<subsection id="HADDFDDACA96F4614A8636533CCCCB968"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Clean Air Planning Act of 2005</short-title></quote>.</text></subsection>

<subsection id="H6A35D2F7D3114606B6B02806ACFD79D"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="HB7401A8A19B64C1BB8425071BD90CC6F"><enum>(1)</enum><text>fossil fuel-fired electric generating facilities, consisting of facilities fueled by coal, fuel oil, and natural gas, produce nearly <fraction>2/3</fraction> of the electricity generated in the United States;</text></paragraph> 
<paragraph id="H2020D0D66BCE4850BE2E70293500925B"><enum>(2)</enum><text>fossil fuel-fired electric generating facilities produce approximately <fraction>2/3</fraction> of the total sulfur dioxide emissions, <fraction>1/3</fraction> of the total nitrogen oxides emissions, <fraction>1/3</fraction> of the total carbon dioxide emissions, and <fraction>1/3</fraction> of the total mercury emissions, in the United States;</text></paragraph> 
<paragraph id="H5CEA1CF7369C46D8951C91F4BCA9A2F8"><enum>(3)</enum>
<subparagraph id="H37B6D4FF39C543C4B880A3004D107DB4" display-inline="yes-display-inline"><enum>(A)</enum><text>many electric generating facilities have been exempt from the emission limitations applicable to new units based on the expectation that over time the units would be retired or updated with new pollution control equipment; but</text> </subparagraph>
<subparagraph indent="up1" id="H1D503A070D3541E4936FE7BAA828FB2D"><enum>(B)</enum><text>many of the exempted units continue to operate and emit pollutants at relatively high rates;</text></subparagraph></paragraph> 
<paragraph id="H9753E23CC927437783529D76B8DB4B80"><enum>(4)</enum><text>pollution from existing electric generating facilities can be reduced through adoption of modern technologies and practices;</text></paragraph> 
<paragraph id="HBEB8953D539641BC895784FDB66938D2"><enum>(5)</enum><text>the electric generating industry is being restructured with the objective of providing lower electricity rates and higher quality service to consumers;</text></paragraph> 
<paragraph id="HF23B308D004E41608E01A961885F706C"><enum>(6)</enum><text>the full benefits of competition will not be realized if the environmental impacts of generation of electricity are not uniformly internalized; and</text></paragraph> 
<paragraph id="H1FAE25AC54234054A3908F38021822CD"><enum>(7)</enum><text>the ability of owners of electric generating facilities to effectively plan for the future is impeded by the uncertainties surrounding future environmental regulatory requirements that are imposed inefficiently on a piecemeal basis.</text></paragraph></subsection> 
<subsection id="HD0E97E593AFE46E6B645759B4601D512"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H2444E63EA3F64927B1BB05B88D464133"><enum>(1)</enum><text>to protect and preserve the environment and safeguard public health by ensuring that substantial emission reductions are achieved at fossil fuel-fired electric generating facilities;</text></paragraph> 
<paragraph id="HD3C18906FE774234B431E858D3CBFD66"><enum>(2)</enum><text>to significantly reduce the quantities of mercury, carbon dioxide, sulfur dioxide, and nitrogen oxides that enter the environment as a result of the combustion of fossil fuels;</text></paragraph> 
<paragraph id="HA53A816FD77A4E86A525BAB976C437B8"><enum>(3)</enum><text>to encourage the development and use of renewable energy;</text></paragraph> 
<paragraph id="H3C90DA20E774416789CA709D57C2A812"><enum>(4)</enum><text>to internalize the cost of protecting the values of public health, air, land, and water quality in the context of a competitive market in electricity;</text></paragraph> 
<paragraph id="H730EA8A80874405F959CA3F62DDC4E74"><enum>(5)</enum><text>to ensure fair competition among participants in the competitive market in electricity that will result from fully restructuring the electric generating industry;</text></paragraph> 
<paragraph id="HC8CE6BAB5CD54E76AEB49F77E0C1E818"><enum>(6)</enum><text>to provide a period of environmental regulatory stability for owners and operators of electric generating facilities so as to promote improved management of existing assets and new capital investments; and</text></paragraph> 
<paragraph id="H0B599C46BEF444C7BCBE19472EDF01FC"><enum>(7)</enum><text>to achieve emission reductions from electric generating facilities in a cost-effective manner.</text></paragraph></subsection></section> 
<section id="HDB6C0B3C9CE1425F8851E6F031144939"><enum>3.</enum><header>Integrated air quality planning for the electric generating sector</header><text display-inline="no-display-inline">The <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HD83841DDCE764913BF7CC9978F3587E7"><enum>701.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H0C6C8AA825CA48EB8C243DF8EEE3B886"><enum>(1)</enum><header>Affected unit</header> 
<subparagraph id="HA734B40519B44FA9A2A4DFBCF22BE01E"><enum>(A)</enum><header>Mercury</header><text>The term <term>affected unit</term>, with respect to mercury, means a coal-fired electric generating facility (including a cogenerating facility) that—</text> 
<clause id="HE8ECC344B9C84CEF86846F6C8E8F0342"><enum>(i)</enum><text>has a nameplate capacity greater than 25 megawatts; and</text></clause> 
<clause id="H2462E98F2A2D4D1FA761D0E0424CD02"><enum>(ii)</enum><text>generates electricity for sale.</text></clause></subparagraph> 
<subparagraph id="HECAC42F227DE4FC19525B7BBD8539F1B"><enum>(B)</enum><header>Nitrogen oxides and carbon dioxide</header><text>The term <term>affected unit</term>, with respect to nitrogen oxides and carbon dioxide, means a fossil fuel-fired electric generating facility (including a cogenerating facility) that—</text> 
<clause id="H01A2582586E84C3C924558001DA6D5C6"><enum>(i)</enum><text>has a nameplate capacity greater than 25 megawatts; and</text></clause> 
<clause id="H2975456B53A9407B9FBD0300F9E3536D"><enum>(ii)</enum><text>generates electricity for sale.</text></clause></subparagraph> 
<subparagraph id="H99D838FE8B9E47B9958BF8F8BAFABB"><enum>(C)</enum><header>Sulfur dioxide</header><text>The term <term>affected unit</term>, with respect to sulfur dioxide, has the meaning given the term in section 402.</text></subparagraph></paragraph> 
<paragraph id="H0EB48A191F674D9A851F92D3B0184306"><enum>(2)</enum><header>Carbon dioxide allowance</header><text>The term <term>carbon dioxide allowance</term> means an authorization allocated by the Administrator under this title to emit 1 ton of carbon dioxide during or after a specified calendar year.</text></paragraph> 
<paragraph id="H9BFE39DC97044FE5BE6F216D64FD864"><enum>(3)</enum><header>Covered unit</header><text>The term <term>covered unit</term> means—</text> 
<subparagraph id="H36FF83F8C4BD472B98D5BC6678E159D6"><enum>(A)</enum><text>an affected unit;</text></subparagraph> 
<subparagraph id="HB196607A8FD944659ED0D490C4B831CA"><enum>(B)</enum><text>a nuclear generating unit with respect to incremental nuclear generation; and</text></subparagraph> 
<subparagraph id="H283BC8530A024BF79971F5D3C414A1FF"><enum>(C)</enum><text>a renewable energy unit.</text></subparagraph></paragraph> 
<paragraph id="HB377281D371044059306A454319C00"><enum>(4)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means—</text> 
<subparagraph id="HC4ED55D7CB024B078BE4D48FCD4C5D"><enum>(A)</enum><text>carbon dioxide;</text></subparagraph> 
<subparagraph id="H579BD309F83C4043997BB17D9D3FAC95"><enum>(B)</enum><text>methane;</text></subparagraph> 
<subparagraph id="H652A33F9399C438BB12FCC7DBB28E112"><enum>(C)</enum><text>nitrous oxide;</text></subparagraph> 
<subparagraph id="HABD6D790DBF740839B28D97849A14E09"><enum>(D)</enum><text>hydrofluorocarbons;</text></subparagraph> 
<subparagraph id="HC4E6BE6885D041A89695BF11B0D35690"><enum>(E)</enum><text>perfluorocarbons; and</text></subparagraph> 
<subparagraph id="HDEA2BFD2C1FB4F1F83BA38F789D924BF"><enum>(F)</enum><text>sulfur hexafluoride.</text></subparagraph></paragraph> 
<paragraph id="HBF8D1D470BD44394A7009919AB8067A7"><enum>(5)</enum><header>Incremental nuclear generation</header><text>The term <term>incremental nuclear generation</term> means the difference between—</text> 
<subparagraph id="H621E13C354DB433B0043D7CF82DA80D7"><enum>(A)</enum><text>the quantity of electricity generated by a nuclear generating unit in a calendar year; and</text></subparagraph> 
<subparagraph id="HE66B241E8B5F4D3DB23F61B6EB8C0047"><enum>(B)</enum><text>the quantity of electricity generated by the nuclear generating unit in calendar year 1990;</text></subparagraph><continuation-text continuation-text-level="paragraph">as determined by the Administrator and measured in megawatt hours.</continuation-text></paragraph> 
<paragraph id="H75AD99C6E7B24CB0864FF87C8B390025"><enum>(6)</enum><header>Mercury allowance</header><text>The term <term>mercury allowance</term> means an authorization allocated by the Administrator under this title to emit 1 pound of mercury during or after a specified calendar year.</text></paragraph> 
<paragraph id="H6D77D5AF272B48BA879E1EBAE5C6DD45"><enum>(7)</enum><header>New renewable energy unit</header><text>The term <term>new renewable energy unit</term> means a renewable energy unit that has operated for a period of not more than 3 years.</text></paragraph> 
<paragraph id="HC671587C2A0B4DF2B3048CBA6451F088"><enum>(8)</enum><header>New unit</header><text>The term <term>new unit</term> means an affected unit that has operated for not more than 3 years and is not eligible to receive—</text> 
<subparagraph id="H7D30668FC5C34C299D00B1C677EF3F8D"><enum>(A)</enum><text>sulfur dioxide allowances under section 417(b);</text></subparagraph> 
<subparagraph id="HEA603DF180A84CAF8BBC27007648FCD1"><enum>(B)</enum><text>nitrogen oxide allowances or mercury allowances under section 703(c)(2); or</text></subparagraph> 
<subparagraph id="H24D55C976B2C4475876D40877E4585BE"><enum>(C)</enum><text>carbon dioxide allowances under section 704(c)(2).</text></subparagraph></paragraph> 
<paragraph id="H54E9F701DC5D490E8929268CD6647990"><enum>(9)</enum><header>Nitrogen oxide allowance</header><text>The term <term>nitrogen oxide allowance</term> means an authorization allocated by the Administrator under this title to emit 1 ton of nitrogen oxides during or after a specified calendar year.</text></paragraph> 
<paragraph id="HCE2D9DA37BBB46ABBE113DEABC543006"><enum>(10)</enum><header>Nuclear generating unit</header><text>The term <term>nuclear generating unit</term> means an electric generating facility that—</text> 
<subparagraph id="H7CAF84D40E8147CE8DCCC9C8B6EC1780"><enum>(A)</enum><text>uses nuclear energy to supply electricity to the electric power grid; and</text></subparagraph> 
<subparagraph id="H7BFC43F6738C41EA907422A2169365A7"><enum>(B)</enum><text>commenced operation in calendar year 1990 or earlier.</text></subparagraph></paragraph> 
<paragraph id="H7453D1B41491448DB4F74C107B44F22F"><enum>(11)</enum><header>Renewable energy</header><text>The term <term>renewable energy</term> means electricity generated from—</text> 
<subparagraph id="H2EA5598459FE4D650074945F93EDC7DB"><enum>(A)</enum><text>wind;</text></subparagraph> 
<subparagraph id="HC112B99DF4B240EF840085C697CDED24"><enum>(B)</enum><text>organic waste (excluding incinerated municipal solid waste);</text></subparagraph> 
<subparagraph id="HB9A08D9745274C7FB0B5E421F0458633"><enum>(C)</enum><text>biomass (including anaerobic digestion from farm systems and landfill gas recovery);</text></subparagraph> 
<subparagraph id="H011E4A4FC3E54483A9AA8C3576AC51A6"><enum>(D)</enum><text>fuel cells; or</text></subparagraph> 
<subparagraph id="HB46880961EE44F268DCF32A0F809D0EA"><enum>(E)</enum><text>a hydroelectric, geothermal, solar thermal, photovoltaic, or other nonfossil fuel, nonnuclear source.</text></subparagraph></paragraph> 
<paragraph id="H555B839AE0E74F349F727CEC5DDC668"><enum>(12)</enum><header>Renewable energy unit</header><text>The term <term>renewable energy unit</term> means an electric generating facility that uses exclusively renewable energy to supply electricity to the electric power grid.</text></paragraph> 
<paragraph id="HBB6B590F713B4B9CAB8DBF5EDA1E8555"><enum>(13)</enum><header>Sequestration</header><text>The term <term>sequestration</term> means the action of sequestering carbon by—</text> 
<subparagraph id="H2A79D618CA684A8B92C92643C7B3CBD1"><enum>(A)</enum><text>enhancing a natural carbon sink (such as through afforestation); or</text></subparagraph> 
<subparagraph id="HB15929D2E6F2473683B3259124FAB877"><enum>(B)</enum><text>(i) capturing the carbon dioxide emitted from a fossil fuel-based energy system; and</text> 
<clause indent="up1" id="H0E6D5AA87C1A4FC0BB84B1D325FAC5C3"><enum>(ii)</enum><text>(I) storing the carbon in a geologic formation or in a deep area of an ocean; or</text> 
<subclause indent="up1" id="H36DA04E9C54A40C4BE6361D961AD7707"><enum>(II)</enum><text>converting the carbon to a benign solid material through a biological or chemical process.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H557A5485D26F4D628B25B36FBB2C9EFE"><enum>(14)</enum><header>Sulfur dioxide allowance</header><text>The term <term>sulfur dioxide allowance</term> has the meaning given the term <term>allowance</term> in section 402.</text></paragraph></section> 
<section id="H47D417BF12C740589E0953F45919FE85"><enum>702.</enum><header>National pollutant tonnage limitations</header> 
<subsection id="H25CF29B4A72E4EF68503B380E5BD6540"><enum>(a)</enum><header>Sulfur dioxide</header><text>The annual tonnage limitation for emissions of sulfur dioxide from affected units in the United States shall be equal to—</text> 
<paragraph id="H9345808169B24D90A32082EC55D2D5C"><enum>(1)</enum><text>for each of calendar years 2010 through 2013, 4,500,000 tons;</text></paragraph> 
<paragraph id="HA5E693407A0B4957BF665E32225D171E"><enum>(2)</enum><text>for each of calendar years 2014 through 2016, 3,500,000 tons; and</text></paragraph> 
<paragraph id="HED1F5AF16FCB42D0818B1FE1DAA5EAE8"><enum>(3)</enum><text>for calendar year 2017 and each calendar year thereafter, 2,250,000 tons.</text></paragraph></subsection> 
<subsection id="HB3EABA4B77D44091AB5442422B909888"><enum>(b)</enum><header>Nitrogen oxides</header><text>The annual tonnage limitation for emissions of nitrogen oxides from affected units in the United States shall be equal to—</text> 
<paragraph id="H437C03F35E2740C08340D5A0B76538A"><enum>(1)</enum><text>for each of calendar years 2009 through 2014, 1,870,000 tons; and</text></paragraph> 
<paragraph id="HD5AB37946E034708AD11BCB7BC498C9B"><enum>(2)</enum><text>for calendar year 2015 and each calendar year thereafter, 1,700,000 tons.</text></paragraph></subsection> 
<subsection id="HFB9D9B89BA24452F90F8D8124ED9944D"><enum>(c)</enum><header>Mercury</header> 
<paragraph id="HDF658EAAB6B543EF9B34D8EDB5D55B00"><enum>(1)</enum><header>In general</header><text>The annual tonnage limitation for emissions of mercury from affected units in the United States shall be equal to the following:</text> 
<subparagraph id="H95AB6E71D183493199EECE28C45F498"><enum>(A)</enum><text>For each of calendar years 2010 through 2014, 24 tons.</text></subparagraph> 
<subparagraph id="HB2D8E60DECAA4A5286182BE553DC9BD6"><enum>(B)</enum><text>For calendar year 2015 and each calendar year thereafter, 10 tons.</text></subparagraph></paragraph> 
<paragraph id="H4140FF4AB61D42369CD4B1FC00FC2765"><enum>(2)</enum><header>Maximum emissions of mercury from each affected unit</header> 
<subparagraph id="HA295A208AC1C42EDAF6109CECE582288"><enum>(A)</enum><header>Calendar years 2010 through 2014</header><text>For each of calendar years 2010 through 2014, the emissions of mercury from each affected unit shall not exceed either, at the option of the operator of the affected unit—</text> 
<clause id="HFBB994ADE27249F89F774642DE874E00"><enum>(i)</enum><text>50 percent of the total quantity of mercury present in the coal delivered to the affected unit in the calendar year; or</text></clause> 
<clause id="HBB601735325E488E93CA1857DC4905E5"><enum>(ii)</enum><text>an annual output-based emission rate for mercury that shall be determined by the Administrator based on an input-based rate of 4 pounds per trillion British thermal units.</text></clause></subparagraph> 
<subparagraph id="H9A6E38A4DAAA4EC5A82109C8009B53C"><enum>(B)</enum><header>Calendar year 2015 and thereafter</header><text>For calendar year 2015 and each calendar year thereafter, the emissions of mercury from each affected unit shall not exceed—</text> 
<clause id="H6219E9D91FDE475F885C8D5B325E9BE4"><enum>(i)</enum><text>30 percent of the total quantity of mercury present in the coal delivered to the affected unit in the calendar year; or</text></clause> 
<clause id="H34EC14DA24064DF78600D28E70851F9D"><enum>(ii)</enum><text>an annual output-based emission rate for mercury that shall be determined by the Administrator.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HC639C8C98C7742878F606CC3A6AE5900"><enum>(d)</enum><header>Carbon dioxide</header><text>Subject to section 704(d), the annual tonnage limitation for emissions of carbon dioxide from covered units in the United States shall be equal to—</text> 
<paragraph id="HD3958EE882F444BD8449A839A2AC00CB"><enum>(1)</enum><text>for each of calendar years 2010 through 2014, the quantity of emissions project to be emitted from affected units in calendar year 2006, as determined by the Energy Information Administration of the Department of Energy based on the projections of the Administration the publication of which most closely precedes the date of enactment of this title; and</text></paragraph> 
<paragraph id="H963BF1E4EECE419F9084CF037868FC2"><enum>(2)</enum><text>for calendar year 2015 and each calendar year thereafter, the quantity of emissions emitted from affected units in calendar year 2001, as determined by the Energy Information Administration of the Department of Energy.</text></paragraph></subsection> 
<subsection id="HD56ADDB438594A918C49BC2230C8D217"><enum>(e)</enum><header>Review of annual tonnage limitations</header> 
<paragraph id="H37970CBDE2514D68BD46CF38E113DCEA"><enum>(1)</enum><header>Period of effectiveness</header><text>The annual tonnage limitations established under subsections (a) through (d) shall remain in effect until the date that is 20 years after the date of enactment of this title.</text></paragraph> 
<paragraph id="H542E45008F214C959ED5CF76F21FDF00"><enum>(2)</enum><header>Determination by Administrator</header><text>Not later than 15 years after the date of enactment of this title, the Administrator, after considering impacts on human health, the environment, the economy, and costs, shall determine whether 1 or more of the annual tonnage limitations should be revised.</text></paragraph> 
<paragraph id="HEDC445BD54134FB8A516B13892B50092"><enum>(3)</enum><header>Determination not to revise</header><text>If the Administrator determines under paragraph (2) that none of the annual tonnage limitations should be revised, the Administrator shall publish in the Federal Register a notice of the determination and the reasons for the determination.</text></paragraph> 
<paragraph id="HB4658CC7721745E7BC2BB55EFB2166D0"><enum>(4)</enum><header>Determination to revise</header> 
<subparagraph id="HBE7C886D8F474DF7B3239875B4FEF841"><enum>(A)</enum><header>In general</header><text>If the Administrator determines under paragraph (2) that 1 or more of the annual tonnage limitations should be revised, the Administrator shall publish in the Federal Register—</text> 
<clause id="H5A4B708FA34A47A4B34FAF0010FA6873"><enum>(i)</enum><text>not later than 15 years and 180 days after the date of enactment of this title, proposed regulations implementing the revisions; and</text></clause> 
<clause id="H1F09FCC4F6A747A5B74DEB8E07858ED4"><enum>(ii)</enum><text>not later than 16 years and 180 days after the date of enactment of this title, final regulations implementing the revisions.</text></clause></subparagraph> 
<subparagraph id="HE0664320B7404189B744679133F2F53E"><enum>(B)</enum><header>Effective date of revisions</header><text>Any revisions to the annual tonnage limitations under subparagraph (A) shall take effect on the date that is 20 years after the date of enactment of this title.</text></subparagraph></paragraph></subsection> 
<subsection id="HC0598EFD9B854DAF9D93E468FB781353"><enum>(f)</enum><header>Reduction of emissions from specified affected units</header><text>Subject to the requirements of this Act concerning national ambient air quality standards established under part A of title I, notwithstanding the annual tonnage limitations established under this section, the Federal Government or a State government may require that emissions from a specified affected unit be reduced to address a local air quality problem.</text></subsection></section> 
<section id="H759BCD10E54C4F0EA1B6E02D9C17B7DC"><enum>703.</enum><header>Nitrogen oxide and mercury allowance trading programs</header> 
<subsection id="HF7E3B8227EAE46D38C4717D39ECB4CD5"><enum>(a)</enum><header>Regulations</header> 
<paragraph id="H023250501CBA4D1981CA1B3FCD30DA4C"><enum>(1)</enum><header>Promulgation</header> 
<subparagraph id="H20D7F045A4AA4433B982A8A9A1501B75"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after enactment of this section, the Administrator shall promulgate regulations to establish for affected units in the United States—</text> 
<clause id="H09135F648C3B4629907D26006169FF6B"><enum>(i)</enum><text>a nitrogen oxide allowance trading program; and</text></clause> 
<clause id="HBE4788398E704DC8AB00C47E41F14C76"><enum>(ii)</enum><text>a mercury allowance trading program.</text></clause></subparagraph> 
<subparagraph id="H6682103BE9724838BDD4DD58C5FDEEFF"><enum>(B)</enum><header>Requirements</header><text>Regulations promulgated under subparagraph (A) shall establish requirements for the allowance trading programs under this section, including requirements concerning—</text> 
<clause id="H72921023F1A74638B137BB2C00194B38"><enum>(i)</enum>
<subclause id="H273BDC15A1E94B3993E284A41C3972F3" display-inline="yes-display-inline"><enum>(I)</enum><text>the generation, allocation, issuance, recording, tracking, transfer, and use of nitrogen oxide allowances and mercury allowances; and</text> </subclause>
<subclause indent="up1" id="H5A666FE8621E491F8F3ED2B0E0F78CE5"><enum>(II)</enum><text>the public availability of all information concerning the activities described in subclause (I) that is not confidential;</text></subclause></clause> 
<clause id="H2B8D01EC201C461000374E52E387F68"><enum>(ii)</enum><text>compliance with subsection (e)(1);</text></clause> 
<clause id="HF14CB0D7508045F29091BD48DAEA34FE"><enum>(iii)</enum><text>the monitoring and reporting of emissions under paragraphs (2) and (3) of subsection (e); and</text></clause> 
<clause id="H00798F2C6E4A4B479C87FC2B1B789B48"><enum>(iv)</enum><text>excess emission penalties under subsection (e)(4).</text></clause></subparagraph></paragraph> 
<paragraph id="H2DCE6F9F9F1646CDA2DCF590797C2C69"><enum>(2)</enum><header>Mixed fuel, co-generation facilities and combined heat and power facilities</header><text>The Administrator shall promulgate such regulations as are necessary to ensure the equitable issuance of allowances to—</text> 
<subparagraph id="HE425A97616E34CBD86A18F61FD70AF3C"><enum>(A)</enum><text>facilities that use more than 1 energy source to produce electricity; and</text></subparagraph> 
<subparagraph id="H391AF9F11C6B4599BE97D2299D4CAF62"><enum>(B)</enum><text>facilities that produce electricity in addition to another service or product.</text></subparagraph></paragraph> 
<paragraph id="H8F83F4D58B614819AC8B76B900CB9185"><enum>(3)</enum><header>Report to Congress on use of captured or recovered mercury</header> 
<subparagraph id="H684C83ECE6E1438496ED4D2BA7D34790"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this title, the Administrator shall submit to Congress a report on the public health and environmental impacts from mercury that is or may be—</text> 
<clause id="H8FBC5AF93E234EB4BB004E1BD45CC1F3"><enum>(i)</enum><text>captured or recovered by air pollution control technology; and</text></clause> 
<clause id="H1712244C0D2648398F90EFBEDFA7728C"><enum>(ii)</enum><text>incorporated into products such as soil amendments and cement.</text></clause></subparagraph> 
<subparagraph id="H064565C60BC84676BD9DCDF9A833CFF7"><enum>(B)</enum><header>Required elements</header><text>The report shall—</text> 
<clause id="H2D990C53AB4B491EAB3E55E776ECA56F"><enum>(i)</enum><text>review—</text> 
<subclause id="H4F96429A76E849B4A7CAF8596366EEDF"><enum>(I)</enum><text>technologies, in use as of the date of the report, for incorporating mercury into products; and</text></subclause> 
<subclause id="H41AC995BFFE34F789F08B751F6F5B736"><enum>(II)</enum><text>potential technologies that might further minimize the release of mercury; and</text></subclause></clause> 
<clause id="HC55B720CF5984A0EB900E517D97D90F1"><enum>(ii)</enum>
<subclause id="HAAE6D566A289448D8EE168FDB938A3CB" display-inline="yes-display-inline"><enum>(I)</enum><text>address the adequacy of legal authorities and regulatory programs in effect as of the date of the report to protect public health and the environment from mercury in products described in subparagraph (A)(ii); and</text> </subclause>
<subclause indent="up1" id="H4DF7071CDCB34B57AFC9013F2DEAEF9B"><enum>(II)</enum><text>to the extent necessary, make recommendations to improve those authorities and programs.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HD0E2CAF3F3DD484800EFFA9DFFAB6CF6"><enum>(b)</enum><header>New unit reserves</header> 
<paragraph id="H1084D48A403F457591AB2500AD50CA79"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish by regulation a reserve of nitrogen oxide allowances and a reserve of mercury allowances to be set aside for use by new units.</text></paragraph> 
<paragraph id="H28D728865658405DB4252E3808D60839"><enum>(2)</enum><header>Determination of quantity</header><text>The Administrator, in consultation with the Secretary of Energy, shall determine, based on projections of electricity output for new units—</text> 
<subparagraph id="HDD865A0FF3CB4918873D4ECFC8F6AB2E"><enum>(A)</enum><text>not later than June 30, 2006, the quantity of nitrogen oxide allowances and mercury allowances required to be held in reserve for new units for each of calendar years 2009 through 2014; and</text></subparagraph> 
<subparagraph id="HE1EEDAFF047C471FBC6F40433E91CBAE"><enum>(B)</enum><text>not later than June 30 of each fifth calendar year thereafter, the quantity of nitrogen oxide allowances and mercury allowances required to be held in reserve for new units for the following 5-calendar year period.</text></subparagraph></paragraph></subsection> 
<subsection id="H37C9747942984FDC95B2CABD36585DE1"><enum>(c)</enum><header>Nitrogen oxide and mercury allowance allocations</header> 
<paragraph id="H6E6CAF177A884011B63C705156443CFB"><enum>(1)</enum><header>Timing of allocations</header><text>The Administrator shall allocate nitrogen oxide allowances and mercury allowances to affected units—</text> 
<subparagraph id="H5C16C5EF2547424994E354FACF07F5"><enum>(A)</enum><text>not later than December 31, 2006, for calendar year 2010; and</text></subparagraph> 
<subparagraph id="H200E1024F46A45DEBE03C41F16882E7D"><enum>(B)</enum><text>not later than December 31 of calendar year 2007 and each calendar year thereafter, for the fourth calendar year that begins after that December 31.</text></subparagraph></paragraph> 
<paragraph id="H20EE9AD0155D406FB5CB5238EBD594B8"><enum>(2)</enum><header>Allocations to affected units that are not new units</header> 
<subparagraph id="H1D61E86792264E4A8FAFD05C3F2F6BF7"><enum>(A)</enum><header>Quantity of nitrogen oxide allowances allocated</header><text>The Administrator shall allocate to each affected unit that is not a new unit a quantity of nitrogen oxide allowances that is equal to the product obtained by multiplying—</text> 
<clause id="HED7ED0E8406046BC8BAF25E7B3DA97F6"><enum>(i)</enum><text>1.5 pounds of nitrogen oxides per megawatt hour; and</text></clause> 
<clause id="H65C06824D7314C568B50382E54A8AA82"><enum>(ii)</enum><text>the quotient obtained by dividing—</text> 
<subclause id="HFDEF1CC17C644C13AEB9706C4E5739BB"><enum>(I)</enum><text>the average annual net quantity of electricity generated by the affected unit during the most recent 3-calendar year period for which data are available, measured in megawatt hours; by</text></subclause> 
<subclause id="H3DB6DF16E68F4D4193F45900298EAB39"><enum>(II)</enum><text>2,000 pounds of nitrogen oxides per ton.</text></subclause></clause></subparagraph> 
<subparagraph id="H87F8D66078684532924B66C657EC4315"><enum>(B)</enum><header>Quantity of mercury allowances allocated</header><text>The Administrator shall allocate to each affected unit that is not a new unit a quantity of mercury allowances that is equal to the product obtained by multiplying—</text> 
<clause id="HD854F988A6234EFFBAC184EC12C066B6"><enum>(i)</enum><text>0.0000227 pounds of mercury per megawatt hour; and</text></clause> 
<clause id="H1177B105B21148D0A490BA17454E52DD"><enum>(ii)</enum><text>the average annual net quantity of electricity generated by the affected unit during the most recent 3-calendar year period for which data are available, measured in megawatt hours.</text></clause></subparagraph> 
<subparagraph id="H5852F13662574DF88B489505AD5D172"><enum>(C)</enum><header>Adjustment of allocations</header> 
<clause id="H6C2E2DE285464D6CB3D1135721B818E6"><enum>(i)</enum><header>In general</header><text>If, for any calendar year, the total quantity of allowances allocated under subparagraph (A) or (B) is not equal to the applicable quantity determined under clause (ii), the Administrator shall adjust the quantity of allowances allocated to affected units that are not new units on a pro-rata basis so that the quantity is equal to the applicable quantity determined under clause (ii).</text></clause> 
<clause id="HC21680A6466F437D9BFB810090705082"><enum>(ii)</enum><header>Applicable quantity</header><text>The applicable quantity referred to in clause (i) is the difference between—</text> 
<subclause id="H8E554E43835A4E309836E7E231FA2F23"><enum>(I)</enum><text>the applicable annual tonnage limitation for emissions from affected units specified in subsection (b) or (c) of section 702 for the calendar year; and</text></subclause> 
<subclause id="HA799A1FECADC46828BFB49D8F4E161B"><enum>(II)</enum><text>the quantity of nitrogen oxide allowances or mercury allowances, respectively, placed in the applicable new unit reserve established under subsection (b) for the calendar year.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H0085DECF50274DD693708136C9EF8BD"><enum>(3)</enum><header>Allocation to new units</header> 
<subparagraph id="H072F11E01E784575BF0829D97599EA72"><enum>(A)</enum><header>Methodology</header><text>The Administrator shall promulgate regulations to establish a methodology for allocating nitrogen oxide allowances and mercury allowances to new units.</text></subparagraph> 
<subparagraph id="H91C18FB678CC497A8971BFC6E8EF5626"><enum>(B)</enum><header>Quantity of nitrogen oxide allowances and mercury allowances allocated</header><text>The Administrator shall determine the quantity of nitrogen oxide allowances and mercury allowances to be allocated to each new unit based on the projected emissions from the new unit.</text></subparagraph></paragraph> 
<paragraph id="HC8DA1FBD664B46CE93E353E150119291"><enum>(4)</enum><header>Allowance not a property right</header><text>A nitrogen oxide allowance or mercury allowance—</text> 
<subparagraph id="H72E102E4737944648403909EE324E64C"><enum>(A)</enum><text>is not a property right; and</text></subparagraph> 
<subparagraph id="HD8B46784DBB444BF8EFE3DFEF756EAE"><enum>(B)</enum><text>may be terminated or limited by the Administrator.</text></subparagraph></paragraph> 
<paragraph id="HC297280BF27045C0A67C782756DEB493"><enum>(5)</enum><header>No judicial review</header><text>An allocation of nitrogen allowances or mercury allowances by the Administrator under this subsection shall not be subject to judicial review.</text></paragraph></subsection> 
<subsection id="HA1FC0D3CFAA742BDBB7F11703E001EF6"><enum>(d)</enum><header>Nitrogen oxide allowance and mercury allowance transfer system</header> 
<paragraph id="H7B9EE533568C4FC58D20438D9DE19CCE"><enum>(1)</enum><header>Use of allowances</header><text>The regulations promulgated under subsection (a)(1)(A) shall—</text> 
<subparagraph id="H2CA9FAA694654C3B8470F069E75EF9D8"><enum>(A)</enum><text>prohibit the use (but not the transfer in accordance with paragraph (3)) of any nitrogen oxide allowance or mercury allowance before the calendar year for which the allowance is allocated;</text></subparagraph> 
<subparagraph id="H559B1216A2B3442488B91E4F5C342A"><enum>(B)</enum><text>provide that unused nitrogen oxide allowances and mercury allowances may be carried forward and added to nitrogen oxide allowances and mercury allowances, respectively, allocated for subsequent years; and</text></subparagraph> 
<subparagraph id="H17C287F3463D497AA0C49DC7D87245BD"><enum>(C)</enum><text>provide that unused nitrogen oxide allowances and mercury allowances may be transferred by—</text> 
<clause id="H850528E3E343476E9ED6C13BF663DBA"><enum>(i)</enum><text>the person to which the allowances are allocated; or</text></clause> 
<clause id="H2CA0F5DA3F4041B388ACBB33F4015324"><enum>(ii)</enum><text>any person to which the allowances are transferred.</text></clause></subparagraph></paragraph> 
<paragraph id="HD8415593CC324565BF5770AD3B2E2D"><enum>(2)</enum><header>Use by persons to which allowances are transferred</header><text>Any person to which nitrogen oxide allowances or mercury allowances are transferred under paragraph (1)(C)—</text> 
<subparagraph id="H64263BE0C954411F9CA8CCE0661933FC"><enum>(A)</enum><text>may use the nitrogen oxide allowances or mercury allowances in the calendar year for which the nitrogen oxide allowances or mercury allowances were allocated, or in a subsequent calendar year, to demonstrate compliance with subsection (e)(1); or</text></subparagraph> 
<subparagraph id="H3AF331115C1648B2A99B00E2E586C313"><enum>(B)</enum><text>may transfer the nitrogen oxide allowances or mercury allowances to any other person for the purpose of demonstration of that compliance.</text></subparagraph></paragraph> 
<paragraph id="H9A9208D697734406B596CB6D05C68B3E"><enum>(3)</enum><header>Certification of transfer</header><text>A transfer of a nitrogen oxide allowance or mercury allowance shall not take effect until a written certification of the transfer, authorized by a responsible official of the person making the transfer, is received and recorded by the Administrator.</text></paragraph> 
<paragraph id="H29620A317008444CB4B9008F455F3D27"><enum>(4)</enum><header>Permit requirements</header><text>An allocation or transfer of nitrogen oxide allowances or mercury allowances to an affected unit shall, after recording by the Administrator, be considered to be part of the federally enforceable permit of the affected unit under this Act, without a requirement for any further review or revision of the permit.</text></paragraph></subsection> 
<subsection id="HFFCF754C928046E49551476B2DFB822C"><enum>(e)</enum><header>Compliance and enforcement</header> 
<paragraph id="H8DDDAB0C0B8A4AFB99F058BA06857C4D"><enum>(1)</enum><header>In general</header><text>For calendar year 2009 and each calendar year thereafter, the operator of each affected unit shall surrender to the Administrator—</text> 
<subparagraph id="H184AC5422A6846A5A7A2901865D8F580"><enum>(A)</enum><text>a quantity of nitrogen oxide allowances that is equal to the total tons of nitrogen oxides emitted by the affected unit during the calendar year; and</text></subparagraph> 
<subparagraph id="H34152429724C4A96BA589510F6128FF6"><enum>(B)</enum><text>a quantity of mercury allowances that is equal to the total pounds of mercury emitted by the affected unit during the calendar year.</text></subparagraph></paragraph> 
<paragraph id="HDBE433C01EB44E10B1B954978F92B034"><enum>(2)</enum><header>Monitoring system</header><text>The Administrator shall promulgate regulations requiring the accurate monitoring of the quantities of nitrogen oxides and mercury that are emitted at each affected unit.</text></paragraph> 
<paragraph id="HDBCC15BAF85C47FA91DB27358E00E600"><enum>(3)</enum><header>Reporting</header> 
<subparagraph id="HCF67467BC0304C728E8DA64383D9772C"><enum>(A)</enum><header>In general</header><text>Not less often than quarterly, the owner or operator of an affected unit shall submit to the Administrator a report on the monitoring of emissions of nitrogen oxides and mercury carried out by the owner or operator in accordance with the regulations promulgated under paragraph (2).</text></subparagraph> 
<subparagraph id="H32A9CA68C961494097398640AD0075F3"><enum>(B)</enum><header>Authorization</header><text>Each report submitted under subparagraph (A) shall be authorized by a responsible official of the affected unit, who shall certify the accuracy of the report.</text></subparagraph> 
<subparagraph id="H500634480BAA49D8808BE8829F6209C7"><enum>(C)</enum><header>Public reporting</header><text>The Administrator shall make available to the public, through 1 or more published reports and 1 or more forms of electronic media, data concerning the emissions of nitrogen oxides and mercury from each affected unit.</text></subparagraph></paragraph> 
<paragraph id="H1DBEB92424D74684BC4B58BA434D3185"><enum>(4)</enum><header>Excess emissions</header> 
<subparagraph id="HD5F0F21FE82D46D2BD0109BF5D63C7D6"><enum>(A)</enum><header>In general</header><text>The owner or operator of an affected unit that emits nitrogen oxides or mercury in excess of the nitrogen oxide allowances or mercury allowances that the owner or operator holds for use for the affected unit for the calendar year shall—</text> 
<clause id="H5251AAB31ACC4AA39BFC00828EF841D0"><enum>(i)</enum><text>pay an excess emissions penalty determined under subparagraph (B); and</text></clause> 
<clause id="H67654810438546B2BDEFDAD151F48C2B"><enum>(ii)</enum><text>offset the excess emissions by an equal quantity in the following calendar year or such other period as the Administrator shall prescribe.</text></clause></subparagraph> 
<subparagraph id="H84276452F22144B600B788388ECDB99E"><enum>(B)</enum><header>Determination of excess emissions penalty</header> 
<clause id="H74D04A551D9B480383F57CB0AC9802C"><enum>(i)</enum><header>Nitrogen oxides</header><text>The excess emissions penalty for nitrogen oxides shall be equal to the product obtained by multiplying—</text> 
<subclause id="HF8A718C4F6374D6800F0B6A1C4FDE541"><enum>(I)</enum><text>the number of tons of nitrogen oxides emitted in excess of the total quantity of nitrogen oxide allowances held; and</text></subclause> 
<subclause id="HFBE2E1D01A2C49EBBFCD8D9554219FD2"><enum>(II)</enum><text>$5,000, adjusted (in accordance with regulations promulgated by the Administrator) for changes in the Consumer Price Index for All-Urban Consumers published by the Department of Labor.</text></subclause></clause> 
<clause id="H5211624390C94BC385074099B5F5F5DE"><enum>(ii)</enum><header>Mercury</header><text>The excess emissions penalty for mercury shall be equal to the product obtained by multiplying—</text> 
<subclause id="HC9A35F2BDC5E44C38000E79200DD008F"><enum>(I)</enum><text>the number of pounds of mercury emitted in excess of the total quantity of mercury allowances held; and</text></subclause> 
<subclause id="H8F99CDC54D1A4996005B0800D5634AE"><enum>(II)</enum><text>$10,000, adjusted (in accordance with regulations promulgated by the Administrator) for changes in the Consumer Price Index for All-Urban Consumers published by the Department of Labor.</text></subclause></clause></subparagraph></paragraph></subsection></section> 
<section id="H4A8342570D9542E295DE64B1295FD7E7"><enum>704.</enum><header>Carbon dioxide allowance trading program</header> 
<subsection id="H81773F802EE549C5893C02D4F00C3EF"><enum>(a)</enum><header>Regulations</header> 
<paragraph id="H9057411EFD544374BC6321EBA66F30A5"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the enactment of this section, the Administrator shall promulgate regulations to establish a carbon dioxide allowance trading program for covered units in the United States.</text></paragraph> 
<paragraph id="H4A279505A2AF405DB67BF01487D22FA0"><enum>(2)</enum><header>Required elements</header><text>Regulations promulgated under paragraph (1) shall establish requirements for the carbon dioxide allowance trading program under this section, including requirements concerning—</text> 
<subparagraph id="HECD401F8292E4C46931FE3B6E158FAEE"><enum>(A)</enum> 
<clause id="HE1CC46D4A65B478EBC158F772D03BC27" display-inline="yes-display-inline"><enum>(i)</enum><text>the generation, allocation, issuance, recording, tracking, transfer, and use of carbon dioxide allowances; and</text></clause> 
<clause id="H46AD71D06E64418086D03EC342FB457F" indent="up1"><enum>(ii)</enum><text>the public availability of all information concerning the activities described in clause (i) that is not confidential;</text> </clause> </subparagraph> 
<subparagraph id="H7FBDAB0773B2416FB9EAAA51FD200BB"><enum>(B)</enum><text>compliance with subsection (f)(1);</text></subparagraph> 
<subparagraph id="HD9601BF5190F4E6E00E8500C0B7DD75"><enum>(C)</enum><text>the monitoring and reporting of emissions under paragraphs (2) and (3) of subsection (f);</text></subparagraph> 
<subparagraph id="HBF07A1CECA144B779CD6E1724800429F"><enum>(D)</enum><text>excess emission penalties under subsection (f)(4); and</text></subparagraph> 
<subparagraph id="HBC5CD138791B49F4B69165944C2DDA99"><enum>(E)</enum><text>standards, guidelines, and procedures concerning the generation, certification, and use of additional carbon dioxide allowances made available under subsection (d).</text></subparagraph></paragraph></subsection> 
<subsection id="HDEE1F4F9F62340AFA8E818A6D0F77026"><enum>(b)</enum><header>New unit reserve</header> 
<paragraph id="H2C08F11D2C56467883E1588E9EF45E5"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish by regulation a reserve of carbon dioxide allowances to be set aside for use by new units and new renewable energy units.</text></paragraph> 
<paragraph id="HE72C86A70A21407A827B76E32B36904"><enum>(2)</enum><header>Determination of quantity</header><text>The Administrator, in consultation with the Secretary of Energy, shall determine, based on projections of electricity output for new units and new renewable energy units—</text> 
<subparagraph id="HC51C9A42E46E4BBDB7AF7745A73648F2"><enum>(A)</enum><text>not later than June 30, 2006, the quantity of carbon dioxide allowances required to be held in reserve for new units and new renewable energy units for each of calendar years 2010 through 2013; and</text></subparagraph> 
<subparagraph id="H0E25DC9F5F9246A2A2E81360D79C4E9B"><enum>(B)</enum><text>not later than June 30 of each fifth calendar year thereafter, the quantity of carbon dioxide allowances required to be held in reserve for new units and renewable energy units for the following 5-calendar year period.</text></subparagraph></paragraph></subsection> 
<subsection id="H418B609A94584132925B3891D8681C81"><enum>(c)</enum><header>Carbon dioxide allowance allocation</header> 
<paragraph id="H0C2B25EBB02648698376BD5940645B9C"><enum>(1)</enum><header>Timing of allocations</header><text>The Administrator shall allocate carbon dioxide allowances to covered units—</text> 
<subparagraph id="HA77645FEB6E6489098A4AE3EAA30097"><enum>(A)</enum><text>not later than December 31, 2006, for calendar year 2010; and</text></subparagraph> 
<subparagraph id="H962F55DBCAF74FB7897DC2BECEA23B83"><enum>(B)</enum><text>not later than December 31 of calendar year 2007 and each calendar year thereafter, for the fourth calendar year that begins after that December 31.</text></subparagraph></paragraph> 
<paragraph id="H360F8E54726E49EDB98F0341D12C61E0"><enum>(2)</enum><header>Allocations to covered units that are not new units</header> 
<subparagraph id="HA440A5CA38D64880B80857EDED91B96D"><enum>(A)</enum><header>In general</header><text>The Administrator shall allocate to each affected unit that is not a new unit, to each nuclear generating unit with respect to incremental nuclear generation, and to each renewable energy unit that is not a new renewable energy unit, a quantity of carbon dioxide allowances that is equal to the product obtained by multiplying—</text> 
<clause id="H66B9869660BF4631A660041DC8F9D78C"><enum>(i)</enum><text>the quantity of carbon dioxide allowances available for allocation under subparagraph (B); and</text></clause> 
<clause id="HF30EC156B40C4EE2BB55058D8C82EFC6"><enum>(ii)</enum><text>the quotient obtained by dividing—</text> 
<subclause id="HC3929BD7A39F41B5822377D5404464B4"><enum>(I)</enum><text>the average net quantity of electricity generated by the unit in a calendar year during the most recent 3-calendar year period for which data are available, measured in megawatt hours; and</text></subclause> 
<subclause id="H5D52F20FBED742668600D542C1F252D"><enum>(II)</enum><text>the total of the average net quantities described in subclause (I) with respect to all such units.</text></subclause></clause></subparagraph> 
<subparagraph id="HAC28B81D9E65441082C29DF28C0278C"><enum>(B)</enum><header>Quantity to be allocated</header><text>For each calendar year, the quantity of carbon dioxide allowances allocated under subparagraph (A) shall be equal to the difference between—</text> 
<clause id="H2BDC8A1CDE0045C2942FD7B87E119C8F"><enum>(i)</enum><text>the annual tonnage limitation for emissions of carbon dioxide from affected units specified in section 702(d) for the calendar year; and</text></clause> 
<clause id="H76D2E58A6046407DA46ED8BF2004314"><enum>(ii)</enum><text>the quantity of carbon dioxide allowances placed in the new unit reserve established under subsection (b) for the calendar year.</text></clause></subparagraph></paragraph> 
<paragraph id="H31B46BB6CCB54922BEEDF9469C4550BB"><enum>(3)</enum><header>Allocation to new units and new renewable energy units</header> 
<subparagraph id="HDCE3AE7B4CEA44319F23AC9D8F005F"><enum>(A)</enum><header>Methodology</header><text>The Administrator shall promulgate regulations to establish a methodology for allocating carbon dioxide allowances to new units and new renewable energy units.</text></subparagraph> 
<subparagraph id="H3FD99E0605154C5F936200696475CE3C"><enum>(B)</enum><header>Quantity of carbon dioxide allowances allocated</header><text>The Administrator shall determine the quantity of carbon dioxide allowances to be allocated to each new unit and each new renewable energy unit based on the unit’s projected share of the total electric power generation attributable to covered units.</text></subparagraph></paragraph></subsection> 
<subsection id="H94684260168B44B68BE8827F06FA87B4"><enum>(d)</enum><header>Issuance and use of additional carbon dioxide allowances</header> 
<paragraph id="H8132D420D79D452FB8E3CD9EBAF68ED9"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H893697C5835D46C89CB6BC6C70C60000"><enum>(A)</enum><header>Allowances for projects certified by independent review board</header><text>In addition to carbon dioxide allowances allocated under subsection (c), the Administrator shall make carbon dioxide allowances available to projects that are certified, in accordance with paragraph (3), by the independent review board established under paragraph (2) as eligible to receive the carbon dioxide allowances.</text></subparagraph> 
<subparagraph id="HE9C6BDC0276348F08BC5868E39084B28"><enum>(B)</enum><header>Allowances obtained under other programs</header><text>The regulations promulgated under subsection (a)(1) shall—</text> 
<clause id="H15AEF92AB6F74AD3BD33001BBA5C3F39"><enum>(i)</enum><text>allow covered units to comply with subsection (f)(1) by purchasing and using carbon dioxide allowances that are traded under any other United States or internationally recognized carbon dioxide reduction program that is specified under clause (ii);</text></clause> 
<clause id="H21B180741A5D4379B3964632C2D8DBB8"><enum>(ii)</enum><text>specify, for the purpose of clause (i), programs that meet the goals of this section; and</text></clause> 
<clause id="H765BC5E94860474AA81BBEBBE0603C5E"><enum>(iii)</enum><text>apply such conditions to the use of carbon dioxide allowances traded under programs specified under clause (ii) as are necessary to achieve the goals of this section.</text></clause></subparagraph></paragraph> 
<paragraph id="H65A2CEE07E614574A51000F9916EBE78"><enum>(2)</enum><header>Independent review board</header> 
<subparagraph id="H5B59E6C3EA2D4DA69707D006E085EAF"><enum>(A)</enum><header>In general</header> 
<clause id="HFD157FBF82D046E7B1F4D5979E0045A8"><enum>(i)</enum><header>Establishment</header><text>The Administrator shall establish an independent review board to assist the Administrator in certifying projects as eligible for carbon dioxide allowances made available under paragraph (1)(A).</text></clause> 
<clause id="H847AF90871854DFD810467F6778D7200"><enum>(ii)</enum><header>Review and approval</header><text>Each certification by the independent review board of a project shall be subject to the review and approval of the Administrator.</text></clause> 
<clause id="HC975518EC0994AA9B578DB03408FA2A8"><enum>(iii)</enum><header>Requirements</header><text>Subject to this subsection, requirements relating to the creation, composition, duties, responsibilities, and other aspects of the independent review board shall be included in the regulations promulgated by the Administrator under subsection (a).</text></clause></subparagraph> 
<subparagraph id="HC13C00572B1F490D974CEE03F4C9BD45"><enum>(B)</enum><header>Membership</header><text>The independent review board shall be composed of 12 members, of whom—</text> 
<clause id="H4E7A4B463317442BB7FBFE8F75188767"><enum>(i)</enum><text>10 members shall be appointed by the Administrator, of whom—</text> 
<subclause id="H7959811C274748618C18217D61006DE"><enum>(I)</enum><text>1 member shall represent the Environmental Protection Agency (who shall serve as chairperson of the independent review board);</text></subclause> 
<subclause id="H36275EE655E24FF0A13688E32584D0CA"><enum>(II)</enum><text>3 members shall represent State governments;</text></subclause> 
<subclause id="HE9893449BB43472B980070EF46C353FF"><enum>(III)</enum><text>3 members shall represent the electric generating sector; and</text></subclause> 
<subclause id="HEF90AD73DEAC426FBCBFB5661CDE1DB6"><enum>(IV)</enum><text>3 members shall represent environmental organizations;</text></subclause></clause> 
<clause id="H99B6ABD149ED46A993CE59D589D31983"><enum>(ii)</enum><text>1 member shall be appointed by the Secretary of Energy to represent the Department of Energy; and</text></clause> 
<clause id="H2C3A8F5B267541C8A200E937F5C9F463"><enum>(iii)</enum><text>1 member shall be appointed by the Secretary of Agriculture to represent the Department of Agriculture.</text></clause></subparagraph> 
<subparagraph id="HB3D95A5E46BF453790783E002C9C4EFF"><enum>(C)</enum><header>Staff and other resources</header><text>The Administrator shall provide such staff and other resources to the independent review board as the Administrator determines to be necessary.</text></subparagraph> 
<subparagraph id="H09EFEBCC7D784DCE8B00E2DF4888FB05"><enum>(D)</enum><header>Development of guidelines</header> 
<clause id="HCB8F72018A4445D98777B66BB92B65E9"><enum>(i)</enum><header>In general</header><text>The independent review board shall develop guidelines for certifying projects in accordance with paragraph (3), including—</text> 
<subclause id="HE90321DE8BC64427ABFF4B1580135FAD"><enum>(I)</enum><text>criteria that address the validity of claims that projects result in the generation of carbon dioxide allowances;</text></subclause> 
<subclause id="HC312493F5AF14668BE3B1F47CD9727D0"><enum>(II)</enum><text>guidelines for certifying incremental carbon sequestration in accordance with clause (ii); and</text></subclause> 
<subclause id="H06374788DB654FB4A31101FDBC00EA80"><enum>(III)</enum><text>guidelines for certifying geological sequestration of carbon dioxide in accordance with clause (iii).</text></subclause></clause> 
<clause id="H195D3C7EECE5492E00B5E601009D7C00"><enum>(ii)</enum><header>Guidelines for certifying incremental carbon sequestration</header><text>The guidelines for certifying incremental carbon sequestration in forests, agricultural soil, rangeland, or grassland shall include development, reporting, monitoring, and verification guidelines, to be used in quantifying net carbon sequestration from land use projects, that are based on—</text> 
<subclause id="H6BDF6A95327C4DBDB6F4D2FCD73E237"><enum>(I)</enum><text>measurement of increases in carbon storage in excess of the carbon storage that would have occurred in the absence of such a project;</text></subclause> 
<subclause id="H87B0DABEBCBC40C288362EEC1F88C601"><enum>(II)</enum><text>comprehensive carbon accounting that—</text> 
<item id="H24D48E31E1824B95AC046178BDF06CCE"><enum>(aa)</enum><text>reflects net increases in carbon reservoirs; and</text></item> 
<item id="H3C8D6E9F09FF45ED83BDDE007995A367"><enum>(bb)</enum><text>takes into account any carbon emissions resulting from disturbance of carbon reservoirs in existence as of the date of commencement of the project;</text></item></subclause> 
<subclause id="H384AC433CA1541509E5BA813BDF7078E"><enum>(III)</enum><text>adjustments to account for—</text> 
<item id="H4A41731B93854E3E88B162EF0462BE09"><enum>(aa)</enum><text>emissions of carbon that may result at other locations as a result of the impact of the project on timber supplies; or</text></item> 
<item id="HBFE3554C7A1746478B3535587B3ED800"><enum>(bb)</enum><text>potential displacement of carbon emissions to other land owned by the entity that carries out the project; and</text></item></subclause> 
<subclause id="HAAE07D8BA5D64AAC9BFFA1F6A700A428"><enum>(IV)</enum><text>adjustments to reflect the expected carbon storage over various time periods, taking into account the likely duration of the storage of the carbon stored in a carbon reservoir.</text></subclause></clause> 
<clause id="H1068BE69F8534DA0AEA21733E89D42DF"><enum>(iii)</enum><header>Guidelines for certifying geological sequestration of carbon dioxide</header><text>The guidelines for certifying geological sequestration of carbon dioxide produced by a covered unit shall—</text> 
<subclause id="H25143063326E427B9FDBA926A84251E8"><enum>(I)</enum><text>provide that a project shall be certified only to the extent that the geological sequestration of carbon dioxide produced by a covered unit is in addition to any carbon dioxide used by the covered unit in 2010 for enhanced oil recovery; and</text></subclause> 
<subclause id="HD761E9AE8A0F4CFF980017C23DD95208"><enum>(II)</enum><text>include requirements for development, reporting, monitoring, and verification for quantifying net carbon sequestration—</text> 
<item id="HD1B45B7E6E2E4897B1F9F4B5C41B2E6B"><enum>(aa)</enum><text>to ensure the permanence of the sequestration; and</text></item> 
<item id="H76E75BA44A164DBEAE9755FED0058540"><enum>(bb)</enum><text>to ensure that the sequestration will not cause or contribute to significant adverse effects on the environment.</text></item></subclause></clause> 
<clause id="HE53CE33A4057446792D97C5D839FAD95"><enum>(iv)</enum><header>Deadlines for development</header><text>The guidelines under clause (i) shall be developed—</text> 
<subclause id="HE4A5BE14935B42AAB529953F83C5A5BC"><enum>(I)</enum><text>with respect to projects described in paragraph (3)(A), not later than January 1, 2006; and</text></subclause> 
<subclause id="H08D4DF82079F43CB88C0D8B62611B237"><enum>(II)</enum><text>with respect to projects described in paragraph (3)(B), not later than January 1, 2007.</text></subclause></clause> 
<clause id="H0EB7E862923645DB85B0B9D8B599FD83"><enum>(v)</enum><header>Updating of guidelines</header><text>The independent review board shall periodically update the guidelines as the independent review board determines to be appropriate.</text></clause></subparagraph> 
<subparagraph id="H4F61E1FE64BD42FFB0E7F69913CA39A4"><enum>(E)</enum><header>Certification of projects</header> 
<clause id="HED963D8203034D57B8F0E393D2173D96"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), subparagraph (A)(ii), and paragraph (3), the independent review board shall certify projects as eligible for additional carbon dioxide allowances.</text></clause> 
<clause id="HFDF825DF2DF447D1A17CF2A7C03A24C"><enum>(ii)</enum><header>Limitation</header><text>The independent review board shall not certify a project under this subsection if the carbon dioxide emission reductions achieved by the project will be used to satisfy any requirement imposed on any foreign country or any industrial sector to reduce the quantity of greenhouse gases emitted by the foreign country or industrial sector.</text></clause></subparagraph></paragraph> 
<paragraph id="H1E38C01B9E494B468880D2222B28A65E"><enum>(3)</enum><header>Projects eligible for additional carbon dioxide allowances</header> 
<subparagraph id="H8FB0B1D8AC504570A359B8DDAADE4B5E"><enum>(A)</enum><header>Projects carried out in calendar years 1990 through 2009</header> 
<clause id="HE7C14F04F54847528DA9C7007496C6D5"><enum>(i)</enum><header>In general</header><text>The independent review board may certify as eligible for carbon dioxide allowances a project that—</text> 
<subclause id="H6662B590D4484A76808D38F35B57F216"><enum>(I)</enum><text>is carried out on or after January 1, 1990, and before January 1, 2010; and</text></subclause> 
<subclause id="HF64B0F26DBD94A789D00A9940035BE51"><enum>(II)</enum><text>consists of—</text> 
<item id="HA3BB42BFC6DE48EDBF77DDF5C78DD5E8"><enum>(aa)</enum><text>a carbon sequestration project carried out in the United States or a foreign country;</text></item> 
<item id="H53A61C6D8EB943E5A726F9B73022C3EC"><enum>(bb)</enum><text>a project reported under section 1605(b) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13385">42 U.S.C. 13385(b)</external-xref>); or</text></item> 
<item id="H8CB96D01E84140DDBA71C32637C375F4"><enum>(cc)</enum><text>any other project to reduce emissions of greenhouse gases that is carried out in the United States or a foreign country.</text></item></subclause></clause> 
<clause id="HE10A8EB9D814416A83DA250000006751"><enum>(ii)</enum><header>Maximum quantity of additional carbon dioxide allowances</header><text>The Administrator may make available to projects certified under clause (i) a quantity of allowances that is not greater than 10 percent of the tonnage limitation for calendar year 2010 for emissions of carbon dioxide from affected units specified in section 702(d)(1).</text></clause> 
<clause id="H28849BB197E441EFBE7271692DB5285E"><enum>(iii)</enum><header>Use of allowances</header><text>Allowances made available under clause (ii) may be used to comply with subsection (f)(1) in calendar year 2010 or any calendar year thereafter.</text></clause></subparagraph> 
<subparagraph id="HB9D52F0363274C58B4770006A36FF8BC"><enum>(B)</enum><header>Projects carried out in calendar year 2010 and thereafter</header><text>The independent review board may certify as eligible for carbon dioxide allowances a project that—</text> 
<clause id="HB31F7CDB5E2A49F2ABA2D2509107F9BB"><enum>(i)</enum><text>is carried out on or after January 1, 2010; and</text></clause> 
<clause id="H2BE66213B43B49C491FCCA14D37E981E"><enum>(ii)</enum><text>consists of—</text> 
<subclause id="H632B44300B614B0AA1A4B3BD56FB6CEB"><enum>(I)</enum><text>a carbon sequestration project carried out in the United States or a foreign country; or</text></subclause> 
<subclause id="H5F603E0491A94F88B2FC27EBAF7BC2D"><enum>(II)</enum><text>a project to reduce the greenhouse gas emissions (on a carbon dioxide equivalency basis determined by the independent review board) of a source of greenhouse gases that is not an affected unit.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HEA44BB05FC92439BA5C5570747C270CB"><enum>(e)</enum><header>Carbon dioxide allowance transfer system</header> 
<paragraph id="H549384E0172A4B7CA43F17E6E1FB3345"><enum>(1)</enum><header>Use of allowances</header><text>The regulations promulgated under subsection (a)(1) shall—</text> 
<subparagraph id="H12681AB95A6E4AFA856BF0EB9F09DDB0"><enum>(A)</enum><text>prohibit the use (but not the transfer in accordance with paragraph (3)) of any carbon dioxide allowance before the calendar year for which the carbon dioxide allowance is allocated;</text></subparagraph> 
<subparagraph id="HCBE420972F1F472F9B6BDDB9FB75EBAB"><enum>(B)</enum><text>provide that unused carbon dioxide allowances may be carried forward and added to carbon dioxide allowances allocated for subsequent years;</text></subparagraph> 
<subparagraph id="H87F303630B63402390651F68EEA4AFBB"><enum>(C)</enum><text>provide that unused carbon dioxide allowances may be transferred by—</text> 
<clause id="H8BB88C9D36F64F7D0025B3EE6B38FEE2"><enum>(i)</enum><text>the person to which the carbon dioxide allowances are allocated; or</text></clause> 
<clause id="HAEF72CC2822049FD841619F669E133D7"><enum>(ii)</enum><text>any person to which the carbon dioxide allowances are transferred; and</text></clause></subparagraph> 
<subparagraph id="H882B0649405A4ED7BEA122CB3585FA9D"><enum>(D)</enum><text>provide that carbon dioxide allowances allocated and transferred under this section may be transferred into any other market-based carbon dioxide emission trading program that is—</text> 
<clause id="H84A96D8F6DB940D386A0A20064D21063"><enum>(i)</enum><text>approved by the President; and</text></clause> 
<clause id="H9106335B18B648F0832CBB8DB5F4D96B"><enum>(ii)</enum><text>implemented in accordance with regulations developed by the Administrator or the head of any other Federal agency.</text></clause></subparagraph></paragraph> 
<paragraph id="H684AB40156A34FEE89115F8D4EB8CE53"><enum>(2)</enum><header>Use by persons to which carbon dioxide allowances are transferred</header><text>Any person to which carbon dioxide allowances are transferred under paragraph (1)(C)—</text> 
<subparagraph id="H4A7C1C9D8F244F47B188D202A5A07B09"><enum>(A)</enum><text>may use the carbon dioxide allowances in the calendar year for which the carbon dioxide allowances were allocated, or in a subsequent calendar year, to demonstrate compliance with subsection (f)(1); or</text></subparagraph> 
<subparagraph id="H3DB1028EF9854F6395139D61850019A5"><enum>(B)</enum><text>may transfer the carbon dioxide allowances to any other person for the purpose of demonstration of that compliance.</text></subparagraph></paragraph> 
<paragraph id="H819D636679DF4FEAB1A2907F331174F4"><enum>(3)</enum><header>Certification of transfer</header><text>A transfer of a carbon dioxide allowance shall not take effect until a written certification of the transfer, authorized by a responsible official of the person making the transfer, is received and recorded by the Administrator.</text></paragraph> 
<paragraph id="H57376E5376E34F009E5DD6637EAD83BD"><enum>(4)</enum><header>Permit requirements</header><text>An allocation or transfer of carbon dioxide allowances to a covered unit, or for a project carried out on behalf of a covered unit, under subsection (c) or (d) shall, after recording by the Administrator, be considered to be part of the federally enforceable permit of the covered unit under this Act, without a requirement for any further review or revision of the permit.</text></paragraph></subsection> 
<subsection id="H27384FB5927648CDBA3EE0BC6223B300"><enum>(f)</enum><header>Compliance and enforcement</header> 
<paragraph id="H2D8F0408375D4DA486929C6000B90048"><enum>(1)</enum><header>In general</header><text>For calendar year 2010 and each calendar year thereafter—</text> 
<subparagraph id="HCD0F84FA47B642E89F1DF44FEE36B943"><enum>(A)</enum><text>the operator of each affected unit and each renewable energy unit shall surrender to the Administrator a quantity of carbon dioxide allowances that is equal to the total tons of carbon dioxide emitted by the affected unit or renewable energy unit during the calendar year; and</text></subparagraph> 
<subparagraph id="H99AF8F39DB5D41E9A13D9E787BDF71EB"><enum>(B)</enum><text>the operator of each nuclear generating unit that has incremental nuclear generation shall surrender to the Administrator a quantity of carbon dioxide allowances that is equal to the total tons of carbon dioxide emitted by the nuclear generating unit during the calendar year from incremental nuclear generation.</text></subparagraph></paragraph> 
<paragraph id="HBDEBD97BCB00459FA8F7EFEE59AEEEBB"><enum>(2)</enum><header>Monitoring system</header><text>The Administrator shall promulgate regulations requiring the accurate monitoring of the quantity of carbon dioxide that is emitted at each covered unit.</text></paragraph> 
<paragraph id="H069E8FF439FA4A73982C40FF964D46FE"><enum>(3)</enum><header>Reporting</header> 
<subparagraph id="H04A27616D2894EA89FAAFBAAEBFB1624"><enum>(A)</enum><header>In general</header><text>Not less often than quarterly, the owner or operator of a covered unit, or a person that carries out a project certified under subsection (d) on behalf of a covered unit, shall submit to the Administrator a report on the monitoring of carbon dioxide emissions carried out at the covered unit in accordance with the regulations promulgated under paragraph (2).</text></subparagraph> 
<subparagraph id="H68F73FE7FCA240C99847A767A6C62E79"><enum>(B)</enum><header>Authorization</header><text>Each report submitted under subparagraph (A) shall be authorized by a responsible official of the covered unit, who shall certify the accuracy of the report.</text></subparagraph> 
<subparagraph id="H5EFBDD2B6A9B4F4FB2BAC08D7B78EE1"><enum>(C)</enum><header>Public reporting</header><text>The Administrator shall make available to the public, through 1 or more published reports and 1 or more forms of electronic media, data concerning the emissions of carbon dioxide from each covered unit.</text></subparagraph></paragraph> 
<paragraph id="HE9D8DA8B351D4E6B96B7C0F5703E24BC"><enum>(4)</enum><header>Excess emissions</header> 
<subparagraph id="H2428D96080494B32AEAAF65BE6579036"><enum>(A)</enum><header>In general</header><text>The owner or operator of a covered unit that emits carbon dioxide in excess of the carbon dioxide allowances that the owner or operator holds for use for the covered unit for the calendar year shall—</text> 
<clause id="HE9A5B6502EB1450494E43254C365CABC"><enum>(i)</enum><text>pay an excess emissions penalty determined under subparagraph (B); and</text></clause> 
<clause id="H77B40D46FD69432190DB2CE93362E400"><enum>(ii)</enum><text>offset the excess emissions by an equal quantity in the following calendar year or such other period as the Administrator shall prescribe.</text></clause></subparagraph> 
<subparagraph id="HADDDA60800FA4A398BA81434CD54A654"><enum>(B)</enum><header>Determination of excess emissions penalty</header><text>The excess emissions penalty shall be equal to the product obtained by multiplying—</text> 
<clause id="HA176C3F066D04F28A084BD196944BFD0"><enum>(i)</enum><text>the number of tons of carbon dioxide emitted in excess of the total quantity of carbon dioxide allowances held; and</text></clause> 
<clause id="H95B67E34D42848D7AB03F7C674F003D"><enum>(ii)</enum><text>$100, adjusted (in accordance with regulations promulgated by the Administrator) for changes in the Consumer Price Index for All-Urban Consumers published by the Department of Labor.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HEB36383447AB4B6A00EC5C83549390A1"><enum>(g)</enum><header>Allowance not a property right</header><text>A carbon dioxide allowance—</text> 
<paragraph id="HD361036B51964B45A8ACDB7BC5008006"><enum>(1)</enum><text>is not a property right; and</text></paragraph>

<subsection id="HB9166C233510481BBFD5E01D2A91EC8"><enum>(h)</enum><header>No judicial review</header><text>An allocation of carbon dioxide allowances by the Administrator under subsection (c) or (d) shall not be subject to judicial review.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE37041055EED4995809DD38C00D3AF84"><enum>4.</enum><header>New source review program</header><text display-inline="no-display-inline">Section 165 of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7475">42 U.S.C. 7475</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HDE1346D9A414411D8B229D81F419C14E"><enum>(A)</enum><header>Covered unit</header><text>The term <term>covered unit</term> has the meaning given the term in section 701.</text></subparagraph> 
<subparagraph id="H0595D345CE48443D9C48672ECC6E0054"><enum>(B)</enum><header>New source review program</header><text>The term <term>new source review program</term> means the program to carry out section 111 and this part.</text></subparagraph></paragraph> 
<paragraph id="H3092E89D8C46489EA544CE20F7BB3CEF"><enum>(2)</enum><header>Regulations</header><text>In accordance with this subsection, the Administrator shall promulgate revisions to the new source review program.</text></paragraph> 
<paragraph id="H18178EA783C8475195275E5D16BBA81"><enum>(3)</enum><header>Applicability criteria</header><text>Beginning January 1, 2009, the new source review program shall apply only to—</text> 
<subparagraph id="H4C6FC142515B4E8C89C887EC75A6F701"><enum>(A)</enum><text>construction of a new covered unit, which shall include the replacement of an existing boiler; and</text></subparagraph> 
<subparagraph id="H60D80A1F6C064171922B4E8D36D4C87C"><enum>(B)</enum><text>activities that result in any increase in the maximum hourly rate of emissions from a covered unit of air pollutants regulated under the new source review program (measured in pounds per megawatt hour), after netting among covered units at a source.</text></subparagraph></paragraph> 
<paragraph id="HA6D48BE788A244AC88CA9FD525EED8F8"><enum>(4)</enum><header>Performance standards</header><text>Beginning in 2020, all affected units, as that term is defined under section 701 for nitrogen oxides and carbon dioxide, on which construction commenced before August 17, 1971, shall meet the following performance standards:</text> 
<subparagraph id="HA4E697C18BC2484C9EE41F15B548F8AB"><enum>(A)</enum><text>4.5 lbs/MWh for sulfur dioxide; and</text></subparagraph> 
<subparagraph id="H91A094E621FA4988B1F262FD5DE0C6D0"><enum>(B)</enum><text>2.5 lbs/MWh for nitrogen oxides.</text></subparagraph></paragraph> 
<paragraph id="H91047011EA5849FEA8839CF663C139C9"><enum>(5)</enum><header>Bi-annual definition of best available control technology and lowest achievable emission rate</header><text>The definitions of <quote>best available control technology</quote> under section 169 and of <quote>lowest achievable emission rate</quote> under section 171 shall be revised to require the Administrator to define on a bi-annual basis best available control technology and lowest achievable emission rate as those terms apply to covered units.</text></paragraph> 
<paragraph id="H326F11E0747F49AD8E5859A4DE434F03"><enum>(6)</enum><header>Lowest achievable emission rate</header><text>The regulations shall revise the definition of <quote>lowest achievable emission rate</quote> under section 171, with respect to technology required to be installed by the electric generating sector, to allow costs to be considered in the determination of the lowest achievable emission rate, so that, beginning January 1, 2010, a covered unit (as defined in section 701) shall not be required to install technology required to meet a lowest achievable emission rate if the cost of the technology exceeds a maximum amount (in dollars per ton) that is determined by the Administrator. In no event shall such cost be more than twice the amount of the applicable cost guideline for best available control technology.</text></paragraph> 
<paragraph id="HC15DD44D1A1741E49743EF14FAD821A1"><enum>(7)</enum><header>Emission offsets</header><text>No source within the electric generating sector that locates in a non-attainment area after December 31, 2009, shall be required to obtain offsets for emissions of air pollutants.</text></paragraph> 
<paragraph id="H00770475AEDA49D3B594A27C273EBDF3"><enum>(8)</enum><header>No effect on other requirements</header><text>Nothing in this subsection affects the obligation of any State or local government to comply with the requirements established under this section concerning—</text> 
<subparagraph id="H70A4EAED3D0C4DDB8849A86CDC5FE5BD"><enum>(A)</enum><text>national ambient air quality standards;</text></subparagraph> 
<subparagraph id="H0FD2CFAE35544BA2AF9405002C135713"><enum>(B)</enum><text>maximum allowable air pollutant increases or maximum allowable air pollutant concentrations; or</text></subparagraph> 
<subparagraph id="HDEDA2E0729164AC59EC1DE5E2440D96E"><enum>(C)</enum><text>protection of visibility and other air quality-related values in areas designated as class I areas under part C of title I. Additionally, States are required to identify areas with adverse local air quality impacts and to impose such facility-specific and other measures as are necessary to remedy such impacts in light of the national pollutant tonnage limitations in section 702.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HBA9E8933A9C444BBA400C521D04FE1D"><enum>5.</enum><header>Revisions to sulfur dioxide allowance program</header> 
<subsection id="HE1E05C38833443E79288CC04E625097B"><enum>(a)</enum><header>In general</header><text>Title IV of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (relating to acid deposition control) (<external-xref legal-doc="usc" parsable-cite="usc/42/7651">42 U.S.C. 7651 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H269F8835CD3B4357006C59CB6D853F01"><enum>417.</enum><header>Revisions to sulfur dioxide allowance program</header> 
<subsection id="H557440BA304C4A86BC66112E009FC119"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>affected unit</term> and <term>new unit</term> have the meanings given the terms in section 701.</text></subsection> 
<subsection id="HA41D36F6AABB4BD197F4D3E81929F0EB"><enum>(b)</enum><header>Regulations</header><text>Not later than January 1, 2006, the Administrator shall promulgate such revisions to the regulations to implement this title as the Administrator determines to be necessary to implement section 702(a).</text></subsection> 
<subsection id="H22F31E0ED4154FE583ADCAE8A1C1CD50"><enum>(c)</enum><header>New unit reserve</header> 
<paragraph id="H3B99955F168F47BB87F9B1CF6534E3E3"><enum>(1)</enum><header>Establishment</header><text>Subject to the annual tonnage limitation for emissions of sulfur dioxide from affected units specified in section 702(a), the Administrator shall establish by regulation a reserve of allowances to be set aside for use by new units.</text></paragraph> 
<paragraph id="HA4507E5AA57B4698A03112AD8F465175"><enum>(2)</enum><header>Determination of quantity</header><text>The Administrator, in consultation with the Secretary of Energy, shall determine, based on projections of electricity output for new units—</text> 
<subparagraph id="H1F4122D6AE224AAAB06DBF8046004490"><enum>(A)</enum><text>not later than June 30, 2006, the quantity of allowances required to be held in reserve for new units for each of calendar years 2010 through 2014; and</text></subparagraph> 
<subparagraph id="H45B087F2ECEB451A8380DDC679CDBD23"><enum>(B)</enum><text>not later than June 30 of each fifth calendar year thereafter, the quantity of allowances required to be held in reserve for new units for the following 5-calendar year period.</text></subparagraph></paragraph> 
<paragraph id="HD097526372774C558598D6DA226803CD"><enum>(3)</enum><header>Allocation</header> 
<subparagraph id="HAA9F9368170945F680A98811577933A9"><enum>(A)</enum><header>Regulations</header><text>The Administrator shall promulgate regulations to establish a methodology for allocating allowances to new units.</text></subparagraph> 
<subparagraph id="H4EA89655EB9F4BBB85E66C09D09CFEE8"><enum>(B)</enum><header>No judicial review</header><text>An allocation of allowances by the Administrator under this subsection shall not be subject to judicial review.</text></subparagraph></paragraph></subsection> 
<subsection id="HEBDC696C2A6D4C3BBEC567E2D6ED5D"><enum>(d)</enum><header>Existing units</header> 
<paragraph id="HF10D33223321498483061B1D52B55E72"><enum>(1)</enum><header>Allocation</header> 
<subparagraph id="H1B8DBB319BFB4ECCA451A629CA758727"><enum>(A)</enum><header>Regulations</header><text>Subject to the annual tonnage limitation for emissions of sulfur dioxide from affected units specified in section 702(a), and subject to the reserve of allowances for new units under subsection (c), the Administrator shall promulgate regulations to govern the allocation of allowances to affected units that are not new units.</text></subparagraph> 
<subparagraph id="H87BBDD22E8E24DDF90E882C1CB6B87D3"><enum>(B)</enum><header>Required elements</header><text>The regulations shall provide for—</text> 
<clause id="H55B9154E4C124965A26859A5BA208BE9"><enum>(i)</enum><text>the allocation of allowances on a fair and equitable basis between affected units that received allowances under section 405 and affected units that are not new units and that did not receive allowances under that section, using for both categories of units the same or similar allocation methodology as was used under section 405; and</text></clause> 
<clause id="H14D8E9B84DE8417DBB675972E8C00A2"><enum>(ii)</enum><text>the pro-rata distribution of allowances to all units described in clause (i), subject to the annual tonnage limitation for emissions of sulfur dioxide from affected units specified in section 702(a).</text></clause></subparagraph></paragraph> 
<paragraph id="H45728B00F86D45080084BEAE9F83E713"><enum>(2)</enum><header>Timing of allocations</header><text>The Administrator shall allocate allowances to affected units—</text> 
<subparagraph id="H4E1DB53C1A06436A8D96F9369F1C358D"><enum>(A)</enum><text>not later than December 31, 2006, for calendar year 2010; and</text></subparagraph> 
<subparagraph id="H38CDB2B9134149DE9F270066BE4E2DE"><enum>(B)</enum><text>not later than December 31 of calendar year 2007 and each calendar year thereafter, for the fourth calendar year that begins after that December 31.</text></subparagraph></paragraph> 
<paragraph id="H7D3AD17EE8F54268AE00BB800077D18D"><enum>(3)</enum><header>No judicial review</header><text>An allocation of allowances by the Administrator under this subsection shall not be subject to judicial review.</text></paragraph></subsection> 
<subsection id="H85E028446128456D00FF31F7E2717E59"><enum>(e)</enum><header>Western regional air partnership</header> 
<paragraph id="H94D1B105FAC04AA7AD183E4D8D007B50"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H2AB942B26FE540F083C13D7B9B515565"><enum>(A)</enum><header>Covered State</header><text>The term <term>covered State</term> means each of the States of Arizona, California, Colorado, Idaho, Nevada, New Mexico, Oregon, Utah, and Wyoming.</text></subparagraph> 
<subparagraph id="HF1FFA791BC4F4661B03CA5B941FF9344"><enum>(B)</enum><header>Covered year</header><text>The term <term>covered year</term> means—</text> 
<clause id="H6F4B32D6B3D1407D8E7BEAE00E1C443"><enum>(i)</enum>
<subclause id="HCE6B3CC2DA3F439F99C7DC4D9B80FFF3" display-inline="yes-display-inline"><enum>(I)</enum>
<item id="H939050FB9B14435B96785BB90045491C" display-inline="yes-display-inline"><enum>(aa)</enum><text>the third calendar year after the first calendar year in which the Administrator determines by regulation that the total of the annual emissions of sulfur dioxide from all affected units in the covered States is projected to exceed 271,000 tons in calendar year 2018 or any calendar year thereafter; but</text></item></subclause></clause> 
<clause id="HC99EBFB6B95E480DB044FF56007FE5B"><enum>(bb)</enum><text>not earlier than calendar year 2016; or</text> 
<subclause indent="up1" id="H7E87A69A6ED04427BF9E602C00B67568"><enum>(II)</enum><text>if the Administrator does not make the determination described in subclause (I)(aa)—</text> 
<item id="H7F56B8900F9B42B99602C958B8D7F176"><enum>(aa)</enum><text>the third calendar year after the first calendar year with respect to which the total of the annual emissions of sulfur dioxide from all affected units in the covered States first exceeds 271,000 tons; but</text></item> 
<item id="H995262F985A04DC0A584078CC2ACE2E6"><enum>(bb)</enum><text>not earlier than calendar year 2021; and</text></item></subclause></clause> 
<clause id="H37D621BC09BC4972A993337ECFFC5D7C"><enum>(ii)</enum><text>each calendar year after the calendar year determined under clause (i).</text></clause></subparagraph></paragraph> 
<paragraph id="H723063C52F0E4E78AAB8AA4BEF206D11"><enum>(2)</enum><header>Maximum emissions of sulfur dioxide from each affected unit</header><text>In each covered year, the emissions of sulfur dioxide from each affected unit in a covered State shall not exceed the number of allowances that are allocated under paragraph (3) and held by the affected unit for the covered year.</text></paragraph> 
<paragraph id="H93495C1E40EE4F0D90FD88D8546197FB"><enum>(3)</enum><header>Allocation of allowances</header> 
<subparagraph id="HA149189946B241398E4BEFBD2D50B00"><enum>(A)</enum><header>In general</header><text>Not later than January 1, 2015, the Administrator shall promulgate regulations to establish—</text> 
<clause id="H20296F5D99B14AFBA3FA45AB39087991"><enum>(i)</enum><text>a methodology for allocating allowances to affected units in covered States under this subsection; and</text></clause>

<subsection id="HAAF3C93297714AF6A0FA820051F0F35C"><enum>(c)</enum><header>No effect on other Federal and State requirements</header><text>Except as otherwise specifically provided in this Act, nothing in this Act or an amendment made by this Act—</text> 
<paragraph id="HEB8009D446DE407CA31373C12685D9CE"><enum>(1)</enum><text>affects any permitting, monitoring, or enforcement obligation of the Administrator of the Environmental Protection Agency under the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or any remedy provided under that Act;</text></paragraph> 
<paragraph id="HB883B151C522466D8D465EDBE3675046"><enum>(2)</enum><text>affects any requirement applicable to, or liability of, an electric generating facility under that Act;</text></paragraph> 
<paragraph id="HFBB964FE08F54178AC235074E40831F6"><enum>(3)</enum><text>requires a change in, affects, or limits any State law that regulates electric utility rates or charges, including prudency review under State law; or</text></paragraph> 
<paragraph id="H50E3024B822849C196C29997F2C15240"><enum>(4)</enum><text>precludes a State or political subdivision of a State from adopting and enforcing any requirement for the control or abatement of air pollution, except that a State or political subdivision may not adopt or enforce any emission standard or limitation that is less stringent than the requirements imposed under that Act.</text></paragraph></subsection></section>
