<official-title>To direct the Secretary of the Interior to undertake a program to reduce the risks from and mitigate the effects of avalanches on recreational users of public land.</official-title>

<section commented="no" display-inline="no-display-inline" id="HBEE2FEAC90004FE987285508552707F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Land Recreational Visitor Protection Act of 2005</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HF42A87F236804EAEB7B5B6E0D7AE1831" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HB152703BB5DD45ACA28600DC8CF031CC"><enum>(1)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the avalanche protection program established under section 3(a).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8805E5D032534944A221FA3E2EE31E01"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H436E37498DD640D889C845BED3F866C1" section-type="subsequent-section"><enum>3.</enum><header>Avalanche protection program</header> 
<subsection commented="no" display-inline="no-display-inline" id="H8E041B7BF071468AA6FB9EFFD36562BA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a coordinated avalanche protection program—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H6DB11CC691DD4A8286DEA2C32FAA998E"><enum>(1)</enum><text display-inline="yes-display-inline">to provide early identification of the potential for avalanches that could endanger the safety of recreational users of public land, including skiers, backpackers, snowboarders, and campers and visitors to units of the National Park System; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H4EF99F3B34E74BEE8945E3A8743B6EDC"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce the risks and mitigate the effects of avalanches on visitors, recreational users, neighboring communities, and transportation corridors.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HF41B6476B3D54918866283B8D935E5A5"><enum>(b)</enum><header>Coordination</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H53A2C236D3C24013B116FC774E2C588C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In developing and implementing the program, the Secretary shall consult with the Secretary of Agriculture, and coordinate the program, to ensure adequate levels of protection for recreational users of public land under the jurisdiction of the Secretary, including units of the National Park System, National Recreation Areas, wilderness and backcountry areas, components of the National Wild and Scenic Rivers System, and other areas that are subject to the potential threat of avalanches.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2AE6717B302C4ADF9603666E749205C6"><enum>(2)</enum><header>Resources</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary and the Secretary of Agriculture—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4A46B5FBF0ED4E84A6D76500C900E88E"><enum>(A)</enum><text display-inline="yes-display-inline">shall, to the maximum extent practicable, use the resources of the National Avalanche Center of the Forest Service; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H51B0644998A044F698D38B0000CCC373"><enum>(B)</enum><text display-inline="yes-display-inline">may use such other resources as the Secretary has available in the development and implementation of the program.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H47060DFEC89046DD888F3300210064D7"><enum>(c)</enum><header>Advisory Committee</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H78DE1D7A341F4FE1B8E031C09A6A959"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Agriculture shall jointly establish an advisory committee to assist in the development and implementation of the program.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H274A6D72D396451EB151B1682B9ED96"><enum>(2)</enum><header>Membership</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H99F41B101884476FA90444CB535D2DF5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Advisory Committee shall consist of 11 members, appointed by the Secretaries, who represent authorized users of artillery, other military weapons, or weapons alternatives used for avalanche control.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD181D76D27254046A0FCDCEF50976BF2"><enum>(B)</enum><header>Representatives</header><text display-inline="yes-display-inline">The membership of the Advisory Committee shall include representatives of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H892C9F59DEB34B43AAC2E1CE2E895DA"><enum>(i)</enum><text display-inline="yes-display-inline">Federal land management agencies and concessionaires or permittees that are exposed to the threat of avalanches;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H8DBA5B7FC5EA4A92B24CAD6EC5C005FE"><enum>(ii)</enum><text display-inline="yes-display-inline">State departments of transportation that have experience in dealing with the effects of avalanches; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB2ECC980C38C4B8AA9DA192E00CD4400"><enum>(iii)</enum><text display-inline="yes-display-inline">Federal- or State-owned railroads that have experience in dealing with the effects of avalanches.</text></clause></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB71342F6F42E448B89DA7D76700600E2"><enum>(d)</enum><header>Central depository</header><text display-inline="yes-display-inline">The Secretary, the Secretary of Agriculture, and the Secretary of the Army shall establish a central depository for weapons, ammunition, and parts for avalanche control purposes, including an inventory that can be made available to Federal and non-Federal entities for avalanche control purposes under the program.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7A21C718C3C94C1E93473B1610A527C"><enum>(e)</enum><header>Grants</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HA054D8788B9C4C6AAC00D7C7BE30000"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Agriculture may make grants to carry out projects and activities under the program—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H378284A050354070A6EA895105BEFA57"><enum>(A)</enum><text display-inline="yes-display-inline">to assist in the prevention, forecasting, detection, and mitigation of avalanches for the safety and protection of persons, property, and at-risk communities;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF68B80B543054D9BB903D8809FAA154F"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain essential transportation and communications affected or potentially affected by avalanches;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8B8BB21D74064CC1807501D4A1C70C4"><enum>(C)</enum><text display-inline="yes-display-inline">to assist avalanche artillery users to ensure the availability of adequate supplies of artillery and other unique explosives required for avalanche control in or affecting—</text> 
<clause commented="no" display-inline="no-display-inline" id="HB0098C2213324D7D85F3BC79696D85FE"><enum>(i)</enum><text display-inline="yes-display-inline">units of the National Park System; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H2E8C0FF116424EA8A3CD7C6FB849FD5C"><enum>(ii)</enum><text display-inline="yes-display-inline">other Federal land used for recreation purposes; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB6C18530B71243CF99415F9207ADE0B"><enum>(iii)</enum><text display-inline="yes-display-inline">adjacent communities, and essential transportation corridors, that are at risk of avalanches; and</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H59F2D925C034427580D6C999832FDDF5"><enum>(D)</enum><text display-inline="yes-display-inline">to assist public or private persons and entities in conducting research and development activities for cost-effective and reliable alternatives to minimize reliance on military weapons for avalanche control.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H76DA2AC0BDA3492FA867877BCA2D1B94"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">For each fiscal year for which funds are made available under section 4, the Secretary shall give priority to projects and activities carried out in avalanche zones—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF28D277979CE41AFAE49FFD14269B04F"><enum>(A)</enum><text display-inline="yes-display-inline">with a high frequency or severity of avalanches; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCD930F9FB30B491E87E1FA9F749C00BE"><enum>(B)</enum><text display-inline="yes-display-inline">in which deaths or serious injuries to individuals, or loss or damage to public facilities and communities, have occurred or are likely to occur.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H51644A5BCB344A7AA41DB6007D2929AA"><enum>(f)</enum><header>Surplus ordinance</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/549">Section 549(c)(3)</external-xref> of title 40, United States Code, is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H6AB888C100274B079600E6B6BA009492"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or</quote> after the semicolon at the end;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB08C024718214035AAED82FF96894D1"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6D5B75563851447B8427F4402FE5572"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3333B06FBCE14E8686277B6F00080065" style="OLC"> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA680D47D19CB4DF58BFD46AB8F953E63"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of surplus artillery ordinance that is suitable for avalanche control purposes, to a user of such ordinance.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HAA34AD04A3794E448C3F01B6EB2E70B3" section-type="subsequent-section"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $15,000,000 for each of fiscal years 2006 through 2010.</text></section>
