<official-title>To establish a grant program to provide follow-up treatment for children identified to have a vision disorder.</official-title>

<section section-type="section-one" id="HF45FC01DA0B84BF7ADDD8E388C5293AA" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Access to Vision Act of 2005</short-title></quote>. </text></section> 
<section id="H9CB8B0D200254299A2699B701E5DFEEB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> 
<paragraph id="HCAB94E998F044E00B1EFB108D8F136EE"><enum>(1)</enum><text>Good vision is essential for proper physical development and educational progress in growing children.</text></paragraph> 
<paragraph id="H5B4DC5984FF14FE1B75EAC9160070F4"><enum>(2)</enum><text>Many serious ocular conditions are treatable if identified in the preschool and early school-aged years.</text></paragraph> 
<paragraph id="H06460BF85AD64B55A1E0143F17385C2B"><enum>(3)</enum><text>Early detection of ocular conditions provides the best opportunity for effective, inexpensive treatment and can have far reaching implications for vision.</text></paragraph> 
<paragraph id="H5E67B6B0433340B1B000B3571E334059"><enum>(4)</enum><text display-inline="yes-display-inline">Widespread use of identification methods, whether vision screening programs, or comprehensive eye exams required by State law, will identify children needing services. A child identified through vision screening should receive a comprehensive eye exam followed by subsequent treatment as needed. A child identified through a comprehensive eye exam should receive subsequent treatment as needed. All children identified as needing services should have access to subsequent treatment as needed.</text></paragraph> </section> 
<section id="H319E181C36AF43709FC81C2B365EC129"><enum>3.</enum><header>Grants regarding comprehensive eye examinations for children</header> 
<subsection id="HC2B4DE57086B48FB9B78CDC6AD49B7CF"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), acting through the Director of the Centers for Disease Control and Prevention, may make grants to States on the basis of an established review process for the purpose of—</text> 
<paragraph id="H0BAF9A0EFB64458EB14FEF6C3AF005C"><enum>(1)</enum><text>providing comprehensive eye examinations for children who have been identified by a licensed health care provider or vision screener as needing such services, with priority given to children who are under the age of 9;</text></paragraph> 
<paragraph id="H1E385C50D75D4AFFA27E236491EF636C"><enum>(2)</enum><text>providing for children subsequent treatment or services necessary to correct vision problems; and</text></paragraph> 
<paragraph id="H58938E8D7DDA42DDAFD384D2DEAE7DB0"><enum>(3)</enum><text>developing and disseminating, to parents, teachers, and health care practitioners, educational materials on recognizing signs of visual impairment in children.</text></paragraph></subsection> 
<subsection id="H7604360879324D9B92B213A41C9B00"><enum>(b)</enum><header>Criteria and coordination</header> 
<paragraph id="H9983538F6D15443CB7A4D5A3AB4DCC58"><enum>(1)</enum><header>Criteria</header><text>The Secretary, in consultation with appropriate professional and consumer organizations including individuals with knowledge of age appropriate vision services, shall develop criteria—</text> 
<subparagraph id="H685B60C9045B4196BA98028E2308F65E"><enum>(A)</enum><text>governing the operation of the grant program; and</text></subparagraph> 
<subparagraph id="H97A740CE3AF84DC3A2649DC492A4A2DD"><enum>(B)</enum><text>for the collection of data related to vision assessment and the utilization of followup services.</text></subparagraph></paragraph> 
<paragraph id="H22C60A6812D74EE4A4098902BF88E024"><enum>(2)</enum><header>Coordination</header><text>The Secretary shall, as appropriate, coordinate the program under subsection (a) with the program under section 330 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (relating to health centers), the program under title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name> (relating to the Medicaid program), the program under title XXI of such Act (relating to the State children’s health insurance program), and with other Federal or State program that provide services to children.</text></paragraph></subsection> 
<subsection id="H6B162F540C0A44F797E8AC2832BE7614"><enum>(c)</enum><header>Application</header><text>A grant may be made under subsection (a) only if an application for the grant is submitted to the Secretary and the application is in such form, is made in such manner, and contains such information as the Secretary may require, including—</text> 
<paragraph id="H2F9ED585DAF6413B82692856004F9C7D"><enum>(1)</enum><text>information on existing Federal, Federal-State, or State-funded children’s vision screening programs;</text></paragraph> 
<paragraph id="HFF3D181914A547F190BD5EEC96BC9127"><enum>(2)</enum><text>a plan for the use of grant funds, including how funds will be used to complement existing State efforts;</text></paragraph> 
<paragraph id="H274C0549BF5D4FCAB5EC00F86E4EBDBD"><enum>(3)</enum><text>a plan to determine if a grant eligible child has received an age appropriate vision screening; and</text></paragraph> 
<paragraph id="HAEC857FAAC14428885D17D00FF330000"><enum>(4)</enum><text>a description of how funds will be used to provide items or services only as a secondary payer to—</text> 
<subparagraph id="HC271AC81631940ADA289EDD41276EA5E"><enum>(A)</enum><text>any State compensation program, under an insurance policy, or under any Federal or State health benefits program; or</text></subparagraph> 
<subparagraph id="HFAD816D7FA72478EAC19F1CE23315E09"><enum>(B)</enum><text>by any entity that provides health services on a prepaid basis.</text></subparagraph></paragraph></subsection> 
<subsection id="HBAE6FC042ADF4C8AA3FBA0F019A55F07"><enum>(d)</enum><header>Evaluations</header><text>A grant may be made under subsection (a) only if the State involved agrees that, not later than 1 year after the date on which amounts under the grant are first received by the State, and annually thereafter while receiving amounts under the grant, the State will submit to the Secretary an evaluation of the operations and activities carried out under the grant, including—</text> 
<paragraph id="H706B212E945F4CFB881E027E7FCF84D7"><enum>(1)</enum><text>an assessment of the utilization of vision services and the status of children receiving these services as a result of the activities carried out under the grant;</text></paragraph> 
<paragraph id="HC350E991515B42AFA9762D2C021C57BE"><enum>(2)</enum><text>the collection, analysis, and reporting of children’s vision data according to guidelines prescribed by the Secretary; and</text></paragraph> 
<paragraph id="H79ABF81A356743B3A88428146E6CCBB"><enum>(3)</enum><text>such other information as the Secretary may require.</text></paragraph></subsection> 
<subsection id="H54E1837DE6F74E0A8CFA5005DE1779D2" display-inline="no-display-inline"><enum>(e)</enum><header>Certain provisions regarding expenditure of grant</header> 
<paragraph id="H006DCF5F39B7464EB936B0E591540073"><enum>(1)</enum><header>Uses other than comprehensive eye examinations</header><text>A grant under subsection (a) may be expended for the purposes described in paragraphs (2) and (3) of such subsection without regard to whether under paragraph (1) of such subsection the State involved expends the grant to provide comprehensive eye examinations. The Secretary may not disapprove an application under subsection (c), or reduce the amount of the grant, solely on the basis that the State will not expend the grant to provide such examinations.</text></paragraph> 
<paragraph id="H73D9CBDD83CD48898ECBB2767284BB91"><enum>(2)</enum><header>Limitation on grant expenditures</header><text>A grant may be made under subsection (a) only if the State involved agrees that the State will not expend more than 20 percent of the grant to carry out the purpose described in paragraph (3) of such subsection.</text> </paragraph></subsection> 
<subsection id="H7CC35D09C62C4381A7E9F3E0EF658E20"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section, the term <term>comprehensive eye examination</term> includes an assessment of a patient’s history, general medical observation, external and ophthalmoscopic examination, visual acuity, ocular alignment and motility, refraction, and as appropriate, binocular vision or gross visual fields, performed by an optometrist or an ophthalmologist.</text> </subsection> 
<subsection id="HE17FFBB6AAF642A09344B4C8CB602921"><enum>(g)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated $75,000,000 for fiscal year 2006, and such sums as may be necessary for each of fiscal years 2007 through 2009.</text> </subsection></section>
