<official-title>To reduce acid deposition under the Clean Air Act, and for other purposes.</official-title>

<section id="H6EC723DE33D04994A1DD132E844CE700" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Acid Rain Control Act</short-title></quote>.</text></section> 
<section id="H760D390506FC4A85003625F0E15DA084"><enum>2.</enum><header>Reduction in total annual emissions of sulfur dioxide by utility units</header><text display-inline="no-display-inline">The second sentence of section 403(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7651b">42 U.S.C. 7651b</external-xref>) is amended by striking the period at the end and inserting <quote>, and such 8.90 million tons amount shall be reduced to 4.45 million tons for each of calendar years 2010, 2011, 2012, and 2013, and shall be further reduced to 3 million tons for calendar years thereafter.</quote>.</text></section> 
<section id="HF6A9E860C18C4EA1B900E32E52BC6777"><enum>3.</enum><header>Reduction in total annual emissions of nitrogen oxides by affected facilities</header> 
<subsection id="H2E8DA4AB2C834B9AA080FFC52DACA95"><enum>(a)</enum><header>Total annual emissions</header><text>The Administrator of the Environmental Protection Agency shall ensure that total annual emissions of nitrogen oxides by affected facilities in the 50 States and the District of Columbia do not exceed—</text> 
<paragraph id="H80E9EBF9FCFB49D0820000C763148000"><enum>(1)</enum><text>2.10 million tons for each of calendar years 2010, 2011, 2012, and 2013; and</text></paragraph> 
<paragraph id="HA35A1C4B40CC4DA69FBBF7038A6A21D"><enum>(2)</enum><text>1.70 million tons for calendar year 2014 and each calendar year thereafter.</text></paragraph></subsection> 
<subsection id="HB80AE119390540B89E487997BFEBA0F2"><enum>(b)</enum><header>Penalty</header><text>The owner or operator of any affected facility that emits nitrogen oxides for any calendar year after 2009 in excess of the facility’s emissions limitation requirement, or any allowance the owner or operator holds for the facility for that calendar year, under regulations promulgated under this Act or title IV of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7651">42 U.S.C. 7651 et seq.</external-xref>)—</text> 
<paragraph id="H1187D991F9C04B98B8B200DB1A14C35"><enum>(1)</enum><text>shall be liable for the payment of an excess emissions penalty under section 411 of such title (<external-xref legal-doc="usc" parsable-cite="usc/42/7651j">42 U.S.C. 7651j</external-xref>), except that the penalty shall be calculated on the basis of the number of tons emitted in excess of the facility’s emissions limitation requirement multiplied by $6,000; and</text></paragraph> 
<paragraph id="H9DD920FCC1574CE9B3407C6C00CC21CC"><enum>(2)</enum><text>shall be liable to offset the excess emissions by an equal tonnage amount in the manner applicable under section 411 of such title (<external-xref legal-doc="usc" parsable-cite="usc/42/7651j">42 U.S.C. 7651j</external-xref>) to the owner or operator of any affected source that emits excess sulfur dioxide.</text></paragraph></subsection> 
<subsection id="H5380353A652A4A9FBCDD03E1DDD3D500"><enum>(c)</enum><header>Affected facility</header><text>For purposes of this section, the term <quote>affected facility</quote> means a facility with 1 or more combustion units that serve at least 1 electricity generator with a capacity not less than 25 megawatts.</text></subsection></section> 
<section id="HDBD10D35CA4242BEAE60845F9632DD57"><enum>4.</enum><header>Mercury emission control</header> 
<subsection id="H3377A445AD904FFCBA492C6E8053FC6D"><enum>(a)</enum><header>Regulation</header><text>Not later than March 15, 2005, the Administrator shall promulgate a regulation controlling electric utility and industrial source emissions of mercury in the 50 States and the District of Columbia.</text></subsection> 
<subsection id="H5C006D81B7F84704AD3DAA77B7971CA"><enum>(b)</enum><header>Prohibition on transfer</header><text>The Administrator may not allow any electric utility or other industrial source to transfer any mercury emission allowance.</text></subsection></section> 
<section id="H5FF17C5AB3AD4A0A9394F2667C81655"><enum>5.</enum><header>Regulations</header> 
<subsection id="HADDA1B42300A419DB884BE46B372C4D"><enum>(a)</enum><header>In general</header><text>The Administrator shall promulgate regulations to carry out sections 2, 3, and 4 that—</text> 
<paragraph id="HDCAB4334B0DD4331835B2531A56F3375"><enum>(1)</enum><text>may, except in the case of mercury, provide for market-oriented mechanisms, such as emissions trading, auctions, or other allocation methods;</text></paragraph> 
<paragraph id="HDE3E59C39AFD40D2A73F89B98B00F122"><enum>(2)</enum><text>shall prevent localized adverse effects on public health and the environment; and</text></paragraph> 
<paragraph id="HDF003B902D9F451EB8D903AF0A38751"><enum>(3)</enum><text>shall ensure that significant emission reductions are achieved in both the Eastern and Western Regions of the United States.</text></paragraph></subsection> 
<subsection id="HA6EE212C94814D99865F729C4E89C5E2"><enum>(b)</enum><header>Deadline</header><text>The Administrator shall promulgate—</text> 
<paragraph id="H0514B4AFD24D4A0AACA9CA5DDD984B2B"><enum>(1)</enum><text>the regulations required under subsection (a) to carry out sections 2 and 3 not later than 2 years after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H2F25928FFD55409F94193200E26148D3"><enum>(2)</enum><text>the regulations required under subsection (a) to carry out section 4 not later than March 15, 2005.</text></paragraph></subsection></section> 
<section id="HDE458EDD8B0745B8B96E5E011445A480"><enum>6.</enum><header>Regional ecosystems</header> 
<subsection id="H5DB0BACA446C453AA8CDA2FC889EC063"><enum>(a)</enum><header>Report</header> 
<paragraph id="HDA33F374D06D4DA1BF65EE38C500FA4F"><enum>(1)</enum><header>In general</header><text>Not later than December 31, 2009, the Administrator shall submit to the Congress a report identifying objectives for scientifically credible environmental indicators, as determined by the Administrator, that are sufficient to protect sensitive ecosystems of the Adirondack Mountains, mid-Appalachian Mountains, Rocky Mountains, and Southern Blue Ridge Mountains, and water bodies of the Great Lakes, Lake Champlain, Long Island Sound, and the Chesapeake Bay.</text></paragraph> 
<paragraph id="H5363C976F47A4960856DAA9DF1B65DD9"><enum>(2)</enum><header>Acid neutralizing capacity</header><text>The report shall—</text> 
<subparagraph id="HD8DDEF1C663148FEBF55C18BDEF500"><enum>(A)</enum><text>include acid neutralizing capacity as an indicator; and</text></subparagraph> 
<subparagraph id="H97835D796EAC410F00D064F590DC162C"><enum>(B)</enum><text>identify as an objective the objective of increasing the proportion of water bodies in sensitive receptor areas with an acid neutralizing capacity greater than zero from the proportion identified in surveys begun in 1984.</text></subparagraph></paragraph> 
<paragraph id="H4247228963D04D0E8E11E543C09D4E52"><enum>(3)</enum><header>Updated report</header><text>Not later than December 31, 2013, the Administrator shall submit to the Congress a report updating the report under paragraph (1) and assessing the status and trends of various environmental indicators for the regional ecosystems referred to in paragraph (1).</text></paragraph> 
<paragraph id="H8FFD92DAB4B445CCA145034BE3D857B8"><enum>(4)</enum><header>Reports under the national acid precipitation assessment program</header><text>The reports under this subsection shall be subject to the requirements applicable to a report under section 103(j)(3)(E) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403(j)(3)(E)</external-xref>).</text></paragraph></subsection> 
<subsection id="HF414652012F64B8BA1D0A1ADC13A2B1"><enum>(b)</enum><header>Regulations</header> 
<paragraph id="H51222CEC30984F98A445D46700E49780"><enum>(1)</enum><header>Determination</header><text>Not later than December 31, 2013, the Administrator shall determine whether emissions reductions called for in this Act are sufficient to ensure achievement of the objectives stated in subsection (a)(1).</text></paragraph> 
<paragraph id="H4C9B81786FBE4B94A4B1D9005EABF525"><enum>(2)</enum><header>Promulgation</header><text>If the Administrator finds under paragraph (1) that emission reductions are not sufficient to ensure achievement of the objectives identified in subsection (a)(1), the Administrator shall promulgate, not later than 2 years after making the finding, such regulations, including modification of nitrogen oxides and sulfur dioxide allowance allocations or any such measure, as the Administrator determines are necessary to protect the sensitive ecosystems described in subsection (a)(1).</text></paragraph></subsection></section> 
<section id="H3E285DC5CFE64EC6B881A374315ECFC8"><enum>7.</enum><header>Administrator</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>Administrator</quote> means the Administrator of the Environmental Protection Agency.</text></section>
