<official-title>To amend the Electronic Fund Transfer Act to prohibit any operator of an automated teller machine that displays any paid advertising from imposing any fee on a consumer for the use of that machine, and for other purposes.</official-title>

<section section-type="section-one" id="H2EA57F7EB0D240648215A2C016E469A7" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to Money (ATM) Act of 2005</short-title></quote>.</text></section> 
<section id="H191CFF8A884D4D74BB53657300A96C27"><enum>2.</enum><header>Prohibition on user fees for automated teller machines that carry paid advertising </header><text display-inline="no-display-inline">The <act-name parsable-cite="EFTA">Electronic Fund Transfer Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1693">15 U.S.C. 1693 et seq.</external-xref>) is amended—</text> 
<paragraph id="HE82EF6CB97354007AFD5129193922C5"><enum>(2)</enum><text>by redesignating sections 918, 919, 920, and 921 as sections 919, 920, 921, and 922, respectively; and</text></paragraph> 
<paragraph id="HFFDAA4B7139140C0BE07D12E21AE624B"><enum>(3)</enum><text>by inserting after section 917 the following new section:</text>

<section id="H20AF7FCA961441BC8447E0CE21ACC0DB"><enum>918.</enum><header>Fees</header> 
<subsection id="HAF96B27FCA644FDAB4418CE299982F3C"><enum>(a)</enum><header>In general</header><text>If an automated teller machine or other cash dispensing machine at which a consumer may initiate an electronic fund transfer displays any advertising on the screen of such machine, whether in the form of a banner or a trailer or in any other format, for which the operator of such machine has received any payment or other financial benefit, no fee may be imposed on the consumer with respect to such transaction by the operator of such machine, whether or not the consumer maintains an account with the operator.</text></subsection> 
<subsection id="H55BD01D9730A4FABBCD9611FC6E4DC"><enum>(b)</enum><header>Exception for direct advertising by the operator and public service announcements</header><text>Subsection (a) shall not apply with respect to—</text> 
<paragraph id="H2B626835F93A49C7A64707249800CA24"><enum>(1)</enum><text>advertising relating to products or services provided by the operator of an automated teller machine or cash dispensing machine referred to in such subsection or by any affiliate of such operator; or</text></paragraph> 
<paragraph id="H69993C8D57F640BB00BB2758F68221D9"><enum>(2)</enum><text>any public service announcement.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
