<section section-type="section-one" id="H09C03FFF0A824F15A5B8772BFBCB9209" display-inline="no-display-inline"><enum>1.</enum><header>Increase in widow’s and widower’s insurance benefits by reason of delayed retirement</header> 
<subsection id="HF0748A31113C43E3916CF185F44EEF66"><enum>(a)</enum><header>Delayed retirement credit for widow’s and widower’s benefits</header> 
<paragraph id="H390A19FAAF2945E993034EC63B269EA5"><enum>(1)</enum><header>In general</header><text>Section 202(w) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)</external-xref>) is amended—</text> 
<subparagraph id="H37938618100B4DFDBD4FDEFD56DCE972"><enum>(A)</enum><text>in paragraph (1) by striking <quote>old-age insurance benefit</quote> and inserting <quote>old-age, widow’s, or widower’s insurance benefit</quote>;</text></subparagraph> 
<subparagraph id="H7BC7DE7511524E5200E1446960D0B1FA"><enum>(B)</enum><text>in paragraph (2), by striking <quote>the number of increment months for any individual</quote> in the matter preceding subparagraph (A) and inserting <quote>the number of increment months for any individual to whom an old-age, widow’s, or widower’s insurance benefit is payable as described in paragraph (1)</quote>; and</text></subparagraph> 
<subparagraph id="HE6EFCB880A0E484BB18BE1F82932835"><enum>(C)</enum><text>by striking <quote>and</quote> at the end of paragraph (2)(A), and by striking paragraph (2)(B) and inserting the following:</text>

<subparagraph id="H5DCC94F116C94B6EB616B3878980F6D6" indent="up1"><enum>(B)</enum><text>with respect to which—</text> 
<clause id="HD8A87E1A0F12420480426293ECA4D217"><enum>(i)</enum><text>in the case of an individual to whom an old-age insurance benefit is payable, such individual was a fully insured individual (as defined in section 214(a)) and—</text> 
<subclause id="H5E7F97B023D74D9790D600262384F2A5"><enum>(I)</enum><text>was not entitled to such a benefit, or</text></subclause> 
<subclause id="H14DEC9AECA4647FFB5B516113BE1E00"><enum>(II)</enum><text>was so entitled but did not receive benefits pursuant to a request by such individual that benefits not be paid, or</text></subclause></clause> 
<clause id="H4281D348ED374CBAA41D8481F900AFE6"><enum>(ii)</enum><text>in the case of an individual to whom a widow’s or widower’s insurance benefit is payable, such individual satisfied subparagraphs (A), (B), and (D) of subsection (e)(1) or (f)(1) and—</text> 
<subclause id="HDEF369EB9D134B97837FE9286743C649"><enum>(I)</enum><text>was not entitled to such a benefit,</text></subclause> 
<subclause id="H6C65276704C94134BE9E7B924EACF81D"><enum>(II)</enum><text>was so entitled but suffered deductions under section 203(b) or 203(c) in amounts equal to the amount of such benefit, or</text></subclause> 
<subclause id="H54B30E8D23774E6C83B20FD605DFCDF"><enum>(III)</enum><text>was so entitled but did not receive benefits pursuant to a request by such individual that benefits not be paid, and</text></subclause></clause></subparagraph> 
<subparagraph id="H37A7CE832FFE4C2C81420014262E3E39" indent="up1"><enum>(C)</enum><text>with respect to which such individual was not subject to a penalty under section 1129A.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCB704AAC080042E99F6B0095B0FC4C90"><enum>(2)</enum><header>Conforming amendments to Section 202(w)</header> 
<subparagraph id="H1CEF08D132D4451E8B97ACC9B8B079BC"><enum>(A)</enum><text>Section 202(w)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)(3)</external-xref>) is amended by striking <quote>old-age</quote> each place it appears and inserting <quote>old-age, widow’s, or widower’s</quote>.</text></subparagraph> 
<subparagraph id="H19ED84A7EC95458C839939E8F6515525"><enum>(B)</enum><text>Section 202(w)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)(5)</external-xref>) is amended—</text> 
<clause id="HE02F4C484D004A2184A3A241F0F965C2"><enum>(i)</enum><text>by striking <quote>If an individual’s primary insurance amount</quote> and inserting <quote>If the primary insurance amount on which an individual’s old-age, widow’s, or widower’s insurance benefit is based</quote>;</text></clause> 
<clause id="H941007E2945E47079E17676CD4BAA33"><enum>(ii)</enum><text>by striking <quote>old-age</quote> each place it appears and inserting <quote>old-age, widow’s, or widower’s</quote>;</text></clause> 
<clause id="HE5A71E7128314AA2AA5099EBF7ED8DF"><enum>(iii)</enum><text>by striking <quote>his primary insurance amount</quote> each place it appears and inserting <quote>the primary insurance amount</quote>; and</text></clause> 
<clause id="H9867634F638649E09800009FE3F94942"><enum>(iv)</enum><text>by striking <quote>he</quote> and <quote>his</quote> each place they appear and inserting <quote>such individual</quote> and <quote>such individual’s</quote>, respectively.</text></clause></subparagraph> 
<subparagraph id="H453AAD46A7344EE8A9634CA86BC238FD"><enum>(C)</enum><text>Section 202(w)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)(6)</external-xref>) is amended—</text> 
<clause id="HBC389427DE4F4BD6ABE52C99E61BE48C"><enum>(i)</enum><text>by striking <quote>old-age</quote> each place it appears and inserting <quote>old-age, widow’s, or widower’s</quote>; and</text></clause> 
<clause id="HFA237389C3A24FFDBCE6A452E91F3FCB"><enum>(ii)</enum><text>by adding at the end (after and below subparagraph (D)) the following new sentence:</text> 
<quoted-block id="HA63809566DA34FC9A6FD87384CC01F9D"><text display-inline="no-display-inline">For purposes of this paragraph, an individual is deemed to become eligible for an old-age insurance benefit on the first day of the month in which such individual attains age 62, and for a widow’s or widower’s insurance benefit on the first day of the month in which such individual attains age 60.</text><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="H713953996B464DC783C0BE53005729EF"><enum>(3)</enum><header>Other conforming amendments</header> 
<subparagraph id="H03967897174E4F1B0007FFE325EA0244"><enum>(A)</enum><text>Section 202(e)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(e)(2)(A)</external-xref>) is amended by inserting <quote>subsection (w),</quote> after <quote>subsection (q),</quote>.</text></subparagraph> 
<subparagraph id="H295DC6D5655E4659B14FC8EC3BF4EA82"><enum>(B)</enum><text>Section 202(f)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(f)(2)(A)</external-xref>) is amended by inserting <quote>subsection (w),</quote> after <quote>subsection (q),</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HF629CDB332A744838BAD35C0D9502D96"><enum>(b)</enum><header>Treatment of delayed retirement in cases of simultaneous entitlement to old-age insurance benefits and widow’s or widower’s insurance benefits</header><text>Section 202(w) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)</external-xref>) is amended—</text> 
<paragraph id="H57921D5817CE4B998BC117E2C4AA0450"><enum>(1)</enum><text>by striking <quote>The amount</quote> in paragraph (1) and inserting <quote>Subject to paragraph (7), the amount</quote>; and</text></paragraph> 
<paragraph id="H07FAE3DB751947958D838B511E5B10AB"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="up1" id="H802774683494468EB80267355F86CAEB"><enum>(7)</enum><text>If for any month an individual is entitled (prior to the application of this subsection) both to an old-age insurance benefit and to a widow’s or widower’s insurance benefit, the resulting increase (if any) in the amount of the widow’s or widower’s insurance benefit under paragraph (1) shall be made (prior to the application of subsection (k)(3)(A)) in lieu of any increase in the amount of the old-age insurance benefit under such paragraph, unless—</text> 
<subparagraph id="H246901854A4C4D948079C2BFA8B12DE0"><enum>(A)</enum><text>the amount of such old-age insurance benefit would be greater than the amount of such widow’s or widower’s insurance benefit after the application of paragraph (1) to each such benefit, or</text></subparagraph> 
<subparagraph id="HD8905641C5224A27A546BE00190001F5"><enum>(B)</enum><text>the increase which would otherwise be made under such paragraph in the amount of such old-age insurance benefit would result (under the language following subparagraph (F) in the first sentence of subsection (e)(1) or (f)(1)) in the termination of the individual’s entitlement to widow’s or widower’s insurance benefits.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA039B6A77B4F402B9288B55FFF73591B"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to widow’s and widower’s insurance benefits (under section 202 (e) and (f) of the <act-name parsable-cite="SSA">Social Security Act</act-name>) for months after the month in which this Act is enacted.</text></section>
