<official-title>To amend the Agricultural Marketing Act of 1946 to establish a voluntary program for country of origin labeling of meat, and for other purposes.</official-title>

<section id="H041B37F7415345A6AB4F4C64C98CB3CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Meat Promotion Act of 2005</short-title></quote>.</text></section> 
<section id="H365D77EE5D1E4E24AE5B215EBDF7CB7D"><enum>2.</enum><header>Voluntary program for country of origin labeling for meat</header> 
<subsection id="H6D9E96D7E334488B85E9DE3049944D98"><enum>(a)</enum><header>Establishment</header><text>The Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subtitle id="H19C2EDE861E44920961DFAFF494542A2"><enum>E</enum><header>Country of origin labeling for meat</header> 
<section id="H9B8B9A16B5EC42F689B78BD22532B5B"><enum>291.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> 
<paragraph id="H1E52F621D5AC401696A107EFC52BEFB2"><enum>(1)</enum><header>Beef</header><text>The term <quote>beef</quote> means meat produced from cattle (including veal).</text></paragraph> 
<paragraph id="H95933CEB3D8A4B31B28DE07DBCD4001B"><enum>(2)</enum><header>Covered meat product</header><text>The term <quote>covered meat product</quote> means ground beef, ground pork, ground lamb, and fresh muscle cuts of beef, pork, and lamb.</text></paragraph> 
<paragraph id="HD15DE6AF72E24D70ADAB242EA8BAC9EB"><enum>(3)</enum><header>Lamb</header><text>The term <quote>lamb</quote> means meat produced from sheep.</text></paragraph> 
<paragraph id="H3A0799FCFD4F4F170045C7FBEA489E4B"><enum>(4)</enum><header>Pork</header><text>The term <quote>pork</quote> means meat produced from swine.</text></paragraph> 
<paragraph id="H4EAFC202204F4B6A9BC7005B26948416"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></section> 
<section id="H784A075E651F4074A3BEAD66A5B5B832"><enum>292.</enum><header>Voluntary program</header><text display-inline="no-display-inline">The Secretary of Agriculture shall establish a voluntary program of country of origin labeling for covered meat products.</text></section> 
<section id="HD720605BA3374EB592DBD7D25E4EE25"><enum>293.</enum><header>Label</header><text display-inline="no-display-inline">For purposes of the program established under section 292, the Secretary shall—</text> 
<paragraph id="H797712151B5D457A8EF9FA836897D019"><enum>(1)</enum><text>design a label to be used to designate the country of origin of covered meat products; and</text></paragraph> 
<paragraph id="HDCB941FD433E4B3F986615344CECF698"><enum>(2)</enum><text>require persons participating in the program to use the label designed under paragraph (1), or such other label as the Secretary determines appropriate, to designate the country of origin of covered meat products.</text></paragraph> </section> 
<section id="H41A9E1E1717A4623B019E660FF2C1600"><enum>294.</enum><header>Limitation on use of United States as country of origin</header><text display-inline="no-display-inline">A person participating in the program established under section 292 may not designate a covered meat product as having the United States as the country of origin unless the covered meat product is derived exclusively from—</text> 
<paragraph id="H9EA9BC0E810E49F7A39F5E492E3341F7"><enum>(1)</enum><text>an animal born, raised, and slaughtered in the United States; or</text></paragraph> 
<paragraph id="HFFAE1C9AA3F54FE3BEF589D730F01813"><enum>(2)</enum><text>an animal born and raised in Alaska or Hawaii, transported for a period not to exceed 60 days outside of those States, and slaughtered in the United States.</text></paragraph></section> 
<section id="HE68D9A6122974378BD15FA667D090970"><enum>295.</enum><header>Verification</header><text display-inline="no-display-inline">The Secretary may require participants in the program established under section 292 to maintain a recordkeeping audit trail that will permit the Secretary to verify compliance with the program.</text></section> 
<section id="H569F7458EA234739812F81CDC003EA92"><enum>296.</enum><header>Enforcement</header> 
<subsection id="H1FE471D1181C4E75ADB3A78693D9037"><enum>(a)</enum><header>Civil penalty</header> 
<paragraph id="HFBC37D5C85914F9B86009931E41969E3"><enum>(1)</enum><header>Assessment</header><text>The Secretary may assess a civil penalty against a participant in the program established under section 292 that purposely or knowingly violates the terms of the program.</text></paragraph> 
<paragraph id="HD90337E6681445ABBA39CE545F3D331B"><enum>(2)</enum><header>Amount of penalty</header><text>The amount of the civil penalty assessed under paragraph (1) may not exceed $10,000 for each violation.</text></paragraph> 
<paragraph id="HDE8AC3FA259F475BB00062CD13C053A2"><enum>(3)</enum><header>Continuing violation</header><text>Each day during which a violation of the program continues shall be considered to be a separate violation.</text></paragraph></subsection> 
<subsection id="H33622CF938F1436CBB2E3093ACEA8E00"><enum>(b)</enum><header>Notice and hearing</header><text display-inline="yes-display-inline">The Secretary shall not assess a civil penalty under this section against a person unless the person is given notice and opportunity for a hearing in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code, with respect to the violation for which the person is being assessed.</text></subsection></section> 
<section id="HB57BEAB6EB754D18B6F6EC29539B66B4"><enum>297.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of the Meat Promotion Act of 2005, the Secretary shall promulgate regulations to carry out the program established under section 292.</text></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H49CEF768D26E44578C6EA4930000B2C2"><enum>(b)</enum><header>Conforming amendments</header><text>Subtitle D of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638">7 U.S.C. 1638 et seq.</external-xref>) is amended—</text>

<subparagraph id="H462BF8EFACB1446C9B0128E56ECB34EE"><enum>(A)</enum><text>by striking paragraphs (1), (5), and (7);</text></subparagraph>
