<legis-type>A BILL</legis-type> 
<official-title>To provide an amnesty period during which veterans and their family members can register certain firearms in the National Firearms Registration and Transfer Record, and for other purposes.</official-title> 
</form> 
<legis-body id="H277597EED60149DFADE9F9D7785F9990" style="OLC"> 
<section section-type="section-one" id="HC663134ED56140ABBABAB7C033008B10" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Heritage Firearms Act of 2005</short-title></quote>.</text></section> 
<section id="H53CB3814B12A4BBC8D74B97B928DCBE5"><enum>2.</enum><header>Amnesty period for veterans to register qualifying firearms</header> 
<subsection id="H14B32F14734648DE92586700F9852E64"><enum>(a)</enum><header>Registration</header><text>Subject to such regulations as the Attorney General may prescribe, the applicable veteran or a member of such a veteran’s family, who owns and possesses a qualifying firearm, may register such firearm in the National Firearms Registration and Transfer Record (described in <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986) during the amnesty period.</text></subsection> 
<subsection id="HC761DC7BDBFF4E858EBC3691B382F41"><enum>(b)</enum><header>Qualifying firearm</header> 
<paragraph id="H8E3819FB49424CAB9BB2CBA00E09624"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the term <term>qualifying firearm</term> means any firearm which was acquired—</text> 
<subparagraph id="H3A22167727DE4F20BFBE0038E0009ECF"><enum>(A)</enum><text>before October 31, 1968; and</text></subparagraph> 
<subparagraph id="H434716D9D5BB48EAA652860014E5F445"><enum>(B)</enum><text>by a veteran, while such veteran was a member of the Armed Forces and was stationed outside the continental United States.</text></subparagraph></paragraph> 
<paragraph id="HF65A5C9D5CC349BD80D1E244223597D1"><enum>(2)</enum><header>Presumption of validity</header><text>With respect to any firearm, in the absence of clear and convincing evidence to the contrary the Attorney General shall accept as true and accurate any affidavit, document, or other evidence submitted by an individual to establish that such firearm meets the requirements of paragraph (1).</text></paragraph></subsection> 
<subsection id="H890667F810014BE48913EEF4CBE8788E"><enum>(c)</enum><header>Hearings</header><text>If the Attorney General determines that any individual may not register a firearm under subsection (a) during the amnesty period, the Attorney General, upon the request of such individual, shall—</text> 
<paragraph id="HB3EB7CDE450242209B409C7117BDC954"><enum>(1)</enum><text>provide such individual any evidence on which the Attorney General’s decision is based; and</text></paragraph> 
<paragraph id="H0E3BEE52ED104F1890B5DDED24CD2000"><enum>(2)</enum><text>promptly hold a hearing to review such determination.</text></paragraph></subsection> 
<subsection id="H92B841AC5466458FBEF913F615969C7D"><enum>(d)</enum><header>Limited immunity</header> 
<paragraph id="H002D079179374CD8901FC39838D3B401"><enum>(1)</enum><header>Criminal liability under title 18</header><text>Any individual who registers a firearm under subsection (a)—</text> 
<subparagraph id="HF5FE3395B75345C09574919EA38E9BD7"><enum>(A)</enum><text>shall be treated, for purposes of subsections (a)(3) and (o) of <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922</external-xref> of title 18, United States Code, as having lawfully acquired and possessed the firearm before the date of the enactment of chapter 44 of such title and each of such chapter’s provisions; and</text></subparagraph> 
<subparagraph id="HB75BAC67CB124954BC13B89C752149CD"><enum>(B)</enum><text>shall not be liable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, for any violation of such chapter which—</text> 
<clause id="H3B74826B3D7A44C1BA1E0915B7EEAED5"><enum>(i)</enum><text>is based solely on such individual’s ownership, possession, transportation, importation, or alteration of such firearm; and</text></clause> 
<clause id="H05CD5F7B05A245269859A3309E67AB93"><enum>(ii)</enum><text>occurred before or concurrent with such registration.</text></clause></subparagraph></paragraph> 
<paragraph id="HCE083B0BEFE64CE1A26F276E5F57CBE2"><enum>(2)</enum><header>Criminal liability under Internal Revenue Code</header><text>Except as provided in paragraph (3), any individual who registers a firearm under subsection (a) shall not be liable under chapter 53 or 75 of the Internal Revenue Code of 1986 for any violation of such chapters which relates to such firearm and which occurred before or concurrent with such registration.</text></paragraph> 
<paragraph id="H097C2AB815324C4C97C444F0289C7294"><enum>(3)</enum><header>Transfer tax liability</header><text>Paragraph (2) shall not affect the liability of any individual for any transfer tax imposed under <external-xref legal-doc="usc" parsable-cite="usc/26/5811">section 5811</external-xref> of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="H4C3CCC4A0DFF43A60000334F98462463"><enum>(4)</enum><header>Attempts to register</header><text>In the case of an applicable veteran or a member of such a veteran’s family who attempts to register a qualifying firearm in the National Firearms Registration and Transfer Record at a time other than during the amnesty period, paragraphs (1), (2), and (3) shall apply with respect to such individual if such individual surrenders such firearm to a law enforcement agency not later than 30 days after notification by the Attorney General of potential criminal liability for continued possession of the firearm.</text></paragraph></subsection> 
<subsection id="H61FB1779FCB64AD8AB5CD277C3DCABF2"><enum>(e)</enum><header>Forfeiture</header><text>Any firearm registered under subsection (a) shall not be subject to seizure or forfeiture under chapter 53 or 75 of the Internal Revenue Code or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, for any violation of such chapters which relates to such firearm and which occurred before or concurrent with such registration.</text></subsection> 
<subsection id="HB6096B83A5AC43328F9CC8F559F7FB73"><enum>(f)</enum><header>Notice; forms; mailbox rule</header> 
<paragraph id="HF3B9076082D6471CB648BA003CAD8600"><enum>(1)</enum><header>Notice of amnesty period</header><text>The Attorney General shall provide clear printed notices providing information regarding the amnesty period and registering a firearm during such period. To the extent feasible, the Attorney General shall ensure that such notices are posted in post offices, law enforcement buildings, buildings of the Department of Veterans Affairs, and in the businesses of licensed firearms dealers.</text></paragraph> 
<paragraph id="H76771771796D48B39773FA3ED2830480"><enum>(2)</enum><header>Forms</header><text>The Attorney General shall make available any forms necessary for registering a firearm in the National Firearms Registration and Transfer Record. To the extent feasible, the Attorney General shall make such forms available in the locations referred to in paragraph (1) and through the website for the Bureau of Alcohol, Tobacco, Firearms, and Explosives.</text></paragraph> 
<paragraph id="HB1E412560ED2451FB642F9A7937F9484"><enum>(3)</enum><header>Mailbox rule</header><text>For purposes of this section, the Attorney General shall treat any form that is postmarked during the amnesty period as received during the amnesty period.</text></paragraph></subsection> 
<subsection id="H0DBECECAA6BF4D50B4DA3BC199B5D31B"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H4FB90288BFC5409AA658F6F635192E11"><enum>(1)</enum><header>Amnesty period</header><text>The term <term>amnesty period</term> means the 90-day period beginning on the date that is 90 days after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HAFD658887B8547A8A792D50541290012"><enum>(2)</enum><header>Firearm</header><text>The term <term>firearm</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845</external-xref> of the Internal Revenue Code of 1986, except that such term does not include—</text> 
<subparagraph id="H5018D619FB5241A5883F00F65536A4C4"><enum>(A)</enum><text>any device described in subsection (f)(1) of such section; or</text></subparagraph> 
<subparagraph id="HE68940FF2B6840FE856988A6D5FF6DC3"><enum>(B)</enum><text>any combination of parts—</text> 
<clause id="HE8480F5E709A4A628CEAE5FFA9E6BEFE"><enum>(i)</enum><text>designed or intended for use in converting any device into a device described in subparagraph (A); or</text></clause> 
<clause id="H54BA80D84C46459287D08DEF43591DEA"><enum>(ii)</enum><text>from which a device described in subparagraph (A) may be readily assembled.</text></clause></subparagraph></paragraph> 
<paragraph id="H0708338791BA48D6877DF03131C38F90"><enum>(3)</enum><header>Applicable veteran</header><text>With respect to any firearm, the term <term>applicable veteran</term> means the veteran described in subsection (b)(1)(B).</text></paragraph> 
<paragraph id="H05E3C7659268441EB36914BAA0F586DC"><enum>(4)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101(2)</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="H4C5A86DBCA204FE7BC30817DC8DB851"><enum>(5)</enum><header>Family</header><text>The term <term>family</term> means, with respect to a veteran, the grandparents of such veteran, the grandparents of such veteran’s spouse, the lineal descendants of such grandparents, and any spouse of such a lineal descendant. A spouse of an individual who is legally separated from such individual under a decree of divorce or separate maintenance shall be treated as such individual’s spouse for purposes of this paragraph. Individuals related by the half blood or by legal adoption shall be treated as if they were related by the whole blood for purposes of this paragraph.</text></paragraph> 
<paragraph id="H83C89A44C1494F49B6AC756BC48E9F13"><enum>(6)</enum><header>Continental United States</header><text>The term <term>continental United States</term> means the several States and the District of Columbia, but does not include Alaska or Hawaii.</text></paragraph></subsection></section> 
<section id="H9984845BA1D7428CA0338722D2CE56D7"><enum>3.</enum><header>Transfer of firearms to museums</header> 
<subsection id="HEB1225DBF69541A8AA0611F856DCE8EE"><enum>(a)</enum><header>Transfer of forfeited firearms to museums</header> 
<paragraph id="H322B92ECB7724A5CA636669514849C51"><enum>(1)</enum><header>In general</header><text>The Attorney General shall transfer each firearm which has been forfeited to the United States to the first qualified museum that submits a request for such firearm in such form and manner as the Attorney General may specify.</text></paragraph> 
<paragraph id="H5A60AF5CA50F4DCCB4BB0000733FE5D8"><enum>(2)</enum><header>Destruction of forfeited firearms prohibited</header><text>The Attorney General shall not destroy any firearm which has been forfeited to the United States until the end of the 5-year period beginning on the date of such forfeiture.</text></paragraph> 
<paragraph id="HFA01813F8A6E40E2AC23D679530741B6"><enum>(3)</enum><header>Catalogue of firearms</header><text>With respect to each firearm which is available to be transferred to a museum under paragraph (1), the Attorney General shall, not later than 60 days after the forfeiture of such firearm, publish information which identifies such firearm (including a picture) on the web page of the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Such information shall be available to the public without cost and without restriction.</text></paragraph> 
<paragraph id="HA668B9E5F73C4DB887B25C48E7D6FFD"><enum>(4)</enum><header>Registration of firearms</header><text>Any firearm transferred under paragraph (1) to a qualified museum shall be registered to the transferee in the National Firearms Registration and Transfer Record (described in <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986).</text></paragraph> 
<paragraph id="HB9C404969D4F4053A861389FAB6B1153"><enum>(5)</enum><header>Firearm</header><text>For purposes of this subsection, the term <term>firearm</term> means any firearm (as defined in section 2(g)(2)) which is treated as a curio or relic under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code.</text></paragraph> 
<paragraph id="H1928702EB6084BF5983B53FAFA718100"><enum>(6)</enum><header>Qualified museum</header><text>For purposes of this subsection, the term <term>qualified museum</term> means—</text> 
<subparagraph id="HA010D1BC9B344F93B10008B8A37CB32"><enum>(A)</enum><text>any museum owned or operated by a unit of Federal, State, or local government; and</text></subparagraph> 
<subparagraph id="H8F90ABD56F2C4536B167B8F763A000A6"><enum>(B)</enum><text>any museum which—</text> 
<clause id="HD186D711BA274F3997AFF57BC23CBBA1"><enum>(i)</enum><text>is open to the public;</text></clause> 
<clause id="HB1E99FDD750B4967985400DEB3CC774F"><enum>(ii)</enum><text>is incorporated as not-for-profit corporation under applicable state law;</text></clause> 
<clause id="H37055338368147A485F2BA716D4C68A2"><enum>(iii)</enum><text>may possess a firearm in the collection of the museum under the laws of the State in which the collection of the museum is displayed;</text></clause> 
<clause id="HF59DBD1614684B6E973E40AEFCAB14EA"><enum>(iv)</enum><text>holds a license under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, as a collector of curios or relics; and</text></clause> 
<clause id="HBEF787F40B444EBA9CDBB7A7421C1EB3"><enum>(v)</enum><text>certifies to the Attorney General that—</text> 
<subclause id="H33C3A79F482E49CA9EA06EA14C1735EB"><enum>(I)</enum><text>the museum is not engaged in the trade or business of buying or selling firearms,</text></subclause> 
<subclause id="H89AB4625AEC0438785185DA678C79691"><enum>(II)</enum><text>with respect to the transfer of any firearm under paragraph (1), the museum is not requesting the transfer of such firearm for purpose of sale, and</text></subclause> 
<subclause id="HF741E91E5E9B4C12A7D7C9F070D54D7E"><enum>(III)</enum><text>the museum shall, not later than 90 days after the date on which such museum ceases operations, file an application pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986 to transfer any machinegun transferred to the museum under paragraph (1) to an entity or person who may lawfully possess such machinegun under <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(o)</external-xref> of title 18, United States Code, or abandon such machinegun to Federal, State, or local law enforcement authorities.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H3655BAA28605479BB450826D747809BC"><enum>(b)</enum><header>Transfer of machineguns to museums</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(o)(2)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H991D8E4C44AD4E0B894503FFB1D5FC9C"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H5B33130D2FD247A49266E40382CC7F73"><enum>(2)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></paragraph> 
<paragraph id="H560AA0346BEA486D94C1DE1E7CAACC2B"><enum>(3)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text> 
<quoted-block id="H8EDF60896632440CBE4EA3B639E37BF"> 
<subparagraph indent="up1" id="H2C8B67B26AE54B329FCAD0D803710000"><enum>(B)</enum><text>a transfer to or by, or possession by, a museum which is open to the public and incorporated as a not-for-profit corporation under applicable State law; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
