<official-title>To modify the prohibition on recognition by United States courts of certain rights relating to certain marks, trade names, or commercial names.</official-title>

<section id="HC3B49EAF66944203009F89AAF2E60041" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Modification of prohibition</header><text display-inline="no-display-inline">Section 211 of the Department of Commerce and Related Agencies Appropriations Act, 1999 (as contained in section 101(b) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; 112 Stat. 2681–88) is amended—</text> 
<paragraph id="HC80986E7ADBB4CD8B8770061E68E9D81"><enum>(1)</enum><text>in subsection (a)(2)—</text> 
<subparagraph id="HBB63491226304C84A346DDDB8E1F88F4"><enum>(A)</enum><text>by striking <quote>by a designated national</quote>; and</text></subparagraph> 
<subparagraph id="H34E194DC543B4B258E00A8FC837A9BF"><enum>(B)</enum><text>by inserting before the period <quote>that was used in connection with a business or assets that were confiscated unless the original owner of the mark, trade name, or commercial name, or the bonafide successor-in-interest has expressly consented</quote>;</text></subparagraph></paragraph> 
<paragraph id="HFA737141D8704696928CAE295375B468"><enum>(2)</enum><text>in subsection (b), by striking <quote>by a designated national or its successor-in-interest</quote>;</text></paragraph> 
<paragraph id="HFF42EE9D022B490E913E20438BB437C2"><enum>(3)</enum><text>by redesignating subsection (d) as subsection (e);</text></paragraph> 
<paragraph id="HCC83DB0E76764D6F995E15A399717BF"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="H1E94522CB65C4E9B8639D38D921BE25F"><enum>(d)</enum><text>Subsections (a)(2) and (b) of this section shall apply only if the person or entity asserting the rights knew or had reason to know at the time when the person or entity acquired the rights asserted that the mark, trade name, or commercial name was the same as or substantially similar to a mark, trade name, or commercial name that was used in connection with a business or assets that were confiscated.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
