<section section-type="section-one" id="H324FD5EA316C4FEA9C13D11B10008D8E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Health Care Reporting Act of 2005</short-title></quote>.</text></section> 
<section id="H2DBF507778164B70BB0611C6F9698702"><enum>2.</enum><header>Reporting of sanctions</header><text display-inline="no-display-inline">Section 422 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11132">42 U.S.C. 11132</external-xref>) is amended—</text> 
<paragraph id="H90C1F086A6364C468E9F3D572D2594D1"><enum>(1)</enum><text>in the section heading by striking <quote>Boards of medical examiners</quote> and inserting <quote>State licensing boards</quote>;</text></paragraph> 
<paragraph id="HCD4BEB4B468C435399FCFD2C2B5212E"><enum>(2)</enum><text>in paragraphs (1) and (2) of subsection (a)—</text> 
<subparagraph id="HD46EC4BC37FE487999BED6FC2C7F368E"><enum>(A)</enum><text>by striking <quote>physician’s</quote> each place it appears and inserting <quote>physician’s or other health care practitioner’s</quote>; and</text></subparagraph> 
<subparagraph id="H76749CAB4798471AB436FDB0358D8E53"><enum>(B)</enum><text>by striking <quote>physician</quote> each place it appears and inserting <quote>physician or other health care practitioner</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H0BD2251C12ED44CFAB7ED0092C54D2B5"><enum>(3)</enum><text>in subsections (a) and (b), by striking <quote>Board of Medical Examiners</quote> each place it appears and inserting <quote>State licensing board</quote>.</text></paragraph></section> 
<section id="HD5709D332EC24A48AD66CC30983F92DE"><enum>3.</enum><header>Reporting of certain professional review actions</header><text display-inline="no-display-inline">Section 423 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11133">42 U.S.C. 11133</external-xref>) is amended—</text> 
<paragraph id="HBAAAEF54D9454FD18262028689A04CBB"><enum>(1)</enum><text>by striking <quote>Board of Medical Examiners</quote> each place it appears and inserting <quote>State licensing board</quote>;</text></paragraph> 
<paragraph id="HBF22F794C9074F2E006FE382C08DD1F7"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="HF7645A92C2A14FC38DD9EBC00675C476"><enum>(A)</enum><text>by striking paragraph (2) and inserting the following:</text>

<paragraph id="H2D6E2337EF6F4CD883B8002177B5D177"><enum>(2)</enum><header>Mandatory reporting on other licensed health care practitioners</header><text>A health care entity shall report to the appropriate State licensing boards and to the agency designated under section 424(b), the information described in paragraph (3) in the case of a licensed health care practitioner who is not a physician, if the entity would be required to report such information under paragraph (1) with respect to the practitioner if the practitioner were a physician.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H98465E476C1B42F19D60289DEF211E7E"><enum>(B)</enum><text>by redesignating paragraph (3)(C) as paragraph (3)(D); and</text></subparagraph> 
<subparagraph id="H7C37D0ED98D6490FB6282485491B6BC4"><enum>(C)</enum><text>by striking paragraph (3)(B) and inserting the following:</text>

<subparagraph id="H892B207DC7DD4546BF7E109E82DF9F35"><enum>(B)</enum><text>a description of any adverse action, including dismissal and review action, taken by a hospital or other health care entity against a health care practitioner who is employed by, has privileges at, is under contract with, or otherwise works at the health care entity for conduct that may be construed to violate any Federal or State law, including laws governing licensed health care professional practice standards,</text></subparagraph> 
<subparagraph id="HF0D9BAD5079944348719FE725C7D2D09"><enum>(C)</enum><text>information on a health care practitioner who voluntarily resigns during, or as a result of, a pending dismissal or review action, and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3B02E98FB5404120818C27D1611387D2"><enum>(3)</enum><text>by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively;</text></paragraph> 
<paragraph id="H3A6A7C14884B42669B938895113CB911"><enum>(4)</enum><text>by inserting after subsection (a), the following:</text> 
<quoted-block id="HCAEAD9A44DCF4338AD31C3A79D5BA3E"> 
<subsection id="H5C3A09DD9F4C42A3A420AE69A229C274"><enum>(b)</enum><header>Standard for reporting of adverse actions</header><text>Adverse actions reported under subsection (a)(2) shall be made in accordance with the rights and procedures afforded to physicians under section 412.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5F9C04E9284F41F486E7EC8F86F657"><enum>(5)</enum><text>in subsection (c) (as so redesignated), in the subsection heading, by striking <quote>Board of Medical Examiners</quote> and inserting <quote>State licensing board</quote>;</text></paragraph> 
<paragraph id="H84692FA885154DE084D02B9C35B107B7"><enum>(6)</enum><text>in subsection (d)(1) (as so redesignated), by striking <quote>subsection (a)(1)</quote> and inserting <quote>paragraphs (1) and (2) of subsection (a) and subsection (b)</quote>;</text></paragraph> 
<paragraph id="HA3D4179D573343F69D61DAE5B0D0A954"><enum>(7)</enum><text>in subsection (d)(2) (as so redesignated), in the paragraph heading, by striking <quote>Board of Medical Examiners</quote> and inserting <quote>State licensing board</quote>;</text></paragraph>

<subsection id="H40170F8EADEB4973ADBDEDDE326FB66"><enum>(f)</enum><header>Civil penalties</header> 
<paragraph id="HADDF01D8B5964B0486002381D915C5E9"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide for the imposition of no more than $50,000 per violation for health care entities that fail to comply with this section.</text></paragraph> 
<paragraph id="HD45D91D1AD534535B54295F8FDBB1FDB"><enum>(2)</enum><header>Repeated violations</header><text>The Secretary shall provide for civil penalties in addition to the amount listed in paragraph (1) for health care entities that establish patterns of repeated violations of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1BF4BA0741B6464FB59FBB4D82603230"><enum>4.</enum><header>Civil penalties</header><text display-inline="no-display-inline">Section 425 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11135">42 U.S.C. 11135</external-xref>) is amended—</text> 
<paragraph id="HF998565EA64C4BD5912325F7764725A5"><enum>(1)</enum><text>in paragraphs (1) and (2) of subsection (a), and subsections (b) and (c), by striking <quote>hospital</quote> each place it appears and inserting <quote>health care entity or agency employing a physician or other licensed health care practitioner</quote>;</text></paragraph> 
<paragraph id="H30A773E9475E48759C002C528C7D4BB0"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="H2DE845BEB2014CE492FA457045E93B5B"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text> 
<clause id="HD5EC6110284147A6A9409FF9BB841DCB"><enum>(i)</enum><text>by striking <quote>each hospital</quote> and inserting <quote>each health care entity and agency employing a physician or other licensed health care practitioner</quote>; and</text></clause> 
<clause id="HC3C98B9D28CB43178868117C8340ED60"><enum>(ii)</enum><text>by inserting <quote>and from the appropriate State licensing board,</quote> after <quote>(or the agency designated under section 424(b)),</quote>;</text></clause></subparagraph> 
<subparagraph id="H1D5A206F88224B8D8E37041400C360BF"><enum>(B)</enum><text>in paragraph (1), by inserting <quote>or employment</quote> after <quote>clinical privileges</quote>; and</text></subparagraph> 
<subparagraph id="H38E3444673834F6290E33B565FF20090"><enum>(C)</enum><text>in paragraph (2), by inserting <quote>or employed</quote> after <quote>clinical privileges</quote>;</text></subparagraph></paragraph> 
<paragraph id="HBCE01B66383849F6A4C3E95C00A59D4B"><enum>(3)</enum><text>in subsection (c), by striking <quote>hospital’s</quote> and inserting <quote>the health care entity’s or agency’s</quote> and</text></paragraph> 
<paragraph id="H1A6BBA0504F14E6B849DC84BF2B8E09E"><enum>(4)</enum><text>by adding at the end the following:</text>

<subsection id="H9CF5853EF3264CED81B341246351C76"><enum>(d)</enum><header>Civil penalties</header> 
<paragraph id="H17490AFBF7724365852BC5F624C9CC2C"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide for the imposition of no more than $50,000 per violation for a health care entity or agency employing a physician or other licensed health care practitioner that fails to comply with this section.</text></paragraph>

<section id="HA4C0A4679026453DBF328724288BF14B"><enum>5.</enum><header>Professional review</header><text display-inline="no-display-inline">Section 411 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11111">42 U.S.C. 11111</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HA3C8CB85A8E7454990168F7C63FA5175"> 
<subsection id="H9463810DF3534ED9A7497D766EFA2C13"><enum>(d)</enum><header>Civil liability immunity for health care entities</header> 
<paragraph id="HEAD1FBD46D334B1C8BB22B3141DAE46F"><enum>(1)</enum><header>In general</header><text>A health care entity that discloses information about a former or current employee pursuant to section 423 is immune from civil liability for such disclosure and its consequences unless it is demonstrated that the employer—</text> 
<subparagraph id="H8ED2132BE7EC47A1A4CB9C5C214DE7FF"><enum>(A)</enum><text>knowingly disclosed false information; or</text></subparagraph> 
<subparagraph id="HA8D1D2189CAA4CC38CB4C28CDCE6FD3"><enum>(B)</enum><text>violated any right of the former or current employee that is protected under Federal or State laws.</text></subparagraph></paragraph> 
<paragraph id="HF989D26ED96D458600F99EF37E1EFE7F"><enum>(2)</enum><header>Application</header><text>This subsection applies to any employee, agent, or other representative of the current or former employer who is authorized to provide and who provides information in accordance with section 423.</text></paragraph></subsection> 
<subsection id="HB144040E9C544BB4ABBEAA04A7CAF202"><enum>(e)</enum><header>Protection of health care practitioners</header><text>A health care entity shall not penalize, discriminate, or retaliate in any manner with respect to employment, including discharge, promotion, compensation, or terms, conditions, or privileges of employment, against an employee who, in good faith, reports conduct that may be construed to violate a Federal or State law, including laws governing licensed health care professional practice standards, to a State authority, licensing authority, peer review organization, or employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE36CC88FFC334325BF4426FEAB9F7638"><enum>6.</enum><header>Health care entity; skilled nursing facility</header><text display-inline="no-display-inline">Section 431 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11151">42 U.S.C. 11151</external-xref>) is amended—</text> 
<paragraph id="HC13628C08B064BE0963B26226CDD7000"><enum>(1)</enum><text>in paragraph (4)(i), by inserting <quote>or skilled nursing facility</quote> after <quote>hospital</quote>;</text></paragraph> 
<paragraph id="HF5F2B57A03744A9C8DF6989CF94585EB"><enum>(2)</enum><text>by redesignating paragraphs (13) and (14) as paragraphs (14) and (15), respectively; and</text></paragraph> 
<paragraph id="HCE5443E6F78E4E8C81CEA0598EEE118"><enum>(3)</enum><text>by inserting after paragraph (12) the following:</text> 
<quoted-block id="HCE99B7BF6C354D2298E8FE537D7F96E8"> 
<paragraph id="H422382F124E943B595B91D5203003858"><enum>(13)</enum><text>The term <term>skilled nursing facility</term> means an entity described in section 1819(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(a)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE2E59D5F46B649F5BAC36B9766F6B521"><enum>7.</enum><header>Sanctions Against and background checks of health care practitioners and providers</header><text display-inline="no-display-inline">Section 1921 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-2">42 U.S.C. 1396r–2</external-xref>) is amended—</text> 
<paragraph id="HA7EBE491DE794FD9822758F311B671AD"><enum>(1)</enum><text>in the section heading, by inserting <quote>and Criminal Background Checks of</quote> after <quote>Against</quote>; and</text></paragraph> 
<paragraph id="HD2D1B7671C554B4698C74833BA246B71"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="HD6C9403CBDE84713895153001043F28B"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph> 
<subparagraph id="H7E84F7F76E964E0C93728DAC4F412700"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text> 
<quoted-block id="HCF420A31CAD041338B85B70380D84BAA"> 
<paragraph id="H046836499B9F43C8BD835E7C50ECE7C7"><enum>(2)</enum><header>Information concerning criminal background of licensed health care practitioners</header><text>The State shall have in effect a system of reporting criminal background information on licensed health care practitioners to the agency designated under section 424(b) of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11134">42 U.S.C. 11134(b)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H875C82DB30074E44933431CFDB8E28A0"><enum>8.</enum><header>Date of implementation</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall, through the promulgation of appropriate regulations, implement the provisions of this Act within 1 year after the date of enactment of this Act.</text></section>
