<section id="H5D72912094D341C083CBE927CF4CB743" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Reduction of engine idling of heavy-duty vehicles</header> 
<subsection id="HDCCA7949C21342BE9E6BE90066500596"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0539AB8D538B4E4D87D299318CEBAE86"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="H1F6A2609EA914346A7D019E791087351"><enum>(2)</enum><header>Advanced truck stop electrification system</header><text>The term <quote>advanced truck stop electrification system</quote> means a stationary system that delivers heat, air conditioning, electricity, and/or communications, and is capable of providing verifiable and auditable evidence of use of those services, to a heavy-duty vehicle and any occupants of the heavy-duty vehicle with or without relying on components mounted onboard the heavy-duty vehicle for delivery of those services.</text></paragraph> 
<paragraph id="H6F4E86CBFFD9404E80F412D8E0884D5F"><enum>(3)</enum><header>Auxiliary power unit</header><text>The term <quote>auxiliary power unit</quote> means an integrated system that—</text> 
<subparagraph id="HD1D72023B774494E91CCD87CCB3DC628"><enum>(A)</enum><text>provides heat, air conditioning, engine warming, or electricity to components on a heavy-duty vehicle as if the main drive engine of the heavy-duty vehicle were running; and</text></subparagraph> 
<subparagraph id="H4824B28D19F74E74A518D0D5D48FA3F"><enum>(B)</enum><text>is certified by the Administrator under part 89 of title 40, Code of Federal Regulations (or any successor regulation), as meeting applicable emission standards.</text></subparagraph></paragraph> 
<paragraph id="H665633B3EA2245A0A9C61B34F370B00"><enum>(4)</enum><header>Heavy-duty vehicle</header><text>The term <quote>heavy-duty vehicle</quote> means a vehicle that—</text> 
<subparagraph id="HEC37A20F9CF54CF39D6923D1DD9CBAD7"><enum>(A)</enum><text>has a gross vehicle weight rating greater than 8,500 pounds; and</text></subparagraph> 
<subparagraph id="HECED2666ED894CB1B3DAAD8DDBEBC92"><enum>(B)</enum><text>is powered by a diesel engine.</text></subparagraph></paragraph> 
<paragraph id="HFBFDBEA8A7D24E30A7C958D4D31D73D8"><enum>(5)</enum><header>Idle reduction technology</header><text>The term <quote>idle reduction technology</quote> means an advanced truck stop electrification system, auxiliary power unit, or other device or system of devices that—</text> 
<subparagraph id="HAD42185E37A54249A7CBBFA1523B6B9D"><enum>(A)</enum><text>is used to reduce long-duration idling of a heavy-duty vehicle; and</text></subparagraph> 
<subparagraph id="H3C2A796BF77B4D6580E45323682973C6"><enum>(B)</enum><text>allows for the main drive engine or auxiliary refrigeration engine of a heavy-duty vehicle to be shut down.</text></subparagraph></paragraph> 
<paragraph id="HCF31CA6B9F864A7687823673D9CCA934"><enum>(6)</enum><header>Energy conservation technology</header><text display-inline="yes-display-inline">the term <quote>energy conservation technology</quote> means any device, system of devices, or equipment that improves the fuel economy of a heavy-duty vehicle.</text></paragraph> 
<paragraph id="H82F0313A56054E62A0CCDB5CFB90E3B"><enum>(7)</enum><header>Long-duration idling</header> 
<subparagraph id="H7A371585F3F041C1A99D4F25174EE73B"><enum>(A)</enum><header>In general</header><text>The term <quote>long-duration idling</quote> means the operation of a main drive engine or auxiliary refrigeration engine of a heavy-duty vehicle, for a period greater than 15 consecutive minutes, at a time at which the main drive engine is not engaged in gear.</text></subparagraph> 
<subparagraph id="H042E6ACB6797415A9BF4592D5CECDFAB"><enum>(B)</enum><header>Exclusions</header><text>The term <quote>long-duration idling</quote> does not include the operation of a main drive engine or auxiliary refrigeration engine of a heavy-duty vehicle during a routine stoppage associated with traffic movement or congestion.</text></subparagraph></paragraph></subsection> 
<subsection id="H79A5C306777B49C985FBF6B14BAF9BF9"><enum>(b)</enum><header>Idle reduction technology benefits, programs, and studies</header> 
<paragraph id="H85D8137EBF1249658BBA9100326974C4"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator shall—</text> 
<subparagraph id="H9F4FDAA6422F437FA9C7A5CABBB447B"><enum>(A)</enum> 
<clause id="HAB56321B5EBE40AB902DEF35EE601B59" display-inline="yes-display-inline"><enum>(i)</enum><text>commence a review of the mobile source air emission models of the Environmental Protection Agency used under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) to determine whether the models accurately reflect the emissions resulting from long-duration idling of heavy-duty vehicles and other vehicles and engines; and</text></clause> 
<clause id="H1E28A47271BE4F8800BF7E9356BE749F" indent="up1"><enum>(ii)</enum><text>update those models as the Administrator determines to be appropriate; and</text></clause></subparagraph> 
<subparagraph id="HCD1ED8E6F4D74ECDB1A6921018E2B9F"><enum>(B)</enum> 
<clause id="HA8A0625CCBB24C07B7BB26A091BA46C" display-inline="yes-display-inline"><enum>(i)</enum><text>commence a review of the emission reductions achieved by the use of idle reduction technology; and</text></clause> 
<clause id="H7892CFE204BF4551A2044615C3E4F26E" indent="up1"><enum>(ii)</enum><text>complete such revisions of the regulations and guidance of the Environmental Protection Agency as the Administrator determines to be appropriate.</text></clause></subparagraph></paragraph> 
<paragraph id="H016A5766FCDA4C57BA6311A0C2479DB4"><enum>(2)</enum><header>Deadline for completion</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall—</text> 
<subparagraph id="HEBF5777E53FC44A39899A1D369DEE737"><enum>(A)</enum><text>complete the reviews under subparagraphs (A)(i) and (B)(i) of paragraph (1); and</text></subparagraph> 
<subparagraph id="H874A983FE2D245E18C648BA18623B7C1"><enum>(B)</enum><text>prepare and make publicly available 1 or more reports on the results of the reviews.</text></subparagraph></paragraph> 
<paragraph id="HD0E43A5BB2FC495EAD9F6F7700E76D12"><enum>(3)</enum><header>Discretionary inclusions</header><text>The reviews under subparagraphs (A)(i) and (B)(i) of paragraph (1) and the reports under paragraph (2)(B) may address the potential fuel savings resulting from use of idle reduction technology.</text></paragraph> 
<paragraph id="HDEB31FF527024C27A559877FB46C5549"><enum>(4)</enum><header>Idle reduction and energy conservation deployment program</header> 
<subparagraph id="H6EF1CD6EBFFB4235B9DE98CEF649766F"><enum>(A)</enum><header>Establishment</header> 
<clause id="H9802CDA527054258B522E28047907D00"><enum>(i)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator, in consultation with the Secretary of Transportation shall, through the Environmental Protection Agency’s SmartWay Transport Partnership, establish a program to support deployment of idle reduction and energy conservation technologies.</text></clause> 
<clause id="HF3F29E901FBD4095AB49CB53FFD5B0E3"><enum>(ii)</enum><header>Priority</header><text>The Administrator shall give priority to the deployment of idle reduction and energy conservation technologies based on the costs and beneficial effects on air quality and ability to lessen the emission of criteria air pollutants.</text></clause></subparagraph> 
<subparagraph id="H7FC8C7DBD0D74EC2815D9D8324CE2600"><enum>(B)</enum><header>Funding</header> 
<clause id="HDCE0FE6071684986873FB1EA057B34F0"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator to carry out subparagraph (A) $19,500,000 for fiscal year 2006, $30,000,000 for fiscal year 2007, and $45,000,000 for fiscal year 2008.</text></clause> 
<clause id="H4D82558CFFC34872BAF5EE335114E2D"><enum>(ii)</enum><header>Cost sharing</header><text>Subject to clause (iii), the Administrator shall require at least 50 percent of the costs directly and specifically related to any project under this section to be provided from non-Federal sources.</text></clause> 
<clause id="HD11CD7B3CB0543FA8C009C3B9D25D37"><enum>(iii)</enum><header>Necessary and appropriate reductions</header><text>The Administrator may reduce the non-Federal requirement under clause (ii) if the Administrator determines that the reduction is necessary and appropriate to meet the objectives of this section.</text></clause></subparagraph></paragraph> 
<paragraph id="H81F33596734B4E29B9F6B3473570F3DF"><enum>(5)</enum><header>Idling location study</header> 
<subparagraph id="H8BCF9226B87F478EB7C0F6CEC19D7074"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator, in consultation with the Secretary of Transportation, shall commence a study to analyze all locations at which heavy-duty vehicles stop for long-duration idling, including—</text> 
<clause id="HB98FBC0FA2C14D62A5756BE7AE004628"><enum>(i)</enum><text>truck stops;</text></clause> 
<clause id="H662936A1005B45DA95CE5FD234E7DA76"><enum>(ii)</enum><text>rest areas;</text></clause> 
<clause id="HAD54F5742F184163BF4DFC646DF6FBD9"><enum>(iii)</enum><text>border crossings;</text></clause> 
<clause id="HF0167950685847B2A2980240A6FF8884"><enum>(iv)</enum><text>ports;</text></clause> 
<clause id="H6E8BC373F42245FDAA33F7725C82EC12"><enum>(v)</enum><text>transfer facilities; and</text></clause> 
<clause id="HB7BFE8D5615043BE8F018EFE9CFE492D"><enum>(vi)</enum><text>private terminals.</text></clause></subparagraph> 
<subparagraph id="H0F4245CC8AD24A4399AADABE7D005E80"><enum>(B)</enum><header>Deadline for completion</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall—</text> 
<clause id="HCC8067279298400EA33036142C31B108"><enum>(i)</enum><text>complete the study under subparagraph (A); and</text></clause> 
<clause id="HB4EAEAB3251344BA8477AD06B31C9442"><enum>(ii)</enum><text>prepare and make publicly available 1 or more reports of the results of the study.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HDD634D2048BD4D7FA6D07BBC31978D62"><enum>(c)</enum><header>Vehicle weight exemption</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/127">Section 127(a)</external-xref> of title 23, United States Code, is amended—</text> 
<paragraph id="HAF39074BC75D446200769BCEF021AED"><enum>(1)</enum><text>by designating the first through eleventh sentences as paragraphs (1) through (11), respectively; and</text></paragraph> 
<paragraph id="HE5E22B34047C44C2A24C8175FE359436"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H42E48E41971F4447004F3C97C0003CC3" style="OLC"> 
<paragraph id="H2CF5DE724E604F3CA77DA9F6D34DBECE"><enum>(12)</enum><header>Heavy duty vehicles</header> 
<subparagraph id="HDE1FA162C920479D98F960B5000B221"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), in order to promote reduction of fuel use and emissions because of engine idling, the maximum gross vehicle weight limit and the axle weight limit for any heavy-duty vehicle equipped with an idle reduction technology shall be increased by a quantity necessary to compensate for the additional weight of the idle reduction system.</text></subparagraph> 
<subparagraph id="HCF34016218F14AE3BE02C5DF41DE2C04"><enum>(B)</enum><header>Maximum weight increase</header><text>The weight increase under subparagraph (A) shall be not greater than 400 pounds.</text></subparagraph> 
<subparagraph id="H13A2374409AD4367B5A4FC81E9438BE6"><enum>(C)</enum><header>Proof</header><text>On request by a regulatory agency or law enforcement agency, the vehicle operator shall provide proof (through demonstration or certification) that—</text> 
<clause id="H4507C8E145AF4B689E7623705CFA6E52"><enum>(i)</enum><text>the idle reduction technology is fully functional at all times; and</text></clause> 
<clause id="H90CF67D4EBEB494CB6CB44CB9556BBAC"><enum>(ii)</enum><text>the 400-pound gross weight increase is not used for any purpose other than the use of idle reduction technology described in subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEF5F10F7E88D4B8C8FD44E27B8045FD"><enum>(d)</enum><header>Report</header><text>Not later than 60 days after the date on which funds are initially awarded under this section, and on an annual basis thereafter, the Administrator shall submit to Congress a report containing—</text> 
<paragraph id="H1DAA7627BA334F2ABFDFEDE33F0047D9"><enum>(1)</enum><text>an identification of the grant recipients, a description of the projects to be funded and the amount of funding provided; and</text></paragraph> 
<paragraph id="HE10B47CB4E9B479F8300A880A0204723"><enum>(2)</enum><text>an identification of all other applicants that submitted applications under the program.</text></paragraph></subsection></section>
