<official-title>To amend title 10, United States Code, to improve transition assistance provided to members of the Armed Forces being discharged, released from active duty, or retired, and for other purposes.</official-title>

<section id="HC138128148024E6E87D76929A9D8D7E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service Members’ Enhanced Transition Services Act of 2005</short-title></quote>.</text></section> 
<section id="H070DC0629A6D4E73B7FAED568637827"><enum>2.</enum><header>Transmittal to Department of Veterans Affairs of medical records of all members separating from active duty</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/58">Chapter 58</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H8D048C599E874E1C88CFD0D4CC626CB5"><enum>(1)</enum><text>by inserting before subsection (c) of section 1142 the following:</text> 
<quoted-block style="USC" id="HABE7B863F4F740588269B6F6DD891FF"> 
<section id="H4A00D0C85066425D00D02C440511DC28"><enum>1142a.</enum><header>Members separating from active duty: transmittal of medical records to Department of Veterans Affairs</header></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFEE2BAB31731447E9DA0C49D68384E7B"><enum>(2)</enum><text>in section 1142a, as designated by paragraph (1)—</text> 
<subparagraph id="H133E663941034CF793B8102F3FAD83DD"><enum>(A)</enum><text>by striking <quote>(c) <header-in-text level="subsection" style="USC">Transmittal of Medical Information to Department of Veterans Affairs.—</header-in-text></quote>; </text></subparagraph> 
<subparagraph id="H040348C3010B41CDA6DFC0D370821EF6"><enum>(B)</enum><text>by striking <quote>a member being medically separated or being retired under chapter 61 of this title</quote> and inserting <quote>each member of the armed forces being discharged, released from active duty, or retired</quote>; and</text></subparagraph> 
<subparagraph id="H698AEE4CA6C74BA987482BA405E3249C"><enum>(C)</enum><text>by inserting <quote>of the member</quote> before the period at the end. </text></subparagraph></paragraph> </section> 
<section id="HEC9A857F2C7042A68F2D192DD83C0026"><enum>3.</enum><header>Preseparation counseling and transition services</header> 
<subsection id="H430895EA4E5249029EE9DB62BCF62B1" display-inline="no-display-inline"><enum>(a)</enum><header>Individualized services, etc</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/10/1142">section 1142</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H8880C619AF694CD9A81FF64C6B6848ED"><enum>(1)</enum><text>in the first sentence of paragraph (1)—</text> 
<subparagraph id="HC8219AFA0E374BBCB7586BB4593DD4CA"><enum>(A)</enum><text>by striking <quote>shall (except as provided in paragraph (4)) provide for individual preseparation counseling of</quote> and inserting <quote>shall (except as provided in paragraph (7)) provide preseparation counseling and additional individualized transition services to</quote>; and</text></subparagraph> 
<subparagraph id="H9D2FB242D2C747D3BC7FFE2C2B6FC9DE"><enum>(B)</enum><text>by inserting <quote>under conditions other than dishonorable</quote> after <quote>active duty</quote>; </text></subparagraph></paragraph> 
<paragraph id="H6599E97A3C3D4D839431F2D9E3B95731"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (7); and</text></paragraph> 
<paragraph id="H7D280FAEA0FD4CA9A50676D3C393F5BB"><enum>(3)</enum><text>by inserting after paragraph (3) the following new paragraphs:</text> 
<quoted-block id="H6C23CB77809E499083C30019A9F959C2" style="USC"> 
<paragraph id="H3D55355AA5D6464EB5C5537161FDAC01" indent="up1"><enum>(4)</enum><text>For members of the reserve components being separated from service on active duty for a period of more than 30 days, the Secretary concerned shall require that preseparation counseling and services under this section be provided to all such members before the members are separated.</text></paragraph> 
<paragraph id="H7AC5BD57CF264C9B85B28F69F9869334" indent="up1"><enum>(5)</enum><text>In carrying out this section, the Secretary concerned shall ensure that such counseling and services are provided to officers as well as enlisted members.</text></paragraph> 
<paragraph id="HAF3899C6B6C543C88394DDE0FEC582FD" indent="up1"><enum>(6)</enum><text>The Secretary concerned shall ensure that commanders of members who are required to be provided preseparation counseling and services under this section authorize the members to be provided such counseling and services during duty time.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBD6A4DFC9C5E424294539BABB13E3675"><enum>(b)</enum><header>Additional information to be provided</header><text>Subsection (b) of such section is amended—</text> 
<paragraph id="H768BFEE6B82B49E7B0CBF98F36C70CD"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="USC">Counseling.—</header-in-text>Counseling under</quote> and inserting <quote><header-in-text level="subsection" style="USC">Counseling and additional individualized transitional services.—</header-in-text>Counseling and additional individualized transitional services under</quote>;</text> </paragraph> 
<paragraph id="H5E4808E71AAA444D0000F44B4F22B27C"><enum>(2)</enum><text>by striking <quote>(4) Information concerning Government</quote> and inserting the following:</text>

<subparagraph id="HFD476EE11FED415E00C14F1FDD66C07"><enum>(A)</enum><text>certification and licensure requirements that are applicable to civilian occupations;</text></subparagraph> 
<subparagraph id="HA2A3E6A3082F4F67B4003824EB290257"><enum>(B)</enum><text>civilian occupations that correspond to military occupational specialties; and</text></subparagraph> 
<subparagraph id="HC6B72697EF174388808863374000D77"><enum>(C)</enum><text display-inline="yes-display-inline">Government</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8A0BF70AB60C462BA2B1FA133C67C729"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text> 
<quoted-block style="USC" id="H8667661A87434B13999910861DFC6299" display-inline="no-display-inline"> 
<paragraph id="H896A727588924175002634825FB87300"><enum>(11)</enum><text display-inline="yes-display-inline">Information concerning the priority of service for veterans in the receipt of employment, training, and placement services provided under qualified job training programs of the Department of Labor.</text></paragraph> 
<paragraph id="HECD6B3B50FD940EA853DD8EFAC8E0100"><enum>(12)</enum><text>Information concerning veterans small business ownership and entrepreneurship programs of the Small Business Administration and the National Veterans Business Development Corporation.</text></paragraph> 
<paragraph id="H0C25AE5736D8453B8F8E5BC213EF8FB2"><enum>(13)</enum><text>Information concerning employment and reemployment rights and obligations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38. </text></paragraph> 
<paragraph id="H94D734B9EA0349ADADB3519D9743FDF0"><enum>(14)</enum><text>Information concerning veterans preference in Federal employment and Federal procurement opportunities.</text></paragraph> 
<paragraph id="HF2178F8014344CAEA9C680F63F800F2"><enum>(15)</enum><text>Information concerning homelessness, including risk factors, awareness assessment, and contact information for preventative assistance associated with homelessness.</text></paragraph> 
<paragraph id="HF4BE33CD94CC4075A0DD7945591C77C6"><enum>(16)</enum><text>Contact information for housing counseling and assistance.</text></paragraph> 
<paragraph id="H1CB4625EAB894A37A489A46FC4A63131"><enum>(17)</enum><text display-inline="yes-display-inline">A description (to be developed with the assistance of the Secretary of Veterans Affairs) of the health care and other benefits to which the member may be entitled under the laws administered by the Secretary of Veterans Affairs.</text></paragraph> 
<paragraph id="H5A342FAB2D554C6D98C618C10290E063"><enum>(18)</enum><text display-inline="yes-display-inline">In the case of a member who, as determined pursuant to the preseparation physical examination conducted under section 1145(d) of this title, may be eligible for compensation or pension benefits under the laws administered by the Secretary of Veterans Affairs, a referral (to be provided with the assistance of the Secretary of Veterans Affairs) for a medical examination by the Secretary of Veterans Affairs referred to as a compensation and pension examination.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCDF8C3578F5B44E2B291B50381C18F3B"><enum>(c)</enum><header>Additional provisions</header><text>Such section is further amended by adding at the end the following new subsections:</text> 
<quoted-block id="H186BDCFA4E1C4468B3163B7C88A419E0" style="USC"> 
<subsection id="HB74E6F9707E54912A01E8000CD19B95D"><enum>(c)</enum><header>Content relevant to regular and reserve component members</header><text>The Secretary concerned shall ensure that preseparation counseling and services under this section include material that is specifically relevant to the needs of members being separated from active duty from a regular component, the needs of members of the reserve components being separated from active duty, and the needs of members of the National Guard being separated from full-time National Guard duty.</text> </subsection> 
<subsection id="H887451F3D02C4A80BC99E10597C51F09" display-inline="no-display-inline"><enum>(d)</enum><header>Locations for services to be provided</header><text display-inline="yes-display-inline">The Secretary concerned shall ensure that the locations at which preseparation counseling and services are provided under this section include the following:</text> 
<paragraph id="H12242112B665485C8DBCC54DF6B0872"><enum>(1)</enum><text>Each military installation under the jurisdiction of the Secretary.</text></paragraph> 
<paragraph id="H80CCAE8049314E2000915555417778FF"><enum>(2)</enum><text display-inline="yes-display-inline">Each armory and military family support center of the National Guard.</text> </paragraph> 
<paragraph id="H0D93A34C2F0246BAA8BD6347CFF59400"><enum>(3)</enum><text>Each inpatient medical care facility of the uniformed services.</text></paragraph> 
<paragraph id="HB1315AA88C25468EAD2BED4720E79FA4"><enum>(4)</enum><text>In the case of a member on the temporary disability retired list under section 1202 or 1205 of this title who is being retired under another provision of this title or is being discharged, a location reasonably convenient to the member.</text></paragraph> <continuation-text continuation-text-level="subsection">Counselors for the provision of preseparation counseling and services may be made available on a appointment basis and need not be stationed at the facilities specified in paragraphs (1) through (4) permanently.</continuation-text></subsection> 
<subsection id="H9578993802B242C4AD7254D5F4C237F" indent="up1" display-inline="no-display-inline"><enum>(e)</enum><header>Consistency of materials</header><text display-inline="yes-display-inline">The Secretary concerned shall ensure that the scope and content of the materials presented as part of preseparation counseling and services at each location under this section are consistent with the scope and content of the materials presented as part of the preseparation counseling and services at the other locations under this section. </text></subsection> 
<subsection id="H375FC8910F964129AD33FFE03EBE38E" indent="up1"><enum>(f)</enum><header>Post-separation follow-up for reserve component members</header><text display-inline="yes-display-inline">The Secretary concerned shall ensure that follow-up counseling is provided for each member of a reserve component separated from active duty not later than 180 days after such separation.</text></subsection> 
<subsection id="HFAEEB37C6F3B4F33A1CD7CD7429574D8" indent="up1"><enum>(g)</enum><header>Updated content of materials and activities</header><text>The Secretary concerned shall, on a continuing basis, update the content of the materials used by the National Veterans Training Institute and other activities of the Secretary that provide direct training support to personnel who provide preseparation counseling and other services under this section.</text></subsection> 
<subsection id="HAE3F6280F95A42A7A54DD66BAA6DD67B"><enum>(h)</enum><header>National guard members on duty in State status</header> <text>Members of the National Guard being separated from duty to which ordered under <external-xref legal-doc="usc" parsable-cite="usc/32/502">section 502(f)</external-xref> of title 32 shall be provided preseparation counseling and services under this section to the same extent that members of a reserve component being discharged or released from active duty are provided preseparation counseling and services under this section.</text> </subsection> 
<subsection id="H71DCE9F0D954448CB83577335B66FD00"><enum>(i)</enum><header>Minimum required individualized services</header> 
<paragraph id="HEB7B66D4165143BF83AC9B9E1E53F900" display-inline="yes-display-inline"><enum>(1)</enum><text>In carrying out this section, the Secretary concerned ensure that at least eight hours of individualized transition services are provided, in addition to preseparation counseling and group workshops, for each member provided counseling and services under this section.</text></paragraph> 
<paragraph id="H7C61E04210224D55BE158F867BE060F8" indent="up1"><enum>(2)</enum><text>In order to ensure that the requirements of paragraph (1) are met, the Secretary concerned shall ensure, for each fiscal year, that there is allocated, from the appropriate operation and maintenance or military personnel accounts, such amounts as necessary to provide for the individualized transition services required under that paragraph for each member expected to receive such services during the fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HCAD42E8162D54DD8A300764F6E52E187"><enum>(b)</enum><header>Required participation for certain members</header><text>Subsection (c) of such section is amended to read as follows:</text>

<subsection id="HBFC8FAE7E5FF46CAA62CD9CB58962DF3"><enum>(c)</enum><header>Participation</header> 
<paragraph display-inline="yes-display-inline" id="H2F803FD7EBB74A239F18D75600B8ADA6"><enum>(1)</enum><text>Subject to paragraph (2), the Secretary of Defense and the Secretary of Homeland Security shall require participation by members of the armed forces eligible for assistance under the program carried out under this section.</text></paragraph> 
<paragraph indent="up1" id="HA245DB59D35F43CC95A647DE97E41366"><enum>(2)</enum><text>The Secretary of Defense and the Secretary of Homeland Security need not require, but shall encourage and otherwise promote, participation in the program by the following members described in paragraph (1):</text> 
<subparagraph id="H5A0954C78BFD4D7B9C098F1C1830E763"><enum>(A)</enum><text>A member who has previously participated in the program.</text></subparagraph> 
<subparagraph id="H9FF2774069514FC79147A848BD07F54"><enum>(B)</enum><text>A member who, upon discharge or release from active duty, is returning to—</text> 
<clause id="H5F9CCC1C940E4BF9974B41FEFE5298B5"><enum>(i)</enum><text>a position of employment; or</text></clause> 
<clause id="HB3780AC831A440AFAF52CB006CD16B14"><enum>(ii)</enum><text>pursuit of an academic degree or other educational or occupational training objective that the member was pursuing when called or ordered to such active duty.</text></clause></subparagraph></paragraph> 
<paragraph id="H088FD6F723934EE8BB962225A94E3EC8" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Members of the armed forces eligible for assistance under this section include members of the reserve components being separated from service on active duty for a period of more than 30 days and members of the National Guard being separated from full-time National Guard duty.</text></paragraph> 
<paragraph id="HC2D0D7BE15C44DEAB83E7D135B8C4E42" indent="up1"><enum>(4)</enum><text>The Secretary concerned shall ensure that commanders of members who are required to be provided assistance under this section authorize the members to be provided such assistance during duty time.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA6966118808A48468D1D633E935411E2"><enum>(c)</enum><header>Required updating of materials</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="HEC56598F2F90411088D333D4ABA3F8ED"><enum>(e)</enum><header>Updating of materials</header><text display-inline="yes-display-inline">The Secretary shall, on a continuing basis, update the content of the materials used by the National Veterans Training Institute of the Department of Labor and the Secretary’s other materials that provide direct training support to personnel who carry out the program established in this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
