<official-title>To amend the Help America Vote Act of 2002 to permit local jurisdictions within a State to conduct early voting in elections for Federal office held in such jurisdictions, and for other purposes.</official-title>

<section id="H6A63A8F521B14A36B8DCF9B18679E83" section-type="section-one"><enum>1.</enum><header>Providing Authority to Local Jurisdictions to Conduct Early Voting in Elections</header> 
<subsection id="H82D3896930ED44C0AF30D3B05FC1B0D0"><enum>(a)</enum><header>Authority</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended by inserting after section 303 the following new section:</text>

<section id="H1A66072522E246248DBAC9B4B02F8C15"><enum>303A.</enum><header>Authority of Local Jurisdictions to Conduct Early Voting</header> 
<subsection id="H09E615F773E44B6982015459F0D8C700"><enum>(a)</enum><header>In General</header><text>Notwithstanding any provision of State law, a jurisdiction which is located within a State and which is responsible for administering an election for Federal office may permit individuals to cast ballots in the election prior to the date of the election in the same manner in which ballots are cast on the date of the election, during such period prior to the date of the election as the jurisdiction may establish.</text></subsection> 
<subsection id="HD648903E1A3548D2BC71CE9F03B6EC4B"><enum>(b)</enum><header>Effective Date</header><text>Each State shall be required to comply with the requirements of this section on and after January 1, 2006.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H46C6BDA7FBA64CA8B12DE86ED6964B98"><enum>(b)</enum><header>Conforming Amendment Relating to Enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>sections 301, 302, and 303</quote> and inserting <quote>subtitle A of title III</quote> .</text></subsection> 
<subsection id="H7C4BC26864A346F0AF0717F4DD587E81"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 303 the following new item:</text>

<subsection id="HE559ABC532CB4F7689E7F3CB3FF009E"><enum>(a)</enum><header>Requiring Election Official to Accept Ballots</header><text display-inline="yes-display-inline">Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>), as amended by section 1(a), is amended by inserting after section 303A the following new section:</text>

<section id="H132660C2FC6442EF85CFF493B9DE2D99"><enum>303B.</enum><header>Requiring Acceptance of Absentee Ballots Without Sufficient Postage</header> 
<subsection id="H71161B6B17534F089C8442CC48146CCE"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">A State or local election official may not refuse any mail matter consisting of an absentee ballot sent by a voter to a State or local election official on the grounds that the matter does not include sufficient postage.</text></subsection> 
<subsection id="H5E7FE69EA5F042B286BB5E8B5B428CC7"><enum>(b)</enum><header>Effective Date</header><text>Each State shall be required to comply with the requirements of this section on and after January 1, 2006.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H249AF9A104D84353B2583E2B105DF5EC"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents of such Act, as amended by section 1(c), is amended by inserting after the item relating to section 303A the following new item:</text>

<section id="H116873E78B364F5897953E5700A3CF38" section-type="subsequent-section"><enum>3.</enum><header>Treatment of Provisional Ballots Cast at Incorrect Polling Place</header> 
<subsection id="H9511F3BA75084CBD8550B29C7E77CAB"><enum>(a)</enum><header>Requiring Ballots Cast at Incorrect Polling Places by Eligible Voters to be Counted</header><text>Section 302(a)(4) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482(a)(4)</external-xref>) is amended by striking <quote>eligible under State law to vote,</quote> and inserting the following: <quote>eligible under State law to vote in that election at the polling place at which the ballot is cast or at any other polling place in the State,</quote>.</text></subsection> 
<subsection id="H4DEDE4E90C284E9EAE6027AD04C0E17E"><enum>(b)</enum><header>Notifying Individuals of Option to Cast Ballots at Correct Polling Place</header><text>Section 302(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482(a)(1)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>, and in the case of an individual whose name does not appear on the official list of eligible voters for the polling place, shall provide the individual with the location of the polling place at which the individual’s name does appear on the official list of eligible voters and notify the individual in writing that the individual may cast a ballot at that polling place instead of a provisional ballot under this subsection.</quote></text></subsection> 
<subsection id="H26105C87AB4C43F1B875C32F44ADF92D"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall apply with respect to elections held during 2006 and any succeeding year.</text></subsection></section>
