<section section-type="section-one" id="HD561BB284BA59AA5640CE8B53E6DB27"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Filipino Veterans Fairness Act</short-title></quote>.</text></section> 
<section id="H3F3F2A98B1D54EF08DBEF782A5A73C00"><enum>2.</enum><header>Eligibility of certain Filipino veterans for disability pension</header> 
<subsection id="HA59BC8420D7D4DE8B0A5E664DE68DAC"><enum>(a)</enum><header>Eligibility</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/107">Section 107</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H3B6AFC7E9B4B4B01B200D887F2D870C7"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H07C0D3DC2E9242519749A033D4004076"><enum>(A)</enum><text>in paragraph (3) of the first sentence, by inserting <quote>15,</quote> before <quote>23,</quote>; and</text></subparagraph> 
<subparagraph id="H23F9FA51639E4368BF61423D05493B7D"><enum>(B)</enum><text>in the second sentence, by striking <quote>subsection (c) or (d)</quote> and inserting <quote>subsections (c), (d), and (e)</quote> ; and</text></subparagraph></paragraph> 
<paragraph id="HAE05A5804EBA4C1C83D145D0560093E2"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="HBF77874E12174DA19F417EABF24213F1"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2) of the first sentence, by inserting <quote>15,</quote> before <quote>23,</quote>; and</text> </subparagraph> 
<subparagraph id="H50FA5FD607B54EFCB0FDF8B488E63E8C"><enum>(B)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>subsection (c) or (d)</quote> and inserting <quote>subsections (c), (d), and (e)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HB916EAFC6003489EBD3D1EFCB093E51"><enum>(b)</enum><header>Rate of payment</header><text>That section is further amended by adding at the end the following new subsection:</text>

<subsection id="H271EDFEDDD7949A8AB36CDE8437294B8"><enum>(e)</enum><text>In the case of benefits under chapter 15 of this title paid by reason of service described in subsection (a) or (b)—</text> 
<paragraph id="H1A46FE7A160B45D197608CF6B4338733"><enum>(1)</enum><text>if the benefits are paid to an individual residing in the United States who is a citizen of, or an alien lawfully admitted for permanent residence in, the United States, the second sentence of the applicable subsection shall not apply; and</text></paragraph> 
<paragraph id="HA1121A86FAB643878703EB2215BEAA4"><enum>(2)</enum><text>if the benefits are paid to an individual residing in the Republic of the Philippines, the benefits shall be paid (notwithstanding any other provision of law) at the rate of $100 per month.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDE045016CFE548B3B2B6DC98BE00DEF4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to benefits for months beginning on or after that date.</text></subsection></section> 
<section id="H22352375DC5A4A5D006056D9E3784DAC"><enum>3.</enum><header>Eligibility for vocational rehabilitation</header> 
<subsection id="H99017CA5F04B442BB0F536F5AED9FB59"><enum>(a)</enum><header>Eligibility</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/107">Section 107</external-xref> of title 38, United States Code, as amended by this Act, is further amended—</text> 
<paragraph id="H2DFF3BE07F954B68923481401BC3EEDA"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H4D3149AF197240DA9D609C9487E5B361"><enum>(A)</enum><text>in paragraph (3) of the first sentence—</text> 
<clause id="HB762CC9132A843828C38395C2C215E68"><enum>(i)</enum><text>by striking <quote>and</quote> before <quote>24</quote>; and</text></clause> 
<clause id="HE489EE96DBB24AE8BDD09183B196A400"><enum>(ii)</enum><text>by inserting <quote>, and chapter 31</quote> before <quote>of this title</quote>;</text></clause></subparagraph> 
<subparagraph id="HCAE0CE910916431DB3CDAB70CBC59F08"><enum>(B)</enum><text>in the second sentence, by striking <quote>and (e)</quote> and inserting <quote>(e), and (f)</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H62964B57B6DA4606BE445662F7C6A7A3"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H41440C7F81ED4280979C87CE4100FC32"><enum>(A)</enum><text>in paragraph (2) of the first sentence—</text> 
<clause id="H6B73635398F24680A1B5938706431FAA"><enum>(i)</enum><text>by striking <quote>and</quote> before <quote>24</quote>; and</text></clause> 
<clause id="HBFFBF93098BC4108B441C9009834EBA"><enum>(ii)</enum><text>by inserting <quote>, and chapter 31</quote> before <quote>of this title</quote>;</text></clause></subparagraph> 
<subparagraph id="HE504E98728854240BD7249D62231EBDF"><enum>(B)</enum><text>in the second sentence, by striking <quote>and (e)</quote> and inserting <quote>(e), and (f)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HBC2007C2D2824440AFDF3FACF22639F"><enum>(b)</enum><header>Rate of payment</header><text>That section is further amended by adding at the end the following new subsection:</text>

<subsection id="H1936975B31564DA1B2C6B2C7CBA6BC8C"><enum>(f)</enum><text>In the case of benefits under chapter 31 of this title paid by reason of service described in subsection (a) or (b), if the benefits are paid to an individual residing in the United States who is a citizen of, or an alien lawfully admitted for permanent residence in, the United States, the second sentence of the applicable subsection shall not apply.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0FEF9FD88A55448E894169281338FEDF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to benefits for months beginning on or after that date.</text></subsection></section> 
<section id="H98917C98A0594F2F86A7A6E6D9891737"><enum>4.</enum><header>Outpatient health care for veterans residing in the Philippines</header> 
<subsection id="HCB4AF53850884C95883743FBC0EBEE55"><enum>(a)</enum><header>In general</header><text>Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H7AB2580C919B4E1CA900D4E22C00C459"><enum>(1)</enum><text>by redesignating section 1735 as section 1736; and</text></paragraph> 
<paragraph id="HFBDC8CA08FCF4772A5FD172DF648349E"><enum>(2)</enum><text>by inserting after section 1734 the following new section 1735:</text>

<section id="HAF147FFA84B54379A28E9B434F9E4496"><enum>1735.</enum><header>Outpatient care and services for World War II veterans residing in the Philippines</header> 
<subsection id="H0B895B6DFECB4E8098A64120B032069D"><enum>(a)</enum><header>Outpatient health care</header><text>The Secretary shall furnish care and services to veterans of World War II, Commonwealth Army veterans, and new Philippine Scouts for the treatment of the service-connected disabilities and nonservice-connected disabilities of such veterans and scouts residing in the Republic of the Philippines on an outpatient basis at the Manila VA Outpatient Clinic.</text></subsection> 
<subsection id="H3BB97F5DF2C5489295E61BFAA1D69D0"><enum>(b)</enum><header>Limitations</header> 
<paragraph display-inline="yes-display-inline" id="HCDC55A6919E5407D81F06A8EABFF234"><enum>(1)</enum><text>The amount expended by the Secretary for the purpose of subsection (a) in any fiscal year may not exceed $500,000.</text></paragraph> 
<paragraph indent="up1" id="HA710DBD6FA8E470C95301400B4D89E4D"><enum>(2)</enum><text>The authority of the Secretary to furnish care and services under subsection (a) is effective in any fiscal year only to the extent that appropriations are available for that purpose.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H216DC8E7721E46B3A5C1206DD700BA39"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by striking the item relating to section 1735 and inserting the following new items:</text>

<section id="HB87951204F1E456EBB8DA6FA9E65A7AC"><enum>5.</enum><header>Eligibility for housing loans</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3701">Section 3701(b)</external-xref> of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H840B4137CB524F6A89D798C01302336"><enum>(6)</enum><text>The term <term>veteran</term> also includes an individual who is a Commonwealth Army veteran (as defined in subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/38/3566">section 3566</external-xref> of this title), or a new Philippine Scout (as defined in subsection (b) of such section) who resides in the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3FC03D77FFB04677A989D62785FFE49"><enum>6.</enum><header>Educational benefits for spouses and dependents</header> 
<subsection id="H3BC7FA3DAD834F9AA25FC600E9F50033"><enum>(a)</enum><header>Inclusion of spouses</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/3565">Section 3565(a)</external-xref> of title 38, United States Code, is amended to read as follows:</text> 
<quoted-block id="H2BDFA0BB04A140808C8296B2C2641C36"> 
<subsection id="H816DE2E8A5DD4D41AA8C4600B1ED00AE"><enum>(a)</enum><text>The term <term>eligible person</term> as used in <external-xref legal-doc="usc" parsable-cite="usc/38/3501">section 3501(a)(1)</external-xref> of this title includes the spouse, surviving spouse, and child of a Commonwealth Army veteran or a <quote>New</quote> Philippine Scouts in the same manner as a spouse, surviving spouse, and child of a person who meets the requirements of service-connected disability or death under such section, based on service as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/3566">section 3566</external-xref> of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE2FC87C13D2B4011AFB99A953566C00"><enum>(b)</enum><header>Increase in rates payable for dependents residing in the United States</header><text>Section 3565(b) of such title is amended—</text> 
<paragraph id="HA8C53463CF3447E9951500CDC4DB8127"><enum>(1)</enum><text>by striking <quote>children</quote> in the matter preceding paragraph (1) and inserting <quote>a spouse, surviving spouse, or child</quote>;</text></paragraph> 
<paragraph id="H45BDE273CC4B4DD9BC53F5EC4728F8C7"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></paragraph> 
<paragraph id="H93F70A0BBB7E47379588D72786B6CDDD"><enum>(3)</enum><text>in paragraph (1) by striking <quote>, and</quote> and inserting <quote>in the case of a spouse, surviving spouse, or child residing in the Philippines,</quote>; and</text></paragraph> 
<paragraph id="HC5F675C1DA68453BB873AD0DD6873D2"><enum>(4)</enum><text>by inserting after paragraph (1) the following new paragraph:</text>

<paragraph id="H52901922AC2B499BB6F12FD78780168"><enum>(2)</enum><text>notwithstanding section 3532(d) of this title, educational assistance allowances authorized by section 3532 of this title and the special training allowance authorized by section 3542 of this title shall be paid at the rate of $1.00 for each dollar in the case of a spouse, surviving spouse, or child residing in the United States, and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H59A80796B9584F1FB4F08FDED93B609"><enum>7.</enum><header>Eligibility for benefits for job counseling, training, and placement</header> 
<subsection id="H54F080B33A8040F8B17D004D3148D096"><enum>(a)</enum><header>Veterans</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/4101">Section 4101(4)</external-xref> of title 38, United States Code, is amended by inserting before the period the following: <quote>, and includes a Commonwealth Army veteran (as defined in subsection (a) of section 3566 of this title), or a new Philippine Scout (as defined in subsection (b) of such section)</quote>.</text></subsection> 
<subsection id="H790886177AB84DB5AA2073793BD87C99"><enum>(b)</enum><header>Dependents</header><text>Section 4104(5) of such title is amended—</text> 
<paragraph id="HC349CCA4CB7E42BBB8AF71EE7521A94F"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (B);</text></paragraph> 
<paragraph id="H49806E722F7140F19F3359C47BBE79A2"><enum>(2)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>, or</quote> and</text></paragraph> 
<paragraph id="H840734F70DEB43DABA398EC0200A129"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<section id="HF5B1BBFACE884E30A3274B5B6F91FB7D"><enum>8.</enum><header>Representation on Advisory Committee on Minority Veterans</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/544">Section 544(a)(2)</external-xref> of title 38, United States Code, is amended by adding at the end the following new subparagraph:</text>

<subparagraph indent="up2" id="HB27E8E34DC5746448E03FF09CC3168A1"><enum>(D)</enum><text>The Secretary shall ensure that at least one member of the Committee each year is a Commonwealth Army veteran (as defined in subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/38/3566">section 3566</external-xref> of this title), or a new Philippine Scout (as defined in subsection (b) of such section).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
