<subsection id="HC7C2CFC90F5A44B9807622ED55969160"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H9BBDA4006A11473698EA9DDBC8DF107F"><enum>(1)</enum><text>Public access to information held by the Federal Government is vitally important to the functioning of a democratic society.</text></paragraph> 
<paragraph id="H7AAE40D43CCB477AACE6332B07DFBCC0"><enum>(2)</enum><text>The Freedom of Information Act was enacted to ensure such public access to information.</text></paragraph> 
<paragraph id="H3211152206EA48B3865539D9CAC779E8"><enum>(3)</enum><text>The Freedom of Information Act specifies limited exemptions to the general requirement for disclosure, where disclosure could potentially threaten other important public policy goals.</text></paragraph> 
<paragraph id="HE8E997C6384E4399A37E23312864C9E"><enum>(4)</enum><text>In establishing the categories of exempt information under the Freedom of Information Act, Congress allowed agencies to withhold information in those categories, but did not in any way mandate or encourage such withholding.</text></paragraph></subsection> 
<subsection id="HF59E7556C4244E2DBB19084FE5E05202"><enum>(b)</enum><header>Policy</header><text>The policy of the Federal Government is to release information to the public in response to a request under the Freedom of Information Act—</text> 
<paragraph id="HFD75E93B5EB74C7AAE0050F900869284"><enum>(1)</enum><text>if such release is required by law; or</text></paragraph> 
<paragraph id="H7AF1778917934C3FB13EDEBFEEECDC9F"><enum>(2)</enum><text>if such release is allowed by law and the agency concerned does not reasonably foresee that disclosure would be harmful to an interest protected by an applicable exemption.</text></paragraph></subsection> 
<subsection id="H8B63F795398043BA97879C857BBDE6"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">All guidance provided to Federal Government employees responsible for carrying out the Freedom of Information Act shall be consistent with the policy set forth in subsection (b).</text></subsection></section> 
<section id="HBE476FE7471E45CD9900B8F79C361700"><enum>4.</enum><header>Revocation of the Ashcroft and Card Memoranda that encourage the withholding of information</header><text display-inline="no-display-inline">The <quote>Memorandum for Heads of all Federal Departments and Agencies” on “The Freedom of Information Act” issued by Attorney General John Ashcroft on October 12, 2001, and the “Memorandum for the Heads of Executive Department and Agencies</quote> on <quote>Action to Safeguard Information Regarding Weapons of Mass Destruction and Other Sensitive Documents Related to Homeland Security</quote> issued by Andrew H. Card, Jr., Assistant to the President and Chief of Staff, on March 19, 2002, shall have no force or effect.</text></section> 
<section id="HEBB5D43B87F545998B85AF3D4412E35"><enum>5.</enum><header>Elimination of unnecessary pseudo-classification</header> 
<subsection id="H7AD5CCFA4D164FF6BD09000168F4D687"><enum>(a)</enum><header>Report on the proliferating use of pseudo-classification designations</header><text display-inline="yes-display-inline"></text> 
<paragraph id="HF206E326CA5D4F4DBBF5125DD19800B6"><enum>(1)</enum><header>Report requirement</header><text>Not later than nine months after the date of the enactment of this Act, the Archivist of the United States shall submit to the congressional committees described in subsection (d) a report describing the use of pseudo-classification designations.</text></paragraph> 
<paragraph id="H12FF0E4135BF40769E002B8F86DF1E06"><enum>(2)</enum><header>Matters covered</header><text>The Archivist shall report on, at a minimum, the following:</text> 
<subparagraph id="HD4CB9D8965B842439D77DE2640D008DA"><enum>(A)</enum><text>The number of pseudo-classification designation policies used by Federal agencies, and a list of each of the pseudo-classification designations that includes the agency or agencies that use the designation.</text></subparagraph> 
<subparagraph id="H98CCBDC4FD144A2488E4E40643C2DC75"><enum>(B)</enum><text>Any existing guidance, instruction, directive, or regulations regarding each agency’s use of the pseudo-classification designations.</text></subparagraph> 
<subparagraph id="HBAD640380CCE4FC99DA52DC000E54E70"><enum>(C)</enum><text>The number of documents categorized by each agency in each of the previous three fiscal years under each designation.</text></subparagraph> 
<subparagraph id="HB846769722184513A4E6C2AE0044C2BA"><enum>(D)</enum><text>The number and level of experience and training of Federal agency, office, and contractor personnel authorized to make pseudo-classification designations.</text></subparagraph> 
<subparagraph id="H4759DC4007EB444983FA9280A7E328D8"><enum>(E)</enum><text>The cost of placing and maintaining information under each pseudo-classification designation.</text></subparagraph> 
<subparagraph id="H7B20F957259F43BFB2D4C5D813AF6E8B"><enum>(F)</enum><text>The extent to which information placed under pseudo-classification designations has subsequently been released under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (popularly known as the Freedom of Information Act).</text></subparagraph> 
<subparagraph id="H76370F4685BE44C385C777F1283C1CA9"><enum>(G)</enum><text>The extent to which pseudo-classification designations have been used to withhold from the public information that is not authorized to be withheld by Federal statute, or by an Executive order relating to the classification of national security information.</text></subparagraph> 
<subparagraph id="HF207F86657B34968AFED006E2FEF457D"><enum>(H)</enum><text>The statutory provisions described in subsection (c).</text></subparagraph></paragraph> 
<paragraph id="HB5D9F701DD1D40D8844493A05C33E86"><enum>(3)</enum><header>Input from other Federal agencies</header><text>In order to report on the use of pseudo-classification designations, the Archivist shall solicit and consider input from Federal agencies, offices, and contractors, and all federal agencies, offices, and contractors shall cooperate fully and promptly with all requests by the Archivist in the fulfillment of this section.</text></paragraph> 
<paragraph id="HBD439090908B447DB4A6D05CD4979860"><enum>(4)</enum><header> Notice and comment</header><text>The Archivist shall provide notice and an opportunity for public comment on the report.</text></paragraph></subsection> 
<subsection id="H2E2C0ABA283741BE96F1007B83293FC4"><enum>(b)</enum><header>Elimination of unnecessary pseudo-classification designations</header> 
<paragraph id="HB6D21134F1B84DAFB7641BF7B25F39CB"><enum>(1)</enum><header>Regulations</header><text>Not later than 15 months after the date of the enactment of this Act, the Archivist of the United States shall promulgate regulations banning the use of unnecessary pseudo-classification designations.</text></paragraph> 
<paragraph id="HB579284CBCFD47E28E8852D27882C550"><enum>(2)</enum><header>Standards for information control designations</header><text>If the Archivist determines that there is a need for some agencies to use information control designations to safeguard information prior to review for disclosure, beyond those designations established by statute or by an Executive Order relating to the classification of national security information, the regulations under paragraph (1) shall establish standards for the use of those designations by agencies. Such standards shall address, at a minimum, the following issues:</text> 
<subparagraph id="HFA386453546547309B3CBFD614F0F200"><enum>(A)</enum><text>Standards for utilizing the information control designations in a manner that is narrowly tailored to maximize public access to information.</text></subparagraph> 
<subparagraph id="H2343824CBB60460492D4E67841C49F1B"><enum>(B)</enum><text>Procedures for providing specified Federal officials with authority to utilize the information control designations, including training and certification requirements.</text></subparagraph> 
<subparagraph id="H1A0125B601E64E43A13FB0949E717396"><enum>(C)</enum><text>Categories of information that may be assigned the information control designations.</text></subparagraph> 
<subparagraph id="H072BB0AC8D7745B7A8C1BB9FB9C73517"><enum>(D)</enum><text>The duration of the information control designations and the process by which they will be removed.</text></subparagraph> 
<subparagraph id="H2BB12C525C24453E9BAAA794337772FA"><enum>(E)</enum><text>Procedures for identifying, marking, dating, and tracking information assigned the information control designations, including the identity of officials making the designations.</text></subparagraph> 
<subparagraph id="H86F8C56068394E448F3DACE541B777F"><enum>(F)</enum><text>Specific limitations and prohibitions against using the information control designations.</text></subparagraph> 
<subparagraph id="HFCA924BAB9CE4038A5F0573B5C74DF57"><enum>(G)</enum><text>Procedures for members of the public to challenge the use of the information control designations.</text></subparagraph> 
<subparagraph id="H7017DC562EE84CD38FD7C60469207C43"><enum>(H)</enum><text>The manner in which the use of the information control designations relates to the procedures of each agency or office under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H921C6D91FD0B46B18B18468179C800C6"><enum>(3)</enum><header>Regulation to constitute sole authority</header><text>A regulation promulgated pursuant to this subsection shall constitute the sole authority by which Federal agencies, offices, or contractors are permitted to control information for the purposes of safeguarding information prior to review for disclosure, other than authority granted by Federal statute or by an Executive order relating to the classification of national security information.</text></paragraph></subsection> 
<subsection id="HFE43B7DBD5E449D1B449E2DF1D910685"><enum>(c)</enum><header>Review of statutory barriers to public access to information</header> 
<paragraph id="HC40D9AA7D80E448B93CEDD77B4719AB"><enum>(1)</enum><header>Review of statutes</header><text>As part of the report required under subsection (a), the Archivist shall examine existing Federal statutes that allow Federal agencies, offices, or contractors to control, protect, or otherwise withhold information based on security concerns.</text></paragraph> 
<paragraph id="HA4A3811221764FF88F06A1B084992BA2"><enum>(2)</enum><header>Recommendations</header><text>The report shall make recommendations on potential changes to the Federal statutes examined under paragraph (1) that would improve public access to information governed by such statutes.</text></paragraph></subsection> 
<subsection id="H7CE5B769F2AD43F687F12B003493A7D2"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFBC2173C50BE425F8532ED50A8223422"><enum>(1)</enum><text>The term <quote>congressional committees</quote> means the Committees on Government Reform, Judiciary, Homeland Security, and Appropriations of the House of Representatives and the Committees on Homeland Security and Governmental Affairs, Judiciary, and Appropriations of the Senate.</text></paragraph> 
<paragraph id="H448F75026E4E4D95A4FD5B2EE1CE2DFE"><enum>(2)</enum><text>The term <quote>pseudo-classification designations</quote> means information control designations, including <quote>sensitive but unclassified</quote> and <quote>for official use only,</quote> that are not defined by Federal statute, or by an Executive order relating to the classification of national security information, but that are used to manage, direct, or route Government information, or control the accessibility of Government information, regardless of its form or format.</text></paragraph></subsection></section> 
<section section-type="subsequent-section" id="H716A1DB677FA4C23B7BFBFE5C9F99F41" display-inline="no-display-inline"><enum>6.</enum><header>Restoration of public access to presidential records</header><text display-inline="no-display-inline">Executive Order number 13233, dated November 1, 2001 (66 Fed. Reg. 56025), shall have no force or effect, and Executive Order number 12667, dated January 18, 1989 (54 Fed. Reg. 3403), shall apply by its terms.</text></section> 
<section id="H728062537183453CB6B1074EB1689EC9"><enum>7.</enum><header>Prohibition on secret advisory committees</header> 
<subsection id="H383E5C74D45D4E87A8A8BA3B98FFF260"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <quote>Presidential inter-agency advisory committee</quote> is any committee or task force that—</text> 
<paragraph id="HB11B8CDD73904165860012A64B7CD923"><enum>(1)</enum><text>is composed wholly of full-time, or permanent part-time, officers or employees of the Federal Government; </text></paragraph> 
<paragraph id="H1FF5C1951585447881ABAE348B324403"><enum>(2)</enum><text>includes officers or employees of at least two separate Federal agencies; </text></paragraph> 
<paragraph id="H15EFD162E3274047819DF04C7857B128"><enum>(3)</enum><text>is established or utilized to provide advice, ideas, or recommendations to the President or Vice President on a specified topic or topics; and </text></paragraph> 
<paragraph id="H67AAC38C866142C68DFB6741122C636"><enum>(4)</enum><text>has at least one officer or employee assigned full-time as a staff member of the committee to support the functions of the committee.</text></paragraph></subsection> 
<subsection id="H7E5A9EA980D44025A0F77F99BDF00283"><enum>(b)</enum><header>Requirements</header> 
<paragraph id="H3A0B74C49B1D453483A3709CACDC82E2"><enum>(1)</enum><text> The President shall ensure that the names of the members of the committee are published in the Federal Register.</text></paragraph> 
<paragraph id="HAC998AC521EA4A79B27D10127C97E925"><enum>(2)</enum><text>The committee must make public each substantive contact between the advisory committee, or individual members of the advisory committee acting on the committee’s behalf, and any person who is not a full-time or permanent part-time officer or employee of the Federal Government, including—</text> 
<subparagraph id="H6CED764B00BD44CE8B2264E3356E82AB"><enum>(A)</enum><text>the date of the contact;</text></subparagraph> 
<subparagraph id="H017D33AF92ED4796B07137E58962BCB1"><enum>(B)</enum><text display-inline="yes-display-inline">the form of the contact (in person, by telephone, by e-mail, or in writing);</text></subparagraph> 
<subparagraph id="HEEACC123D5944B66BAF059CE36AC2C00"><enum>(C)</enum><text>the names and affiliations of the parties involved; and</text></subparagraph> 
<subparagraph id="H41E9E1629BF04A70BECB00DF6CEE68AC"><enum>(D)</enum><text display-inline="yes-display-inline">the substance of the communication and the communication itself, if in electronic or written form. </text></subparagraph></paragraph> 
<paragraph id="H8D0E512252694B24B61E64220201EC1F"><enum>(3)</enum><text>For purposes of this subsection, a contact shall be considered substantive if the information conveyed influenced or was reflected in any way in the committee’s advice, recommendations, or report to the President or Vice President.</text></paragraph></subsection> 
<subsection id="H50C3F730D4E940E68CACB99CBFFBB7"><enum>(c)</enum><header>Applicability</header><text>The requirements of this section do not apply to substantive contacts exclusively with the President or the Vice President or their immediate personal staff.</text></subsection></section> 
<section id="H612A75D84490487F8BEB2BEDC876386"><enum>8.</enum><header>Promotion of timely declassification of Government documents</header> 
<subsection id="H9599F69F7202480BA3219CD0F2EE7044"><enum>(a)</enum><header>Funding</header><text>Section 708 of the Public Interest Declassification Act of 2000 (title VII of <external-xref legal-doc="public-law" parsable-cite="pl/106/567">Public Law 106–567</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/435">50 U.S.C. 435</external-xref> note; 114 stat. 2856) is amended by adding at the end the following new subsection: </text> 
<quoted-block style="OLC" id="HFE6EA7AF26DE47FD0021C306EDC3FEBC" display-inline="no-display-inline"> 
<subsection id="H6D5F7C9117A04F19BBEA714DCF65CE88"><enum>(c)</enum><header>Funding</header><text>For any fiscal year in which funds appropriated pursuant to the authorization in subsection (a) are insufficient, as determined by the Archivist of the United States, to support the activities of the Board, the Archivist shall levy from each agency, and may retain, a fee of not more than $0.005 per page classified by each agency. The Archivist shall use the fees retained under this section to fund the activities of the Board. Fees received in a fiscal year and retained under this section shall remain available for obligation until expended.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFF3638044CE940C7A926671169E36881"><enum>(b)</enum><header>Sunset</header><text>Subsection (b) of section 710 of such Act is amended to read as follows:</text>

<subsection id="H310BBDA4E19543C69C9CC02E46A2DF33"><enum>(b)</enum><header>Sunset</header><text>The provisions of this title shall expire 8 years after the date of the enactment of the Restore Open Government Act of 2005.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H9BE00A44B2384F81AE136B2B194E5E3B"><enum>9.</enum><header>Improvements to operation of Freedom of Information Act</header> 
<subsection id="H055EF95B997D48929E02A8C931471646"><enum>(a)</enum><header>Restoration of the integrity of the Freedom of Information Act by limiting the broad exemption for critical infrastructure information under the Homeland Security Act of 2002</header> 
<paragraph id="H5F1A1606AB744A138809899B1201D1D8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended by striking subtitle B and inserting the following:</text>

<subtitle id="H5754C1945E104A21917C03F7FD29184D"><enum>B</enum><header>Protection of Voluntarily Furnished Confidential Information</header> 
<section id="H97F31865FD8B42BE8929F42330660085"><enum>211.</enum><header>Protection of voluntarily furnished confidential information</header> 
<subsection id="HCFCD1EC56433498D82A4C6151B4D3C28"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFAE98BCD643B40E2B7DEB0DC83FCC9"><enum>(1)</enum><header>Critical infrastructure</header><text>The term <quote>critical infrastructure</quote> has the meaning given that term in section 1016(e) of the USA PATRIOT ACT of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text></paragraph> 
<paragraph id="H8854434030FB42838726F38BDF32531B"><enum>(2)</enum><header>Furnished voluntarily</header> 
<subparagraph id="H9EE5F7CAC3AA46698700A51E704F2821"><enum>(A)</enum><header>Definition</header><text>The term <quote>furnished voluntarily</quote> means a submission of a record that—</text> 
<clause id="H5C41A71F41374AB78000CCBFDD612D87"><enum>(i)</enum><text>is made to the Department in the absence of authority of the Department requiring that record to be submitted; and</text></clause> 
<clause id="H0769775D679847D7A06EC45237E052F"><enum>(ii)</enum><text>is not submitted or used to satisfy any legal requirement or obligation or to obtain any grant, permit, benefit (such as agency forbearance, loans, or reduction or modifications of agency penalties or rulings), or other approval from the Government.</text></clause></subparagraph> 
<subparagraph id="HF6C93534685C45AA825BE064198E48B3"><enum>(B)</enum><header>Benefit</header><text>In this paragraph, the term <quote>benefit</quote> does not include any warning, alert, or other risk analysis by the Department.</text></subparagraph></paragraph></subsection> 
<subsection id="H15CFAF15FE164FF4AD1FC4779500E537"><enum>(b)</enum><header>In general</header><text>Notwithstanding any other provision of law, a record pertaining to the vulnerability of and threats to critical infrastructure (such as attacks, response, and recovery efforts) that is furnished voluntarily to the Department shall not be made available under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, if—</text> 
<paragraph id="H56B60FBD7E7440C2003EE844DBFCB035"><enum>(1)</enum><text>the provider would not customarily make the record available to the public; and</text></paragraph> 
<paragraph id="H4FBB8B5F52A647A6AB23423F4DB799A6"><enum>(2)</enum><text>the record is designated and certified by the provider, in a manner specified by the Department, as confidential and not customarily made available to the public.</text></paragraph></subsection> 
<subsection id="H10585021F4E4479CAD00D75EE8795514"><enum>(c)</enum><header>Records shared with other agencies</header> 
<paragraph id="H9F29893458C94284AEA25B267DD0363B"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H109380C7C6DF463AB2F4D052AB20F2E"><enum>(A)</enum><header>Response to request</header><text>An agency in receipt of a record that was furnished voluntarily to the Department and subsequently shared with the agency shall, upon receipt of a request under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, for the record—</text> 
<clause id="HE65CCFCD0140409DB241681FE1D71DBE"><enum>(i)</enum><text>not make the record available; and</text></clause> 
<clause id="H8CBEB91BE3A74AD384BBB298123828B3"><enum>(ii)</enum><text>refer the request to the Department for processing and response in accordance with this section.</text></clause></subparagraph> 
<subparagraph id="H97B87CC54AB34FB7A0B9FB1B3B32BA00"><enum>(B)</enum><header>Segregable portion of record</header><text>Any reasonably segregable portion of a record shall be provided to the person requesting the record after deletion of any portion which is exempt under this section.</text></subparagraph></paragraph> 
<paragraph id="H8582389882F8455DAD8C177BE28200DF"><enum>(2)</enum><header>Disclosure of independently furnished records</header><text>Notwithstanding paragraph (1), nothing in this section shall prohibit an agency from making available under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, any record that the agency receives independently of the Department, regardless of whether or not the Department has a similar or identical record.</text></paragraph></subsection> 
<subsection id="HFF61C94CB627473180BF60B26BAF6215"><enum>(d)</enum><header>Withdrawal of confidential designation</header><text>The provider of a record that is furnished voluntarily to the Department under subsection (b) may at any time withdraw, in a manner specified by the Department, the confidential designation.</text></subsection> 
<subsection id="HF37B3292496A423C83D55C9EDBACB83"><enum>(e)</enum><header>Procedures</header><text>The Secretary shall prescribe procedures for—</text> 
<paragraph id="H717207B934C44E14A14ECCA65D1184F2"><enum>(1)</enum><text>the acknowledgement of receipt of records furnished voluntarily;</text></paragraph> 
<paragraph id="H2C7836CC66A94D5E9327DA8F11B1C300"><enum>(2)</enum><text>the designation, certification, and marking of records furnished voluntarily as confidential and not customarily made available to the public;</text></paragraph> 
<paragraph id="HCA51FF38AFDA4A1C8D3658F2D38DC60"><enum>(3)</enum><text>the care and storage of records furnished voluntarily;</text></paragraph> 
<paragraph id="HF31D906943C84FA2A3BE02C8B59BFC6"><enum>(4)</enum><text>the protection and maintenance of the confidentiality of records furnished voluntarily; and</text></paragraph> 
<paragraph id="H1DD11AA671944F31818C0471058BAEBC"><enum>(5)</enum><text>the withdrawal of the confidential designation of records under subsection (d).</text></paragraph></subsection> 
<subsection id="HD51D6563D74D4EDAB5722695B5F9CBDB"><enum>(f)</enum><header>Effect on State and local law</header><text>Nothing in this section shall be construed as preempting or otherwise modifying State or local law concerning the disclosure of any information that a State or local government receives independently of the Department.</text></subsection> 
<subsection id="H97A66C4D66A74E4D91B196824236B800"><enum>(g)</enum><header>Report</header> 
<paragraph id="HD71060F88B0E4EA4ADC0019CE85F0C7"><enum>(1)</enum><header>Requirement</header><text>Not later than 18 months after the date of the enactment of the Restore Open Government Act of 2005, the Comptroller General of the United States shall submit to the committees of Congress specified in paragraph (2) a report on the implementation and use of this section, including—</text> 
<subparagraph id="HDADE332A541A471C9400364CA655D0D2"><enum>(A)</enum><text>the number of persons in the private sector, and the number of State and local agencies, that furnished voluntarily records to the Department under this section;</text></subparagraph> 
<subparagraph id="H3F932CA2B3F9482DBFBA6CCD8ED87348"><enum>(B)</enum><text>the number of requests for access to records granted or denied under this section; and</text></subparagraph> 
<subparagraph id="H5D6604C13C214A0CA03F241B1D29A573"><enum>(C)</enum><text>such recommendations as the Comptroller General considers appropriate regarding improvements in the collection and analysis of sensitive information held by persons in the private sector, or by State and local agencies, relating to vulnerabilities of and threats to critical infrastructure, including the response to such vulnerabilities and threats.</text></subparagraph></paragraph> 
<paragraph id="HF2B28685E09B4AB4A4897C0348921300"><enum>(2)</enum><header>Committees of Congress</header><text>The committees of Congress specified in this paragraph are—</text> 
<subparagraph id="H8D7A59618235488C9594B167B142F7A8"><enum>(A)</enum><text>the Committees on the Judiciary and Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph> 
<subparagraph id="HBB86BFF20E7E4BDDB3D7477CCF4334DF"><enum>(B)</enum><text>the Committees on the Judiciary and Government Reform of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="HF178060847FC46AD81C35F847D47EE91"><enum>(3)</enum><header>Form</header><text display-inline="yes-display-inline">The report shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8605E5F4C6BE468986E809FD92FD5EFF"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended by striking the items relating to subtitle B of title II and sections 211 through 215 and inserting the following:</text>

<paragraph id="H648157E57D6F4824A2C776CF066C11F"><enum>(1)</enum><header>Additional matters covered by report</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552(e)(1)</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="H65B9547871014EFBB7009819BB7DF0E3"><enum>(A)</enum><text>by striking <quote>fiscal year and which</quote> and inserting <quote>fiscal year. Information in the report shall be expressed in terms of each principal component of the agency and</quote>;</text></subparagraph> 
<subparagraph id="HB50D9D568BCD476894EE276452CD00EF"><enum>(B)</enum><text>in subparagraph (E), by inserting before the semicolon <quote>, based on the date on which the requests were originally filed with the agency</quote>; and</text></subparagraph>

<subparagraph id="H0888D18B020B46B795F4C4009B5CA576"><enum>(H)</enum><text>data on the 10 active administrative appeals with the earliest filing dates pending before the agency as of September 30 of the preceding year, including the number of business days that have elapsed since the requests were originally filed with the agency;</text></subparagraph> 
<subparagraph id="H8444D33948EE494CAE7C241DC16B8E62"><enum>(I)</enum><text>the median and average number of days for the agency to respond to administrative appeals based on the date on which the appeals originally were filed with the agency; the highest number of business days taken by the agency to respond to an administrative appeal; and the lowest number of business days taken by the agency to respond to an administrative appeal;</text></subparagraph> 
<subparagraph id="HA61F233E287448188968AE04D2BD99CB"><enum>(J)</enum><text>the number of fee status requests that are granted and denied, and the average number of days for adjudicating fee status determinations; </text></subparagraph> 
<subparagraph id="HE935AB8017B24328A4E7144F3CE69FC4"><enum>(K)</enum><text>the number of expedited review requests that are granted and denied, and the average number of days for adjudicating expedited review requests;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HEE406A3308AE495200F349446383E303"><enum>(2)</enum><header>No aggregation of reports</header><text>Section 552(e) of such title is further amended by adding at the end the following new paragraph:</text>

<paragraph id="HB596FACACA2A471981DE827D90CB2C39" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The reports required by this section shall not aggregate requests for records to the agency made under subsection (a) with requests for records to the agency made by first parties under section 552a of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1DD86F66CBBF4E5AA63F03DFCEC3B700"><enum>(c)</enum><header>Increased feasibility of citizen group challenges to improper withholding of Government information</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552(a)(4)(E)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H7CE90950BE754E56A5F35CB7AFA52810"><enum>(1)</enum><text>by inserting <quote>, or in any case seeking information from a Federal agency or official under any other Federal law,</quote> after <quote>case under this section</quote>; and</text></paragraph> 
<paragraph id="HB27D7874FC2A4BFDA47D7B2ECE19CD42"><enum>(2)</enum><text>by adding at the end the following: <quote>For purposes of this section, a complainant has <quote>substantially prevailed</quote> if the complainant has obtained some of its requested relief through a judicial or administrative order or an enforceable written agreement, or if the complainant’s pursuit of a nonfrivolous claim or defense has been a catalyst for a voluntary or unilateral change in position by the opposing party that provides any significant part of the relief sought.</quote>.</text></paragraph></subsection></section>
