<subsection id="HECB42EB669864B2FAB003D56DF327964"><enum>(a)</enum><header>In general</header><text>Title 18, United States Code, is amended by inserting after chapter 65 the following:</text>

<section id="H9A0A8B9CA8D147BE8FDB6197773CF8E8"><enum>1371</enum><header>Jurisdiction and scope</header> 
<subsection id="H31ED96D45A91439DB68ED8EBAE7C3483"><enum>(a)</enum><header>In general</header><text>There is jurisdiction under section 3231 over an offense under this chapter if—</text> 
<paragraph id="H145139EF6CDD4B08AE87086BA4EA5D24"><enum>(1)</enum><text>the prohibited activity takes place within the United States, or in waters or submerged lands thereunder subject to the jurisdiction of the United States; or</text></paragraph> 
<paragraph id="H1DB77FF860484F64B5526C4574C08EBD"><enum>(2)</enum><text>the prohibited activity takes place outside the United States, and—</text> 
<subparagraph id="H9A4BBA3FFFA94C6C91D477C7B03D46B7"><enum>(A)</enum><text>an offender or a victim of the prohibited activity is a citizen of the United States;</text></subparagraph> 
<subparagraph id="H8963887F0138430D9C386B11ABD30014"><enum>(B)</enum><text>a citizen of the United States was on board a vessel to which this chapter applies; or</text></subparagraph> 
<subparagraph id="HC3E8436D10AC44E5A8C1284EDA778313"><enum>(C)</enum><text>the prohibited activity involves a vessel of the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="H4A3683CC688B4C09AD145C8354195B4D"><enum>(b)</enum><header>Applicability</header><text>Nothing in this chapter shall apply to otherwise lawful activities carried out by, or at the direction of, the United States Government.</text></subsection></section> 
<section id="HBCC6324933A3497FB6B6E44362E7CA3"><enum>1372.</enum><header>Destruction of vessel or maritime facility</header> 
<subsection id="H64FD89A3C58640E28F933000E0002BB3"><enum>(a)</enum><header>Offenses</header><text>It shall be unlawful for any person—</text> 
<paragraph id="H60C8D0C19356459FAB7E002ED76FE210"><enum>(1)</enum><text>to willfully—</text> 
<subparagraph id="H574BD323950E43A4B643EF8F27FCB947"><enum>(A)</enum><text>set fire to, damage, destroy, disable, or wreck any vessel; or</text></subparagraph> 
<subparagraph id="H9702B616B8904604A084D11565E684C6"><enum>(B)</enum><text>place or cause to be placed a destructive device or destructive substance in, upon, or in proximity to, or otherwise make or cause to be made an unworkable or unusable or hazardous to work or use, any vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/1/3">section 3</external-xref> of title 1), or any part or other materials used or intended to be used in connection with the operation of a vessel; or</text></subparagraph> 
<subparagraph id="HC1A6AE4C9786405DBBE26E4135E9AACD"><enum>(C)</enum><text>set fire to, damage, destroy, disable, or displace a destructive device or destructive substance in, upon, or in proximity to, any maritime facility, including any aid to navigation, lock, canal, or vessel traffic service facility or equipment, or interfere by force or violence with the operation of such maritime facility, if such action is likely to endanger the safety of any vessel in navigation;</text></subparagraph> 
<subparagraph id="HF5AFBBFF8D8045ECA0897600A616534C"><enum>(D)</enum><text>set fire to, damage, destroy, disable, or place a destructive device or destructive substance in, upon, or in proximity to any appliance, structure, property, machine, apparatus, or any facility or other material used or intended to be used in connection with the operation, maintenance, loading, unloading, or storage of any vessel or any passenger or cargo carried on, or intended to be carried on, any vessel;</text></subparagraph> 
<subparagraph id="H711037AA365C444BA3A66B00CD321D94"><enum>(E)</enum><text>perform an act of violence against or incapacitate an individual on a vessel, if such act of violence or incapacitation is likely to endanger the safety of the vessel or those on board;</text></subparagraph> 
<subparagraph id="HB4AAC28E6B5740B300BB45B9EB660000"><enum>(F)</enum><text>perform an act of violence against a person that causes or is likely to cause serious bodily injury in, upon, or in proximity to any appliance, structure, property, machine, apparatus, or any facility or other material used or intended to be used in connection with the operation, maintenance, loading, unloading, or storage of any vessel or any passenger or cargo carried or intended to be carried on any vessel; or</text></subparagraph> 
<subparagraph id="HE1946927BD32442296A47E8D50B46786"><enum>(G)</enum><text>communicate information, knowing the information to be false and under circumstances in which such information may reasonably be believed, thereby endangering the safety of any vessel in navigation; or</text></subparagraph></paragraph> 
<paragraph id="HE05F9283230E49B485C895C966E93140"><enum>(2)</enum><text>to attempt or conspire to do anything prohibited under paragraph (1).</text></paragraph></subsection> 
<subsection id="H6568C33E68C24915A507C036006CF407"><enum>(b)</enum><header>Penalty</header><text>Any person who—</text> 
<paragraph id="H3F85FFFD022C451A9ED47FCF20F14B95"><enum>(1)</enum><text>violates subparagraph (A) or (B) of subsection (a)(1) shall be fined in accordance with this title or imprisoned for a maximum life imprisonment term, or both, and if death results, shall be subject to the death penalty; and</text></paragraph> 
<paragraph id="H34457CDD497F4F5DA63285075FC6DA5E"><enum>(2)</enum><text>violates subsection (a)(2) or subparagraph (C), (D), (E), (F), or (G) of subsection (a)(1) shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></paragraph></subsection> 
<subsection id="H722A74209BCE4DBE96BF181BD74EB682"><enum>(c)</enum><header>Additional penalties</header><text>Any person who is fined or imprisoned in accordance with subsection (b) for an offense that involved a vessel that, at the time the violation occurred, carried high-level radioactive waste or spent nuclear fuel shall be fined in accordance with this title or imprisoned for not less than 30 years, or for life.</text></subsection> 
<subsection id="HDE4F3837DC25472E9572FD0015628359"><enum>(d)</enum><header>Threatened offense</header><text>Any person who willfully imparts or conveys any threat to do an act which would violate this chapter, with an apparent determination and will to carry out the threat, shall be—</text> 
<paragraph id="H6125CC1828E04CDFA900D54D5E16C6ED"><enum>(1)</enum><text>fined in accordance with this title or imprisoned not more than 5 years, or both; and</text></paragraph> 
<paragraph id="HB8C60D218BE647B79CF6A81271349606"><enum>(2)</enum><text>liable for all costs incurred as a result of such threat.</text></paragraph></subsection> 
<subsection id="HB71E686FCF8B40C18B40A4BF00C8C9EE"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HBF504EDB449D485CB51C529D18B93ECE"><enum>(1)</enum><text>the term <term>destructive device</term> has the meaning as such term in section 921(a)(4);</text></paragraph> 
<paragraph id="HDEB6C57AC88A46F9AA4C2DC3C15EAAF"><enum>(2)</enum><text>the term <term>destructive substance</term> has the meaning as such term in section 31;</text></paragraph> 
<paragraph id="H7D7A5E1A00394B0C9FF34606EC8B2650"><enum>(3)</enum><text>the term <term>high-level radioactive waste</term> has the meaning as such term in section 2(12) of the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101(12)</external-xref>);</text></paragraph> 
<paragraph id="HB2633D8163214106933DAAB92F279EA6"><enum>(4)</enum><text>the term <term>serious bodily injury</term> has the meaning as such term in section 1365(g); and</text></paragraph> 
<paragraph id="HBBA4ABA8DBA5489A8DA235AC63E66426"><enum>(5)</enum><text>the term <term>spent nuclear fuel</term> has the meaning as such term in section 2(23) of the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101(23)</external-xref>).</text></paragraph></subsection></section> 
<section id="H035B691562FB46A5B6F1AA2920F286ED"><enum>1373.</enum><header>Imparting or conveying false information</header> 
<subsection id="H8E17C249CAFD49E6A8185FDECDF55CA0"><enum>(a)</enum><header>In general</header><text>Any person who imparts or conveys, or causes to be imparted or conveyed, false information, knowing the information to be false, concerning an attempt or alleged attempt being made or to be made, to do any act that is an offense under this chapter or chapter 2, 97, or 111, shall be subject to a civil penalty of not more than $5,000, which shall be recoverable in a civil action brought in the name of the United States.</text></subsection> 
<subsection id="H0CA2BCEE975D44AEBBBD92F53D17A7EA"><enum>(b)</enum><header>Increased penalty</header><text>Any person who willfully and maliciously, or with reckless disregard for the safety of human life, imparts or conveys, or causes to be imparted or conveyed, false information, knowing the information to be false, concerning an attempt or alleged attempt being made by or to be made, to do any act that is an offense under this chapter or chapter 2, 97, or 111, shall be fined in accordance with this title or imprisoned not more than 5 years, or both.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD8EC8F12285E4FA187DDA41DD1CFFAAD"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of chapters at the beginning of title 18, is amended by inserting after the item relating to chapter 65 the following:</text>

<subsection id="HA6954FCAF41E457AB5BF8CFD00D870E9"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/111">Chapter 111</external-xref> of title 18, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2280">section 2280</external-xref> the following:</text>

<section id="H0C90369823D84059BA7F9F095004ED1"><enum>2280A.</enum><header>Devices or substances in waters of the United States likely to destroy or damage Ships</header> 
<subsection id="HF631549A2C0C4AB092F4264E18DE618D"><enum>(a)</enum><header>In general</header><text>Any person who knowingly places or causes to be placed in waters subject to the jurisdiction of the United States, by any means, a device or substance that is likely to destroy or cause damage to a ship or its cargo, or cause interference with the safe navigation of vessels or interference with maritime commerce, such as by damaging or destroying marine terminals, facilities, and any other maritime structure or entity used in maritime commerce, with the intent of causing such destruction or damage—</text> 
<paragraph id="H5CBB6A19016140AAB364F3B541FE61B3"><enum>(1)</enum><text>shall be fined in accordance with this title and imprisoned for any term of years or for life; and</text></paragraph> 
<paragraph id="H3D41DC6B71C5487FBB68E601256BED94"><enum>(2)</enum><text>if the death of any person results from conduct prohibited under this section, may be punished by death.</text></paragraph></subsection> 
<subsection id="H3357F0487D0B46478E30CE6CD496C68"><enum>(b)</enum><header>Applicability</header><text>Nothing in this section shall be construed to apply to otherwise lawfully authorized and conducted activities of the United States Government.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="HF87E307701304DC4AB5747DA408379C6"><enum>1651.</enum><header>Piracy</header><text display-inline="no-display-inline">Any person who commits the crime of piracy and is afterwards brought into, or found in, the United States shall be imprisoned for life.</text></section> 
<section id="H0CD5B36761AB4859AFF64806C9DADE7E"><enum>1652.</enum><header>Crimes against United States persons or property on board a ship or maritime structure</header><text display-inline="no-display-inline">Any person who commits any illegal act of violence, detention, or depredation against the United States, including any vessel of the United States, citizen of the United States, any commercial structure owned in whole or in part by a United States citizen or resident alien, or any United States citizen or resident alien, or the property of that citizen or resident alien, on board a ship or maritime structure and is afterwards brought into or found in the United States, shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></section> 
<section id="H4C8063EFA5EB4CC3A4812864E67F5D92"><enum>1653.</enum><header>Crimes against persons on board a ship or maritime structure within the territorial jurisdiction of the United States</header><text display-inline="no-display-inline">Any person who commits any illegal act of violence, detention, or depredation against an individual on board a ship or maritime structure, or the property of that individual, in waters or submerged lands thereunder, subject to the jurisdiction of the United States, shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></section> 
<section id="HCE3E36EFDE754A2591026403D8F92C45"><enum>1654.</enum><header>Crimes by United States citizens or resident aliens</header><text display-inline="no-display-inline">Any person, being a United States citizen or resident alien, or purporting to act under the authority of the United States, who commits any illegal act of violence, detention, or depredation against an individual on board a ship or maritime structure, or the property of that individual, shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></section> 
<section id="H74F36CDBCE3F46B2A01C0088293B9B85"><enum>1655.</enum><header>Privateering</header> 
<subsection id="H6FD654F7AA0B430F96AFF5D96DECDAFA"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for any person to furnish, fit out, arm, or serve in a privateer or private vessel used to commit any illegal act of violence, detention, or depredation against an individual, or the property of that individual, or any vessel or maritime structure without the express authority of the United States Government when—</text> 
<paragraph id="HE73A748D97EF4D3B997C83CEE5C4948D"><enum>(1)</enum><text>the perpetrator of the act is a United States citizen or resident alien, or purports to act under authority of the United States;</text></paragraph> 
<paragraph id="H4FDA9DA10E74476FB5FEFC15836F3F00"><enum>(2)</enum><text>the individual against whom the act is committed is a United States citizen or resident alien or the property, vessel, or maritime structure involved is owned, in whole or in part, by a United States citizen or resident alien; or</text></paragraph> 
<paragraph id="HC39F623530924EB2834460EA886ED574"><enum>(3)</enum><text>some element of the illegal act of violence, detention, or depredation is committed in waters subject to the jurisdiction of the United States.</text></paragraph></subsection> 
<subsection id="H8885A9F2891849189F75244497C717D8"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection></section> 
<section id="HAAD01FEB34DE41BE8C07B786CB00992B"><enum>1656.</enum><header>Theft or conversion of vessel, maritime structure, cargo, or effects</header> 
<subsection id="HFE06573632E74B789BEDD4DA64E1DDFD"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for any person who is a captain, officer, crewman, or passenger of a vessel or maritime structure to assist in the theft or conversion of such vessel or maritime structure, or its cargo or effects when—</text> 
<paragraph id="H585E1AD5FDAE4D449D2DBDBA006737B2"><enum>(1)</enum><text>the perpetrator is a United States citizen or resident alien, or purports to act under the authority of the United States;</text></paragraph> 
<paragraph id="HF05E0A837BA14CC5A820CF2200C43030"><enum>(2)</enum><text>the vessel, maritime structure, cargo, or effects is owned in whole or in part by a United States citizen or resident alien; or</text></paragraph> 
<paragraph id="H76EEBA383BFD4FFCA9B8EDCA433D56A1"><enum>(3)</enum><text>some element of the theft or conversion is committed in waters subject to the jurisdiction of the United States.</text></paragraph></subsection> 
<subsection id="HE21A0F3B9D334715A208B520D4F8B26E"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection></section> 
<section id="H8AADDCDB853C4173BA8890AFEF33EEF3"><enum>1657.</enum><header>Intentional wrecking or plunder of a vessel, maritime structure, cargo, or effects</header> 
<subsection id="HFE5B47654280447FADF145A79C78C221"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for any person to—</text> 
<paragraph id="HC1BC3DEAF72B49F1ACD4AE0041F39230"><enum>(1)</enum><text>intentionally cause the wrecking of a vessel or maritime structure by act or omission, either directly such as by intentional grounding, or indirectly by modification or destruction of any navigational marker or safety device;</text></paragraph> 
<paragraph id="H790297856C2541DA97E4BF7DA1EA6940"><enum>(2)</enum><text>intentionally plunder, steal, or destroy a vessel, maritime structure, cargo, or effects when such vessel or maritime structure is in distress, wrecked, lost, stranded, or cast away; or</text></paragraph> 
<paragraph id="H2B156F23E4FB457D828720ABD6A6252F"><enum>(3)</enum><text>intentionally obstruct or interfere with the rescue of a person on board a vessel or maritime structure in distress, wrecked, lost, stranded, or cast away, or the legal salvage of such a vessel, maritime structure, cargo, or effects, when—</text> 
<subparagraph id="H9CC185238763407EA683FE463793E207"><enum>(A)</enum><text>the perpetrator is a United States citizen or resident alien, or purports to act under authority of the United States;</text></subparagraph> 
<subparagraph id="H9E17813A508B44DBB0DC9CC781F7CA15"><enum>(B)</enum><text>the vessel, maritime structure, cargo, or effects is owned in whole or in part by a United States citizen or resident alien; or</text></subparagraph> 
<subparagraph id="H5DF825BDEB474C5998CAE976E835B1A5"><enum>(C)</enum><text>some element of the theft or conversion is committed in waters subject to the jurisdiction of the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="H711765A315AC43C285CCB7CD004FEC5D"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection></section> 
<section id="H49FB89DD504240EAA1E31B00C900B243"><enum>1658.</enum><header>Knowing receipt of an illegally acquired vessel, maritime structure, cargo, or effects</header><text display-inline="no-display-inline">Any person who knowingly receives or acquires a vessel, maritime structure, cargo, or effects converted or obtained by action falling under any section of this chapter shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></section> 
<section id="HCAA6417CA96644BDB5C750DC5209EFDD"><enum>1659.</enum><header>Attempts</header><text display-inline="no-display-inline">Any person who attempts any act which, if committed, would constitute an offense under this chapter shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></section> 
<section id="H8BF4B0C2C2F840CD82812B05B49DAB62"><enum>1660.</enum><header>Accessories</header> 
<subsection id="HDC3F0CC67877438388F6C6D116508807"><enum>(a)</enum><header>Commission of an offense</header><text>Any person who knowingly assists any person in the commission of an act that constitutes an offense under this chapter shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection> 
<subsection id="H6596C022817944CFAAB866503DE96586"><enum>(b)</enum><header>Avoidance of consequences</header><text>Any person who knowingly assists any person in avoiding the consequences of an act that constitutes an offense under this chapter shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection></section> 
<section id="H19AA87E72F8C418499F4DBBFD1CDE0D5"><enum>1661.</enum><header>Inapplicability to United States Government activities</header><text display-inline="no-display-inline">Nothing in this chapter shall apply to otherwise lawful activities—</text> 
<paragraph id="H9C18F16E8F2243549454D732FC7E28F0"><enum>(1)</enum><text>carried out by, or at the direction of, the United States Government; or</text></paragraph> 
<paragraph id="H6EC3FA5ADED54B2295CFC647B2A59662"><enum>(2)</enum><text>undertaken under a letter or marque and reprisal issued by the United States Government.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE80C7476DAB2469C91C57800952C7600"><enum>104.</enum><header>Use of a dangerous weapon or explosive on a passenger vessel</header> 
<subsection id="HBDAE53D7E50C44F0908D2FFC38AF46CF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/39">Chapter 39</external-xref> of title 18, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/831">section 831</external-xref> the following:</text>

<section id="H36FFA2B004C543C7929C9C51C0600100"><enum>832.</enum><header>Use of a dangerous weapon or explosive on a passenger vessel</header> 
<subsection id="H2FA8A54BB2954FD9841025EBF3AD86E2"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for any person to willfully—</text> 
<paragraph id="H7A5DCFC5A7D24CEC906B8010842FE87D"><enum>(1)</enum><text>commit an act, including the use of a dangerous weapon, explosive, or incendiary device, with the intent to cause death or serious bodily injury to a crew member or passenger of a passenger vessel or any other person while on board a passenger vessel; or</text></paragraph> 
<paragraph id="HED577B3ADDA145509DCDF8A03F59BAE5"><enum>(2)</enum><text>attempt, threaten, or conspire to do any act referred to in paragraph (1).</text></paragraph></subsection> 
<subsection id="H97135DC02E82404C9C031EF0F3E37528"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text></subsection> 
<subsection id="HB57C9545F65444BD8D811D3057E469FA"><enum>(c)</enum><header>Aggravated offense</header><text>Any person who commits an offense described in subsection (a) in a circumstance in which—</text> 
<paragraph id="H2CA0A7280BD54957B6AFC19DC157E491"><enum>(1)</enum><text>the vessel was carrying a passenger at the time of the offense; or</text></paragraph> 
<paragraph id="H0B4C3960C926464395D3CCE6657235D"><enum>(2)</enum><text>the offense has resulted in the death of any person;</text></paragraph><continuation-text continuation-text-level="subsection">shall be guilty of an aggravated offense and shall be fined in accordance with this title or imprisoned for any term of years or for life.</continuation-text></subsection> 
<subsection id="H6480559598AE4345B5DC82D204DDE82D"><enum>(d)</enum><header>Applicability</header><text>This section shall apply to vessels that are subject to the jurisdiction of the United States, and vessels carrying passengers who are United States citizens or resident aliens, wherever located.</text></subsection> 
<subsection id="H94AE35CE935F4DD29789E3F4B4C70385"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HD90B8EA5626A4D7CB9ADEE98C6738140"><enum>(1)</enum><text>the term <term>dangerous weapon</term> has the meaning given such term in section 930(g);</text></paragraph> 
<paragraph id="H20C046056E2F40028793ACF453EEE0D0"><enum>(2)</enum><text>the term <term>explosive or incendiary device</term> has the meaning given such term in section 232(5);</text></paragraph> 
<paragraph id="H124E3444B37C499FA5F92FC6CDB5AEAC"><enum>(3)</enum><text>the term <term>passenger</term> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(21)</external-xref> of title 46;</text></paragraph> 
<paragraph id="HFBEA5D755FC54DACB25FD886B3E40090"><enum>(4)</enum><text>the term <term>passenger vessel</term> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(22)</external-xref> of title 46; and</text></paragraph> 
<paragraph id="HDB9E52E5009C45ED94B43F42785B4552"><enum>(5)</enum><text>the term <term>serious bodily injury</term> has the meaning given such term in section 1365(g).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HC05AB89778FD4B6FAE5D5E014D77A600"><enum>(a)</enum><header>Failure to heave to</header><text>It shall be unlawful for the master, operator, or person in charge of a vessel of the United States, or a vessel subject to the jurisdiction of the United States, to knowingly fail to obey an order to heave to on being ordered to do so by an authorized Federal law enforcement officer.</text></subsection> 
<subsection id="H55179047D47C43679180E189F293F0C8"><enum>(b)</enum><header>Obstruction of boarding and providing false information</header><text>It shall be unlawful for any person on board a vessel of the United States or a vessel subject to the jurisdiction of the United States to—</text> 
<paragraph id="H962F34E3005B4A228DF8B41D2861F96B"><enum>(1)</enum><text>forcibly assault, resist, oppose, prevent, impede, intimidate, or interfere with a boarding or other law enforcement action authorized by any Federal law, or to resist a lawful arrest; or</text></paragraph> 
<paragraph id="H66101BE7B79246BEB6002ED51C8927F1"><enum>(2)</enum><text>provide information to a Federal law enforcement officer during a boarding of a vessel regarding the vessel’s destination, origin, ownership, registration, nationality, cargo, or crew that the person knows is false.</text></paragraph></subsection> 
<subsection id="HE027B1270C8B428C8D9C4C1400F778C2"><enum>(c)</enum><header>Limitations</header><text>This section shall not limit the authority of—</text> 
<paragraph id="H198B8EFD54A540729B06FF94F387D75"><enum>(1)</enum><text>an officer under section 581 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1581">19 U.S.C. 1581</external-xref>) or any other provision of law enforced or administered by the Secretary of the Treasury or the Under Secretary for Border and Transportation Security of the Department of Homeland Security; or</text></paragraph> 
<paragraph id="H267D38A497AB427AA791EE1EC570F3DD"><enum>(2)</enum><text>a Federal law enforcement officer under any law of the United States to order a vessel to stop or heave to.</text></paragraph></subsection> 
<subsection id="H1EB6364A39FB480CB7D4BAF1E2EE015"><enum>(d)</enum><header>Consent or objection to enforcement</header><text>A foreign nation may consent or waive objection to the enforcement of United States law by the United States under this section by radio, telephone, or similar oral or electronic means, which consent or waiver may be proven by certification of the Secretary of State or the Secretary’s designee.</text></subsection> 
<subsection id="H0317A1E5E68442F2B700254C3D63FA07"><enum>(e)</enum><header>Penalty</header><text>Any person who intentionally violates this section shall be fined in accordance with this title and imprisoned not more than 1 year.</text></subsection> 
<subsection id="HF7EE08AF7C58466C93043C268D2D085E"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H9A1930074E73429F9D61995B83F09E71"><enum>(1)</enum><text>the terms <term>vessel of the United States</term> and <term>vessel subject to the jurisdiction of the United States</term> have the same meanings as such terms in section 3 of the Maritime Drug Law Enforcement Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/1903">46 U.S.C. App. 1903</external-xref>);</text></paragraph> 
<paragraph id="H06186C36C62845E89201DABA8DAF8C96"><enum>(2)</enum><text>the term <term>heave to</term> means to cause a vessel to slow, come to a stop, or adjust its course or speed to account for the weather conditions and sea state to facilitate a law enforcement boarding; and</text></paragraph> 
<paragraph id="HCAC20F866B194BE5A6D2F904928B8BD6"><enum>(3)</enum><text>the term <term>Federal law enforcement officer</term> has the same meaning as such term in section 115.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subparagraph id="H0A97067F9AB94D1D8BC1EA4618C4B436"><enum>(C)</enum><text>in subparagraph (I), as so redesignated, by striking <quote>through (G)</quote> and inserting <quote>through (H)</quote>; and</text></subparagraph></paragraph>

<subsection id="HB96E3EE2C5E146E5842C38FA2BF34011"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/111">Chapter 111</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H7152BF112D7C46D0B93E3CA87693ABA"><enum>(1)</enum><text>shall be fined in accordance with this title and imprisoned for any term of years or for life; and</text></paragraph> 
<paragraph id="H117DCB192C6D485600559B49A7C683E3"><enum>(2)</enum><text>if the death of any person results from conduct prohibited under this section, may be punished by death.</text></paragraph></subsection> 
<subsection id="HF8E38C425DEB49CABF00A223F27E2443"><enum>(b)</enum><header>Endangerment of marine environment</header><text>Any person who knowingly discharges or releases oil, a hazardous material, a noxious liquid substance, or any other substance into the navigable waters of the United States or the adjacent shoreline with the intent to endanger the marine environment shall be fined in accordance with this title or imprisoned not more than 30 years, or both.</text></subsection> 
<subsection id="HF3D9A9BEE64C4074BE4F91E3BBE77F49"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H9F8DD7E6E55C4B0FAF094273C0CFE376"><enum>(1)</enum><text>the term <term>discharge</term> means any spilling, leaking, pumping, pouring, emitting, emptying, or dumping;</text></paragraph> 
<paragraph id="HCC961756FA3E42CA9BB24D23BC9B00B0"><enum>(2)</enum><text>the term <term>hazardous material</term> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(14)</external-xref> of title 46;</text></paragraph> 
<paragraph id="H6B498551577E48BD8E8CF3CC18C71DD8"><enum>(3)</enum><text>the term <term>marine environment</term> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(15)</external-xref> of title 46;</text></paragraph> 
<paragraph id="H192086BE8EB84FC49EF1B36C9D126CAC"><enum>(4)</enum><text>the term <term>navigable waters</term> has the same meaning given such term in section 502(7) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(7)</external-xref>), and also includes the territorial sea of the United States as described in Presidential Proclamation 5928 of December 27, 1988; and</text></paragraph> 
<paragraph id="HCC6586C026F84B68B107C1EC70000666"><enum>(5)</enum><text>the term <term>noxious liquid substance</term> has the same meaning given such term in the MARPOL Protocol as defined in section 2(a)(3) of the Act to Prevent Pollution from Ships (<external-xref legal-doc="usc" parsable-cite="usc/33/1901">33 U.S.C. 1901(a)(3)</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H758D2192F9CF4D189EE4D322CC43AD95"><enum>(a)</enum><header>Regulations</header><text>The Attorney General shall issue regulations to—</text> 
<paragraph id="H3D0FD0A8B05C4A238CD1C2EC5B229B9"><enum>(1)</enum><text>require the reporting by a carrier that is the victim of a cargo theft offense to the Attorney General of information on the cargo theft offense (including offenses occurring outside ports of entry and ports of shipment origination) that identifies the port of entry, the port where the shipment originated, where the theft occurred, and any other information specified by the Attorney General;</text></paragraph> 
<paragraph id="H793A6AA1FE8E4D5993007D9306B80011"><enum>(2)</enum><text>create a database to contain the reports described in paragraph (1) and integrate those reports, to the extent feasible, with other noncriminal justice and intelligence data, such as insurer bill of lading, cargo contents and value, point of origin, and lien holder filings; and</text></paragraph> 
<paragraph id="H49C3BE09487C4BB0A32482CD1EDDE341"><enum>(3)</enum><text>prescribe procedures for access to the database created in accordance with paragraph (2) by appropriate Federal, State, and local governmental agencies and private companies or organizations, while limiting access to privacy of the information in accordance with other applicable Federal laws.</text></paragraph></subsection> 
<subsection id="H77EE61DA58E2409BA5E66B95DDDC007E"><enum>(b)</enum><header>Modification of databases</header> 
<paragraph id="HEF956781330C4638AE3ED06D4F9CD832"><enum>(1)</enum><header>In general</header><text>United States Government agencies with significant regulatory or law enforcement responsibilities at United States ports shall, to the extent feasible, modify their information databases to ensure the collection and retrievability of data relating to crime, terrorism, and related activities at, or affecting, United States ports.</text></paragraph> 
<paragraph id="HC4B7F7BD6BAA4D73A91D441EDB508199"><enum>(2)</enum><header>Designation of agencies</header><text>The Attorney General, after consultation with the Secretary of Homeland Security, shall designate the agencies referred to in paragraph (1).</text></paragraph></subsection> 
<subsection id="HD63D144B8EE04CE9B274C6BCFBEB00FD"><enum>(c)</enum><header>Outreach program</header><text>The Attorney General, in consultation with the Secretary of Homeland Security, the National Maritime Security Advisory Committee established under <external-xref legal-doc="usc" parsable-cite="usc/46/70112">section 70112</external-xref> of title 46, United States Code, and the appropriate Federal and State agencies, shall establish an outreach program—</text> 
<paragraph id="H2EB151E53D0B47AC89616297C9166D99"><enum>(1)</enum><text>to work with State and local law enforcement officials to harmonize the reporting of data on cargo theft among States and localities with the United States Government’s reports; and</text></paragraph> 
<paragraph id="HD71A38659F884668BDDD5CEF50000035"><enum>(2)</enum><text>to work with local port security committees to disseminate cargo theft information to appropriate law enforcement officials.</text></paragraph></subsection> 
<subsection id="H88E4B3F6D589482A9BD55E3E3BA3F3F7"><enum>(d)</enum><header>Annual report</header><text>The Attorney General shall report annually to the Committee on the Judiciary of the Senate and the House of Representatives on the implementation of this section.</text></subsection> 
<subsection id="HFD3B47AEE7A04D1AB4B2090363240021"><enum>(e)</enum><header>Interstate or foreign shipments by carrier; State prosecutions</header> 
<paragraph id="H6EDFF43C429943C1BC8B952B1D863247"><enum>(1)</enum><header>State prosecutions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/659">Section 659</external-xref> of title 18, United States Code, is amended—</text>

<paragraph id="HA040B67FE2BE48EBACB67FE8903B5D1C"><enum>(2)</enum><header>Separate violations</header><text>Each day of a continuing violation shall constitute a separate violation.</text></paragraph> 
<paragraph id="HD6521350262C481DA600D8365F14F6F2"><enum>(3)</enum><header>Amount of penalty</header> 
<subparagraph id="H4900B358DEFA48C5807889E87CF47B4B"><enum>(A)</enum><header>In general</header><text>The amount of a civil penalty for a violation of this section or a regulation issued under this section shall be assessed by the Attorney General, or the designee of the Attorney General, by written notice.</text></subparagraph> 
<subparagraph id="H658C93A3ECCE4A9DA47100E00061CA66"><enum>(B)</enum><header>Considerations</header><text>In determining the amount of a civil penalty under this paragraph, the Attorney General shall take into account—</text> 
<clause id="HBA53D6792A02488A9521096B10F22E04"><enum>(i)</enum><text>the nature, circumstances, extent, and gravity of the prohibited act committed; and</text></clause> 
<clause id="H0234CCCE221747DA85EB4F7463C45BA3"><enum>(ii)</enum><text>with respect to the violator, the degree of culpability, any history of prior offenses, ability to pay, and such other matters as justice may require.</text></clause></subparagraph></paragraph> 
<paragraph id="H84258764D5DE4063A4BB11EC4C349085"><enum>(4)</enum><header>Modification of penalty</header><text>The Secretary of Homeland Security may compromise, modify, or remit, with or without conditions, any civil penalty that is subject to imposition or which has been imposed under this section.</text></paragraph> 
<paragraph id="H11BA4560375B4D36B248CB9C48DCB200"><enum>(5)</enum><header>Failure to pay</header><text>If a person fails to pay an assessment of a civil penalty after it has become final, the Secretary of Homeland Security may refer the matter to the Attorney General for collection in an appropriate district court of the United States.</text></paragraph></subsection> 
<subsection id="H618FDB3CB89840F6A66049E040739780"><enum>(g)</enum><header>Definition</header><text>For purposes of this section, the term <term>goods or chattels</term> means to be moving as an interstate or foreign shipment at all points between the point of origin and the final destination (as evidenced by the waybill or other shipping document of the shipment) regardless of any temporary stop while awaiting transshipment or otherwise.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H19980B781CCD413CB7F4808C005E5D01"><enum>(2)</enum><header>Federal Sentencing Guidelines</header><text>Pursuant to <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994</external-xref> of title 28, United States Code, the United States Sentencing Commission shall review the Federal Sentencing Guidelines to determine whether sentencing enhancement is appropriate for any offense under <external-xref legal-doc="usc" parsable-cite="usc/18/659">section 659</external-xref> of title 18, United States Code, as amended by this subsection.</text></paragraph> 
<paragraph id="H250B994DAEFC4D30008932A880BC3C72"><enum>(3)</enum><header>Annual report</header><text>The Attorney General shall annually submit to Congress a report that shall include an evaluation of law enforcement activities relating to the investigation and prosecution of offenses under <external-xref legal-doc="usc" parsable-cite="usc/18/659">section 659</external-xref> of title 18, United States Code.</text></paragraph></subsection></section></title> 
<title id="H2FEBB46B11C343F200BBF988B3D6C6F2"><enum>II</enum><header>Protecting United States ports against terrorism and crime</header> 
<subtitle id="H9052CF6D61604640A5BE9C4B956CCD24"><enum>A</enum><header>General provision</header> 
<section id="H48AD9CED28E94E8EAEB581D69EF326E8"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HE7CBA7929C274FECA9C07BD106DA00D"><enum>(1)</enum><header>Aircraft</header><text>The term <term>aircraft</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="H3753B1F6E45843ABBB2E2B2BBFD7FD5B"><enum>(2)</enum><header>Captain-of-the-Port</header><text>The term <term>Captain-of-the-Port</term>, with respect to a United States seaport, means the individual designated by the Commandant of the Coast Guard as the Captain-of-the-Port at that seaport.</text></paragraph> 
<paragraph id="H22DFEEE16FCF415AB4F84F5058C19163"><enum>(3)</enum><header>Common carrier</header><text>The term <term>common carrier</term> means any person that holds itself out to the general public as a provider for hire of a transportation by water, land, or air of merchandise, whether or not the person actually operates the vessel, vehicle, or aircraft by which the transportation is provided, between a port or place and a port or place in the United States.</text></paragraph> 
<paragraph id="H66DAAA714EED4ABE921179286C00893B"><enum>(4)</enum><header>Container</header><text>The term <term>container</term> means a container that is used or designed for use for the international transportation of merchandise by vessel, vehicle, or aircraft.</text></paragraph> 
<paragraph id="H6A509B9833754186A40033C8C84F1721"><enum>(5)</enum><header>Directorate</header><text>The term <term>Directorate</term> means the Border and Transportation Security Directorate of the Department of Homeland Security.</text></paragraph> 
<paragraph id="H634FB1315FC1413D8F50BEC68DAE7B9D"><enum>(6)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> means a person who fabricates or assembles merchandise for sale in commerce.</text></paragraph> 
<paragraph id="H9A3A151A7396438EB986AB76F1A8006E"><enum>(7)</enum><header>Merchandise</header><text>The term <term>merchandise</term> has the meaning given that term in section 401 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>).</text></paragraph> 
<paragraph id="H2C4A14D81DE54D4BBC58979E5EDA48E7"><enum>(8)</enum><header>Ocean transportation intermediary</header><text>The term <term>ocean transportation intermediary</term> has the meaning given that term in <external-xref legal-doc="regulation" parsable-cite="cfr/46/515.2">section 515.2</external-xref> of title 46, Code of Federal Regulations (as in effect on January 1, 2003).</text></paragraph> 
<paragraph id="HB9EF8F19B5F149CC8D75D108F166EDC"><enum>(9)</enum><header>Shipment</header><text>The term <term>shipment</term> means cargo traveling in international commerce under a bill of lading.</text></paragraph> 
<paragraph id="HCE6CF16F3C7C4DD7A1F9BF3375DA00C5"><enum>(10)</enum><header>Shipper</header><text>The term <term>shipper</term> means—</text> 
<subparagraph id="H37940338BBEB45459F98E3D754003D40"><enum>(A)</enum><text>a cargo owner;</text></subparagraph> 
<subparagraph id="H5991D3D5EC01459587D7CC3B156253C0"><enum>(B)</enum><text>the person for whose account ocean transportation is provided;</text></subparagraph> 
<subparagraph id="H01D7238494474C7BBB7188DFE1253C59"><enum>(C)</enum><text>the person to whom delivery of merchandise is to be made; or</text></subparagraph> 
<subparagraph id="H13644DD5FB774DC89437D9716134C600"><enum>(D)</enum><text>a common carrier that accepts responsibility for payment of all charges applicable under a tariff or service contract.</text></subparagraph></paragraph> 
<paragraph id="HF33BE42F3F4B4111A5EE3620EA6C821B"><enum>(11)</enum><header>United States seaport</header><text>The term <term>United States seaport</term> means a place in the United States on a waterway with shoreside facilities for the intermodal transfer of cargo containers that are used in international trade.</text></paragraph> 
<paragraph id="H6A63A71566EA4CFEB1E8F0DDB3592DC"><enum>(12)</enum><header>Vehicle</header><text>The term <term>vehicle</term> has the meaning given that term in section 401 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>).</text></paragraph> 
<paragraph id="H2F7B6784FE62478B94B3D1B142CA3815"><enum>(13)</enum><header>Vessel</header><text>The term <term>vessel</term> has the meaning given that term in section 401 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>).</text></paragraph></section></subtitle> 
<subtitle id="HA13737ED3ED241D5B0239670E938B7E2"><enum>B</enum><header>Security authority</header> 
<section id="H160FFB3DBC3C4566878CD6EBE284808"><enum>211.</enum><header>Designated security authority</header><text display-inline="no-display-inline">The Captain-of-the-Port of each United States seaport shall be the primary authority responsible for security at the United States seaport and shall—</text> 
<paragraph id="HEA2E655E9E5F41319604795DE1CA4ED3"><enum>(1)</enum><text>coordinate security at such seaport; and</text></paragraph> 
<paragraph id="H678FC6F5F1474B639FA314BFA8330722"><enum>(2)</enum><text>be the point of contact on seaport security issues for civilian and commercial port entities at such seaport.</text></paragraph></section></subtitle> 
<subtitle id="H5143E05FAA5F4E91B01E466FBF641212"><enum>C</enum><header>Securing the supply chain</header> 
<section id="HE06098181F534C96A4506B21A64DE568"><enum>221.</enum><header>Penalties for inaccurate manifest</header> 
<subsection id="H44EFB4E88B46495FB3DB0AC26967C25"><enum>(a)</enum><header>Falsity or lack of manifest</header><text>Section 584 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1584">19 U.S.C. 1584</external-xref>) is amended—</text> 
<paragraph id="H548FC739B15F430093003B9408C23F61"><enum>(1)</enum><text>in subsection (a)(1)—</text> 
<subparagraph id="HF3AE6EF083454C09AABB362FC3CC10E8"><enum>(A)</enum><text>by striking <quote>$1,000</quote> each place it appears and inserting <quote>$50,000</quote>; and</text></subparagraph>

<subsection id="HF43E52873EA740A8AB4E5716E266D96C"><enum>(c)</enum><header>Criminal penalties</header><text>Any person who ships or prepares for shipment any merchandise bound for the United States who intentionally provides inaccurate or false information, whether inside or outside the United States, with respect to such merchandise for the purpose of introducing such merchandise into the United States in violation of the laws of the United States, shall be liable, upon conviction of a violation of this subsection, for a fine of not more than $50,000 or imprisonment for 1 year, or both; except that if the importation of such merchandise into the United States is prohibited, such person shall be liable for an additional fine of not more than $50,000 or imprisonment for not more than 5 years, or both.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0FF23A1EFA9240EA87ECE27DD4CE3F90"><enum>(b)</enum><header>Penalties for violations of the arrival, reporting, entry, and clearance requirements</header><text>Subsections (b) and (c) of section 436 of <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1436">19 U.S.C. 1436</external-xref>) are amended to read as follows:</text>

<subsection id="H8CE66AC1E6B44C4DB82575C99B61DCAF"><enum>(b)</enum><header>Civil penalty</header><text>Any master, person in charge of a vessel, vehicle, or aircraft pilot who commits any violation listed in subsection (a) shall be liable for a civil penalty of $25,000 for the first violation, and $50,000 for each subsequent violation, and any conveyance used in connection with any such violation is subject to seizure and forfeiture.</text></subsection> 
<subsection id="H6526BA12600544DF9DAA8D87798EE3EE"><enum>(c)</enum><header>Criminal penalty</header><text>In addition to being liable for a civil penalty under subsection (b), any master, person in charge of a vessel, vehicle, or aircraft pilot who intentionally commits or causes another to commit any violation listed in subsection (a) shall be liable, upon conviction, for a fine of not more than $50,000 or imprisonment for 1 year, or both; except that if the conveyance has, or is discovered to have had, on board any merchandise (other than sea stores or the equivalent for conveyances other than vessels) the importation of which into the United States is prohibited, such individual shall be liable for an additional fine of not more than $50,000 or imprisonment for not more than 5 years, or both.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HE38663B790F348D6A374CCC2EC5DCD4B"><enum>222.</enum><header>Shipment profiling plan</header> 
<subsection id="HC4893042C4734A5500F8A1E3C69E0078"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall develop a shipment profiling plan to track containers and shipments of merchandise to be imported into the United States. The tracking system shall be designed to identify any shipment that is a threat to the security of the United States before such shipment enters the United States.</text></subsection> 
<subsection id="H16730EF1AD134A9FB5AEEC9E34190083"><enum>(b)</enum><header>Information requirements</header> 
<paragraph id="H7DC28AB71C16447590266F859E659B6F"><enum>(1)</enum><header>Content</header><text>The shipment profiling plan required by subsection (a) shall at a minimum—</text> 
<subparagraph id="H22DDA47B4A964BE08E55FFFA7D15FE61"><enum>(A)</enum><text>require common carriers, shippers, and ocean transportation intermediaries to provide appropriate information regarding each shipment of merchandise to the Secretary of Homeland Security; and</text></subparagraph> 
<subparagraph id="H4324EF1A5E03453D81D6B7700BE94EA"><enum>(B)</enum><text>require shippers to use a standard international bill of lading for each shipment that includes—</text> 
<clause id="H31D2328FC5314F5B8EC822FC12F3B35"><enum>(i)</enum><text>the weight of the cargo;</text></clause> 
<clause id="HAE33A59D18D2495F8B40B4BA6BAEFBC6"><enum>(ii)</enum><text>the value of the cargo;</text></clause> 
<clause id="H8F1AD0D749F84793A1A8EF4EE68ED6D4"><enum>(iii)</enum><text>the vessel name;</text></clause> 
<clause id="H66A5C7AAF7CC423AAF09AE6CC3D61555"><enum>(iv)</enum><text>the voyage number;</text></clause> 
<clause id="H0430FC8F226548EB99AD8C4BD1673F98"><enum>(v)</enum><text>a description of each container;</text></clause> 
<clause id="HB1AE77A89B394766006C307680221F2B"><enum>(vi)</enum><text>a description of the nature, type, and contents of the shipment;</text></clause> 
<clause id="HAB3324E780884665B559DB3B0806C599"><enum>(vii)</enum><text>the code number from the Harmonized Tariff Schedule;</text></clause> 
<clause id="HFAE97BCC8D8D428AA678832331766624"><enum>(viii)</enum><text>the port of destination;</text></clause> 
<clause id="H0AC43A63D27A45369624EECF8E688DA9"><enum>(ix)</enum><text>the final destination of the cargo;</text></clause> 
<clause id="H80E4D3A425B746D5B762BC3D1156A252"><enum>(x)</enum><text>the means of conveyance of the cargo;</text></clause> 
<clause id="HAC98A394A4DE41CAA242045E00CA2447"><enum>(xi)</enum><text>the origin of the cargo;</text></clause> 
<clause id="H4B6415B20E944436B8C2B905242CB21"><enum>(xii)</enum><text>the name of the precarriage deliverer or agent;</text></clause> 
<clause id="H3D206B81BF0341AEA01D8D31A748D926"><enum>(xiii)</enum><text>the port at which the cargo was loaded;</text></clause> 
<clause id="H52FD23F160B84D50AF39E545AC02CAE"><enum>(xiv)</enum><text>the name of the formatting agent;</text></clause> 
<clause id="HA78E4D00E8A1475C8BE4A4B6478EE000"><enum>(xv)</enum><text>the bill of lading number;</text></clause> 
<clause id="H3EF6E0D3C868473B801006EA3F64B6F4"><enum>(xvi)</enum><text>the name of the shipper;</text></clause> 
<clause id="HF3C9DB7DF8634825A0EF605B7D1E473B"><enum>(xvii)</enum><text>the name of the consignee;</text></clause> 
<clause id="H4A95338C31DB4821914D0722FE951068"><enum>(xviii)</enum><text>the universal transaction number or carrier code assigned to the shipper by the Secretary;</text></clause> 
<clause id="H43FD8247624E45C8BD6C8BD29806D7C2"><enum>(xix)</enum><text>the information contained in the continuous synopsis record for the vessel transporting the shipment; and</text></clause> 
<clause id="HE471472988234743A8216F4C5E47DE03"><enum>(xx)</enum><text>any additional information that the Secretary by regulation determines is reasonably necessary to ensure seaport safety.</text></clause></subparagraph></paragraph> 
<paragraph id="HBD3F03042073430CB667A70660E5CFDF"><enum>(2)</enum><header>Continuous synopsis record defined</header><text>In this subsection, the term <term>continuous synopsis record</term> means the continuous synopsis record required by regulation 5 of chapter XI–1 of the Annex to the International Convention of the Safety of Life at Sea, 1974.</text></paragraph> 
<paragraph id="H6D53DE5EEF7B45860040E28136CF1BDC"><enum>(3)</enum><header>Effective date</header><text>The requirement imposed under clause (xix) of paragraph (1)(B) shall take effect on July 1, 2004.</text></paragraph></subsection> 
<subsection id="HD881AFD59511448AB1B9F95C297C60F6"><enum>(c)</enum><header>Creation of profile</header><text>The Secretary of Homeland Security shall combine the information described in subsection (b) with other law enforcement and national security information that the Secretary determines useful to assist in locating containers and shipments that could pose a threat to the security of the United States and to create a profile of every container and every shipment within the container that will enter the United States.</text></subsection> 
<subsection id="H9D2FA3160DAE4D76AA0564B9CBC5BACE"><enum>(d)</enum><header>Cargo screening</header> 
<paragraph id="H3B0A2DBDE4E94C1C975C9EFBB58E4EF9"><enum>(1)</enum><header>In general</header><text>Officers of the Directorate shall review the profile of a shipment that a shipper desires to transport into the United States to determine whether the shipment or the container in which it is carried should be subjected to additional inspection by the Directorate. In making such a determination, an officer shall consider, in addition to any other relevant factors—</text> 
<subparagraph id="HE21403D4F0B44E6AA81E0393B179607C"><enum>(A)</enum><text>whether the shipper has regularly shipped cargo to the United States in the past; and</text></subparagraph> 
<subparagraph id="H8154AC322F0842928D328149E75427E0"><enum>(B)</enum><text>the specificity of the description of the shipment’s contents.</text></subparagraph></paragraph> 
<paragraph id="H5C00CA1BD56F431999D865E93611C1A3"><enum>(2)</enum><header>Notification</header><text>The Secretary of Homeland Security shall transmit to the shipper and the person in charge of the vessel, aircraft, or vehicle on which a shipment is located a notification of whether the shipment is to be subjected to additional inspection as described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H13EC85A4A9F9426E89004000AA666644"><enum>(e)</enum><header>Consistency with the National Customs Automation Program</header><text>The Secretary of Homeland Security, in consultation with the Secretary of the Treasury, shall ensure that the National Customs Automation Program established pursuant to section 411 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1411">19 U.S.C. 1411</external-xref>) is compatible with the shipment profile plan developed under this section.</text></subsection></section> 
<section id="H77A07F9CE047414AA8B886C555F272E6"><enum>223.</enum><header>Inspection of merchandise at foreign facilities</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit to Congress a plan to—</text> 
<paragraph id="H4A9A008994B545B600B855EA56731B33"><enum>(1)</enum><text>station inspectors from the Directorate, other Federal agencies, or the private sector at the foreign facilities of manufacturers or common carriers to profile and inspect merchandise and the containers or other means by which such merchandise is transported as they are prepared for shipment on a vessel that will arrive at any port or place in the United States;</text></paragraph> 
<paragraph id="H9EA4E29CEC0C45DB9241B0127E064110"><enum>(2)</enum><text>develop procedures to ensure the security of merchandise inspected as described in paragraph (1) until it reaches the United States; and</text></paragraph> 
<paragraph id="H7E1212E21149448FABDAFB58EF891D6E"><enum>(3)</enum><text>permit merchandise inspected as described in paragraph (1) to receive expedited inspection upon arrival in the United States.</text></paragraph></section></subtitle> 
<subtitle id="H587660B3A42B4047A300C2A745391B74"><enum>D</enum><header>Security of seaports and containers</header> 
<section id="H29715875D09247A3A7E74FD3FE391D2F"><enum>231.</enum><header>Seaport security requirements</header> 
<subsection id="H2FBB38BE82CD40B6BF168E755200166F"><enum>(a)</enum><header>Requirement</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall issue final regulations setting forth minimum security requirements, including security performance standards for United States seaports. The regulations shall—</text> 
<paragraph id="H63F4FFA4FEA7432EB8FD05426EBAFB85"><enum>(1)</enum><text>limit private vehicle access to the terminal area of a United States seaport to vehicles that are registered at such seaport and display a seaport registration pass;</text></paragraph> 
<paragraph id="H363C0E686A344706AC1CB6C394B74BE"><enum>(2)</enum><text>prohibit individuals, other than law enforcement officers, from carrying firearms or explosives inside a United States seaport without written authorization from the Captain-of-the-Port;</text></paragraph> 
<paragraph id="H254972E1C7874D0DA16EB17D7549ADE1"><enum>(3)</enum><text>prohibit individuals from physically accessing the terminal area of a United States seaport without a seaport specific access pass;</text></paragraph> 
<paragraph id="H1678139B186B4D0591EA20F1C85ABC2"><enum>(4)</enum><text>require that officers of the Directorate, and other appropriate law enforcement officers, at United States seaports be provided with, and utilize, personal radiation detection pagers to increase the ability of such officers to accurately detect radioactive materials that could be used to commit terrorist acts in the United States;</text></paragraph> 
<paragraph id="H34D75DBB97024D2F94FCB2AFA22F503F"><enum>(5)</enum><text>require that the terminal area of each United States seaport be equipped with—</text> 
<subparagraph id="H1CBDFF87C77E44AEB05B87B6D44C92D6"><enum>(A)</enum><text>a secure perimeter;</text></subparagraph> 
<subparagraph id="H9EF11FFED27844A985F4E7E991A46489"><enum>(B)</enum><text>monitored or locked access points; and</text></subparagraph> 
<subparagraph id="HAF6660B845B9488192B92D8B16B10803"><enum>(C)</enum><text>sufficient lighting; and</text></subparagraph></paragraph> 
<paragraph id="HCE69E74477F240D0A8A0CB88BC901642"><enum>(6)</enum><text>include any additional security requirement that the Secretary determines is reasonably necessary to ensure seaport security.</text></paragraph></subsection> 
<subsection id="H65D492D912F44817BCF2DC63B92315E"><enum>(b)</enum><header>Limitation</header><text>Except as provided in subsection (c), any United States seaport that does not meet the minimum security requirements described in subsection (a) is prohibited from—</text> 
<paragraph id="H792C459103E54DB99BC0D661E7CCC8CD"><enum>(1)</enum><text>handling, storing, stowing, loading, discharging, or transporting dangerous cargo; and</text></paragraph> 
<paragraph id="H4E059F37F35645AA8FCCE305246DC3E"><enum>(2)</enum><text>transferring passengers to or from a passenger vessel that—</text> 
<subparagraph id="H415B875B7F43454C852C086480DBFFE1"><enum>(A)</enum><text>weighs more than 100 gross tons;</text></subparagraph> 
<subparagraph id="HC82F7B14EB174AA081E85979627E1BB4"><enum>(B)</enum><text>carries more than 12 passengers for hire; and</text></subparagraph> 
<subparagraph id="H4B40FC3DE84E47CEB9EF36FE34DA00D0"><enum>(C)</enum><text>has a planned voyage of more than 24 hours, part of which is on the high seas.</text></subparagraph></paragraph></subsection> 
<subsection id="H4F822AD59F7F4DB7BB36BBA406DF906"><enum>(c)</enum><header>Exception</header><text>The Secretary of Homeland Security may waive 1 or more of the minimum requirements described in subsection (a) for a United States seaport if the Secretary determines that it is not appropriate for such seaport to implement the requirement.</text></subsection></section> 
<section id="HA1DE68BA7FFC426494A94400E8129F7C"><enum>232.</enum><header>Seaport security cards</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70105">Section 70105</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="HEF89DC2AF5E24307B3CFD100A900999D"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> 
<quoted-block id="HF40A8A9117A040B488CF1917E6FA8B88"> 
<subsection id="H7D36CDBFA8A94018B432857531285EDD"><enum>(a)</enum><header>Prohibition</header> 
<paragraph display-inline="yes-display-inline" id="H5F9E56729193457BA72980E55EDFB9F9"><enum>(1)</enum><text>Unless the requirements of paragraph (2) are met, the Secretary shall prescribe regulations to prohibit—</text> 
<subparagraph indent="up1" id="H64882D598D3546068462B3C4A4E2B41"><enum>(A)</enum><text>an individual from entering an area of a vessel or facility that is designated as a secure area by the Secretary for purposes of a security plan for the vessel or facility that is approved by the Secretary under section 70103 of this title; and</text></subparagraph> 
<subparagraph indent="up1" id="H33AE2AD51A4D421093EC3C85C700FC64"><enum>(B)</enum><text>an individual who is regularly employed at a United States seaport or who is employed by a common carrier that transports merchandise to or from a United States seaport from entering a United States seaport.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HCA27F75115FE4CBA0026CF54AFA34603"><enum>(2)</enum><text>The prohibition imposed under paragraph (1) may not apply to—</text> 
<subparagraph id="H51BF11ABF8934CB39E00177185847089"><enum>(A)</enum><text>an individual who—</text> 
<clause id="HE5F6646BB49E41D980C1451DD5361FF8"><enum>(i)</enum><text>holds a transportation security card issued under this section; and</text></clause> 
<clause id="H0D9A9205EEBC4E1DB2686DBED040F73D"><enum>(ii)</enum><text>is authorized to be in area in accordance with the plan if the individual is attempting to enter an area of a vessel or facility that is designated as a secure area by the Secretary for purposes of a security plan for the vessel or facility approved by the Secretary under section 70103 of this title; or</text></clause></subparagraph> 
<subparagraph id="HE6CA0A99F2A747D9A6F6E46B650074B5"><enum>(B)</enum><text>an individual who is accompanied by another individual who may access the secure area or United States seaport in accordance with this section.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H7055BD360CC646F2B819BCFA9FFF49B9"><enum>(3)</enum><text>A person may not admit an individual into a United States seaport or a secure area unless the individual is in compliance with this subsection.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5CAB3C30546746D4866080301114639E"><enum>(2)</enum><text>in paragraph (2) of subsection (b)—</text> 
<subparagraph id="H351A6000554440219B07DF1FAB3C7932"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote>;</text></subparagraph> 
<subparagraph id="H77BDE04C74434E3496F3D3DA2C005667"><enum>(B)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></subparagraph> 
<subparagraph id="HD50A82D1A3D343608B7F136159C5F7F"><enum>(C)</enum><text>by inserting after subparagraph (E) the following new subparagraph:</text>

<subparagraph indent="up1" id="H25C461BDEB9A4B56844396874BCCFD3"><enum>(F)</enum><text>an individual who is regularly employed at a United States seaport or who is employed by a common carrier that transports merchandise to or from a United States seaport; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HAD23607790964F3CB62BFB70DCA8DF3"><enum>(3)</enum><text>in paragraph (1) of subsection (c)—</text> 
<subparagraph id="HD21FD80B029E4C0F96AB107300347632"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>or</quote>;</text></subparagraph> 
<subparagraph id="HDA26E188CD844067A15EC845A6C3074"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting a semicolon and <quote>or</quote>; and</text></subparagraph> 
<subparagraph id="H21AD062990FB43EA8733B725AB4E8E63"><enum>(C)</enum><text>at the end, by inserting the following new subparagraph:</text> 
<quoted-block id="HA95EBC9A63234D33B63552CF945E5BCC"> 
<subparagraph indent="up1" id="H3E15D8FB745341F595E24BE0C40048F3"><enum>(E)</enum><text>has not provided sufficient information to allow the Secretary to make the determinations described in subparagraph (A), (B), (C), or (D).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H154079CCC077419286B585E0C492C7FE"><enum>(4)</enum><text>by striking subsection (f); and</text></paragraph> 
<paragraph id="H04869C43F3B74C9EB8A2271CB8C0215B"><enum>(5)</enum><text>by inserting after subsection (e) the following new subsections:</text> 
<quoted-block id="HECCE24B46A2D4D67A7530067639D3C75"> 
<subsection id="H3E0C739F649840BD8D9FFD3B15557E80"><enum>(f)</enum><header>Data on cards</header><text>A transportation security card issued under this section shall—</text> 
<paragraph id="H3F2BAE025E5F48AE8B86FBF011D84419"><enum>(1)</enum><text>be tamper resistant; and</text></paragraph> 
<paragraph id="HEB6590E21D494F239BB7C139906EA72"><enum>(2)</enum><text>contain—</text> 
<subparagraph id="H1F1AC60C96F04E2C9462CA9778E032FF"><enum>(A)</enum><text>the number of the individual’s commercial driver’s license issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/313">chapter 313</external-xref> of title 49, if any;</text></subparagraph> 
<subparagraph id="H06319F36D29D493C9886962F369DB3B0"><enum>(B)</enum><text>the State-issued vehicle registration number of any vehicle that the individual desires to bring into the United States seaport, if any;</text></subparagraph> 
<subparagraph id="HB97F1A47F60F41458416DA97BA090019"><enum>(C)</enum><text>the work permit number issued to the individual, if any;</text></subparagraph> 
<subparagraph id="H9692AEF6900C430290B8B8E0B915D6E"><enum>(D)</enum><text>a unique biometric identifier to identify the license holder; and</text></subparagraph> 
<subparagraph id="HE1A304FAB6604D4E924563557D93C1F8"><enum>(E)</enum><text>a safety rating assigned to the individual by the Secretary of Homeland Security.</text></subparagraph></paragraph></subsection> 
<subsection id="HB61B7184710C4A03B551B3B5EB470935"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD315E42CCAEE459EB483F74FF34D00FD"><enum>(1)</enum><header>Alien</header><text>The term <term>alien</term> has the meaning given the term in section 101(a)(3) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(3)</external-xref>).</text></paragraph> 
<paragraph id="HFB035AA311544F8B00D1EA8CB98EBE25"><enum>(2)</enum><header>United States seaport</header><text>The term <term>United States seaport</term> means a place in the United States on a waterway with shoreside facilities for the intermodal transfer of cargo containers that are used in international trade.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H2B4F6167EEAC4244B49653EF00DA07AF"><enum>233.</enum><header>Securing sensitive information</header> 
<subsection id="H786C46B500B2439BA84EB5D410EC8479"><enum>(a)</enum><header>Requirement</header><text>Not later than 90 days after the date of enactment of this Act, the Captain-of-the-Port of each United States seaport shall secure and protect all sensitive information, including information that is currently available to the public, related to the seaport.</text></subsection> 
<subsection id="H65F35F380AAD46F89EA87E578D529B37"><enum>(b)</enum><header>Sensitive information</header><text>In this section, the term <term>sensitive information</term> means—</text> 
<paragraph id="H57E1CB48A7D6447AB256E1E73BE001E"><enum>(1)</enum><text>maps of the seaport;</text></paragraph> 
<paragraph id="HFEBF696222264BF8902913E664F4DE96"><enum>(2)</enum><text>blueprints of structures located within the seaport; and</text></paragraph> 
<paragraph id="H0107CDDC70A4478A00F6008643D996A4"><enum>(3)</enum><text>any other information related to the security of the seaport that the Captain-of-the-Port determines is appropriate to secure and protect.</text></paragraph></subsection></section> 
<section id="H1A6AE243C2834F2DBC67C998A4BFFCCB"><enum>234.</enum><header>Container security</header> 
<subsection id="H1EED2F216FF94100B173068D992612FC"><enum>(a)</enum><header>Container seals</header> 
<paragraph id="H98F8FC44F20A408E9B1DC03F46CBFC82"><enum>(1)</enum><header>Approval</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Homeland Security shall approve minimum standards for high security container seals that—</text> 
<subparagraph id="H42C8B9D82B31477F868F1898AE0600F7"><enum>(A)</enum><text>meet or exceed the American Society for Testing Materials Level D seals;</text></subparagraph> 
<subparagraph id="H5AABA54A719E4947806FD6B03DF4A890"><enum>(B)</enum><text>permit each seal to have a unique identification number; and</text></subparagraph> 
<subparagraph id="HA38DBB6D23AE442C94F6556F9D3B8E73"><enum>(C)</enum><text>contain an electronic tag that can be read electronically at a seaport.</text></subparagraph></paragraph> 
<paragraph id="H9B15C264516943B490714F073574ED57"><enum>(2)</enum><header>Requirement for use</header><text>Within 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall deny entry of a vessel into the United States if the containers carried by the vessel are not sealed with a high security container seal approved under paragraph (1).</text></paragraph></subsection> 
<subsection id="H1CAB7DAD3627413200B16693B6F0EE4"><enum>(b)</enum><header>Identification number</header> 
<paragraph id="H2FC78A1C9A304F2F979C1CD200CEEFE6"><enum>(1)</enum><header>Requirement</header><text>A shipment that is shipped to or from the United States either directly or via a foreign port shall have a designated universal transaction number.</text></paragraph> 
<paragraph id="H7ADD28DFBBA244C5B929355B63BB831C"><enum>(2)</enum><header>Tracking</header><text>The person responsible for the security of a container shall record the universal transaction number assigned to the shipment under paragraph (1), as well as any seal identification number on the container, at every port of entry and point at which the container is transferred from one conveyance to another conveyance.</text></paragraph></subsection> 
<subsection id="H1FB5659A7F114CB7AF10576ED2149920"><enum>(c)</enum><header>Pilot program</header> 
<paragraph id="H05A934B3F32141C590800260F1E16F90"><enum>(1)</enum><header>Grants</header><text>The Secretary of Homeland Security is authorized to award grants to eligible entities to develop an improved seal for cargo containers that—</text> 
<subparagraph id="H1DD2BC8487864A64B199655BC3218898"><enum>(A)</enum><text>permit the immediate detection of tampering with the seal;</text></subparagraph> 
<subparagraph id="H092A9D6D679A4481004E82AFDD8FDD20"><enum>(B)</enum><text>permit the immediate detection of tampering with the walls, ceiling, or floor of a container that indicates a person is attempting to improperly access the container; and</text></subparagraph> 
<subparagraph id="H092C7E66E1874B9F8294866C65351BAA"><enum>(C)</enum><text>transmit information regarding tampering with the seal, walls, ceiling, or floor of the container in real time to the appropriate authorities at a remote location.</text></subparagraph></paragraph> 
<paragraph id="H6D1DD93A3D50400FA392327DFE83AEB3"><enum>(2)</enum><header>Application</header><text>Each eligible entity seeking a grant under this subsection shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may reasonably require.</text></paragraph> 
<paragraph id="HFFBB5998C0404D94BDCCCFB08CE4AF21"><enum>(3)</enum><header>Eligible entity</header><text>In this subsection, the term <term>eligible entity</term> means any national laboratory, nonprofit private organization, institution of higher education, or other entity that the Secretary determines is eligible to receive a grant authorized by paragraph (1).</text></paragraph></subsection> 
<subsection id="H710E6587C9E94506B2003CD91B006BFB"><enum>(d)</enum><header>Empty containers</header> 
<paragraph id="HA6AA982AA487422799A867D60862807D"><enum>(1)</enum><header>Certification</header><text>The Secretary of Homeland Security shall prescribe in regulations requirements for certification of empty containers that are to be shipped to or from the United States either directly or via a foreign port. Such regulations shall require that an empty container—</text> 
<subparagraph id="H34433DE1C9084FDA9F2DCC572ED300B0"><enum>(A)</enum><text>be inspected and certified as empty prior to being loaded onto a vessel for transportation to a United States seaport; and</text></subparagraph> 
<subparagraph id="H55F179FCE02A46CC8C6CC9007C00352E"><enum>(B)</enum><text>be sealed with a high security container seal approved under subsection (a)(1) to enhance the security of United States seaports.</text></subparagraph></paragraph></subsection></section> 
<section id="HC148A53AF4E24EE2BB64E5448E103259"><enum>235.</enum><header>Office and inspection facilities</header> 
<subsection id="H981FA5D05FFD4BB8B322BD4C8D4B353E"><enum>(a)</enum><header>Operational space in seaports</header><text>Each entity that owns or operates a United States seaport that receives cargo from a foreign country, whether governmental, quasi-governmental, or private, shall provide to the Directorate permanent office and inspection space within the seaport that is sufficient for the Directorate officers at the seaport to carry out their responsibilities. Such office and inspection space—</text> 
<paragraph id="H1F938FABACFF43EB001B34F5334DA550"><enum>(1)</enum><text>shall be provided at no cost to the Directorate; and</text></paragraph> 
<paragraph id="H1C96ED4DF72C4B78AD9D5FD77479D15F"><enum>(2)</enum><text>may be located outside the terminal area of the seaport.</text></paragraph></subsection> 
<subsection id="HB1AFC0E889654CE880F3234EE270758C"><enum>(b)</enum><header>Inspection technology</header><text>The Secretary of Homeland Security shall maintain permanent inspection facilities that utilize available inspection technology in the space provided at each seaport pursuant to subsection (a).</text></subsection></section> 
<section id="H86BF49BBDF854C23B3EEB3B8CD08CF1"><enum>236.</enum><header>Security grants to seaports</header> 
<subsection id="H8AA503EC45154331A0D600F5E9268282"><enum>(a)</enum><header>Criteria for awarding grants</header><text>Notwithstanding any other provision of law, the Secretary of Homeland Security shall use the proportion of the containerized imports that are received at a United States seaport as a factor to be considered when determining whether to select that seaport for award of a competitive grant for security.</text></subsection> 
<subsection id="H64BE7E753BE0489FBA03507060E0AA32"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0A5FCB5C03A34DD9975F8937F42ED5CE"><enum>(1)</enum><header>Containerized imports</header><text>The term <term>containerized imports</term> means the number of twenty-foot equivalent units of containerized imports that enter the United States annually through a United States seaport as estimated by the Bureau of Transportation Statistics of the Department of Transportation.</text></paragraph> 
<paragraph id="H8F8D044512644D40B7003DA3F1D810D4"><enum>(2)</enum><header>Competitive grant for security</header><text>The term <term>competitive grant for security</term> means a grant of Federal financial assistance that the Secretary of Homeland Security is authorized to award to a United States seaport for the purpose of enhancing security at the seaport, including a grant of funds appropriated under the heading <quote><header-in-text level="section" style="traditional">Border and Transportation Security</header-in-text></quote> in title II of the Department of Homeland Security Appropriations Act, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/334">Public Law 108–334</external-xref>).</text></paragraph></subsection></section></subtitle></title>

<section id="HFC27A907BB8A43BD9CEEB9E3C32F39D"><enum>301.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Attorney General and the Secretary of Homeland Security such sums as are necessary to carry out this Act. Sums authorized to be appropriated under this section are authorized to remain available until expended.</text></section></title>
