<section id="HBC91274369BB47F28B72C6FDF7133E11" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congestion Relief Act of 2005</short-title></quote>. </text></section> 
<section id="H473BBAE1D4D843E5B985B7AF2BCDCF3B"><enum>2.</enum><header>Surface transportation program</header> 
<subsection id="HC8D1450D35974D5981DB0073B55CDFDB"><enum>(a)</enum><header>Division of funds between urbanized areas of over 200,000 population and other areas</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/133">Section 133(d)(3)(A)</external-xref> of title 23, United States Code, is amended—</text> 
<paragraph id="HFFE915B051E0499EB222A542F9EA9F48"><enum>(1)</enum><text>by striking <quote>62.5 percent of</quote>; and</text></paragraph> 
<paragraph id="HA68190DF7005494FA266C9AFC8714D4"><enum>(2)</enum><text>by striking <quote>The remaining 37.5 percent may be obligated in any area of the State.</quote>.</text></paragraph></subsection> 
<subsection id="H6FC5E211AFE94B44882C9445DEF16490"><enum>(b)</enum><header>Obligation authority</header><text>Section 133(f)(1) of such title is amended by striking <quote>the period of fiscal years 1998</quote> and all that follows through <quote>2003</quote> and inserting <quote>the period of fiscal years 2004 through 2006 and the period of fiscal years 2007 through 2009</quote>.</text></subsection></section> 
<section id="H96FAA81514B34345810374E157E4DD0"><enum>3.</enum><header>Congestion mitigation and air quality improvement program</header> 
<subsection id="H9B40B6B9D22B4D579F385B32060766DB"><enum>(a)</enum><header>Allocations</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/149">Section 149</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H3EDC402881634413BD6BFEC41050F16F"> 
<subsection id="H391AF20E024B472BA8B565CD28F926C9"><enum>(f)</enum><header>Allocations of apportioned funds</header> 
<paragraph id="H48446BC6A43C4CFEA64D452FA638D234"><enum>(1)</enum><header>In general</header><text>A State shall allocate the amounts apportioned to the State for a fiscal year under section 104(b)(2) and the amounts apportioned for the congestion mitigation and air quality improvement program under section 110 among metropolitan planning organizations and other agencies responsible for air quality conformity determinations in federally designated air quality areas in the ratio that—</text> 
<subparagraph id="H2A4A23186F5C418596E31529F6A4FD02"><enum>(A)</enum><text>the total of all weighted nonattainment and maintenance area populations (as determined under section 104(b)(2)) represented by the metropolitan planning organization or other agency; bears to</text></subparagraph> 
<subparagraph id="H83C8930314484439A656CF3F6F007441"><enum>(B)</enum><text>the total of all weighted nonattainment and maintenance area populations (as determined under section 104(b)(2)) in the State.</text></subparagraph></paragraph> 
<paragraph id="HFC27E8BFDEC046A292353B8924ABE1FB"><enum>(2)</enum><header>Nonapplicability to certain amounts</header><text>Amounts described in subsections (c)(1) and (c)(2) that may be used for any project eligible under the surface transportation program under section 133 shall not be subject to the requirements of paragraph (1).</text></paragraph> 
<paragraph id="H49165FE0D4694BECA9066F884EB6F0E4"><enum>(3)</enum><header>Availability of amounts</header><text>A State may reallocate amounts allocated under this subsection as necessary to prevent lapses of funds under section 118.</text></paragraph> 
<paragraph id="H2BB714DDE0F542CBB1E214008C68AC0"><enum>(4)</enum><header>Obligation authority</header><text>A State shall make available to a metropolitan planning organization or other agency to which amounts are allocated for a fiscal year under this section an amount of obligation authority distributed to the State for Federal-aid highways and highway safety construction programs for use in the area represented by the metropolitan planning organization or other agency that is equal to the amount obtained by multiplying—</text> 
<subparagraph id="H39F8836DF5BD4B82ABDDF7A43B006B8E"><enum>(A)</enum><text>the aggregate amount of funds that the State is required to obligate in the area under this subsection; and</text></subparagraph> 
<subparagraph id="H34825CF76DF4459BB600A74401279BA3"><enum>(B)</enum><text>the ratio that—</text> 
<clause id="H5BCF48EB131249C086E73F5212503C95"><enum>(i)</enum><text>the aggregate amount of obligation authority distributed to the State for Federal-aid highways and highway safety construction programs for the fiscal year; bears to</text></clause> 
<clause id="H64739C59C9844EDCAFBD8D54E503C016"><enum>(ii)</enum><text>the total of the sums apportioned to the State for Federal-aid highways and highway safety construction programs for the fiscal year.</text></clause></subparagraph></paragraph> 
<paragraph id="H0EE005BB79154843BA19976745382B1B"><enum>(5)</enum><header>Joint responsibility</header><text>Each State, each affected metropolitan planning organization or other agency, and the Secretary shall jointly ensure compliance with paragraph (4).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HFBA9BE91D6C44993B64278AEB4230000"><enum>4.</enum><header>National Highway System</header> 
<subsection id="H0A92366EE20647A0BAF6766CAFCC001B"><enum>(a)</enum><header>Selection of projects</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/103">Section 103(a)(6)</external-xref> of title 23, United States Code, is amended by inserting <quote>the project selection requirements of section 134(i)(4)(B) and</quote> after <quote>Subject to</quote>.</text></subsection> 
<subsection id="H78E9A11AB4F9493C95B6E25339CE5E8E"><enum>(b)</enum><header>Allocation</header><text>Section 103(b) of such title is amended by adding at the end the following:</text> 
<quoted-block id="H312A09F2A3394E78A217B1DF12F5A692"> 
<paragraph id="HE1DD10CA29CA49C1AB3159E8E03EC00"><enum>(7)</enum><header>Allocation to urbanized areas of over 200,000 population</header><text>The funds apportioned to a State under section 104(b)(1) for a fiscal year shall be allocated between urbanized areas with a population of over 200,000 in the State and other areas in the State—</text> 
<subparagraph id="H54C189EA45B24DDB00E433EE00CF59C3"><enum>(A)</enum><text>75 percent in the ratio that—</text> 
<clause id="H57E3FAAF4ACD4EDC8B15039FD74000EC"><enum>(i)</enum><text>the total lane miles on the National Highway System in such urbanized areas in the State; bears to</text></clause> 
<clause id="H89B90BD73B2443B7922B316CC5A7D100"><enum>(ii)</enum><text>the total lane miles on the National Highway System in all areas in the State; and</text></clause></subparagraph> 
<subparagraph id="H4BEC0CCDC66C46C4A5F6908B3D7DA970"><enum>(B)</enum><text>25 percent in the ratio that—</text> 
<clause id="H1EE04B4C11F24660A5A50080E89475C4"><enum>(i)</enum><text>the total vehicle miles traveled on the National Highway System in such urbanized areas in the State; bears to</text></clause> 
<clause id="HD646BB7669DC485CB6DF93328BBA1382"><enum>(ii)</enum><text>the total vehicle miles traveled on the National Highway System in all areas in the State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H34CD2714B9D94F07A6EAD7D310DE45A5"><enum>5.</enum><header>Minimum guarantee</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/105">Section 105(c)(2)</external-xref> of title 23, United States Code, is amended by striking <quote>paragraphs (1), (2), and (3)</quote> and inserting <quote>paragraphs (1) and (2)</quote>.</text></section> 
<section id="HBEC781285CC94D668B2FA1EC08D993BC"><enum>6.</enum><header>Metropolitan congestion relief program</header> 
<subsection id="H9C444B22873545F98D6BA0ACA8438543"><enum>(a)</enum><header>In general</header><text>Subchapter I of chapter I of title 23, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H700A0A8BF24340D3B46BEDC5C07691EF"> 
<section id="H5CFA90D2D10D4666931B9817DD69416B"><enum>165.</enum><header>Metropolitan congestion relief program</header> 
<subsection id="HC7A52AE63D68490C9C078C60CF79A490"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a metropolitan congestion relief program in accordance with this section.</text></subsection> 
<subsection id="H75569F40958C4ECC952CA4C5456205F"><enum>(b)</enum><header>Eligible projects</header><text>A project shall be eligible for assistance under this section if the project is eligible for assistance under the surface transportation program established by section 133 and the project is developed in accordance with the planning requirements of subsection (c).</text></subsection> 
<subsection id="HA43002A6826449DC8CBE77CE80431277"><enum>(c)</enum><header>Planning</header><text>Programming and expenditure of funds for projects under this section shall be consistent with the requirements of sections 134 and 135. In addition, with respect to each project carried out under this section, the appropriate metropolitan planning organization shall demonstrate, as part of its congestion management system if applicable, that the project will improve congestion in its region.</text></subsection> 
<subsection id="H5A5F244B0BEF4747B1BDCB0018EF004C"><enum>(d)</enum><header>Apportionment</header> 
<paragraph id="H3D9EDE0C2B5B49EF8E484CD9EC4657FB"><enum>(1)</enum><header>Eligible urbanized areas</header><text>Amounts made available to carry out this section for a fiscal year shall be apportioned directly to a metropolitan planning organization designated for—</text> 
<subparagraph id="H4FD912A6B8A640429738BC4313B1E141"><enum>(A)</enum><text>an urbanized area that has a travel time index of 1.2 or more; and</text></subparagraph> 
<subparagraph id="HFDBE2A82B31646BE81EFA69F2DDFD65B"><enum>(B)</enum><text>an urbanized area with a population of more than 1,000,000 that otherwise would not be eligible under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H2C7556947C4E41FBA50117CFCB355603"><enum>(2)</enum><header>Formula</header><text>Amounts made available to carry out this section for a fiscal year shall be apportioned among eligible urbanized areas under paragraph (1) as follows:</text> 
<subparagraph id="HE3A192A54EC34557B950F963F300BA33"><enum>(A)</enum><text>50 percent in the ratio that—</text> 
<clause id="H7EA83930161E4BCF88AB3435D0A46049"><enum>(i)</enum><text>the travel time index of the eligible urbanized area; bears to</text></clause> 
<clause id="H9572C0ABFFC24A14999400FE1C8D64C"><enum>(ii)</enum><text>the travel time index of all eligible urbanized areas.</text></clause></subparagraph> 
<subparagraph id="H828050FBF25B44BEB14100E0D8504C51"><enum>(B)</enum><text>50 percent in the ratio that—</text> 
<clause id="HFF42C5FD3B104DDDA3EA65C5A7BE337F"><enum>(i)</enum><text>the passenger miles traveled in the eligible urbanized area; bears to</text></clause> 
<clause id="H61C7CC00829E43E6B4FDD1DA80BF8741"><enum>(ii)</enum><text>the passenger miles traveled in all eligible urbanized areas.</text></clause></subparagraph></paragraph> 
<paragraph id="H5F799C35657B46E8B831B258EFAE684F"><enum>(3)</enum><header>Determinations</header><text>Eligibility and apportionment determinations under this subsection shall be made by the Secretary based on data from the most recent year for which data is available.</text></paragraph></subsection> 
<subsection id="H269C9B6C80264EA4B900B1C98F1355D6"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out this section $2,000,000,000 for each of fiscal years 2004 through 2009.</text></subsection> 
<subsection id="HE8AC95540BA14CF5B0771B92FE723254"><enum>(f)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HD4C3BD86D827453599E0A7A0079D727"><enum>(1)</enum><header>Travel time index</header><text>The term <term>travel time index</term> means the travel time index developed by the Texas Transportation Institute and included in the performance plan of the Federal Highway Administration.</text></paragraph> 
<paragraph id="HA808BDA11B234B76AD813977CE84EF74"><enum>(2)</enum><header>Passenger miles traveled</header><text>The term <term>passenger miles traveled</term> includes daily vehicle miles traveled and daily transit ridership as measured by Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H29F45E9362634F22A4DCAE78C83C5E2"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating section 164 the following:</text>

<section id="HC25CA39F0F364248BA9CF9228B41F996"><enum>7.</enum><header>Transportation operational improvement program</header> 
<subsection id="HEB92E70A7A9C40868703C798A1E89348"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is further amended by adding at the end the following:</text>

<section id="HC4CCF3DA9A39427D8600008084BFE4E5"><enum>166.</enum><header>Operational improvement program</header> 
<subsection id="H81E0D9EC88A74F81ABCA4130C348D363"><enum>(a)</enum><header>General authority</header><text>The Secretary shall establish and implement an operational improvement program under which the Secretary shall make grants to States, metropolitan planning organizations, and local governments for projects to improve the operation of the Nation’s roadways.</text></subsection> 
<subsection id="HBE43CDC892274409AFABE5E88793EF7F"><enum>(b)</enum><header>Eligible uses</header><text>Grants to States, metropolitan planning organizations, and local governments under this section may be used for the following purposes:</text> 
<paragraph id="HC4F18857C60349A7A5FFA600121EAF45"><enum>(1)</enum><text>Incident management projects, including the following:</text> 
<subparagraph id="H1E720D23FB9D408D91CCFE008CBE8D35"><enum>(A)</enum><text>Development of a regionwide coordinated plan to mitigate delays due to accidents and breakdowns.</text></subparagraph> 
<subparagraph id="H911369FC5711476989E518F7E8F697B7"><enum>(B)</enum><text>Purchase or lease of telecommunications equipment for first responders.</text></subparagraph> 
<subparagraph id="H320BF73AF706493982017DE4633DE91E"><enum>(C)</enum><text>Purchase or lease of towing and recovery equipment.</text></subparagraph> 
<subparagraph id="H98CA0BAE6AB14B2B8517869DBDDD8BBB"><enum>(D)</enum><text>Payments to contractors for towing and recovery services.</text></subparagraph> 
<subparagraph id="HAFDE80B25F2D446E8683F367DEF2E901"><enum>(E)</enum><text>Rental of vehicle storage areas immediately adjacent to roadways.</text></subparagraph> 
<subparagraph id="HCAC3F43A6B774846A16E0094CD9E78AE"><enum>(F)</enum><text>Service patrols.</text></subparagraph> 
<subparagraph id="H74AF4DF5C42545799F4E768DF6DA980"><enum>(G)</enum><text>Enhanced hazard materials incident response capacity.</text></subparagraph>

<subparagraph id="HC150828C0BFD465BAA81049CFBDB846B"><enum>(I)</enum><text>Training.</text></subparagraph></paragraph> 
<paragraph id="HE512D5F336AF4F979161FD47002B1521"><enum>(2)</enum><text>Deployment of intelligent transportation systems technology, including the deployment of the national 511 traveler information telephone number.</text></paragraph> 
<paragraph id="HF41774E7456B48BFA5A20024E91FA82B"><enum>(3)</enum><text>Transportation demand management techniques, including the following:</text> 
<subparagraph id="H8DEDF19B15B347B48E5E722423206217"><enum>(A)</enum><text>Commuter benefit programs.</text></subparagraph> 
<subparagraph id="HF141E94B9308459B98F5201107378584"><enum>(B)</enum><text>Parking management programs.</text></subparagraph> 
<subparagraph id="H675AE3BCA0FE4798BBF74C00E7B0AD17"><enum>(C)</enum><text>Carpool and vanpool projects.</text></subparagraph> 
<subparagraph id="HC2CF09EA53E54ABAAD88E9BEA442DA1"><enum>(D)</enum><text>Geographic Information System based ride matching operations.</text></subparagraph> 
<subparagraph id="HC9EF1BB8138B41CDA2A3315DD6C20531"><enum>(E)</enum><text>Employer based, real-time traveler information programs.</text></subparagraph> 
<subparagraph id="H029EB029C32648C398DECF43DBB3C5B1"><enum>(F)</enum><text>Telework programs.</text></subparagraph> 
<subparagraph id="H8ED1AAB275D64E3D8C60D45F324BD2FB"><enum>(G)</enum><text>Bicycle and pedestrian programs.</text></subparagraph> 
<subparagraph id="H254AB914EFA44895B4007C0010AB5842"><enum>(H)</enum><text>Access to transit investments.</text></subparagraph> 
<subparagraph id="H22EF1A5061FD43BA93B85E23A7351EC"><enum>(I)</enum><text>Design and implementation of commuter-friendly facilities.</text></subparagraph> 
<subparagraph id="H3639DA7EE1104A999E6B84E8244FAFB"><enum>(J)</enum><text>Employer and employment-site based transit shuttle planning and operation.</text></subparagraph></paragraph></subsection> 
<subsection id="H713D8A1DAEF3489881181437C2442300"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out this section $500,000,000 for each of fiscal years 2004 through 2009.</text></subsection> 
<subsection id="H8129E6F26861440CB1118B3DC0E43D6"><enum>(d)</enum><header>Applicability of NHS requirements</header><text>All provisions of this chapter that are applicable to National Highway System funds, other than provisions relating to the apportionment formula and provisions limiting the expenditures of such funds to Federal-aid systems, shall apply to funds authorized to be appropriated to carry out this section, except as determined by the Secretary to be inconsistent with this section and except that sums authorized by this section shall remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H38D2130ED44C4CCCA97EBF00CC65852E"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating section 165 the following:</text>
