<section section-type="section-one" id="H2AAF34FB0ED24223BA31C13870A7BD25" display-inline="no-display-inline"><enum>1.</enum><header>Debt reduction for developing countries with coral reefs and other coastal marine resources</header><text display-inline="no-display-inline">The <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) is amended by adding at the end the following:</text>

<part id="H1071EBFE99FD475EB2EDAB00CA394D6"><enum>VI</enum><header>Debt reduction for developing countries with coral reefs and other coastal marine resources</header>
<section id="H1B86D0A99B194D6897D6CB2DAAAB73E7"><enum>901.</enum><header>Short title</header><text display-inline="no-display-inline">This part may be cited as the <quote>Coral Reef and Coastal Marine Conservation Act of 2005</quote>.</text></section>
<section id="H6199CA371F954E1A9E0075C7FFC9C56B"><enum>902.</enum><header>Findings and purposes</header>
<subsection id="HDE85F90B8E394EFE8CA347974BC3AD23"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text>
<paragraph id="H7E9D45D6DF654AA0A08071498054C458"><enum>(1)</enum><text>It is the established policy of the United States to support and seek the protection and restoration of natural coastal marine areas, in particular coral reefs and other critically imperiled coastal marine resources around the world, as demonstrated by the establishment of the United States Government’s Coral Reef Task Force under Executive Order 13089 (June 11, 1998) and by the emphasis given to coral reefs at the Conference on Oceans held in Monterey, California.</text></paragraph>
<paragraph id="HC6069E4E1D984A248B1DF3D3AA3F93F"><enum>(2)</enum><text>Coral reefs and other coastal marine resources provide a wide range of benefits to mankind by—</text>
<subparagraph id="H17E1B2B683684B1DADC1EAAB51F47B8"><enum>(A)</enum><text>harboring a major share of the world’s marine biological diversity, and by acting as seed-grounds and nurseries for many deep-sea species; and</text></subparagraph>
<subparagraph id="HA6FD55AC0299415CA1A6A36BE5F3934"><enum>(B)</enum><text>serving as the basis for major activities of critical economic, social, and cultural importance, including fishing, pharmaceutical research, recreation, tourism, and the natural purification and recharge of waters.</text></subparagraph></paragraph>
<paragraph id="H6FC23F606E654CC58F520098347C2F66"><enum>(3)</enum><text>International organizations and assistance programs to conserve coral reefs and other coastal marine resources have proliferated in recent years, but the rapid destruction of these resources nonetheless continues in many countries.</text></paragraph>
<paragraph id="H912EC5DE06CF493100DB925012F9C1A0"><enum>(4)</enum><text>Poverty and economic pressures on many developing countries, including the burden of official debts, has promoted inefficient, unsustainable over-exploitation of coral reefs and other coastal marine resources, while also denying necessary funds to protection efforts.</text></paragraph>
<paragraph id="H0ADFD1BB622A4D35A28815190806841B"><enum>(5)</enum><text>Reduction of official, government-to-government debts can help reduce economic pressures for over-exploitation of coral reefs and other coastal marine resources and can mobilize additional resources for their protection.</text></paragraph></subsection>
<subsection id="H24F3FBA23FF4451697A6EFA6B5C5239"><enum>(b)</enum><header>Purposes</header><text>The purposes of this part are—</text>
<paragraph id="HEFCC9006FBB3471B823EF800C93D9165"><enum>(1)</enum><text>to recognize the values received by United States citizens from protection of coral reefs and other coastal marine resources;</text></paragraph>
<paragraph id="HF57D458F0F764D338D86B44BD5C7FAD6"><enum>(2)</enum><text>to facilitate greater protection of remaining coral reefs and other coastal marine resources, and the recovery of damaged areas, by providing for the alleviation of debt in countries where these resources are located, thus allowing for the use of additional resources to protect and restore such coral reefs and other coastal marine resources, and to reduce economic pressures that have led to unsustainable exploitation; and</text></paragraph>
<paragraph id="HE824E31EC9E3475FA73DFD28D25F7D00"><enum>(3)</enum><text>to ensure that resources freed from debt in such countries are rechanneled to protection of coral reefs and other coastal marine resources.</text></paragraph></subsection></section>
<section id="H48DE3C559ED44DEAA9EAC604CF13085"><enum>903.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
<paragraph id="HFC40154024E047BE9CED414028A6A8B7"><enum>(1)</enum><header>Administering body</header><text>The term <term>administering body</term> means the entity provided for in section 908(c).</text></paragraph>
<paragraph id="HDA70290ADA364DD1A7C200DF45C7932E"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>
<subparagraph id="HD2F6E05BC7D24C65B3F68305B1751172"><enum>(A)</enum><text>the Committee on International Relations and the Committee on Appropriations of the House of Representatives; and</text></subparagraph>
<subparagraph id="HE1FA7FF8F61745B3891E5C20A07E9579"><enum>(B)</enum><text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate.</text></subparagraph></paragraph>
<paragraph id="H042E862F2A3E4BAAB4A117F121C04D1"><enum>(3)</enum><header>Beneficiary country</header><text>The term <term>beneficiary country</term> means an eligible country with respect to which the authority of section 906(a) or paragraph (1) or (2) of section 907(a) of this part is exercised.</text></paragraph>
<paragraph id="H55B0323A63FF4385B29C0042C9773E4C"><enum>(4)</enum><header>Board</header><text>The term <term>Board</term> means the board referred to in section 910.</text></paragraph>
<paragraph id="H1F16D44FFE7045CC8E8565FC9CA592E0"><enum>(5)</enum><header>Coral</header><text>The term <term>coral</term> means species of the phylum Cnidaria, including—</text>
<subparagraph id="H4817A4B86260404600B64BDD7B09519F"><enum>(A)</enum><text>all species of the orders Antipatharia (black corals), Scleractinia (stony corals), Alcyonacea (soft corals), Gorgonacea (horny corals), Stolonifera (organpipe corals and others), and Coenothecalia (blue coral), of the class Anthozoa; and</text></subparagraph>
<subparagraph id="HC68C62A454BF4BD8AC705933C44EB3D6"><enum>(B)</enum><text>all species of the order Hydrocorallina (fire corals and hydrocorals) of the class Hydrozoa.</text></subparagraph></paragraph>
<paragraph id="HE952515B66D046BBB4000074205D44CF"><enum>(6)</enum><header>Coral reef</header><text>The term <term>coral reef</term> means any reef or shoal composed primarily of corals.</text></paragraph>
<paragraph id="H9578D5AC24F043A9AEFC301C6828FC00"><enum>(7)</enum><header>Developing country with a coral reef or other coastal marine resource</header><text>The term <term>developing country with a coral reef or other coastal marine resource</term> means—</text>
<subparagraph id="H7DB6922E92514C54B144FEC0F4CC1D5C"><enum>(A)</enum>
<clause display-inline="yes-display-inline" id="H25A3FB0F4524405800245574B79570FB"><enum>(i)</enum><text>a country that has a per capita income of $725 or less in 1994 United States dollars (commonly referred to as <quote>low-income country</quote>), as determined and adjusted on an annual basis by the International Bank for Reconstruction and Development in its World Development Report; or</text></clause>
<clause indent="up1" id="H5C6EA7B2FBFA493A8E860358F533243D"><enum>(ii)</enum><text>a country that has a per capita income of more than $725 but less than $8,956 in 1994 United States dollars (commonly referred to as <quote>middle-income country</quote>), as determined and adjusted on an annual basis by the International Bank for Reconstruction and Development in its World Development Report; and</text></clause></subparagraph>
<subparagraph id="H22F0295CAA6844B783B01B3729C4025"><enum>(B)</enum><text>a country that contains at least one coral reef or other coastal marine resource that is of conservation concern.</text></subparagraph></paragraph>
<paragraph id="H68A2CD1A41A64F4892C801FE49EE3792"><enum>(8)</enum><header>Eligible country</header><text>The term <term>eligible country</term> means a country designated by the President in accordance with section 905.</text></paragraph>
<paragraph id="HE1996B434913497E9B7E207902C3241B"><enum>(9)</enum><header>Coral Reef and Other Coastal Marine Resources Agreement</header><text>The term <term>Coral Reef and Other Coastal Marine Resources Agreement</term> or <term>Agreement</term> means an Coral Reef and Other Coastal Marine Resources Agreement as provided for in section 908.</text></paragraph>
<paragraph id="HCC7AE3709DF54226A6E7A37494B78675"><enum>(10)</enum><header>Coral Reef and Other Coastal Marine Resources Facility</header><text>The term <term>Coral Reef and Other Coastal Marine Resources Facility</term> or <term>Facility</term> means the Coral Reef and Other Coastal Marine Resources Facility established in the Department of the Treasury by section 904.</text></paragraph>
<paragraph id="H226DE21079714ACEA8FE5FD56B2534E2"><enum>(11)</enum><header>Coral Reef and Other Coastal Marine Resources Fund</header><text>The term <term>Coral Reef and Other Coastal Marine Resources Fund</term> or <term>Fund</term> means a Coral Reef and Other Coastal Marine Resources Fund provided for in section 909.</text></paragraph></section>
<section id="H165AE3F880A7467AA6D252630500BF30"><enum>904.</enum><header>Establishment of the Facility</header><text display-inline="no-display-inline">There is established in the Department of the Treasury an entity to be known as the <quote>Coral Reef and Other Coastal Marine Resources Facility</quote> for the purpose of providing for the administration of debt reduction in accordance with this part.</text></section>
<section id="H958CD05056964FAF00FB7822A34653B5"><enum>905.</enum><header>Eligibility for benefits</header>
<subsection id="HBA60DEB953154F45B181271CA7AE89C3"><enum>(a)</enum><header>In general</header><text>To be eligible for benefits from the Facility under this part, a country shall be a developing country with a coral reef or other coastal marine resource—</text>
<paragraph id="H3218204DB76643679C26C170D1D182D2"><enum>(1)</enum><text>the government of which meets the requirements applicable to Latin American or Caribbean countries under paragraphs (1) through (5) and (7) of section 703(a) of this Act; and</text></paragraph>
<paragraph id="H0C6A55BC30CC4D2FBA6BC09E8768916E"><enum>(2)</enum><text>that has established investment reforms, as evidenced by the conclusion of a bilateral investment treaty with the United States, implementation of an investment sector loan with the Inter-American Development Bank, World Bank-supported investment reforms, or other measures, as appropriate.</text></paragraph></subsection>
<subsection id="HD2E0CFC97A4547EE8BC742D499107C73"><enum>(b)</enum><header>Eligibility determinations</header>
<paragraph id="H82FE77F1550D477ABDF0C00A900AB49"><enum>(1)</enum><header>In general</header><text>Consistent with subsection (a), the President shall determine whether a country is eligible to receive benefits under this part.</text></paragraph>
<paragraph id="HFA47EC6ACB7245DF82C1D864FF769E2"><enum>(2)</enum><header>Congressional notification</header><text>The President shall notify the appropriate congressional committees of the intention of the President to designate a country as an eligible country at least 15 days in advance of any formal determination.</text></paragraph></subsection></section>
<section id="H8D8FF26D6C114F2AA284CDD13F804D02"><enum>906.</enum><header>Reduction of debt owed to the United States as a result of concessional loans under this Act</header>
<subsection id="H9D12A79EA246446D80F500A7B15B28B6"><enum>(a)</enum><header>Authority to reduce debt</header>
<paragraph id="HC2B54B7AF8804345A5C16CCE83768FB"><enum>(1)</enum><header>Authority</header><text>The President may reduce the amount owed to the United States (or any agency of the United States) that is outstanding as of January 1, 2005, as a result of concessional loans made to an eligible country by the United States under this Act or predecessor foreign economic assistance legislation.</text></paragraph>
<paragraph id="H0338C3AE44E1494A9BC44496E70583FB"><enum>(2)</enum><header>Authorization of appropriations</header><text>For the cost (as defined in section 502(5) of the <act-name parsable-cite="FCRA90">Federal Credit Reform Act of 1990</act-name>) for the reduction of any debt pursuant to this section, there are authorized to be appropriated to the President $10,000,000 for each of the fiscal years 2006 through 2009.</text></paragraph>
<paragraph id="HEC101FFFFB324BCFACED004300000060"><enum>(3)</enum><header>Certain prohibitions inapplicable</header>
<subparagraph id="H33EF50A4D00D40FAA0009C009C3E002F"><enum>(A)</enum><header>In general</header><text>A reduction of debt pursuant to this section shall not be considered assistance for purposes of any provision of law limiting assistance to a country.</text></subparagraph>
<subparagraph id="H54E569DF667F42C2AB6D31BB90007D8C"><enum>(B)</enum><header>Additional requirement</header><text>The authority of this section may be exercised notwithstanding section 620(r) of this Act or section 321 of the International Development and Food Assistance Act of 1975.</text></subparagraph></paragraph></subsection>
<subsection id="H43D23D8246674CDF9CDAF4A3591701E2"><enum>(b)</enum><header>Implementation of debt reduction</header>
<paragraph id="H7AC271ACD48C4D4698FDD5E97603DC82"><enum>(1)</enum><header>In general</header><text>Any debt reduction pursuant to subsection (a) shall be accomplished at the direction of the Facility by the exchange of a new obligation for obligations of the type referred to in subsection (a) outstanding as of the date specified in subsection (a)(1).</text></paragraph>
<paragraph id="H2EE7767A58A1486AA58D899EF6B7C865"><enum>(2)</enum><header>Exchange of obligations</header>
<subparagraph id="H78F44AB5914340CA80BC20C53B64506B"><enum>(A)</enum><header>In general</header><text>The Facility shall notify the United States Agency for International Development of an agreement entered into under paragraph (1) with an eligible country to exchange a new obligation for outstanding obligations.</text></subparagraph>
<subparagraph id="H01D1B35E974E4194A501364F1594C504"><enum>(B)</enum><header>Additional requirement</header><text>At the direction of the Facility, the old obligations that are the subject of the agreement shall be canceled and a new debt obligation for the country shall be established relating to the agreement, and the United States Agency for International Development shall make an adjustment in its accounts to reflect the debt reduction.</text></subparagraph></paragraph></subsection>
<subsection id="H3A708A340C90487589E175A6E1407909"><enum>(c)</enum><header>Additional terms and conditions</header><text>The following additional terms and conditions shall apply to the reduction of debt under subsection (a)(1) in the same manner as such terms and conditions apply to the reduction of debt under section 704(a)(1) of this Act:</text>
<paragraph id="H15781FAE49B34546BE6D3C7972222D8D"><enum>(1)</enum><text>The provisions relating to repayment of principal under section 705 of this Act.</text></paragraph>
<paragraph id="H4E05945EF127493498DEB214B5FD433D"><enum>(2)</enum><text>The provisions relating to interest on new obligations under section 706 of this Act.</text></paragraph></subsection></section>
<section id="H51A6F9BCFC2044D785DD85023C38B582"><enum>907.</enum><header>Authority to engage in debt-for-nature swaps and debt buybacks</header>
<subsection id="HBDA7973072314C2CA54EB7EC53A48836"><enum>(a)</enum><header>Loans and credits eligible for sale, reduction, or cancellation</header>
<paragraph id="H5848082690E747BAB2AB7FC4BE014D91"><enum>(1)</enum><header>Debt-for-nature swaps</header>
<subparagraph id="H0F225E51DA304708A55DF50040F028B2"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President may, in accordance with this section, sell to any eligible purchaser described in subparagraph (B) any concessional loans described in section 906(a)(1), or on receipt of payment from an eligible purchaser described in subparagraph (B), reduce or cancel such loans or portion thereof, only for the purpose of facilitating a debt-for-nature swap to support eligible activities described in section 908(d).</text></subparagraph>
<subparagraph id="H9AA8CDA49E65405993BD5942368432F9"><enum>(B)</enum><header>Eligible purchaser described</header><text>A loan may be sold, reduced, or canceled under subparagraph (A) only to a purchaser who presents plans satisfactory to the President for using the loan for the purpose of engaging in debt-for-nature swaps to support eligible activities described in section 908(d).</text></subparagraph>
<subparagraph id="H0280EA7D7DF64000931F5510DED324A8"><enum>(C)</enum><header>Consultation requirement</header><text>Before the sale under subparagraph (A) to any eligible purchaser described in subparagraph (B), or any reduction or cancellation under such subparagraph (A), of any loan made to an eligible country, the President shall consult with the country concerning the amount of loans to be sold, reduced, or canceled and their uses for debt-for-nature swaps to support eligible activities described in section 908(d).</text></subparagraph>
<subparagraph id="H9211D4BBC2AB4C46BE6B029D2C679D4E"><enum>(D)</enum><header>Authorization of appropriations</header><text>For the cost (as defined in section 502(5) of the <act-name parsable-cite="FCRA90">Federal Credit Reform Act of 1990</act-name>) for the reduction of any debt pursuant to subparagraph (A), amounts authorized to be appropriated under section 906(a)(2) shall be made available for such reduction of debt pursuant to subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="H237C7C32915D4212AE5BB5521806B478"><enum>(2)</enum><header>Debt buybacks</header><text>Notwithstanding any other provision of law, the President may, in accordance with this section, sell to any eligible country any concessional loans described in section 906(a)(1), or on receipt of payment from an eligible purchaser described in paragraph (1)(B), reduce or cancel such loans or portion thereof, only for the purpose of facilitating a debt buyback by an eligible country of its own qualified debt, only if the eligible country uses an additional amount of the local currency of the eligible country, equal to not less than the lessor of 40 percent of the price paid for such debt by such eligible country, or the difference between the price paid for such debt and the face value of such debt, to support eligible activities described in section 908(d).</text></paragraph>
<paragraph id="HAFA674EB2F7747BE8ED41E6CC650C8E1"><enum>(3)</enum><header>Limitation</header><text>The authority provided by paragraphs (1) and (2) shall be available only to the extent that appropriations for the cost (as defined in section 502(5) of the <act-name parsable-cite="FCRA90">Federal Credit Reform Act of 1990</act-name>) of the modification of any debt pursuant to such paragraphs are made in advance.</text></paragraph>
<paragraph id="H1EA4CD1CFA654C79B7149FDBF8568B50"><enum>(4)</enum><header>Terms and conditions</header><text>Notwithstanding any other provision of law, the President shall, in accordance with this section, establish the terms and conditions under which loans may be sold, reduced, or canceled pursuant to this section.</text></paragraph>
<paragraph id="H2A48E139D7DB44869494390682186189"><enum>(5)</enum><header>Administration</header>
<subparagraph id="H86819CF9EDBB40F6BE005952F7C79DC"><enum>(A)</enum><header>In general</header><text>The Facility shall notify the Administrator of the United States Agency for International Development of eligible purchasers described in paragraph (1)(B) that the President has determined to be eligible under paragraph (1), and shall direct such agency to carry out the sale, reduction, or cancellation of a loan pursuant to such paragraph.</text></subparagraph>
<subparagraph id="H30E9838E151E4969939C637DA8C4BE4E"><enum>(B)</enum><header>Additional requirement</header><text>Such agency shall make an adjustment in its accounts to reflect the sale, reduction, or cancellation of such a loan.</text></subparagraph></paragraph></subsection>
<subsection id="H17DE9D48F89E42238BD2F5508D692EFE"><enum>(b)</enum><header>Deposit of proceeds</header><text>The proceeds from the sale, reduction, or cancellation of any loan sold, reduced or canceled pursuant to this section shall be deposited in the United States Government account or accounts established for the repayment of such loan.</text></subsection></section>
<section id="H34F673DFECAE4C25B27DABD19B1E5020"><enum>908.</enum><header>Coral Reef and Other Coastal Marine Resources Agreement</header>
<subsection id="HD3A2E0F88443421587E3335D4BEB8C9"><enum>(a)</enum><header>Authority</header>
<paragraph id="HB10439915EFB4168AD35ECEA16E01AF"><enum>(1)</enum><header>In general</header><text>The Secretary of State is authorized, in consultation with other appropriate officials of the Federal Government, to enter into a Coral Reef and Other Coastal Marine Resources Agreement with any eligible country concerning the operation and use of the Fund for that country.</text></paragraph>
<paragraph id="HE191FA90AC1745A9ADFEBAEFA3008C35"><enum>(2)</enum><header>Consultation</header><text>In the negotiation of such an Agreement, the Secretary shall consult with the Board in accordance with section 910.</text></paragraph></subsection>
<subsection id="H2DA019658783490595C2D7F252BF0001"><enum>(b)</enum><header>Contents of Agreement</header><text>The requirements contained in section 708(b) of this Act (relating to contents of an agreement) shall apply to an Agreement in the same manner as such requirements apply to an Americas Framework Agreement.</text></subsection>
<subsection id="H51F15A12DAC3433C8FD0A551F106DCE1"><enum>(c)</enum><header>Administering body</header>
<paragraph id="HAEFD5466EFA94F3490F9D00A18F001F"><enum>(1)</enum><header>In general</header><text>Amounts disbursed from the Fund in each beneficiary country shall be administered by a body constituted under the laws of that country.</text></paragraph>
<paragraph id="H4EFAE5A879CF4B6C821C48DC8BD9D365"><enum>(2)</enum><header>Composition</header>
<subparagraph id="H1980DADBCB4E417F84D52EC6AC001FC8"><enum>(A)</enum><header>In general</header><text>The administering body shall consist of—</text>
<clause id="H1C7F706ADB1B472BBDF590C97102150"><enum>(i)</enum><text>one or more individuals appointed by the United States Government;</text></clause>
<clause id="HD1020D397413412800CFEE4BD003CE"><enum>(ii)</enum><text>one or more individuals appointed by the government of the beneficiary country; and</text></clause>
<clause id="HF440A8DA6CD74C27AB213E3E52D09EA6"><enum>(iii)</enum><text>individuals who represent a broad range of—</text>
<subclause id="H6E1F01488A5646838885058BF372258"><enum>(I)</enum><text>environmental non-governmental organizations of, or active in, the beneficiary country;</text></subclause>
<subclause id="H45D99F1403AE48B39800362399C260AD"><enum>(II)</enum><text>local community development non-governmental organizations of the beneficiary country; and</text></subclause>
<subclause id="HA6265A1F2DB947A28394F5E4E600C8D"><enum>(III)</enum><text>scientific, academic, or forestry organizations of the beneficiary country.</text></subclause></clause></subparagraph>
<subparagraph id="H461373C3A87746E5903529C181794315"><enum>(B)</enum><header>Additional requirement</header><text>A majority of the members of the administering body shall be individuals described in subparagraph (A)(iii).</text></subparagraph></paragraph>
<paragraph id="H0BD34A6A23F8464688EB1133C2706250"><enum>(3)</enum><header>Responsibilities</header><text>The requirements contained in section 708(c)(3) of this Act (relating to responsibilities of the administering body) shall apply to an administering body described in paragraph (1) in the same manner as such requirements apply to an administering body described in section 708(c)(1) of this Act.</text></paragraph></subsection>
<subsection id="H8EF3597DA970480900F509DC2E059F27"><enum>(d)</enum><header>Eligible activities</header><text>Amounts deposited in a Fund shall be used only to provide grants to conserve, maintain, and restore the coral reefs and other coastal marine resources in the beneficiary country, through one or more of the following activities:</text>
<paragraph id="HADC36C4498634A8288DB2F4DD700AE64"><enum>(1)</enum><text>Establishment, restoration, protection, and maintenance of parks, protected areas, and reserves.</text></paragraph>
<paragraph id="HB543A4456933435D90700056CAE93D71"><enum>(2)</enum><text>Development and implementation of scientifically sound systems of natural resource management, including <quote>ridgeline to reef</quote> and ecosystem management practices.</text></paragraph>
<paragraph id="H53FF9A5AD81F4256B792449C6079D2C3"><enum>(3)</enum><text>Training programs to increase the scientific, technical, and managerial capacities of individuals and organizations involved in conservation efforts.</text></paragraph>
<paragraph id="H056A9D7F697940E293557E1B34DC3456"><enum>(4)</enum><text>Restoration, protection, or sustainable use of diverse marine animal and plant species.</text></paragraph>
<paragraph id="H18ECFCD4561943F8B7C893D0FFA47D99"><enum>(5)</enum><text>Development and support of the livelihoods of individuals living near a coral reef or other coastal marine resource, in a manner consistent with protecting those resources.</text></paragraph></subsection>
<subsection id="H975B214B54C0482B9989B7A2E2678EC4"><enum>(e)</enum><header>Grant recipients</header>
<paragraph id="H7E3D011B39524A629B47955BB6ACB950"><enum>(1)</enum><header>In general</header><text>Grants made from a Fund shall be made to—</text>
<subparagraph id="H44C90A8374544B0C99BDF6E92F7C33CE"><enum>(A)</enum><text>nongovernmental environmental, forestry, conservation, and indigenous peoples organizations of, or active in, the beneficiary country;</text></subparagraph>
<subparagraph id="HB0F786DA70CF4F4DBCB2AEB7DCB7B9E"><enum>(B)</enum><text>other appropriate local or regional entities of, or active in, the beneficiary country; or</text></subparagraph>
<subparagraph id="HB639AFA1B4A34A8C9F57130078B6CEC0"><enum>(C)</enum><text>in exceptional circumstances, the government of the beneficiary country.</text></subparagraph></paragraph>
<paragraph id="HF5EF88A291554E42BBD27FBE323EDB8"><enum>(2)</enum><header>Priority</header><text>In providing grants under paragraph (1), priority shall be given to projects that are run by nongovernmental organizations and other private entities and that involve local communities in their planning and execution.</text></paragraph></subsection>
<subsection id="HC6C2085CEAF3410E9BC8001346ACFE42"><enum>(f)</enum><header>Review of larger grants</header><text>Any grant of more than $100,000 from a Fund shall be subject to veto by the Government of the United States or the government of the beneficiary country.</text></subsection>
<subsection id="H7F4E8776AFEA4E65A483B993811847D5"><enum>(g)</enum><header>Eligibility criteria</header><text>In the event that a country ceases to meet the eligibility requirements set forth in section 905(a), as determined by the President pursuant to section 905(b), then grants from the Fund for that country may only be made to nongovernmental organizations until such time as the President determines that such country meets the eligibility requirements set forth in section 905(a).</text></subsection></section>
<section id="H06B53CDBCA944FA6B5B48776F2877B1E"><enum>909.</enum><header>Coral Reef and Other Coastal Marine Resources Fund</header>
<subsection id="H1A6C5F4A8CCC4F2BA65372963BF677C3"><enum>(a)</enum><header>Establishment</header><text>Each beneficiary country that enters into a Coral Reef and Other Coastal Marine Resources Agreement under section 908 shall be required to establish a Coral Reef and Other Coastal Marine Resources Fund to receive payments of interest on new obligations undertaken by the beneficiary country under this part.</text></subsection>
<subsection id="HEA614BBBD5004E4D8896C8EA1015117"><enum>(b)</enum><header>Requirements relating to operation of Fund</header><text>The following terms and conditions shall apply to the Fund in the same manner as such terms as conditions apply to an Enterprise for the Americas Fund under section 707 of this Act:</text>
<paragraph id="H9DC2B6A1641D45D8A1C9868C1F2C704F"><enum>(1)</enum><text>The provision relating to deposits under subsection (b) of such section.</text></paragraph>
<paragraph id="HE42EB68E6B8E4EE58C1C899476AAF900"><enum>(2)</enum><text>The provision relating to investments under subsection (c) of such section.</text></paragraph>
<paragraph id="HB8D5600AB0AC4292A8362645FB1197E"><enum>(3)</enum><text>The provision relating to disbursements under subsection (d) of such section.</text></paragraph></subsection></section>
<section id="H90A062C4962F4003B018D49FFF86DE76"><enum>910.</enum><header>Board</header>
<subsection id="H836E7E5E92C848B79460DDD55508544B"><enum>(a)</enum><header>Enterprise for the Americas Board</header><text>The Enterprise for the Americas Board established under section 610(a) of the <act-name parsable-cite="ATDAA54">Agricultural Trade Development and Assistance Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/1738i">7 U.S.C. 1738i(a)</external-xref>) shall, in addition to carrying out the responsibilities of the Board under section 610(c) of such Act, carry out the duties described in subsection (c) of this section for the purposes of this part.</text></subsection>
<subsection id="H4565FB90A13C4739000064913E536B82"><enum>(b)</enum><header>Membership</header>
<paragraph id="HACE463444BB64674A8CE45A780BD6357"><enum>(1)</enum><header>Initial membership</header><text>Of the six members of the Enterprise for the Americas Board appointed by the President under section 610(b)(1)(A) of the <act-name parsable-cite="ATDAA54">Agricultural Trade Development and Assistance Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/1738i">7 U.S.C. 1738i(b)(1)(A)</external-xref>), at least one shall be a representative of the Department of State, at least one shall be a representative of the Department of the Treasury, and at least one shall be a representative of the Inter-American Foundation.</text></paragraph>
<paragraph id="HAE58EC69291C48499197EBB8E1DBC89"><enum>(2)</enum><header>Additional membership</header><text>The Enterprise for the Americas Board shall be composed of an additional four members appointed by the President as follows:</text>
<subparagraph id="HFC9ED64D02BE4D09B6BB70221B4C945"><enum>(A)</enum><text>Two representatives from the United States Government, including a representative of the National Oceanographic and Atmospheric Administration (NOAA) and a representative of the United States Geological Survey (USGS).</text></subparagraph>
<subparagraph id="H01D50B6C7BED441AA807EDA4096B9944"><enum>(B)</enum><text>Two representatives from private nongovernmental environmental, scientific, forestry, or academic organizations with experience and expertise in preservation, maintenance, sustainable uses, and restoration of coral reefs and other coastal marine resources.</text></subparagraph></paragraph></subsection>
<subsection id="H1ED564F336C14DFABBD9005016DE7BCD"><enum>(c)</enum><header>Duties</header><text>The duties described in this subsection are as follows:</text>
<paragraph id="HBBFD87509D3F49AC90FE982CA41353B1"><enum>(1)</enum><text>Advise the Secretary of State on the negotiations of Coral Reef and Other Coastal Marine Resources Agreements.</text></paragraph>
<paragraph id="HDDB384589806473190754B85B23CACFF"><enum>(2)</enum><text>Ensure, in consultation with—</text>
<subparagraph id="HA9460FD2F5704E99A827080019AA95E2"><enum>(A)</enum><text>the government of the beneficiary country;</text></subparagraph>
<subparagraph id="HD2B8F337D52F40AD9713492F2711DA97"><enum>(B)</enum><text>nongovernmental organizations of the beneficiary country;</text></subparagraph>
<subparagraph id="H8B13D4FD18B5414CBDD8B7661C6FFBE5"><enum>(C)</enum><text>nongovernmental organizations of the region (if appropriate);</text></subparagraph>
<subparagraph id="H3F5C812F9BAA48CE8000F45B3BA79BD2"><enum>(D)</enum><text>environmental, scientific, oceanographic, and academic leaders of the beneficiary country; and</text></subparagraph>
<subparagraph id="HE694525FAB5443CAA6E3F1BA067874C6"><enum>(E)</enum><text>environmental, scientific, oceanographic, and academic leaders of the region (as appropriate),</text></subparagraph><continuation-text continuation-text-level="paragraph">that a suitable administering body is identified for each Fund.</continuation-text></paragraph>
<paragraph id="H23188128A9D242ADA8D848A7DE5D5EBF"><enum>(3)</enum><text>Review the programs, operations, and fiscal audits of each administering body.</text></paragraph></subsection></section>
<section id="H7D1D4B273C23455CB47314AD12E4FA00"><enum>911.</enum><header>Consultations with the Congress</header><text display-inline="no-display-inline">The President shall consult with the appropriate congressional committees on a periodic basis to review the operation of the Facility under this part and the eligibility of countries for benefits from the Facility under this part.</text></section>
<section id="H5CCFE20E03FA40C4A11BA644CAB8D4CC"><enum>912.</enum><header>Annual reports to the Congress</header>
<subsection id="H013EA635CF5B4DF4BD97DB56A4E5E454"><enum>(a)</enum><header>In general</header><text>Not later than December 31 of each year, the President shall prepare and transmit to the Congress an annual report concerning the operation of the Facility for the prior fiscal year. Such report shall include—</text>
<paragraph id="HF6297D13D3BC40148B50FC86D8676F6E"><enum>(1)</enum><text>a description of the activities undertaken by the Facility during the previous fiscal year;</text></paragraph>
<paragraph id="HEDFF4F9273914AB1963BD8ED52C27B96"><enum>(2)</enum><text>a description of any Agreement entered into under this part;</text></paragraph>
<paragraph id="H3D8207E342B54437B7461300B3B6C214"><enum>(3)</enum><text>a report on any Funds that have been established under this part and on the operations of such Funds; and</text></paragraph>
<paragraph id="H497255F5CED34E6C96B1BEF896378E3D"><enum>(4)</enum><text>a description of any grants that have been provided by administering bodies pursuant to Agreements under this part.</text></paragraph></subsection>
<subsection id="H6DACA905AFAF41688F09B6E237A7AF27"><enum>(b)</enum><header>Supplemental views in annual report</header><text>Not later than December 15 of each year, each member of the Board shall be entitled to receive a copy of the report required under subsection (a). Each member of the Board may prepare and submit supplemental views to the President on the implementation of this part by December 31 for inclusion in the annual report when it is transmitted to Congress pursuant to this section.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>
