<section id="HE28AE85305914BE386AF1374552B035B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>General Services Administration Modernization Act</short-title></quote>.</text></section> 
<section id="HF74CC1B059B046E595F358173500993E"><enum>2.</enum><header>Federal Acquisition Service</header> 
<subsection id="HEA0493CD706A402BB4E80701AC915FE4" display-inline="no-display-inline"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="HDC2AAF9EC65740379F3172F6C979B657"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/303">Section 303</external-xref> of title 40, United States Code, is amended to read as follows:</text>

<section id="HCF74635EAE8B47D5A82E5500137BB057"><enum>303.</enum><header>Federal Acquisition Service</header> 
<subsection id="HC5B9B0E797064AC589829640107B1841"><enum>(a)</enum><header>Establishment</header><text>There is established in the General Services Administration a Federal Acquisition Service. The Administrator of General Services shall appoint a non-career employee as Commissioner of the Federal Acquisition Service, who shall be the head of the Federal Acquisition Service.</text></subsection> 
<subsection id="H5A03536104574AE4AA56557581052DF5"><enum>(b)</enum><header>Functions</header><text>Subject to the direction and control of the Administrator of General Services, the Commissioner of the Federal Acquisition Service shall be responsible for administering the Acquisition Services Fund under <external-xref legal-doc="usc" parsable-cite="usc/40/321">section 321</external-xref> of this title and carrying out functions related to the uses for which such Fund is authorized under such section, including any functions that were carried out by the entities known as the Federal Supply Service and the Federal Technology Service and such other related functions as the Administrator considers appropriate. </text> </subsection> 
<subsection id="H6965814305A747C19F4E94D400A1F91D"><enum>(c)</enum><header>Regional Executives</header><text display-inline="yes-display-inline">The Administrator may appoint up to five Regional Executives in the Federal Acquisition Service, to carry out such functions within the Federal Acquisition Service as the Administrator considers appropriate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H7D3921FB43B7474E843F427EA907D978"><enum>(2)</enum><header>Clerical amendment</header><text>The item relating to section 303 at the beginning of chapter 3 of such title is amended to read as follows:</text>

<paragraph id="H6688C3F266A2442B8800D227D38BA392"><enum>(1)</enum><text>to the Federal Supply Service is deemed to refer to the Federal Acquisition Service;</text></paragraph> 
<paragraph id="H69768635A6C04D9A9E25611979F6FAFF"><enum>(2)</enum><text>to the GSA Federal Technology Service is deemed to refer to the Federal Acquisition Service;</text></paragraph> 
<paragraph id="HA861A9E513B74D9B98404E50635C7961"><enum>(3)</enum><text>to the Commissioner of the Federal Supply Service is deemed to refer to the Commissioner of the Federal Acquisition Service; and</text></paragraph>

<section id="H7D99BF8F2EA744AF83A8D497135D4731" section-type="subsequent-section"><enum>3.</enum><header>Acquisition Services Fund</header> 
<subsection id="H01E6BF65153649BC8C285F8600E8CEF4"><enum>(a)</enum><header>Abolishment of General Supply Fund and Information Technology Fund</header><text>The General Supply Fund and the Information Technology Fund in the Treasury are hereby abolished.</text></subsection> 
<subsection id="H870450EBDC8A42A9B72B8C57FF01019D"><enum>(b)</enum><header>Transfers</header><text>Capital assets and balances remaining in the General Supply Fund and the Information Technology Fund as in existence immediately before this section takes effect shall be transferred to the Acquisition Services Fund and shall be merged with and be available for the purposes of the Acquisition Services Fund under <external-xref legal-doc="usc" parsable-cite="usc/40/321">section 321</external-xref> of title 40, United States Code (as amended by this Act).</text></subsection> 
<subsection id="H69A80933DF514CC1916FCB64430485AB"><enum>(c)</enum><header>Assumption of obligations</header><text>Any liabilities, commitments, and obligations of the General Supply Fund and the Information Technology Fund as in existence immediately before this section takes effect shall be assumed by the Acquisition Services Fund. </text></subsection> 
<subsection id="HCBBD84CDA39A45A9B6812B86715786D"><enum>(d)</enum><header>Existence and composition of Acquisition Services Fund</header><text>Subsections (a) and (b) of <external-xref legal-doc="usc" parsable-cite="usc/40/321">section 321</external-xref> of title 40, United States Code, are amended to read as follows:</text>

<subsection id="HAFD4C31B852E47D9B71F177F001D7B30"><enum>(a)</enum><header>Existence</header><text>The Acquisition Services Fund is a special fund in the Treasury.</text></subsection> 
<subsection id="H9207EC47552A43CB9CA644F450C8B455"><enum>(b)</enum><header>Composition</header> 
<paragraph id="HB9D12EB745C84C4594F139F79422D300"><enum>(1)</enum><header>In general</header><text>The Fund is composed of amounts authorized to be transferred to the Fund or otherwise made available to the Fund.</text></paragraph> 
<paragraph id="H5DE977FC5FCB431BA8FD61A44FD64C32"><enum>(2)</enum><header>Other credits</header><text>The Fund shall be credited with all reimbursements, advances, and refunds or recoveries relating to personal property or services procured through the Fund, including—</text> 
<subparagraph id="HA42A776AA0C6465EA19593F0EF00828C"><enum>(A)</enum><text>the net proceeds of disposal of surplus personal property; </text></subparagraph> 
<subparagraph id="H528849F6C3E64203BA14092755CD9564"><enum>(B)</enum><text>receipts from carriers and others for loss of, or damage to, personal property; and</text></subparagraph> 
<subparagraph id="H7DD8C8D440BC4E97A3FF6333CB83D53F" commented="no"><enum>(C)</enum><text>receipts from agencies charged fees pursuant to rates established by the Administrator.<italic></italic></text></subparagraph></paragraph> 
<paragraph id="HCC8BDD2646C74E9FB534E375854D30D0"><enum>(3)</enum><header>Cost and capital requirements</header><text>The Administrator shall determine the cost and capital requirements of the Fund for each fiscal year and shall develop a plan concerning such requirements in consultation with the Chief Financial Officer of the General Services Administration. Any change to the cost and capital requirements of the Fund for a fiscal year shall be approved by the Administrator. The Administrator shall establish rates to be charged agencies provided, or to be provided, supply of personal property and non-personal services through the Fund, in accordance with the plan. </text> </paragraph> 
<paragraph id="H2579CB7978F14A4D005EB8DD2B26EE83"><enum>(4)</enum><header>Deposit of fees</header><text>Fees collected by the Administrator under <external-xref legal-doc="usc" parsable-cite="usc/40/313">section 313</external-xref> of this title may be deposited in the Fund to be used for the purposes of the Fund.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF64AC168BBAB4D1480D3B677BDC5F320"><enum>(e)</enum><header>Uses of Fund</header><text>Section 321(c) of such title is amended in paragraph (1)(A)—</text> 
<paragraph id="H8A839216DE0240C085AE6F8E9C58BF91"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></paragraph> 
<paragraph id="H1A349B6FA95D45B3B5FB8F006230A8F3"><enum>(2)</enum><text>by inserting <quote>and</quote> after the semicolon at the end of clause (ii); and</text></paragraph> 
<paragraph id="H3E71559A43EE4C7BBAAA25102D9DF69D"><enum>(3)</enum><text>by inserting after clause (ii) the following new clause :</text>

<clause id="H4C45064CD8314547939CD7C79189941E"><enum>(iii)</enum><text>personal services related to the provision of information technology (as defined in section 11101(6) of this title);</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEE46F0364A0444669B006DBED349B1CB"><enum>(f)</enum><header>Payment for property and services</header><text>Section 321(d)(2)(A) of such title is amended—</text> 
<paragraph id="HDB44342302AB45BA9EB4E64229CF81C6"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (iv); </text></paragraph> 
<paragraph id="H13B46EC0D30F4F0D9FD11C176B1FF925"><enum>(2)</enum><text>by redesignating clause (v) as clause (vi); and</text></paragraph> 
<paragraph id="H64C841B6C50D4E3A954F97908BD3CB1F"><enum>(3)</enum><text>by inserting after clause (iv) the following new clause:</text>

<clause id="HB51A6853B0D742C8AFE18B899742035B"><enum>(v) </enum><text>the cost of personal services employed directly in providing information technology (as defined in section 11101(6) of this title); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H92C51BB704794D0E806438BD00BFAFA5"><enum>(g)</enum><header>Transfer of uncommitted balances</header><text>Subsection (f) of section 321 of such title is amended to read as follows:</text>

<subsection id="HE5069D8A2B7C473AA5DA86DD2FCE07BC"><enum>(f)</enum><header>Transfer of uncommitted balances</header><text>Following the close of each fiscal year, after making provision for a sufficient level of inventory of personal property to meet the needs of Federal agencies, the replacement cost of motor vehicles, and other anticipated operating needs reflected in the cost and capital plan developed under subsection (b), the uncommitted balance of any funds remaining in the Fund shall be transferred to the general fund of the Treasury as miscellaneous receipts.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4DA3908796CC43EA9FA1001D00EF6425"><enum>(h)</enum><header>Conforming and Clerical amendments</header> 
<paragraph id="H9A5A5EA988F44237AE710575D3009DEF"><enum>(1)</enum><text>Section 322 of such title is repealed.</text> </paragraph> 
<paragraph id="HA9261DF5076246D5A8120200AE55D365"><enum>(2)</enum><text>The heading for section 321 of such title is amended to read as follows: </text>

<section id="HD7357AAA56604590AC5580D700E00EF" section-type="subsequent-section" display-inline="no-display-inline"><enum>4.</enum><header>Provisions relating to acquisition personnel</header><text display-inline="no-display-inline">Section 37 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/433">41 U.S.C. 433</external-xref>) is amended by adding at the end the following new subsections:</text> 
<quoted-block id="HAA2647C7128947598F3719DAC8295800"> 
<subsection id="H1AEB318D79CF46FF9968C9579B37F59E"><enum>(i)</enum><header>Provisions relating to reemployment</header><text>If an individual receiving an annuity from the Civil Service Retirement and Disability Fund on the basis of such individual’s service becomes reemployed in an acquisition-related position (as described in subsection (g)(1)(A)), such annuity shall not be discontinued thereby. An individual so reemployed shall not be considered an employee for the purposes of chapter 83 or 84 of title 5, United States Code.</text></subsection> 
<subsection id="H19E1A89E7A9D44CCAC648679F7162FA5"><enum>(j)</enum><header>Retention bonuses</header> 
<paragraph id="H92D1B753C1FE41ECAE70364CF3576D65"><enum>(1)</enum><text>The head of each executive agency, after consultation with the Administrator, shall establish policies and procedures under which the agency head may pay retention bonuses to employees holding acquisition-related positions (as described in subsection (g)(1)(A)) within such agency, except that the authority to pay a bonus under this subsection shall be available only if—</text> 
<subparagraph id="H09F50574A6AD4CB98863B2097DAA222B"><enum>(A)</enum><text>the unusually high or unique qualifications of an employee or a special need of the agency for the services of an employee makes the retention of such employee essential; and</text></subparagraph> 
<subparagraph id="H61C4C5C5770B46858EB5C767BA95ECBB"><enum>(B)</enum><text>the agency determines that, in the absence of such a bonus, it is likely that the employee would leave—</text> 
<clause id="HA98562FC91AC427FB2AF14C4324FF8F8"><enum>(i)</enum><text>the Federal service; or</text></clause> 
<clause id="HC09024EE3E22427BA5B2189355B4E240"><enum>(ii)</enum><text>for a different position in the Federal service under conditions described in regulations of the Office.</text></clause></subparagraph></paragraph> 
<paragraph id="H5046ACEA104F4D88A493151712C3FD4C"><enum>(2)</enum> 
<subparagraph id="HFDF3A3C423EF4A05004CCF9FFC9CFA6C" display-inline="yes-display-inline"><enum>(A)</enum><text>Payment of a bonus under this subsection shall be contingent upon the employee entering into a written agreement with the agency to complete a period of service with the agency in return for the bonus.</text></subparagraph> 
<subparagraph id="HA089176F3A574792A9A6D15B90280047" indent="up1"><enum>(B)</enum> 
<clause id="H2880230BB8F74B36B08C5BFEB73C62A6" display-inline="yes-display-inline"><enum>(i)</enum><text>The agreement shall include—</text> 
<subclause id="H5A1CBA85F929404D83A7D182731CAE38" indent="up1"><enum>(I)</enum><text>the length of the period of service required;</text></subclause> 
<subclause id="H84B0F4DB31824C46AE6613CA10ACE53F" indent="up1"><enum>(II)</enum><text>the bonus amount;</text></subclause> 
<subclause id="H8B7A9C7D0EA44995915C5824A10014D1" indent="up1"><enum>(III)</enum><text>the manner in which the bonus will be paid (as described in paragraph (3)(B)); and</text></subclause> 
<subclause id="H7D98B35385C442ACB2CFE4FC7801FF6D" indent="up1"><enum>(IV)</enum><text>any other terms and conditions of the bonus, including the terms and conditions governing the termination of an agreement.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HED099BD7FA61444E8531CBE97D634CF8"><enum>(3)</enum><text>A bonus under this subsection—</text> 
<subparagraph id="HFACF560A898F425FBFFF281C5C727C3E"><enum>(A)</enum><text>may not exceed 50 percent of the basic pay of the employee;</text></subparagraph> 
<subparagraph id="H039BADE1B2C54394820320FE150000AB"><enum>(B)</enum><text display-inline="yes-display-inline">may be paid to an employee—</text> 
<clause id="H4E1447E9811E4E5087DDEFD618A4DD63"><enum>(i)</enum><text>in installments after completion of specified periods of service;</text></clause> 
<clause id="H3B3976EBF7784768B6038B29D48884D6"><enum>(ii)</enum><text>in a single lump sum at the end of the period of service required by the agreement; or</text></clause> 
<clause id="H932AACB4BF0E4A9782AF52F519A2FE49" commented="no"><enum>(iii)</enum><text>in any other manner mutually agreed to by the agency and the employee;</text></clause></subparagraph> 
<subparagraph id="HE90A54C2795C4E248E678614A8979157"><enum>(C)</enum><text>is not part of the basic pay of the employee; and</text></subparagraph> 
<subparagraph id="H8EE9F4FB80FC4BCCB6077C2C00BFADC4"><enum>(D)</enum><text>may not be paid to an employee who holds a position—</text> 
<clause id="H0BEA398FC60D445583FE92C95B1FA885"><enum>(i)</enum><text>appointment to which is by the President, by and with the advice and consent of the Senate;</text></clause> 
<clause id="H4D3640DD7D5947419782DDF01D825EFE"><enum>(ii)</enum><text>in the Senior Executive Service as a noncareer appointee (as such term is defined under <external-xref legal-doc="usc" parsable-cite="usc/5/3132">section 3132(a)</external-xref> of title 5, United States Code); or</text></clause> 
<clause id="HA48979B253C040E6BD15D191BDE6FA2C"><enum>(iii)</enum><text>which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H343DA83412284B2CA01710B1EA006800"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect 60 days after the date of the enactment of this Act.</text></section>
