designation of the potential wilderness area as wilderness under subsection (d), the wilderness area shall be—</text>
<paragraph id="H42A0062CBFB24DACA5E9E8C835F06586"><enum>(1)</enum><text>known as the <quote>Elkhorn Ridge Wilderness</quote>; and</text></paragraph>
<paragraph id="H127ABB9A2DB5464B87FE5EB72942B56F"><enum>(2)</enum><text display-inline="yes-display-inline">administered by the Secretary of the Interior in accordance with section 3 and the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text>
<subparagraph id="H16B91D25EB2647B9A2CBD1C9AC19C104"><enum>(A)</enum><text>any reference in section 3 to the date of enactment of this Act and any reference in the Wilderness Act to the effective date of the Wilderness Act shall be considered to be a reference to the date on which the wilderness area is designated under subsection (d); and </text></subparagraph>
<subparagraph id="H014F0BCC7C3F456394C6F6007CDFF3D"><enum>(B)</enum><text display-inline="yes-display-inline">any reference in the Wilderness Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary of the Interior.</text></subparagraph></paragraph></subsection></section>
<section id="H176985FFDEFA427A8D3BBB975676AD70"><enum>6.</enum><header>Wild and scenic river designation, Black Butte River, California</header>
<subsection id="H675F7B09F8DF4A61A512256FC5325CBC"><enum>(a)</enum><header>Designation of Black Butte River segments</header><text>Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H83D31E673172449A9D59B0D452E89C2F" indent="up1"><enum>(__)</enum><header>Black Butte River, California</header><text>The following segments of the Black Butte River in the State of California, to be administered by the Secretary of Agriculture:</text>
<subparagraph id="H42F16A1F3F7A4F7A8C475DE997A4BD41"><enum>(A)</enum><text>The 16 miles of Black Butte River, from the Mendocino County Line to its confluence with Jumpoff Creek, as a wild river.</text></subparagraph>
<subparagraph id="HBFED6F8B6A9244978D721ED4DB19CC12"><enum>(B)</enum><text>The 3.5 miles of Black Butte River from its confluence with Jumpoff Creek to its confluence with Middle Eel River, as a scenic river.</text></subparagraph>
<subparagraph id="H3D74FB8E5DA5432AB0B828EF2060CE5D"><enum>(C)</enum><text>The 1.5 miles of Cold Creek from the Mendocino County Line to its confluence with Black Butte River, as a wild river.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H276B73AFF79C4A47A5114736C64FAFD0"><enum>(b)</enum><header>Fire management plan and cultural and historic resources report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary of Agriculture shall submit to Congress—</text>
<paragraph id="H9A286FDD0066428CAC5D00AE7701D363"><enum>(1)</enum><text>a fire management plan for the Black Butte River segments designated by the amendment made by subsection (a); and</text></paragraph>
<paragraph id="HF4661648AC134E2BA1E74F9B072F2B88"><enum>(2)</enum><text>a report on the cultural and historic resources within those segments.</text></paragraph></subsection>
<subsection id="H57E9A9419D06439AA5D620069982612"><enum>(c)</enum><header>Transmittal to county</header><text>The Secretary of Agriculture shall transmit to the Board of Supervisors of Mendocino County, California, a copy of the plan and report submitted under subsection (b).</text></subsection></section>
<section id="HF6A3656CEFE447B78353F3D2A693A640"><enum>7.</enum><header>King Range National Conservation Area boundary adjustment</header><text display-inline="no-display-inline">Section 9 of <external-xref legal-doc="public-law" parsable-cite="pl/91/476">Public Law 91–476</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460y-8">16 U.S.C. 460y–8</external-xref>) is amended by adding at the end the following:</text>
