<section section-type="section-one" id="H14029E60E6914432860500E9D9CB512C" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open Air Drug Market Penalty Act of 2005</short-title></quote>.</text></section> 
<section id="HC9B314498BB44882AFBA8DC3238882C2"><enum>2.</enum><header>Penalties for open air drug markets</header> 
<subsection id="H5A83F3AD11E6474BAD29941888C84EC2"><enum>(a)</enum><header>In general</header><text>Part D of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" act-name="Controlled Substances Act" id="H285D9B16D4BA4A9B99D24E328DCA282"> 
<section id="HD93ABF43B46343EFAA3B156EC5F2BD01"><enum>423.</enum><header>Open air drug markets</header> 
<subsection display-inline="yes-display-inline" id="H7FC6C99EE768474488309F8B24B2EDA4"><enum>(a)</enum><text>Whoever commits a specified Federal drug offense, knowing that at least one other has committed a specified Federal drug offense—</text> 
<paragraph id="H2DDF237F5C894E28AF2430CCE5F9777D"><enum>(1)</enum><text>within 500 feet of the place the offense under this section takes place; and</text></paragraph> 
<paragraph id="H80FA100A4FE34F0188D3531CE1969EC8"><enum>(2)</enum><text>within a 48-hour period;</text></paragraph><continuation-text continuation-text-level="subsection">shall, in addition to any penalty imposed for the specified Federal drug offense, be imprisoned 5 years.</continuation-text></subsection> 
<subsection id="H106C5504BE4245DC9CA96CC61E2CDD00"><enum>(b)</enum><text>Notwithstanding any other provision of law, the court shall not place on probation or suspend the sentence of any person convicted for a violation of this section, nor shall the term of imprisonment imposed under this subsection run concurrently with any other term of imprisonment, including that imposed for the specified Federal drug offense.</text></subsection> 
<subsection id="H2BD87945D0664162BA16316875CD4773"><enum>(c)</enum><text>As used in this section, the term <term>specified Federal drug offense</term> means a Federal offense—</text> 
<paragraph id="HD18DE0472EC64117A4E968B90E5EFB6"><enum>(1)</enum><text>of which an element is the distribution or attempted distribution of a controlled substance; and</text></paragraph> 
<paragraph id="HBB44971330A34BF388764FD7DB51D903"><enum>(2)</enum><text>for which the maximum term of imprisonment that may be imposed equals or exceeds 5 years.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEBD32E4BB76947A7ABC45CB17B515FC9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for title II of the <act-name parsable-cite="CDAPCA70">Comprehensive Drug Abuse Prevention and Control Act of 1970</act-name> is amended by inserting after the item relating to section 422 the following new item:</text>
