<official-title>To provide for the fair and efficient judicial consideration of personal injury and wrongful death claims arising out of asbestos or silica exposure, to ensure that individuals who suffer impairment, now or in the future, from illnesses caused by exposure to asbestos or silica receive compensation for their injuries, and for other purposes.</official-title>

<subsection id="H8CE4A3EE0E3F45D6B93246E1FE713B23"><enum>(a)</enum><header>Findings</header><text>The Congress finds that—</text> 
<paragraph id="H38CEA411367E41758F8F74008C1E7816"><enum>(1)</enum><text>asbestos is a mineral that was widely used prior to the 1980s for insulation, fireproofing, and other purposes;</text></paragraph> 
<paragraph id="H68D90928F3524F6598AF45A61DB106C5"><enum>(2)</enum><text>millions of American workers and others were exposed to asbestos, especially during and after World War II and prior to the advent of regulation by the Occupational Safety and Health Administration in the early 1970s;</text></paragraph> 
<paragraph id="HC59E24FC8BF543D38D3DC8472BC70015"><enum>(3)</enum><text>long-term exposure to asbestos has been associated with various types of cancer, including mesothelioma and lung cancer, as well as such nonmalignant conditions as asbestosis, pleural plaques, and diffuse pleural thickening;</text></paragraph> 
<paragraph id="H17F26716B88E4547BF7DE10729F18266"><enum>(4)</enum><text>the diseases caused by asbestos often have long latency periods;</text></paragraph> 
<paragraph id="H350ADC7637064956A57D8E87BF18D8D0"><enum>(5)</enum><text>although the use of asbestos has dramatically declined since 1980 and workplace exposures have been regulated since 1971 by the Occupational Safety &amp; Health Administration, past exposures will continue to result in significant claims of death and disability as a result of such exposure;</text></paragraph> 
<paragraph id="HC216DEBA73674F1200EDFBE91844AFF2"><enum>(6)</enum><text>exposure to asbestos has created a flood of litigation in State and Federal courts that the United States Supreme Court has characterized as <quote>an elephantine mass</quote> of cases that <quote>defies customary judicial administration and calls for national legislation,</quote> Ortiz v. Fibreboard Corporation, 119 S. Ct. 2295, 2302 (1999);</text></paragraph> 
<paragraph id="H3D7FC0F6342F4635B9EF4CBE308084"><enum>(7)</enum><text>asbestos personal injury litigation can be unfair and inefficient, imposing a severe burden on litigants and taxpayers alike;</text></paragraph> 
<paragraph id="H1153F8A53BBD41E78335B0BE597C2F12"><enum>(8)</enum><text display-inline="yes-display-inline">the extraordinary volume of nonmalignant asbestos cases continues to strain State and Federal courts, with a significant number of new cases filed each year;</text></paragraph> 
<paragraph id="H3AFBB94A67B54473BB2C3D622BCDBCA"><enum>(9)</enum><text>asbestos personal injury litigation has already contributed to the bankruptcy of more than 70 companies, including nearly all manufacturers of asbestos textile and insulation products, and the rate of asbestos-driven bankruptcies is accelerating;</text></paragraph> 
<paragraph id="HE69FE463EEA5411491EF94A995398C80"><enum>(10)</enum><text>the vast majority of asbestos claims are filed by individuals who allege they have been exposed to asbestos and who may have some physical sign of exposure, but who suffer no present asbestos-related impairment;</text></paragraph> 
<paragraph id="H15A390F5294D43C4970010CF12BB52F7"><enum>(11)</enum><text>the cost of compensating exposed individuals who are not sick jeopardizes the ability of defendants to compensate people with cancer and other serious asbestos-related diseases, now and in the future; threatens the savings, retirement benefits, and jobs of defendants’ current and retired employees; adversely affects the communities in which these defendants operate; and impairs the national economy and interstate commerce;</text></paragraph> 
<paragraph id="HAF7B5C5284924906BDE8D282609EA26D"><enum>(12)</enum><text>the several thousand asbestos-related cancer cases that are filed each year are manageable by the courts and the litigants;</text></paragraph> 
<paragraph id="H9017F424E0B3486BBF9796BB6FCDD37D"><enum>(13)</enum><text display-inline="yes-display-inline">silica is a naturally occurring mineral with the Earth’s crust consisting of over 90 percent silica, and crystalline silica dust is the primary component of sand, quartz, and granite; </text></paragraph> 
<paragraph id="HB8006AF5812E4323A57800050868DBCA"><enum>(14)</enum><text display-inline="yes-display-inline">silicosis was recognized as an occupational disease many years ago, and by the 1930s, the Federal Government launched a silica awareness campaign, which led to greater protection for workers exposed to silica resulting in a predictable number of silica claims; </text></paragraph> 
<paragraph id="H67C3C72C97B14FB5876CE0D4D69D4662"><enum>(15)</enum><text>in recent years, however, the number of new lawsuits alleging silica disease being filed each year began to rise precipitously;</text></paragraph> 
<paragraph id="H3AFC905E95844EB8980439E0D68004D6"><enum>(16)</enum><text>like asbestos claims, silica claims often arise when an exposed person is identified as having markings on his or her lungs that are possibly consistent with silica exposure, but the exposed person has no functional or physical impairment from silica;</text></paragraph> 
<paragraph id="HEE0E1A3552174C6B9CD407ED9534E243"><enum>(17)</enum><text>therefore, it is necessary to address silica litigation to avoid an asbestos-like litigation crisis;</text></paragraph> 
<paragraph id="H3DDF31B3FD1B4FC5AAE49CA37687A821"><enum>(18)</enum><text>concerns about statutes of limitations can force claimants who have been exposed to asbestos or silica, but who have no current injury, to bring premature lawsuits in order to protect against losing their rights to future compensation should they become impaired;</text></paragraph> 
<paragraph id="HA88DF89B4752437D002835A900EC2C47"><enum>(19)</enum><text>consolidations, joinder, and similar procedures, to which some courts have resorted in order to deal with the mass of asbestos and silica cases, can undermine the appropriate functioning of the judicial process and encourage the filing of thousands of cases by exposed individuals who are not yet sick and who may never become sick;</text></paragraph> 
<paragraph id="H067496C6C17A4B528EC611371C72601F"><enum>(20)</enum><text>similarly, the availability of sympathetic forums in States with no connection to the plaintiff or to the exposures that form the basis of the lawsuit has encouraged the filing of thousands of cases on behalf of exposed individuals who are not yet sick and may never become sick;</text></paragraph> 
<paragraph id="HFB80745220644577A900E59412ED3005"><enum>(21)</enum><text>excessive, unpredictable, and often arbitrary damage awards and unfair allocations of liability jeopardize the financial well-being of many individuals, businesses, and entire industries, particularly the Nation’s small businesses;</text></paragraph> 
<paragraph id="HBD0F8B460ABD48D1B5A67C002FA56372"><enum>(22)</enum><text>punitive damage awards unfairly divert the resources of defendants from compensating genuinely impaired claimants and, given the lengthy history of asbestos and silica litigation and the regulatory restrictions on the use of asbestos-containing products in the workplace, the legal justification for such awards—punishment and deterrence—is either inapplicable or inappropriate; and</text></paragraph> 
<paragraph id="HE61F3E3F895A4CE5903700001CFC51C8"><enum>(23)</enum><text>the public interest and the interest of interstate commerce requires deferring the claims of exposed individuals who are not sick in order to preserve, now and for the future, defendants’ ability to compensate people who develop cancer and other serious asbestos, or related, injuries and to safeguard the jobs, benefits, and savings of American workers and the well-being of the national economy.</text></paragraph></subsection> 
<subsection id="H7856B1D98FAC4EB5AE8C07F3DDFADD14"><enum>(b)</enum><header>Purposes</header><text>It is the purpose of this Act to—</text> 
<paragraph id="HC3079E7834754DF691EF7BCD5B7D2DF0"><enum>(1)</enum><text>give priority to those asbestos or silica claimants who can demonstrate actual physical harm or illness caused by exposure to asbestos or silica;</text></paragraph> 
<paragraph id="HE0EBEFB85E054871B5FDFEC237E79989"><enum>(2)</enum><text>fully preserve the rights of claimants who were exposed to asbestos or silica to pursue compensation should they become impaired in the future as a result of such exposure;</text></paragraph> 
<paragraph id="H8258CBB73F494E60844921009FCA3C31"><enum>(3)</enum><text>enhance the ability of the State and Federal judicial systems to supervise and control asbestos and silica litigation and asbestos-related bankruptcy proceedings; and</text></paragraph> 
<paragraph id="H6D37F668B8464EDDABEECCC09D034257"><enum>(4)</enum><text>conserve the scarce resources of the defendants, and marshal assets in bankruptcy, to allow compensation of cancer victims and others who are physically impaired by exposure to asbestos or silica while securing the right to similar compensation for those who may suffer physical impairment in the future.</text></paragraph></subsection></section> 
<section id="H44E901FFD0564DFD8D15D5BB105E0061"><enum>3.</enum><header>Physical impairment</header> 
<subsection id="H2F85935CCE2B41DBB3B65F26BD76D36"><enum>(a)</enum><header>Impairment essential element of claim</header><text>Physical impairment of the exposed person, to which asbestos or silica exposure was a substantial contributing factor, shall be an essential element of an asbestos or silica claim.</text></subsection> 
<subsection id="H68EFA42A4CC647EC8BDA5CE75F9304"><enum>(b)</enum><header>Prima facie evidence of physical impairment for nonmalignant asbestos claims</header><text>No person shall bring or maintain a civil action alleging a nonmalignant asbestos claim in the absence of a prima facie showing of physical impairment as a result of a medical condition to which exposure to asbestos was a substantial contributing factor. Such a prima facie showing shall include all of the following minimum requirements:</text> 
<paragraph id="HFF41AE13D07746CA85A5F2211439E141"><enum>(1)</enum><text>Evidence verifying that a qualified physician has taken a detailed occupational and exposure history of the exposed person or, if such person is deceased, from the person who is the most knowledgeable about the exposures that form the basis of the nonmalignant asbestos claim, including—</text> 
<subparagraph id="H7FD2A30682B341549265C617D32C6499"><enum>(A)</enum><text>all of the exposed person’s principal places of employment and exposures to airborne contaminants; and</text></subparagraph> 
<subparagraph id="HCC7EF208E5754A38AB7BD77CD1C87F85"><enum>(B)</enum><text>whether each place of employment involved exposures to airborne contaminants (including but not limited to asbestos fibers or other disease causing dusts) that can cause pulmonary impairment and the nature, duration, and level of any such exposure.</text></subparagraph></paragraph> 
<paragraph id="H53E0AA5CF2B6444AB183C29D289B747B"><enum>(2)</enum><text>Evidence verifying that a qualified physician has taken detailed medical and smoking history, including a thorough review of the exposed person’s past and present medical problems, and their most probable cause.</text></paragraph> 
<paragraph id="H8ABD74C64DC44E50A32C7424A8748034"><enum>(3)</enum><text>A determination by a qualified physician, on the basis of a medical examination and pulmonary function testing, that the exposed person has a permanent respiratory impairment rating of at least Class 2 as defined by and evaluated pursuant to the AMA Guides to the Evaluation of Permanent Impairment.</text></paragraph> 
<paragraph id="H0AA092A84FBD47718194751400C8C4A6"><enum>(4)</enum><text>A diagnosis by a qualified physician of asbestosis or diffuse pleural thickening, based at a minimum on radiological or pathological evidence of asbestosis or radiological evidence of diffuse pleural thickening.</text></paragraph> 
<paragraph id="H4EFC00B839744DADA80030F918EA4E85"><enum>(5)</enum><text>A determination by a qualified physician that asbestosis or diffuse pleural thickening (rather than solely chronic obstructive pulmonary disease) is a substantial contributing factor to the exposed person’s physical impairment, based at a minimum on a determination that the exposed person has—</text> 
<subparagraph id="H5061E424DA0B4FF1932DE53C100000BC"><enum>(A)</enum><text>total lung capacity, by plethysmography or timed gas dilution, below the predicted lower limit of normal; or</text></subparagraph> 
<subparagraph id="HD8E5D8BE35A34481006C607F22D06C70"><enum>(B)</enum><text>forced vital capacity below the lower limit of normal and a ratio of FEV1 to FVC that is equal to or greater than the predicted lower limit of normal; and</text></subparagraph> 
<subparagraph id="HDC2EFC0594A449CCADBB643911AA446D"><enum>(C)</enum><text>a chest x-ray showing small, irregular opacities (s,t,u) graded by a certified B-reader at least 2/1 on the ILO scale.</text></subparagraph></paragraph></subsection> 
<subsection id="H78F5CD24A1F14600B5AEB53E9A874B6"><enum>(c)</enum><header>Prima facie evidence of asbestos-related lung cancer</header><text>No person shall bring or maintain a civil action alleging an asbestos claim which is based upon lung cancer, in the absence of a prima facie showing which shall include the following minimum requirements:</text> 
<paragraph id="H3A7CC288D0C642A7B11BDF663450142B"><enum>(1)</enum><text>Diagnosis by a Board-certified pathologist, pulmonary specialist, or oncologist of a primary lung cancer and that exposure to asbestos was a substantial contributing factor to the lung cancer.</text></paragraph> 
<paragraph id="H91DF11AF3C9F4F899D23CED936D3DAB"><enum>(2)</enum><text>Evidence sufficient to demonstrate that at least 10 years have elapsed between the date of first exposure to asbestos and the date of diagnosis of the lung cancer.</text></paragraph> 
<paragraph id="H393BD1D80C634F7EBC615773ABB728B"><enum>(3)</enum><text>Depending on whether the exposed person has a history of smoking, the requirements of either (A) or (B) below—</text> 
<subparagraph id="HB96962210C374734B2A9B7ECF8965DB9"><enum>(A)</enum><text>in the case of an exposed person who is a nonsmoker, either—</text> 
<clause id="H03E6DAF758C146CA8FB72BD0E25B9635"><enum>(i)</enum><text>radiological or pathological evidence of asbestosis or radiological evidence of diffuse pleural thickening; or</text></clause> 
<clause id="H36662FD775474C13AB3FCC6DE38FE970"><enum>(ii)</enum><text display-inline="yes-display-inline">either—</text> 
<subclause id="H7CF93B4F38BF4307919086113CAED8D"><enum>(I)</enum><text>evidence of the exposed person’s substantial occupational exposure to asbestos; or</text></subclause> 
<subclause id="H652E5A0751E14F8FB5C4CDBB8644D75"><enum>(II)</enum><text>evidence of the exposed person’s exposure to asbestos at least equal to 25 fiber per cc years as determined to a reasonable degree of scientific probability by a scientifically valid retrospective exposure reconstruction conducted by a certified industrial hygienist or certified safety professional based upon all reasonably available quantitative air monitoring data and all other reasonably available information about the exposed person’s occupational history and history of exposure to asbestos; or</text></subclause></clause> </subparagraph> 
<subparagraph id="HE35C229A57B14F1986C700D3A5F9B2CA"><enum>(B)</enum><text>in the case of an exposed person who is a smoker, the criteria contained in both (A)(i) and (A)(ii) must be met.</text></subparagraph></paragraph></subsection> 
<subsection id="H5B739B43D11B4747981058743B177928"><enum>(d)</enum><header>Prima facie evidence of asbestos-related other cancer</header><text>No person shall bring or maintain a civil action alleging an asbestos claim which is based upon cancer of the colon, rectum, larynx, pharynx, esophagus, or stomach, in the absence of a prima facie showing which shall include the following minimum requirements:</text> 
<paragraph id="HE5E36E74F25A4C38AB7117A92F008F71"><enum>(1)</enum><text>A diagnosis by a Board-certified pathologist, Board-certified pulmonary specialist, or Board-certified oncologist (as appropriate for the type of cancer claimed) of primary cancer of the colon, rectum, larynx, pharynx, esophagus, or stomach, and that exposure to asbestos was a substantial contributing factor to the condition.</text></paragraph> 
<paragraph id="H5D2619111EF84A0B9983A38DABA8BD5"><enum>(2)</enum><text>Evidence sufficient to demonstrate that at least 10 years have elapsed between the date of first exposure to asbestos and the date of diagnosis of the cancer.</text></paragraph> 
<paragraph id="H195910CD8CDD400F908E253690EDD080"><enum>(3)</enum><text>The requirements of (A) and (B) below—</text> 
<subparagraph id="H94E4F7085D76417FBEC0F07BC7E8B540"><enum>(A)</enum><text>radiological or pathological evidence of asbestosis or radiological evidence of diffuse pleural thickening; and</text></subparagraph> 
<subparagraph id="HB3D4622D33EB42F49FC0208845E3278B"><enum>(B)</enum><text display-inline="yes-display-inline">either of the following:</text> 
<clause id="HD60CBBBA685F4B01ADA372451E193D29"><enum>(i)</enum><text>Evidence of the exposed person’s substantial occupational exposure to asbestos.</text></clause> 
<clause id="HF2087ADB3A6C4C02A3F2B5F22BFD9835"><enum>(ii)</enum><text>Evidence of the exposed person’s exposure to asbestos at least equal to 25 fiber per cc years as determined to a reasonable degree of scientific probability by a scientifically valid retrospective exposure reconstruction conducted by a certified industrial hygienist or certified safety professional based upon all reasonably available quantitative air monitoring data and all other reasonably available information about the exposed person’s occupational history and history of exposure to asbestos.</text></clause></subparagraph> </paragraph></subsection> 
<subsection id="HEF8C0D022509466F85502ED51C293432"><enum>(e)</enum><header>Prima facie requirement for mesothelioma</header><text display-inline="yes-display-inline">No person shall bring or maintain a civil action alleging an asbestos claim based upon mesothelioma, in the absence of a prima facie showing which shall include a diagnosis of malignant mesothelioma disease on the basis of findings by a qualified physician and credible evidence of identifiable exposure to asbestos resulting from—</text> 
<paragraph id="HE521729160A64866A32200E69FACC49B"><enum>(1)</enum><text>occupational exposure to asbestos;</text></paragraph> 
<paragraph id="H057E610B293A44AC852FE5E23FD991E"><enum>(2)</enum><text>exposure to asbestos fibers brought into the home of the claimant by a worker occupationally exposed to asbestos; or</text></paragraph> 
<paragraph id="H2162AF610417415E9DD8E514833ED87"><enum>(3)</enum><text>exposure to asbestos fibers resulting from living or working in the proximate vicinity of a factory, shipyard, building demolition site, or other operation that regularly released asbestos fibers into the air due to operations involving asbestos at that site.</text></paragraph></subsection> 
<subsection id="HCF143D5499A9410EB932335183D37372"><enum>(f)</enum><header>Prima facie evidence of physical impairment for nonmalignant silica claims</header><text display-inline="yes-display-inline">No person shall bring or maintain a civil action alleging a nonmalignant silica claim in the absence of a prima facie showing of physical impairment as a result of a medical condition to which exposure to silica was a substantial contributing factor. Such a prima facie showing shall include all of the following minimum requirements:</text> 
<paragraph id="HBFDE2FBB08C94459BFDF0359BDAFF6FE"><enum>(1)</enum><text>Evidence verifying that a qualified physician has taken a detailed occupational and exposure history of the exposed person or, if such person is deceased, from the person who is the most knowledgeable about the exposures that form the basis of the nonmalignant silica claim, including—</text> 
<subparagraph id="H23C85CC5DB7C4A7D00F31354A55584D0"><enum>(A)</enum><text>all of the exposed person’s principal places of employment and exposures to airborne contaminants; and</text></subparagraph> 
<subparagraph id="HFF3B4F619EB64982B5D043815DB830C7"><enum>(B)</enum><text>whether each place of employment involved exposures to airborne contaminants (including but not limited to silica or other disease causing dusts) that can cause pulmonary impairment and the nature, duration, and level of any such exposure.</text></subparagraph></paragraph> 
<paragraph id="H80C276DACFD94EB695013F47A4E91835"><enum>(2)</enum><text>Evidence verifying that a qualified physician has taken detailed medical and smoking history, including a thorough review of the exposed person’s past and present medical problems, and their most probable cause. </text></paragraph> 
<paragraph id="H1491FF2E76A34526BC37C347C4FDD5C"><enum>(3)</enum><text>A determination by a qualified physician, on the basis of a medical examination and pulmonary function testing, that the exposed person has both—</text> 
<subparagraph id="H10E5D6AD4EEC4AE6A4D93B5F9414867B"><enum>(A)</enum><text>a permanent respiratory impairment rating of at least Class 2 as defined by and evaluated pursuant to the AMA Guides to the Evaluation of Permanent Impairment; and</text></subparagraph> 
<subparagraph id="HADE06E9E810242EFB89618D26500BB10"><enum>(B)</enum><text>silicosis based at a minimum on radiological or pathological evidence of silicosis.</text></subparagraph></paragraph></subsection> 
<subsection id="H9B84DCEFD1D8448BA0D4A6D42C19D522"><enum>(g)</enum><header>Prima facie evidence of silica-related lung cancer</header><text>No person shall bring or maintain a civil action alleging an asbestos claim which is based upon lung cancer, in the absence of a prima facie showing which shall include the following minimum requirements:</text> 
<paragraph id="H4D58007B3BC6448CA8B873C40015E189"><enum>(1)</enum><text>Diagnosis by a Board-certified pathologist, pulmonary specialist, or oncologist of a primary lung cancer and that exposure to silica was a substantially contributing factor to the condition.</text></paragraph> 
<paragraph id="H742079AF75984EDFA5D902009BB470D7"><enum>(2)</enum><text>Evidence sufficient to demonstrate that at least 10 years have elapsed from the date of the exposed person’s first exposure to silica until the date of diagnosis of the exposed person’s primary lung cancer.</text></paragraph> 
<paragraph id="HD580D9D77D6B45C5AFCAC2DB001D6200"><enum>(3)</enum><text>Depending on whether the exposed person has a history of smoking, the requirements of either (A) or (B) below—</text> 
<subparagraph id="HAA4AD7F8571044E7ACCECA3676289190"><enum>(A)</enum><text>in the case of an exposed person who is a nonsmoker, either—</text> 
<clause id="H4E33ABCD96304DB09526C7EEAEEB7F79"><enum>(i)</enum><text>radiological or pathological evidence of silicosis; or </text></clause> 
<clause id="H71899A024BF243388EED9C5223BCDADD"><enum>(ii)</enum><text>evidence of the exposed person’s substantial occupational exposure to silica; or</text></clause></subparagraph> 
<subparagraph id="H811A9A3F9B1A4135BCDE6EA4EA6838D1"><enum>(B)</enum><text>in the case of an exposed person who is a smoker, the criteria contained in both (A)(i) and (A)(ii) must be met.</text></subparagraph></paragraph></subsection> 
<subsection id="H4183AB3664224D74841191CF48C16225"><enum>(h)</enum><header>Compliance with technical standards</header><text>Evidence relating to physical impairment under this section, including pulmonary function testing and diffusing studies, shall comply with the technical recommendations for examinations, testing procedures, quality assurance/quality control, and equipment of the AMA Guides to the Evaluation of Permanent Impairment. No adjustments with respect to pulmonary function testing shall be made on the basis of race.</text></subsection> 
<subsection id="HE09AD375430E4EE08B00A59D5E00E476"><enum>(i)</enum><header>No presumption at trial</header><text>Presentation of prima facie evidence meeting the requirements of subsection (b), (c), (d), (f), or (g) of this section shall not—</text> 
<paragraph id="H692FF1DB33C041848785816589AC6600"><enum>(1)</enum><text>result in any presumption at trial that the exposed person is impaired by an asbestos- or silica-related condition;</text></paragraph> 
<paragraph id="H3BD7BA2A868D48399102FCF3108E54AA"><enum>(2)</enum><text>be conclusive as to the liability of any defendant; and</text></paragraph> 
<paragraph id="H6FD975FA4AD34D83BD78D9D82E374881"><enum>(3)</enum><text>be admissible at trial.</text></paragraph></subsection></section> 
<section id="HA8AB8AC57A5F41239CE070E2333F41D8"><enum>4.</enum><header>Procedures</header> 
<subsection id="HA83698DE8C2D4E818871F2E6DB852507"><enum>(a)</enum><header>Consolidation</header><text>A court may consolidate for trial any number and type of asbestos or silica claims with consent of all the parties. In the absence of such consent, the court may consolidate for trial only asbestos or silica claims relating to the same exposed person and members of his or her household.</text></subsection> 
<subsection id="H76F678A8BEC14EBFBE0048ECF7970051"><enum>(b)</enum><header>Federal venue</header><text display-inline="yes-display-inline">The Federal district courts shall have original jurisdiction of any asbestos or silica claim. A civil action alleging an asbestos or silica claim may only be brought in the Federal district court of plaintiff’s domicile or where all, or a substantial part, including the most significant, exposure to asbestos or silica occurred, that is a substantial contributing factor to the physical impairment on which the claim is based. </text></subsection> 
<subsection id="H86DA446571154D4886E83F975752B4C7"><enum>(c)</enum><header>Preliminary proceedings</header><text>The plaintiff in any civil action alleging an asbestos or silica claim shall file together with the complaint or other initial pleading a written report and supporting test results constituting prima facie evidence of the exposed person’s asbestos- or silica-related impairment meeting the requirements of subsection (b), (c), (d), (f), or (g) of section 3. For any asbestos or silica claim pending on the effective date of this Act, the plaintiff shall file such a written report and supporting test results no later than 60 days following the effective date, or if trial is scheduled within 60 days of the effective date, no later than 30 days prior to trial. The defendant shall be afforded a reasonable opportunity to challenge the adequacy of the proffered prima facie evidence of asbestos- or silica-related impairment. The plaintiff’s claim shall be dismissed without prejudice upon a finding of failure to make the required prima facie showing.</text></subsection> 
<subsection id="H7BE7D50A6816476387278100EC2DCE13"><enum>(d)</enum><header>Burden of proof</header><text display-inline="yes-display-inline">The plaintiff in any civil action alleging an asbestos or silica claim shall have the following burden of proof:</text> 
<paragraph id="HE0C9B5EAE11B4335B3726126E6D58B4E"><enum>(1)</enum><text>The plaintiff must prove that the conduct of each defendant was a substantial contributing factor of the exposed person’s asbestos- or silica-related impairment.</text></paragraph> 
<paragraph id="H2AFB2EA199B143A780736C2F32373522"><enum>(2)</enum><text>The plaintiff must prove exposure to asbestos or silica that was manufactured, supplied, installed, or used by each defendant in the civil action and that the plaintiff’s exposure to each defendant’s asbestos or silica was a substantial factor in causing the asbestos- or silica-related impairment. In determining whether exposure to a particular defendant’s asbestos or silica was a substantial contributing factor in causing the asbestos- or silica-related impairment, the trier of fact in the civil action shall consider, without limitation, all of the following:</text> 
<subparagraph id="HBC5CA250507A429D9CFE2DB1C1A3F253"><enum>(A)</enum><text>The manner in which the plaintiff was exposed to defendant’s asbestos or silica.</text></subparagraph> 
<subparagraph id="HF0730F2E9EC74799B19010FC1C7369E6"><enum>(B)</enum><text>The proximity of the defendant’s asbestos or silica to the plaintiff when the exposure to the defendant’s asbestos or silica occurred.</text></subparagraph> 
<subparagraph id="H5DD2D3C5DE264ED28B22F2F7037E60DB"><enum>(C)</enum><text>The frequency and length of the plaintiff’s exposure to the defendant’s asbestos or silica.</text></subparagraph> 
<subparagraph id="H42D56ED6577C411AAC991368CEE06F5B"><enum>(D)</enum><text>Any factors that mitigated or enhanced the plaintiff’s exposure to asbestos or silica.</text></subparagraph></paragraph></subsection> </section> 
<section id="HF4855E330DE64D219DF1560092431802"><enum>5.</enum><header>Statute of limitations; two-disease rule</header> 
<subsection id="HE68C535CC26F4C5D9C84A2B9C56305D6"><enum>(a)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, with respect to any asbestos or silica claim not barred as of the effective date of this Act, the limitations period shall not begin to run until the exposed person discovers, or through the exercise of reasonable diligence should have discovered, that he or she is physically impaired by an asbestos- or silica-related condition.</text></subsection> 
<subsection id="HCBC709FF11C14E8F9CD8DB6BC8D49D"><enum>(b)</enum><header>Two-disease rule</header><text>An asbestos or silica claim arising out of a nonmalignant condition shall be a distinct cause of action from an asbestos or silica claim relating to the same exposed person arising out of asbestos- or silica-related cancer. No damages shall be awarded for fear or risk of cancer in any civil action asserting an asbestos or silica claim.</text></subsection> </section> 
<section id="H1A2F7432B5F6474EABC9F0C3715CFF00"><enum>6.</enum><header>Scope of liability; damages</header> 
<subsection id="H4ECEF2799B874D53A6C2D863775EFB00"><enum>(a)</enum><header>Proportional liability</header><text>A defendant against whom a final judgment is entered in a civil action alleging an asbestos or silica claim shall be liable only for that portion of the judgment that corresponds to the percentage of responsibility of such defendant. For the purposes of determining the percentage of responsibility of a defendant, the trier of fact shall determine that percentage as a percentage of the total fault of all persons (including the plaintiff and those who have filed for bankruptcy protection) who are responsible for the harm to the plaintiff, regardless of whether or not such person is a party to the action. The court shall render a separate judgment against each defendant in an amount determined pursuant to this subsection.</text></subsection> 
<subsection id="HB0F6846243E047769CB0B35321726400"><enum>(b)</enum><header>Noneconomic loss</header><text>In any civil action alleging an asbestos or silica claim, the total amount of damages that may be awarded for noneconomic loss shall not exceed $250,000, regardless of the number of parties against whom the action is brought. However, in actions involving an asbestos or silica claim based upon mesothelioma, the total amount of damages that may be awarded for noneconomic loss shall not exceed $500,000.</text></subsection> 
<subsection id="HFD36DAD6FD5346FD99FA45A454802763"><enum>(c)</enum><header>Punitive damages</header><text>No punitive damages shall be awarded in any civil action alleging an asbestos or silica claim.</text></subsection> 
<subsection id="HB23A8808AE82494893F5EC2E0933FB77"><enum>(d)</enum><header>Collateral source payments</header><text display-inline="yes-display-inline">At the time a complaint is filed in a civil action alleging an asbestos or silica claim, the plaintiff must file a written report with the court that discloses the total amount of any collateral source payments received, including payments which the plaintiff will receive in the future, as a result of settlements or judgments based upon the same claim. For any asbestos or silica claim pending on the date of enactment of this Act, the plaintiff shall file such written report no later than 60 days after the date of enactment, or if trial is scheduled within 60 days of enactment, no later than 30 days prior to trial. Further, the plaintiff shall be required to update this report on a regular basis during the course of the proceeding until a final judgment is entered in the case. The court shall ensure that the information contained in the initial and updated reports is treated as privileged and confidential and that the contents of the written reports shall not be disclosed to anyone except the other parties to the action. The amount of an award otherwise available to an asbestos or silica plaintiff shall be reduced by the amount of collateral source compensation disclosed pursuant to this section.</text></subsection></section> 
<section id="HE156C50668F94AD795F23154AA3D176"><enum>7.</enum><header>Liability rules applicable to product sellers, renters, lessors, and premises owners</header> 
<subsection id="HBCD6BF2D69DB4B28B2C21D5B8DD3E62"><enum>(a)</enum> 
<paragraph display-inline="yes-display-inline" id="H32DECF43C41F4333B8BBFEBDC3A6BF7"><enum>(1)</enum><header>In General</header><text>In any civil action alleging an asbestos or silica claim, a product seller other than a manufacturer shall be liable to a plaintiff only if the plaintiff establishes that—</text> 
<subparagraph indent="up1" id="H976C2099AF02479EAF871777179FB8C4"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="H16E9820157A8482E89FAE84064007DE3"><enum>(i)</enum><text>the product that allegedly caused the harm that is the subject of the complaint was sold, rented, or leased by the product seller;</text></clause> 
<clause indent="up1" id="H90E0A90A7EEE435591419F2BA377A8A2"><enum>(ii)</enum><text>the product seller failed to exercise reasonable care with respect to the product; and</text></clause> 
<clause indent="up1" id="H074ACF525BD24D9080D5006CBBDBA2AC"><enum>(iii)</enum><text>the failure to exercise reasonable care was a proximate cause of the harm to the exposed person;</text></clause></subparagraph> 
<subparagraph indent="up1" id="HFF89F31F42F54D4A944FC53576549169"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="H5A9AD17B2D2D41D79BBCE0F43EE43DAE"><enum>(i)</enum><text>the product seller made an express warranty applicable to the product that allegedly caused the harm that is the subject of the complaint, independent of any express warranty made by the manufacturer as to the same product;</text></clause> 
<clause indent="up1" id="H47A6425C73DA457AAE12842C8FB9F725"><enum>(ii)</enum><text>the product failed to conform to the warranty; and</text></clause> 
<clause indent="up1" id="H48D93BEEB80B48669594E015D1065705"><enum>(iii)</enum><text>the failure of the product to conform to the warranty caused the harm to the exposed person; or</text></clause></subparagraph> 
<subparagraph indent="up1" id="HA863C188022644ACA4E72C47BC82FA68"><enum>(C)</enum> 
<clause display-inline="yes-display-inline" id="H4CE4999493054EA7A6764DADF083F01"><enum>(i)</enum><text>the product seller engaged in intentional wrongdoing, as determined under applicable State law; and</text></clause> 
<clause indent="up1" id="HF651C47C8AC644B1B67288BB9367F05C"><enum>(ii)</enum><text>the intentional wrongdoing caused the harm that is the subject of the complaint.</text></clause></subparagraph></paragraph> 
<paragraph id="HB5E62BE6FD6B4CDF885030D3DB55D7C4" indent="up1"><enum>(2)</enum><header>Reasonable opportunity for inspection</header><text>For the purposes of paragraph (1)(A)(i), a product seller shall not be considered to have failed to exercise reasonable care with respect to a product based upon an alleged failure to inspect the product, if—</text> 
<subparagraph id="HF6E4EA737072463CA5648172FA9C52F8"><enum>(A)</enum><text>the failure occurred because there was no reasonable opportunity to inspect the product; or</text></subparagraph> 
<subparagraph id="H3A441290F687478285ED7EE9BC06CA00"><enum>(B)</enum><text>the inspection, in the exercise of reasonable care, would not have revealed the aspect of the product that allegedly caused the exposed person’s impairment.</text></subparagraph></paragraph></subsection> 
<subsection id="HA5FF07903C5F46BE88D69DA802DD374"><enum>(b)</enum><header>Rented or leased products</header><text>In any civil action alleging an asbestos or silica claim, a person engaged in the business of renting or leasing a product shall not be liable for the tortious act of another solely by reason of ownership of that product.</text></subsection> 
<subsection id="HEC471DD028CB42A6ACCEF0D4152C67D"><enum>(c)</enum><header>Premises owners</header><text display-inline="yes-display-inline">In any civil action alleging an asbestos or silica claim, a premises owner, or any entity performing any operations on a premises, is not liable to a plaintiff for asbestos or silica claims, unless that plaintiff’s alleged exposure occurred while the exposed person was at the premises.</text></subsection></section> 
<section id="HBD5CD10763324199B616F2F9EF00FE"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H84A5FAC36F2640E88FA4006200431434"><enum>(1)</enum><header>AMA Guides to the Evaluation of Permanent Impairment</header><text>The term <term>AMA Guides to the Evaluation of Permanent Impairment</term> means the American Medical Association’s Guides to the Evaluation of Permanent Impairment (Fifth Edition 2000) as may be modified from time to time by the American Medical Association.</text></paragraph> 
<paragraph id="H255620D070FF47D488C7E5C1760079FC"><enum>(2)</enum><header>Asbestos</header><text>The term <term>asbestos</term> includes all minerals defined as <term>asbestos</term> in 29 CFR 1910 as amended from time to time.</text></paragraph> 
<paragraph id="H1D743613F364492B93CA1E39DBA6AAD"><enum>(3)</enum><header>Asbestos claim</header><text>The term <term>asbestos claim</term> means any claim for damages or other relief presented in a civil action or bankruptcy proceeding, arising out of, based on, or related to the health effects of exposure to asbestos, including loss of consortium and any other derivative claim made by or on behalf of any exposed person or any representative, spouse, parent, child, or other relative of any exposed person. The term does not include claims for benefits under a workers’ compensation law or veterans’ benefits program, or claims brought by any person as a subrogee by virtue of the payment of benefits under a workers’ compensation law.</text></paragraph> 
<paragraph id="H16D40C4BA5F24804A61B670169F71403"><enum>(4)</enum><header>Asbestosis</header><text>The term <term>asbestosis</term> means bilateral diffuse interstitial fibrosis of the lungs caused by inhalation of asbestos fibers.</text></paragraph> 
<paragraph id="HAAEBF5EA9C3D4FB699C5ACAFCF8EA683"><enum>(5)</enum><header>Bankruptcy proceeding</header><text>The term <term>bankruptcy proceeding</term> means a case brought under title 11, United States Code, or any related proceeding as provided in <external-xref legal-doc="usc" parsable-cite="usc/28/157">section 157</external-xref> of title 28, United States Code.</text></paragraph> 
<paragraph id="HE1F4F249368D44E191E9D173EEECEB23"><enum>(6)</enum><header>Board-certified in internal medicine</header><text display-inline="yes-display-inline">The term <quote>Board-certified in internal medicine</quote> means a physician who is certified by the American Board of Internal Medicine or the American Osteopathic Board of Internal Medicine.</text></paragraph> 
<paragraph id="H41F3D941793C4299B95EA400450885CF"><enum>(7)</enum><header>Board-certified in occupational medicine</header><text>The term <quote>Board-certified in occupational medicine</quote> means a physician who is certified in the subspecialty of occupational medicine by the American Board of Preventive Medicine or the American Osteopathic Board of Preventive Medicine.</text></paragraph> 
<paragraph id="HE9D006DD101F4668BC7CE570BB6B0037"><enum>(8)</enum><header>Board-certified in oncology</header><text>The term <quote>Board-certified in oncology</quote> means a physician who is certified in the subspecialty of medical oncology by the American Board of Internal Medicine or the American Osteopathic Board of Internal Medicine.</text></paragraph> 
<paragraph id="H89ED3CE219CE4358ACDEE71983440440"><enum>(9)</enum><header>Board-certified in pathology</header><text>The term <quote>Board-certified in pathology</quote> means a physician who holds primary certification in anatomic pathology or clinical pathology from the American Board of Pathology or the American Osteopathic Board of Internal Medicine and whose professional practice—</text> 
<subparagraph id="H5CBEEF23AF22440FB4525985C3596D74"><enum>(A)</enum><text>is principally in the field of pathology; and</text></subparagraph> 
<subparagraph id="HEFB5BF86C7BC40A5A47DD815A86285CE"><enum>(B)</enum><text>involves regular evaluation of pathology materials obtained from surgical or postmortem specimens. </text></subparagraph></paragraph> 
<paragraph id="H250EB2C9611747ACB68BC894CAE2F68C"><enum>(10)</enum><header>Board-certified in pulmonary medicine</header><text>The term <quote>Board-certified in pulmonary medicine</quote> means a physician who is certified in the subspecialty of pulmonary medicine by the American Board of Internal Medicine or the American Osteopathic Board of Internal Medicine.</text></paragraph> 
<paragraph id="H97F84ED7E0224599882DDB47B23E5285"><enum>(11)</enum><header>Certified B-reader</header><text>The term <term>certified B-reader</term> means an individual qualified as a <quote>final</quote> or <quote>B-reader</quote> under 42 CFR 37.51(b) as amended.</text></paragraph> 
<paragraph id="HE83D04A4A07F496F9BCD4639C3961CEC"><enum>(12)</enum><header>Civil action</header><text>The term <term>civil action</term> means all suits or claims of a civil nature in State or Federal court, whether cognizable as cases at law or in equity or in admiralty, including an asbestos or silica claim in a bankruptcy proceeding. The term does not include an action relating to any workers’ compensation law, or a proceeding for benefits under any veterans’ benefits program.</text></paragraph> 
<paragraph id="H9E9087BAB19A4E658550AAF436A654DA"><enum>(13)</enum><header>Economic loss</header><text>The term <term>economic loss</term> means any pecuniary loss resulting from physical impairment, including the loss of earnings or other benefits related to employment, medical expense loss, replacement services loss, loss due to death, burial costs, and loss of business or employment opportunities.</text></paragraph> 
<paragraph id="HAF9B99F10E2E4038A5B405A16710411E"><enum>(14)</enum><header>Exposed person</header><text>The term <term>exposed person</term> means any person whose exposure to asbestos or silica or to asbestos- or silica-containing products which is the basis for an asbestos or silica claim.</text></paragraph> 
<paragraph id="H876345816C184CFCB33DCBE11DBA161"><enum>(15)</enum><header>Exposure years</header><text>The term <term>exposure years</term> means—</text> 
<subparagraph id="HEECEC068C0234BA1BAD7930012E3F76C"><enum>(A)</enum><text>each single year of exposure prior to 1972 will be counted as one year;</text></subparagraph> 
<subparagraph id="H93ACC9C8A167488AB609DF00F8750109"><enum>(B)</enum><text>each single year of exposure from 1972 through 1979 will be counted as one-half year; and</text></subparagraph> 
<subparagraph id="HB2A321A91184437800114BCA6055325C"><enum>(C)</enum><text>exposure after 1979 will not be counted, except that each year from 1972 forward for which the plaintiff can establish exposure exceeding the OSHA limit for 8-hour time-weighted average airborne concentration for a substantial portion of the year will count as one year.</text></subparagraph></paragraph>

<paragraph id="H1445F7576C984566A5258E8C9B6569AD"><enum>(21)</enum><header>Noneconomic loss</header><text>The term <term>noneconomic loss</term> means subjective, nonmonetary loss resulting from physical impairment, including pain, suffering, inconvenience, mental anguish, emotional distress, disfigurement, loss of society and companionship, loss of consortium, injury to reputation, or any other nonpecuniary loss of any kind or nature.</text></paragraph> 
<paragraph id="H5A85D4B206084B3EAE888279D14FB8E"><enum>(22)</enum><header>Nonmalignant condition</header><text>The term <term>nonmalignant condition</term> means any condition that is caused or may be caused by asbestos or silica other than a diagnosed cancer.</text></paragraph> 
<paragraph id="HE9730063CB774DF4943100E3432E01A8"><enum>(23)</enum><header>Nonsmoker</header><text display-inline="yes-display-inline">The term <term>nonsmoker</term> means the exposed person has not smoked cigarettes or used any other tobacco products within 15 years from the date the person was diagnosed with an asbestos- or silica-related disease.</text></paragraph> 
<paragraph id="H4DE542C2671C491E9CDEDF737EED839C"><enum>(24)</enum><header>Pathological evidence of asbestosis</header><text>The term <term>pathological evidence of asbestosis</term> means a statement by a Board-certified pathologist that more than one representative section of lung tissue uninvolved with any other disease process demonstrates a pattern of peribronchiolar or parenchymal scarring in the presence of characteristic asbestos bodies and that there is no other more likely explanation for the presence of the fibrosis.</text></paragraph> 
<paragraph id="H1595D6657A0D425D843EA35EB000B2EF"><enum>(25)</enum><header>Pathological evidence of silicosis</header><text display-inline="yes-display-inline">The term <quote>pathological evidence of silicosis</quote> means a statement by a Board-certified pathologist that more than one representative section of lung tissue uninvolved with any other disease process demonstrates a pattern of round silica nodules and birefringent crystals or other demonstration of crystal structures consistent with silica (well-organized concentric whorls of collagen surrounded by inflammatory cells) in the lung parenchyma and that there is no other more likely explanation for the presence of the fibrosis. </text></paragraph> 
<paragraph id="HA45617C424D84AC2A3D5740933EA9E7"><enum>(26)</enum><header>Predicted lower limit of normal</header><text>The term <term>predicted lower limit of normal</term> for any pulmonary function test means the calculated standard convention lying at the fifth percentile, below the upper 95 percent of the reference population based on age, height, and gender, according to the recommendations of the American Thoracic Society as referenced in the AMA Guides to the Evaluation of Permanent Impairment (5th Ed. 2000).</text></paragraph> 
<paragraph id="HCC5CC2D60D2A4CDBB8B568AA1513682"><enum>(27)</enum><header>Premises owner</header><text display-inline="yes-display-inline">The term <quote>premises owner</quote> means a person who owns, in whole or in part, leases, rents, maintains, or controls privately owned lands, ways or waters, or any buildings and structures on those lands, ways or waters, and all privately owned and State-owned lands, ways, or waters leased to a private person, firm, or organization, including any buildings and structures on those lands, ways or waters.</text></paragraph>

<subparagraph id="H51FA56AC74A74CB997DD4F9892BD07D2"><enum>(A)</enum><text>is a Board-certified internist, oncologist, pathologist, pulmonary specialist, radiologist, or specialist in occupational and environmental medicine;</text></subparagraph> 
<subparagraph id="HEB3574316B9F4745AA60644C53FCB88D"><enum>(B)</enum><text display-inline="yes-display-inline">has conducted a physical examination of the exposed person;</text></subparagraph> 
<subparagraph id="H7AFB0687EF0C45538DACDCFCD72538DF"><enum>(C)</enum><text display-inline="yes-display-inline">is actually treating or treated the exposed person, and has or had a doctor-patient relationship with such person at the time of the physical examination;</text></subparagraph> 
<subparagraph id="H4AF11D8F9CEF49DD8ECBFED6DB415CA9"><enum>(D)</enum><text display-inline="yes-display-inline">spends no more than 10 percent of his/her professional practice time, or rendered more than 40 diagnoses, whichever quantity is smaller, in providing consulting or expert services in connection with actual or potential civil actions, and whose medical group, professional corporation, clinic, or other affiliated group earns not more than 20 percent of their revenues from providing such services;</text></subparagraph> 
<subparagraph id="HA31795AF292C4711A35528AA0096E915"><enum>(E)</enum><text display-inline="yes-display-inline">is currently licensed to practice and actively practices in the State where the plaintiff resides or where the plaintiff’s civil action was filed or was licensed and practiced at the time of the physical examination;</text></subparagraph> 
<subparagraph id="H6F052B794582441A001488E0B1B7DD01"><enum>(F)</enum><text display-inline="yes-display-inline">receives or received payment for the treatment of the exposed person from that person’s health maintenance organization or other medical provider, or from the exposed person or from a member of the exposed person’s family; and</text></subparagraph> 
<subparagraph id="HAC6C77A5863B4E0CA79EAB6F3292202D"><enum>(G)</enum><text display-inline="yes-display-inline">a physician may not, as the basis for a diagnosis, rely, in whole or in part, on any of—</text> 
<clause id="H7D0D2B6EBBE74493A42258A55C561849"><enum>(i)</enum><text>the reports or opinions of any doctor, clinic, laboratory, or testing company that performed an examination, test, or screening of the exposed person’s medical condition in violation of any law, regulation, licensing requirement, or medical code of practice of the State in which the examination, test, or screening was conducted;</text></clause> 
<clause id="H14874B4850D04AD88F74E62F23A7474E"><enum>(ii)</enum><text>the reports or opinions of any doctor, clinic, laboratory, or testing company that performed an examination, test, or screening of the exposed person’s medical condition that was conducted without clearly establishing a doctor-patient relationship with the exposed person or medical person involved in the examination, test, or screening process; or</text></clause> 
<clause id="H4FBE9DB66626419E95706470E077F1E5"><enum>(iii)</enum><text>the reports or opinions of any doctor, clinic, laboratory, or testing company that performed an examination, test, or screening of the exposed person’s medical condition that required the exposed person to agree to retain the legal service of the law firm sponsoring the examination, test, or screening.</text></clause></subparagraph></paragraph> 
<paragraph id="H29175B0AE5E9474987140301A871A8DC"><enum>(31)</enum><header>Radiological evidence of asbestosis</header><text display-inline="yes-display-inline">The term <term>radiological evidence of asbestosis</term> means a quality 1 chest x-ray under the ILO system of classification (in a death case where no pathology is available, the necessary radiological findings may be made with a quality 2 film, if a quality 1 film is not available) showing small, irregular opacities (s,t,u) graded by a certified B-reader as at least 1/1 on the ILO scale.</text></paragraph> 
<paragraph id="H0DE429B8C08B4403A6D19E9D09BC96A4"><enum>(32)</enum><header>Radiological evidence of diffuse pleural thickening</header><text display-inline="yes-display-inline">The term <term>radiological evidence of diffuse pleural thickening</term> means a quality 1 chest x-ray under the ILO system of classification (in a death case where no pathology is available, the necessary radiological findings may be made with a quality 2 film, if a quality 1 film is not available) showing bilateral pleural thickening of at least B2 on the ILO scale and blunting of at least one costophrenic angle.</text></paragraph> 
<paragraph id="H3B5FE83BFD984DDE9E1BD1AC5BC5D7B8"><enum>(33)</enum><header>Radiological evidence of silicosis</header><text display-inline="yes-display-inline">The term <quote>radiological evidence of silicosis</quote> means a chest x-ray showing bilateral rounded or irregular opacities (p, q, or r) in the upper lung fields graded by a certified B-reader as at least 1/1 on the ILO scale.</text></paragraph> 
<paragraph id="H7393078035954C3B91DFAF45C8D6B4BD"><enum>(34)</enum><header>Silica</header><text>The terms <quote>silica</quote> means a respirable crystalline form of silicon dioxide, including, but not limited to, alpha, quartz, cristobalite, and trydmite.</text></paragraph> 
<paragraph id="H91F089C4B1584C15A6BCE89DCBBEF8D9"><enum>(35)</enum><header>Silica claim</header><text>The term <quote>silica claim</quote> means any claim for damages or other relief presented in a civil action or bankruptcy proceeding, arising out of, based on, or related to the health effects of exposure to silica, including loss of consortium and any other derivative claim made by or on behalf of any exposed person or any representative, spouse, parent, child, or other relative of any exposed person. The term does not include claims for benefits under a workers’ compensation law or veterans’ benefits program, or claims brought by any person as a subrogee by virtue of the payment of benefits under a workers’ compensation law.</text></paragraph> 
<paragraph id="H3ABA029FCD75496BA40070E8E17E07E6"><enum>(36)</enum><header>Silicosis</header><text>The term <quote>silicosis</quote> means nodular interstitial fibrosis of the lungs caused by inhalation of silica.</text></paragraph> 
<paragraph id="H82FEA6460B1241A7A738D5DD80EA07E7"><enum>(37)</enum><header>Smoker</header><text display-inline="yes-display-inline">The term <term>smoker</term> means a person who has smoked cigarettes or used other tobacco products within 15 years from the date the person was diagnosed with an asbestos, silica, or mixed-dust related disease.</text></paragraph> 
<paragraph id="HCD02B0A34FF44E50AB9F18C508A44947"><enum>(38)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, Commonwealth of Puerto Rico, the Northern Mariana Islands, the Virgin Islands, Guam, American Samoa, and any other territory or possession of the United States or any political subdivision of any of the foregoing.</text></paragraph> 
<paragraph id="HA0E5429658E0474F8DC4E738B3770697"><enum>(39)</enum><header>Substantial contributing factor</header><text>The term <term>substantial contributing factor</term> means—</text> 
<subparagraph id="H55B0326402C642DC9BE952B73DA95F54"><enum>(A)</enum><text>exposure to asbestos or silica is the predominate cause of the physical impairment alleged in the asbestos or silica claim;</text></subparagraph> 
<subparagraph id="H2427FA65D35241B1BE8EADBDD4990F6"><enum>(B)</enum><text>the exposure to asbestos or silica took place on a regular basis over an extended period of time and in close proximity to the exposed person; and</text></subparagraph> 
<subparagraph id="H4AF6A32DDDD9473CBA1CDCD460A9343D"><enum>(C)</enum><text>a qualified physician has determined with a reasonable degree of medical certainty that the physical impairment of the exposed person would not have occurred but for the asbestos or silica exposures.</text></subparagraph></paragraph> 
<paragraph id="H3F5280FCC286433F8CD7D3DC61912F6D"><enum>(40)</enum><header>Substantial occupational exposure to asbestos</header><text display-inline="yes-display-inline">The term <quote>substantial occupational exposure to asbestos</quote> means employment for a cumulative period of at least ten years in an industry and an occupation in which, for a substantial portion of a normal work year for that occupation, the exposed person did any of the following:</text> 
<subparagraph id="H1448267EEF6D4CD9A11574A3555753A3"><enum>(A)</enum><text>Handled raw asbestos fibers.</text></subparagraph> 
<subparagraph id="H1C9320EC47F84CF3845B09AB71CDE5E2"><enum>(B)</enum><text>Fabricated asbestos-containing products so that the person was exposed to raw asbestos fibers in the fabrication process.</text></subparagraph> 
<subparagraph id="HF85B36BF015F41558D09D4AD9314AAC5"><enum>(C)</enum><text>Altered, repaired, or otherwise worked with an asbestos-containing product in a manner that exposed the person on a regular basis to asbestos fibers.</text></subparagraph> 
<subparagraph id="H704C5DCB529F4CA8A48544A0F35F8DB4"><enum>(D)</enum><text>Worked in close proximity to other workers engaged in any of the activities described herein in a manner that exposed the person on a regular basis to asbestos fibers.</text></subparagraph></paragraph> 
<paragraph id="H8543DDCEF1CC4169982614013B8054BD"><enum>(41)</enum><header>Total lung capacity</header><text>The term <quote>total lung capacity</quote> means the volume of air in the lungs after a maximal inspiration as measured by either plethysmography or time gas dilution techniques.</text></paragraph> 
<paragraph id="HD6B397ABE2144359AB8778C5574B7ED4"><enum>(42)</enum><header>Veterans’ benefits program</header><text>The term <term>veterans’ benefits program</term> means any program for benefits in connection with military service administered by the Veterans’ Administration under title 38, United States Code.</text></paragraph> 
<paragraph id="H7B15A824DE674B619C88D9D22FFD466C"><enum>(43)</enum><header>Workers’ compensation law</header><text>The term <term>workers’ compensation law</term> means a law respecting a program administered by a State or the United States to provide benefits, funded by a responsible employer or its insurance carrier, for occupational diseases or injuries or for disability or death caused by occupational diseases or injuries. The term includes the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/901">33 U.S.C. 901–944</external-xref>, 948–950), and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code (known as the Federal Employees Compensation Act), but does not include the Act of April 22, 1908 (<external-xref legal-doc="usc" parsable-cite="usc/45/51">45 U.S.C. 51 et seq.</external-xref>) (popularly referred to as the <quote>Federal Employers’ Liability Act</quote>).</text></paragraph></section> 
<section id="H1463D630A04D485B97C6CE815FC7438D"><enum>9.</enum><header>Miscellaneous provisions</header> 
<subsection id="H7537B17F749A4E15BD86001886747597"><enum>(a)</enum><header>Construction with other laws</header><text>This Act shall not be construed to affect the scope or operation of any workers’ compensation law or veterans’ benefit program, to affect the exclusive remedy or subrogation provisions of any such law, or to authorize any lawsuit which is barred by any such provision of law.</text></subsection> 
<subsection id="H5D3DFB20161840139DB44F54460D49E"><enum>(b)</enum><header>Constitutional authority</header><text>The Constitutional authority for this Act is contained in article I, section 8, clause 3 of the Constitution of the United States and in article III, section 1 of the Constitution of the United States.</text></subsection></section> 
<section id="HD5189AEB4CA44A34BE004E811135C3C6"><enum>10.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall be effective on the date of the enactment of this Act and apply to any civil action asserting an asbestos or silica claim in which final judgment has not been entered as of the date of the enactment of this Act.</text></section>
