<official-title>To establish the District of Columbia as a Congressional district for purposes of representation in the House of Representatives, and for other purposes.</official-title> 
</form>

<section section-type="section-one" id="HF08DD572CE94432F80351EE77248D84F" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia Fairness in Representation Act</short-title></quote>.</text></section> 
<section id="HC53517F40A2443F7AEE6151DE2981BCE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> 
<paragraph id="H2AEDDE4BD41F4988009F1E0668AC39C7"><enum>(1)</enum><text>Over half a million people living in the District of Columbia, the capital of our democratic Nation, lack direct voting representation in the United States Senate and House of Representatives.</text></paragraph> 
<paragraph id="H30D641BF2E5243ADBF11CF53ED007371"><enum>(2)</enum><text>District of Columbia residents have fought and died to defend our democracy in every war since the War of Independence.</text></paragraph> 
<paragraph id="H120026BA199A476100C0BC4C4543EBDE"><enum>(3)</enum><text>District of Columbia residents pay billions of dollars in Federal taxes each year.</text></paragraph> 
<paragraph id="H6B3228DB534141DB929859C56C42E129"><enum>(4)</enum><text>Our Nation is founded on the principles of <quote>one person, one vote</quote> and <quote>government by the consent of the governed</quote>.</text></paragraph></section> 
<section id="H6DEE01B13D4A42CF83A93828501F71D"><enum>3.</enum><header>Treatment of District of Columbia as Congressional district</header> 
<subsection id="H180581348F8C49D09C47274D7C3907B3"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the District of Columbia shall be considered a Congressional district for purposes of representation in the House of Representatives.</text></subsection> 
<subsection id="HC88DD34C92A948F6AE71536C7EA5F5C6"><enum>(b)</enum><header>Conforming amendment regarding application of method of equal proportions in apportionment of House of Representatives</header><text>Section 2(a) of the Act entitled <quote>An Act to provide for apportioning Representatives in Congress among the several States by the equal proportion method</quote>, approved November 15, 1941 (<external-xref legal-doc="usc" parsable-cite="usc/2/2b">2 U.S.C. 2b</external-xref>), is amended by inserting <quote>or the District of Columbia</quote> after <quote>no State</quote>.</text></subsection> 
<subsection id="H698CCB93178345BDBFDF082984313D89"><enum>(c)</enum><header>Conforming amendments regarding appointments to service academies</header> 
<paragraph id="H9CA380D0EF6E42F1A3604DE0B02B8B95"><enum>(1)</enum><header>United States military academy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/4342">Section 4342</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="H2C6EF6E57F7D4A6DBC9FA7C825172F3C"><enum>(A)</enum><text>in subsection (a), by striking paragraph (5); and</text></subparagraph> 
<subparagraph id="H0569A56A815E40678E3D672EE4E650DD"><enum>(B)</enum><text>in subsection (f), by striking <quote>the District of Columbia,</quote>.</text></subparagraph></paragraph> 
<paragraph id="H0C2F6BF524C8491BA49DAAF3C223100"><enum>(2)</enum><header>United States naval academy</header><text>Such title is amended—</text> 
<subparagraph id="H29FE8F9D257F4DCAB361214710B6608D"><enum>(A)</enum><text>in section 6954(a), by striking paragraph (5); and</text></subparagraph> 
<subparagraph id="H363BDA93C9DD4EBD8BA3044E004DAF46"><enum>(B)</enum><text>in section 6958(b), by striking <quote>the District of Columbia,</quote>.</text></subparagraph></paragraph> 
<paragraph id="HB5F4384B405544B2B1FF4F5E0620AE8C"><enum>(3)</enum><header>United States air force academy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/9342">Section 9342</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="H493ACEC612384F8C80003295B93E5B82"><enum>(A)</enum><text>in subsection (a), by striking paragraph (5); and</text></subparagraph> 
<subparagraph id="H5C9FF4045247460284FC78CCBCC5C05"><enum>(B)</enum><text>in subsection (f), by striking <quote>the District of Columbia,</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H051F846B18AD4CE18BD0676F656375FD"><enum>(d)</enum><header>Effective date</header><text>This section and the amendments made by this section shall apply with respect to the One Hundred Tenth Congress and each succeeding Congress.</text></subsection></section> 
<section id="H7E244D8B7E7448838C773211AD521CE"><enum>4.</enum><header>Temporary increase in apportionment of House of Representatives</header> 
<subsection id="H9B4A384E28BA425F99E837B054C0A1C"><enum>(a)</enum><header>In general</header><text>Effective January 3, 2007, and until the taking effect of the first reapportionment occurring after the regular decennial census conducted for 2010—</text> 
<paragraph id="H6BC0B1DD03E642AF8FB7D2FB918FAD83"><enum>(1)</enum><text>the membership of the House of Representatives shall be increased by 2 members;</text></paragraph> 
<paragraph id="HBFDCA66CCADD4819A3C62900563DCFBC"><enum>(2)</enum><text>each such Representative shall be in addition to the membership of the House of Representatives as now prescribed by law; and</text></paragraph> 
<paragraph id="HD913BA00617248C5892C21585047217B"><enum>(3)</enum><text>the State identified by the Clerk of the House of Representatives in the report submitted under subsection (b) shall be entitled to one additional Representative.</text></paragraph></subsection> 
<subsection id="H045ACA75117748339776E3876476577B"><enum>(b)</enum><header>Transmittal of revised apportionment information by President and clerk</header> 
<paragraph id="HBDB570E4223F4172BEF9BE21976382BC"><enum>(1)</enum><header>Statement of apportionment by President</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall transmit to Congress a revised version of the most recent statement of apportionment submitted under section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), to take into account the provisions of this Act.</text></paragraph> 
<paragraph id="HD61A02EEAA9E4D88B2564B1E4650D560"><enum>(2)</enum><header>Report by clerk</header><text>Not later than 15 calendar days after receiving the revised version of the statement of apportionment under paragraph (1), the Clerk of the House of Representatives, in accordance with section 22(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(b)</external-xref>), shall send to the executive of each State a certificate of the number of Representatives to which such State is entitled under section 22 of such Act, and shall submit a report to the Speaker of the House of Representatives identifying the State entitled to one additional Representative pursuant to this section.</text></paragraph></subsection> 
<subsection id="HCA297CF86E464CF0AF8779039D794651"><enum>(c)</enum><header>Increase Not counted against total number of members</header><text>The temporary increase in the membership of the House of Representatives provided under subsection (a) shall not—</text> 
<paragraph id="HB3EA00A6F05D41B184C9DD8395B5EC21"><enum>(1)</enum><text>operate to either increase or decrease the permanent membership of the House of Representatives as prescribed in the Act of August 8, 1911 (<external-xref legal-doc="usc" parsable-cite="usc/2/2">2 U.S.C. 2</external-xref>);</text></paragraph> 
<paragraph id="H495D2F5F3B434C29B2A7BB7E36D37D6"><enum>(2)</enum><text>affect the basis of reapportionment established by the Act of June 28, 1929, as amended (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>), for the Eighty Second Congress and each Congress thereafter; or</text></paragraph> 
<paragraph id="H6E5BA27DBE594471B148A93C951387C9"><enum>(3)</enum><text>be taken into account in determining the number of electors under <external-xref legal-doc="usc" parsable-cite="usc/3/3">section 3</external-xref> of title 3, United States Code, with respect to the 2008 Presidential election.</text></paragraph></subsection></section> 
<section id="H0F3DC503315E450C00548800F0EBD04"><enum>5.</enum><header>Repeal of office of District of Columbia delegate</header> 
<subsection id="HE7F69940DA3A4037958C01F38C5F0710"><enum>(a)</enum><header>In general</header><text>Sections 202 and 204 of the District of Columbia Delegate Act (<external-xref legal-doc="public-law" parsable-cite="pl/91/405">Public Law 91–405</external-xref>; sections 1–401 and 1–402, D.C. Official Code) are repealed, and the provisions of law amended or repealed by such sections are restored or revived as if such sections had not been enacted.</text></subsection> 
<subsection id="H80C63F02E1D54E0F9E7820265BDEBC95"><enum>(b)</enum><header>Conforming amendments to District of Columbia Elections Code of 1955</header><text>The District of Columbia Elections Code of 1955 is amended—</text> 
<paragraph id="H9B1B8A24EB3A473E87D4979564993F00"><enum>(1)</enum><text>in section 1 (sec. 1–1001.01, D.C. Official Code), by striking <quote>the Delegate to the House of Representatives</quote>;</text></paragraph> 
<paragraph id="HA843EE8F4DEE4385B9FF01006EB751D8"><enum>(2)</enum><text>in section 2 (sec. 1–1001.02, D.C. Official Code)—</text> 
<subparagraph id="HFD65F0811C8C4B31B4A21433A2E73DA2"><enum>(A)</enum><text>by striking paragraph (6), and</text></subparagraph> 
<subparagraph id="HD569F4B9D8834DE196DF8C59C294EE7C"><enum>(B)</enum><text>in paragraph (13), by striking <quote>the Delegate to Congress for the District of Columbia</quote>;</text></subparagraph></paragraph> 
<paragraph id="HA13CC798700E45C58840637E1D892E11"><enum>(3)</enum><text>in section 8 (sec. 1–1001.08, D.C. Official Code)—</text> 
<subparagraph id="H061DFAEDE0484050BAEB80475E838B0"><enum>(A)</enum><text>by striking <quote>Delegate</quote> in the heading, and</text></subparagraph> 
<subparagraph id="H2B99403DA90242B093B01E0014D089E6"><enum>(B)</enum><text>by striking <quote>Delegate,</quote> each place it appears in subsections (h)(1)(A), (i)(1), and (j)(1);</text></subparagraph></paragraph> 
<paragraph id="H84A08AF2E00E45EDA562868457A1CFC"><enum>(4)</enum><text>in section 10 (sec. 1–1001.10, D.C. Official Code)—</text> 
<subparagraph id="HF866F5DE78014179AEF71F5FD7E02078"><enum>(A)</enum><text>by striking subparagraph (A) of subsection (a)(3), and</text></subparagraph> 
<subparagraph id="H27FC19A25E49446DBD335082B343333B"><enum>(B)</enum><text>in subsection (d)—</text> 
<clause id="H1E533F6F9E8945B0A25F106F068DAC05"><enum>(i)</enum><text>by striking <quote>Delegate,</quote> each place it appears in paragraph (1), and</text></clause> 
<clause id="H0F95678B5DAD4696BD1B651658262E00"><enum>(ii)</enum><text>by striking paragraph (2) and redesignating paragraph (3) as paragraph (2);</text></clause></subparagraph></paragraph> 
<paragraph id="HAF3ED7CA9B16423BA06700E0D8823DAE"><enum>(5)</enum><text>in section 15(b) (sec. 1–1001.15(b), D.C. Official Code), by striking <quote>Delegate,</quote>; and</text></paragraph> 
<paragraph id="H95E7E1920E5A4E378DAC7D7E9EEFFEA"><enum>(6)</enum><text>in section 17(a) (sec. 1–1001.17(a), D.C. Official Code), by striking <quote>except the Delegate to the Congress from the District of Columbia</quote>.</text></paragraph></subsection> 
<subsection id="H09A0D1C4A2E74DE89C0000467078602C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to elections occurring during 2006 and any succeeding year.</text></subsection></section> 
<section id="H06309AE134D4488AB6309BF0D629BBA4"><enum>6.</enum><header>Repeal of office of statehood Representative</header> 
<subsection id="HCF17EFA31EDD47DBBA8262F2A59CE070"><enum>(a)</enum><header>In general</header><text>Section 4 of the District of Columbia Statehood Constitutional Convention Initiative of 1979 (sec. 1–123, D.C. Official Code) is amended as follows:</text> 
<paragraph id="H7A2347EB96EE47C38DEBE1434FA38E84"><enum>(1)</enum><text>By striking <quote>offices of Senator and Representative</quote> each place it appears in subsection (d) and inserting <quote>office of Senator</quote>.</text></paragraph> 
<paragraph id="HDF847118D015408982E8CBE6926379C0"><enum>(2)</enum><text>In subsection (d)(2)—</text> 
<subparagraph id="HE1B8F0C8D2D24772A0252B015CFA575C"><enum>(A)</enum><text>by striking <quote>a Representative or</quote>;</text></subparagraph> 
<subparagraph id="H97312DE35A76449C953CD10032FDED0"><enum>(B)</enum><text>by striking <quote>the Representative or</quote>; and</text></subparagraph> 
<subparagraph id="HACB559743CC847E28F661EC5D0F3FF9E"><enum>(C)</enum><text>by striking <quote>Representative shall be elected for a 2-year term and each</quote>.</text></subparagraph></paragraph> 
<paragraph id="H1E3CDEA2F07D44918185DCFC8CA7E1C"><enum>(3)</enum><text>In subsection (d)(3)(A), by striking <quote>and 1 United States Representative</quote>.</text></paragraph>

<paragraph id="HAFBCE38C25BA44D69EEFA07B3F03EFAE"><enum>(4)</enum><header>Application of campaign finance laws</header><text>Section 3 of the Statehood Convention Procedural Amendments Act of 1982 (sec. 1–135, D.C. Official Code) is amended by striking <quote>and United States Representative</quote>.</text></paragraph></subsection> 
<subsection id="HEF8D1A9425B54A3A9CF1AFDFEB613621"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to elections occurring during 2006 and any succeeding year.</text></subsection></section> 
<section id="HF7DD4A8B4D2A491495F1961B524F07D7"><enum>7.</enum><header>Nonseverability of provisions</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act is held invalid, the remaining provisions of this Act or any amendment made by this Act shall be treated as invalid.</text></section>
