<official-title>To amend part D of title XVIII of the Social Security Act to provide to the Secretary of Health and Human Services authority similar to the authority of the Secretary of Veterans Affairs to negotiate the lowest possible prices for outpatient prescription drugs, to include in the determination of best price for covered outpatient drugs under the Medicaid Program prices charged by manufacturers to certain Federal agencies, and for other purposes.</official-title>

<section id="H8DA9F58288844315B2C43E7B004C86C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prescription Drug Price Fairness Act</short-title></quote>.</text> </section>
<section section-type="subsequent-section" id="HC831107B042D431D8BD575BE980ABB6" display-inline="no-display-inline"><enum>2.</enum><header>Negotiation of lowest possible prices for prescription drugs under medicare</header><text display-inline="no-display-inline">Section 1860D–11 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111</external-xref>) is amended by striking subsection (i) (relating to noninterference) and by inserting the following:</text>

<subsection id="HAE43EA6A2D4549439844A85333D60062"><enum>(i)</enum><header>Requirement to negotiate for lowest prices</header><text>In order to ensure that beneficiaries enrolled under prescription drug plans and MA–PD plans pay the lowest possible price for covered part D drugs, the Secretary shall have and exercise authority similar to that of the Secretary of Veterans Affairs to purchase prescription drugs in bulk and to negotiate contracts with manufacturers of covered part D drugs, consistent with the requirements and in furtherance of the goals of providing quality care and containing costs under this part. In exercising such authority, the Secretary shall negotiate the best possible prices for such drugs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H80EFDA792D734729B0C0B116C594C276"><enum>3.</enum><header>Inclusion of prices charged for covered outpatient drugs to certain Federal agencies in the determination of best price for such drugs under the medicaid program</header>
<subsection id="H3DD65C99075A4FDE95F67D2EDA8EA00"><enum>(a)</enum><header>In general</header><text>Clause (i) of section 1927(c)(1)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(c)(1)(C)</external-xref>) is amended by striking <quote>, excluding—</quote> and all that follows and inserting a period.</text></subsection>
<subsection id="H959A58EDC2E747FDA69F53D917F1A7D6"><enum>(b)</enum><header>Conforming amendments</header>
<paragraph id="H5AA5EBEC14CD473CB25235202F45D315" display-inline="yes-display-inline"><enum>(1)</enum><text>Such section is further amended by striking clause (iii).</text></paragraph>
<paragraph id="HA02A6A2512D449A5B8384BE6208797B" indent="up1"><enum>(2)</enum><text>Section 1847A(c)(2) of the Social Security Act (42 U.S.C. 1395w–3a(c)(2)) is amended by striking subparagraph (A) and redesignating the succeeding provision accordingly.</text></paragraph>
<paragraph id="H21689CCAB12C4229B9DE5B4F6C18DEA7" indent="up1"><enum>(3)</enum><text>Section 1860D–2(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(d)(1)</external-xref>) is amended by striking subparagraph (C).</text></paragraph>
<paragraph id="H4EC6FAE4A4A8480197FB46DEEEE4E346" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Section 1860D–31(e)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-131">42 U.S.C. 1395w–131(e)(1)</external-xref>) is amended by striking subparagraph (D).</text></paragraph></subsection>
<subsection id="H75457A5A2E774D649CA0221600673D07"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to payments for covered outpatient drugs furnished on or after January 1, 2006.</text></subsection></section>
<section id="H5FB7F77D81234C0BBBBFA9615EEFF8EB"><enum>4.</enum><header>Clarification of authority for States to negotiate together to achieve greater discounts from manufacturers of covered outpatient drugs</header><text display-inline="no-display-inline">Section 1927(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(a)</external-xref>) is amended by adding at the end the following new paragraph: </text>
