<section id="H30A68E128E364551BB6C4526EF647F4B" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeland Security Grant Enhancement Act of 2005</short-title></quote>.</text></section> 
<section id="H440D1E4736F54FA292AEFCF7D71C6C68"><enum>2.</enum><header>Interagency Committee to Coordinate and Streamline Homeland Security Grant Programs</header> 
<subsection id="H766809CBEC4C4D13906216DBF6BBB57"><enum>(a)</enum><header>In general</header><text>Title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/361">6 U.S.C. 361 et seq.</external-xref>) is amended by inserting after section 801 the following:</text>

<section id="HE057256CE0C942998260C767E52A215"><enum>802.</enum><header>Interagency committee to coordinate and streamline homeland security grant programs</header> 
<subsection id="HE667DC579CF640AC8273DC3515854195"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H4B4063193DA848C89905E4E1D9FCB5F"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the Attorney General, the Secretary of Health and Human Services, the Secretary of Transportation, the Administrator of the Environmental Protection Agency, and other agencies providing assistance for emergency response provider preparedness, as identified by the President, shall establish the Interagency Committee to Coordinate and Streamline Homeland Security Grant Programs (referred to in this subtitle as the <quote>Interagency Committee</quote>).</text></paragraph> 
<paragraph id="HD103C379BE7C4ED58C7F1EAA11D3BF7D"><enum>(2)</enum><header>Composition</header><text>The Interagency Committee shall be composed of—</text> 
<subparagraph id="HA140FF6788CC488085D839E03993DF86"><enum>(A)</enum><text>at least 2 representatives of the Department, including a representative of the United States Fire Administration;</text></subparagraph> 
<subparagraph id="HEFADB86483614B3C96CD734BF1F0077"><enum>(B)</enum><text>a representative of the Department of Health and Human Services;</text></subparagraph> 
<subparagraph id="H8C21E25AA4014778005F1EDF76998EC"><enum>(C)</enum><text>a representative of the Department of Transportation;</text></subparagraph> 
<subparagraph id="HFEA87363C02247DF8C10FD0275B1D280"><enum>(D)</enum><text>a representative of the Department of Justice;</text></subparagraph> 
<subparagraph id="H5AF729991EEA4F0BB0C6F275B24DCEEE"><enum>(E)</enum><text>a representative of the Environmental Protection Agency; and</text></subparagraph> 
<subparagraph id="H0979871BCA40461E9593F8824F807C49"><enum>(F)</enum><text>a representative of any other department or agency determined to be necessary by the President.</text></subparagraph></paragraph> 
<paragraph id="H4C1224C848B645FAA08818AEBEB6EFD5"><enum>(3)</enum><header>Responsibilities</header><text>The Interagency Committee shall—</text> 
<subparagraph id="HA6F7A020FC4F4FA49E5852689D859F68"><enum>(A)</enum><text>provide any findings to the Information Clearinghouse established under section 801(c);</text></subparagraph> 
<subparagraph id="H4661AA37413143ADB923C27BA9350057"><enum>(B)</enum><text>consult with State and local governments and emergency response providers regarding their homeland security needs and capabilities;</text></subparagraph> 
<subparagraph id="HBE0191660EC64AAAAA1F94E2BC162CB6"><enum>(C)</enum><text>advise the Secretary on the development of performance measures for homeland security and other first responder assistance programs;</text></subparagraph> 
<subparagraph id="H46D8CD0624CA427093AB51C567521CF6"><enum>(D)</enum><text>compile a list of homeland security and other first responder assistance programs;</text></subparagraph> 
<subparagraph id="H30D556317B8C479DA3006D2B5CDC3EAD"><enum>(E)</enum><text>not later than 1 year after the date of enactment of the <short-title>Homeland Security Grant Enhancement Act of 2005</short-title>—</text> 
<clause id="HD5E92526DC804E3C8513ACAD4D876B8B"><enum>(i)</enum><text>develop a proposal to coordinate, to the maximum extent practicable, the planning, reporting, application, and other guidance documents contained in homeland security assistance programs to—</text> 
<subclause id="H620365567BF743519FAEBF7D3FF81358"><enum>(I)</enum><text>eliminate all redundant and duplicative requirements;</text></subclause> 
<subclause id="H29B9044593C648608500675E48C11FBD"><enum>(II)</enum><text>ensure accountability of the programs to the intended purposes of such programs; and</text></subclause> 
<subclause id="H645A1A0A85274D0C8DE5547400DFB232"><enum>(III)</enum><text>coordinate expenditures of grant funds to avoid duplicative or inconsistent purchases; and</text></subclause></clause> 
<clause id="HC6475B8EB9374905B199CC4D2027E7A7"><enum>(ii)</enum><text>submit the proposal developed under clause (i) to—</text> 
<subclause id="H530A2690990D4508AF004440A7C31F09"><enum>(I)</enum><text>the President;</text></subclause> 
<subclause id="HDB79BD2E98D64A17895EE896D6B8007E"><enum>(II)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subclause> 
<subclause id="H0A2934BF3317418AABDB4CFB70159BEE"><enum>(III)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></subclause></clause></subparagraph> 
<subparagraph id="HFD3D6BBFDCC74BC3A6826110AFD82D27"><enum>(F)</enum><text>otherwise promote the coordination of homeland security grant programs throughout the Federal government.</text></subparagraph></paragraph></subsection> 
<subsection id="H78EAD8570BA34087A9D4F910D4CC7CC"><enum>(b)</enum><header>Administration</header><text>The Department shall provide administrative support to the Interagency Committee, which shall include—</text> 
<paragraph id="H4577EFFE53944285B0009201914D4E71"><enum>(1)</enum><text>scheduling meetings;</text></paragraph> 
<paragraph id="H588695443B30489BB60099D660B0DBF5"><enum>(2)</enum><text>preparing agenda;</text></paragraph> 
<paragraph id="HD60A924D18284799AFD44D24CBA0928D"><enum>(3)</enum><text>maintaining minutes and records; and</text></paragraph> 
<paragraph id="HC4E7B5AA19EA45BEACE38134B62FEDB"><enum>(4)</enum><text>producing reports.</text></paragraph></subsection> 
<subsection id="HCB9E4E5939D64174840082D9E1A6733D"><enum>(c)</enum><header>Chairperson</header><text>The Secretary shall designate a chairperson of the Interagency Committee.</text></subsection> 
<subsection id="H604F782378D8426EA4D46F006C1DE6D6"><enum>(d)</enum><header>Meetings</header><text>The Interagency Committee shall meet—</text> 
<paragraph id="H4D5E3266CD4A41C49DDD46D119F3CDC0"><enum>(1)</enum><text>at the call of the Secretary; or</text></paragraph> 
<paragraph id="H2FC1D0A215E047EDA4BEAC94E9B18B5"><enum>(2)</enum><text>not less frequently than once every month.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD03F221EAD7A4036B7B300470063FFDC"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by inserting after the item relating to section 801 the following:</text>

<subsection id="H81C66F4C6ED14243B3A057D5486B97E"><enum>(a)</enum><header>Director of State and Local Government Coordination and Preparedness</header><text>Section 801(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/361">6 U.S.C. 361(a)</external-xref>) is amended to read as follows:</text>

<subsection id="HC8BAA8F889A04C38BD3F47469BD0E6C"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H65CD94C397684F3F955922DAA3A7294F"><enum>(1)</enum><header>In general</header><text>There is established within the Office of the Secretary the Office for State and Local Government Coordination and Preparedness, which shall oversee and coordinate departmental programs for, and relationships with, State and local governments.</text></paragraph> 
<paragraph id="HB155410E17C94B5CBDEB1F87AC4B75AB"><enum>(2)</enum><header>Executive director</header><text>The Office established under paragraph (1) shall be headed by the Executive Director of State and Local Government Coordination and Preparedness, who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HED0BFF8C2E924579A8ECA073F918B515"><enum>(b)</enum><header>Office for domestic preparedness</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended—</text> 
<paragraph id="HEC0DDF3C69AB417FAAF51CE83C654F6E"><enum>(1)</enum><text>by redesignating section 430 as section 803 and transferring that section to the end of subtitle A of title VIII, as amended by section 2; and</text></paragraph> 
<paragraph id="HDD7BD8BD6B1B464498BF04340190E677"><enum>(2)</enum><text>in section 803, as redesignated by paragraph (1)—</text> 
<subparagraph id="H67DCCC219F94480E85AD6FDBEA5E3D46"><enum>(A)</enum><text>in subsection (a), by striking <quote>the Directorate of Border and Transportation Security</quote> and inserting <quote>the Office for State and Local Government Coordination and Preparedness</quote>;</text></subparagraph> 
<subparagraph id="HEE9AC2E0E4C24E6F9C946253A42C29EA"><enum>(B)</enum><text>in subsection (b), by striking <quote>who shall be appointed by the President</quote> and all that follows and inserting <quote>who shall report directly to the Executive Director of State and Local Government Coordination and Preparedness.</quote>; and</text></subparagraph> 
<subparagraph id="HDA85A331A2404F400099AEE3CAA197B8"><enum>(C)</enum><text>in subsection (c)—</text>

<subsection id="HC1C21EBA5E9A47F08315CD257D7845F1"><enum>(c)</enum><header>Homeland security information clearinghouse</header> 
<paragraph id="HF71BBA6036CE4785A741678CA5EBC57C"><enum>(1)</enum><header>Establishment</header><text>There is established within the Office for State and Local Government Coordination and Preparedness a Homeland Security Information Clearinghouse (referred to in this section as the <quote>Clearinghouse</quote>), which shall assist States, local governments, and emergency response providers in accordance with paragraphs (2) through (6).</text></paragraph> 
<paragraph id="H16DD79F2F28C4BDCB73CC5CF74E6FEE"><enum>(2)</enum><header>Homeland security grant information</header><text>The Clearinghouse shall create a new website or enhance an existing website, establish a toll-free number, and produce a single publication that each contain information regarding the homeland security grant programs administered by the Department.</text></paragraph> 
<paragraph id="H9D10300FF10B4E098F00EC95B0BAA7D5"><enum>(3)</enum><header>Technical assistance</header><text>The Clearinghouse, in consultation with the Interagency Committee established under section 802, shall provide information regarding technical assistance provided by any Federal agency to States and local governments relating to homeland security matters, including templates for conducting threat analyses and vulnerability assessments.</text></paragraph> 
<paragraph id="HE5DF4E7E38434AED91F4B24953B70615"><enum>(4)</enum><header>Best practices</header><text>The Clearinghouse shall work with States, local governments, emergency response providers, the National Domestic Preparedness Consortium, the National Memorial Institute for the Prevention of Terrorism, and private organizations to gather, validate, and disseminate information regarding successful State and local homeland security programs and practices.</text></paragraph> 
<paragraph id="H2B0E0383B8724357B675BEB535908CE9"><enum>(5)</enum><header>Use of Federal funds</header><text>The Clearinghouse shall compile information regarding equipment, training, and other services that can be purchased with Federal funds provided under homeland security grant programs and make such information, and information regarding voluntary standards of training, equipment, and exercises, available to States, local governments, and emergency response providers.</text></paragraph> 
<paragraph id="H1101E98FB58648A0BDD00CDF0C3D6C3"><enum>(6)</enum><header>Other information</header><text>The Clearinghouse shall provide States, local governments, and emergency response providers with any other information that the Secretary determines necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HB1167C538D0A4A2E83DFCB60BFC3D087"><enum>4.</enum><header>Essential capabilities for first responders and threat-based homeland security grant program</header> 
<subsection id="HDA35E47933764D548F5FB52046ADDACD"><enum>(a)</enum><header>In general</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by adding at the end the following:</text>

<title id="H40134269E6C941C3BA7E2F1C3E8B92FA"><enum>XVIII</enum><header>Essential capabilities for first responders and threat-based homeland security grant program</header> 
<section id="HD4B39FE1E3DF46FCAD3767DEDCC61135"><enum>1801.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions shall apply:</text> 
<paragraph id="H556B7094EA3E43B8AF9510D9D0E83B00"><enum>(1)</enum><header>Eligible Metropolitan Region</header><text>The term <term>eligible metropolitan region</term> means the following:</text> 
<subparagraph id="H08A1C440828C42BB87003C4F79F9FA21"><enum>(A)</enum><header>In general</header><text>A combination of 2 or more incorporated municipalities, counties, parishes, or Indian tribes within a metropolitan region that includes the city in that metropolitan region with the largest population. Such eligible metropolitan region may include additional local governments outside the metropolitan region that are likely to be affected by, or be called upon to respond to, a terrorist attack or other catastrophic event within the metropolitan region.</text></subparagraph> 
<subparagraph id="H899C13BEE468439A8BDD1F82F5EE656B"><enum>(B)</enum><header>Other combinations</header><text>Any other combination of contiguous local governments that are formally certified by the Secretary as an eligible metropolitan region for purposes of this title with the consent of the State or States in which such local governments are located.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7B123F01792D4297B5F4341D6C7981"><enum>(2)</enum><header>Essential Capabilities</header><text display-inline="yes-display-inline">The term <term>essential capabilities</term> means the levels, availability, and competence of emergency personnel, planning, training, and equipment across a variety of disciplines needed to effectively and efficiently prevent, prepare for, and respond to threatened or actual domestic terrorist attacks and other catastrophic events.</text></paragraph> 
<paragraph id="H5C9C4D2C3A6F49DBA0847D2F76CAB9C1"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> means an entity described under section 2(10)(B).</text></paragraph> 
<paragraph id="H900D3283D9EF4DCD822E5C31BBB68D65"><enum>(4)</enum><header>Metropolitan Region</header><text>The term <term>metropolitan region</term> means—</text> 
<subparagraph id="H0038AA51D0524256AA77F6387363B000"><enum>(A)</enum><text>any of the 100 largest metropolitan statistical areas in the United States, as defined by the Office of Management and Budget; or</text></subparagraph> 
<subparagraph id="H41848007B94A4A95B1B3CA837DE5613C"><enum>(B)</enum><text>any combined statistical area, as defined by the Office of Management and Budget, of which any metropolitan statistical area covered by subparagraph (A) is a part.</text></subparagraph></paragraph> 
<paragraph id="HFD51EB66F2AA450689F4C38FAAA7A4D8"><enum>(5)</enum><header>Population</header><text>The term <term>population</term> means population according to the most recent United States census population estimates available at the start of the relevant fiscal year.</text></paragraph> 
<paragraph id="HDADEA00BEE2C41ADBAD38DC359D94FE2"><enum>(6)</enum><header>Population density</header><text>The term <term>population density</term> means population divided by land area in square miles.</text></paragraph> 
<paragraph id="H5A92DE3702BE486100CDFAFF4533F443"><enum>(7)</enum><header>Sliding scale baseline allocation</header><text>The term <term>sliding scale baseline allocation</term> means 0.001 multiplied by the sum of—</text> 
<subparagraph id="H140FA00F56C7466EBA02207344FECC00"><enum>(A)</enum><text>the value of a State's population relative to that of the most populous of the 50 States of the United States, where the population of such States has been normalized to a maximum value of 100; and</text></subparagraph> 
<subparagraph id="H224CE887CC094938B8E6FCB0BFD59455"><enum>(B)</enum><text>one-fourth of the value of a State's population density relative to that of the most densely populated of the 50 States of the United States, where the population density of such States has been normalized to a maximum value of 100.</text></subparagraph></paragraph> 
<paragraph id="HF884EE6924314D22A280B45DEF46A6AF"><enum>(8)</enum><header>Threat-based homeland security grant program</header><text>The term <term>Threat-Based Homeland Security Grant Program</term> means the program established under section 1804.</text></paragraph></section> 
<section id="HBE9508F4279C41F0AACE82D12344FC56"><enum>1802.</enum><header>Preservation of pre-9/11 grant programs for traditional first responder missions</header> 
<subsection id="H4FAF472D18634B53B62D3C41DD5E4EBD"><enum>(a)</enum><header>In general</header><text>This title shall not be construed to affect any authority to award grants under any Federal grant program listed under subsection (b), which existed on September 10, 2001, to enhance traditional missions of State and local law enforcement, firefighters, ports, emergency medical services, or public health missions.</text></subsection> 
<subsection id="H64632B1CB8464A5987AC46CC5042D1D"><enum>(b)</enum><header>Programs not affected</header><text>The programs referred to in subsection (a) are the following:</text> 
<paragraph id="HB483DD6CD12346F98660E5000B5E21"><enum>(1)</enum><text>The Firefighter Assistance Program authorized under section 33 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229</external-xref>) and programs under section 34 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2229a">15 U.S.C. 2229a</external-xref>).</text></paragraph> 
<paragraph id="H312A74AADB4D478F8BEA8CA929DA909C"><enum>(2)</enum><text>All grant programs authorized under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>), including the Emergency Management Performance Grant Program and the Urban Search and Rescue Grant program.</text></paragraph>

<section id="HDA06FC9B9D8043418B1CFF9F69F2BE72"><enum>1803.</enum><header>Essential capabilities for first responders</header> 
<subsection id="H20B9B5F0457E4D97955B3D3E99343818"><enum>(a)</enum><header>Establishment of essential capabilities</header> 
<paragraph id="H8FD1B1A9175E4952B42009FC5BE3A28B"><enum>(1)</enum><header>In general</header><text>Building upon the national preparedness guidance issued by the Secretary, the Secretary shall establish clearly defined essential capabilities for State and local governments, in consultation with—</text> 
<subparagraph id="HDD0BC41253C944A2ADD4D0AC8DB83D32"><enum>(A)</enum><text>the Task Force on Essential Capabilities for First Responders established under subsection (d);</text></subparagraph> 
<subparagraph id="H6F1E77C00A054ED5A03C51EEBAAC1638"><enum>(B)</enum><text>the Under Secretaries for Emergency Preparedness and Response (including representatives of the United States Fire Administration), Border and Transportation Security, Information Analysis and Infrastructure Protection, and Science and Technology, and the Executive Director of the Office for State and Local Government Coordination and Preparedness;</text></subparagraph> 
<subparagraph id="HADA37E5AFB0E474FBB003F455DB3116E"><enum>(C)</enum><text>the Secretary of Health and Human Services;</text></subparagraph> 
<subparagraph id="H6D220CA5E74248348B2508BAFC281C4E"><enum>(D)</enum><text>other appropriate Federal agencies;</text></subparagraph> 
<subparagraph id="HC578E1140F274EEA83C62245985792B4"><enum>(E)</enum><text>State and local emergency response providers;</text></subparagraph> 
<subparagraph id="H8F5CE719EEC049B49590FF47B2DBED20"><enum>(F)</enum><text>State and local officials; and</text></subparagraph> 
<subparagraph id="H5B685608FC7649A088C6138458604240"><enum>(G)</enum><text>consensus-based standard making organizations responsible for setting standards relevant to the first responder community.</text></subparagraph></paragraph> 
<paragraph id="H7E1D06E6D8ED480D9ED8E0DDFD6DEDC5"><enum>(2)</enum><header>Deadlines</header><text>The Secretary shall—</text> 
<subparagraph id="H0E9E8C21E04F471DA3DC7928E2C8F8D6"><enum>(A)</enum><text>establish essential capabilities under paragraph (1) within 30 days after receipt of the first report under subsection (d)(3); and</text></subparagraph> 
<subparagraph id="H8D1B1BC5E81E4820AF2100445B6E0050"><enum>(B)</enum><text>regularly update such essential capabilities as necessary, but not less than every 3 years.</text></subparagraph></paragraph> 
<paragraph id="HFF715A5710A24F49A7ED7834B14D39D7"><enum>(3)</enum><header>Provision of essential capabilities</header><text>The Secretary shall ensure that a detailed description of the essential capabilities established under paragraph (1) is provided promptly to the States and to Congress. The States shall make the description of the essential capabilities available as appropriate to local governments within their jurisdictions.</text></paragraph></subsection> 
<subsection id="H6684C8B704B8461C9219D5158D153179"><enum>(b)</enum><header>Objectives</header><text>The Secretary shall ensure that essential capabilities established under subsection (a)(1) meet the following objectives:</text> 
<paragraph id="H017C3F98E2EA4E5ABA9E710889AADAFC"><enum>(1)</enum><header>Specificity</header><text>The determination of essential capabilities shall describe specifically the training, planning, personnel, and equipment that different types of communities in the Nation should possess, or to which they should have access, in order to meet the Department’s goals for preparedness based upon—</text> 
<subparagraph id="H6607463F1F4F472987974BA1EC519C89"><enum>(A)</enum><text>the national preparedness goal, the target capabilities list, and the national preparedness guidance;</text></subparagraph> 
<subparagraph id="H356FE6C4F0084CB0AC00C3C6886E4BC7"><enum>(B)</enum><text>the most current risk assessment available by the Directorate for Information Analysis and Infrastructure Protection of the threats of terrorism against the United States;</text></subparagraph> 
<subparagraph id="H5CF0BBC7C11542C5907456C8114CE453"><enum>(C)</enum><text>the risks faced by different types of communities, including communities of various sizes, geographies, and other distinguishing characteristics; and</text></subparagraph> 
<subparagraph id="H0250261F06364A2887D7F73D1AB1D7D"><enum>(D)</enum><text>the principles of regional coordination and mutual aid among State and local governments.</text></subparagraph></paragraph> 
<paragraph id="H78A62EF33DDC41E981E3044974007D12"><enum>(2)</enum><header>Flexibility</header><text>The establishment of essential capabilities shall be sufficiently flexible to allow State and local government officials to set priorities based on local or regional needs, while reaching nationally determined preparedness levels within a specified time period.</text></paragraph> 
<paragraph id="H26E73649A8304C78ACDEA9D6BCE69426"><enum>(3)</enum><header>Measurability</header><text>The establishment of essential capabilities shall be designed to enable measurement of progress toward specific terrorism preparedness goals.</text></paragraph> 
<paragraph id="HAF24C44BB9B54686B05F13786C994E73"><enum>(4)</enum><header>Comprehensiveness</header><text>The determination of essential capabilities shall be made within the context of a comprehensive State emergency management system.</text></paragraph></subsection> 
<subsection id="H1824119DC8854150ACCF74FD28D4D166"><enum>(c)</enum><header>Factors To be considered</header><text>In establishing essential capabilities for different types of communities under subsection (a)(1), the Secretary specifically shall consider the variables of threat, vulnerability, and consequences with respect to population (including transient commuting and tourist populations), areas of high population density, critical infrastructure, coastline, and international borders. Such consideration shall be based upon the most current risk assessment available by the Directorate for Information Analysis and Infrastructure Protection of the threats of terrorism against the United States and the needs described in the national preparedness guidance and the target capabilities list.</text></subsection> 
<subsection id="H82061D60B4944E389CE6FDEC3719ED70"><enum>(d)</enum><header>Task Force on Essential Capabilities for First Responders</header> 
<paragraph id="H04933E0458CA472C92969CC059C466DB"><enum>(1)</enum><header>Establishment</header> 
<subparagraph id="H6472C389C3824C17B206762BC1212514"><enum>(A)</enum><header>In general</header><text>To assist the Secretary in establishing essential capabilities under subsection (a)(1), the Secretary shall establish an advisory body under section 871(a) not later than 60 days after the date of enactment of this section, which shall be known as the Task Force on Essential Capabilities for First Responders.</text></subparagraph> 
<subparagraph id="H455D22C7A4F043F098F2AABBB6E58573"><enum>(B)</enum><header>Termination</header><text>Notwithstanding section 871(b), the Task Force shall terminate 5 years after the date of its establishment, unless the Secretary makes a written determination to extend the Task Force to a specified date, which shall not be more than 5 years after the date on which such determination is made. The Secretary may make any number of subsequent extensions consistent with this subsection.</text></subparagraph></paragraph> 
<paragraph id="H5F29C08C6CFF47FF9C71C722056FECED"><enum>(2)</enum><header>Public comment</header><text>Not later than 90 days after the date of enactment of this section, the Task Force shall solicit comment on the establishment of essential capabilities for State and local government preparedness.</text></paragraph> 
<paragraph id="HE12F8F8FF5CB4BA8B303B94BD47669E8"><enum>(3)</enum><header>Report</header> 
<subparagraph id="H8BBC86E81A18498CABD5C1B0A2C83B28"><enum>(A)</enum><header>In general</header><text>Not later than 9 months after the establishment of the Task Force by the Secretary, and every 3 years thereafter, the Task Force shall submit to the Secretary a report on its recommendations for essential capabilities for preparedness for terrorism.</text></subparagraph> 
<subparagraph id="H924255EB16D54F7082AF55AD25A5D69B"><enum>(B)</enum><header>Contents</header><text>Each report shall—</text> 
<clause id="H1440AFE6070F4F4885EAED0799E2D646"><enum>(i)</enum><text>provide a thorough assessment of the national preparedness guidance and target capabilities list and recommendations for revisions;</text></clause> 
<clause id="H74DA8DE1304745B48F00754E93CD3C46"><enum>(ii)</enum><text>include a priority ranking of essential capabilities in order to provide guidance to the Secretary and to Congress on determining the appropriate allocation of, and funding levels for, first responder needs;</text></clause> 
<clause id="H30F9E5BE762D4A1BBE417414FA8FF39B"><enum>(iii)</enum><text>set forth a methodology by which any State or local government will be able to determine the extent to which it possesses or has access to the essential capabilities that States and local governments having similar risks should obtain; and</text></clause> 
<clause id="H9807D103ADF945B69C8072D5833C944D"><enum>(iv)</enum><text>describe the availability of national voluntary consensus standards, and whether there is a need for new national voluntary consensus standards, with respect to first responder training and equipment.</text></clause></subparagraph> 
<subparagraph id="HC6D2386235F140369B1DC6EA5DECCF1C"><enum>(C)</enum><header>Comprehensiveness</header><text>The Task Force shall ensure that, when recommending essential capabilities for terrorism preparedness, such recommendations are made within the context of a comprehensive State emergency management system.</text></subparagraph></paragraph> 
<paragraph id="HBF77754EFA9D46F885F7F32CA1F92557"><enum>(4)</enum><header>Membership</header> 
<subparagraph id="HAC6120DC1D504D68BA2FEEE27F1339D4"><enum>(A)</enum><header>In general</header><text>The Task Force shall consist of 25 members appointed by the Secretary, and shall, to the extent practicable, represent a geographic and substantive cross section of first responder disciplines from the State and local government levels, including as appropriate—</text> 
<clause id="H4E50D26BCB4F4F9A85057EBB0900FF28"><enum>(i)</enum><text>members selected from the emergency response field, including fire service and law enforcement, hazardous materials response, emergency medical services, and emergency management personnel;</text></clause> 
<clause id="H94439842E37346B68E26B4CF48B8ED35"><enum>(ii)</enum><text>health scientists, emergency and inpatient medical providers, and public health professionals, including experts in emergency health care response to chemical, biological, radiological, and nuclear terrorism, and experts in providing mental health care during emergency response operations;</text></clause> 
<clause id="H75B2E59603104AEDA0F23601095900BE"><enum>(iii)</enum><text>experts from Federal, State, and local governments, and the private sector, representing standards-setting organizations, including representatives from the voluntary consensus codes and standards development community, particularly those with expertise in first responder disciplines; and</text></clause> 
<clause id="H48B5F58FE67A4F74B9CC25DEE585EB5B"><enum>(iv)</enum><text>State and local officials with expertise in terrorism preparedness and other emergency preparedness.</text></clause></subparagraph> 
<subparagraph id="H46C9E7A545B64C78ADAFDBFC6152AB39"><enum>(B)</enum><header>Coordination with the department of health and human services</header><text>In the selection of members of the Task Force who are health professionals, including emergency medical professionals, the Secretary shall coordinate the selection with the Secretary of Health and Human Services.</text></subparagraph> 
<subparagraph id="H861F0E19F30F4572A5AEA8FC5542E064"><enum>(C)</enum><header>Ex officio members</header><text>The Secretary shall designate 1 or more officers of the Department to serve as ex officio members of the Task Force. One of the ex officio members from the Department shall be the designated officer of the Federal Government for purposes of subsection (e) of section 10 of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.).</text></subparagraph></paragraph> 
<paragraph id="H73F5C5FF0DCC4E42BF822975FD0078E1"><enum>(5)</enum><header>Applicability of <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>Notwithstanding section 871(a), the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.), including subsections (a), (b), and (d) of section 10 of the Federal Advisory Committee Act, and <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b(c)</external-xref> of title 5, United States Code, shall apply to the Task Force.</text></paragraph></subsection></section> 
<section id="HFC52FBECDAA240089C4CB8F12469D7E9"><enum>1804.</enum><header>Threat-based homeland security grant program</header> 
<subsection id="H273B309C6ACD4DE99F87C43F5B009415"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H66CC537B66FF4DCA8B293C97D32140BF"><enum>(1)</enum><header>In general</header><text>There is established the Threat-Based Homeland Security Grant Program, which includes—</text> 
<subparagraph id="H81E45D9422194362B9AFD58529CECA7C"><enum>(A)</enum><text>formula-based grants for State and local programs administered by the Office of State and Local Government Coordination and Preparedness, including the State Homeland Security Grant Program, and the Law Enforcement Terrorism Prevention Program under section 1014 of the USA PATRIOT ACT (<external-xref legal-doc="usc" parsable-cite="usc/42/3714">42 U.S.C. 3714</external-xref>);</text></subparagraph> 
<subparagraph id="H6D19E4EAC2564BE3880007196FF9195F"><enum>(B)</enum><text>discretionary grants for State and local programs administered by the Office of State and Local Government Coordination and Preparedness for use in high-threat, high-density urban areas, including the Urban Area Security Initiative Program; and</text></subparagraph> 
<subparagraph id="HFEAD42A611A14F98AD0060526DD6349E"><enum>(C)</enum><text>any successor program to any program described in subparagraph (A) or (B).</text></subparagraph></paragraph> 
<paragraph id="HD6B4913B92794350915B8900B846EC65"><enum>(2)</enum><header>Grants authorized</header><text>The Secretary may award grants to States and eligible metropolitan regions under the Threat-Based Homeland Security Grant Program to enhance homeland security.</text></paragraph> 
<paragraph id="H456C49B200D041B4A024223EB113F264"><enum>(3)</enum><header>Relationship to other laws</header><text>The Threat-Based Homeland Security Grant Program shall be deemed to satisfy the requirements of section 1014 of the USA PATRIOT ACT (<external-xref legal-doc="usc" parsable-cite="usc/42/3714">42 U.S.C. 3714</external-xref>). The allocation of grants authorized under this section shall be governed by the terms of this section and not by any other provision of law.</text></paragraph></subsection> 
<subsection id="HBB46929876164675BB555D4427BC9FB"><enum>(b)</enum><header>Use of funds</header> 
<paragraph id="HB976CBF53F9E49FBB8C2F7C72F0667DA"><enum>(1)</enum><header>In general</header><text>Grants awarded under this section—</text> 
<subparagraph id="H5C4D814FBE5C4D73B6E1000596EC40C6"><enum>(A)</enum><text>shall be used to address homeland security matters related to acts of terrorism or catastrophic events, related capacity building, or otherwise addressing shortfalls in essential capabilities; and</text></subparagraph> 
<subparagraph id="HF44F8B9E1EC44FDDA4ED2753494FB265"><enum>(B)</enum><text>shall not be used to supplant ongoing emergency response expenses or general protective measures.</text></subparagraph></paragraph> 
<paragraph id="HD8E32E8977EB4639B908A100B3704D67"><enum>(2)</enum><header>Allowable uses</header><text>Grants awarded under this section may be used to achieve essential capabilities through—</text> 
<subparagraph id="H9DA7E51DD3514CE391E36E59FD1716EA"><enum>(A)</enum><text>developing State or regional plans or risk assessments (including the development of the homeland security plan under subsection (e)) to respond to terrorist attacks or other catastrophic events and community wide plans for responding to terrorist or catastrophic events that are coordinated with the capacities of applicable Federal, State, and local governments, emergency response providers, and State and local government health agencies;</text></subparagraph> 
<subparagraph id="H36CB5B06CDC94E159051597D04F3208B"><enum>(B)</enum><text>developing State, regional, or local mutual aid agreements;</text></subparagraph> 
<subparagraph id="H9A18BDB55B7E4D4B87A6CF7646EE7604"><enum>(C)</enum><text>purchasing, upgrading, storing, or maintaining equipment based on State and local needs as identified under a State homeland security plan, consistent with essential capability needs;</text></subparagraph> 
<subparagraph id="H25C15736E5F84EC7A5BB9EB1DCECB5A4"><enum>(D)</enum><text>conducting exercises to strengthen emergency preparedness of State and local first responders including law enforcement, firefighting personnel, and emergency medical service workers, and other emergency responders identified in a State homeland security plan;</text></subparagraph> 
<subparagraph id="H7D4E9F8A2944405BA13409069CF67E19"><enum>(E)</enum><text>paying for expenses relating to—</text> 
<clause id="H8E1C196CE3A54B04BC92F82419E1BCE"><enum>(i)</enum><text>overtime regarding training activities consistent with the goals outlined in a State homeland security plan; and</text></clause> 
<clause id="H8B28F36492334D39B6DED4005BE98100"><enum>(ii)</enum><text>as determined by the Secretary, overtime activities relating to an increase in the threat level under the Homeland Security Advisory System;</text></clause></subparagraph> 
<subparagraph id="HCF4E48595D384984A323EC5592F5EBD7"><enum>(F)</enum><text>promoting training relating to homeland security preparedness including—</text> 
<clause id="HB14F308EA83F4B2CA91D2D06998610FC"><enum>(i)</enum><text>emergency preparedness responses to a use or threatened use of a weapon of mass destruction; and</text></clause> 
<clause id="HC2DDF9F950C3468FAB4BE7CA3C4725BC"><enum>(ii)</enum><text>training in the use of equipment, including detection, monitoring, and decontamination equipment, and personal protective gear;</text></clause></subparagraph> 
<subparagraph id="HFEDEF43D43894AC089FA5D1BA4E22D76"><enum>(G)</enum><text>conducting any activity permitted under the Law Enforcement Terrorism Prevention Grant Program under section 1014 of the USA PATRIOT ACT (<external-xref legal-doc="usc" parsable-cite="usc/42/3714">42 U.S.C. 3714</external-xref>); and</text></subparagraph> 
<subparagraph id="H88DEE54C84AE416190E6B7C1EE02C12D"><enum>(H)</enum><text>any other activity relating to achieving essential capabilities approved by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H381FED16A69746D58003E6CEA156E7D"><enum>(3)</enum><header>Prohibited uses</header><text>Grants awarded under this section may not be used to construct buildings or other physical facilities, except those described in section 611 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42 U.S.C. 5196</external-xref>) and approved by the Secretary in the homeland security plan certified under subsection (e), or to acquire land.</text></paragraph></subsection> 
<subsection id="H93F0AAC6C7784D679F08C37966F78498"><enum>(c)</enum><header>Equipment standards</header><text>If an applicant for a grant under this section proposes to upgrade or purchase, with assistance provided under the grant, new equipment or systems that do not meet or exceed any applicable national voluntary consensus standards established by the Secretary under section 1807(a), the applicant shall include in the application an explanation of why such equipment or systems will serve the needs of the applicant better than equipment or systems that meet or exceed such standards.</text></subsection> 
<subsection id="HED9A39CCADBA4B0594BF3C11600BB7F"><enum>(d)</enum><header>Application</header> 
<paragraph id="H64EB16C2243A4C51A6605177A1F30004"><enum>(1)</enum><header>States</header> 
<subparagraph id="H9F47C121652340B1B7CC7DA59C4D2573"><enum>(A)</enum><header>Submission</header><text>A State may apply for a grant under this section by submitting to the Secretary an application detailing how requested funds would be used to achieve essential capabilities and containing such other information the Secretary may reasonably require.</text></subparagraph> 
<subparagraph id="H82333C2DC1084F9BA99863C2BBC12C1"><enum>(B)</enum><header>Revisions</header><text>A State may revise a homeland security plan certified under subsection (e) at the time an application is submitted under subparagraph (A) after receiving approval from the Secretary.</text></subparagraph> 
<subparagraph id="H080A9B558553405BAC5B2B8EA632051C"><enum>(C)</enum><header>Approval</header><text>The Secretary shall not award a grant under this section unless—</text> 
<clause id="HC0D2FDA5FE014051ACE322769002D28"><enum>(i)</enum><text>the State submitting the application has previously submitted a homeland security plan meeting the requirements of subsection (e); and</text></clause> 
<clause id="HBA771ABB0C464F14BBCBC5B08470DA4C"><enum>(ii)</enum><text>the Secretary finds that the report submitted by the recipient under subsection (g) demonstrates satisfactory progress toward achieving essential capabilities.</text></clause></subparagraph> 
<subparagraph id="H4E75311402BB48569CAF3DCAC412F61"><enum>(D)</enum><header>Release of funds</header><text>The Secretary shall release grant funds to States with approved plans after the approval of an application submitted under this paragraph.</text></subparagraph></paragraph> 
<paragraph id="H36F46EB94A8A49F18032EA705B14E415"><enum>(2)</enum><header>Eligible metropolitan regions</header> 
<subparagraph id="H8DCB0963C88944659FFD8B38C0597278"><enum>(A)</enum><header>Submission</header><text>An eligible metropolitan region may apply for a grant under this section by submitting an application through the Governor of each State within which any part of the relevant metropolitan region is located.</text></subparagraph> 
<subparagraph id="H2584B231D8A8453ABCEEC79204F55ED4"><enum>(B)</enum><header>Contents</header><text>An application under this paragraph shall include—</text> 
<clause id="HB5D9AC27601346F691B8B6FAD200AF8E"><enum>(i)</enum><text>a description of how requested funds would be used to achieve essential capabilities;</text></clause> 
<clause id="HCD3991F06803423983E6BA13C74EE00"><enum>(ii)</enum><text>an explanation of how the proposed use of funds would be consistent with the homeland security plans of all relevant States;</text></clause> 
<clause id="H68440257BD7E4B018473AB9F532F0015"><enum>(iii)</enum><text>a geographic description of the eligible metropolitan region, including a list of all local governments participating in the application;</text></clause> 
<clause id="HE68A3CDF03AC4597A2BA1FD3DE3D7EAF"><enum>(iv)</enum><text>an explanation of how the applicant intends to expend funds under the grant, to administer such funds, and to allocate such funds among the participating local governments;</text></clause> 
<clause id="H89AD1D847DA74266A5AF8374005C9729"><enum>(v)</enum><text>if not all of the incorporated municipalities, counties, parishes, or Indian tribes in a metropolitan region are participating in the application, or if additional local governments outside the metropolitan region are participating, an explanation of why the eligible metropolitan region, as constituted, is an appropriate unit to receive grants to prevent, prepare for, and respond to acts of terrorism and other catastrophic events; and</text></clause> 
<clause id="HDF08DAEF84E946CA9B8BBED28F1E8883"><enum>(vi)</enum><text>such other information the Secretary may reasonably require.</text></clause></subparagraph> 
<subparagraph id="H0C9A20535FEB4C588C9FE1F500DA5678"><enum>(C)</enum><header>State review and submission</header> 
<clause id="H26D6DFEFB24D4522BE5EA8CEEDBDA7B2"><enum>(i)</enum><header>In general</header><text>To ensure consistency with State homeland security plans, an eligible metropolitan region applying for a grant under this paragraph shall submit its application to each State within which any part of the eligible metropolitan region is located for review before submission of such application to the Secretary.</text></clause> 
<clause id="H23D40D719B8D40F292DBC27E1D2D96B1"><enum>(ii)</enum><header>Deadline</header><text>Not later than 30 days after receiving an application from an eligible metropolitan region, each such State shall transmit the application to the Secretary.</text></clause> 
<clause id="HB4E8DDD1C0994687ACB429D999F3FF79"><enum>(iii)</enum><header>State disagreement</header><text>If the Governor of any such State determines that a regional application is inconsistent with the State homeland security plan of that State, or otherwise does not support the application, the Governor shall—</text> 
<subclause id="HD0A3FDB17D874F928974E7951DFD5C7B"><enum>(I)</enum><text>notify the Secretary, in writing, of that fact; and</text></subclause> 
<subclause id="H3B27A6AAA62745428BB4E16885174000"><enum>(II)</enum><text>provide an explanation of the reasons for not supporting the application at the time of transmission of the application.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HE76288A44DC84268950172D700223B6C"><enum>(e)</enum><header>Homeland security plan</header> 
<paragraph id="H033D0D3A4E6F4FBFBCB859177400B5C3"><enum>(1)</enum><header>In general</header><text>A State applying for a grant under this section shall have a 3-year State homeland security plan (referred to in this subsection as the <quote>plan</quote>) to respond to terrorist attacks and other catastrophic events that has been approved by the Secretary.</text></paragraph> 
<paragraph id="H8310C33979CE4C6D928C648184782096"><enum>(2)</enum><header>Contents</header><text>The plan shall contain—</text> 
<subparagraph id="H25ACC01F323C41D381D18DED328B47C"><enum>(A)</enum><text>a 3-year strategy to—</text> 
<clause id="H2167B7221DF5423293FBD2ADEDF4789"><enum>(i)</enum><text>ensure that the funds allocated to local governments are used exclusively to meet the needs and capabilities described under paragraph (3)(C);</text></clause> 
<clause id="H5B9AEC29F7EE4525A01689D4D2428FF6"><enum>(ii)</enum><text>provide for interoperable communications;</text></clause> 
<clause id="HB514060C6B574DE487BCEA296F153B19"><enum>(iii)</enum><text>provide for local coordination of response and recovery efforts, including procedures for effective incident command in conformance with the National Incident Management System;</text></clause> 
<clause id="H87E068C05A3B409B8D1D602EA308A0D"><enum>(iv)</enum><text>ensure that first responders and other emergency personnel have adequate training and appropriate equipment for the threats that may occur;</text></clause> 
<clause id="HC7FFDF850AEC421DB4F0C00A8FD9B62"><enum>(v)</enum><text>provide for improved coordination and collaboration among law enforcement, fire, and public health authorities at Federal, State, local, and tribal government levels;</text></clause> 
<clause id="HEF9A07AE5C734D8291B615E760A14C87"><enum>(vi)</enum><text>coordinate emergency response and public health plans;</text></clause> 
<clause id="HD524E63C58E44FDE8B701BAA023EE298"><enum>(vii)</enum><text>mitigate risks to critical infrastructure that may be vulnerable to terrorist attacks;</text></clause> 
<clause id="H23F0D8E08EBC4CF8BC00C301CB72F05F"><enum>(viii)</enum><text>promote regional coordination among contiguous local governments;</text></clause> 
<clause id="H00849D15ABF343218F2913995CDC7280"><enum>(ix)</enum><text>identify necessary protective measures by private owners of critical infrastructure;</text></clause> 
<clause id="HE296F0A1A10B4B5EBD80A1778B6238CA"><enum>(x)</enum><text>promote orderly evacuation procedures when necessary;</text></clause> 
<clause id="H0D037415AEBE4A30A570C3DC7B003350"><enum>(xi)</enum><text>ensure support from the public health community for measures needed to prevent, detect, and treat bioterrorism, and radiological and chemical incidents;</text></clause> 
<clause id="H1798269C5A5E451698551EC449F732AB"><enum>(xii)</enum><text>increase the number of local jurisdictions participating in local and statewide exercises; and</text></clause> 
<clause id="H47739A82F5854BB78CC1E81635E34D49"><enum>(xiii)</enum><text>meet preparedness goals as determined by the Secretary;</text></clause></subparagraph> 
<subparagraph id="H53F9A7E274C44B779F8989973B00568B"><enum>(B)</enum><text>objective measures for assessing the extent to which the goals and objectives set forth in paragraph (A) have been achieved;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H26C723D490084E8FB7395D075F649CBD"><enum>(C)</enum><text display-inline="yes-display-inline">priorities for the allocation of funding to local governments based on the risk, capabilities, and needs described under paragraph (3)(C); and</text></subparagraph> 
<subparagraph id="H09DDC74910694C6E93BCE6AF13A2DD02"><enum>(D)</enum><text>a report from the relevant advisory committee established under paragraph (3)(D) that documents the areas of support, disagreement, or recommended changes to the plan before its submission to the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H64FDB194DD5E42928172C079740017D5"><enum>(3)</enum><header>Development process</header> 
<subparagraph id="HD289807678614DA70032162FCBE46800"><enum>(A)</enum><header>In general</header><text>In preparing the plan under this section, a State shall—</text> 
<clause id="HF75173E6C6AA4E5D87904EF64BC43B32"><enum>(i)</enum><text>provide for the consideration of all homeland security needs;</text></clause> 
<clause id="H2DABE7951E7243F6A24D62000533E05C"><enum>(ii)</enum><text>follow a process that is continuing, inclusive, cooperative, and comprehensive, as appropriate; and</text></clause> 
<clause id="HD5EE6EA4785C43E58787163905CA27A7"><enum>(iii)</enum><text>coordinate the development of the plan with the homeland security planning activities of local governments.</text></clause></subparagraph> 
<subparagraph id="HC0BAE56BBAB0489F995B3B274F6FA21B"><enum>(B)</enum><header>Coordination with local planning activities</header><text>The coordination under subparagraph (A)(iii) shall contain input from local stakeholders, including—</text> 
<clause id="HDAFEF04A86334311932EACA7BD3D09A0"><enum>(i)</enum><text>local officials, including representatives of rural, high-population, and high-threat jurisdictions and of Indian tribes;</text></clause> 
<clause id="HC455400601DB4647BDF79FD56471535E"><enum>(ii)</enum><text>emergency response providers; and</text></clause> 
<clause id="HB6DB8C2467AB41CC9674712DC3A3E43E"><enum>(iii)</enum><text>private sector companies that own or operate critical infrastructure.</text></clause></subparagraph> 
<subparagraph id="H49B88FED6E4F4D44AD8CFEBDA51C02BA"><enum>(C)</enum><header>Scope of planning</header><text>Each State preparing a plan under this section shall, in conjunction with the local stakeholders under subparagraph (B), address all the information requested by the Secretary, and complete a comprehensive assessment of—</text> 
<clause id="HD0D984B422D24F02BB5CFFC00002A8D9"><enum>(i)</enum><text>risk, including a—</text> 
<subclause id="HCE8488450ED448678302FC9000ABCBB3"><enum>(I)</enum><text>vulnerability and consequence assessment;</text></subclause> 
<subclause id="H890C6F9F0A2C488F8C8D214BEE25B0E6"><enum>(II)</enum><text>threat assessment; and</text></subclause> 
<subclause id="H1121547611C44E39A8ECBCA96C1C006F"><enum>(III)</enum><text>public health assessment, in coordination with the State bioterrorism plan; and</text></subclause></clause> 
<clause id="HB61A4F1E215F49C1898F583D1EB4D27D"><enum>(ii)</enum><text>capabilities and needs, consistent with the essential capabilities established by the Secretary, including—</text> 
<subclause id="H4FE43DEF7DB946AC83C20027B202A0A8"><enum>(I)</enum><text>an evaluation of current preparedness, mitigation, and response capabilities based on such assessment mechanisms as shall be determined by the Secretary;</text></subclause> 
<subclause id="H3A70AEA4DE474D3090994700EEA59ECC"><enum>(II)</enum><text>an evaluation of capabilities needed to address the risks described under clause (i); and</text></subclause> 
<subclause id="H36EB909A341940F9859710D5E6437687"><enum>(III)</enum><text>an assessment of the shortfall between the capabilities described under subclause (I) and the required capabilities described under subclause (II).</text></subclause></clause></subparagraph> 
<subparagraph id="H6B17C66458CA4C778D6D32B0B5AAF2A3"><enum>(D)</enum><header>Advisory committee</header> 
<clause id="H7D6444C8DF314502AFEBB3580099D726"><enum>(i)</enum><header>In general</header><text>Each State preparing a plan under this section shall establish an advisory committee to receive comments from the public and the local stakeholders identified under subparagraph (B).</text></clause> 
<clause id="HA07761C454F54D4A925710A5F4D48FAA"><enum>(ii)</enum><header>Composition</header> 
<subclause id="H4972703B0FB34803AFA8F3558897DEF2"><enum>(I)</enum><header>In general</header><text>The Advisory Committee shall include—</text> 
<item id="H0D391749C5BF487B81F14FF4177BF088"><enum>(aa)</enum><text>local officials; and</text></item> 
<item id="H45B1F9C60E944089896713859EE9E3E1"><enum>(bb)</enum><text>emergency response providers, which shall include representatives of the fire service, law enforcement, emergency medical response, and emergency managers.</text></item></subclause> 
<subclause id="H3EE8A10160264C04BD99ADF3CC6ED7E"><enum>(II)</enum><header>Geographic representation</header><text>The members of the Advisory Committee shall be a representative group of individuals from the counties, cities, towns, and Indian tribes within the State, including representatives of rural, high-population, and high-threat jurisdictions.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HA41C9E93F3644DD79E4DE9AF7E70989D"><enum>(4)</enum><header>Plan approval</header><text>The Secretary shall approve a plan upon finding that the plan meets the requirements of—</text> 
<subparagraph id="H8C884F33607942188054C8E8CA7AE89"><enum>(A)</enum><text>paragraphs (2) and (3); and</text></subparagraph> 
<subparagraph id="H34CA44B424FE48FF85FF22649DA73FDB"><enum>(B)</enum><text>any other criteria the Secretary determines necessary to the approval of a State plan.</text></subparagraph></paragraph> 
<paragraph id="H6FAFF6C4C67C4A5BB6F361F2A5C1F97"><enum>(5)</enum><header>Review of advisory committee report</header><text>The Secretary shall review the recommendations of the advisory committee report incorporated into a plan under subsection (e)(2)(D), including any dissenting views submitted by advisory committee members, to ensure cooperation and coordination between State and local government jurisdictions in planning for the use of grant funds under this section.</text></paragraph></subsection> 
<subsection id="HB46D2A3BBC7043A7BF44A6C0D280EC38"><enum>(f)</enum><header>Allocation</header> 
<paragraph id="HA93C54456CAF4B9B8166B23DA83E00C3"><enum>(1)</enum><header>Sliding scale baseline distribution</header> 
<subparagraph id="H9EBF353414F44B8EAECAB72592C40554"><enum>(A)</enum><header>States</header><text>Each State whose application is approved under subsection (d) shall receive, for each fiscal year, the greater of—</text> 
<clause id="H36B99691A6B54658BDCF8EF711C4D84"><enum>(i)</enum><text>0.55 percent of the amounts appropriated for the Threat-Based Homeland Security Grant Program; or</text></clause> 
<clause id="H1DB5C23AD1934C9DBDD2C31E3BAEFF97"><enum>(ii)</enum><text>the State’s sliding scale baseline allocation of 28.62 percent of the amounts appropriated for the Threat-Based Homeland Security Grant Program.</text></clause></subparagraph> 
<subparagraph id="HFB05820A91FD4525910079444E831177"><enum>(B)</enum><header>Other entities</header><text>Notwithstanding subparagraph (A)—</text> 
<clause id="H1A56F02322F344CD8435E4D3E756AFFE"><enum>(i)</enum><text>the District of Columbia shall receive for each fiscal year 0.55 percent of the amounts appropriated for the Threat-Based Homeland Security Grant Program;</text></clause> 
<clause id="HB761E72A66A34D1E00F148A9F19547FE"><enum>(ii)</enum><text>the Commonwealth of Puerto Rico shall receive for each fiscal year 0.35 percent of the amounts appropriated for the Threat-Based Homeland Security Grant Program;</text></clause> 
<clause id="H6991F39430D34DDE00C61CEAE2ECD4A7"><enum>(iii)</enum><text>American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands shall each receive 0.055 percent of the amounts appropriated for the Threat-Based Homeland Security Grant Program; and</text></clause> 
<clause id="HA8FAC944093F4BA893D3416910942E88"><enum>(iv)</enum><text>no possession of the United States shall receive a baseline distribution under subparagraph (A).</text></clause></subparagraph></paragraph> 
<paragraph id="H688B53BAF72441D283E4245CC41C62B"><enum>(2)</enum><header>Urban area security initiative distribution</header> 
<subparagraph id="H2899887CD2504047B4B700E7DDCFDC"><enum>(A)</enum><header>In general</header><text>After the distribution under paragraph (1), the Secretary may allocate up to 50 percent of the funds remaining to provide grants to eligible metropolitan regions.</text></subparagraph> 
<subparagraph id="HAAD17063AFA84537A248007895E01912"><enum>(B)</enum><header>Criteria</header> 
<clause id="H89F2BEFA22A64873A848805CC6F21EF8"><enum>(i)</enum><header>In general</header><text>The Secretary shall allocate the grants under this paragraph to assist eligible metropolitan regions to achieve essential capabilities to effectively prevent, prepare for, and respond to acts of terrorism or other catastrophic events.</text></clause> 
<clause id="HBD7A87830E6E484AADE49EF9F6002C58"><enum>(ii)</enum><header>Prioritization</header><text>In prioritizing among the applications of eligible metropolitan regions for such funds, the Secretary shall consider the relative threat, vulnerability, and consequences faced by an eligible metropolitan region from a terrorist attack, including consideration of—</text> 
<subclause id="HB5424058C0F448628215DBD443C1D081"><enum>(I)</enum><text>the population of the eligible metropolitan region, except that the Secretary shall not establish a minimum population requirement that would disqualify from consideration a locality that otherwise faces significant threats, vulnerabilities, or consequences from acts of terrorism;</text></subclause> 
<subclause id="H04F39FAA16F54E199885B4EFB7322697"><enum>(II)</enum><text>the population density of the eligible metropolitan region;</text></subclause> 
<subclause id="H41410BCDB8EE45BAB8E4B300BC27EBC2"><enum>(III)</enum><text>the degree of threat, vulnerability, and consequence to the eligible metropolitan region related to critical infrastructure or key assets identified by the Secretary or State homeland security plan, including threats, vulnerabilities, and consequences from critical infrastructure in nearby jurisdictions;</text></subclause> 
<subclause id="H37011A7C6B1B48E2AE8CAB527B720302"><enum>(IV)</enum><text>whether the eligible metropolitan region is at or near an international border;</text></subclause> 
<subclause id="H844D9107B5BF4C70B6B4A370EA88868F"><enum>(V)</enum><text>whether the eligible metropolitan region has a coastline bordering ocean or international waters;</text></subclause> 
<subclause id="H4B1A7FB445C04A14A14FD7F6CE6DB42D"><enum>(VI)</enum><text>threats, vulnerabilities, and consequences faced by the eligible metropolitan region related to at-risk sites or activities in nearby jurisdictions, including the need to respond to terrorist attacks arising in those jurisdictions;</text></subclause> 
<subclause id="HAC76C902945F46D78559D1D1938E306E"><enum>(VII)</enum><text>the extent to which the eligible metropolitan region has unmet essential capabilities;</text></subclause> 
<subclause id="H4C611C1C40EE4564A5012CC5E3998129"><enum>(VIII)</enum><text>the extent to which the application of the eligible metropolitan region includes all incorporated municipalities, counties, parishes, and Indian tribes within the relevant metropolitan region; and</text></subclause> 
<subclause id="H4865CAC3AEB94A729457B2F7A1C36814"><enum>(IX)</enum><text>such other factors as are specified in writing by the Secretary.</text></subclause></clause></subparagraph> 
<subparagraph id="HBCD7B74FF3394F2D965510E738D3E215"><enum>(C)</enum><header>Distribution of awards to metropolitan regions</header> 
<clause id="H55ED76C6F74047489BDE6579007ED561"><enum>(i)</enum><header>In general</header><text>If the Secretary approves the application of an eligible metropolitan region for a grant under this section, the Secretary shall distribute the regional grant funds to the State or States in which the eligible metropolitan region is located.</text></clause> 
<clause id="HF31FF7194E4F44948CE560827D69236E"><enum>(ii)</enum><header>State distribution of funds</header><text>Each State shall provide the eligible metropolitan region not less than 80 percent of the grant funds. Any funds retained by a State shall be expended on items or services approved by the Secretary and that benefit the eligible metropolitan region.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HF233C49764E54BA9993EB0BB938829B1"><enum>(iii)</enum><header>Multistate regions</header><text>If parts of an eligible metropolitan region awarded a grant are located in 2 or more States, the Secretary shall distribute to each such State a portion of the grant funds in proportion to that State’s share of the population of the eligible metropolitan region, unless the Governors of each State (or in the case of the District of Columbia, the Mayor) agree otherwise.</text></clause></subparagraph></paragraph> 
<paragraph id="H30555A188C6542F99B68022BACDD9D76"><enum>(3)</enum><header>Threat-based distribution to States</header> 
<subparagraph id="H5B41BAF57B794AB793EDB0ED95DD238"><enum>(A)</enum><header>In general</header><text>After the distribution of funds under paragraphs (1) and (2), the Secretary shall, from the remaining funds for the Threat-Based Homeland Security Grant Program, distribute amounts to each State to assist that State in achieving essential capabilities to effectively prevent, prepare for, and respond to acts of terrorism and other catastrophic events.</text></subparagraph> 
<subparagraph id="HBD3F33454375441DAD9ED8803C31D7FF"><enum>(B)</enum><header>Prioritization</header><text>In prioritizing among State applications for such funds, the Secretary shall—</text> 
<clause id="HA6F8AA19D25542168C93297EEE5B7598"><enum>(i)</enum><text>consider the relative threat, vulnerability, and consequences faced by a State from a terrorist attack, including consideration of—</text> 
<subclause id="H15CB8916221D4332B6CB89F099384CDB"><enum>(I)</enum><text>the percent of a State’s population residing in metropolitan statistical areas, as defined by the Office of Management and Budget;</text></subclause> 
<subclause id="H07277869A9704E4AAB1161DED2577CE8"><enum>(II)</enum><text>the degree of threat, vulnerability, and consequence related to critical infrastructure or key assets identified by the Secretary or State homeland security plan;</text></subclause> 
<subclause id="H76F9DA66F20E4A2BB030F631EBBB5BDB"><enum>(III)</enum><text>whether the State has an international border;</text></subclause> 
<subclause id="HFE3B84EBF8D148138013C8D6BDE6B316"><enum>(IV)</enum><text>whether the State has a coastline bordering ocean or international waters;</text></subclause> 
<subclause id="H4B94BD1B17B64111B0C8AF36BF5042E"><enum>(V)</enum><text>threats, vulnerabilities, and consequences faced by a State related to at-risk sites or activities in adjacent States, including the need to respond to terrorist attacks arising in adjacent States;</text></subclause> 
<subclause id="H5C2EFDA51C104897BB42D03CEF8BA893"><enum>(VI)</enum><text>the extent to which the State has unmet essential capabilities; and</text></subclause> 
<subclause id="H40C45467187542C0A6F1D45FF4FA655F"><enum>(VII)</enum><text>such other factors as are specified in writing by the Secretary; and</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H87566F445B0646C2975DA21F7036705D"><enum>(ii)</enum><text>balance the goal of ensuring that the essential capabilities of the highest-risk areas are achieved quickly and the goal of ensuring that basic levels of preparedness, as measured by the attainment of essential capabilities, are achieved nationwide.</text></clause></subparagraph></paragraph> 
<paragraph id="H7ECE65CBD81F4B14BDEDADA100811899"><enum>(4)</enum><header>Funding for local governments and first responders</header> 
<subparagraph id="H3058D8ED2FF44BFB9844AC836003BA5"><enum>(A)</enum><header>In general</header><text>The Secretary shall require recipients of the sliding scale baseline distribution and the threat-based distribution to States to make available to local governments and emergency response providers, consistent with the applicable State homeland security plan, not less than 80 percent of the grant funds, the resources purchased with such grant funds, or a combination thereof, not later than 60 days after receiving grant funding.</text></subparagraph> 
<subparagraph id="H86EF964C00F548B29400CF5F4E154C7F"><enum>(B)</enum><header>Indian Tribes</header><text>States shall be responsible for allocating Federal resources to tribal communities in order to help those tribal communities achieve essential capabilities. Indian tribes shall be eligible for funding directly from the States, and shall not be required to seek funding from any local government.</text></subparagraph> 
<subparagraph id="H0B551F1381544EE7A26D29E8F08D889"><enum>(C)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands.</text></subparagraph></paragraph> 
<paragraph id="H15C2D95B3EA14A21A33BBC783B9211E"><enum>(5)</enum><header>Supplement not supplant</header><text>Amounts appropriated for grants under this subsection shall be used to supplement and not supplant other State and local government public funds obligated for the purposes provided under this title.</text></paragraph> 
<paragraph id="H2A805D8436E645CA00583648E091F3E"><enum>(6)</enum><header>Law enforcement terrorism prevention program</header> 
<subparagraph id="HEF5D2C3A51C941E98BA6BBABAFC72815"><enum>(A)</enum><header>In general</header><text>The Secretary shall designate not more than 25 percent of the amounts authorized under this section to be used for the Law Enforcement Terrorism Prevention Program under section 1014 of the USA PATRIOT ACT (<external-xref legal-doc="usc" parsable-cite="usc/42/3714">42 U.S.C. 3714</external-xref>) to provide grants to law enforcement agencies to enhance capabilities for terrorism prevention.</text></subparagraph> 
<subparagraph id="H827681DA83AC4D1D82BA47CCA2431754"><enum>(B)</enum><header>Use of funds</header><text>Notwithstanding subsection (b), grants awarded under this paragraph may be used for—</text> 
<clause id="H569BE3B460794B2CA6BBAAD19B41858D"><enum>(i)</enum><text>information sharing to preempt terrorist attacks;</text></clause> 
<clause id="HFC6F59184B95492EBA33FCBAFF94BE6B"><enum>(ii)</enum><text>target hardening to reduce the vulnerability of selected high value targets;</text></clause> 
<clause id="HAE2FCA1F1F674D26B0EB5E495106E6EE"><enum>(iii)</enum><text>threat recognition to recognize the potential or development of a threat;</text></clause> 
<clause id="H40BC74BE7ABB456891DA3474580230C8"><enum>(iv)</enum><text>intervention activities to interdict terrorists before they can execute a threat;</text></clause> 
<clause id="HADBFED98622248D1B15E013EF56B20B"><enum>(v)</enum><text>interoperable communication systems;</text></clause> 
<clause id="H42019D0FC8C24E0E94F4EEB7E93C2C8F"><enum>(vi)</enum><text>overtime expenses related to the homeland security plan approved by the Secretary, including overtime costs associated with providing enhanced law enforcement operations in support of Federal agencies for increased border security and border crossing enforcement; and</text></clause> 
<clause id="H0622B8E1A8CA43A0A8E63E85E8825F00"><enum>(vii)</enum><text>any other terrorism prevention activity authorized by the Secretary.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H36A7D8F3882C4DEEA960CD8BC3C50590"><enum>(g)</enum><header>Report on homeland security spending</header><text>Each recipient of a grant under this section shall annually submit a report to the Secretary that contains—</text> 
<paragraph id="HE1F8E69D5933447A94E41EDBDF885B64"><enum>(1)</enum><text>an accounting of the amount of State and local government funds spent on homeland security activities under the applicable State homeland security plan;</text></paragraph> 
<paragraph id="HE2FCC02C6BE7420C81E650EDBC5B7633"><enum>(2)</enum><text>information regarding the use of grant funds by the State and by units of local government as required by the Secretary; and</text></paragraph> 
<paragraph id="HEFC3E0A91DF040988C005BE20405E65D"><enum>(3)</enum><text>progress of the recipient and subgrantees in achieving essential capabilities.</text></paragraph></subsection> 
<subsection id="H8FBD98F1A80D41E897FB29CDA24FD144"><enum>(h)</enum><header>Accountability</header> 
<paragraph id="HB16509454E1F44C6B374B87851F06B7B"><enum>(1)</enum><header>Government accountability office access to information</header><text>Each recipient of a grant under this section and the Department shall provide the Government Accountability Office with full access to information regarding the activities carried out under this section.</text></paragraph> 
<paragraph id="H4E00B7386F7A4611B0DE2B99E5DB8001"><enum>(2)</enum><header>Audit</header><text>Grant recipients that expend $500,000 or more in Federal funds during any fiscal year shall submit to the Secretary an organization wide financial and compliance audit report in conformance with the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="HC007D457B04D4CA3A1CC94A26E006863"><enum>(i)</enum><header>Remedies for non-Compliance</header> 
<paragraph id="HD863758C90E749EC9CE900BB27381C7"><enum>(1)</enum><header>In general</header><text>If the Secretary finds, after reasonable notice and an opportunity for a hearing, that a recipient of a grant under this section has failed to substantially comply with any provision of this section, or with any regulations or guidelines of the Department regarding eligible expenditures, the Secretary shall—</text> 
<subparagraph id="HA36E54BB09DA49F48E958CF092DA3C91"><enum>(A)</enum><text>terminate any payment of grant funds to be made to the recipient under this section;</text></subparagraph> 
<subparagraph id="HC7A102C32EBA41C8AC80B123EADEA146"><enum>(B)</enum><text>reduce the amount of payment of grant funds to the recipient by an amount equal to the amount of grants funds that were not expended by the recipient in accordance with this section; or</text></subparagraph> 
<subparagraph id="H8235D7950DFB4773BE84069209C65813"><enum>(C)</enum><text>limit the use of grant funds received under this section to programs, projects, or activities not affected by the failure to comply.</text></subparagraph></paragraph> 
<paragraph id="H0E5469E9986144899E2EBE208BA561E7"><enum>(2)</enum><header>Duration of penalty</header><text>The Secretary shall apply an appropriate penalty under paragraph (1) until such time as the Secretary determines that the grant recipient is in full compliance with this section or with applicable guidelines or regulations of the Department.</text></paragraph> 
<paragraph id="HC9E263E783294745BFDC42B1CEFD6CAC"><enum>(3)</enum><header>Direct funding</header><text>If a State fails to substantially comply with any provision of this section or with applicable guidelines or regulations of the Department, including failing to provide local governments with grant funds or resources purchased with grant funds in a timely fashion, a local government entitled to receive such grant funds or resources may petition the Secretary, at such time and in such manner as determined by the Secretary, to request that grant funds or resources be provided directly to the local government.</text></paragraph></subsection> 
<subsection id="H39345B2A41DB430DAABD486BD967BEF8"><enum>(j)</enum><header>Reports to Congress</header><text>The Secretary shall submit an annual report to Congress that provides—</text> 
<paragraph id="H2EFC00DB38C943C4BFDC41BA6DCC4317"><enum>(1)</enum><text>the status of preparedness goals and objectives;</text></paragraph> 
<paragraph id="H0A782772E4CE4BBEB08FD989D9394CB3"><enum>(2)</enum><text>an evaluation of how States and local governments are making progress in achieving essential capabilities;</text></paragraph> 
<paragraph id="H1D09853C18C743A7BED524E755FDA057"><enum>(3)</enum><text>the total amount of resources provided to the States;</text></paragraph> 
<paragraph id="HA96910083A8D4DBC82F381E6A02F57F5"><enum>(4)</enum><text>the total amount of resources provided to local governments and metropolitan regions; and</text></paragraph> 
<paragraph id="H7CB570926473410A84A9ADC77B102B00"><enum>(5)</enum><text>an accounting of how these resources were expended.</text></paragraph></subsection> 
<subsection id="H3E65B1EBFBCB4CC7AA291149A218ACF4"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as are necessary for each fiscal year.</text></subsection></section> 
<section id="H1B2EF6C6ECEA4434BC4285009B4F0700"><enum>1805.</enum><header>Eliminating homeland security fraud, waste, and abuse</header> 
<subsection id="H61E94C03717D49C082BEBCA0857189DB"><enum>(a)</enum><header>Annual government accountability office audit and report</header> 
<paragraph id="HE9F637A2B6B748CF82F0BDC6579F6716"><enum>(1)</enum><header>Audit</header><text>The Comptroller General of the United States shall conduct an annual audit of the Threat-Based Homeland Security Grant Program.</text></paragraph> 
<paragraph id="HE8A5A8FBEDE44B09B5AFBDA08F54BF21"><enum>(2)</enum><header>Report</header><text>The Comptroller General of the United States shall provide a report to Congress on the results of the audit conducted under paragraph (1), which includes—</text> 
<subparagraph id="H76C1C9D3FAB6440C9C3665E4D11C02E9"><enum>(A)</enum><text>an analysis of whether the grant recipients allocated funding consistent with the State homeland security plan and the guidelines established by the Department; and</text></subparagraph> 
<subparagraph id="HCA14385D26CE40B994D4F6B5F84930B1"><enum>(B)</enum><text>the amount of funding devoted to overtime and administrative expenses.</text></subparagraph></paragraph></subsection> 
<subsection id="H693293DFF3CB4FABA365828046C61EF5"><enum>(b)</enum><header>Reviews of threat-Based homeland security funding</header><text>The Secretary shall conduct periodic reviews of grants made through the Threat Based Homeland Security Grant Program to ensure that recipients allocate funds consistent with the guidelines established by the Department.</text></subsection></section> 
<section id="H6E983F79F8684613904553B890A5A183"><enum>1806.</enum><header>Flexibility in unspent homeland security funds</header> 
<subsection id="H7761910B17184031AB1099A11D09908"><enum>(a)</enum><header>Reallocation of funds</header><text>The Director of the Office for Domestic Preparedness shall allow any State to request approval to reallocate funds received pursuant to appropriations for the State Homeland Security Grant Program under Public Laws 105–277 (112 Stat. 2681 et seq.), 106–113 (113 Stat. 1501A–3 et seq.), 106–553 (114 Stat. 2762A–3 et seq.), 107–77 (115 Stat. 78 et seq.), or the Consolidated Appropriations Resolution of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>), among the 4 categories of equipment, training, exercises, and planning.</text></subsection> 
<subsection id="H4F7FA45C5CF5427984F8B02351D2E62F"><enum>(b)</enum><header>Approval of reallocation requests</header><text>The Director shall approve reallocation requests under subsection (a) in accordance with the State homeland security plan and any other relevant factors that the Secretary determines to be necessary.</text></subsection> 
<subsection id="H052E11F3D0DD493CA4094125976E4B34"><enum>(c)</enum><header>Limitation</header><text>A waiver under this section shall not affect the obligation of a State to make available 80 percent of the amount appropriated for equipment to units of local government.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H7FE4692DEB58477A92E914272B4E13AA" section-type="subsequent-section"><enum>1807.</enum><header>National standards for first responder equipment and training</header> 
<subsection id="HADB27117CBF344B5BD9B52D7637FBDDE"><enum>(a)</enum><header>Equipment standards</header> 
<paragraph id="H0F0CE78FD2CA45A4A988FF1BAE200E3"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Under Secretaries for Emergency Preparedness and Response and Science and Technology (including a representative of the United States Fire Administration) and the Executive Director of the Office for State and Local Government Coordination and Preparedness, shall support the development of, promulgate, and update as necessary national voluntary consensus standards for the performance, use, and validation of first responder equipment for purposes of section 1804(c).</text></paragraph> 
<paragraph id="HD004E1F0B5A8439EAA34DC2BEA62F158"><enum>(2)</enum><header>Standards</header><text>Standards under this subsection shall—</text> 
<subparagraph id="HDBBD44163C1D48DB8D62DFAE868DFD15"><enum>(A)</enum><text>be, to the maximum extent practicable, consistent with any existing voluntary consensus standards;</text></subparagraph> 
<subparagraph id="HBC2F2534E50D4624AE2BDD530330D5B"><enum>(B)</enum><text>take into account, as appropriate, new types of terrorism threats that may not have been contemplated when such existing standards were developed;</text></subparagraph> 
<subparagraph id="HD637CE54ABCB46F985F9B67648F58123"><enum>(C)</enum><text>be focused on maximizing interoperability, interchangeability, durability, flexibility, efficiency, efficacy, portability, sustainability, and safety; and</text></subparagraph> 
<subparagraph id="H44187E2D925648EB9000E993F185E38C"><enum>(D)</enum><text>cover all appropriate uses of the equipment.</text></subparagraph></paragraph></subsection> 
<subsection id="H450040CED0624946BAC07BECD945AD49"><enum>(b)</enum><header>Training standards</header> 
<paragraph id="H56712A442C0A4E87B597AC703C9AB3F"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Under Secretaries for Emergency Preparedness and Response and Science and Technology (including a representative of the United States Fire Administration) and the Director of the Office for Domestic Preparedness, shall support the development of, promulgate, and regularly update as necessary national voluntary consensus standards for first responder training that will enable State and local government first responders to achieve optimal levels of terrorism preparedness as quickly as practicable.</text></paragraph></subsection> 
<subsection id="H0A5AA2F6E6244594BF00BA8BAA7651B1"><enum>(c)</enum><header>Consultation with standards organizations</header><text>In establishing national voluntary consensus standards for first responder equipment and training under this section, the Secretary shall consult with relevant public and private sector groups, including—</text> 
<paragraph id="H0D7F4A5265364F328401161495396DBA"><enum>(1)</enum><text>the National Institute of Standards and Technology;</text></paragraph> 
<paragraph id="H11133D9C22F148AFAD472F50EB5BA3E1"><enum>(2)</enum><text>the National Fire Protection Association;</text></paragraph> 
<paragraph id="H4142D91DB58944118F35BE86BE921F31"><enum>(3)</enum><text>the American National Standards Institute;</text></paragraph> 
<paragraph id="H89156BC4BF2D415300AFCF32879E6FD5"><enum>(4)</enum><text>the National Institute of Justice;</text></paragraph> 
<paragraph id="H1E89CCB65EC344E8BA16DB32031BBC00"><enum>(5)</enum><text>the National Institute for Occupational Safety and Health; and</text></paragraph> 
<paragraph id="HC963C59591C346D486F500F273A65FB7"><enum>(6)</enum><text>to the extent the Secretary considers appropriate, other national voluntary consensus standards development organizations, other interested Federal, State, and local agencies, and other interested persons.</text></paragraph></subsection> 
<subsection id="H008BF58114914B28A158BB9E00D7B07"><enum>(d)</enum><header>Coordination with Secretary of HHS</header><text>In establishing any national voluntary consensus standards under this section for first responder equipment or training that involve or relate to health professionals, including emergency medical professionals, the Secretary shall coordinate activities under this section with the Secretary of Health and Human Services.</text></subsection></section> 
<section id="HBAFF6CAD59F643C2BE631E74CAC5E6D3"><enum>1808.</enum><header>Certification relative to the screening of municipal solid waste transported into the United States</header> 
<subsection id="H639CF30E22A64675AD755155719701AB"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>municipal solid waste</term> includes sludge (as defined in section 1004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>)).</text></subsection> 
<subsection id="H4F920BB0C53B4FA28DE902896B913C84"><enum>(b)</enum><header>Reports to Congress</header><text>Not later than 90 days after the date of enactment of this section, the Bureau of Customs and Border Protection shall submit a report to Congress that—</text> 
<paragraph id="HEDEC5E2CCCF649CD8900DA38A0FEF5E3"><enum>(1)</enum><text>indicates whether the methodologies and technologies used by the Bureau to screen for and detect the presence of chemical, nuclear, biological, and radiological weapons in municipal solid waste are as effective as the methodologies and technologies used by the Bureau to screen for such materials in other items of commerce entering into the United States by commercial motor vehicle transport; and</text></paragraph> 
<paragraph id="H2DE735822AE044148D079D19BD8FAF4"><enum>(2)</enum><text>if the methodologies and technologies used to screen solid waste are less effective than those used to screen other commercial items, identifies the actions that the Bureau will take to achieve the same level of effectiveness in the screening of solid waste, including the need for additional screening technologies.</text></paragraph></subsection> 
<subsection id="H65B2669E7A4D49BBB755A783B948CF71"><enum>(c)</enum><header>Impact on commercial motor vehicles</header><text>If the Bureau of Customs and Border Protection fails to fully implement the actions described in subsection (b)(2) before the earlier of 6 months after the date on which the report is due under subsection (b) or 6 months after the date on which such report is submitted, the Secretary shall deny entry into the United States of any commercial motor vehicle (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/31101">section 31101(1)</external-xref> of title 49, United States Code) carrying municipal solid waste until the Secretary certifies to Congress that the methodologies and technologies used by the Bureau to screen for and detect the presence of chemical, nuclear, biological, and radiological weapons in such waste are as effective as the methodologies and technologies used by the Bureau to screen for such materials in other items of commerce entering into the United States by commercial motor vehicle transport.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7EFB3B5BEE57463D88DDEF26BA663261"><enum>(b)</enum><header>Fire services</header><text>Section 2(6) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101(6)</external-xref>) is amended by inserting <quote>(including fire services)</quote> after <quote>local emergency public safety</quote>.</text></subsection> 
<subsection id="HB81C6CD78E894899A6F57BF719EF0061"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> note) is amended by adding at the end the following:</text>
