		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To amend the Fair Labor Standards Act of 1938 to provide
		  more effective remedies to victims of discrimination in the payment of wages on
		  the basis of sex, and for other purposes.</official-title>
	</form>
	<legis-body id="H0CA30887E16048BFA95B544E45CC093E" style="OLC">
		<section display-inline="no-display-inline" id="HE1F7AD324480477D9976DE941F0386F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Paycheck Fairness
			 Act</short-title></quote>.</text>
		</section><section id="H64AE19B81E7D41D78F8979C36BFF3084"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HF23FC2DC5ADA4B80B032C500F3F833DD"><enum>(1)</enum><text>Women have entered
			 the workforce in record numbers over the past 50 years.</text>
			</paragraph><paragraph id="H6C6D0123B4B348FA8FB5004BF513D3D3"><enum>(2)</enum><text>Even today, women
			 earn significantly lower pay than men for work on jobs that require equal
			 skill, effort, and responsibility and that are performed under similar working
			 conditions. These pay disparities exist in both the private and governmental
			 sectors. In many instances, the pay disparities can only be due to continued
			 intentional discrimination or the lingering effects of past
			 discrimination.</text>
			</paragraph><paragraph id="HF89A24FA19DA4FA6B8E5EE9EC77E111E"><enum>(3)</enum><text>The existence of
			 such pay disparities—</text>
				<subparagraph id="H727705633E624965B9F2C1BACCAD4FBB"><enum>(A)</enum><text>depresses the
			 wages of working families who rely on the wages of all members of the family to
			 make ends meet;</text>
				</subparagraph><subparagraph id="H3C4FA081DFDD4D4983A017C0DD495B1C"><enum>(B)</enum><text>undermines women's
			 retirement security, which is often based on earnings while in the
			 workforce;</text>
				</subparagraph><subparagraph id="H3251DD5BDCA1478E8D9735A700E3C2B0"><enum>(C)</enum><text>prevents the
			 optimum utilization of available labor resources;</text>
				</subparagraph><subparagraph id="HB9E807DAC706490CAA0129F5AAFC8332"><enum>(D)</enum><text>has been spread
			 and perpetuated, through commerce and the channels and instrumentalities of
			 commerce, among the workers of the several States;</text>
				</subparagraph><subparagraph id="HF05946BF821A4634B0CF4FB678EB1D62"><enum>(E)</enum><text>burdens commerce
			 and the free flow of goods in commerce;</text>
				</subparagraph><subparagraph id="H74351F122B074B0C86F52DDDFA25996"><enum>(F)</enum><text>constitutes an
			 unfair method of competition in commerce;</text>
				</subparagraph><subparagraph id="H6698A4D148E84F7A945E2FE7B45F8F17"><enum>(G)</enum><text>leads to labor
			 disputes burdening and obstructing commerce and the free flow of goods in
			 commerce;</text>
				</subparagraph><subparagraph id="HF1B8CDD5D1DE46F589DBC08506EBD5DB"><enum>(H)</enum><text>interferes with
			 the orderly and fair marketing of goods in commerce; and</text>
				</subparagraph><subparagraph id="H088FBE52678245D6AAE7425F5E8D616"><enum>(I)</enum><text>in many instances,
			 may deprive workers of equal protection on the basis of sex in violation of the
			 5th and 14th amendments.</text>
				</subparagraph></paragraph><paragraph id="HFC60AA0C564949F4844B7687583C668C"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3A7B52D10CE341F5910230D8ACAA2EF"><enum>(A)</enum><text>Artificial barriers to
			 the elimination of discrimination in the payment of wages on the basis of sex
			 continue to exist decades after the enactment of the Fair Labor Standards Act
			 of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) and the <act-name parsable-cite="CRA64">Civil
			 Rights Act of 1964</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>).</text>
				</subparagraph><subparagraph id="H8730B3B1F58F4F0BB72623C2A23B19C" indent="up1"><enum>(B)</enum><text>Elimination of such barriers would
			 have positive effects, including—</text>
					<clause id="HE98BE8333C4348C8AD008B58C973F2B"><enum>(i)</enum><text>providing a solution to problems in
			 the economy created by unfair pay disparities;</text>
					</clause><clause id="H8A4B2E98ACC7415A005B08D56DDEF4B6"><enum>(ii)</enum><text>substantially reducing the number
			 of working women earning unfairly low wages, thereby reducing the dependence on
			 public assistance;</text>
					</clause><clause id="HBFC179124B2F4D3CBC5E2FFAE2A2E79B"><enum>(iii)</enum><text>promoting stable families by
			 enabling all family members to earn a fair rate of pay;</text>
					</clause><clause id="H6BA7B92F9C1D441D00C51007C95316EA"><enum>(iv)</enum><text>remedying the effects of past
			 discrimination on the basis of sex and ensuring that in the future workers are
			 afforded equal protection on the basis of sex; and</text>
					</clause><clause id="H122372A53D524F2A80C7E5EF09EE174"><enum>(v)</enum><text>ensuring equal protection pursuant
			 to Congress’ power to enforce the 5th and 14th amendments.</text>
					</clause></subparagraph></paragraph><paragraph id="H6F3F554A8F094CA5936DEA8594DBFFD0"><enum>(5)</enum><text display-inline="yes-display-inline">The Department of Labor has important and
			 unique responsibilities to help ensure that women receive equal pay for doing
			 work that is substantially equal to men's work.</text>
			</paragraph><paragraph id="H7F0CC89575B842A1AB6F66D9718FD381"><enum>(6)</enum><text display-inline="yes-display-inline">The Department of Labor is responsible
			 for_</text>
				<subparagraph id="H12DFE0E40B9345CDAC64355379A39227"><enum>(A)</enum><text display-inline="yes-display-inline">collecting and making publicly available
			 information about women’s pay;</text>
				</subparagraph><subparagraph id="HE48973F5DAF44E46B8502BB93D1456FF"><enum>(B)</enum><text display-inline="yes-display-inline">ensuring that companies receiving Federal
			 contracts comply with anti-discrimination affirmative action requirements of
			 Executive Order 11246 (relating to equal employment opportunity);</text>
				</subparagraph><subparagraph id="HD9BF5708CDE34E01B832BBD991F56BE8"><enum>(C)</enum><text display-inline="yes-display-inline">disseminating information about women’s
			 rights in the workplace;</text>
				</subparagraph><subparagraph id="H4B5A44FE87044298BF915E1B69226DBF"><enum>(D)</enum><text display-inline="yes-display-inline">helping women who have been victims of pay
			 discrimination obtain a remedy; and</text>
				</subparagraph><subparagraph id="H2115ABAD33A8415F91F73B71F57F34E"><enum>(E)</enum><text>being proactive in
			 investigating and prosecuting equal pay violations, especially systemic
			 violations, and in enforcing all of its mandates.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD757A42687CA46F8B7629B4642FF4170"><enum>(7)</enum><text>With a stronger
			 commitment by the Department of Labor to its responsibilities, increased
			 information about the provisions added by the Equal Pay Act of 1963, wage data,
			 and more effective remedies, women will be better able to recognize and enforce
			 their rights.</text>
			</paragraph><paragraph id="H6C7E2E5D877F454A8B1DE376CC4CB82"><enum>(8)</enum><text>Certain employers
			 have already made great strides in eradicating unfair pay disparities in the
			 workplace and their achievements should be recognized.</text>
			</paragraph></section><section id="H09A53DDBD1B84619AA8759F0F16034F5"><enum>3.</enum><header>Enhanced
			 enforcement of equal pay requirements</header>
			<subsection id="H857A0F8EE1C841C6A4FE225FFA5D1F52"><enum>(a)</enum><header>Required
			 demonstration for affirmative defense</header><text>Section 6(d)(1) of the Fair
			 Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(d)(1)</external-xref>) is amended by striking
			 <quote>(iv) a differential</quote> and all that follows through the period and
			 inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="H39F16BDFD42A461194A005BE98C88ED" style="OLC">
					<text>(iv) a differential
			 based on a bona fide factor other than sex, such as education, training or
			 experience, except that the bona fide factor defense shall apply only
			 if—</text><subclause id="HA4FC959C6E484A2D93F331A7A0E9A8F0" indent="up3"><enum>(I)</enum><text>the employer demonstrates that—</text>
						<item id="H2BFA7EAE767F452A96AE1037C15BECC6"><enum>(aa)</enum><text>such factor—</text>
							<subitem id="H47BE8EE1913446B2A42CD667232B2450"><enum>(AA)</enum><text>is job-related with respect to the
				position in question; or</text>
							</subitem><subitem id="H9ABCB105EE2F4339A8EA05A55490AFE9"><enum>(BB)</enum><text>furthers a legitimate business purpose,
				except that this item shall not apply where the employee demonstrates that an
				alternative employment practice exists that would serve the same business
				purpose without producing such differential and that the employer has refused
				to adopt such alternative practice; and</text>
							</subitem></item><item id="HEDAE8BCC22D94D539C1076FFBD00004C"><enum>(bb)</enum><text>such factor was actually applied
				and used reasonably in light of the asserted justification; and</text>
						</item></subclause><subclause id="HC47DEFB1A14643CCA238D3AEE332FB18" indent="up3"><enum>(II)</enum><text>upon the employer succeeding under
				subclause (I), the employee fails to demonstrate that the differential produced
				by the reliance of the employer on such factor is itself the result of
				discrimination on the basis of sex by the employer.</text>
					</subclause><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">An
				employer that is not otherwise in compliance with this paragraph may not reduce
				the wages of any employee in order to achieve such compliance.</quoted-block-continuation-text><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection id="H7E8DDACF9CB24D48A2C140AA2188E945"><enum>(b)</enum><header>Application of
			 provisions</header><text>Section 6(d)(1) of the Fair Labor Standards Act of
			 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(d)(1)</external-xref>) is amended by adding at the end the following:
			 <quote>The provisions of this subsection shall apply to applicants for
			 employment if such applicants, upon employment by the employer, would be
			 subject to any provisions of this section.</quote>.</text>
			</subsection><subsection id="H358D277483284AD8B2785C7197E8C78"><enum>(c)</enum><header>Elimination of
			 establishment requirement</header><text>Section 6(d) of the Fair Labor
			 Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(d)</external-xref>) is amended—</text>
				<paragraph id="HA49920307FD9449FB63C10B5E755FA6C"><enum>(1)</enum><text>by striking
			 <quote>, within any establishment in which such employees are
			 employed,</quote>; and</text>
				</paragraph><paragraph id="H579D9EE92F7F4160AFCC1F006CB6ED2"><enum>(2)</enum><text>by
			 striking <quote>in such establishment</quote> each place it appears.</text>
				</paragraph></subsection><subsection id="HD1E38CEDD4604A04BC5DBB8FDFA45616"><enum>(d)</enum><header>Nonretaliation
			 provision</header><text>Section 15(a)(3) of the Fair Labor Standards Act of
			 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/215">29 U.S.C. 215(a)(3)</external-xref>) is amended—</text>
				<paragraph id="H4174A9AC85F349B19B88D641FAA5EB98"><enum>(1)</enum><text>by striking
			 <quote>or has</quote> each place it appears and inserting <quote>has</quote>;
			 and</text>
				</paragraph><paragraph id="HEDB5D9F464F24516B5E1BBF98C5B6B8"><enum>(2)</enum><text>by
			 inserting before the semicolon the following: <quote>, or has inquired about,
			 discussed, or otherwise disclosed the wages of the employee or another
			 employee, or because the employee (or applicant) has made a charge, testified,
			 assisted, or participated in any manner in an investigation, proceeding,
			 hearing, or action under section 6(d)</quote>.</text>
				</paragraph></subsection><subsection id="H7E041143DF374A1BBCE13987A057FBFE"><enum>(e)</enum><header>Enhanced
			 penalties</header><text>Section 16(b) of the Fair Labor Standards Act of 1938
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(b)</external-xref>) is amended—</text>
				<paragraph id="H28C06B53EE224694AA00967EEFAB36B7"><enum>(1)</enum><text>by inserting after
			 the first sentence the following: <quote>Any employer who violates section 6(d)
			 shall additionally be liable for such compensatory or punitive damages as may
			 be appropriate, except that the United States shall not be liable for punitive
			 damages.</quote>;</text>
				</paragraph><paragraph id="HFEFE41FE7BF347F181FD095F5419E46B"><enum>(2)</enum><text>in the sentence
			 beginning <quote>An action to</quote>, by striking <quote>either of the
			 preceding sentences</quote> and inserting <quote>any of the preceding sentences
			 of this subsection</quote>;</text>
				</paragraph><paragraph id="HA3C5AB834C5F4A09A615A63D77A0C73B"><enum>(3)</enum><text>in the sentence
			 beginning <quote>No employees shall</quote>, by striking <quote>No
			 employees</quote> and inserting <quote>Except with respect to class actions
			 brought to enforce section 6(d), no employee</quote>;</text>
				</paragraph><paragraph id="HDAB3CEF26F954B5D8949DEF12AFBD93"><enum>(4)</enum><text>by
			 inserting after the sentence referred to in paragraph (3), the following:
			 <quote>Notwithstanding any other provision of Federal law, any action brought
			 to enforce section 6(d) may be maintained as a class action as provided by the
			 Federal Rules of Civil Procedure.</quote>; and</text>
				</paragraph><paragraph id="H37EBA7E3B2A7490195C14E01D130555C"><enum>(5)</enum><text>in the sentence
			 beginning <quote>The court in</quote>—</text>
					<subparagraph id="HF92BAB52316B42DCBD4F875423FB00A6"><enum>(A)</enum><text>by striking
			 <quote>in such action</quote> and inserting <quote>in any action brought to
			 recover the liability prescribed in any of the preceding sentences of this
			 subsection</quote>; and</text>
					</subparagraph><subparagraph id="H983B56EFE7494AB0AD7129ED69A79D2"><enum>(B)</enum><text>by inserting before
			 the period the following: <quote>, including expert fees</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H2145CAA93B81477CAB3CDF376F1316D"><enum>(f)</enum><header>Action by
			 Secretary</header><text>Section 16(c) of the Fair Labor Standards Act of 1938
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(c)</external-xref>) is amended—</text>
				<paragraph id="H3826DF3820194BA9A0A3474CECB2DC9"><enum>(1)</enum><text>in
			 the first sentence—</text>
					<subparagraph id="H4D7CD56F49D04935B41C847CC0279BBD"><enum>(A)</enum><text>by inserting
			 <quote>or, in the case of a violation of section 6(d), additional compensatory
			 or punitive damages,</quote> before <quote>and the agreement</quote>;
			 and</text>
					</subparagraph><subparagraph id="H60F1ACE386794A7D975BA8E9E321407"><enum>(B)</enum><text>by inserting before
			 the period the following: <quote>, or such compensatory or punitive damages, as
			 appropriate</quote>;</text>
					</subparagraph></paragraph><paragraph id="H3F817F83B3A94FE9842F95E3CA35B634"><enum>(2)</enum><text>in the second
			 sentence, by inserting before the period the following: <quote>and, in the case
			 of a violation of section 6(d), additional compensatory or punitive
			 damages</quote>;</text>

					</subparagraph></paragraph></subsection></section><section id="HED7DDC86C9AE4D4C81647800F156C4DB"><enum>4.</enum><header>Training</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission
			 and the Office of Federal Contract Compliance Programs, subject to the
			 availability of funds appropriated under section 11, shall provide training to
			 Commission employees and affected individuals and entities on matters involving
			 discrimination in the payment of wages.</text>
		</section><section id="H20DFBE282CAA4BEA00B2BC2975CC6FC"><enum>5.</enum><header>Negotiation skills
			 training for girls and women</header>
			<subsection id="H0D84C2BB890A43D2B51080F76F6E29"><enum>(a)</enum><header>Program
			 authorized</header>
				<paragraph id="HA925D3DA81CC48939FC2E14D51ABA8CE"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor, after consultation with the
			 Secretary of Education, is authorized to establish and carry out a grant
			 program.</text>
				</paragraph><paragraph id="H20D49FFAB8904E70973561C3A720E6A"><enum>(2)</enum><header>Grants</header><text>In
			 carrying out the program, the Secretary of Labor may make grants on a
			 competitive basis to eligible entities, to carry out negotiation skills
			 training programs for girls and women.</text>
				</paragraph><paragraph id="H2B7E435B46F548B28DDC6F1AAC737CC"><enum>(3)</enum><header>Eligible
			 entities</header><text>To be eligible to receive a grant under this subsection,
			 an entity shall be a public agency, such as a State, a local government in a
			 metropolitan statistical area (as defined by the Office of Management and
			 Budget), a State educational agency, or a local educational agency, a private
			 nonprofit organization, or a community-based organization.</text>
				</paragraph><paragraph id="H16A9CDC65659447DA7A226602B427308"><enum>(4)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this subsection, an entity shall submit an
			 application to the Secretary of Labor at such time, in such manner, and
			 containing such information as the Secretary of Labor may require.</text>
				</paragraph><paragraph id="H3CBEBB966BC6457DB064C11F25E5F880"><enum>(5)</enum><header>Use of
			 funds</header><text>An entity that receives a grant under this subsection shall
			 use the funds made available through the grant to carry out an effective
			 negotiation skills training program that empowers girls and women. The training
			 provided through the program shall help girls and women strengthen their
			 negotiation skills to allow the girls and women to obtain higher salaries and
			 the best compensation packages possible for themselves.</text>
				</paragraph></subsection><subsection id="H1CF8F7C4CF02440B8B52C568A0F9B1CF"><enum>(b)</enum><header>Incorporating
			 training into existing programs</header><text>The Secretary of Labor and the
			 Secretary of Education shall issue regulations or policy guidance that provides
			 for integrating the negotiation skills training, to the extent practicable,
			 into programs authorized under—</text>
				<paragraph id="H417BD64040304D5CA926F61B65B4F120"><enum>(1)</enum><text>in the case of the
			 Secretary of Education, the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6301 et seq.), the Carl D. Perkins Vocational and Technical Education
			 Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>), the Higher Education Act of 1965 (20
			 U.S.C. 1001 et seq.), and other programs carried out by the Department of
			 Education that the Secretary of Education determines to be appropriate;
			 and</text>
				</paragraph><paragraph id="HFD5EFBF68226446FB8092C8F22D2D904"><enum>(2)</enum><text>in the case of the
			 Secretary of Labor, the Workforce Investment Act of 1998 (29 U.S.C. 2801 et
			 seq.), and other programs carried out by the Department of Labor that the
			 Secretary of Labor determines to be appropriate.</text>
				</paragraph></subsection><subsection id="HA89E37988B6543D2B728E2AAE97B548D"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and annually
			 thereafter, the Secretary of Labor and the Secretary of Education shall prepare
			 and submit to Congress a report describing the activities conducted under this
			 section.</text>
			</subsection></section><section id="HBAC4675E4A934A0C90C62BAEEE60C87C"><enum>6.</enum><header>Research,
			 education, and outreach</header><text display-inline="no-display-inline">The
			 Secretary of Labor shall conduct studies and provide information to employers,
			 labor organizations, and the general public concerning the means available to
			 eliminate pay disparities between men and women, including—</text>
			<paragraph id="H36F151D843244A7EA2831F62D31CBFC1"><enum>(1)</enum><text>conducting and
			 promoting research to develop the means to correct expeditiously the conditions
			 leading to the pay disparities;</text>
			</paragraph><paragraph id="H257D717032E74DA69E38F67CC25FAF95"><enum>(2)</enum><text>publishing and
			 otherwise making available to employers, labor organizations, professional
			 associations, educational institutions, the media, and the general public the
			 findings resulting from studies and other materials, relating to eliminating
			 the pay disparities;</text>
			</paragraph><paragraph id="H543BEDEB147B499F80F12BAF16F810FE"><enum>(3)</enum><text>sponsoring and
			 assisting State and community informational and educational programs;</text>
			</paragraph><paragraph id="H6BD6FF3BFAAD417E97526BAD68C69700"><enum>(4)</enum><text>providing
			 information to employers, labor organizations, professional associations, and
			 other interested persons on the means of eliminating the pay
			 disparities;</text>
			</paragraph><paragraph id="HEDAE4001FBC847B690999C098CD3EB00"><enum>(5)</enum><text>recognizing and
			 promoting the achievements of employers, labor organizations, and professional
			 associations that have worked to eliminate the pay disparities; and</text>
			</paragraph><paragraph id="H6B93EC33253E49E2B71B1D58347892A3"><enum>(6)</enum><text>convening a
			 national summit to discuss, and consider approaches for rectifying, the pay
			 disparities.</text>
			</paragraph></section><section id="H0E7CF41F49EE4F6194D7B67D44435687"><enum>7.</enum><header>Technical
			 assistance and employer recognition program</header>
			<subsection id="H52F69A81E1334F1E9FC448E704B70578"><enum>(a)</enum><header>Guidelines</header>
				<paragraph id="H606EE1FD0704438E8E0905AD5FCEAB"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor shall develop guidelines to enable
			 employers to evaluate job categories based on objective criteria such as
			 educational requirements, skill requirements, independence, working conditions,
			 and responsibility, including decisionmaking responsibility and de facto
			 supervisory responsibility.</text>
				</paragraph><paragraph id="HA969FD82BD5D4C7ABC00AE1E62FD978C"><enum>(2)</enum><header>Use</header><text>The
			 guidelines developed under paragraph (1) shall be designed to enable employers
			 voluntarily to compare wages paid for different jobs to determine if the pay
			 scales involved adequately and fairly reflect the educational requirements,
			 skill requirements, independence, working conditions, and responsibility for
			 each such job with the goal of eliminating unfair pay disparities between
			 occupations traditionally dominated by men or women.</text>
				</paragraph><paragraph id="HC7C12D85C56C4E85960089BB28A4D153"><enum>(3)</enum><header>Publication</header><text>The
			 guidelines shall be developed under paragraph (1) and published in the Federal
			 Register not later than 180 days after the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="H3E9CEF26C941486AB7FC93C1473E014B"><enum>(b)</enum><header>Employer
			 recognition</header>
				<paragraph id="H7678989634464B65A4333760C7B3E661"><enum>(1)</enum><header>Purpose</header><text>It
			 is the purpose of this subsection to emphasize the importance of, encourage the
			 improvement of, and recognize the excellence of employer efforts to pay wages
			 to women that reflect the real value of the contributions of such women to the
			 workplace.</text>
				</paragraph><paragraph id="H81F38E471F3F48B79BD1ABD5BEE9C326"><enum>(2)</enum><header>In
			 general</header><text>To carry out the purpose of this subsection, the
			 Secretary of Labor shall establish a program under which the Secretary shall
			 provide for the recognition of employers who, pursuant to a voluntary job
			 evaluation conducted by the employer, adjust their wage scales (such
			 adjustments shall not include the lowering of wages paid to men) using the
			 guidelines developed under subsection (a) to ensure that women are paid fairly
			 in comparison to men.</text>
				</paragraph><paragraph id="HF0F33D4B70924E9B83F9C06B74004BCC"><enum>(3)</enum><header>Technical
			 assistance</header><text>The Secretary of Labor may provide technical
			 assistance to assist an employer in carrying out an evaluation under paragraph
			 (2).</text>
				</paragraph></subsection><subsection id="HD7CE2517FC304515AA4D2F54C100A500"><enum>(c)</enum><header>Regulations</header><text>The
			 Secretary of Labor shall promulgate such rules and regulations as may be
			 necessary to carry out this section.</text>
			</subsection></section><section id="H8652849069C545A191F48E8CEAF8271D"><enum>8.</enum><header>Establishment of
			 the National Award for Pay Equity in the Workplace</header>
			<subsection id="H6A3EF62468B34B748000A11166F6E197"><enum>(a)</enum><header>In
			 general</header><text>There is established the Secretary of Labor’s National
			 Award for Pay Equity in the Workplace, which shall be evidenced by a medal
			 bearing the inscription <quote>Secretary of Labor’s National Award for Pay
			 Equity in the Workplace</quote>. The medal shall be of such design and
			 materials, and bear such additional inscriptions, as the Secretary of Labor may
			 prescribe.</text>
			</subsection><subsection id="H25A336F2F68F46C5A6E7B78FFBF825C5"><enum>(b)</enum><header>Criteria for
			 qualification</header><text>To qualify to receive an award under this section a
			 business shall—</text>
				<paragraph id="H471B0270A785455EB62BC4A21ED4E600"><enum>(1)</enum><text>submit a written
			 application to the Secretary of Labor, at such time, in such manner, and
			 containing such information as the Secretary may require, including at a
			 minimum information that demonstrates that the business has made substantial
			 effort to eliminate pay disparities between men and women, and deserves special
			 recognition as a consequence; and</text>
				</paragraph><paragraph id="H58996C9ED9D545A5B2D77D2809BAD788"><enum>(2)</enum><text>meet such
			 additional requirements and specifications as the Secretary of Labor determines
			 to be appropriate.</text>
				</paragraph></subsection><subsection id="H1735754A028848A9AA52A067D205BCED"><enum>(c)</enum><header>Making and
			 presentation of award</header>
				<paragraph id="H832CD5DF65CB46AEA882970095F24CA6"><enum>(1)</enum><header>Award</header><text>After
			 receiving recommendations from the Secretary of Labor, the President or the
			 designated representative of the President shall annually present the award
			 described in subsection (a) to businesses that meet the qualifications
			 described in subsection (b).</text>
				</paragraph><paragraph id="HB8160216079243639113B159A29349B0"><enum>(2)</enum><header>Presentation</header><text>The
			 President or the designated representative of the President shall present the
			 award under this section with such ceremonies as the President or the
			 designated representative of the President may determine to be
			 appropriate.</text>
				</paragraph></subsection><subsection id="H75FE43C769144AB8AC916ED5D042DA4"><enum>(d)</enum><header>Business</header><text>In
			 this section, the term <term>business</term> includes—</text>
				<paragraph id="HFDDCBBC6F15D472D80CEAB5C23EC5575"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB9E8C36FE2F5461A971B6648BEB9B235"><enum>(A)</enum><text>a corporation, including
			 a nonprofit corporation;</text>
					</subparagraph><subparagraph id="H53EBD46285924A129164A1B12FF958" indent="up1"><enum>(B)</enum><text>a partnership;</text>
					</subparagraph><subparagraph id="H4A1968252E584B43BFE5EE80CECAAC54" indent="up1"><enum>(C)</enum><text>a professional association;</text>
					</subparagraph><subparagraph id="HD49CC985A5E042FF8DA4403ED7707193" indent="up1"><enum>(D)</enum><text>a labor organization; and</text>
					</subparagraph><subparagraph id="H6F785276476248EF9391A17D42743610" indent="up1"><enum>(E)</enum><text>a business entity similar to an entity
			 described in any of subparagraphs (A) through (D);</text>
					</subparagraph></paragraph><paragraph id="H40780FD735CE462B8F22114FFCAEBBD1"><enum>(2)</enum><text>an entity carrying
			 out an education referral program, a training program, such as an
			 apprenticeship or management training program, or a similar program; and</text>
				</paragraph><paragraph id="H9AADF6C8025A480E80558400EA7DBED9"><enum>(3)</enum><text>an entity carrying
			 out a joint program, formed by a combination of any entities described in
			 paragraph (1) or (2).</text>
				</paragraph></subsection></section><section id="H69D16E0AE90048E59093F9812BD21E61"><enum>9.</enum><header>Collection of pay
			 information by the equal employment opportunity Commission</header><text display-inline="no-display-inline">Section 709 of the
			 <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (42 U.S.C.
			 2000e–8) is amended by adding at the end the following:</text>
			<quoted-block act-name="Civil Rights Act of 1964" id="HB0D35072185449ADA0008CB6F9B5F73">
				<subsection id="H15BB1ACB7E01476B830011D6C265498"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HBD1E22B394D24FEBAC31959848B25286"><enum>(1)</enum><text>Not later than 18 months
				after the date of enactment of this subsection, the Commission shall—</text>
						<subparagraph id="H8E424297214246B3A6D37FE9CBC38D3C" indent="up1"><enum>(A)</enum><text>complete a survey of the data that is
				currently available to the Federal Government relating to employee pay
				information for use in the enforcement of Federal laws prohibiting pay
				discrimination and, in consultation with other relevant Federal agencies,
				identify additional data collections that will enhance the enforcement of such
				laws; and</text>
						</subparagraph><subparagraph id="H4D7CAED573174E1EBC13D026003FD811" indent="up1"><enum>(B)</enum><text>based on the results of the survey and
				consultations under subparagraph (A), issue regulations to provide for the
				collection of pay information data from employers as described by the sex,
				race, and national origin of employees.</text>
						</subparagraph></paragraph><paragraph id="H49CACFE987A04068BCFB5D7D1FC1A340" indent="up1"><enum>(2)</enum><text>In implementing paragraph (1), the
				Commission shall have as its primary consideration the most effective and
				efficient means for enhancing the enforcement of Federal laws prohibiting pay
				discrimination. For this purpose, the Commission shall consider factors
				including the imposition of burdens on employers, the frequency of required
				reports (including which employers should be required to prepare reports),
				appropriate protections for maintaining data confidentiality, and the most
				effective format for the data collection
				reports.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB382FA28CC3A499FA116CA70EC1602B1"><enum>10.</enum><header>Reinstatement of
			 pay equity programs and pay equity data collection</header>
			<subsection id="HC2950D67193F4A7D84343C16C6DDF53"><enum>(a)</enum><header>Bureau of Labor
			 Statistics data collection</header><text>The Commissioner of Labor Statistics
			 shall collect data on women workers in the Current Employment Statistics
			 survey.</text>
			</subsection><subsection id="H7B27F38620A649CBBFE912D9002E1DCF"><enum>(b)</enum><header>Office of
			 Federal Contract Compliance Programs initiatives</header>
				<paragraph id="H7288DD11EE4C4915ACF1AA6497850074"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of Federal Contract Compliance
			 Programs shall ensure that employees of the Office—</text>
					<subparagraph id="HEA936DE07BF543FCB7ADC063A925F082"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HB1737483120444FBB9C7A3AFC089B249"><enum>(i)</enum><text>shall use the full range
			 of investigatory tools at the Office's disposal, including pay grade
			 methodology;</text>
						</clause><clause id="H0B4C3506F3DE47B6A1A9B9176B6B9540" indent="up1"><enum>(ii)</enum><text>in considering evidence of
			 possible compensation discrimination—</text>
							<subclause id="H1E8ED6094E7144C99300E6E3E7A7BC5D"><enum>(I)</enum><text>shall not limit its consideration to a
			 small number of types of evidence; and</text>
							</subclause><subclause id="H8420697E3DA948058900FDAA069BB958"><enum>(II)</enum><text>shall not limit its evaluation of the
			 evidence to a small number of methods of evaluating the evidence; and</text>
							</subclause></clause><clause id="H8D08886A661A4942B672FF68EBDF5055" indent="up1"><enum>(iii)</enum><text>shall not require a multiple
			 regression analysis or anecdotal evidence for a compensation discrimination
			 case;</text>
						</clause></subparagraph><subparagraph id="H409CAE5BBA334F25809EB8B09B9C931D"><enum>(B)</enum><text>for purposes of
			 its investigative, compliance, and enforcement activities, shall define
			 <term>similarly situated employees</term> in a way that is consistent with and
			 not more stringent than the definition provided in item 1 of subsection A of
			 section 10–III of the Equal Employment Opportunity Commission Compliance Manual
			 (2000), and shall consider only factors that the Office's investigation reveals
			 were used in making compensation decisions; and</text>
					</subparagraph><subparagraph id="HA79C761F4A8044FA9904FC6285F00095"><enum>(C)</enum><text>shall designate
			 not less than half of all nonconstruction contractor establishments each year
			 to prepare and file the Equal Opportunity Survey, required by section 60–2.18
			 of title 41, Code of Federal Regulations, and shall review and utilize the
			 responses to the survey to identify contractor establishments for further
			 evaluation.</text>
					</subparagraph></paragraph><paragraph id="H9BFDB1888E554E8FB7CA1F1BAC57664"><enum>(2)</enum><header>Regulations</header><text>In
			 promulgating any regulations with respect to the compensation discrimination
			 cases, the Secretary of Labor, in establishing standards for similarly situated
			 employees, shall include examples of similar jobs.</text>
				</paragraph></subsection><subsection id="H65D7A357D031464D89A32F9CECE9EE06"><enum>(c)</enum><header>Department of
			 Labor distribution of wage discrimination information</header><text>The
			 Secretary of Labor shall make readily available (in print, on the Department of
			 Labor website, and through any other forum that the Department may use to
			 distribute compensation discrimination information), accurate information on
			 compensation discrimination, including statistics, explanations of employee
			 rights, historical analyses of such discrimination, instructions for employers
			 on compliance, and any other information that will assist the public in
			 understanding and addressing such discrimination.</text>
			</subsection></section><section id="HEA87CC312DF745D295D74B9872397593"><enum>11.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act.</text>
