<section id="H4F7D30C751CC4555B710E8673E742291" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Access to Justice and Court Protection Act of 2005</short-title></quote>.</text></section> 
<section id="H0DC2F336AE3943B6AA71E21E828EF099" section-type="subsequent-section"><enum>2.</enum><header>Penalties for influencing, impeding, or retaliating against judges and other officials by threatening or injuring a family member</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/115">Section 115</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HEE975EF25339491081EEE7C0CB0CA25" display-inline="no-display-inline"><enum>(1)</enum><text>in each of subparagraphs (A) and (B) of subsection (a)(1), by inserting <quote>federally funded public safety officer (as defined for the purposes of section 1123)</quote> after <quote>Federal law enforcement officer,</quote>;</text></paragraph> 
<paragraph id="H04A698C72B344BDE83C46221C4E5DCC8"><enum>(2)</enum><text>so that subsection (b) reads as follows:</text>

<subsection id="HA47C0BB5392D408580D650DF87D2407"><enum>(b)</enum> 
<paragraph id="HBFC38003A3D64E289746111EDD964E52" display-inline="yes-display-inline"><enum>(1)</enum><text>Except as provided in paragraph (2), the punishment for an offense under this section is as follows:</text> 
<subparagraph id="H54693C7FCDCB460981C9269168576B96" display-inline="no-display-inline" indent="up1"><enum>(A)</enum><text>The punishment for an assault in violation of this section is the same as that provided for a like offense under section 111.</text></subparagraph> 
<subparagraph id="H95D69F2ED20B467EA1C4F7D8A6C975BF" indent="up1"><enum>(B)</enum><text>The punishment for a kidnapping, attempted kidnapping, or conspiracy to kidnap in violation of this section is the same as provided for a like violation in section 1201.</text></subparagraph> 
<subparagraph id="HEBC65C85E33645F4BBD42059A95B2F39" indent="up1"><enum>(C)</enum><text>The punishment for a murder, attempted murder, or conspiracy to murder in violation of this section is the same as provided for a like offense under section 1111, 1113, and 1117.</text></subparagraph> 
<subparagraph id="HE021977EED084F8AB1005CB1B4E6C0E4" indent="up1"><enum>(D)</enum><text>A threat made in violation of this section shall be punished by a fine under this title or imprisonment for not more than 10 years, or both.</text></subparagraph></paragraph> 
<paragraph indent="subsection" id="H08F9399C84094D34AF3F7DD420FCC862"><enum>(2)</enum><text>If the victim of the offense under this section is an immediate family member of a United States judge, a Federal law enforcement officer (as defined for the purposes of section 1114) or of a federally funded public safety officer (as defined for the purposes of section 1123), in lieu of the punishments otherwise provided by paragraph (1), the punishments shall be as follows:</text> 
<subparagraph id="H13CB5D0AE7154994B9BE38FB66122B79" display-inline="no-display-inline" indent="up1"><enum>(A)</enum><text>The punishment for an assault in violation of this section is as follows:</text> 
<clause id="H79B262E11EB14E0EB64D86C77CA6A59B"><enum>(i)</enum><text> If the assault is a simple assault, a fine under this title or a term of imprisonment for not more than one year, or both.</text></clause> 
<clause id="HDC8F796EA2D9424D845C81B36500DC10" display-inline="no-display-inline"><enum>(ii)</enum><text>If the assault resulted in bodily injury (as defined in section 1365), a fine under this title and a term of imprisonment for not less than one year nor more than 10 years.</text></clause> 
<clause id="H62CF71BFD6BA48F9B3EF0066A843E73E"><enum>(iii)</enum><text display-inline="yes-display-inline">If the assault resulted in substantial bodily injury (as defined in section 113), a fine under this title and a term of imprisonment for not less than 3 years nor more than 12 years.</text></clause> 
<clause id="H9387C416C162421882D5EE6926B88C3E"><enum>(iv)</enum><text display-inline="yes-display-inline">If the assault resulted in serious bodily injury (as defined in section 2119), a fine under this title and a term of imprisonment for not less than 10 years nor more than 30 years.</text></clause></subparagraph> 
<subparagraph id="HA50293BE58884D7AB863634B7CCD4B86" indent="up1"><enum>(B)</enum><text>The punishment for a kidnapping, attempted kidnapping, or conspiracy to kidnap in violation of this section is a fine under this title and imprisonment for any term of years not less than 30, or for life.</text></subparagraph> 
<subparagraph id="HD3E3A823B87E4ED39100C721FCD7D159" indent="up1"><enum>(C)</enum><text>The punishment for a murder, attempted murder, or conspiracy to murder in violation of this section is a fine under this title and imprisonment for any term of years not less than 30, or for life, or, if death results, the offender may be sentenced to death.</text></subparagraph> 
<subparagraph id="H8E2573F8A87843AF8D5BD8CC61FA3DDF" indent="up1"><enum>(D)</enum><text>A threat made in violation of this section shall be punished by a fine under this title and imprisonment for not less than one year nor more than 10 years.</text></subparagraph> 
<subparagraph id="HE67DE389B2BB47728E00ED89C8658E77" indent="up1"><enum>(E)</enum><text>If a dangerous weapon was used during and in relation to the offense, the punishment shall include a term of imprisonment of 5 years in addition to that otherwise imposed under this paragraph.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBD4154DB7F334D2596634BA982ECC9B"><enum>3.</enum><header>Penalties for certain assaults</header> 
<subsection id="HF323E9CCBF944677A35B3F23CA51C7C8"><enum>(a)</enum><header>Inclusion of federally funded public safety officers</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/111">Section 111(a)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H6262BF6493EC4135BCCCF39151BBD342"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or a federally funded public safety officer (as defined in section 1123)</quote> after <quote>1114 of this title</quote>; and </text></paragraph> 
<paragraph id="H5464CC7A0D5A4A11AAA7CBCABF4BEE8"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>or a federally funded public safety officer (as defined in section 1123)</quote> after <quote>1114</quote>. </text></paragraph></subsection> 
<subsection id="HD9F66B2E1D954572A5C6EDEB43237044"><enum>(b)</enum><header>Alternate penalty where victim is a United States judge, a Federal law enforcement officer, or federally funded public safety officer</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/111">Section 111</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="HE99EF195E65043160009588006C73F15"> 
<subsection id="H355D0169D4564E14899B3BAC031DD105"><enum>(c)</enum><header>Alternate penalty where victim is a United States judge, a Federal law enforcement officer, or federally funded public safety officer</header> 
<paragraph id="HF65FC232846744BDA2BA63051EDB71B2" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), if the offense is an assault and the victim of the offense under this section is a United States judge, a Federal law enforcement officer (as defined for the purposes of section 1114) or of a federally funded public safety officer (as defined for the purposes of section 1123), in lieu of the penalties otherwise set forth in this section, the offender shall be subject to a fine under this title and—</text> 
<subparagraph id="H33AA858EF19F46CFBA09C487C0C1F455" indent="up1"><enum>(A)</enum><text>If the assault is a simple assault, a fine under this title or a term of imprisonment for not more than one year, or both.</text></subparagraph> 
<subparagraph id="H4754DD5D5C164E559900833D7247B9D8" indent="up1"><enum>(B)</enum><text>if the assault resulted in bodily injury (as defined in section 1365), shall be imprisoned not less than one nor more than 10 years;</text></subparagraph> 
<subparagraph id="H45F26BCA1AD043D5A6A4C68423D8753" indent="up1"><enum>(C)</enum><text>if the assault resulted in substantial bodily injury (as defined in section 113), shall be imprisoned not less than 3 nor more than 12 years; and</text></subparagraph> 
<subparagraph id="H008021716C3746E8A0C03EA95AF3EA2" indent="up1"><enum>(D)</enum><text>if the assault resulted in serious bodily injury (as defined in section 2119), shall be imprisoned not less than 10 nor more than 30 years.</text></subparagraph></paragraph> 
<paragraph id="H3CD63F3FF310417D9244D59E4508FF21" indent="up1"><enum>(2)</enum><text>If a dangerous weapon was used during and in relation to the offense, the punishment shall include a term of imprisonment of 5 years in addition to that otherwise imposed under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H9485AD86375648A1BD51FB63B4ED017F"><enum>4.</enum><header>Protection of federally funded public safety officers</header> 
<subsection id="H9D022E493B2241E18B00EF561E191F0"><enum>(a)</enum><header>Offense</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">Chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H5E271D9599C549E784E8B3AFBC7BB61" display-inline="no-display-inline"> 
<section id="H0016199006F34B040030D07EF2118678"><enum>1123.</enum><header>Killing of federally funded public safety officers</header> 
<subsection id="H10C4C9C3E48E43AB85C255E696208CDA"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever kills, or attempts or conspires to kill, a federally funded public safety officer while that officer is engaged in official duties, or arising out of the performance of official duties, or kills a former federally funded public safety officer arising out of the performance of official duties, shall be punished by a fine under this title and imprisonment for any term of years not less than 30, or for life, or, if death results, may be sentenced to death.</text></subsection> 
<subsection id="HB0651C803D664121A87588FFF7BA0311"><enum>(b)</enum><text>As used in this section—</text> 
<paragraph id="H7C386B79AD6B4C9EA1B981D3E88FEABF"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>federally funded public safety officer</quote> means a public safety officer for a public agency (including a court system, the National Guard of a State to the extent the personnel of that National Guard are not in Federal service, and the defense forces of a State authorized by <external-xref legal-doc="usc" parsable-cite="usc/32/109">section 109</external-xref> of title 32) that receives Federal financial assistance, of an entity that is a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, Guam, American Samoa, the Trust Territory of the Pacific Islands, the Commonwealth of the Northern Mariana Islands, or any territory or possession of the United States, an Indian tribe, or a unit of local government of that entity;</text></paragraph> 
<paragraph id="H7986121DCF6643A99497AAD146C287C4"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>public safety officer</quote> means an individual serving a public agency in an official capacity, as a judicial officer, as a law enforcement officer, as a firefighter, as a chaplain, or as a member of a rescue squad or ambulance crew;</text></paragraph> 
<paragraph id="H1DD93ACB16234C49BD5F5BCFDF394491"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>judicial officer</quote> means a judge or other officer or employee of a court, including prosecutors, court security, pretrial services officers, court reporters, and corrections, probation, and parole officers; and</text></paragraph> 
<paragraph id="HAC1B4E1D746D4B229BEFB514C0C39686"><enum>(4)</enum><text>the term <quote>firefighter</quote> includes an individual serving as an official recognized or designated member of a legally organized volunteer fire department and an officially recognized or designated public employee member of a rescue squad or ambulance crew; and</text></paragraph> 
<paragraph id="HA2062538924844718CC8A5084036406B"><enum>(5)</enum><text>the term <quote>law enforcement officer</quote> means an individual involved in crime and juvenile delinquency control or reduction, or enforcement of the laws.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H19F8A18E26DC48EDAC00AEC4619BF6FA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text>

<section id="HE598225699614FB4A9570887975D054E" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>General modifications of Federal murder crime and related crimes</header> 
<subsection id="H2A1BC4CCA3B4467C8F196E41BE2E5E94"><enum>(a)</enum><header>Murder amendments</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1111">Section 1111</external-xref> of title 18, United States Code, is amended in subsection (b), by inserting <quote>not less than 30</quote> after <quote>any term of years</quote>.</text></subsection> 
<subsection id="HC04FB7A561F4433D8D19FD4C00DC43A3"><enum>(b)</enum><header>Manslaughter amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1112">Section 1112(b)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H73EC16D8A4564ED59DE8B2C3CD60ACAA"><enum>(1)</enum><text>by striking <quote>ten years</quote> and inserting <quote>20 years</quote>; and</text></paragraph> 
<paragraph id="HCFA366D80DB1412E00B14D15B7DFA37C"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>six years</quote> and inserting <quote>10 years</quote>.</text></paragraph></subsection></section> 
<section id="H8DDCDEEA5B6344ADB824DA59D0290071"><enum>6.</enum><header>Modification of definition of offense and of the penalties for, influencing or injuring officer or juror generally</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1503">Section 1503</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HDEA813427F854DCFBC0001B7B7F7245D"><enum>(1)</enum><text>so that subsection (a) reads as follows:</text>

<subparagraph id="H9DA50A7BC3844C8AA263F49D8EB3D5EA" indent="up1"><enum>(A)</enum><text>corruptly, or by threats of force or force, endeavors to influence, intimidate, or impede a juror or officer in a judicial proceeding in the discharge of that juror or officer’s duty;</text></subparagraph> 
<subparagraph id="HEB7A75A7DB9C4DE6B1510098A83D7B17" indent="up1"><enum>(B)</enum><text>injures a juror or an officer in a judicial proceeding arising out of the performance of official duties as such juror or officer; or</text></subparagraph> 
<subparagraph id="H22EB7119881B4B1093DAC602DB50EBBA" indent="up1"><enum>(C)</enum><text>corruptly, or by threats of force or force, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice;</text></subparagraph><continuation-text continuation-text-level="paragraph">or attempts or conspires to do so, shall be punished as provided in subsection (b).</continuation-text></paragraph> 
<paragraph id="H06DCC929F1A041B295700014FF074800" indent="up1"><enum>(2)</enum><text>As used in this section, the term <quote>juror or officer in a judicial proceeding</quote> means a grand or petit juror, or other officer in or of any court of the United States, or an officer who may be serving at any examination or other proceeding before any United States magistrate judge or other committing magistrate.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H90468DB5217048DCA9D105D01404E683"><enum>(2)</enum><text>in subsection (b), by striking paragraphs (1) through (3) and inserting the following:</text>

<section id="HF7BA60BE631B42D2A800E9F81BC84FC2"><enum>7.</enum><header>Modification of tampering with a witness, victim, or an informant offense</header> 
<subsection id="H6E002DDC51ED495688403147AFA0C872"><enum>(a)</enum><header>Changes in penalties</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1512">Section 1512</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HFACECC9340D2431D81BA1200333B70A5"><enum>(1)</enum><text>in each of paragraphs (1) and (2) of subsection (a), insert <quote>or conspires</quote> after <quote>attempts</quote>;</text></paragraph> 
<paragraph id="H0C22797916664BBD83A873F1BDC7CE3D" display-inline="no-display-inline"><enum>(2)</enum><text>so that subparagraph (A) of subsection (a)(3) reads as follows:</text>

<subparagraph id="H78B37D22BDDF47F780476E321CB12CAC"><enum>(A)</enum><text>in the matter following clause (ii) of subparagraph (B) by striking <quote>20 years</quote> and inserting <quote>30 years</quote> ; and</text></subparagraph> 
<subparagraph id="H4A52BDD6165143448EA443933653DCCE"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>10 years</quote> and inserting <quote>20 years</quote>; </text></subparagraph></paragraph>

<paragraph id="HD031271D97B64E8E00C6B300656C3350"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (d), by striking <quote>one year</quote> and inserting <quote>20 years</quote>.</text></paragraph></subsection></section> 
<section id="H69A415E4B86B46C4BE1168F7BC7D4D2"><enum>8.</enum><header>Modification of retaliation offense</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1513">Section 1513</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H63A713BE20534625A6858C00AD0059E7"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>or conspires</quote> after <quote>attempts</quote>; </text></paragraph> 
<paragraph id="H3D52297128F84F2FA682A474C273A3B3"><enum>(2)</enum><text>in subsection (a)(1)(B)—</text> 
<subparagraph id="H7B0707BBEDD74DF9B39D21084F6200E2"><enum>(A)</enum><text>by inserting a comma after <quote>probation</quote>; and</text></subparagraph> 
<subparagraph id="H108AB83137D24973B2F592C528F1574C"><enum>(B)</enum><text>by striking the comma which immediately follows another comma;</text></subparagraph></paragraph>

<subsection id="H74F9895E1B064B21A793AA79B69C19F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available to carry out this part, the Attorney General may make grants to States, units of local government, and Indian tribes to create and expand witness protection programs in order to prevent threats, intimidation, and retaliation against victims of, and witnesses to, crimes.</text></subsection> 
<subsection id="H66883287CAA24D3F82C82966B46D1763"><enum>(b)</enum><header>Uses of funds</header><text>Grants awarded under this part shall be—</text> 
<paragraph id="H606674BB856F47F1A6F76515ED9262ED"><enum>(1)</enum><text>distributed directly to the State, unit of local government, or Indian tribe; and </text></paragraph> 
<paragraph id="HC357441DA3A24888BF746E2675F7F098"><enum>(2)</enum><text>used for the creation and expansion of witness protection programs in the jurisdiction of the grantee. </text></paragraph></subsection> 
<subsection id="H6DE33DDFC2FC41579775736C898F4200"><enum>(c)</enum><header>Preferential consideration</header><text>In awarding grants under this part, the Attorney General may give preferential consideration, if feasible, to an application from a jurisdiction that—</text> 
<paragraph id="H9E3A64161CDB4C668C223F4B7D74E55F"><enum>(1)</enum><text>has the greatest need for witness and victim protection programs; </text></paragraph> 
<paragraph id="H35D2C72143DB475BA6616E69B2333867"><enum>(2)</enum><text>has a serious violent crime problem in the jurisdiction; and</text></paragraph> 
<paragraph id="HE5BEBBDEC1EE47F89E33EF2407C8404D"><enum>(3)</enum><text>has had, or is likely to have, instances of threats, intimidation, and retaliation against victims of, and witnesses to, crimes. </text></paragraph></subsection> 
<subsection id="H1537916FF6BA4035B7F88DB2246177C3"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years 2006 through 2010.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection id="H228C574377194427AD1E71AA2C02C1B"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever knowingly, and with intent to harm, intimidate, or retaliate against a covered official makes restricted personal information about that covered official publicly available through the Internet shall be fined under this title and imprisoned not more than 5 years, or both.</text></subsection> 
<subsection id="HC1E2C6C45692431FBBBD0CB4B17AFFB"><enum>(b)</enum><text display-inline="yes-display-inline">It is a defense to a prosecution under this section that the defendant is a provider of Internet services and did not knowingly participate in the offense.</text></subsection> 
<subsection id="H31EFB56905FA43ECA617DA7530B0B4AE"><enum>(c)</enum><text display-inline="yes-display-inline">As used in this section—</text> 
<paragraph id="HAC5E89CB2D8A4ABC991632FA4C2FF2C8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>restricted personal information</quote> means, with respect to an individual, the Social Security number, the home address, home phone number, mobile phone number, personal email, or home fax number of, and identifiable to, that individual; and</text></paragraph> 
<paragraph id="H6EF787235E6F4779A7E3B48BC00C7D0"><enum>(2)</enum><text>the term <quote>covered official</quote> means—</text> 
<subparagraph id="HCD0243CC0AD549B5B4AA2BDD710001AC"><enum>(A)</enum><text>an individual designated in section 1114;</text></subparagraph> 
<subparagraph id="H180E44D847894DCA8B792649D6590014"><enum>(B)</enum><text display-inline="yes-display-inline">a public safety officer (as that term is defined in section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968); or</text></subparagraph> 
<subparagraph id="H1BA6CDD8A51F45F48B00105186ACEE13"><enum>(C)</enum><text display-inline="yes-display-inline">a grand or petit juror, witness, or other officer in or of, any court of the United States, or an officer who may be serving at any examination or other proceeding before any United States magistrate judge or other committing magistrate.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HBA8A3658F6DF49C1B05FD27DABD6CCB9"><enum>(b)</enum><header>State and local governments to consider courts</header><text>The Attorney General shall ensure that whenever a State or unit of local government applies for a grant from the Department of Justice, the State or unit demonstrate that, in developing the application and distributing funds, the State or unit—</text> 
<paragraph id="HEA11A597169E425A9314F604C9BF193"><enum>(1)</enum><text>considered the needs of the judicial branch of the State or unit, as the case may be; and</text></paragraph> 
<paragraph id="H846AF8387DE74B7E94B652F7233E69B8"><enum>(2)</enum><text>consulted with the chief judicial officer of the highest court of the State or unit, as the case may be.</text></paragraph></subsection></section> 
<section id="HF46BFE80EA2644A184D9307BF717E400"><enum>19.</enum><header>Report on security of Federal prosecutors</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Attorney General shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report on the security of assistant United States attorneys and other Federal attorneys arising from the prosecution of terrorists, violent criminal gangs, drug traffickers, gun traffickers, white supremacists, and those who commit fraud and other white-collar offenses. The report shall describe each of the following:</text> 
<paragraph id="H61E34DB25BC74B8CA6AEFBED50EC15BD"><enum>(1)</enum><text display-inline="yes-display-inline">The number and nature of threats and assaults against attorneys handling those prosecutions and the reporting requirements and methods.</text></paragraph> 
<paragraph id="H2B2A41FEF4674A77AF31001349DDE5AD"><enum>(2)</enum><text>The security measures that are in place to protect the attorneys who are handling those prosecutions, including measures such as threat assessments, response procedures, availability of security systems and other devices, firearms licensing (deputations), and other measures designed to protect the attorneys and their families.</text></paragraph> 
<paragraph id="HC32E04D69400479994D4E8948B83008B"><enum>(3)</enum><text display-inline="yes-display-inline">The Department of Justice’s firearms deputation policies, including the number of attorneys deputized and the time between receipt of threat and completion of the deputation and training process. </text></paragraph> 
<paragraph id="H9AD202EC40B542B58E2D1C2F71DF9872"><enum>(4)</enum><text>For each measure covered by paragraphs (1) through (3), when the report or measure was developed and who was responsible for developing and implementing the report or measure. </text></paragraph> 
<paragraph id="HDD7A8C1916304D3E8D1749B49935F741"><enum>(5)</enum><text>The programs that are made available to the attorneys for personal security training, including training relating to limitations on public information disclosure, basic home security, firearms handling and safety, family safety, mail handling, counter- surveillance, and self-defense tactics. </text></paragraph> 
<paragraph id="HB1DCE27A316B461E8D0997F13B13DA01"><enum>(6)</enum><text>The measures that are taken to provide the attorneys with secure parking facilities, and how priorities for such facilities are established—</text> 
<subparagraph id="H033DA8FC0D7A48928C3713DD44D2A345"><enum>(A)</enum><text>among Federal employees within the facility; </text></subparagraph> 
<subparagraph id="HB7E41EE646464A8DA2CAEC58DC783FC5"><enum>(B)</enum><text>among Department of Justice employees within the facility; and </text></subparagraph> 
<subparagraph id="H5A1CA9644D7D4DB2ABB44CC7BDA068C8"><enum>(C)</enum><text>among attorneys within the facility. </text></subparagraph></paragraph> 
<paragraph id="H632BE3896D05492992C8313E4D4DB8C"><enum>(7)</enum><text>The frequency such attorneys are called upon to work beyond standard work hours and the security measures provided to protect attorneys at such times during travel between office and available parking facilities. </text></paragraph> 
<paragraph id="HB7F9D76D82974230B497B8E1D169E823"><enum>(8)</enum><text>With respect to attorneys who are licensed under State laws to carry firearms, the Department of Justice’s policy as to—</text> 
<subparagraph id="HFEFFB8E697344C1DAA17C929ACD338CD"><enum>(A)</enum><text>carrying the firearm between available parking and office buildings;</text></subparagraph> 
<subparagraph id="H8A86D2650D354F7BA3329DB1EAD0CA8C"><enum>(B)</enum><text>securing the weapon at the office buildings; and</text></subparagraph> 
<subparagraph id="H9D0A6B57F8D54433BB29675FE0DFCA78"><enum>(C)</enum><text>equipment and training provided to facilitate safe storage at Department of Justice facilities. </text></subparagraph></paragraph> 
<paragraph id="H06E2A1038B644C85B13CEA9D117C4BCF"><enum>(9)</enum><text>The offices in the Department of Justice that are responsible for ensuring the security of the attorneys, the organization and staffing of the offices, and the manner in which the offices coordinate with offices in specific districts. </text></paragraph> 
<paragraph id="HC553DEE8799D482EA1D42F1F857C78A2"><enum>(10)</enum><text>The role, if any, that the United States Marshals Service or any other Department of Justice component plays in protecting, or providing security services or training for, the attorneys.</text></paragraph></section> 
<section id="H8335F281C9F546FC8BD9627DF93C45FF"><enum>20.</enum><header>Flight to avoid prosecution for killing peace officers</header> 
<subsection id="HC2AD9762CFC8412DB8F83416F1B278EB"><enum>(a)</enum><header>Flight</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/49">Chapter 49</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H65C5D6003C7440388CC74B06E97295F4"><enum>21.</enum><header>Special penalties for murder, kidnapping, and related crimes against Federal judges and Federal law enforcement officers</header> 
<subsection id="H86E30A5A451E41F09392382E3143A7F2"><enum>(a)</enum><header>Murder</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1114">Section 1114</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H22E5C4CED7DB4A9F985905CD30C5AC63"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Whoever</quote>; and</text></paragraph> 
<paragraph id="H708C1FAC468D4CE5BD965CA6B1B92FB2"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="USC" id="H44B20C5CA0AE4BFCB80018BCD44F108" display-inline="no-display-inline"> 
<subsection id="H97613448B9044EB4ABDB506D1F2C7CA6"><enum>(b)</enum><text display-inline="yes-display-inline">If the victim of a murder punishable under this section is a United States judge (as defined in section 115) or a Federal law enforcement officer (as defined in 115) the offender shall be punished by a fine under this title and imprisonment for any term of years not less than 30, or for life, or, if death results, may be sentenced to death.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6E8303B0EA4C4A15A312EC0C96D3EFE"><enum>(b)</enum><header>Kidnapping</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1201">Section 1201(a)</external-xref> of title 18, United States Code, is amended by adding at the end the following: <quote>If the victim of the offense punishable under this subsection is a United States judge (as defined in section 115) or a Federal law enforcement officer (as defined in 115) the offender shall be punished by a fine under this title and imprisonment for any term of years not less than 30, or for life, or, if death results, may be sentenced to death.</quote>.</text></subsection></section> 
<section section-type="subsequent-section" id="H568E80DA62A04310B1C0D598E1D2C987" display-inline="no-display-inline"><enum>22.</enum><header>Media coverage of court proceedings</header> 
<subsection id="H3B996A6117DC4E0600121B172410D8F3"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress makes the following findings:</text> 
<paragraph id="H62D99D37AC9346C0AB1E0821B97FF7E"><enum>(1)</enum><text>The right of the people of the United States to freedom of speech, particularly as it relates to comment on governmental activities, as protected by the first amendment to the Constitution, cannot be meaningfully exercised without the ability of the public to obtain facts and information about the Government upon which to base their judgments regarding important issues and events. As the United States Supreme Court articulated in <italic>Craig v. Harney</italic>, 331 U.S. 367 (1947), <quote>A trial is a public event. What transpires in the court room is public property.</quote>.</text></paragraph> 
<paragraph id="H43C6F8CC2DF9400D9926E14D1733F6D0"><enum>(2)</enum><text>The right of the people of the United States to a free press, with the ability to report on all aspects of the conduct of the business of government, as protected by the first amendment to the Constitution, cannot be meaningfully exercised without the ability of the news media to gather facts and information freely for dissemination to the public.</text></paragraph> 
<paragraph id="HA0069196314D47B7006BD42EDD7ECD33"><enum>(3)</enum><text>The right of the people of the United States to petition the Government to redress grievances, particularly as it relates to the manner in which the Government exercises its legislative, executive, and judicial powers, as protected by the first amendment to the Constitution, cannot be meaningfully exercised without the availability to the public of information about how the affairs of government are being conducted. As the Supreme Court noted in Richmond Newspapers, Inc. v. Commonwealth of Virginia (1980), <quote>People in an open society do not demand infallibility from their institutions, but it is difficult for them to accept what they are prohibited from observing.</quote>.</text></paragraph> 
<paragraph id="H3ED9E579713A4B0EB0E7050930379DB4"><enum>(4)</enum><text>In the twenty-first century, the people of the United States obtain information regarding judicial matters involving the Constitution, civil rights, and other important legal subjects principally through the print and electronic media. Television, in particular, provides a degree of public access to courtroom proceedings that more closely approximates the ideal of actual physical presence than newspaper coverage or still photography.</text></paragraph> 
<paragraph id="H2A28F073AA864BE3ADD54D8327835181"><enum>(5)</enum><text>Providing statutory authority for the courts of the United States to exercise their discretion in permitting televised coverage of courtroom proceedings would enhance significantly the access of the people to the Federal judiciary.</text></paragraph> 
<paragraph id="HF7F7E6F8E3FC489FB63190A73C00E0C3"><enum>(6)</enum><text>Inasmuch as the first amendment to the Constitution prevents Congress from abridging the ability of the people to exercise their inherent rights to freedom of speech, to freedom of the press, and to petition the Government for a redress of grievances, it is good public policy for the Congress affirmatively to facilitate the ability of the people to exercise those rights.</text></paragraph> 
<paragraph id="H04C6CA0AB7374173B41064995276A0FA"><enum>(7)</enum><text>The granting of such authority would assist in the implementation of the constitutional guarantee of public trials in criminal cases, as provided by the sixth amendment to the Constitution. As the Supreme Court stated in In re Oliver (1948), <quote>Whatever other benefits the guarantee to an accused that his trial be conducted in public may confer upon our society, the guarantee has always been recognized as a safeguard against any attempt to employ our courts as instruments of persecution. The knowledge that every criminal trial is subject to contemporaneous review in the forum of public opinion is an effective restraint on possible abuse of judicial power.</quote>.</text></paragraph></subsection> 
<subsection id="H8A82C0BF84BB407794F664599FBA00FE"><enum>(b)</enum><header>Authority of presiding judge to allow media coverage of court proceedings</header> 
<paragraph id="H3E6687A2A46E4D3DB044F9A228CDBBE4"><enum>(1)</enum><header>Authority of appellate courts</header><text>Notwithstanding any other provision of law, the presiding judge of an appellate court of the United States may, in his or her discretion, permit the photographing, electronic recording, broadcasting, or televising to the public of court proceedings over which that judge presides.</text></paragraph> 
<paragraph id="H9C19212988D840C58CB65434396036CF"><enum>(2)</enum><header>Authority of district courts</header> 
<subparagraph id="H55967062A39749A899155F39E3EFB415"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, any presiding judge of a district court of the United States may, in his or her discretion, permit the photographing, electronic recording, broadcasting, or televising to the public of court proceedings over which that judge presides.</text></subparagraph> 
<subparagraph id="HB0BB0234A2E143C89DC3EE893F1A803"><enum>(B)</enum><header>Obscuring of witnesses and jurors</header> 
<clause id="HE1B32115871A4CFBA093DEBD2D617385" display-inline="yes-display-inline"><enum>(i)</enum><text>Upon the request of any witness (other than a party) or a juror in a trial proceeding, the court shall order the face and voice of the witness or juror (as the case may be) to be disguised or otherwise obscured in such manner as to render the witness or juror unrecognizable to the broadcast audience of the trial proceeding.</text></clause> 
<clause id="HE08EF0FD027849009F2F5537E1A6DD6" indent="up1"><enum>(ii)</enum><text>The presiding judge in a trial proceeding shall inform—</text> 
<subclause id="H44C9D31E651E4F1AB2B6002C8759F246"><enum>(I)</enum><text>each witness who is not a party that the witness has the right to request that his or her image and voice be obscured during the witness’ testimony; and</text></subclause> 
<subclause id="HB7769A7A4B504B72944FCEBC6EA141FC"><enum>(II)</enum><text>each juror that the juror has the right to request that his or her image be obscured during the trial proceeding.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HFA9EBFC805BD48FE89E512CACDE5D7DD"><enum>(3)</enum><header>Advisory guidelines</header><text>The Judicial Conference of the United States is authorized to promulgate advisory guidelines to which a presiding judge, in his or her discretion, may refer in making decisions with respect to the management and administration of photographing, recording, broadcasting, or televising described in paragraphs (1) and (2).</text></paragraph></subsection> 
<subsection id="H62B00071C3364740BD77E9D50097E68C"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H994CF7C9F9764BE7A470915C3091E96B"><enum>(1)</enum><header>Presiding judge</header><text>The term <term>presiding judge</term> means the judge presiding over the court proceeding concerned. In proceedings in which more than one judge participates, the presiding judge shall be the senior active judge so participating or, in the case of a circuit court of appeals, the senior active circuit judge so participating, except that—</text> 
<subparagraph id="HAC2ACE6B44344FA19CE470CB24B9229D"><enum>(A)</enum><text>in en banc sittings of any United States circuit court of appeals, the presiding judge shall be the chief judge of the circuit whenever the chief judge participates; and</text></subparagraph> 
<subparagraph id="H7313B71A84CA4D23A983027646ECA7E9"><enum>(B)</enum><text>in en banc sittings of the Supreme Court of the United States, the presiding judge shall be the Chief Justice whenever the Chief Justice participates.</text></subparagraph></paragraph> 
<paragraph id="H7FD62A28C6D6456EBDE55500AAE8BE"><enum>(2)</enum><header>Appellate court of the United States</header><text>The term <term>appellate court of the United States</term> means any United States circuit court of appeals and the Supreme Court of the United States.</text></paragraph></subsection> 
<subsection id="HCFDDE373448D4826AD00E5F8CD2127F"><enum>(d)</enum><header>Sunset</header><text>The authority under subsection (b)(2) shall terminate on the date that is 3 years after the date of the enactment of this Act.</text></subsection></section> 
<section id="HA56FC530039E45D096AEE979CDEF251B"><enum>23.</enum><header>Funding for State courts to assess and enhance court security and emergency preparedness</header> 
<subsection id="HBD93B8C5B7C3412FB86EC995FD39A600"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General, through the Office of Justice Programs, shall make grants under this section to the highest State courts in States participating in the program, for the purpose of enabling such courts—</text> 
<paragraph id="HAC869F6487E542CB85960600ED03BA23"><enum>(1)</enum><text>to conduct assessments focused on the essential elements for effective courtroom safety and security planning; and</text></paragraph> 
<paragraph id="HA801DE2FC22144A98D0020DF15D1A2B8"><enum>(2)</enum><text>to implement changes deemed necessary as a result of the assessments.</text></paragraph></subsection> 
<subsection id="H68546A757FE14F0D9BB10137D4712F01"><enum>(b)</enum><header>Essential elements</header><text>As used in subsection (a)(1), the essential elements include, but are not limited to—</text> 
<paragraph id="H1058E93E94534606B6A206D0C78EE0B3"><enum>(1)</enum><text>operational security and standard operating procedures; </text></paragraph> 
<paragraph id="H4B3BFF98276147D5B23B70B27D486192"><enum>(2)</enum><text>facility security planning and self-audit surveys of court facilities; </text></paragraph> 
<paragraph id="HAA9BECFFDF384A90B9DCD7F21971CDD"><enum>(3)</enum><text>emergency preparedness and response and continuity of operations; </text></paragraph> 
<paragraph id="H9C9DBC4AD8A64AD594DD7B00CDCCD643"><enum>(4)</enum><text>disaster recovery and the essential elements of a plan; </text></paragraph> 
<paragraph id="H052BA447F5D546DA80697D71A74F8585"><enum>(5)</enum><text>threat assessment; </text></paragraph> 
<paragraph id="H28FA43B80A4E4413968678761B8EEB91"><enum>(6)</enum><text>incident reporting; </text></paragraph> 
<paragraph id="H53FD3D96606548B596B1A999B912006D"><enum>(7)</enum><text>security equipment; </text></paragraph> 
<paragraph id="H4457ECC47E214C239E98C2EC23D0A821"><enum>(8)</enum><text>developing resources and building partnerships; and </text></paragraph> 
<paragraph id="HC60257FAB1EF47A0BE1DE65927007BAA"><enum>(9)</enum><text>new courthouse design.</text></paragraph></subsection> 
<subsection id="H1C3C8DBD04614CBAAB8BC115A4BA78C5"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under this section, a highest State court shall submit to the Attorney General an application at such time, in such form, and including such information and assurances as the Attorney General shall require. </text></subsection> 
<subsection id="H98F5EEBAE1AB4098B041F64D9C33B72E"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years 2006 through 2010.</text></subsection></section> 
<section id="HD7505C60CAF74B36ACF9E024A3C8A0BA" section-type="subsequent-section"><enum>24.</enum><header>Additional amounts for United States Marshals Service to protect the judiciary</header><text display-inline="no-display-inline">In addition to any other amounts authorized to be appropriated for the United States Marshals Service, there are authorized to be appropriated for the United States Marshals Service to protect the judiciary, $20,000,000 for each of fiscal years 2006 through 2010 for—</text> 
<paragraph id="H7FA95484C1ED4E6AB2F32500D3B24821"><enum>(1)</enum><text>hiring entry-level deputy marshals for providing judicial security;</text></paragraph> 
<paragraph id="H99EAB6C6F9054510BEAEAFEDB077538"><enum>(2)</enum><text>hiring senior-level deputy marshals for investigating threats to the judiciary and providing protective details to members of the judiciary and Assistant United States Attorneys; and</text></paragraph> 
<paragraph id="H16720134D2294D5B88CA3B2805E17C21"><enum>(3)</enum><text>for the Office of Protective Intelligence, for hiring senior-level deputy marshals, hiring program analysts, and providing secure computer systems.</text></paragraph></section> 
<section id="H2B51D0F63621465981E579402908EC00" section-type="subsequent-section"><enum>25.</enum><header>Grants to States for threat assessment databases</header> 
<subsection id="H2D693428DCAD4BC6AAF7D900430594EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available to carry out this section, the Attorney General shall carry out a program under which the Attorney General makes grants to States for use by the State to establish and maintain a threat assessment database described in subsection (b).</text></subsection> 
<subsection id="HFF5F1A679A9C438191A265A00427C26C"><enum>(b)</enum><header>Database</header><text>For purposes of subsection (a), a threat assessment database is a database through which a State can—</text> 
<paragraph id="HC189058540904059AED069B234D6353E"><enum>(1)</enum><text>analyze trends and patterns in domestic terrorism and crime;</text></paragraph> 
<paragraph id="H13D6658F7A594E1FACB9B41539B559F"><enum>(2)</enum><text>project the probabilities that specific acts of domestic terrorism or crime will occur; and</text></paragraph> 
<paragraph id="H6902D5A6DDEC474FA1BD367E174ED017"><enum>(3)</enum><text>develop measures and procedures that can effectively reduce the probabilities that those acts will occur.</text></paragraph></subsection> 
<subsection id="HF9D38F792D254E24B1E2D245B16248C"><enum>(c)</enum><header>Core elements</header><text>The Attorney General shall define a core set of data elements to be used by each database funded by this section so that the information in the database can be effectively shared with other States and with the Department of Justice.</text></subsection> 
<subsection id="HEF540253835049C88BC5B625F2007100"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2009.</text></subsection></section> 
<section id="HC46C54482D954914A23DDE03D3F4C06" section-type="subsequent-section"><enum>26.</enum><header>Grants for young witness assistance</header> 
<subsection id="HB2B476FE4F644E19A2F994AF3962B170"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H516F5B51812B4F8E91D749EAB87793"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau of Justice Assistance.</text></paragraph> 
<paragraph id="H831A33B530FD48ABBEF29545111FA165"><enum>(2)</enum><header>Juvenile</header><text>The term <term>juvenile</term> means an individual who is 17 years of age or younger.</text></paragraph> 
<paragraph id="HFF2DF2CC67CA460B8F400471DBBEF7A0"><enum>(3)</enum><header>Young adult</header><text>The term <term>young adult</term> means an individual who is between the ages of 18 and 21.</text></paragraph> 
<paragraph id="HFCBBE37619334B1595E0DB066DF1C5C"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands.</text></paragraph></subsection> 
<subsection id="H7F53AB37960840A2BAC5B88DE822B40"><enum>(b)</enum><header>Program authorization</header><text>The Director may make grants to State and local prosecutors and law enforcement agencies in support of juvenile and young adult witness assistance programs, including State and local prosecutors and law enforcement agencies that have existing juvenile and adult witness assistance programs.</text></subsection> 
<subsection id="HF45F134E643C46AA87B5B8FD097D4E56"><enum>(c)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, State and local prosecutors and law enforcement officials shall—</text> 
<paragraph id="H29772FC511B745F48E2F843CA3CF2668"><enum>(1)</enum><text>submit an application to the Director in such form and containing such information as the Director may reasonably require; and</text></paragraph> 
<paragraph id="HCD8375022CAD468EB03932D2E257C8F9"><enum>(2)</enum><text>give assurances that each applicant has developed, or is in the process of developing, a witness assistance program that specifically targets the unique needs of juvenile and young adult witnesses and their families.</text></paragraph></subsection> 
<subsection id="H12CA4ED256CE4CE2801C968CD5D5B495"><enum>(d)</enum><header>Use of funds</header><text>Grants made available under this section may be used—</text> 
<paragraph id="HF940ADF3A1CF4604836B1193AB008449"><enum>(1)</enum><text>to assess the needs of juvenile and young adult witnesses;</text></paragraph> 
<paragraph id="H6DABA46B36A74A36812C786F62A3A2E"><enum>(2)</enum><text>to develop appropriate program goals and objectives; and</text></paragraph> 
<paragraph id="H2CB8560A8E5945809D91ED66704D8246"><enum>(3)</enum><text>to develop and administer a variety of witness assistance services, which includes—</text> 
<subparagraph id="HCC19F3A9597B47F69E69E651F65870AA"><enum>(A)</enum><text>counseling services to young witnesses dealing with trauma associated in witnessing a violent crime;</text></subparagraph> 
<subparagraph id="HB6334366F0AB40DA908B8DEE1CC277D6"><enum>(B)</enum><text>pre- and post-trial assistance for the youth and their family;</text></subparagraph> 
<subparagraph id="HDD7FB16C156A439580913D1C49B619FE"><enum>(C)</enum><text>providing education services if the child is removed from or changes their school for safety concerns;</text></subparagraph> 
<subparagraph id="H39B301BE9B7A494FB1F05DE9A99C1F5"><enum>(D)</enum><text>protective services for young witnesses and their families when a serious threat of harm from the perpetrators or their associates is made; and</text></subparagraph> 
<subparagraph id="HED7F306327F64DAD980005D985F00C8"><enum>(E)</enum><text>community outreach and school-based initiatives that stimulate and maintain public awareness and support.</text></subparagraph></paragraph></subsection> 
<subsection id="HD3396A71AFD948A6BA4443DFFB3BE0CD"><enum>(e)</enum><header>Reports</header> 
<paragraph id="H11CC5ADA32CA4F8FB8BC39F9F2BC2443"><enum>(1)</enum><header>Report</header><text>State and local prosecutors and law enforcement agencies that receive funds under this section shall submit to the Director a report not later than May 1st of each year in which grants are made available under this section. Reports shall describe progress achieved in carrying out the purpose of this section.</text></paragraph> 
<paragraph id="HF4D2D03BF68340339935D78114993BF"><enum>(2)</enum><header>Report to Congress</header><text>The Director shall submit to Congress a report by July 1st of each year which contains a detailed statement regarding grant awards, activities of grant recipients, a compilation of statistical information submitted by applicants, and an evaluation of programs established under this section.</text></paragraph></subsection> 
<subsection id="H016877B30E654B63B411A517CE5EE068"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2006, 2007, and 2008.</text></subsection></section>
