<legis-type>A BILL</legis-type> 
<official-title>To amend the Haitian Refugee Immigration Fairness Act of 1998 to benefit individuals who were children when such Act was enacted.</official-title>

<section id="HCAD49C208F8A4AEA94F2997DCFB35E74" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HRIFA Improvement Act of 2005</short-title></quote>.</text></section> 
<section id="HDEF81B09F0504BF1996731F311F1B22E"><enum>2.</enum><header>Determinations with respect to children under the Haitian and Immigrant Fairness Act of 1998</header> <text display-inline="no-display-inline">Section 902(d) of the Haitian Refugee Immigration Fairness Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended by adding at the end the following:</text>

<paragraph id="HF1817F7D73F14D9284A3524299A6B0BD"><enum>(3)</enum><header>Determinations with respect to children</header> 
<subparagraph id="H64E5CF869821426AA6949B559C0006ED"><enum>(A)</enum><header>Use of application filing date</header><text>Determinations made under this subsection as to whether an individual is a child of a parent shall be made using the age and status of the individual on the date of the enactment of this section.</text></subparagraph> 
<subparagraph id="H98E7BF31E3E84CE0A2E9ACC32FEA6CB"><enum>(B)</enum><header>Application submission by parent</header><text>Notwithstanding paragraph (1)(C), an application under this subsection filed based on status as a child may be filed for the benefit of such child by a parent or guardian of the child, if the child is physically present in the United States on such filing date.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAA8431A92802444CBEDFD95BC1AEB100"><enum>3.</enum><header>New applications and motions to reopen</header> 
<subsection id="H4615C8D5615842E49F96456F95063857"><enum>(a)</enum><header>New applications</header><text>Notwithstanding section 902(a)(1)(A) of the Haitian and Immigrant Fairness Act of 1998, an alien who is eligible for adjustment of status under such Act, as amended by section 2 of this Act, may submit an application for adjustment of status under such Act not later than the later of—</text> 
<paragraph id="H82DDDA3DAA8A4660AF00D7AD09842F00"><enum>(1)</enum><text>2 years after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H27CADCDEDEA342219E1D073241BAC299"><enum>(2)</enum><text>1 year after the date on which final regulations implementing this Act are promulgated.</text></paragraph></subsection> 
<subsection id="H0BBC3FFE194146BB978955FDDAB21093"><enum>(b)</enum><header>Motions to reopen</header><text>The Secretary of Homeland Security shall establish procedures for the reopening and reconsideration of applications for adjustment of status under the Haitian Refugee Immigration Fairness Act of 1998 that are affected by the amendments under section 2 of this Act.</text></subsection> 
<subsection id="HBF22EE8AB35E4A15AD16A76D46FF774E"><enum>(c)</enum><header>Relationship of application to certain orders</header><text>Section 902(a)(3) of the Haitian and Immigrant Fairness Act of 1998 shall apply to an alien present in the United States who has been ordered excluded, deported, removed, or ordered to depart voluntarily, and who files an application under subsection (a), or a motion under subsection (b), in the same manner as such section 902(a)(3) applied to aliens filing applications for adjustment of status under such Act before April 1, 2000.</text></subsection></section>
