<section id="HD2308A6EEDD04959BB89CA779E4295A9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HF49D1DC08B684C9CBDF197CB3BF41C57"><enum>(1)</enum><text>the chemical industry is a crucial part of the critical infrastructure of the United States—</text> 
<subparagraph id="H4639DBF1596B410AB93B7EFE9F6D00B5"><enum>(A)</enum><text>in its own right; and</text></subparagraph> 
<subparagraph id="H022187B7056747A5ABF91F61971006A3"><enum>(B)</enum><text>because that industry supplies resources essential to the functioning of other critical infrastructures;</text></subparagraph></paragraph> 
<paragraph id="H12771A67A1924EC1BE4810C696DF6096"><enum>(2)</enum><text>the possibility of terrorist and criminal attacks on chemical sources (such as industrial facilities) poses a serious threat to public health, safety, and welfare, critical infrastructure, national security, and the environment;</text></paragraph> 
<paragraph id="HE4BEE9A22D014037809CBEC06CA9226"><enum>(3)</enum><text>the possibility of theft of dangerous chemicals from chemical sources for use in terrorist attacks poses a further threat to public health, safety, and welfare, critical infrastructure, national security, and the environment; and</text></paragraph> 
<paragraph id="H5914E0A3E08444909800DDC386F0C100"><enum>(4)</enum><text>there are significant opportunities to prevent theft from, and criminal attack on, chemical sources and reduce the harm that such acts would produce by—</text> 
<subparagraph id="HED659BABA9F343A7A2CE5DEC5F35F154"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H37D066AFF04A454AA5D2EF74852171E6"><enum>(i)</enum><text>reducing usage and storage of chemicals by changing production methods and processes; and</text></clause> 
<clause indent="up1" id="H889B9EBDF94A4942B963B1275618EBF3"><enum>(ii)</enum><text>employing inherently safer technologies in the manufacture, transport, and use of chemicals;</text></clause></subparagraph> 
<subparagraph id="HA3C2D76959DC4BE48DF7744EC2EFB201"><enum>(B)</enum><text>enhancing secondary containment and other existing mitigation measures; and</text></subparagraph> 
<subparagraph id="H7D12A8770F074CE9B3CC956D7323A968"><enum>(C)</enum><text>improving security.</text></subparagraph></paragraph></section> 
<section id="H6392F610236C44549CFA299C1600C0DD"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H78C80911583947039BE1C8D5FF98FC6"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HD782E0B740F2470083F327D410E925A4"><enum>(2)</enum><header>Chemical source</header><text>The term <term>chemical source</term> means a stationary source (as defined in section 112(r)(2) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(2)</external-xref>)) that contains a substance of concern.</text></paragraph> 
<paragraph id="H729AE6DF2DB648BFA4AB604DB0BCAABA"><enum>(3)</enum><header>Covered substance of concern</header><text>The term <term>covered substance of concern</term> means a substance of concern that, in combination with a chemical source and other factors, is designated as a high priority category by the Administrator under section 4(a)(1).</text></paragraph> 
<paragraph id="H900B698C681A4A94878BC3C4265D18A7"><enum>(4)</enum><header>Employee</header><text>The term <term>employee</term> means—</text> 
<subparagraph id="H43EC3390609246B2AEC9D9601D0073DA"><enum>(A)</enum><text>a duly recognized collective bargaining representative at a chemical source; or</text></subparagraph> 
<subparagraph id="H0E5DE0C60A904170BC4EAB13BE606B96"><enum>(B)</enum><text>in the absence of such a representative, other appropriate personnel.</text></subparagraph></paragraph> 
<paragraph id="HA0FDC6CC43814571838FE1A21793DF1"><enum>(5)</enum><header>First responder</header><text>The term <term>first responder</term> includes firefighters and emergency medical personnel.</text></paragraph> 
<paragraph id="H5FA1DF6B6FD2408F959B3653BF8672AC"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Homeland Security.</text></paragraph> 
<paragraph id="H1DE92B5D4C004BE0A5A286009745C84C"><enum>(7)</enum><header>Safer design and maintenance</header><text>The term <term>safer design and maintenance</term> includes, with respect to a chemical source that is within a high priority category designated under section 4(a)(1), implementation, to the extent practicable, of the practices of—</text> 
<subparagraph id="HAA095B1363194705BF866489A65106B6"><enum>(A)</enum><text>preventing or reducing the vulnerability of the chemical source to a release of a covered substance of concern through use of inherently safer technology;</text></subparagraph> 
<subparagraph id="H21C7F125A9A84F8FA4528F3E24457108"><enum>(B)</enum><text>reducing any vulnerability of the chemical source to a release of a covered substance of concern that remains after the measures described in subparagraph (A) through use of well-maintained secondary containment, control, or mitigation equipment; and</text></subparagraph> 
<subparagraph id="HE79FBB150C95443C81ED6BE5C8E0F935"><enum>(C)</enum><text>reducing the potential consequences of any vulnerability of the chemical source to a release of a covered substance of concern through the use of buffer zones between the chemical source and surrounding populations (including buffer zones between the chemical source and residences, schools, hospitals, senior centers, shopping centers and malls, sports and entertainment arenas, public roads and transportation routes, and other population centers).</text></subparagraph></paragraph> 
<paragraph id="H9902095BC792439F8268429206300691"><enum>(8)</enum><header>Security measure</header> 
<subparagraph id="HAC8945AE5D1146888CB1BEF5E1F9C504"><enum>(A)</enum><header>In general</header><text>The term <term>security measure</term> means an action carried out to increase the security of a chemical source.</text></subparagraph> 
<subparagraph id="H08AA6651B79B41C9BEAE8E00671FC279"><enum>(B)</enum><header>Inclusions</header><text>The term <term>security measure</term>, with respect to a chemical source, includes—</text> 
<clause id="H147D7AF04002434189D524B5B17BE8F4"><enum>(i)</enum><text>employee training and background checks;</text></clause> 
<clause id="H4196164ECDF94859A3EAC97E67008477"><enum>(ii)</enum><text>the limitation and prevention of access to controls of the chemical source;</text></clause> 
<clause id="HB275437A007A4E4E846F7C7D186777ED"><enum>(iii)</enum><text>protection of the perimeter of the chemical source;</text></clause> 
<clause id="HA68292468E644C719CC09B375343FADA"><enum>(iv)</enum><text>the installation and operation of an intrusion detection sensor; and</text></clause> 
<clause id="HB580E79652A4450DA59CB8A2BAD9378"><enum>(v)</enum><text>a measure to increase computer or computer network security.</text></clause></subparagraph></paragraph> 
<paragraph id="H00C8A5E99A5F43348BB219FDF857353"><enum>(9)</enum><header>Substance of concern</header> 
<subparagraph display-inline="yes-display-inline" id="H099455C4C1B843678C9990581DD5B38B"><enum>(A)</enum><text>The term <term>substance of concern</term> means—</text> 
<clause indent="up1" id="H1DCBBD9C66C44F6686767971FE79CFC5"><enum>(i)</enum><text>any regulated substance (as defined in section 112(r) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)</external-xref>)); and</text></clause> 
<clause indent="up1" id="H8862B41D1AA64589BE39BEE5818DFC08"><enum>(ii)</enum><text>any substance designated by the Administrator under section 4(a).</text></clause></subparagraph> 
<subparagraph indent="up1" id="H92A41F901EFD4EC581F5CC6EE6A27134"><enum>(B)</enum><text>The term does not include liquefied petroleum gas that is used as fuel or held for sale as fuel at a retail facility as described in section 112(r)(4)(B) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(4)(B)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H8892484767CC40CD93B56EE69936E0E3"><enum>(10)</enum><header>Unauthorized release</header><text>The term <term>unauthorized release</term> means—</text> 
<subparagraph id="HE17067337C0E47309D8E8D50F9DCD158"><enum>(A)</enum><text>a release from a chemical source into the environment of a covered substance of concern that is caused, in whole or in part, by a criminal act;</text></subparagraph> 
<subparagraph id="HEE2DCB52D4EF4705983066A8C6BC03A9"><enum>(B)</enum><text>a release into the environment of a covered substance of concern that has been removed from a chemical source, in whole or in part, by a criminal act; and</text></subparagraph> 
<subparagraph id="HFA51222813E243259DB4BC4B40161D8B"><enum>(C)</enum><text>a release or removal from a chemical source of a covered substance of concern that is unauthorized by the owner or operator of the chemical source.</text></subparagraph></paragraph> 
<paragraph id="H761017812CDA4C8FBA7606E7C8838A9"><enum>(11)</enum><header>Use of inherently safer technology</header> 
<subparagraph id="H878BC3AC39BD4052BD7F12E6C056FA04"><enum>(A)</enum><header>In general</header><text>The term <term>use of inherently safer technology</term>, with respect to a chemical source, means use of a technology, product, raw material, or practice that, as compared with the technologies, products, raw materials, or practices currently in use—</text> 
<clause id="H3F2F23CF65A342D183AC2BA63C1DB2F"><enum>(i)</enum><text>reduces or eliminates the possibility of a release of a substance of concern from the chemical source prior to secondary containment, control, or mitigation; and</text></clause> 
<clause id="H99BABD2C9F6548A9A5218DE8D2C5A3F1"><enum>(ii)</enum><text>reduces or eliminates the threats to public health and the environment associated with a release or potential release of a substance of concern from the chemical source.</text></clause></subparagraph> 
<subparagraph id="HE8EDBDC294034878952E3725A4ABD889"><enum>(B)</enum><header>Inclusions</header><text>The term <term>use of inherently safer technology</term> includes input substitution, catalyst or carrier substitution, process redesign (including reuse or recycling of a substance of concern), product reformulation, procedure simplification, and technology modifications that meet the criteria in paragraph (11)(A) and—</text> 
<clause id="HE20E06BCFF59471BAC9B5B37BF0B313"><enum>(i)</enum><text>use less hazardous substances or benign substances;</text></clause> 
<clause id="HE05BF5E9B9C84346A42CAC91F1F82B1"><enum>(ii)</enum><text>use a smaller quantity of covered substances of concern;</text></clause> 
<clause id="HC94CB2B76B6C4C3684AEF79047ACF39"><enum>(iii)</enum><text>reduce hazardous pressures or temperatures;</text></clause> 
<clause id="HF0B9262D84CA4365A8BEF899DD20B42B"><enum>(iv)</enum><text>reduce the possibility and potential consequences of equipment failure and human error;</text></clause> 
<clause id="H823F9B0A1FEF4E4B8DB375F8E9AB414F"><enum>(v)</enum><text>improve inventory control and chemical use efficiency; and</text></clause> 
<clause id="H9B23656B44EF461085DD293056B2BBB5"><enum>(vi)</enum><text>reduce or eliminate storage, transportation, handling, disposal, and discharge of substances of concern.</text></clause></subparagraph></paragraph></section> 
<section id="HE48A8F90C3104309868551DFECA5E4C0"><enum>4.</enum><header>Designation of and requirements for high priority categories</header> 
<subsection id="H5B9D3CF2F6E94F32B0502928776000C0"><enum>(a)</enum><header>Designation and regulation of high priority categories by the Administrator</header> 
<paragraph id="H71D0F601F49649E3BEDDA36043004659"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Secretary and State and local agencies responsible for planning for and responding to unauthorized releases and providing emergency health care, shall promulgate regulations to designate certain combinations of chemical sources and substances of concern as high priority categories based on the severity of the threat posed by an unauthorized release from the chemical sources.</text></paragraph> 
<paragraph id="HF17D1BD6733A46A0B7FEAE15880055B9"><enum>(2)</enum><header>Factors to be considered</header><text>In designating high priority categories under paragraph (1) the Administrator, in consultation with the Secretary, the United States Chemical Safety and Hazard Investigation Board, and State and local agencies described in paragraph (1)—</text> 
<subparagraph id="HFBF2551440C94AA3B75B999705728FF4"><enum>(A)</enum><text>the severity of the harm that could be caused by an unauthorized release;</text></subparagraph> 
<subparagraph id="H1641C0D1543C40E0B6304FF17D6F8990"><enum>(B)</enum><text>the proximity to population centers;</text></subparagraph> 
<subparagraph id="H3E235C5BC6A945B19F991037E17234A8"><enum>(C)</enum><text>the threats to national security;</text></subparagraph> 
<subparagraph id="H49DFD7B3C0A94917B58CD6BBA785B610"><enum>(D)</enum><text>the threats to critical infrastructure;</text></subparagraph> 
<subparagraph id="HCAF0BDECD80049E182D3BD345DFE95F5"><enum>(E)</enum><text>threshold quantities of substances of concern that pose a serious threat; and</text></subparagraph> 
<subparagraph id="H865FDE2D4C834774808DE5DCBD8343F7"><enum>(F)</enum><text>such other safety or security factors as the Administrator, in consultation with the Secretary, determines to be appropriate.</text></subparagraph></paragraph> 
<paragraph id="HA4960B4808DE44618E003F726035A338"><enum>(3)</enum><header>Requirements for high priority categories</header> 
<subparagraph id="HE1AF7568CF4445D8A453ED22C7769E80"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Secretary, the United States Chemical Safety and Hazard Investigation Board, and State and local agencies described in paragraph (1), shall promulgate regulations to require each owner and each operator of a chemical source that is within a high priority category designated under paragraph (1), in consultation with local law enforcement, first responders, and employees, to—</text> 
<clause id="H8AC6455C6F174D3DAECA71E60000A927"><enum>(i)</enum><text>conduct an assessment of the vulnerability of the chemical source to a terrorist attack or other unauthorized release;</text></clause> 
<clause id="H5C1CD97F84034809001ECCDBBC68400"><enum>(ii)</enum><text>using appropriate hazard assessment techniques, identify hazards that may result from an unauthorized release of a covered substance of concern; and</text></clause> 
<clause id="H183B5F374A3942909B2F122CB8D272B2"><enum>(iii)</enum><text>prepare a prevention, preparedness, and response plan that incorporates the results of those vulnerability and hazard assessments.</text></clause></subparagraph> 
<subparagraph id="HA668224B975547D6A59D874EF1F9F615"><enum>(B)</enum><header>Actions and procedures</header><text>A prevention, preparedness, and response plan required under subparagraph (A)(iii) shall include—</text> 
<clause id="H778F883ABEA04606929E0648D17C00CF"><enum>(i)</enum><text>actions and procedures, including safer design and maintenance of the chemical source, to eliminate or significantly lessen the potential consequences of an unauthorized release of a covered substance of concern;</text></clause> 
<clause id="H0DC52DA9E0134166AA92395264BB0AD"><enum>(ii)</enum><text>a specific numeric goal for the percent by which the size of the vulnerability zone, as measured by distance to an endpoint, will be reduced, relative to the size of the vulnerability zone reported in the offsite consequence analysis most recently submitted pursuant to section 112(r) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)</external-xref>);</text></clause> 
<clause id="HD33F1755BC6345749E477E9D4924FFD0"><enum>(iii)</enum><text>such security measures as are necessary—</text> 
<subclause id="H3ECC4C54CBF845009344FA964F23F332"><enum>(I)</enum><text>to reduce vulnerability of the chemical source to release of a covered substance of concern until actions and procedures planned under subparagraph (B)(i) have been implemented; and</text></subclause> 
<subclause id="HEDDC08C828254F5C801829FC92869068"><enum>(II)</enum><text>to reduce vulnerability of the chemical source to release of a covered substance of concern that remains after actions and procedures planned under subparagraph (B)(i) have been implemented; and</text></subclause></clause> 
<clause id="H58E591E5A3FB4992B1C2E35430518B1D"><enum>(iv)</enum><text>for emergency response plans, an evaluation of the adequacy of evacuation plans for the population living within the vulnerability zone.</text></clause></subparagraph> 
<subparagraph id="H40EBB534254F407FB0942262B5196DED"><enum>(C)</enum><header>Threat information</header><text>To the maximum extent permitted by applicable authorities and the interests of national security, the Secretary, in consultation with the Administrator, shall provide owners and operators of chemical sources with threat information relevant to the assessments and plans required under subsection (b).</text></subparagraph></paragraph> 
<paragraph id="H8D9AFD2F129340B1A892382766FCABD2"><enum>(4)</enum><header>Review and revisions</header><text>Not later than 5 years after the date of promulgation of regulations under each of paragraphs (1) and (3), the Administrator, in consultation with the Secretary, shall review the regulations and make any necessary revisions.</text></paragraph> 
<paragraph id="H22E64435CB9F479394D8F05E624C3318"><enum>(5)</enum><header>Addition of substances of concern</header><text>For the purpose of designating high priority categories under paragraph (1) or any subsequent revision of the regulations promulgated under paragraph (1), the Administrator, in consultation with the Secretary, may designate additional substances that pose a serious threat as substances of concern.</text></paragraph></subsection> 
<subsection id="H2EB19BABBD714F27AEA825593FFD7747"><enum>(b)</enum><header>Certification</header> 
<paragraph id="HE7C9985CC1C14215B35EA3566D54B36"><enum>(1)</enum><header>Vulnerability and hazard assessments</header><text>Not later than 1 year after the date of promulgation of regulations under subsection (a)(3), each owner and each operator of a chemical source that is within a high priority category designated under subsection (a)(1) shall—</text> 
<subparagraph id="H3217617977B04B6EBFDFDCCFE386AE7B"><enum>(A)</enum><text>certify to the Administrator that the chemical source has conducted assessments in accordance with the regulations; and</text></subparagraph> 
<subparagraph id="HA51FD94CCDD94301A724AE855E62DF0"><enum>(B)</enum><text>submit to the Administrator written copies of the assessments.</text></subparagraph></paragraph> 
<paragraph id="H84587231642E40EAB4A7F8F65D890005"><enum>(2)</enum><header>Prevention, preparedness, and response plans</header> 
<subparagraph display-inline="yes-display-inline" id="H4BDB6839989D42AFA975D67F353D6FA"><enum>(A)</enum><text>Not later than 18 months after the date of promulgation of regulations under subsection (a)(3), the owner or operator shall certify to the Administrator that the chemical source has completed a prevention, preparedness, and response plan that incorporates the results of the assessments and complies with the regulations.</text></subparagraph> 
<subparagraph indent="up1" id="HE426C8A5EEBD4A84008C3233DD03C155"><enum>(B)</enum><text>Such certification shall include—</text> 
<clause id="HFA3A53382E244557BD1F971E689BC7F2"><enum>(i)</enum><text>the goal for reducing the size of the vulnerability zone, described in section (a)(3)(B)(ii);</text></clause> 
<clause id="H95F4EB3C2F334D6EBC028E9297517EEB"><enum>(ii)</enum><text>a general description of each option considered, within each element of safer design and maintenance, in developing the prevention, preparedness, and response plans;</text></clause> 
<clause id="H43E5E5EC52224D46A53EEF94490207FA"><enum>(iii)</enum><text>a general description of each option selected for implementation; and</text></clause> 
<clause id="H884244C5425A4536802B6117D3006800"><enum>(iv)</enum><text>for options not implemented, an indication of the reason(s).</text></clause></subparagraph></paragraph> 
<paragraph id="H4441AC7C3A9B47FBA9B7F1C21E68B2DF"><enum>(3)</enum><header>5-year review</header><text>Not later than 5 years after each of the dates of submission of a copy of an assessment under paragraph (1) and a plan under paragraph (2), and not less often than every 3 years thereafter, the owner or operator of the chemical source covered by the assessment or plan, in coordination with local law enforcement and first responders, shall—</text> 
<subparagraph id="HAC581EB11C4B40D8814364574509859F"><enum>(A)</enum><text>review the adequacy of the assessment or plan, as the case may be; and</text></subparagraph> 
<subparagraph id="H1AEBD6354E884CA99986A1E44ED5797"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H9191DF3DE70947C18FE6FDAEEAA56A1"><enum>(i)</enum><text>certify to the Administrator that the chemical source has completed the review; and</text></clause> 
<clause indent="up1" id="HE8478C7419D4461A8B11E91CA5CBF0C5"><enum>(ii)</enum><text>as appropriate, submit to the Administrator any changes to the assessment or plan.</text></clause></subparagraph></paragraph> 
<paragraph id="H5E9B58555948478B94CE7E4FF919EB9E"><enum>(4)</enum><header>Protection of information</header> 
<subparagraph id="HEDDCE7669A6042FEAC352C0883EC9E00"><enum>(A)</enum><header>Disclosure exemption</header><text>Except with respect to certifications specified in paragraphs (1) through (3) of this subsection and section 5(a), all information provided to the Administrator under this subsection, and all information derived from that information, shall be exempt from disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="HF5F9F5BE3A994BE9A696128535A4B14"><enum>(B)</enum><header>Development of protocols</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Secretary, shall develop such protocols as are necessary to protect the copies of the assessments and plans required to be submitted under this subsection (including the information contained in those assessments and plans) from unauthorized disclosure. Such protocols shall ensure that—</text> 
<clause id="HA436CA3EABD146BF8743B05324E332B1"><enum>(i)</enum><text>each copy of such assessment or plan, and all information contained in or derived from the assessment or plan, is kept in a secure location;</text></clause> 
<clause id="H700AACF803AF489DABB8013DAF060538"><enum>(ii)</enum><text>only individuals designated by the Administrator may have access to the copies of the assessments or plans; and</text></clause> 
<clause id="HC1F60B0FAFD4429C8F53D54E8E7F363C"><enum>(iii)</enum><text>no copy of an assessment or plan, or part of an assessment or plan, or information contained in or derived from an assessment or plan shall be available to anyone other than an individual designated by the Administrator.</text></clause><continuation-text continuation-text-level="subparagraph">At the earliest possible time prior to 1 year after the date of enactment of this Act, the Administrator shall complete the development of such protocols for the purpose of having them in place prior to receiving any assessment or plan.</continuation-text></subparagraph> 
<subparagraph id="H26F39C5E7EF84240B264F562FB30F3B5"><enum>(C)</enum><header>Officer or employees of the u.s</header><text>An individual referred to in paragraph (B)(ii) who is an officer or employee of the United States may discuss the contents of an assessment or plan with a State or local official.</text></subparagraph></paragraph></subsection></section> 
<section id="H12BC92841B21432E00DBC2D2D3B276C9"><enum>5.</enum><header>Disseminating information on inherently safer technologies</header> 
<subsection id="HD5A063F322324962B1F299950099DEF4"><enum>(a)</enum><header>Inherently safer technologies clearinghouse</header> 
<paragraph id="HCFCF7D3A4C0E4B9191D1D33F4403AF06"><enum>(1)</enum><header>Authority</header><text>The Administrator shall establish a publicly available clearinghouse to compile and disseminate information on the use and availability of inherently safer technologies.</text></paragraph> 
<paragraph id="H67AEBA0F0CE44CDE0027702F8747A6C8"><enum>(2)</enum><header>Inclusions</header><text>The clearinghouse shall include information on—</text> 
<subparagraph id="HAEF9B55797A348C0B42508E914D11614"><enum>(A)</enum><text>general and specific types of inherently safer technologies;</text></subparagraph> 
<subparagraph id="H71BC8C7EBC47482FA22F92ADA00ACF7"><enum>(B)</enum><text>combinations of covered sources and substances of concern for which the inherently safer technologies could be appropriate;</text></subparagraph> 
<subparagraph id="HD3AB95D0885D435BAAB0E3D010EA6A4"><enum>(C)</enum><text>the scope of current use and availability of the technologies;</text></subparagraph> 
<subparagraph id="HA6E373EA3B2F487B8D6B69BAF230FAF8"><enum>(D)</enum><text>the costs and cost savings resulting from inherently safer technologies;</text></subparagraph> 
<subparagraph id="HFD621EB2EE3D4D3288AF70291B86AE8B"><enum>(E)</enum><text>technological transfer;</text></subparagraph> 
<subparagraph id="H4CE031FA7F4D41928DA9E5E81481C11D"><enum>(F)</enum><text>the availability of technical assistance;</text></subparagraph> 
<subparagraph id="H5425C6A86E334158ADAA1CF152CBD049"><enum>(G)</enum><text>business practices that enable or encourage inherently safer technologies;</text></subparagraph> 
<subparagraph id="HB796E8B2C3434E31A3CD734CBD4F78E1"><enum>(H)</enum><text>current users of inherently safer technologies; and</text></subparagraph> 
<subparagraph id="H36B49E0231F2498BAE9B572B5856BF94"><enum>(I)</enum><text>such other information as the Administrator deems appropriate.</text></subparagraph></paragraph> 
<paragraph id="H28046549E68C4E13A9EBCD6962CDE056"><enum>(3)</enum><header>Collection of information</header><text>The Administrator shall collect information for the clearinghouse—</text> 
<subparagraph id="H134EB4DAFB1E4DA4B0E92F13042F9C8D"><enum>(A)</enum><text>from documents submitted by owners or operators pursuant to this Act;</text></subparagraph> 
<subparagraph id="H757CB83E4D0B43AAB6C69FF435F0371"><enum>(B)</enum><text>by surveying owners or operators who have de-registered their facilities from the requirements of 40 CFR part 68; or</text></subparagraph> 
<subparagraph id="H073D55DE29C140AFB800001DAB00BB10"><enum>(C)</enum><text>through such other methods as the Administrator deems appropriate.</text></subparagraph></paragraph> 
<paragraph id="H14360E64455040388E853C44B0F0B0E9"><enum>(4)</enum><header>Public availability</header><text>Information available publicly through the clearinghouse shall not identify specific facilities by name.</text></paragraph></subsection> 
<subsection id="H356B54B1184F4F47A9D209ABBF1D2CB0"><enum>(b)</enum><header>Technology Transition Fund</header> 
<paragraph id="H19694C4E93E3492FACDBE0689CFE17E7"><enum>(1)</enum><header>Establishment</header><text>The Administrator and the Secretary of Energy shall establish and administer a fund to be known as the <quote>Technology Transition Fund</quote>, consisting of the amount transferred to the Fund under paragraph (3)(A).</text></paragraph> 
<paragraph id="H9B3478E265D7490EACC4C486A56E5350"><enum>(2)</enum><header>Use of amounts in Fund</header><text>Amounts in the Fund established under paragraph(1) shall be used by the Administrator and the Secretary to provide grants to chemical facilities that demonstrate financial hardship to assist those chemical facilities in implementing inherently safer technologies.</text></paragraph> 
<paragraph id="HF878E71230CE45D29202456719D209F"><enum>(3)</enum><header>Funding</header> 
<subparagraph id="HD3B95E418B064E4291225BCBF3BF2C6C"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Fund, for use by the Secretary and the Administrator in carrying out this section, not later than 30 days after the date of enactment of this Act, such sums as are necessary.</text></subparagraph> 
<subparagraph id="H521C13BA4C634D1800562835A29BF37C"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Administrator and Secretary shall be entitled to receive, shall accept, and shall use to carry out this subsection the funds transferred to the Fund under subparagraph (A), without further appropriation.</text></subparagraph> 
<subparagraph id="H431000A75E7C4977A83B77FEA6CAC72C"><enum>(C)</enum><header>Availability of funds</header><text>Funds transferred under subparagraph (A) shall remain available until expended.</text></subparagraph></paragraph></subsection></section> 
<section id="H440D3A4DC18D44339D594C51754D5078"><enum>6.</enum><header>Employee and first responder training</header> 
<subsection id="HFD508D7CE5914805A8CE36F684198DD4"><enum>(a)</enum><header>Authority</header><text>The Administrator shall make grants to provide for training of first responders and of employees at chemical sources.</text></subsection> 
<subsection id="HCBF639F558B045C8B1BC3C6F716C0469"><enum>(b)</enum><header>Administration</header><text>The administrator may enter into agreements with the National Institute for Environmental Health Sciences to administer grants made under this section.</text></subsection> 
<subsection id="H359A1129DCF54414978E3FD5EC5F7FC4"><enum>(c)</enum><header>Purposes</header><text>Grants made under this subsection shall provide for training and education of first responders or employees at covered sources in—</text> 
<paragraph id="H16740F8BD5BF40DD9600E82B23FE12CC"><enum>(1)</enum><text>identifying opportunities to reduce or significantly eliminate the vulnerability of a chemical source to a release of a substance of concern through the use of inherently safer technologies; or</text></paragraph> 
<paragraph id="HDD8CCD9F65ED45DAA4AE00BE027E983D"><enum>(2)</enum><text>appropriate emergency response procedures.</text></paragraph></subsection> 
<subsection id="H7AB3BA438AAC44DAAC102DF2D6A03DA9"><enum>(d)</enum><header>Grant recipients</header><text>Grants shall be awarded to nonprofit organizations which demonstrate experience in implementing and operating worker health and safety or first responder training and education programs.</text></subsection> 
<subsection id="H6CAECC7A12AD49A79F413DEB27F644D0"><enum>(e)</enum><header>Funding</header><text>Notwithstanding any other provision of law, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Fund, for use in carrying out this section, not later than 30 days after the date of enactment of this Act, such sums as are necessary.</text></subsection></section> 
<section id="H63D696B6756242849F245D6011B1FBE4"><enum>7.</enum><header>Enforcement</header> 
<subsection id="HB9A1432886684A7A9E0231969EC92F17"><enum>(a)</enum><header>Review of plans</header> 
<paragraph id="HFBE710A55A3B427BBA00B51E6E203246"><enum>(1)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary, shall review each assessment and plan submitted under section 4(b) to determine the compliance of the chemical source covered by the assessment or plan with regulations promulgated under paragraphs (1) and (3) of section 4(a).</text></paragraph> 
<paragraph id="H10EF02B92EC447DD9495ABFDA64F13EC"><enum>(2)</enum><header>Certification of compliance</header> 
<subparagraph id="HAEF8C25FBFC9466600D90F5E1C5ABFD"><enum>(A)</enum><header>In general</header><text>The Administrator shall certify in writing each determination of the Administrator under paragraph (1).</text></subparagraph> 
<subparagraph id="H609CD85545684EFDB2B8C26B6487ED37"><enum>(B)</enum><header>Inclusions</header><text>A certification of the Administrator shall include a checklist indicating consideration by a chemical source of the use of 3 elements of safer design and maintenance described in subparagraphs (A) through (C) of section 3(7).</text></subparagraph> 
<subparagraph id="HE584DBA1B9C94DD5BB94BFDEF0041837"><enum>(C)</enum><header>Early compliance</header> 
<clause id="H7543C7E2F4DB416F005200CE02A73DA6"><enum>(i)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary, shall—</text> 
<subclause id="H8763B0E573844E52B04955C45644F4E1"><enum>(I)</enum><text>before the date of publication of proposed regulations under section 4(a)(3), review each assessment or plan submitted to the Administrator under section 4(b); and</text></subclause> 
<subclause id="H54A313C4E9A54C0D88A5B57F78C70795"><enum>(II)</enum><text>before the date of promulgation of final regulations under section 4(a)(3), determine whether each such assessment or plan meets the consultation, planning, and assessment requirements applicable to high priority categories under section 4(a)(3).</text></subclause></clause> 
<clause id="HBEF7569994CC4FB6BE4CF47CB453B8E"><enum>(ii)</enum><header>Affirmative determination</header><text>If the Administrator, in consultation with the Secretary, makes an affirmative determination under clause (i)(II), the Administrator shall certify compliance of an assessment or plan described in that clause without requiring any revision of the assessment or plan.</text></clause></subparagraph> 
<subparagraph id="H3EA7E913B3544DF4937CE9F143525DB"><enum>(D)</enum><header>Schedule for review and certification</header> 
<clause id="H5398DD2439094DBAB284BAD6891E2738"><enum>(i)</enum><header>In general</header><text>The Administrator, after taking into consideration the factors described in section 4(a)(2), shall establish a schedule for the review and certification of assessments and plans submitted under section 4(b).</text></clause> 
<clause id="H5C5B2335BA28463C00477355D9E9C81"><enum>(ii)</enum><header>Deadline for completion</header><text>Not later than 3 years after the deadlines for the submission of assessments and plans under paragraph (1) or (2), respectively, of section 4(b), the Administrator shall complete the review and certification of all assessments and plans submitted under those sections.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H39C9852D04E4475C88F5AF96BBBAC7BC"><enum>(b)</enum><header>Compliance assistance</header> 
<paragraph id="HA38CDEAD8B4048B4BE6BC5DB662E3729"><enum>(1)</enum><header>Definition of determination</header><text>In this subsection, the term <term>determination</term> means a determination by the Administrator that, with respect to an assessment or plan described in section 4(b)—</text> 
<subparagraph id="H9C43F4B65F244AE0990029277142B0AA"><enum>(A)</enum><text>the assessment or plan does not comply with regulations promulgated under paragraphs (1) and (3) of section 4(a); or</text></subparagraph> 
<subparagraph id="HF823423B051E4129B08248780670A55C"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H0699A6DD6A524D42BA02004D28CAB1C4"><enum>(i)</enum><text>a threat exists beyond the scope of the submitted plan; or</text></clause> 
<clause indent="up1" id="H840C6FD6D6DD45BFA693A6B4F56640A8"><enum>(ii)</enum><text>current implementation of the plan is insufficient to address—</text> 
<subclause id="HB02277FAC73740D695F33CAA53C03139"><enum>(I)</enum><text>the results of an assessment of a source; or</text></subclause> 
<subclause id="H1116F91BEBBE48668858E49F6C7B58E0"><enum>(II)</enum><text>a threat described in clause (i).</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HDFD38152A32744679B11FD517FFFD1CF"><enum>(2)</enum><header>Determination by Administrator</header><text>If the Administrator, after consultation with the Secretary, makes a determination, the Administrator shall—</text> 
<subparagraph id="HF8B1F50A95EF48688B8C7DAEB9726DEE"><enum>(A)</enum><text>notify the chemical source of the determination; and</text></subparagraph> 
<subparagraph id="H1CB835648C6742F3855986DB98C90213"><enum>(B)</enum><text>provide such advice and technical assistance, in coordination with the Secretary and the United States Chemical Safety and Hazard Investigation Board, as is appropriate—</text> 
<clause id="H00DAB450E41F41D8BF644254D8B14EA6"><enum>(i)</enum><text>to bring the assessment or plan of a chemical source described in section 4(b) into compliance; or</text></clause> 
<clause id="H6182AE86C51D4D75B75834F274B4712F"><enum>(ii)</enum><text>to address any threat described in clause (i) or (ii) of paragraph (1)(B).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H5BCF92E0468F49219B2ED0D6751F8BB1"><enum>(c)</enum><header>Compliance orders</header> 
<paragraph id="H9315034E912C444EB36BF1C1E7056483"><enum>(1)</enum><header>In general</header><text>If, after the date that is 30 days after the later of the date on which the Administrator first provides assistance, or a chemical source receives notice, under subsection (b)(2)(B), a chemical source has not brought an assessment or plan for which the assistance is provided into compliance with regulations promulgated under paragraphs (1) and (3) of section 4(a), or the chemical source has not complied with an entry or information request under section 6, the Administrator may issue an order directing compliance by the chemical source.</text></paragraph> 
<paragraph id="HEA3CC2BA4F904B219EFCFC0016EC33FC"><enum>(2)</enum><header>Notice and opportunity for hearing</header><text>An order under paragraph (1) may be issued only after notice and opportunity for a hearing.</text></paragraph></subsection> 
<subsection id="HDD1027B48A4448C695D499F75DB1733F"><enum>(d)</enum><header>Abatement action</header> 
<paragraph id="H810FAA1C7E79439684F34517F8613C34"><enum>(1)</enum><header>In general</header><text>Notwithstanding a certification under section 5(a)(2), if the Secretary, in consultation with local law enforcement officials and first responders, determines that a threat of a terrorist attack exists that is beyond the scope of a submitted prevention, preparedness, and response plan of 1 or more chemical sources, or current implementation of the plan is insufficient to address the results of an assessment of a source or a threat described in subsection (b)(1)(B)(i), the Secretary shall notify each chemical source of the elevated threat.</text></paragraph> 
<paragraph id="HEA94EC1857E8473D968600F04DF51CBB"><enum>(2)</enum><header>Insufficient response</header><text>If the Secretary determines that a chemical source has not taken appropriate action in response to a notification under paragraph (1), the Secretary shall notify the chemical source, the Administrator, and the Attorney General that actions taken by the chemical source in response to the notification are insufficient.</text></paragraph> 
<paragraph id="HC4AD58785D5C409DAFFB6FD9038DFF2"><enum>(3)</enum><header>Relief</header> 
<subparagraph id="HFF96ED36306246A99240975D7223349E"><enum>(A)</enum><header>In general</header><text>On receipt of a notification under paragraph (2), the Administrator or the Attorney General may secure such relief as is necessary to abate a threat described in paragraph (1), including such orders as are necessary to protect public health or welfare.</text></subparagraph> 
<subparagraph id="H0AF896489A10412FA1A1E1A251FD173"><enum>(B)</enum><header>Jurisdiction</header><text>The district court of the United States for the district in which a threat described in paragraph (1) occurs shall have jurisdiction to grant such relief as the Administrator or Attorney General requests under subparagraph (A).</text></subparagraph></paragraph></subsection></section> 
<section id="HF77C93C51F4047D48BE954D700ACCBDA"><enum>8.</enum><header>Recordkeeping and entry</header> 
<subsection id="H2B09BBBCCB32449E0073C38FBC6B9D14"><enum>(a)</enum><header>Records maintenance</header><text>A chemical source that is required to certify to the Administrator assessments and plans under section 4 shall maintain on the premises of the chemical source a current copy of those assessments and plans.</text></subsection> 
<subsection id="H3BB5C060EC86464AAAA2216858BDB49"><enum>(b)</enum><header>Right of entry</header><text>In carrying out this Act, the Administrator (or an authorized representative of the Administrator), on presentation of credentials—</text> 
<paragraph id="H96CEC71454E14B599B67D378D2EDC001"><enum>(1)</enum><text>shall have a right of entry to, on, or through any premises of an owner or operator of a chemical source described in subsection (a) or any premises in which any records required to be maintained under subsection (a) are located; and</text></paragraph> 
<paragraph id="HDB42571E54674992AE217892C753197C"><enum>(2)</enum><text>may at reasonable times have access to, and may copy, any records, reports, or other information described in subsection (a).</text></paragraph></subsection> 
<subsection id="H9164F48B785A461FBD73AAB393D7A7EA"><enum>(c)</enum><header>Information requests</header><text>In carrying out this Act, the Administrator may require any chemical source to provide such information as is necessary to—</text> 
<paragraph id="HE937E46C2E3C4F29A9EE58E6426000B4"><enum>(1)</enum><text>enforce this Act; and</text></paragraph> 
<paragraph id="HECF79E60FACF4CF39D975C4441F0AA78"><enum>(2)</enum><text>promulgate or enforce regulations under this Act.</text></paragraph></subsection></section> 
<section id="HC0B15094672140ABB9AFB1B21075088B"><enum>9.</enum><header>Penalties</header> 
<subsection id="H11A8E23E0A9847AC8D44CFC489002652"><enum>(a)</enum><header>Civil penalties</header><text>Any owner or operator of a chemical source that violates, or fails to comply with, any order issued may, in an action brought in United States district court, be subject to a civil penalty of not more than $25,000 for each day in which such violation occurs or such failure to comply continues.</text></subsection> 
<subsection id="H612DBF8062EE4C748D6113885E00DE39"><enum>(b)</enum><header>Criminal penalties</header><text>Any owner or operator of a chemical source that knowingly violates, or fails to comply with, any order issued shall—</text> 
<paragraph id="H3BB28FDDEF634FD9AF4DCA584091414D"><enum>(1)</enum><text>in the case of a first violation or failure to comply, be fined not less than $2,500 nor more than $25,000 per day of violation, imprisoned not more than 1 year, or both; and</text></paragraph> 
<paragraph id="H5AA6960B023740378C15720019A3669E"><enum>(2)</enum><text>in the case of a subsequent violation or failure to comply, be fined not more than $50,000 per day of violation, imprisoned not more than 2 years, or both.</text></paragraph></subsection> 
<subsection id="H63007C66A56B4C6690A7BDCEF071D8FA"><enum>(c)</enum><header>Administrative penalties</header> 
<paragraph id="HB921EE46C5FE4CFDBA1BF7C400F3DCD"><enum>(1)</enum><header>Penalty orders</header><text>If the amount of a civil penalty determined under subsection (a) does not exceed $125,000, the penalty may be assessed in an order issued by the Administrator.</text></paragraph> 
<paragraph id="H1DB28137142B4A81A6BB2180442C36D"><enum>(2)</enum><header>Notice and hearing</header><text>Before issuing an order described in paragraph (1), the Administrator shall provide to the person against which the penalty is to be assessed—</text> 
<subparagraph id="H8ED1D3A2BD1E44B4AF1007DB3DED8216"><enum>(A)</enum><text>written notice of the proposed order; and</text></subparagraph> 
<subparagraph id="H603FAEBF9EF543D693FCF5F16F15A84"><enum>(B)</enum><text>the opportunity to request, not later than 30 days after the date on which the notice is received by the person, a hearing on the proposed order.</text></subparagraph></paragraph></subsection></section> 
<section id="H087901C02902469281FC955367C24D75"><enum>10.</enum><header>No effect on requirements under other law</header><text display-inline="no-display-inline">Nothing in this Act affects any duty or other requirement imposed under any other Federal or State law.</text></section> 
<section id="H7F89C2A6833C446BBD09C63B2600CB1"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section>
