<official-title>To amend the Social Security Act to require that anticipated child support be held in trust on the sale or refinancing of certain real property of an obligated parent.</official-title>

<section section-type="section-one" id="HD1659090DA49429FA5D4F242B6FDDF41" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Support Reserve Trust Act</short-title></quote>. </text></section> 
<section id="H34AFED66FA354ECC00A71748C66BE6E"><enum>2.</enum><header>State obligation to provide child support reserve trust system</header><text display-inline="no-display-inline">Section 454 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654</external-xref>) is amended—</text> 
<paragraph id="H761DAEC2896B4BA9BB3620C7B8DEF2DC"><enum>(1)</enum><text>in paragraph (32) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HA99B2A3049284624B6B72115CCF007F"><enum>(2)</enum><text>in paragraph (33) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HBCB8DF4E6D684ED39FC4948FF4879BAA"><enum>(3)</enum><text>by inserting after paragraph (33) the following new paragraph:</text>

<paragraph id="H8B67BEFBAFC14FF0AA8E1C30389650B2"><enum>(34)</enum><text>provide that, on and after January 1, 2006, the State agency will have in effect a State reserve trust system that meets the requirements of section 454C.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5368E1158B084321B73DF03024C9E17"><enum>3.</enum><header>Requirements of child support reserve trust system</header><text display-inline="no-display-inline">The <act-name parsable-cite="SSA">Social Security Act</act-name> is amended by inserting after section 454B (<external-xref legal-doc="usc" parsable-cite="usc/42/654b">42 U.S.C. 654b</external-xref>) the following new section:</text>

<section id="HC9B3C75B11CE48C2A55678A0D3E9A308"><enum>454C.</enum><header>Reserve trust system</header> 
<subsection id="H9FBD3EF5896340E500B572EC9F83A6A6"><enum>(a)</enum><header>In general</header><text>In order for a State to meet the requirements of this section, the State must—</text> 
<paragraph id="H88FDBCC727EC480C8295DFAC6EC34376"><enum>(1)</enum><text>have in effect laws requiring the use of the procedures described in subsection (b); and</text></paragraph> 
<paragraph id="H21E1A9AD38F041BAB6DE1066A9118046"><enum>(2)</enum><text>establish and operate a unit (which shall be known as the State reserve trust unit) that has authority to carry out, and shall carry out, such laws and procedures.</text></paragraph></subsection> 
<subsection id="HF42A9D96B1354DD6875D10A3EE8E0017"><enum>(b)</enum><header>Required procedures</header><text>The procedures described in this subsection are procedures to carry out the following:</text> 
<paragraph id="HA3B413B041144B31A011128ED8F56743"><enum>(1)</enum><header>Withholding of anticipated future child support</header><text>On any sale or refinancing by a person of any real property in the State against which a lien for amounts of overdue support owed by the person has ever arisen, without regard to whether such lien has ever been extinguished, the State reserve trust unit shall—</text> 
<subparagraph id="HBDBE76FF09954E65B95C49E37C0283AB"><enum>(A)</enum><text>withhold the net proceeds of the person from the sale or refinancing;</text></subparagraph> 
<subparagraph id="HD40CC7AC73EC46CCB3E21DC8F538E700"><enum>(B)</enum><text>apply the net proceeds withheld under subparagraph (A) to any overdue support owed by the person;</text></subparagraph> 
<subparagraph id="HB41C2640284D485991FF00C12DFAC28E"><enum>(C)</enum><text>determine the anticipated future child support of the person;</text></subparagraph> 
<subparagraph id="H35970C61844F41C5A0A22400F7C3900"><enum>(D)</enum><text>hold in trust, for the benefit of the child or children for whom the person has a support obligation, an amount equal to the lesser of—</text> 
<clause id="HFB9F298CA41C4CDFB784DE373C25F969"><enum>(i)</enum><text>the anticipated future child support determined under subparagraph (C); and</text></clause> 
<clause id="H883B33285A7F4C349BDE08BB220039BE"><enum>(ii)</enum><text>the net proceeds withheld under subparagraph (A), as reduced by any application of such proceeds under subparagraph (B); and</text></clause></subparagraph> 
<subparagraph id="HDBFEC43B157443BE9EEC74C33E46BC1"><enum>(E)</enum><text>distribute to the person any amounts not held in trust under subparagraph (D).</text></subparagraph></paragraph> 
<paragraph id="H85569769098442768863ADEA8BF419E7"><enum>(2)</enum><header>Application of amounts withheld to overdue child support</header><text>If a person owes overdue child support with respect to a child, and the State reserve trust unit holds in trust amounts withheld from the person for the benefit of the child, the State reserve trust unit shall promptly apply such amounts to satisfy such overdue child support, if the State reserve trust unit determines that all other remedies available under the laws of the State are insufficient to satisfy the overdue child support.</text></paragraph> 
<paragraph id="HE91C1C91F2DD4F5191C1137132D25154"><enum>(3)</enum><header>Adjustment of amounts withheld</header><text>If the State reserve trust unit holds in trust amounts withheld from a person for the benefit of a child, and the support obligation of the person with respect to the child is adjusted under otherwise available State procedures, the State reserve trust unit shall promptly—</text> 
<subparagraph id="H7A27AAD89EA0430D8E6E26A30419F400"><enum>(A)</enum><text>redetermine the anticipated future child support of the person with respect to the child; and</text></subparagraph> 
<subparagraph id="H306AA113BE1640DEAE66EBD6005488A7"><enum>(B)</enum><text>if the amounts held in trust are less than the anticipated future child support as redetermined under subparagraph (A), distribute the difference to the person.</text></subparagraph></paragraph> 
<paragraph id="HDC41EDD9575B452AB06B665014E77099"><enum>(4)</enum><header>Termination of trust</header><text>If the State reserve trust unit holds in trust amounts withheld from a person for the benefit of a child, the State reserve trust unit shall distribute the amounts to the person if—</text> 
<subparagraph id="HAFD18A667C9240369FC22002EBB67311"><enum>(A)</enum><text>the person does not owe overdue child support with respect to the child; and</text></subparagraph> 
<subparagraph id="HB305401ABFFC4360969E5F055725F495"><enum>(B)</enum><text>the support obligation of the person with respect to the child has finally ceased.</text></subparagraph></paragraph></subsection> 
<subsection id="H5B94A19F0DBC47B39100A9B65F3890F7"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> 
<paragraph id="H29F1EFBF13754275B8355C16D3D5019E"><enum>(1)</enum><header>Anticipated future child support</header><text>The term <term>anticipated future child support</term> means the present value of each child support payment that will come due under the support obligation of the person, assuming that the support obligation will finally cease solely because the child has attained an age requiring the termination of the support obligation.</text></paragraph> 
<paragraph id="H6D612BA3035A4869941CA3228E32B800"><enum>(2)</enum><header>Finally cease</header><text>The term <term>finally cease</term> means to cease—</text> 
<subparagraph id="H5FB0E5D3FDB74413999D6E7151D91E80"><enum>(A)</enum><text>because the person or the child has died;</text></subparagraph> 
<subparagraph id="H1B2424BB0EE8448F9E42B8DA118DFFE6"><enum>(B)</enum><text>because the child has attained an age requiring the termination of the support obligation;</text></subparagraph> 
<subparagraph id="H1A9F06CBDED349AD9DEFC68D19333C11"><enum>(C)</enum><text>because the relationship of parent and child has been terminated by a final judicial act, such as an order establishing nonpaternity or an order emancipating the child; or</text></subparagraph> 
<subparagraph id="H33236FF915B84F3D916F95A3AB57E09"><enum>(D)</enum><text>because of any other circumstance that results in cessation under State law that is permanent, substantial, and not solely a change in custody.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
