<official-title>To amend the Help America Vote Act of 2002 to allow all eligible voters to vote by mail in Federal elections.</official-title>

<section id="H0C99577928494E55AA7BBC2DCE7E9F80" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Right to Vote by Mail Act of 2005</short-title></quote>.</text></section> 
<section id="HE56C66107C81420DB5C3845F72DF6518"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H64238D72AD0A444A0041F1BFDD950800"><enum>(1)</enum><text display-inline="yes-display-inline">An inequity of voting rights exists in the United States because voters in some States have the universal right to vote by mail while voters in other States do not.</text></paragraph> 
<paragraph id="H4F9D6157DB9C468F84E4B82401CEC091"><enum>(2)</enum><text display-inline="yes-display-inline">Many voters often have work, family, or other commitments that make getting to polls on the date of an election difficult or impossible.</text></paragraph> 
<paragraph id="H804FF3E52A484824838BE1CC1350DEB4"><enum>(3)</enum><text>Allowing voters to vote by mail can lead to increased voter participation.</text></paragraph> 
<paragraph id="H6206A8D095404B17A4A786BC65923546"><enum>(4)</enum><text>Voting by mail is more convenient for many voters.</text></paragraph> 
<paragraph id="HBF3C8BA1DE6E44D49C58BF37C7B9643"><enum>(5)</enum><text>Voting by mail gives voters more time to consider their choices.</text></paragraph> 
<paragraph id="HDA83152DBF45468CB2C4244DD4B202FC"><enum>(6)</enum><text>Studies show that an overwhelming majority of voters prefer voting by mail as an alternative to going to the polls.</text></paragraph> 
<paragraph id="HCCCBEF9F7F0C4642BC951153B92C9731"><enum>(7)</enum><text>No evidence exists suggesting the potential for fraud in absentee balloting is greater than the potential for fraud by any other method of voting.</text></paragraph> 
<paragraph id="HC7F662D818EA4B00B68B32D324A3BAF3"><enum>(8)</enum><text>25 States currently allow universal absentee voting, which permits any voter to request a mail-in ballot without providing a reason for the request.</text></paragraph></section> 
<section id="HB24DC2A0B1F6415B91F319552088B8E2"><enum>3.</enum><header>Promoting Ability of Voters to Vote by Mail in Federal Elections</header> 
<subsection id="H6EE6F92068084A38B4A41E94B0C00388"><enum>(a)</enum><header>In General</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended by inserting after section 303 the following new section:</text>

<section id="HB332BED026E341CF90C422CE2C5CE94E"><enum>303A.</enum><header>Promoting Ability of Voters to Vote by Mail</header> 
<subsection id="HCB248D4793974AEF9CF209B9B22862F"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">If an individual in a State is eligible to cast a vote in an election for Federal office, the State may not impose any additional conditions or requirements on the eligibility of the individual to cast the vote in such election by mail, except to the extent that the State imposes a deadline for requesting the ballot and related voting materials from the appropriate State or local election official and for returning the ballot to the appropriate State or local election official.</text></subsection> 
<subsection id="HAB3FCEC20B6B4BD5A0060084A5C93564"><enum>(b)</enum><header>Effective Date</header><text>A State shall be required to comply with the requirements of subsection (a) with respect to elections for Federal office held in years beginning with 2006.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3DA25E04773A4A4190002E282F35817C"><enum>(b)</enum><header>Conforming Amendment Relating to Enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 303A</quote>.</text></subsection> 
<subsection id="H94CF69CD91CA487B89D3756ED8DCE6"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of contents for such Act is amended by inserting after the item relating to section 303 the following new item:</text>
