<section id="H5DDF014BE8974FD985FE9BB8003200F0" section-type="section-one"><enum>1.</enum><header>Requiring certain employers to participate in pilot program</header> 
<subsection id="H85D48F84D9BF4EE1A885F5DCE762618"><enum>(a)</enum><header>In general</header><text>Section 402(e)(1) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H5C05DB1578694D019469C90D65048DC" display-inline="no-display-inline"> 
<subparagraph id="H25E76E3DACCF4C7CB7F55867FD00102B"><enum>(C)</enum><header>Employers at critical infrastructure sites</header> 
<clause id="HE31B92AF41164B4E8534A85757173572"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any employer described in clause (ii) shall elect to participate in the basic pilot program described in section 403(a) and shall comply with the terms and conditions of such election.</text></clause> 
<clause id="H4CCDD22F5266476DA9235D3E782DA714"><enum>(ii)</enum><header>Employers described</header><text display-inline="yes-display-inline">An employer is described in this clause if the employer employs individuals working in a location that—</text> 
<subclause id="H00C19A752B264D58BCC4D255B726D000"><enum>(I)</enum><text>is a Federal, State, or local government building, a military base, a nuclear energy site, a weapon site, or an airport; or</text></subclause> 
<subclause id="HD26DAD3D659B43C5994C9F00EFC71FA4"><enum>(II)</enum><text>contains critical infrastructure (as defined in section 1016(e) of the Critical Infrastructure Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>)), as determined by the Secretary of Homeland Security in regulations.</text></subclause> </clause> 
<clause id="HCF6B4F5F326D49EF00E5B0E9211413EF"><enum>(iii)</enum><header>Regulations</header><text>The Secretary of Homeland Security shall promulgate regulations to assist employers in determining whether they are described in clause (ii)(I).</text></clause> 
<clause id="H00818B006EF0434DAA35EBE5F3B48E"><enum>(iv)</enum><header>Special rule for continuing access to critical infrastructure</header> 
<subclause id="H259142EFFF114B1CB17D299900DA5E40"><enum>(I)</enum><header>In general</header><text>It is unlawful for an employer described in clause (ii), after hiring an alien for employment in accordance with clause (i)— </text> 
<item id="HADD80582AF3343469E139B00E7EBAD5D"><enum>(aa)</enum><text>to authorize, or to continue to authorize, the alien’s access to critical infrastructure after having received a notification of nonconfirmation from the Commissioner of Social Security under subsection (e); or</text></item> 
<item id="H9062DF7BE2C24C19BADE081FD914BEB"><enum>(bb)</enum><text>to fail to notify any other person who, or entity that, has issued, or may issue, to the alien documentation authorizing such access that the employer has received such notification.</text></item></subclause> 
<subclause id="H19189862E4724536A9DE1238C545349D"><enum>(II)</enum><header>Enforcement</header><text display-inline="yes-display-inline">In the case of an employer who violates subclause (I), such violation shall be treated as a violation of section 274A(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(a)(2)</external-xref>) for purposes of applying the compliance investigation and enforcement procedures described in section 274A(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)</external-xref>).</text></subclause> 
<subclause id="HB34E60AD790A4A35B37979F9974532B3"><enum>(III)</enum><header>Resumption of authority to provide access</header><text>Subclause (I)(aa) shall cease to apply to an alien when the employer has received satisfactory verification (as determined by the Secretary of Homeland Security in regulations) that the alien is not an unauthorized alien (as defined in section 274A(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)(3)</external-xref>)) with respect to the employment. Upon the receipt of such satisfactory verification, the employer shall notify any person or entity previously notified under subclause (I)(bb) of such receipt.</text></subclause></clause></subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9367ADFA15E04526BACA333F1058D0E0"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect one year after the date of the enactment of this Act.</text></subsection></section> 
<section id="H8372B40A32D84A6B8555965CAD27F95F"><enum>2.</enum><header>Authorizing additional uses of employment eligibility confirmation system</header><text display-inline="no-display-inline">Section 404(h) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) is amended—</text> 
<paragraph id="H26437A0A5DFF4DDC90896617579B287E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>for any other purpose</quote> and all that follows through the period at the end and inserting the following: </text> 
<quoted-block style="OLC" id="H46BE4E54AE63414300C666568EF9D176" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">for any purpose other than—</quoted-block-continuation-text> 
<subparagraph id="H4173DD312004463BAA28D567F9E780F5"><enum>(A)</enum><text>as provided for under this subtitle, including paragraph (2);</text></subparagraph> 
<subparagraph id="H63EE464A58BE422A9517D9C1E1FCD41"><enum>(B)</enum><text>for enforcement of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) and sections 1001, 1028, 1546, and 1621 of title 18, United States Code;</text></subparagraph> 
<subparagraph id="HD0F7A6E470DA4852B1CBC1B6696F18DB"><enum>(C)</enum><text>for enforcement of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/301">42 U.S.C. 301 et seq.</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE977A9E7E4DC4D2CB400E56B7FFB1FB4"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph> 
<paragraph id="H73B3D2BBBDB14CEE9BB74C24D1454DDB"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text> 
<quoted-block style="OLC" id="HDE76564964ED4F4780002BE100F781A0" display-inline="no-display-inline"> 
<paragraph id="HB9A0B3BF62C34DA5B6845C2721259595"><enum>(2)</enum><header>Protection of critical infrastructure</header> 
<subparagraph id="H3C5501D3628F40078C08A03C7DE30348"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this section, the Secretary of Homeland Security may authorize or require any person or entity responsible for granting access to, protecting, securing, operating, administering, or regulating critical infrastructure (as defined in section 1016(e) of the Critical Infrastructure Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>)) to use the confirmation system to verify the citizenship or immigration status of an individual requesting documentation authorizing access to such infrastructure, to the extent that the Secretary determines that such use will assist in the protection of such infrastructure.</text></subparagraph> 
<subparagraph id="H02B1FE3DB69C44A6B7D9D5E7646CA87F"><enum>(B)</enum><header>Enforcement</header><text>In the case of a person or entity subject to a requirement imposed by the Secretary under subparagraph (A), if the person or entity fails to comply with such requirement, such failure shall be treated as a violation of section 274A(a)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(a)(1)(B)</external-xref>) for purposes of applying the compliance investigation and enforcement procedures described in section 274A(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
