<official-title>To amend the Controlled Substances Import and Export Act to provide authority to the Attorney General to authorize any controlled substance that is in schedule I or II or is a narcotic drug in schedule III or IV to be exported from the United States to a country for subsequent export from that country to another country, if certain conditions are met.</official-title>

<section id="H67B3D7E9B029420785C5C2AF378F1390" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Controlled Substances Export Reform Act of 2005</short-title></quote>. </text></section> 
<section id="H6448B2871C674235ACC582B3DF04B400"><enum>2.</enum><header>Subsequent export of controlled substances</header><text display-inline="no-display-inline">Section 1003 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/953">21 U.S.C. 953</external-xref>) is amended by adding at the end the following subsection:</text> 
<quoted-block id="H36E21473E8A1439086C8231FAD7C2FA7" style="OLC"> 
<subsection id="HCF1E4ECC87F9498786A300E1A27765E6"><enum>(f)</enum><text>Notwithstanding subsections (a)(4) and (c)(3), the Attorney General may authorize any controlled substance that is in schedule I or II or is a narcotic drug in schedule III or IV to be exported from the United States to a country for subsequent export from that country to another country, if each of the following conditions is met:</text> 
<paragraph id="HC23CD24D55EA4448B91925F8D0341319"><enum>(1)</enum><text>Both the country to which the controlled substance is exported from the United States (referred to in this subsection as the <quote>first country</quote>) and the country to which the controlled substance is exported from the first country (referred to in this subsection as the <quote>second country</quote>) are parties to the Single Convention on Narcotic Drugs, 1961, and the Convention on Psychotropic Substances, 1971.</text></paragraph> 
<paragraph id="HA5F3B9C023544922B5B14CA432E01FC8"><enum>(2)</enum><text>The first country and the second country have each instituted and maintain, in conformity with such Conventions, a system of controls of imports of controlled substances which the Attorney General deems adequate.</text></paragraph> 
<paragraph id="HB8F129A20EE2473B8EF75D6942881073"><enum>(3)</enum><text>With respect to the first country, the controlled substance is consigned to a holder of such permits or licenses as may be required under the laws of such country, and a permit or license to import the controlled substance has been issued by the country.</text></paragraph> 
<paragraph id="H59298FE862AC41BEB0F35653BBB52EE5"><enum>(4)</enum><text>With respect to the second country, substantial evidence is furnished to the Attorney General by the person who will export the controlled substance from the United States that—</text> 
<subparagraph id="H82A4671EFEAC453DAEE1C112B3269200"><enum>(A)</enum><text display-inline="yes-display-inline">the controlled substance is to be consigned to a holder of such permits or licenses as may be required under the laws of such country, and a permit or license to import the controlled substance is to be issued by the country; and</text></subparagraph> 
<subparagraph id="H98F04A46AE0440E587A3FBD4E3D7C49B"><enum>(B)</enum><text>the controlled substance is to be applied exclusively to medical, scientific, or other legitimate uses within the country.</text></subparagraph></paragraph> 
<paragraph id="H8BB3F99A3F3D4A24BAE6BD8D46F9B8A0"><enum>(5)</enum><text>The controlled substance will not be exported from the second country.</text></paragraph> 
<paragraph id="H95A26B11010A4CB9009B591710AA85E2"><enum>(6)</enum><text>Within 30 days after the controlled substance is exported from the first country to the second country, the person who exported the controlled substance from the United States delivers to the Attorney General documentation certifying that such export from the first country has occurred.</text></paragraph> 
<paragraph id="H61C50E9012DA4926B93BBC87FD2FB37"><enum>(7)</enum><text>A permit to export the controlled substance from the United States has been issued by the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
