<section section-type="section-one" id="HE29039FA8BAB4CDF82B68D26DD20056" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prosecutors and Defenders Incentive Act</short-title></quote>.</text></section> 
<section id="H6AADA61E6C7441B6890637F353DFF991"><enum>2.</enum><header>Student loan repayment for public attorneys</header> 
<subsection id="H0024D6AFAD5C4F6C9DACD117983018EB"><enum>(a)</enum><header>In general</header><text>The <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> is amended by inserting after section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) the following:</text> 
<quoted-block act-name="Higher Education Act of 1965" id="HF552E38302A346BAB1BDBAAD923D5FCE"> 
<section id="H032B1DF212454664AB3F3985F7347EFB"><enum>428L.</enum><header>Loan forgiveness for public attorneys</header> 
<subsection id="H0C3406555BE0491E8CFCAF4C10CF4F9"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to encourage qualified individuals to enter and continue employment as prosecutors and public defenders.</text></subsection> 
<subsection id="H08AEA1FD75764D2B97006D61F02879C"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H3203E344A6C1480DB1884D519722DF44"><enum>(1)</enum><header>Prosecutor</header><text>The term <term>prosecutor</term> means a full-time employee of a State or local agency who—</text> 
<subparagraph id="HDA92E819D72A48D4A9D7A6E8EEFE381B"><enum>(A)</enum><text>is continually licensed to practice law; and</text></subparagraph> 
<subparagraph id="H21785FD2ABD146C19243AE1DD200A188"><enum>(B)</enum><text>prosecutes criminal cases at the State or local level.</text></subparagraph></paragraph> 
<paragraph id="H9F163EF2C590467BA55ECF8CBD6F9779"><enum>(2)</enum><header>Public defender</header><text>The term <term>public defender</term> means an attorney who—</text> 
<subparagraph id="HF68510996ED84C32A5621D528CCA9B41"><enum>(A)</enum><text>is continually licensed to practice law; and</text></subparagraph> 
<subparagraph id="H526A170D8C3A4599B7DA6BC1E080000"><enum>(B)</enum><text>is a full-time employee of a State or local agency, or of a nonprofit organization operating under a contract with a State or unit of local government or as a full time Federal defender attorney employed in a defender organization established pursuant to subsection (g) of <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> of title 18, United States Code, which provides legal representation services to indigent persons in criminal cases.</text></subparagraph></paragraph> 
<paragraph id="H3978650E7BF741B88B2BDAE6364DA554"><enum>(3)</enum><header>Student loan</header><text>The term <term>student loan</term> means—</text> 
<subparagraph id="HBFCC1CD77CDF429AA6D5472894E7C963"><enum>(A)</enum><text>a loan made, insured, or guaranteed under this part; and</text></subparagraph> 
<subparagraph id="H3AD7EB79194D45D8AC2E4276F7A180E6"><enum>(B)</enum><text>a loan made under part D or E.</text></subparagraph></paragraph></subsection> 
<subsection id="H55D947D318E74D8FBDFC2812318680B2"><enum>(c)</enum><header>Program authorized</header><text>For the purpose of encouraging qualified individuals to enter and continue employment as prosecutors and public defenders, the Secretary shall carry out a program, through the holder of a loan, of assuming the obligation to repay (by direct payments on behalf of a borrower) a qualified loan amount for a loan made under section 428 or 428H, in accordance with subsection (d), for any borrower who—</text> 
<paragraph id="H433F9524D7414F389C2B08E185389F43"><enum>(1)</enum><text>is employed as a prosecutor or public defender; and</text></paragraph> 
<paragraph id="H29D28983CFE943F18285A2C5445C09CE"><enum>(2)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></paragraph></subsection> 
<subsection id="HE91161A75EE8472EA214C6ECB169C300"><enum>(d)</enum><header>Terms of agreement</header> 
<paragraph id="H08CD32C32D7749C8BBC1A202B600C739"><enum>(1)</enum><header>In general</header><text>To be eligible to receive repayment benefits under this section, a borrower shall enter into a written agreement that specifies that—</text> 
<subparagraph id="H422915C6988349F7A7242679165BD93B"><enum>(A)</enum><text>the borrower will remain employed as a prosecutor or public defender for a required period of service specified in the agreement (but not less than 3 years), unless involuntarily separated from that employment;</text></subparagraph> 
<subparagraph id="HC3B926AF42EC43D28D09F6A9C4F3BFC8"><enum>(B)</enum><text>if the borrower is involuntarily separated from that employment on account of misconduct, or voluntarily separates from that employment, before the end of the period specified in the agreement, the borrower will repay the Secretary the amount of any benefits received by such employee under this section;</text></subparagraph> 
<subparagraph id="H5BDC74E42290438F84284510AFEB57A"><enum>(C)</enum><text>if the borrower is required to repay an amount to the Secretary under subparagraph (B) and fails to repay the amount described in subparagraph (B), a sum equal to the amount is recoverable by the Government from the employee (or such employee’s estate, if applicable) by such method as is provided by law for the recovery of amounts owing to the Government;</text></subparagraph> 
<subparagraph id="HDD3A36D18DA043C0A416B267197FA59F"><enum>(D)</enum><text>the Secretary may waive, in whole or in part, a right of recovery under this subsection if it is shown that recovery would be against equity and good conscience or against the public interest; and</text></subparagraph> 
<subparagraph id="H9391E16C7E20460981284B6EFC2858ED"><enum>(E)</enum><text>the Secretary shall make student loan payments under this section for the period of the agreement, subject to the availability of appropriations.</text></subparagraph></paragraph> 
<paragraph id="HED187C5BE22C4537BE5ECEDA7E32AD0"><enum>(2)</enum><header>Repayments</header><text>Any amount repaid by, or recovered from, an individual (or an estate) under this subsection shall be credited to the appropriation account from which the amount involved was originally paid. Any amount so credited shall be merged with other sums in such account and shall be available for the same purposes and period, and subject to the same limitations (if any), as the sums with which the amount was merged.</text></paragraph> 
<paragraph id="HDC384AA9C27C4ED78FD6B1F75425CE73"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="H817B8E2788694B6F8E7673FBCC6B251"><enum>(A)</enum><header>Student loan payment amount</header><text>Student loan payments made by the Secretary under this section shall be made subject to such terms, limitations, or conditions as may be mutually agreed to by the borrower concerned and the Secretary in the agreement described in this subsection, except that the amount paid by the Secretary under this section may not exceed—</text> 
<clause id="HDFB2F59358BA4DC7BFB9438910B2F01F"><enum>(i)</enum><text>$6,000 for any borrower in any calendar year; or</text></clause> 
<clause id="H7AD2DD67F08B4F1EBEDD2DBA9B672011"><enum>(ii)</enum><text>a total of $40,000 in the case of any borrower.</text></clause></subparagraph> 
<subparagraph id="H2194825D29B040EEA800ADF22474AA41"><enum>(B)</enum><header>Beginning of payments</header><text>Nothing in this section shall be construed to authorize the Secretary to pay any amount to reimburse a borrower for any repayments made by such borrower prior to the date on which the Secretary entered into an agreement with the employee under this subsection.</text></subparagraph></paragraph></subsection> 
<subsection id="H18C90563FB3E42FC94D0CC5593742B93"><enum>(e)</enum><header>Additional agreements</header><text>On completion of the required period of service under such an agreement, the borrower concerned and the Secretary may enter into an additional agreement described in subsection (d) for a successive period of service specified in the agreement (which may be less than 3 years).</text></subsection> 
<subsection id="H7AFEBF4BC7A3439AA1E16CDF3827BF52"><enum>(f)</enum><header>Award basis; priority</header> 
<paragraph id="H08BD07300A39413A8110E1F22374BFA2"><enum>(1)</enum><header>Award basis</header><text>The Secretary shall provide repayment benefits under this section on a first-come, first-served basis (subject to paragraph (2)) and subject to the availability of appropriations.</text></paragraph> 
<paragraph id="HFE047DBD647D4AC886F06890EFCB0423"><enum>(2)</enum><header>Priority</header><text>The Secretary shall give priority in providing repayment benefits under this section for a fiscal year to a borrower who—</text> 
<subparagraph id="H1DC8F349491342BE0000B700C7DCB71"><enum>(A)</enum><text>received repayment benefits under this section for the preceding fiscal year; and</text></subparagraph> 
<subparagraph id="HE44999895EF24DA991C104FEAD9400F3"><enum>(B)</enum><text>has completed less than 3 years of the first required period of service specified for the borrower in an agreement entered into under subsection (d).</text></subparagraph></paragraph></subsection> 
<subsection id="HB51E6975397745C89229005418A900EB"><enum>(g)</enum><header>Regulations</header><text>The Secretary is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="HF3E923B2ADA847C3B44076455223DCDE"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for fiscal year 2006 and such sums as may be necessary for each succeeding fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDBBC7D371F234F8E8B1600C5C7B264FB"><enum>(b)</enum><header>Cancellation of loans</header> 
<paragraph id="HEBEF7AB632824E5C9CF25E44A2AD3400"><enum>(1)</enum><header>Amendment</header><text>Section 465(a)(2)(F) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ee">20 U.S.C. 1087ee(a)(2)(F)</external-xref>) is amended by inserting <quote>, as a public defender (as defined in section 428L), or as a full time Federal defender attorney employed in a defender organization established pursuant to subsection (g) of <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> of title 18, United States Code</quote> after <quote>agencies</quote>.</text></paragraph> 
<paragraph id="H750F26CE1E2D4EF594C4C0279E8B56E6"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to—</text> 
<subparagraph id="HB8A2428EF951460E9B7F5FBB16A29510"><enum>(A)</enum><text>eligible loans made before, on, or after the date of enactment of this Act; and</text></subparagraph> 
<subparagraph id="H55B79ADF56F642A580FB97EE7F964789"><enum>(B)</enum><text>service as a prosecutor or public defender that is provided on or after the date of enactment of this Act.</text></subparagraph></paragraph> 
<paragraph id="HC47FE449147B4FA283B79FDD5623E8B5"><enum>(3)</enum><header>Construction</header><text>Nothing in this subsection or the amendment made by this subsection shall be construed to authorize the Secretary to pay any amount to reimburse a borrower for any repayments made by such borrower prior to the date on which the borrower became eligible for cancellation under section 465(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ee">20 U.S.C. 1087ee(a)</external-xref>).</text></paragraph></subsection></section>
