<section id="H772E46538DA4428E8F83FDA409E43B2B" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terrorist Penalties Enhancement Act of 2005</short-title></quote>.</text></section> 
<section id="HBD97602DA1FE4D47A450C1E8007E3112"><enum>2.</enum><header>Penalties for terrorist offenses resulting in death; denial of Federal benefits to terrorists</header> 
<subsection id="H6FB5885A74B74635BD9F69B8D1452F21"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H5693BF6F05504C128E9600E9C5DB1693" style="USC"> 
<section id="H3E393025B7824301B9BAC85F25DC78A9"><enum>2339E.</enum><header>Terrorist offenses resulting in death</header> 
<subsection id="H0FEAF4F09DA34162BC43086F089BA427"><enum>(a)</enum><text>Whoever, in the course of committing a terrorist offense, engages in conduct that results in the death of a person, shall be punished by death or imprisoned for any term of years or for life.</text></subsection> 
<subsection id="H3E48B7C47413467DBAD5D33BEFEF460"><enum>(b)</enum><text>As used in this section, the term <quote>terrorist offense</quote> means—</text> 
<paragraph id="H2BC6971C57784510B76886774432FDB9"><enum>(1)</enum><text>a Federal felony offense that is—</text> 
<subparagraph id="H44AEBE20C0244AD483EA00BB04F3B82"><enum>(A)</enum><text>a Federal crime of terrorism as defined in section 2332b(g) except to the extent such crime is an offense under section 1363; or</text></subparagraph> 
<subparagraph id="HBCCE39F1F0B147B2008C1E3D6E1BAFB5"><enum>(B)</enum><text>an offense under this chapter, section 175, 175b, 229, or 831, or section 236 of the Atomic Energy Act of 1954; or</text></subparagraph></paragraph> 
<paragraph id="H20A77899999D4DF0BCD19764C036ECD1"><enum>(2)</enum><text>a Federal offense that is an attempt or conspiracy to commit an offense described in paragraph (1).</text></paragraph></subsection></section> 
<section id="H1769A767039746D1984E0272AFACA00"><enum>2339F.</enum><header>Denial of Federal benefits to terrorists</header> 
<subsection id="HF5ED861ACCBD4CD287001BC967B24642"><enum>(a)</enum><text>An individual or corporation who is convicted of a terrorist offense (as defined in section 2339E) shall, as provided by the court on motion of the Government, be ineligible for any or all Federal benefits for any term of years or for life.</text></subsection> 
<subsection id="HC8FC00CB92D3492EBF5B61D945FFCB6"><enum>(b)</enum><text>As used in this section, the term <quote>Federal benefit</quote> has the meaning given that term in section 421(d) of the Controlled Substances Act, and also includes any assistance or benefit described in section 115(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, with the same limitations and to the same extent as provided in section 115 of that Act with respect to denials of benefits and assistance to which that section applies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2529D7F31B904BDCBA85AEDCFD82FB40"><enum>(b)</enum><header>Conforming Amendment to Table of Sections</header><text>The table of sections at the beginning of the <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code, is amended by adding at the end the following new items:</text>

<toc-entry level="section">2339D. Terrorist offenses resulting in death</toc-entry> 
<toc-entry level="section">2339E. Denial of federal benefits to terrorists</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4AF622410E6842C3B0B0D892D952156B"><enum>(c)</enum><header>Aggravating Factor in Death Penalty Cases</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3592">Section 3592(c)(1)</external-xref> of title 18, United States Code, is amended by inserting <quote>section 2339D (terrorist offenses resulting in death),</quote> after <quote>destruction),</quote>.</text></subsection></section> 
<section id="H55C62DDE611146E0ADBAECCBADBFBF0"><enum>3.</enum><header>Death penalty in certain air piracy cases occurring before enactment of the Federal Death Penalty Act of 1994</header><text display-inline="no-display-inline">Section 60003 of the Violent Crime Control and Law Enforcement Act of 1994, (<external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), is amended, as of the time of its enactment, by adding at the end the following:</text> 
<quoted-block id="H9B6C061F9E8D4FBEB11E4424C1B3C584" style="OLC"> 
<subsection id="HBC06FF616CC14981866DF50612EC7050"><enum>(c)</enum><header>Death penalty procedures for certain previous aircraft piracy violations</header><text>An individual convicted of violating <external-xref legal-doc="usc" parsable-cite="usc/49/46502">section 46502</external-xref> of title 49, United States Code, or its predecessor, may be sentenced to death in accordance with the procedures established in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/228">chapter 228</external-xref> of title 18, United States Code, if for any offense committed before the enactment of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), but after the enactment of the Antihijacking Act of 1974 (<external-xref legal-doc="public-law" parsable-cite="pl/93/366">Public Law 93–366</external-xref>), it is determined by the finder of fact, before consideration of the factors set forth in sections 3591(a)(2) and 3592(a) and (c) of title 18, United States Code, that one or more of the factors set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(2)</external-xref> of title 49, United States Code, or its predecessor, has been proven by the Government to exist, beyond a reasonable doubt, and that none of the factors set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(1)</external-xref> of title 49, United States Code, or its predecessor, has been proven by the defendant to exist, by a preponderance of the information. The meaning of the term <quote>especially heinous, cruel, or depraved</quote>, as used in the factor set forth in former <external-xref legal-doc="usc" parsable-cite="usc/49/46503">section 46503(c)(2)(B)(iv)</external-xref> of title 49, United States Code, or its predecessor, shall be narrowed by adding the limiting language <quote>in that it involved torture or serious physical abuse to the victim</quote>, and shall be construed as when that term is used in <external-xref legal-doc="usc" parsable-cite="usc/18/3592">section 3592(c)(6)</external-xref> of title 18, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
