<official-title display="yes">To provide liability protection to nonprofit volunteer pilot organizations flying for public benefit and to the pilots and staff of such organizations.</official-title>

<section section-type="section-one" id="HFCD1CF20A2A6405ABC148754B461DD17" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Volunteer Pilot Organization Protection Act of 2006</short-title></quote>.</text></section> 
<section id="H488E0D517350430B00FB85BD4420B985"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="HC3BE600948E345099B68CF4130B454D2"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H2D8AE56328E747ACAFBAF2F1222E60CB"><enum>(1)</enum><text>Scores of public benefit nonprofit volunteer pilot organizations provide valuable services to communities and individuals.</text></paragraph> 
<paragraph id="HADB66B22E46F4B0E9890B940E85B1410"><enum>(2)</enum><text>In calendar year 2001, nonprofit volunteer pilot organizations provided long-distance, no-cost transportation for over 30,000 people in times of special need.</text></paragraph> 
<paragraph id="HBF51E853A75C45268BE400663D54A06F"><enum>(3)</enum><text>Such organizations are no longer able to reasonably purchase non-owned aircraft liability insurance to provide liability protection, and thus face a highly detrimental liability risk.</text></paragraph> 
<paragraph id="HCB140F5718AF4728008566F70897F941"><enum>(4)</enum><text>Such organizations have supported the interests of homeland security by providing volunteer pilot services at times of national emergency.</text></paragraph></subsection> 
<subsection id="H02023E1AF09749F3939DB7FFE2A11C00"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to promote the activities of nonprofit volunteer pilot organizations flying for public benefit and to sustain the availability of the services that such organizations provide, including transportation at no cost to financially needy medical patients for medical treatment, evaluation, and diagnosis, as well as other flights of compassion and flights for humanitarian and charitable purposes.</text></subsection></section> 
<section id="H457319B4E19C4D9B96F273ECE3924CAE"><enum>3.</enum><header>Liability protection for nonprofit volunteer pilot organizations flying for public benefit and to pilots and staff of such organizations</header><text display-inline="no-display-inline">Section 4 of the Volunteer Protection Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14503">42 U.S.C. 14503</external-xref>) is amended—</text> 
<paragraph id="HFA197C1BBB8B4809A43D6B1E77E0C466"><enum>(1)</enum><text>in subsection (a)(4)—</text> 
<subparagraph id="HFD799D83C9214CBC82041EF790041CA9"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph> 
<subparagraph id="H639DCB71917D47C49EA125EE489F84A5"><enum>(B)</enum><text>by inserting <quote>(A)</quote> after <quote>(4)</quote>;</text></subparagraph> 
<subparagraph id="HC33CDDD1FF6D4CF4AD9414242678296D"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> 
<subparagraph id="HBA194E1244F04F38B2A31B39E07FC72B"><enum>(D)</enum><text>by adding at the end the following:</text>

<subparagraph indent="paragraph" id="H2B4D375653F94B7900B73FD6F7D1E685"><enum>(B)</enum><text display-inline="yes-display-inline">the harm was caused by a volunteer of a nonprofit volunteer pilot organization that flies for public benefit, while the volunteer was flying in furtherance of the purpose of the organization and was operating an aircraft for which the volunteer was properly licensed and insured, unless the conduct constitutes a Federal crime of terrorism (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2332b">section 2332b(g)(5)</external-xref> of title 18, United States Code) or an act of domestic terrorism (as such term is defined in section 2331 of such title), or unless the entity has been convicted of an offense under section 2339A of such title.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H463D022EDFEA443BBC7977C81DD4E485" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H067DF0C5FFD444C0ABB5C191B808FD97"><enum>(A)</enum><text>by amending the heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Concerning responsibility of volunteers</header-in-text></quote>; </text></subparagraph> 
<subparagraph id="H69897A5CA20846B89D2EEB24992CB873"><enum>(B)</enum><text>by inserting <quote>(1)</quote> before <quote>Nothing</quote>; and</text></subparagraph> 
<subparagraph id="H1E5CEE911EEF48C6812E2029D8E26E85"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HFBF55A21E94F4E46B7C986CF053D9629"> 
<paragraph id="HA24430B33BB948F68F867BFA0400B257"><enum>(2)</enum><text display-inline="yes-display-inline">Nothing in this section shall be construed to affect the liability for negligence of a volunteer of a nonprofit volunteer pilot organization that flies for public benefit with respect to amounts within the limits of liability insurance coverage that such volunteer is required to obtain pursuant to subsection (a)(4)(B) for liability protection under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9D53249F8787444483669823749F8CC5"><enum>(3)</enum><text>in subsection (c)—</text> 
<subparagraph id="H51D65A848E4B46EA964F82111F8C9D61"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>Nothing</quote>; and</text></subparagraph> 
<subparagraph id="H4B461CE3BC2344A5A0F1E70843337366"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="subsection" id="H3F3B523656FD42BEB72DE823540093E0"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (1), a nonprofit volunteer pilot organization that flies for public benefit, and the staff, mission coordinators, officers, and directors (whether volunteer or otherwise) of such organization or a referring agency of such organization, shall not be liable with respect to harm caused to any person by a volunteer of such organization, while the volunteer is flying in furtherance of the purpose of the organization and is operating an aircraft for which the volunteer is properly licensed and has certified to such organization that such volunteer has in force insurance for operating such aircraft. Such referring agency shall include, among others, any nonprofit organization that provides disaster relief services that place staff, volunteers, evacuees, goods, supplies, or cargo on aircraft flights being coordinated by volunteer pilot organizations in circumstances of disaster response and relief.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H91EFFF04A8D84064A424E2000009E87B"><enum>4.</enum><header>Report by Attorney General</header> 
<subsection id="HDE2C20DD836D4486AB3FEE88808BAE2D"><enum>(a)</enum><header>Study required</header><text>The Attorney General shall carry out a study on the availability of insurance to nonprofit volunteer pilot organizations that fly for public benefit. In carrying out the study, the Attorney General shall make findings with respect to—</text> 
<paragraph id="H14312DA02C664FD9B5495209CF67B48"><enum>(1)</enum><text>whether nonprofit volunteer pilot organizations are able to obtain insurance;</text></paragraph> 
<paragraph id="HE96F69A9F22E44C6835B6FF08BEB6E39"><enum>(2)</enum><text>if no, then why;</text></paragraph> 
<paragraph id="H0768CA7625144C3497D07F83CB1E2299"><enum>(3)</enum><text>if yes, then on what terms such insurance is offered; and</text></paragraph> 
<paragraph id="H28A14332FD134B96BB262F18BCDC2F6F"><enum>(4)</enum><text>if the inability of nonprofit volunteer pilot organizations to obtain insurance has any impact on the associations’ ability to operate.</text></paragraph></subsection> 
<subsection id="H0BACBB4B25194019AD0449B252DDD1F8"><enum>(b)</enum><header>Report</header><text>After completing the study, the Attorney General shall submit to Congress a report on the results of the study. The report shall include the findings of the study and any conclusions and recommendations that the Attorney General considers appropriate.</text></subsection></section>
