<official-title>To provide for the medical use of marijuana in accordance with the laws of the various States.</official-title>

<legis-body id="HEBCC2B0798CE4882867D434F2901BCAD" style="OLC"> 
<section section-type="section-one" id="H319B18858F6B44FE96B3E92C82E8116" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>States’ Rights to Medical Marijuana Act</short-title></quote>.</text></section> 
<section id="HE8E78EC6581D42528ED09F4F34C46506"><enum>2.</enum><header><act-name parsable-cite="CSA">Controlled Substances Act</act-name></header> 
<subsection id="H4584CFBD7B454347AAB99662472DC65"><enum>(a)</enum><header>Schedule</header><text>Marijuana is moved from schedule I of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> to schedule II of such Act.</text></subsection> 
<subsection id="HB25137C8ED5A4D56B2AE78B8825C6042"><enum>(b)</enum><header>Prescription or recommendation</header> 
<paragraph id="HB9FF7F5A9ECE41889111199C5F1970EF"><enum>(1)</enum><header>In general</header><text>No provision of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> shall prohibit or otherwise restrict—</text> 
<subparagraph id="H61DF5B3517E249299BBA277300B714C0"><enum>(A)</enum><text>the prescription or recommendation of marijuana by a physician for medical use,</text></subparagraph> 
<subparagraph id="H1D3FDA3FCFF248F48E3892DC1EA696B2"><enum>(B)</enum><text>an individual from obtaining and using marijuana from a prescription or recommendation of marijuana by a physician for medical use by such individual, or</text></subparagraph> 
<subparagraph id="H3ADEB0BD07B6476F92C9002DFA9B4DB4"><enum>(C)</enum><text>a pharmacy from obtaining and holding marijuana for the prescription or recommendation of marijuana by a physician for medical use under applicable State law</text></subparagraph><continuation-text continuation-text-level="paragraph">in a State in which marijuana may be prescribed or recommended by a physician for medical use under applicable State law.</continuation-text></paragraph> 
<paragraph id="H68518BE4AEB44DBE8891041564E1F2E8"><enum>(2)</enum><header>Production</header><text>No provision of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> shall prohibit or otherwise restrict an entity established by a State, in which marijuana may be prescribed or recommended by a physician for medical use, for the purpose of producing marijuana for prescription or recommendation by a physician for medical use from producing and distributing marijuana for such purpose.</text></paragraph></subsection></section> 
<section id="H79B614AD29CB4CB6B7986E1CB3866298"><enum>3.</enum><header>Federal Food, Drug, and Cosmetic Act</header> 
<subsection id="H4410948D1E554A14942F01B15506D1F2"><enum>(a)</enum><header>In general</header><text>No provision of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> shall prohibit or otherwise restrict—</text> 
<paragraph id="H0BB0304602314C2BB950717DCA20E9C9"><enum>(1)</enum><text>the prescription or recommendation of marijuana by a physician for medical use,</text></paragraph> 
<paragraph id="H883BAE885F744D288716BDB820DC34FF"><enum>(2)</enum><text>an individual from obtaining and using marijuana from a prescription or recommendation of marijuana by a physician for medical use by such individual, or</text></paragraph> 
<paragraph id="HC46D47CD5B004092B68CB4BA00E52F98"><enum>(3)</enum><text>a pharmacy from obtaining and holding marijuana for the prescription or recommendation of marijuana by a physician for medical use,</text></paragraph><continuation-text continuation-text-level="subsection">in a State in which marijuana may be prescribed or recommended by a physician for medical use under applicable State law.</continuation-text></subsection> 
<subsection id="H93A8919E562F42D499B600842135201D"><enum>(b)</enum><header>Production</header><text>No provision of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> shall prohibit or otherwise restrict an entity established by a State, in which marijuana may be prescribed or recommended by a physician for medical use, for the purpose of producing marijuana for prescription or recommendation by a physician for medical use from producing and distributing marijuana for such purpose.</text></subsection></section> 
<section id="HBBFBB489DA4B4F82B0BF5BFC60E3011D"><enum>4.</enum><header>Relation of Act to certain prohibitions relating to smoking</header><text display-inline="no-display-inline">This Act does not affect any Federal, State, or local law regulating or prohibiting smoking in public.</text></section>
