<official-title>To amend the Internal Revenue Code of 1986 to exclude from gross income amounts paid on behalf of Federal employees under Federal student loan repayment programs, and for other purposes.</official-title>

<section id="H9D5E8CBDCE784C93B03078C868C5E55F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Generating Opportunity by Forgiving Educational Debt for Service Act of 2005</short-title></quote>.</text></section> 
<section id="H89766B80A7AE443FACD8181FFDF89200" section-type="subsequent-section"><enum>2.</enum><header>Exclusion for student loan repayments by the Federal Government</header> 
<subsection id="H7A622F8122764AE399CA49AFD230284D"><enum>(a)</enum><header>Exclusion from gross income</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/108">Section 108(f)</external-xref> of the Internal Revenue Code of 1986 (relating to student loans) is amended by adding at the end the following:</text>

<paragraph id="HC3FEBC02B322463586C6005C4356CED"><enum>(5)</enum><header>Student loan repayments by Federal Government</header><text>In the case of an individual, gross income does not include any payments made by the Federal Government on behalf of such individual under—</text> 
<subparagraph id="HE8A773F4491448ABB08553DD00ABD070"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/5/5379">section 5379</external-xref> of title 5, United States Code, or</text></subparagraph> 
<subparagraph id="H4739EEF3FE3F45E195A8892433BD4C3E"><enum>(B)</enum><text>any other similar Federal program for its employees.</text></subparagraph></paragraph><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="HABE7AE3E648F4F0ABCB626E9D73300E2"><enum>(b)</enum><header>Exclusion from wages</header> 
<paragraph id="HAC9E7F4C52E0420081BDE1198300414D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3121(a) of such Code (defining wages) is amended by striking <quote>or</quote> at the end of paragraph (21), by striking the period at the end of paragraph (22) and inserting <quote>; or</quote>, and by adding at the end the following:</text>

<paragraph id="H4C7832C49FC146FFBC990081001ECEF5"><enum>(2)</enum><header><act-name parsable-cite="SSA">Social Security Act</act-name></header><text>Section 209(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/409">42 U.S.C. 409(a)</external-xref>) is amended by striking <quote>or</quote> at the end of paragraph (18), by striking the period at the end of paragraph (19) and inserting <quote>; or</quote>, and by adding at the end the following:</text>

<paragraph id="H1889AFB35E164023944B6EEA994CBE69"><enum>(20)</enum><text>Any payment excluded from gross income under <external-xref legal-doc="usc" parsable-cite="usc/26/108">section 108(f)(4)</external-xref> of the Internal Revenue Code of 1986 (relating to student loan repayments by Federal Government).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC24BDC838ED740609586E96B0545E3A4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to payments made in taxable years beginning after December 31, 2004.</text></subsection></section> 
<section id="H0A70E207277249AABC645C21A82E245F"><enum>3.</enum><header>Reporting requirement</header> 
<subsection id="H960D3228F99C4A20861D3F3EC21660F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/5379">Section 5379(h)(2)</external-xref> of title 5, United States Code, is amended by inserting <quote>and the agencies that have not</quote> after <quote>the agencies that have</quote>.</text></subsection> 
<subsection id="H8371C95DE05148EFACB3E48F0038FB25"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to reports submitted after the end of the 3-month period beginning on the date of enactment of this Act.</text></subsection></section>
