<section id="H09053965EC4B403FA2A476B1BC72AD00" section-type="section-one"><enum>1.</enum><header>Limitation on severe reduction in the medicaid FMAP for fiscal year 2006</header> 
<subsection id="HDC7D846B543A48B1A115FCA4AB6E04CD"><enum>(a)</enum><header>Limitation on reduction</header><text>In no case shall the FMAP for a State for fiscal year 2006 be less than the greater of the following:</text> 
<paragraph id="H4F254B52D80544B3BC5655BC1D8C3E20"><enum>(1)</enum><header>Half percentage point decrease</header><text>The FMAP determined for the State for fiscal year 2005, decreased by 0.5 percentage points.</text></paragraph> 
<paragraph id="H24369506EBC241398DEBE97D00044430"><enum>(2)</enum><header>Computation without retroactive application of rebenchmarked per capita income</header><text>The FMAP that would have been determined for the State for fiscal year 2006 if the per capita incomes for 2001 and 2002 that were used to determine the FMAP for the State for fiscal year 2005 were used.</text></paragraph></subsection> 
<subsection id="H00BB3ED4EF824DFCBEECBAAA1F07BD83"><enum>(b)</enum><header>Scope of application</header><text>The FMAP applicable to a State for fiscal year 2006 after the application of subsection (a) shall apply only for purposes of titles XIX and XXI of the <act-name parsable-cite="SSA">Social Security Act</act-name> (including for purposes of making disproportionate share hospital payments described in section 1923 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4</external-xref>) and payments under such titles that are based on the enhanced FMAP described in section 2105(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(b)</external-xref>)) and shall not apply with respect to payments under title IV of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></subsection> 
<subsection id="H9B54EF5A66AC40D58DBCDB4F9F753121"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HE6947CA628F741FF841E65CBC3E91E5E"><enum>(1)</enum><header>FMAP</header><text>The term <term>FMAP</term> means the Federal medical assistance percentage, as defined in section 1905(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>).</text></paragraph> 
<paragraph id="HBD8E40C907DC4C558300FAF10844D400"><enum>(2)</enum><header>State</header><text>The term <term>State</term> has the meaning given such term for purposes of title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>).</text></paragraph></subsection></section> 
<section id="HCED661BB04C443E9B7461B00E6494569"><enum>2.</enum><header>Repeal</header><text display-inline="no-display-inline">Effective as of October 1, 2006, section 1 is repealed and shall not apply to any fiscal year after fiscal year 2006.</text></section>
