<section section-type="section-one" id="H01893FDBC21549E69DD281E143CA4EA1" display-inline="no-display-inline"><enum>1.</enum><header>Use of safety belts and child restraint systems by children</header> 
<subsection id="H0AC2D5DF68594DAFA3436337287084CE"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section section-type="subsequent-section" id="HA84E293937074D2082C8B6854667E133"><enum>165.</enum><header>Use of safety belts and child restraint systems by children</header> 
<subsection id="HCDEC8ED2522C449F9441517E47241F59"><enum>(a)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HCF1A1DCEE1724527963D132E3DA06B1E"><enum>(1)</enum><header>Child safety restraint law</header><text>The term <term>child safety restraint law</term> means a State law that prohibits the driver of a passenger motor vehicle from driving the vehicle whenever there is in the vehicle a child under the age of 16 who does not have a safety belt properly fastened about the child’s body, except if the child is under the age of 9 and is properly secured in a child safety seat or other appropriate restraint system in accordance with the instructions of the manufacturer of such seat or system.</text></paragraph> 
<paragraph id="H2EFCD3EF772E4F8EB3679E01C561CD90"><enum>(2)</enum><header>Child safety seat</header><text>The term <term>child safety seat</term> means a specially designed seating system (including booster and child safety seats) which meets the Federal motor vehicle safety standards set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/571">section 571.213</external-xref> of title 49 of the Code of Federal Regulations, as such section may be amended from time to time, and which is either permanently affixed to a passenger motor vehicle or is affixed to a passenger motor vehicle by a safety belt or a universal attachment system.</text></paragraph> 
<paragraph id="HAA5D97B0FD194909AD169422A1A37845"><enum>(3)</enum><header>Motor vehicle</header><text>The term <term>motor vehicle</term> means a vehicle driven or drawn by mechanical power and manufactured primarily for use on public streets, roads, and highways, but does not include a vehicle operated only on a rail line.</text></paragraph> 
<paragraph id="H8020E701D865434197DFBBC3223F3DEA"><enum>(4)</enum><header>Multipurpose passenger vehicle</header><text>The term <term>multipurpose passenger vehicle</term> means a motor vehicle with motive power (except a trailer), designed to carry not more than 10 individuals, that is constructed either on a truck chassis or with special features for occasional off-road operation.</text></paragraph> 
<paragraph id="H980201555F0146429B9D8E3F068035DE"><enum>(5)</enum><header>Passenger car</header><text>The term <term>passenger car</term> means a motor vehicle with motive power (except a multipurpose passenger vehicle, motorcycle, or trailer) designed to carry not more than 10 individuals.</text></paragraph> 
<paragraph id="HA1AB66DE8E594662B9005B9425A5BA80"><enum>(6)</enum><header>Passenger motor vehicle</header><text>The term <term>passenger motor vehicle</term> means a passenger car or a multipurpose passenger vehicle.</text></paragraph> 
<paragraph id="H3335388BD75C4F1FBED9B35466F0F7D6"><enum>(7)</enum><header>Safety belt</header><text>The term <term>safety belt</term> means—</text> 
<subparagraph id="H2D965A482B35406598A8A01EC9D2C4A8"><enum>(A)</enum><text>with respect to open-body passenger motor vehicles, including convertibles, an occupant restraint system consisting of a lap belt or a lap belt and a detachable shoulder belt meeting applicable Federal motor vehicle safety standards; and</text></subparagraph> 
<subparagraph id="HDE03FA38C9CB4039BBA59C2591A05E7E"><enum>(B)</enum><text>with respect to other passenger motor vehicles, an occupant restraint system consisting of integrated lap and shoulder belts meeting applicable Federal motor vehicle standards.</text></subparagraph></paragraph></subsection> 
<subsection id="H2DFAA3503DC64C04A3FB2C9D76F58400"><enum>(b)</enum><header>Transfer of funds</header> 
<paragraph id="H41C1232CE5F846D38249EE60B0D9A545"><enum>(1)</enum><header>Fiscal year 2009</header><text>On October 1, 2008, if a State has not enacted a child safety restraint law, the Secretary shall transfer an amount equal to 4 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of section 104(b) to the apportionment of the State under section 402 to be used to implement a statewide comprehensive child and other passenger protection education program to promote child and other passenger safety, including education programs about proper seating positions for children in air bag equipped motor vehicles and instruction that increases the proper use of child restraint systems.</text></paragraph> 
<paragraph id="H33BE80B5039F4295AF247E42D7B12EB"><enum>(2)</enum><header>Fiscal year 2010</header><text>On October 1, 2009, if a State has not enacted a child safety restraint law, the Secretary shall transfer an amount equal to 6 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of section 104(b) to the apportionment of the State under section 402 to be used as described in paragraph (1) of this subsection.</text></paragraph> 
<paragraph id="H8D8CBD5C4794452DA8F37E2C1D56BBF7"><enum>(3)</enum><header>Fiscal year 2011</header><text>On October 1, 2010, if a State has not enacted a child safety restraint law, the Secretary shall transfer an amount equal to 8 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of section 104(b) to the apportionment of the State under section 402 to be used as described in paragraph (1) of this subsection.</text></paragraph> 
<paragraph id="H564A4EDF962545788F2DB9A12E50EA51"><enum>(4)</enum><header>Fiscal year 2012 and thereafter</header><text>On October 1, 2011, and each October 1 thereafter, if a State has not enacted a child safety restraint law, the Secretary shall transfer an amount equal to 10 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of section 104(b) to the apportionment of the State under section 402 to be used as described in paragraph (1) of this subsection.</text></paragraph></subsection> 
<subsection id="HC3B72D289E4747018EA757782CDBCF60"><enum>(c)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out with funds transferred under subsection (b) shall be 100 percent.</text></subsection> 
<subsection id="H4394E5A84F1141B0811167AF7006406"><enum>(d)</enum><header>Derivation of amount to be transferred</header><text>The amount to be transferred under subsection (b)(1), (b)(2), (b)(3), or (b)(4) may be derived from 1 or more of the following:</text> 
<paragraph id="H99FCCEBAF9964DF5B1501B0845C7CD6E"><enum>(1)</enum><text>The apportionment of the State under section 104(b)(1).</text></paragraph> 
<paragraph id="HB6103027F8894BFD9D5F344DAA005B8C"><enum>(2)</enum><text>The apportionment of the State under section 104(b)(3).</text></paragraph> 
<paragraph id="HCFC718952BB345A28FA4B2FCAC00224B"><enum>(3)</enum><text>The apportionment of the State under section 104(b)(4).</text></paragraph></subsection> 
<subsection id="H593F99BB141D4055AD12B2A2003F12F1"><enum>(f)</enum><header>Transfer of obligation authority</header> 
<paragraph id="H340399736C3F4A15B1379617BDCD3DDF"><enum>(1)</enum><header>In general</header><text>If the Secretary transfers under this section any funds to the apportionment of a State under section 402 for a fiscal year, the Secretary shall transfer an amount, determined under paragraph (2), of obligation authority distributed for the fiscal year to the State for Federal-aid highways and highway safety construction programs for carrying out projects under section 402.</text></paragraph> 
<paragraph id="H8A3836808FE3429F992133E61466FB83"><enum>(2)</enum><header>Amount</header><text>The amount of obligation authority referred to in paragraph (1) shall be determined by multiplying—</text> 
<subparagraph id="H7AC35101246B4DA79BC4A3979701868B"><enum>(A)</enum><text>the amount of funds transferred under this section to the apportionment of the State under section 402 for the fiscal year; by</text></subparagraph> 
<subparagraph id="H996E7EDCCCAC423DA4C744F6EEF9EE9B"><enum>(B)</enum><text>the ratio that—</text> 
<clause id="H2F477442C4F94332BBBD977EA01B963D"><enum>(i)</enum><text>the amount of obligation authority distributed for the fiscal year to the State for Federal-aid highways and highway safety construction programs; bears to</text></clause> 
<clause id="H67AD9A0FEAAA4B639D4378BC3C38364E"><enum>(ii)</enum><text>the total of the sums apportioned to the State for Federal-aid highways and highway safety construction programs (excluding sums not subject to any obligation limitation) for the fiscal year.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HBBA9DB2FFF2C4856BB9D53DB0265CD"><enum>(g)</enum><header>Limitation on applicability of obligation limitation</header><text>Notwithstanding any other provision of law, no limitation on the total of obligations for highway safety programs under section 402 shall apply to funds transferred under this section to the apportionment of a State under such section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6D78A1663A8C466FAA1E07DF56143424"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for such subchapter is amended by adding at the end the following:</text>
