<official-title>To amend the Internal Revenue Code of 1986 to simplify the determination and deduction of interest on qualified education loans.</official-title>

<section id="H73B95702714F4794A44D7FB31ED818E5" section-type="section-one"><enum>1.</enum><header>Treatment of origination fees and capitalized interest charges for qualified education loans</header> 
<subsection id="H45A7257CF53449959974F90794A35FDE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (e) of <external-xref legal-doc="usc" parsable-cite="usc/26/221">section 221</external-xref> of the Internal Revenue Code of 1986 (relating to special rules) is amended by adding at the end the following: </text>

<paragraph id="H11AA98C390614993B79D8036C0E01F02"><enum>(4)</enum><header>Loan origination fees</header><text display-inline="yes-display-inline">For purposes of this section—</text> 
<subparagraph id="HA67D95F465D3441988503BA5B2D8171"><enum>(A)</enum><header>Treatment as interest</header><text display-inline="yes-display-inline">Loan origination fees, other than fees for services or property—</text> 
<clause id="H459E5959056A44B1A24D62DCB8DF684D"><enum>(i)</enum><text>shall be treated as interest, and</text></clause> 
<clause id="H05A15710EF3147F98C4744A9967DEB55"><enum>(ii)</enum><text display-inline="yes-display-inline">shall accrue at the time the loan origination fees are deducted from the loan proceeds or otherwise are charged to or paid by the borrower.</text></clause></subparagraph> 
<subparagraph id="H82CAA693BC584FBE95E89E00108E1D5E"><enum>(B)</enum><header>Fees under certain Federal programs</header><text>Loan origination fees required under the Federal Family Education Loan Program and Federal Direct Loan Program under title IV of the Higher Education Act of 1965 shall be treated as interest for purposes of subparagraph (A). </text></subparagraph> </paragraph> 
<paragraph id="H9313348C3CE5462E97F1F31370C81249"><enum>(5)</enum><header>Accrual of interest</header><text>For purposes of this section, interest on a qualified education loan (other than loan origination fees) shall accrue in accordance with the stated terms of the loan.</text></paragraph> 
<paragraph id="H995C743EE57A41179DD0280622E80882"><enum>(6)</enum><header>Allocation of payments</header><text>For purposes of this section, a payment (other than payments of collection costs, late fees, and penalties, if any) is treated—</text> 
<subparagraph id="H95619DAAF13D480B829170DA3600B0A0"><enum>(A)</enum><text>first as a payment of interest to the extent of the interest that has accrued and remains unpaid as of the date the payment is due,</text></subparagraph> 
<subparagraph id="HFF5682C273E0434FAE91001E63BA212F"><enum>(B)</enum><text>second as a payment of any loan origination fees or capitalized interest, until such amounts have been reduced to zero, and</text></subparagraph> 
<subparagraph id="H5A2E82C26E824B589226C5A0CEC630C0"><enum>(C)</enum><text>third as a payment of principal.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H18AB90C92CD84E46B6337191383FA045"><enum>(b)</enum><header>Conforming amendment</header><text>Section 6050S(e) of such Code is amended by adding at the end the following new sentence: <quote>The term <term>interest</term> has the same meaning as when used in section 221.</quote>.</text></subsection> 
<subsection id="H3FAB9988379649C4A2B0C4A2D06367CC"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="H6CA2DF4943A440628DE39108C2D6B9EB"><enum>(1)</enum><header>In general</header><text>The amendment made by this section shall apply to taxable years ending on or after December 31, 2005.</text></paragraph> 
<paragraph id="HA8308ABED13A449DB9902E6CB6813972"><enum>(2)</enum><header>Special rule for interest reporting</header><text display-inline="yes-display-inline">The reporting under <external-xref legal-doc="usc" parsable-cite="usc/26/6050S">section 6050S</external-xref> of the Internal Revenue Code of 1986 with respect to capitalized interest and origination fees in accordance with the amendments made by this section shall not be required for loans made prior to September 1, 2004.</text></paragraph></subsection></section>
