<official-title>To require the Attorney General to investigate allegations of violations of Federal criminal law regarding elections not later than 30 days after receiving the allegation, to amend the Help America Vote Act of 2002 to establish standards for the distribution of voter registration application forms and the handling of absentee ballots, to require individuals to produce photo identification as a condition of registering to vote or voting in elections for Federal office, and for other purposes.</official-title>

<section id="H64E0ACC35BAD4A2698FE8618A900459D" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Valuing Our Trust in Elections Act</short-title></quote>.</text></section> 
<section id="H3DD93BA5CAF2472E93B43427131FC407"><enum>2.</enum><header>Timetable for Investigation of Allegations of Violations of Criminal Law Regarding Elections</header> 
<subsection id="H1E31D1E7E85041E500859F00C8F99FC8"><enum>(a)</enum><header>30-Day Deadline for Initiation of Investigation</header> 
<paragraph id="HB5D2FA069E4443D1B9F96C834400394E"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, not later than 30 days after receiving a complaint or other allegation of a violation of any Federal criminal law regarding voter intimidation, election fraud, or any provision relating to voting or registering to vote in elections for Federal office, including section 3(b), the Attorney General shall initiate an investigation of the complaint or allegation, and shall notify the chief election official of the State involved of the status of the investigation every 60 days until the investigation is completed.</text></paragraph> 
<paragraph id="HEAD92227D16F4485806547A7BC7E7900"><enum>(2)</enum><header>Exception for complaints unaccompanied by evidence</header><text>Paragraph (1) shall not apply with respect to a complaint or allegation received by the Attorney General if the person filing the complaint or allegation does not provide any evidence to support the complaint or allegation.</text> </paragraph></subsection> 
<subsection id="H67AC31517A844E7B9BF4773EAED9E7CF"><enum>(b)</enum><header>Effect on State Enforcement</header><text>Nothing in this section may be construed to prohibit a State from investigating complaints or allegations of violations of the offenses referred to in subsection (a), so long as the State does not interfere with or otherwise impede the investigation initiated by the Attorney General.</text></subsection> 
<subsection id="H3F520BACCDC642D1BC9D28A897F913FA"><enum>(c)</enum><header>Effective Date</header><text>This section shall apply with respect to complaints and allegations received by the Attorney General on or after the date of the enactment of this Act. </text></subsection></section>
<section id="HCDDF221C89AD44B2B8BC85FE74ECE496"><enum>3.</enum><header>Standards For Distribution of Voter Registration Application Forms</header> 
<subsection id="HC6B68A3130FD48069DC2D8DC837EB66"><enum>(a)</enum><header>Requiring States to Establish Standards</header><text>Section 303 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>) is amended—</text> 
<paragraph id="HB812C6B71C4945FA8C953C05A4A29C85"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="H43D6EC5D45B44F8E9EC700B7BD971886"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text> 
<quoted-block style="OLC" id="H56BE7DE3791140A386B9DAEFC70097C4" display-inline="no-display-inline"> 
<subsection id="H5757AC492DEE41C1B507677800CA808D"><enum>(d)</enum><header>Standards For Distribution and Transmittal of Voter Registration Application Forms</header> 
<paragraph id="HF29602425C1F4FB19B3765D5CA86FAD9"><enum>(1)</enum><header>Distribution of forms</header> 
<subparagraph id="HBB4143001D174FB6A77B00B2ABD8545E"><enum>(A)</enum><header>Establishment of standards</header><text>Each State shall establish standards for the distribution of voter registration application forms for elections for Federal office under which an individual shall be prohibited from distributing any such form if the individual—</text> 
<clause id="H97C8261FE982401BBCCC53611B3C9BA8"><enum>(i)</enum><text>has been convicted of a felony under any State or Federal law;</text></clause> 
<clause id="HA64496D603204822BB4CD0268D444E99"><enum>(ii)</enum><text>does not provide identifying information (including the individual’s name, address, and other appropriate contact information, including the name and address of any organization which pays the individual to distribute such forms) to each individual to whom the individual distributes such a form; or</text></clause> 
<clause id="HAEB61BEB3374478500AA6C00967C18D0"><enum>(iii)</enum><text>does not meet any other requirements imposed by the State.</text></clause></subparagraph> 
<subparagraph id="HDA8C7675F2824818920079CC88C6C35"><enum>(B)</enum><header>Exception for certain distributions</header><text>Subparagraph (A) shall not apply in the case of the distribution of a voter registration application form—</text> 
<clause id="HCF9AB6A041BF47B1B351889E653EBA2D"><enum>(i)</enum><text>by an individual to any member of the individual’s immediate family or to any individual who shares a residence with the individual;</text></clause> 
<clause id="H6E9AC680C43C40AEBE3772CA9374B6D9"><enum>(ii)</enum><text>by an individual who distributes 10 or fewer of such forms with respect to any election; or</text></clause> 
<clause id="H92BF64E851D040A394239C98FE2544CD"><enum>(iii)</enum><text>under such other circumstances as the State may provide.</text></clause></subparagraph></paragraph> 
<paragraph id="H28D151A000944B4B92DFA3FF381C3037"><enum>(2)</enum><header>Collection and transmittal of forms for chief state election official</header><text>Any individual who collects a voter registration application form for elections for Federal office and transmits the form to the chief State election official for verification by the election official shall include with each such form a statement signed by the individual under penalty of perjury that the applicant presented the individual with a current, valid, government-issued photo identification that matched the name and identifying information provided on the completed application form.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFDD74CB358864FFDA318009582FCB5E"><enum>(b)</enum><header>Penalties</header> 
<paragraph id="H0D3710352AE446068E957E5613E2467C"><enum>(1)</enum><header>Distribution and transmittal of forms by individuals not meeting standards</header><text>Any person who distributes a voter registration application form for elections for Federal office in a State who does not meet the standards established by the State for the distribution of such forms pursuant to section 303(d) of the Help America Vote Act of 2002 (as added by subsection (a)), or who collects and transmits a form which does not include the information required under section 303(d)(2), shall be guilty of a misdemeanor and fined in accordance with title 18, United States Code.</text></paragraph> 
<paragraph id="H1D6102E265E940089B42002C82325B28"><enum>(2)</enum><header>Employment of ineligible individual to distribute forms</header><text>Any person who employs an individual to distribute voter registration application forms for elections for Federal office in a State and who knows, or should reasonably be expected to know, that the individual does not meet the standards established by the State for the distribution of such forms pursuant to section 303(d) of the Help America Vote Act of 2002 shall be guilty of a misdemeanor and fined in accordance with title 18, United States Code.</text></paragraph></subsection> 
<subsection id="H3B8F831BB73F42299682003586DF1E15"><enum>(c)</enum><header>Effective Date</header> 
<paragraph id="H4A618AAF8F8C4AF1A02290CCAC30A41B"><enum>(1)</enum><header>Establishment of standards by States</header><text>Section 303(e) of the Help America Vote Act of 2002, as redesignated by subsection (a), is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HF21E7B55B9D649C09880AFD8BBAAC8AD" display-inline="no-display-inline"> 
<paragraph id="H70353FE00BF94523B87D00FE501DDAC9"><enum>(3)</enum><header>Standards for distribution of voter registration application forms</header><text display-inline="yes-display-inline">Each State shall be required to comply with the requirements of subsection (d) on and after the expiration of the 180-day period which begins on the date of the enactment of the Valuing Our Trust in Elections Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7B2972BD90E147ADAA236C33D2341192"><enum>(2)</enum><header>Adoption of voluntary guidance by Election Assistance Commission</header><text>Section 311(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15501">42 U.S.C. 15501(a)</external-xref>) is amended—</text> 
<subparagraph id="H89EBD69CACD841428EF3F13E00F2309E"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H6742DFDD72454248B0E8B7FF927EC8C"><enum>(B)</enum><text>in paragraph (3)—</text> 
<clause id="HAC720AFCD03848A49F5B3419965B8DDD"><enum>(i)</enum><text>by striking <quote>section 303</quote> and inserting <quote>section 303 (other than subsection (d))</quote>, and</text></clause> 
<clause id="HD6A98A0D1CD54492AA95C294335ECFD8"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> 
<clause id="HF79F17564D3940FD8062ED880042E185"><enum>(iii)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HEFE1085AC0B5420B97BA1B199D3E11D"><enum>(4)</enum><text>in the case of the recommendations with respect to section 303(d), 120 days after the date of the enactment of the Valuing Our Trust in Elections Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection> </section> 
<section id="H5057C95F77AE45989402D9AFF3439AA"><enum>4.</enum><header>Standards for Handling Absentee Ballots</header> 
<subsection id="H2B9597FD71A54811BBB443A023C02200"><enum>(a)</enum><header>Establishment of Standards by Election Assistance Commission</header> 
<paragraph id="HA01F6674E4724D1F9F533CD4D8CE357"><enum>(1)</enum><header>In general</header><text>Subtitle C of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15381">42 U.S.C. 15381 et seq.</external-xref>) is amended by inserting after section 246 the following new section:</text> 
<quoted-block style="OLC" id="H3957E6CAD6E44FC0B4B61D91A1535E6B" display-inline="no-display-inline"> 
<section id="H0622EBFC7A2345268EDE003E72D100B7"><enum>246A.</enum><header>Establishment of Standards for Handling Absentee Ballots</header> 
<subsection id="H79BB68C3A2C74215B953BB88B083B5E"><enum>(a)</enum><header>Establishment of Standards</header><text>The Commission shall establish standards for the prevention of fraud and abuse in the handling of absentee ballots in elections for Federal office, and shall include in the standards a prohibition against the handling of an absentee ballot by any individual other than the voter or any person authorized to handle material delivered to the individual (including a caregiver or guardian). </text></subsection> 
<subsection id="H39BFFE6441104BD29448CED8E3A18965"><enum>(b)</enum><header>Deadline; Revision</header><text display-inline="yes-display-inline">The Commission shall establish the standards required under this section not later than 120 days after the date of the enactment of the Valuing Our Trust in Elections Act, and shall review and (if necessary) revise the standards every 4 years thereafter.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4D69A4478D36425DBE9C142651C23512"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of subtitle C of title II of such Act is amended by inserting after the item relating to section 246 the following new item:</text>

<toc-entry level="section">Sec. 246A. Establishment of standards for handling absentee ballots</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H284EFD5E5CA548BE8D10B5186F190018"><enum>(b)</enum><header>Requiring States to Comply With Standards in Administering Elections</header> 
<paragraph id="H75D04E8480E746AD87902300EAC49195"><enum>(1)</enum><header>In general</header><text>Subtitle A of title III of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended by inserting after section 303 the following new section:</text>

<section id="H90E6CF75E97046D200AF7DD916456136"><enum>303A.</enum><header>Compliance With Standards For Handling Absentee Ballots</header> 
<subsection id="HA1FCAA8CD0E84FCB8F0043CDBA4805C3"><enum>(a)</enum><header>In General</header><text>Each State shall distribute, collect, and process absentee ballots in elections for Federal office in accordance with the standards established by the Commission under section 246A.</text></subsection> 
<subsection id="H3979784672F24E7BAF2C67A9BBE7842C"><enum>(b)</enum><header>Effective Date</header><text>This section shall take effect upon the expiration of the 60-day period which begins on the date the Commission establishes standards under section 246A.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H945213499ECF4F249DBA48C81F1B29C6"><enum>(2)</enum><header>Conforming amendment relating to enforcement of requirement</header><text>Section 401(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511(a)</external-xref>) is amended by striking <quote>sections 301, 302, and 303</quote> and inserting <quote>subtitle A of title III</quote>.</text></paragraph> 
<paragraph id="HF6F67AD7974B4FE2B48BF51978E5DF10"><enum>(3)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 303 the following new item:</text>

<subsection id="H64D0E70A07AC4067A102BD1E02FE1C44"><enum>(c)</enum><header>Penalties</header><text>Any person who knowingly and willfully handles an absentee ballot in an election for Federal office in a fraudulent manner shall be fined in accordance with title 18, United States Code.</text></subsection> </section> 
<section id="H66245B0A0F00431EA12C75BF6F14C3AD"><enum>5.</enum><header>Requiring Individuals Registering to Vote and Voters to Provide Photo Identification</header> 
<subsection id="H005AADD83B2949E7BC805DE2CBE38DA"><enum>(a)</enum><header>Individuals Registering to Vote</header><text>Section 303(a)(5)(A) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)(5)(A)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause id="H7A486987EF874BF3B16CF0220658D900"><enum>(iv)</enum><header>Photo identification</header> 
<subclause id="HC35799989E2D4900B4B7DDB377F865FB"><enum>(I)</enum><header>Requirement</header><text>Notwithstanding any other provision of law, an application for voter registration for an election for Federal office may not be accepted or processed by a State unless the applicant—</text> 
<item id="H24E4E5F6C90E4176B3C4A0C6219DBC00"><enum>(aa)</enum><text display-inline="yes-display-inline">presents to the election official accepting the application a current, valid, government-issued photo identification, in the case an applicant who presents the application in person to an election official, including any individual deputized by the State to accept and process such applications; or</text></item> 
<item id="HA7615930CDF04D13882738C772769E15"><enum>(bb)</enum><text>includes with the application a copy of a current, valid, government-issued photo identification, in the case of any other applicant.</text></item></subclause> 
<subclause id="H61384FA71245412CA32CAF00D9673DB"><enum>(II)</enum><header>Exception</header><text>A State may establish exceptions to the requirements of subclause (I) in the case of individuals who are unable to obtain photo identification because of disability or physical incapacity.</text></subclause> </clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD88DF13E0B0543FAB3EBA700125CF272"><enum>(b)</enum><header>Voters</header> 
<paragraph id="H1FBA1E948A1D42BAAAD2D35C988D4F34"><enum>(1)</enum><header>In general</header><text>Section 303(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)</external-xref>) is amended—</text> 
<subparagraph id="HE0DBF5ED463F48E786D4B3FCB12E2BB"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection">for Voters Who Register by Mail</header-in-text></quote> and inserting <quote><header-in-text level="subsection">for Providing Photo Identification</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="H3FD1991936C0465280B1AA564EBE8066"><enum>(B)</enum><text>by striking paragraphs (1) through (3) and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H9E58E2D1A76A4F7690951C7376456F54"> 
<paragraph id="H610231ACA3354608A5D4837C01E4CD4F"><enum>(1)</enum><header>Individuals voting in person</header><text>Notwithstanding any other provision of law, the appropriate State or local election official may not provide a ballot for an election for Federal office (including a provisional ballot under section 302(a)) to an individual who desires to vote in person unless the individual presents to the official a current, valid, government-issued photo identification.</text> </paragraph> 
<paragraph id="HA876DB56C4C44CD58CFAFDA8682CA2A6"><enum>(2)</enum><header>Individuals voting by mail</header><text>Notwithstanding any other provision of law, the appropriate State or local election official may not accept any ballot for an election for Federal office provided by an individual who votes by mail unless the individual submits with the ballot a copy of a current, valid, government-issued photo identification.</text></paragraph> 
<paragraph id="HE72A25A9773741F2AAD8001325AE774C"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">A State may establish exceptions to the requirements of paragraphs (1) and (2) in the case of individuals who are unable to obtain photo identification because of disability or physical incapacity.</text> </paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph id="H4549F1448CDB477AB96F962D24000261"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section">for voters who register by mail</header-in-text></quote> and inserting <quote><header-in-text level="section">for Providing Photo Identification</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="H2F8644B1D3764D5CBAC94F4600F4C39C"><enum>(B)</enum><text>in subsection (c), by striking <quote>subsections (a)(5)(A)(i)(II) and (b)(3)(B)(i)(II)</quote> and inserting <quote>subsection (a)(5)(A)(i)(II)</quote>.</text></subparagraph></paragraph>

<subsection id="H0AC322DD19D04640A915ACE4A776C1CC"><enum>(d)</enum><header>Requirement to provide photo identification</header><text>Subsections (a)(5)(A)(iv) and (b) shall apply with respect to the regularly scheduled general election for Federal office held in November 2006 and each succeeding election for Federal office.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBAED092543D342A8BD8B2BB4A6094BC6"><enum>(c)</enum><header>Providing Financial Assistance to States to Subsidize Costs to Individuals of Required Photo Identification</header> 
<paragraph id="HF676E99E8D0445F9B8CD70BCCF97E79"><enum>(1)</enum><header>In general</header><text>Subtitle D of title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15401">42 U.S.C. 15401 et seq.</external-xref>) is amended by adding at the end the following new part:</text>

<part id="H68FF14798E89456E92027E8273875B79"><enum>7</enum><header>Payments to Assist Low-Income Individuals in Obtaining Required Photo Identification</header> 
<section id="H43C8A17D50434DE5A1C2AD9C00C8EAAB"><enum>297.</enum><header>Financial Assistance to States to Subsidize Costs to Individuals of Required Photo Identification</header> 
<subsection id="H8F736D9006564E04AA9FD8C94CC72DA4"><enum>(a)</enum><header>In General</header><text>The Commission shall make payments to eligible States for assisting individuals with covering the costs of obtaining the government-issued photo identification an individual must present or provide in order to receive a ballot in an election for Federal office under section 303(b).</text></subsection> 
<subsection id="H2CBD3851D8994E1EA2D72EBE9735028D"><enum>(b)</enum><header>Use of Funds</header> 
<paragraph id="H2E8709B57C044FD6A814FAC013996E51"><enum>(1)</enum><header>In general</header><text>A State receiving a payment under this part shall use the payment to reduce the amount the State would otherwise require an individual to pay to obtain the photo identification required under section 303(b).</text></paragraph> 
<paragraph id="H6D269233DEBF4BF6A4C3EF46F1654820"><enum>(2)</enum><header>Limitations</header><text>A State may not use a payment under this part—</text> 
<subparagraph id="H90220D8CF5004A31B491009ED811FDCF"><enum>(A)</enum><text>to reduce the amount an individual pays for an identification unless the individual is a low-income individual, as determined by the State in accordance with such criteria and tests as the State may establish;</text></subparagraph> 
<subparagraph id="H7BA9B0DDC04F4CE2A8B33E2C7D379041"><enum>(B)</enum><text>to reduce the amount an individual pays for an identification by more than $9; or</text></subparagraph> 
<subparagraph id="H665154AFBCC7493494CB3222B5B59B2D"><enum>(C)</enum><text>to reduce the amount an individual is otherwise required to pay for a driver’s license.</text></subparagraph></paragraph></subsection> 
<subsection id="HD57B243D75124EFDB178A509609D2181"><enum>(c)</enum><header>Eligibility of States</header><text>A State is eligible to receive a payment under this part if the State submits to the Commission (at such time and in such form as the Commission may require) an application containing such information and assurances as the Commission may require.</text></subsection></section> 
<section id="HC639ADDEA07642359CC565AE7CA88CD5"><enum>297A.</enum><header>Authorization of Appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated for payments under this part such sums as may be necessary for fiscal year 2006 and each succeeding fiscal year, to remain available until expended.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="H8EB51E2428A8478600008F313199145B"><enum>(1)</enum><header>In general</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>), as amended by section 3(b), is amended by inserting after section 303A the following new section:</text>

<subsection id="H1225338D038B4EA5A54D9FF1A6AB4CB9"><enum>(a)</enum><header>Requiring Poll Workers to Undergo Training</header><text>No individual may serve as an election official at any polling placed for any election for Federal office unless the State certifies that the individual has successfully completed a program sponsored by the State under which the individual is trained in the applicable laws governing election administration in the State, including the laws governing who is eligible to vote, the forms of identification that may be accepted at the polling place, how votes are cast, and the procedures for contacting other officials in the event that problems occur during the day of the election.</text></subsection> 
<subsection id="H1AD60059BF57470AA354AE8B718F22A"><enum>(b)</enum><header>Effective Date</header><text display-inline="yes-display-inline">This section shall apply with respect to the regularly scheduled general election for Federal office held in November 2006 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subsection id="H68FCE135FCAB48C9A45BFDDFB4C92600"><enum>(a)</enum><header>Mandatory Audit by Commission</header><text>Title IV of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HC31D61894FF54461BF64417BE84971C0"><enum>403.</enum><header>Audit of State Compliance With Requirements</header> 
<subsection id="H2F405549CC6447538D67F1721115876F"><enum>(a)</enum><header>Audit of Compliance of States Receiving Funding</header><text display-inline="yes-display-inline">If a State receives any payment under a program under this Act, the Commission may (at such times as it considers appropriate) conduct an audit to review the State’s compliance with the applicable requirements of this Act.</text></subsection> 
<subsection id="H21D69FB6229A49A8965549F51DB3DF81"><enum>(b)</enum><header>Penalty For Failure to Cure Noncompliance</header><text>If, as a result of an audit conducted under this section, the Commission notifies a State that the State is not in compliance with any of the applicable requirements of this Act and the State does not cure the noncompliance prior to the expiration of the 60-day period which begins on the date the Commission notifies the State, the Commission may impose such penalty upon the State (including a civil money penalty or a reduction in the amount of any payment to the State under a program under this Act) as it considers appropriate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
