<official-title>To amend title 10, United States Code, to provide that consensual sexual activity between adults shall not be a violation of the Uniform Code of Military Justice.</official-title>

<section section-type="section-one" id="H73CA8DC886464318BA59A8AEA556BCB" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Hypocrisy Act of 2005</short-title></quote>.</text></section>
<section id="H7FF12B8D1B2F4611905612EBA5EB58FD"><enum>2.</enum><header>Removal of consensual sexual activity between adults as basis for prosecution under the Uniform Code of Military Justice</header>
<subsection id="H24EB42CF2FED4C6291CA49C9E7DCE01"><enum>(a)</enum><header>Sodomy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/925">Section 925</external-xref> of title 10, United States Code (article 125 of the Uniform Code of Military Justice), is amended—</text>
<paragraph id="HE965E4210BC148C2B529769260928BF5"><enum>(1)</enum><text>by inserting <quote>nonconsensual</quote> after <quote>engages in</quote>; and</text></paragraph>
<paragraph id="H04E295A360A04131B73FAD561103AB31"><enum>(2)</enum><text>by inserting <quote>carnal copulation</quote> before <quote>with an</quote>.</text></paragraph></subsection>
<subsection id="HAD80C519F37D43EF8FC9002825703D00"><enum>(b)</enum><header>Conduct unbecoming an officer and a gentleman</header><text>Section 933 of such title (article 133 of such Code) is amended—</text>
<paragraph id="H8CE33C9B7A944562B96B2FBF9B74D67D"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Any commissioned</quote>; and</text></paragraph>
<paragraph id="HD663575CB4E9456D002717C98086A49"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H61E34DE9D6714322A619C0AD25D525D"><enum>(b)</enum><text>Neither of the following shall be the basis for a prosecution under this section:</text>
<paragraph id="H45F28CB66DE44F50AA74D76E6741B200"><enum>(1)</enum><text>A consensual act of a sexual nature that is between adults and that does not involve compensation.</text></paragraph>
<paragraph id="HB28CC688B0BA42D8949467594D14758B"><enum>(2)</enum><text>Cohabitation by adults.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H7A951B40365E4220B9E33C789E4970EA"><enum>(c)</enum><header>General article</header><text>Section 934 of such title (article 134 of such Code) is amended—</text>
<paragraph id="H574E802A8AB54AABB8F7085995FBD9A1"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Though not</quote>; and</text></paragraph>
<paragraph id="H079188B121ED4163B4CCB5B61FBEE77E"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H287C76DFA7BE4C4CA59CAB69D08100D8"><enum>(b)</enum><text>Neither of the following shall be the basis for a prosecution under this section:</text>
<paragraph id="H89E1B2AE6CA749A0AC74857052E2A593"><enum>(1)</enum><text>A consensual act of a sexual nature that is between adults and that does not involve compensation.</text></paragraph>
<paragraph id="HDA9E84F25576469BA31E95CF85939B3F"><enum>(2)</enum><text>Cohabitation by adults.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HF68BBA8AF5734368B9E2061DEB3B00BA"><enum>(d)</enum><header>Construction of amendments</header><text>Nothing in the amendments made by this section shall be—</text>
<paragraph id="HA0C6AD990EBF4D5BBFE0868E3291710"><enum>(1)</enum><text>construed to prevent prosecution under the Uniform Code of Military Justice for acts of fraternization; or</text></paragraph>
<paragraph id="H5F9BA5D9874342699B004EADA63D66CB"><enum>(2)</enum><text>considered to prevent noncriminal disciplinary action or administrative proceedings against a person subject to the Uniform Code of Military Justice for misconduct (sexual or otherwise) that—</text>
<subparagraph id="H80268F2E60104C68A71C28E302F7E794"><enum>(A)</enum><text>constitutes a disorder and neglect to the prejudice of good order and discipline in the Armed Forces;</text></subparagraph>
<subparagraph id="H6456E38CA7314F989698B4D41A74633"><enum>(B)</enum><text>is of a nature to bring discredit upon the Armed Forces; or</text></subparagraph>
<subparagraph id="HC5F24D7CE5144D7B8EE218F07CC5778"><enum>(C)</enum><text>in the case of a commissioned officer, cadet, or midshipman, constitutes conduct unbecoming an officer and a gentleman.</text></subparagraph></paragraph></subsection></section>
