<official-title>To amend title 10, United States Code, to permit certain retired members of the uniformed services who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs for their disability and either retired pay by reason of their years of military service or Combat-Related Special Compensation.</official-title>

<section id="HB6BDE1CE54B34C35A84CB2FA1EC3B6B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Retired Pay Restoration Act of 2005</short-title></quote>.</text></section> 
<section id="HD91CC545B2754B1C8FEF38E0D0D89D9F"><enum>2.</enum><header>Eligibility for payment of both retired pay and veterans’ disability compensation for certain military retirees with compensable service-connected disabilities</header> 
<subsection id="H1BEB925D44454C7AB6E4947CF08401C"><enum>(a)</enum><header>Extension of concurrent receipt authority to retirees with service-connected disabilities rated less than 50 percent</header> 
<paragraph id="H4A775FF3A1A046B6B9D0F797E62DDC01"><enum>(1)</enum><header>Repeal of 50 percent requirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1414">Section 1414</external-xref> of title 10, United States Code, is amended by striking paragraph (2) of subsection (a).</text></paragraph> 
<paragraph id="H3D36DDD4D22D4D1F944BC583A5FB4697"><enum>(2)</enum><header>Computation</header><text>Paragraph (1) of subsection (c) of such section is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H97A011707EF84A398D75CFBE5F75A48C"><enum>(G)</enum><text>For a month for which the retiree receives veterans’ disability compensation for a disability rated as 40 percent or less or has a service-connected disability rated as zero percent, $0.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB2DDC0BF5EAA4B23A842C0FF6D6A67D"><enum>(b)</enum><header>Repeal of phase-in of concurrent receipt for retirees with service-connected disabilities rated as total</header><text>Subsection (a)(1) of such section is amended by striking <quote>except that</quote> and all that follows and inserting </text> 
<quoted-block style="OLC" id="H5FC594EE3C6F42C500A45FD04FEB54" display-inline="yes-display-inline"><text display-inline="yes-display-inline">except—</text> 
<subparagraph id="HF62F3AC263FB4A6B8E554012E89E5E30"><enum>(A) </enum><text display-inline="yes-display-inline">in the case of a qualified retiree receiving veterans’ disability compensation for a disability rated as 100 percent, payment of retired pay to such veteran is subject to subsection (c) only during the period beginning on January 1, 2004, and ending on December 31, 2004; and</text></subparagraph> 
<subparagraph id="H1AB0B7FEAB294F0E83EADA793063C776"><enum>(B)</enum><text>in the case of a qualified retiree receiving veterans’ disability compensation for a disability rated as total by reason of unemployability, payment of retired pay to such veteran is subject to subsection (c) only during the period beginning on January 1, 2004, and ending on December 31, 2005.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H77C4FFB70E344452A33BCB4152CE3514"><enum>(c)</enum><header>Clerical amendments</header> 
<paragraph id="H419A1609DD6F401C8EB89F43968F7990" display-inline="no-display-inline"><enum>(1)</enum><text>The heading for section 1414 of such title is amended to read as follows:</text>

<paragraph id="HFD49F80CF5E046FFB6805DAC701EB3D7"><enum>(2)</enum><text>The item relating to such section in the table of sections at the beginning of chapter 71 of such title is amended to read as follows:</text>

<subsection id="HEDC9F0BEE7CB4EF6800430F295F05B5F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2006, and shall apply to payments for months beginning on or after that date.</text></subsection></section> 
<section id="HB1B77B6A61814B9193386BE1FDF28745"><enum>3.</enum><header>Coordination of service eligibility for combat-related special compensation and concurrent receipt</header> 
<subsection id="H515D307445B7431994BB8177FD9DCF37"><enum>(a)</enum><header>Eligibility for TERA retirees</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a</external-xref> of title 10, United States Code, is amended by striking <quote>entitled to retired pay who—</quote> and inserting </text> 
<quoted-block style="OLC" id="HB4D14AF65CA44FAE8E4F7CA4D6DF12BC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">who—</text> 
<paragraph id="H9689E7E4ABA24909AC0874564B13CE9E"><enum>(1)</enum><text display-inline="yes-display-inline">is entitled to retired pay, other than a member retired under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/61">chapter 61</external-xref> of this title with less than 20 years of service creditable under <external-xref legal-doc="usc" parsable-cite="usc/10/1405">section 1405</external-xref> of this title and less than 20 years of service computed under <external-xref legal-doc="usc" parsable-cite="usc/10/12732">section 12732</external-xref> of this title; and</text></paragraph> 
<paragraph id="HA14C707BA60E40F6BF44183E26454537"><enum>(2)</enum><text> has a combat-related disability.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5042B165CF524CE28224B59338BBD0D1"><enum>(b)</enum><header>Amendments to standardize similar provisions</header> 
<paragraph id="H467C4E4460044DA08E18F57D7DAADD87" display-inline="no-display-inline"><enum>(1)</enum><header>Clerical amendment</header><text>The heading for paragraph (3) of section 1413a(b) of such title is amended by striking <quote><header-in-text level="paragraph" style="OLC">rules</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">rule</header-in-text></quote>.</text></paragraph> 
<paragraph id="HAD48BECCB993473CB2EC1B8949BC7D7F"><enum>(2)</enum><header>Qualified retirees</header><text>Subsection (a) of section 1414 of such title, as amended by section 2(a), is amended—</text> 
<subparagraph id="H00C124EF021844E9ACFB752B74091500"><enum>(A)</enum><text>by striking <quote>a member or</quote> and all that follows through <quote>retiree’)</quote> and inserting <quote>a qualified retiree</quote>; and</text></subparagraph> 
<subparagraph id="HBA0EF1F19F6340C2B08B4E59BF48DBEC"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H70243EB208A34141A4BFEC749521A1F" indent="down1"><enum>(2)</enum><header>Qualified retirees</header><text>For purposes of this section, a qualified retiree, with respect to any month, is a member or former member of the uniformed services who—</text> 
<subparagraph id="HD066CAA09E8347CEA36EC2829E1B6A5"><enum>(A)</enum><text>is entitled to retired pay, other than in the case of a member retired under chapter 61 of this title with less than 20 years of service creditable under section 1405 of this title and less than 20 years of service computed under section 12732 of this title; and</text></subparagraph> 
<subparagraph id="HB70B92E4DB274A31B545075800F08E00"><enum>(B)</enum><text>is also entitled for that month to veterans’ disability compensation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HEE14E391D1E041A6005C782FBB5F8506"><enum>(3)</enum><header>Disability retirees</header><text>Subsection (b) of section 1414 of such title is amended—</text> 
<subparagraph id="H40DFD1E2CB79405F8C5BC775164F0839"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Special rules</header-in-text></quote> in the subsection heading and all that follows through <quote>is subject to</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Special rule for chapter 61 disability retirees</header-in-text>.—In the case of a qualified retiree who is retired under chapter 61 of this title, the retired pay of the member is subject to</quote>; and</text></subparagraph> 
<subparagraph id="H9F621416521B47F7B531CA6D90F152DC"><enum>(B)</enum><text>by striking paragraph (2).</text></subparagraph></paragraph></subsection> 
<subsection id="HD72CA8FFEAC94050918E8C0747C04CBD"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2006, and shall apply to payments for months beginning on or after that date.</text></subsection></section>
