<section id="H0EC8F6A4FAD740A48986CA50296F74F5" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Great Lakes Environmental Protection and Restoration Programs Reauthorization Act</short-title></quote> .</text></section> 
<section id="H01F95736235D45A4A7D57CCE00BF4BF5"><enum>2.</enum><header>Great Lakes defined</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>Great Lakes</quote> means Lake Ontario, Lake Erie, Lake Huron (including Lake St. Clair), Lake Michigan, and Lake Superior, and the connecting channels (Saint Mary’s River, Saint Clair River, Detroit River, Niagara River, and Saint Lawrence River to the Canadian Border).</text></section>

<section id="H6BF832E1AC084269BAAFAA2435BED180"><enum>101.</enum><header>Great Lakes fishery and ecosystem restoration</header><text display-inline="no-display-inline">Section 506(g) of the Water Resources Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/1962d-22">42 U.S.C. 1962d–22</external-xref>) is amended—</text>

<section id="H3536F403B1954969916500FFEA4C39D3" section-type="subsequent-section"><enum>201.</enum><header>Research reauthorizations</header><text display-inline="no-display-inline">Section 118(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(e)</external-xref>) is amended—</text> 
<paragraph id="HF2313F16552C435EB1DD91FBF8007944"><enum>(1)</enum><text>by striking subsection (e) and inserting the following:</text>

<paragraph id="H3B22C0FED02240BDBECA6107FCD4051"><enum>(1)</enum><header>Joint plan</header><text>Before October 1 of each year, the Program Office and the Research Office shall prepare and submit to the Executive Committee of the Regional Collaboration a joint research plan for the fiscal year which begins in the following calendar year. The plan shall be transmitted to Congress at the time of transmission of the President’s annual budget request.</text></paragraph> 
<paragraph id="H0B4DCEA5D64B456FB13430AE1245A3E6"><enum>(2)</enum><header>Contents of plan</header><text>Each plan prepared under paragraph (1) shall—</text> 
<subparagraph id="H7BC3F193E47245F79DC6D8016200719C"><enum>(A)</enum><text>identify all proposed research dedicated to activities conducted under the Great Lakes Water Quality Agreement of 1978, as amended by the Water Quality Agreement of 1987, and any other agreements and amendments;</text></subparagraph> 
<subparagraph id="HCF775F55EF4247DA9BB63BB92C5EE3CC"><enum>(B)</enum><text>include the Regional Collaboration’s assessment of priorities for research needed to fulfill the terms of such Agreement; and</text></subparagraph> 
<subparagraph id="HB02066010C144C7CB1A5811512F89580"><enum>(C)</enum><text>identify all proposed research that may be used to develop a comprehensive environmental data base for the Great Lakes System and establish priorities for development of such data base. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="HA328F11655294CFEBAA04FFBF9843EAD"><enum>(c)</enum><header>Additional subsidization</header><text>Section 603 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H6ECD529C193A43BFAD8219D806D3A860"><enum>(i)</enum><header>Additional subsidization</header> 
<paragraph id="H97F471F814744941B13100C390FBA6A"><enum>(1)</enum><header>In general</header><text>In any case in which a State provides assistance to a municipality or intermunicipal, interstate, or State agency under subsection (d), the State may provide additional subsidization, including forgiveness of principal and negative interest loans—</text> 
<subparagraph id="HB9C91AD622184F08AC44A8D31746C3A"><enum>(A)</enum><text>to benefit a municipality that—</text> 
<clause id="H0AE6DC6F08B04D30A5CFA171FCDA2633"><enum>(i)</enum><text>meets the State’s affordability criteria established under paragraph (2); or</text></clause> 
<clause id="H7831DAB3F1EF454CB0CB07DE6C689292"><enum>(ii)</enum><text>does not meet the State’s affordability criteria if the recipient—</text> 
<subclause id="H80E4EC35A15645B0A36FF10D2D018E"><enum>(I)</enum><text>seeks additional subsidization to benefit individual ratepayers in the residential user rate class;</text></subclause> 
<subclause id="HCBAE7BD5C12146F1B7D632F4718FC00"><enum>(II)</enum><text>demonstrates to the State that such ratepayers will experience a significant hardship from the increase in rates necessary to finance the project or activity for which assistance is sought; and</text></subclause> 
<subclause id="HF60D5DDDDA1C4713BFDFAC3F93CB61CA"><enum>(III)</enum><text>ensures, as part of an assistance agreement between the State and the recipient, that the additional subsidization provided under this paragraph is directed through a user charge rate system (or other appropriate method) to such ratepayers; or</text></subclause></clause></subparagraph> 
<subparagraph id="H98047304F6F849A7A077464DFF1905DC"><enum>(B)</enum><text>to implement alternative processes, materials, and techniques (including nonstructural protection of surface waters, new or improved methods of waste treatment, and pollutant trading) that may result in cost savings or increased environmental benefit when compared to standard processes, materials, and techniques.</text></subparagraph></paragraph> 
<paragraph id="H659248AE3A19428B87E4BC2039058BA0"><enum>(2)</enum><header>Affordability criteria</header> 
<subparagraph id="H582C49F2874646A7BD46A3388CF43400"><enum>(A)</enum><header>Establishment</header><text>On or before September 30, 2006, and after providing notice and an opportunity for public comment, a State shall establish affordability criteria to assist in identifying municipalities that would experience a significant hardship raising the revenue necessary to finance a project or activity eligible for assistance under section 603(c)(1) if additional subsidization is not provided. Such criteria shall be based on income data, population trends, and other data determined relevant by the State.</text></subparagraph> 
<subparagraph id="H54DFF6DC74854D2483C500E1F2C20072"><enum>(B)</enum><header>Existing criteria</header><text>If a State has previously established, after providing notice and an opportunity for public comment, affordability criteria that meet the requirements of subparagraph (A), the State may use the criteria for the purposes of this subsection. For purposes of this Act, any such criteria shall be treated as affordability criteria established under this paragraph.</text></subparagraph> 
<subparagraph id="HC556CD89E04340BD8F005300F43F8BCC"><enum>(C)</enum><header>Information to assist states</header><text>The Administrator may publish information to assist States in establishing affordability criteria described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H9E38EEF50C8747D5AF2EDA09A81F7DED"><enum>(3)</enum><header>Priority</header><text>A State may give priority to a recipient for a project or activity eligible for funding under section 603(c)(1) if the recipient meets the State’s affordability criteria.</text></paragraph> 
<paragraph id="H0DBC1773243A4BDCA83B904900D02FBC"><enum>(4)</enum><header>Set-aside</header> 
<subparagraph id="HCE657CB71F454BB1A959AE1085F5D2F0"><enum>(A)</enum><header>In general</header><text>In any fiscal year in which the Administrator has available for obligation more than $1,400,000,000 for the purposes of carrying out this title, a State shall provide additional subsidization under this subsection in the amount specified in subparagraph (B) to eligible entities described in paragraph (1) for projects and activities identified in the State’s intended use plan prepared under section 606(c) to the extent that there are sufficient applications for such assistance.</text></subparagraph> 
<subparagraph id="HAAC191385DED4D6684939DFFEE1C00E5"><enum>(B)</enum><header>Amount</header><text>In a fiscal year described in subparagraph (A), a State shall set aside for purposes of subparagraph (A) an amount not less than 25 percent of the difference between—</text> 
<clause id="H031F5CC382A443EDAAD5A5E060006C74"><enum>(i)</enum><text>the total amount that would have been allotted to the State under section 604 for such fiscal year if the amount available to the Administrator for obligation under this title for such fiscal year was equal to $1,400,000,000; and</text></clause> 
<clause id="HE97AA859F07D4E33B28D4C04AF495BA3"><enum>(ii)</enum><text>the total amount allotted to the State under section 604 for such fiscal year.</text></clause></subparagraph></paragraph> 
<paragraph id="HDC6CD900B0234C0689C17EA6AA30E9C2"><enum>(5)</enum><header>Limitation</header><text>The total amount of additional subsidization provided under this subsection by a State may not exceed 30 percent of the total amount of capitalization grants received by the State under this title in fiscal years beginning after September 30, 2005.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="HEFB8D7D575B9473F94B55547D2745446"><enum>(b)</enum><header>Planning assistance</header><text>Section 604(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(b)</external-xref>) is amended by striking <quote>1 percent</quote> and inserting <quote>2 percent</quote>.</text></subsection>

In addition to the duties described in the Executive Order, such Task Force shall—</text> 
<paragraph id="H0C29315EE5DF486987DC43C001ABEE5E"><enum>(1)</enum><text>ensure that program and project implementation is coordinated, effective, and cost-efficient; and</text></paragraph> 
<paragraph id="H7558FF67DA864CEE9994E09CE99F59E"><enum>(2)</enum><text>work in cooperation on the development of budgets regarding the Great Lakes for the annual submissions by the President to Congress of the budget of the United States.</text></paragraph></section></title> 
<title id="HABDB28A8B113440B8F002868FB00A64B"><enum>V</enum><header>Framework for great lakes regional collaboration</header> 
<section id="H896103E86EBE43338C00B8B4F79C3E00"><enum>501.</enum><header>Collaboration</header><text display-inline="no-display-inline">There is a Framework for the Great Lakes Regional Collaboration, a document signed and endorsed on December 3, 2004, by several members of the Great Lakes Governors, Great Lakes Mayors, the Great Lakes Interagency Task Force, tribal leaders, and members of the Great Lakes Congressional Delegation. The duties of such Collaboration include—</text> 
<paragraph id="H5D2BB7B3CF3C40A19F4645000093C661"><enum>(1)</enum><text>developing a restoration and protection strategy to inform future program implementation funding decisions;</text></paragraph>
